Los Angeles police are still deciding whether to pursue charges against a woman who allegedly used pepper spray while shopping at a Walmart Thanksgiving night in Porter Ranch, according to a report in the Los Angeles Times.
"We have a ton of witnesses and victims to interview," Los Angeles Police Officer Bruce Borihanh told the newspaper. "We know who she is."
The woman turned herself in Friday night after the incident allegedly caused minor injuries to 20 shoppers, including children. She was released pending further investigation after she refused to discuss the incident, police said Saturday.
The woman's identity was not released.
The alleged attack took place about 10:20 p.m. Thursday, shortly after doors opened for shopping. Employees brought out a crate of discounted Xbox video game players, and a crowd formed to wait for the unwrapping. Valle said the woman began spraying people in order to get an advantage.
Wal-Mart officials called it "an unfortunate situation."


Judges really need to be allowed more creativity in sentencing people like this. The proper sentence would be to force her to donate that xbox or whatever it was to a charity for needy children and tell her she's never allowed to shop on the friday after thanksgiving, not even for a gallon of milk since she's apparently too stupid to handle the responsibility of acting like a reasonable adult if there's a massive sale.

Then as a side note, she has to turn herself in at the police station on black friday for the next 10 years where she gets peper spray in the face.

Sorry, but both you and Robert are wrong. She did say pepper spray was a derivative of pepper and was a food product, but she never said it was for table use, or even implied it was harmless. Her comment was in response to what it was, not how it was used. And her comment was entirely true, though not entirely complete--when is a news segment ever complete?
In any case, she was completely truthful, and neither of you are, yet you, mike, would argue Fox News is the fake news, for that is what "faux" means. I think in the story about Fox the real worry was what you completely missed (making my case for me better than anything that you are likely a dullard). It was O'Reilley's position that we should not second guess the cops. We should, and we always should. But this doesn't mean they were wrong in any way to pepper spray those people, just that we should consider what was done in the context of doing it and see if the cops went too far.
And from all of this is the more troubling problem as I see it, though it's nothing new. You want the news presented to you in a way that comports with your reality and your biases. And so a completely truthful comment is taken out of context by you to disparage someone, or something, you disagree with. Learned people call it demagoguery. You simply call it a condiment.
I wonder if she might have some sort of claustrophobia and/or just panicked. The story is different in the media than was originally reported.
She absolutely should be charged and yes, under instances like this, judges should be creative with their sentencing. If you can't act like an adult you get your 'toys' taken away. If she had some sort of claustrophobia then she had no business putting herself in a situation on Black Friday....the one day most people come out in droves in the morning hours. Mike the Vet, you are still taking out of context. Kelly was asked if she knew what pepper spray was made of. Her answer was correct, if limited. Pepper is used, with several processes and additions. Military and police spray is much more potent. There are peppers out there which have a rating over 4,000 untreated. Google it.

I know that retailers make a huge chunk of their annual revenue during the holiday shopping season, but it seems to me that the cultural price we pay is too high. We are made to feel pressured into going out in the middle of the night (on a holiday that everyone, no matter what religion, can celebrate with family and friends) to buy things we don't need and can't afford. Is not the holiday itself and the time spent with our loved ones more important than consumerism? Some stores will be open on Christmas Day, which means some people will have to leave their kids at home and go to work on Christmas.
How many people will be out shopping this holiday season, maxing out their credit cards on over-priced stuff they don't need? Watch Hoarders on TV and you'll get an idea of the sickness and greed that seems to be more and more pervasive in our society.

...and this is why I don't shop at Walmart (or anywhere else on Black Friday). It's completely ludicrous to make store employees cut their Thanksgiving holiday short and work all night on Thanksgiving. Why not go back to a reasonable opening hour (like 6 AM) on Black Friday? Would shoppers actually care if they couldn't start their Christmas shopping until the morning after Thanksgiving? What point is there in adding 6 or 8 hours onto the beginning of the Christmas shopping season if it results in incidents like this?
Walmart sells over-priced, low quality foreign-made merchandise. They have a history of hiring undocumented workers and treating their employees unfairly. So many of their customers have no manners and no respect for anyone else. Why anyone shops there is really beyond me.

I don't understand the pervasive concept you display of forcing others to heel to your demands. And I think WalMart's massive success indicates that shoppers get what they want at a price they are willing to pay. Maybe this isn't how you see the company, but the fact that it is so large and profitable belies your opinion.
About the only thing I agree with you on is that this woman seems to have committed an assault. If that investigation plays out that way then you bet, charge her, but can't we wait until a trial is conducted to convict her?

C123 it is clear that based on media reports this woman is guilty. It is clear that all the people who have read this article are now judge, jury and executioner. The fact that the police have to do an investigation and give this woman her due process must make her a family member to somebody in law enforcement, and not just an average person. They clearly don't understand that under the law this attack was a misdemeanor not committed in the presence of a police officer, and therefore they can't arrest her. Now they have to collect evidence, write a report and then submit it to the DA's office for her to be charged. I am shocked that people are so ignorant to how laws are actually investigated and applied.

I do not agree with all Wal-mart's policies. It has been proven in the past that Wal-mart made age and sex discrimination a standard company policy. I also have no doubt that if they are able to force competition in any given area out of business, that they immediately gouge prices for the maximum amount of profit. However, they are usually one of the largest employers in many of the small communities they serve. The general merchandise stock is usually overall much cheaper than local competition, at least as long as the competition can compete.
I do all my shopping at Wal-mart. Since I do not like to shop anywhere and cannot tolerate large crowds, it is convenient for me to shop at a store where I can get everything from groceries to pharmacy items in one location. My oldest son is employed by them. Admittedly he doesn't make a fortune, but it was his choice to drop out of school and accept menial work.
That being said. The visit I made to Wal-mart Friday before last when I did my weekly grocery shopping will be my last trip there until after the after-Christmas sales. I will do my shopping at the local Kroger, which, while more expensive, does not suffer from the crowd level.
I am appalled by what I see our nation has been reduced to in my lifetime. Shoppers attacking each other over a few dollars and shoppers stepping over the dead bodies of other shoppers because someone else might get that "bargain" they are there for if they stop to render aid are only the most recent examples of how selfish this nation has become. I remember an interview Arnold Swarzenegger (spelling) did about how within a week of landing in the United States with only his clothes he had everything he needed to set up house because of the charity of everyone he met. Walmart stores aren't bad during the Christmas holidays if you go early in the day. Ours don't get crazy until the kids get out of school and people start getting off work. The absolute worst time to go is after suppertime and up to about one or two o'clock in the morning. I've made a couple of late night runs, and I'm amazed at the number of people in the stores a midnight or later. Lol, I made a three a.m. run into Walmart a while back to buy an emergency plunger (nothing else would have gotten me in there at that hour), and the place was practically deserted.
I don't know about elsewhere, but our Walmart stores don't appear to discriminate by age. I see older men and women both working there, and I feel sorry for them because I wish they could be at home relaxing. I'm sure most of them wouldn't have jobs at all if they weren't working in a place like Walmart. And our stores hire some young people who took special education classes all the way through school. I see several of them most afternoons when I go into the store, and they seem to be smiling and content enough. There aren't enough jobs in this county to hire all the able bodied, let alone the special needs people. I shop at Walmart a lot too, and I know they do a lot of bad things, but I can't complain about what I see in our stores.
I loathe Walmart. I hope that karma will do bad things to the Walton family for what it's done. Do I shop there? Maybe I got three times a year when I'm desperate and have no other choice (and Walmart sees to it that people have no other choice - so much for capitalism). But when I do, I expect Walmart to give me absolute perfection at my standards. I bought a nine-dollar watch there and found the instructions too difficult to follow to set it. If I wanted to, I could do it, but why should I? I expect perfection. That's what I paid for. I took the watch back and stated that it was too difficult to program. I should be able to do it in one step; that's what I paid Walmart for. I got my money back and bought another watch a block away from a local place. It cost (on sale) a buck more. I could program it in one step. Oh, and the watch I bought locally was made in America. The Walmart one (and it was their brand) was made by communists in China. May karma strike the Walton family soon, very soon. I want to revel in watching it suffer for supporting and promoting communism.

California does not apply assault and battery as one crime. Assault is PC 240 which is the attempt coupled with the present capability to use unlawful force on another.
Battery is PC 242 which is the unlawful use of force upon another. Since PC 242 was completed, there will be no assault charges filed. The term "assault and battery" is a major misnomer made popular by TV.

Everyone who ventures out on Thanksgiving night and early morning on black Friday is responsible for this mentality. Shoppers pepper sprayed in this story. Another person is shot outside of another Wal-Mart. One man collapses at a Target and shoppers step over him. It's this need for some deal we think we are going to get on mostly junk that will end up in a landfill by the next black Friday anyway. Not every person waiting in some long line for black Friday openings was party to these situations, but every person camping out for a toy or some $200 TV is responsible for contributing to this mentality.

I hope that's sarcasm. Walmart didn't put anyone's children anywhere. The parents chose to bring their kids shopping with them on a day that everyone knows can get dangerous. It's not Walmart's fault that parents who make bad choices decide to shop at their store. Walmart can't tell people they can't bring their kids in the store.

Historically Walmart has had issues in their stores on these dates. So by continuing to feed the problem I feel to a point they are quite responsible. They could easily spread these sales out over the course of a week rather than a few hours and help the problem. However people SHOULD be able to use self control and should also be held accountable.

It's assault pure and simple. She wasn't defending herself or others. She did it for greed, pure and simple. If the LA police and DA don't press charges, it would be a miscarriage of justice.

We haven't heard the whole story, there may be more to it. Maybe she was being assaulted in the crowd, maybe it was an accident. It sure wouldn't have happened to me, I was home that day, to many crazies out there.
What more to the story could there be? She feared for her life? She was scared these people would attack her? Nice try, but the story is simple. She wanted said item, and she used whatever means possible to get it. It's just an item. The woman is a criminal, and has no respect for her fellow human beings. Everyone there had children they wanted to buy this item for. Lack of empathy for other people. Bottom line, this was about greed.

Its a misdemeanor and in California you can't be arrested for a misdemeanor that was not committed in the presence of a police officer. Police file a complaint the DA files charges. So, the police are not "Mulling" about charging her, the are "mulling" about what penal code violation to include in their complaint to the DA's office.

It was simple assault on some 20 people. She'll get community service and a rash of civil suits for damages and pain and suffering.
She could put a badge on and all would be considered legal. Our police have shown it is a reasonable response to crowds. Why can`t citizens then use it? It is non-lethal in the the police vernacular. All weekend we have heard stories of how fellow citizens are ripping items from others hands in the stores to claim for themselves....injuring others in the process. She was merely protecting her person. Aren`t we all supposed to be about protecting personhoods from the initial merger of two cells. Well, she was a full grown person...... we should all be about protecting her.

If it is safe to use, why should she be arrested? If police officers can use indiscriminately, why can't ordinary citizens? I would have punched them out as well besides spraying their faces. That is the part she left out. I would have sliced and diced their faces as well.

I am betting that this woman saw FOX news talk about the UC Davis students who got pepper-sprayed. Fox said "It's just a food product" and insanely argued on behalf of the officer who sprayed the students. My guess is that the woman saw this, and said "What the hell? Although I agree that she should be punished to the fullest extent of the law, these retailers MUST be held responsible for pepetuating this type of mob mentality. Maybe when Walmart and stores like them start feeling the lint in their pockets they will change some of their approach. There is absolutely no reason for this type of behavior whether it be during the holidays or not. Clearly no one gives a hoot about the meaning of Thanksgiving or Christmas, that horse has been beaten to death already. Time for people to stand up for what is right and have a little human decency.
I understand the need for fair prices, I am not a rich woman, far from it, but I do not patronize these types of establishments. I believe in paying for quality, not quantity, fair treatment of employees, and shopping in an environment where I won't fear for my life or my familys'. Every little bit helps and if people band together (like they do on Thanksgiving night waiting for one of 3 TVS) maybe we can really make a difference.
There is such a thing as crowd control. In the past, retailers with a sense of responsibility have only allowed a certain amount of people into the store at a time for these ginormous special sales. If a musical act can be personally sued when bleachers or a stage collapses, then the retailer can, and should, have some responsibility for creating a safe shopping environment. IMHO anyone who wants to "experience" a black Friday like this last one should have to take an mental/common sense test and undergo a full cavity search! If you want to be considered a preferred customer, then maybe the retailer could create an online boarding pass thing like Southwest Airlines uses. You are given your number and the time to show up and do your shopping. No early boarding! LOL
And people wonder why corporatons take their jobs overseas where wages are lower and liability issues over mentally deranged shoppers are not an issue. Until retailers are given the right to search all customers for weapons, we cannot hold them responsible when someone uses a weapon.
Ladyofthelake, I'm with you. I do not shop at Walmart. Their promise of low prices is a joke. Other retailers have better prices and better quality, and their shoppers are not deranged and dangerous. I do like the idea of people banding together to end the Black Friday madness.

It really isn't worth the trip, Jerome. It's a pretty sad commentary about people's priority's. It used to be that the holidays were for family's, friends, and love. It still is that way in my home.
I feel so sorry for those who think of Christmas only as a commercial holiday. The woman mentioned in this article is but an example of the way our country has shifted into a hateful, greedy, self serving nation. All you have to do is read through these comments to see the hate people have for others.
Christmas Eve we'll enjoy the midnight service, we will genuflect and give thanks for our many blessings. For us, it's not about the gifts we can buy for each other, but rather the gifts we give each other by loving one another.

Here's what really gets me. I had a particular item that I wanted to try to buy for my son for Christmas. There were two different retailers that had the item on sale on Black Friday. Although I normally don't shop on Black Friday, I was going to make the effort to make my son happy. On Thanksgiving night, I decided to check the websites for the two retailers to see if there was really a huge difference between what I would pay online and what I would pay in the store. Guess what - BOTH retailers had the item online for the EXACT SAME PRICE I would have paid at the store on Friday. So for the price of an extra few dollars for shipping, I was able to avoid all of the craziness at the stores. I advise everyone to check online first - you may be fortunate enough to have the same experience I did!
