Death penalty dropped against Mumia Abu-Jamal

Prosecutors announced Wednesday that they will no longer pursue the death penalty against former Black Panther Mumia Abu-Jamal, meaning he will spend the rest of his life in prison for gunning down a white police officer nearly 30 years ago.

The decision by District Attorney Seth Williams, made with the support of the officer's widow and the city police commissioner, comes after nearly 30 years of legal battles over the racially charged case.

Abu-Jamal was convicted of fatally shooting Philadelphia police Officer Daniel Faulkner on Dec. 9, 1981. He was sentenced to death after his trial the following year.

Abu-Jamal, a one-time journalist who has been incarcerated in a Pennsylvania prison, has garnered worldwide support from those who believe he was the victim of a biased justice system. Hundreds of vocal supporters and death-penalty opponents regularly turn out for court hearings in his case, even though Abu-Jamal is rarely entitled to attend.

His message resonated particularly on college campuses and in the movie and music industries — actors Mike Farrell and Tim Robbins were among dozens of luminaries who used a New York Times ad to advocate for a new trial, and the Beastie Boys played a concert to raise money for Abu-Jamal's defense fund.

His conviction was upheld through years of legal appeals. But a federal appeals court ordered a new sentencing hearing after ruling the instructions given to the jury were potentially misleading.

The U.S. Supreme Court declined to weigh in on the case in October. That forced prosecutors to decide if they wanted to again pursue the death penalty through a new sentencing hearing or accept a life sentence.

The officer's widow, Maureen Faulkner, has tried to remain visible over the years to ensure that her husband is not forgotten. They were newlyweds when he died.

According to trial testimony, Abu-Jamal saw his brother scuffle with the 25-year-old patrolman during a 4 a.m. traffic stop in 1981 and ran toward the scene. Police found Abu-Jamal wounded by a round from Faulkner's gun. Faulkner, shot several times, was killed. A .38-caliber revolver registered to Abu-Jamal was found at the scene with five spent shell casings.

Abu-Jamal, born Wesley Cook, turned 58 earlier this year.

His writings and radio broadcasts from death row made him a cause celebre and the subject of numerous books and movies. His own 1995 book, "Live From Death Row," describes prison life and calls the justice system racist and ruled by political expediency.

Over the years, Abu-Jamal has challenged the predominantly white makeup of the jury, instructions given to jurors and the statements of eyewitnesses. He has also alleged ineffective counsel, racism by the trial judge and that another man confessed to the crime.

We already know what happened. mumia (Cook) shot Officer Faulkner in the back, like the coward he is, then, while Faulkner drew his gun, shot him in the forehead as Faulkner got off his one shot hitting mumia. No one else involved in the shooting. Cook's brother ran away. He never testified. Let me ask you: igfyour brother was on trial for murder and you know he didn't do it, wouldn't you testify to clear him? This was a setup by the Cooks to kill a cop. Don't tell me it was just a coincidence that one brother was driving the wrong way down a one-way street on the same block at the same pre-dawn hour his brother just happened to be parked there. BTW, the first person selected for the jury was a Black woman and mumia rejected her. He wanted a mostly white jury so he could cry racism. Should have fried a long time ago.

Amen to that! Those of us who lived through this here in Philadelphia are sick to death of this guy. He murdered someone in cold blood. The trial was completely fair & the jury was made up of his peers...a jury that exactly replicated the racial mix of Philadelphia at the time. Nice article MSNBC! You really make out Mumia to be a "nice guy" and love the "injustice" part...... however the facts are the facts. The guy murdered a police officer, not only shooting him in the back but then enjoying the moment when he shot him in the face. Hmmmm, nice guy? Injustice???

I'm sure that this decision is going to make some people happy, while continuing to put some lib's panties in a knot. They want him freed, not in for life. Facts are that having the death penalty doesn't usually lead to death. Most of the time the taxpayers are just subject to massive legal fee costs in appeals (millions and millions) while the perp. gets to sit in jail and torment the system regardless of their guilt. It's like in CT where the rapist murderers are on trial now for killing the Cheshire family- the perp's lawyer was going for mistrial after mistrial, now he's asking for a light sentance because the perp was "abused" as a child and because of the value of life. Last I checked he raped and murdered four people- really concerned about the "value of life".

Hope he rots where he is.

Love ALL the people here who KNOW exactly happened that night!! This has to be the most witnessed murder in HISTORY!!

That being said (very facetiously, I might add) juries convict innocent people every day. Was he guilty, I don't know. Should there be some kind of justice for officer Faulkner, ABSOLUTELY!! I think the jury was right in their decision with the facts presented to them, but also think the investigation was sloppy and directed to bring the outcome it did.

      Police were incomplete in their investigation - especially with ballistics. Witnesses gave conflicting testimony. And the prosecution's case did not match the physical evidence. Mumia definitely does not deserve the death penalty. He deserves a fair trial.

      AMEN. Tell me who raised Faulkners kids? Is anyone concerned about them? How about a wife? Are any tears shed for her? Are his parents still here? If they are, they are still grieving. If not, they grieved to the end of their days. RIP Police Officer Faulkner. You are safely in the arms of your creator (where you should be). That POS who killed you is still in prison. Long may he live in captivity and misery. I am a Christian and am usually able to find mercy in my heart but this one remains a struggle.

      I'm originally from Philly, and I always hated seeing people supporting this cop-killing piece of crap. I've seen the t-shirts and the signs, and I really wonder what goes through the minds of people that support his release. Danny Faulkner was 25 years old when he was shot, less than two weeks before his 26th birthday. Jamal stole a lifetime, not just from Faulkner, but from his wife, and deprived his children of a father.

      If he's ever released, I guarantee you, he won't be breathing free air for long.

        Three people at the scene. One is a police officer. He dies. He did not shoot himself. A gun and shell casings found at the scene is registered to one of the other two. The gun and shell casings where found next to the wounded suspect. He is wearing a holster without a gun in it. The dead officer obviously returned fire at the guy who was shooting at him. The officer hit the man shooting at him. Neither of the two people will testify against the other. Only one man's finger prints where on the gun. At the hospital two people testified that the wounded man said " I shot the MF. I hope the MF dies." One witness claims he saw a man running near by. None of the other witness saw any one running or the man. One wounded man's brother refuses to testify sayingat the scene "I ain't got nothing to do with this". The wounded man is a Black Panther a known violent group that had many run ins with the police in many cities. He is quoted as saying "political power grows out of the barrel of a gun". He is connected to the violent MOVE group in Philadelphia. He is found guilty and after numerous appeals that all found him to have had a fair trial. Articulate or not he did kill the officer.

          I have been following this case for quite a while.

          Abu-Jamal is guilty, of that I assure you. The most telling evidence is that his brother never testified in his defense (he definitely saw what happened) and Abu-Jamal never testified either. If he was innocent, why wouldn't he have told the courts what really happened? Lastly, his gun was completely spent at the scene.

          It is true that various alternative proposals to the events of that night cropped up over the years. But none of them were even remotely plausible. And the mere existence of alternatives or the number of alternate stories does not change anything,

          We can debate about whether the court proceedings were biased b/c of racism for our entire lives and not come up with an answer, because so much of that is grounded in opinion. But this man is guilty.

          If you do not believe me, do some simple research. Start with the wikipedia, which is actually a good start. You can read all the articles from people who support Abu-Jamal's innocence. None of them present plausible theories.

          No one ever claimed that movie stars were somehow wiser than the rest of us. As I see it, we pay them because they are good at pretending to be something they are not. It's entertainment, but if we know people in our own lives who pretend to be something they are not, we disrespect them, and do not like them because they are being false. So what's the difference? They have the money to fund any idiocy, and they make no end of the outrageous. It is a world gone wrong that elevates a person to the position of the wise because they have money.

            Your comment is completely wrong and patently offensive. This country has a LOOOOOOOOOOONG history of black folks NOT getting off easy, or receiving the same punishment that whites get for the same crime. This is ESPECIALLY true in the City of Philadelphia.

            Mumia has been in jail for 30 years and will never get out. That's not getting off easy. I personally think Mumia is guilty, and since I'm against the worthless, expensive, non-deterrent Death Penalty, I applaud the decision. Let him rot! Death penalty is the easy way out.

            Since when is the death penalty not a deterrent? In every case that the guilty were executed, the guilty never re-offended. I like those results. The sad fact is that the appeals process is way too long. Three appeals and you should be gone. No appeals if you are caught red handed. No emotional disstress, no insanity plea, no my parents didn't treat me right. No the juror looked at me the wrong way. Do the crime and you are history.

            This was no mistake, Mumia killed Officer Faulkner in cold blood. mumia was sympathetic to the Move cult and their leader John Africa. although an intelligent literate he became so unbalanced that he was fired from his radio gig and drove a cab at night to pay the bills. The Mike Farrells of the world are misguided and have been for years with concerns to mumia. they see him as this great writer that couldn't possibly have done what he was charged with. he shot Faulkner in the back and then stood over him and shot him in the face. Faulkner was able to get a shot off which left mumia lying on the street next to the fallen officer. the bullets in faulkner are from the gun registered to mumia, the bullets in mumia are from faulkners weapon. mumia disrupted his hole trial, firing his legal counsil and making a mokery of the whole trail. 30 years the officers wife had to put up with insult after insult lodged by the mumia organization. he should have been killed years ago, My only hope is that Officer Faulkners family is finally at peace.

                There is probably no one on the face of the earth who couldn't vie for sympathy based on what was done to their ancestors. You didn't suffer their pain, and you don't have the right to collect on a debt owed to the dead by the dead.

                The case of Mumia Abu-Jamal, a prisoner on Pennsylvania's Death Row for 17 years, is one of the most important political cases of the 20th century. In many respects, the case has followed a track eerily reminiscent of the 1920's trial and execution of the framed anarchists Sacco and Vanzetti.

                As a high school student, Jamal was a founding member of the Philadelphia chapter of the Black Panther Party. Mumia's FBI file began at age 14 when he protested a visit to Philly by the segregationist Presidential candidate George Wallace. Later, Mumia became a writer and radio journalist, developing a style that earned him the nickname "the voice of the voiceless."

                Mumia's reporting exposed a corrupt Philadelphia police department and its war against the MOVE organization. Mumia became a police target himself: despite having no criminal record, FBI and local police surveillance of Mumia created a file some 700 pages long.

                This was the background for the night of December 9, 1981. A shootout at 4 A.M. in a rough neighborhood of Center City, Philadelphia found police officer Daniel Faulkner dead and Mumia critically shot. Mumia was arrested and convicted of killing Faulkner in a trial full of irregularities and prejudice.

                Since then Jamal has been locked alone in a cell 23 hours a day. His confidential legal mail has been opened and reproduced by prison authorities - copies of some of his letters to his attorney were even forwarded to the governor's office. Since November 1996, journalists have been prohibited from filming or recording interviews with Mumia, who notes: "they don't just want my death, they want my silence."

                In the early 1990s, he hired civil rights attorney Leonard Weinglass. A 300-page legal brief was filed challenging virtually every aspect of the prosecution case. Mumia's defense team has unearthed many witnesses not brought forward at the time of the original trial in 1982 to support their contention that a third party, a black man or possibly two men, shot officer Faulkner and fled the scene.

                The key point here is that if the shooter ran from the scene, this could not have been Mumia, who was found within minutes on the sidewalk near policeman Faulkner in a pool of blood. Mumia's life was saved by emergency surgery.

                In 1995 Mumia Abu-Jamal was only 10 days away from execution when massive worldwide protest forced the government to grant a temporary stay.

                The case is now before the Pennsylvania Supreme Court, which is expected to issue a ruling at any moment on Mumia's appeal for a new trial. Governor Tom Ridge has promised the powerful Fraternal Order of Police (FOP) organization that he will sign a new death warrant for Mumia the minute an appeal is denied. [Author's note: since the writing of this article, Mumia lost his Pennsylvania Supreme Court appeal and the case is now in the Federal courts.]

                A new anti-Mumia group has been formed in recent months that has undertaken public activities advocating Mumia's guilt, including the purchase of an expensive full-page ad in the New York Times. Some observers speculate this may be an indication that a new effort to execute Mumia will come soon, and that the FOP wants to be more active in the public debate that would follow any court ruling adverse to Mumia.

                Here are ten reasons to believe Mumia is innocent:

                10. Pamela Jenkins. Jenkins was a former prostitute and government informant, the girlfriend of police officer Thomas Ryan. She testified at hearings last year that Ryan tried to make her falsely identify Mumia as the shooter at the time of the original trial, even though Jenkins was not at the scene of the shooting.

                Jenkins' credibility was recently proved by her status as the key witness in the investigation that unraveled the massive police corruption scandal in Philadelphia's 39th Police District. Her testimony was instrumental in reversing the decisions of hundreds of cases.

                9. Cynthia White. Jenkins also recently testified that Cynthia White, or "Lucky," another prostitute and the prosecution's star witness, was successfully coerced to lie on the stand in exchange for exemption from criminal prosecution - that is, being given permission to work her corner. None of the other nine eyewitnesses recall seeing White at the scene of the crime.

                Jenkins on March 5, 1997 saw White, who ran away and hopped into a pickup truck driven by former Philadelphia police officers Jenkins knew. It is likely White is being hidden to this day by the police to prevent her being called to testify by Mumia's legal team.

                8. More on the mysterious "Lucky." White was arrested in 1987 on armed robbery charges. However, Philadelphia homicide detective Douglas Culbreth appeared in court and successfully asked that White be released without having to post bail money, because she was "a Commonwealth witness in a very high profile case."

                When Jamal's legal team sought to find her for recent hearings, the prosecution declared that she was dead. To support this claim, they produced a death certificate for a woman in another state with a different name, whose body had been cremated, and whose fingerprints did not match Cynthia White's.

                7. William Singletary. Singletary was a local businessman and one of the only eyewitnesses who saw the whole incident. Police suppressed Singletary's original statement that he saw a shooter fleeing the scene - a man whom by Singletary's physical description could not have been Mumia. In a 1995 hearing, Singletary testified how he was coerced and intimidated by the police, who tore up his written statement and forced him to sign a different, false statement which they dictated. His version of events is supported by Dessie Hightower, who witnessed the 5-hour police interrogation of Singletary.

                6. More witness manipulation. Veronica Jones confessed in a 1996 hearing that she was coerced by police into retracting her original statement about the case. Jones explained that she lied on the stand in exchange for receiving only probation on unrelated, pending felony charges. Robert Chobert, in a 1995 hearing, testified that he was offered a deal by the D.A.: if he retracted his claim that a shooter fled from the scene (he too described a man whom by physical description could not have been Mumia), the prosecution would reinstate his suspended cab driver's license.

                5. Trial Judge Albert Sabo. Known as a "prosecutor in robes," Sabo has sentenced to death more than twice the number of people than any other judge in the country. Six former Philadelphia prosecutors have sworn in court documents that no accused could receive a fair trial in the court of Judge Sabo.

                Typical Sabo responses to virtually all defense statements were "Shut up!", "Sit down!", and "Take it up with the Supreme Court!" When Mumia's court-appointed attorney Anthony Jackson objected to Mumia not being allowed to be present at Jackson's questioning of certain police witnesses on the record, Sabo replied, "I don't care about Mr. Jamal."

                Stuart Taylor, Jr., in the leading law journal American Lawyer, summarized his review of the transcripts: "Jamal's trial was grotesquely unfair and his sentencing hearing clearly unconstitutional...Judge Sabo flaunted his bias, oozing partiality toward the prosecution."

                4. Jury-stacking. Eleven qualified blacks were removed by peremptory challenges from the prosecution, a practice that was recently revealed as having been taught to prosecutors in a special training video tape prepared by the Philadelphia D.A.'s office in the 1980's. Mumia ended up with an 83 percent white jury (ten whites, two blacks) in a 40 percent black city.

                3. Judge Sabo forcibly prevented Mumia from being present at major proceedings of his own trial, a blatantly improper act, especially in a capital case. Sabo, 76, was forced to retire this past January, but the damage has been done.

                2. Trial travesties. Jamal's court-assigned attorney, Anthony Jackson, testified that he didn't interview a single witness in preparation for the trial and he informed the court in advance that he was not prepared and wished to withdraw. Jackson was so incompetent he was later disbarred. Jamal, who futilely argued throughout the trial that he did not accept Jackson as his attorney, was also denied the right to act as his own attorney.

                Neither a ballistics expert or pathologist could be hired by Mumia, because the court refused to allocate sufficient funds, allowing only $150 for each of a maximum of four experts. Judge Sabo repeatedly refused to authorize additional funds. The defense investigator quit the case before the trial began. How far would O.J. get on $600?

                1. According to the written findings of the medical examiner, Faulkner was killed by bullets from a .44; Mumia's gun was a .38 caliber.

                Thanks Beefy! It's frightening how quickly John Q Public cries for the death penalty without an understanding of the case. If his trial was biased or in violation of of his constitutional rights, he should be retried or acquitted, period. If his guilt can be proven beyond a reasonable doubt, then give him the death penalty. If it can not, he should be released. Where is the logic of this middle ground? "He might be guilty so let's give him life in prison" is unconstitutional and unfair.

                The American ideal is justice. Justice for the victim lies in uncovering the truth in a court of law, and punishing the perpetrator acordingly. If there is widespread doubt about the events of the case, than they need to be re-explored in court, not in the arena of public opinion. I don't care about your political affiliation; as long as it isn't Chinese you should support giving the man a fair and impartial trial before you condemn him to "rot in hell."

                Thanks Beefy. I've read through all of the comments before yours and I have come to the conclusion that the United States' justice system will NEVER improve. Most people gripe and complain about sentences but then turn around and make conclusions about cases that they don't know the details about! I've always read that the gun registered to Jamal (registered means it was legal) was a .38 but the cop was shot by a .44; how does this mean that Jamal shot him? He would only be guilty of felony murder if him and his brother were in the commission of a robbery, rape, burglary, arson, or kidnapping, and a death occurred; meaning, if it was a routine traffic stop and his brother shot and killed the officer, Jamal would NOT be guilty of felony murder.

                The public will never have all of the details of this crime. Is Jamal guilty? I do not have the slightest idea. The wheels of justice have turned and they have not turned in his favor. Once a person is convicted by a jury of their peers, it is incredibly difficult to get it overturned. Subsequent appeals do not consider 'guilt' or 'innocence,' and instead are centered on process and procedure. The Supreme Court will not overturn any conviction unless there is an issue of federal question.

                If there was prosecutorial or police officer misconduct during the investigation and trial of Jamal, then shame on all of those involved. Karma has never been kind and I'm sure it has not been kind to any and all persons involved. If Jamal was involved in the murder of Officer Faulkner, then it is horrible that he has manipulated thousands of people to support the evil that lives within him.

The death penalty was given.                 How quickly people want to believe that a cop murderer is innocent, even though he NEVER proclaimed his innocence, just that the jury was prejudiced.

                If you think you got the whole story from Beefy, try looking a little deeper into the facts of the case, including the statements of the black nurse at the ER. He was found guilty at his trial and every appeal. The only reason he is spared the death sentence is one line in the judge's instructions at the SENTENCING trial.

                Trial courts look at and determine issues of fact. Appeals courts examine issue of procedure. Trial courts determine guilt or lack of guilt and appeals courts affirm or overturn convictions. Jamal could scream over and over again that he is innocent and no court would have ever granted him an appeal; however, claiming that a jury was prejudiced may give a court enough legal foundation to re-examine a decision.

                                    If you want to know what really happened, read the court transcripts (they're freely available). I printed them out (an inch thick) and they're a much better source of information than a bunch of know-nothing celebrities. He either did it, or simply wanted the courts to think he did, and he's solely responsible for being in the position he's in.

                                              I have a friend, Richard Mayberry AP-5251 that has been inside Pennsylvania's prisons since April of 1957. This guy originally went in on a 2 1/2 to 5 year sentence and now has 9 years to go. All of his additional time has been for trying to break out. He hasn't written any books so the lefties in our society do not know his name. All he has done for these past 54 years in solitary confinement, is to try and stay alive from the enmity of the Black Prison Muslims. Not true Muslims, just the pseudo Muslims that prison breeds.

                                                    He's been locked up for 30 years. To me, that's proof that the city of Philadelphia effectively got rid of him.

                                                    We've been "supporting" him for 30 years, what's another 10-15? It's way cheaper than all the appeals that the death penalty would require.
