20 years for illegal immigrant in DUI crash that killed nun

The man convicted in the deadly Bristow, Va., accident that killed a nun was sentenced Friday to 20 years in prison.

Police said Carlos Martinelly-Montano, in the United States illegally, was drunk when he slammed his car into another car in 2010.  The crash killed Sister Denise Mosier and injured two other nuns.  He was convicted of felony murder in October.

In court Friday, Montano pleaded at length for mercy, New4's Julie Carey reported. He told the judge he has reformed in prison and hopes to become a pastor.


The incident was Montano's third drunken driving offense and happened while he was awaiting deportation.

In August of 2010, the three nuns in the car were headed to a retreat at the Saint Benedict Monastery in Bristow, about five miles away from the scene of the crash on Bristow Road near Wright Lane.  Investigators said Martinelly-Montano, coming in the opposite direction, crossed over the center line and crashed into the nuns' car head on.

The other nuns in the vehicle, Sisters Connie Ruth Lupton and Charlotte Lange, were seriously injured in the crash.

Martinelly-Montano has twice before been convicted of drunken driving, and was awaiting a deportation hearing at the time of the accident.

The fatal crash prompted Prince William County officials to sue the federal government to explain why Martinelly-Montano was not in detention for his prior crimes and immigration status.

Montano faces up to 70 years in prison.

How is he convicted twice before of drinking and driving and is still in this country? Seriously if he was deported before and came back that should just be an automatic death sentence. Sick of reading about the nightmares associated with people doing this.

The better question is: why was he free to do this while he was already awaiting deportation? If he was already slated to be deported, why was he not in custody already?

All told it was worth it. A few nuns here and there is a mere pittance to pay when cheap vegetables and meatpacking labor is on the line. Not sure how many nuns it takes dying to make it worth stopping illegal immigration, but one ain't it.

Robtzu, seriously callous there partner. I can appreciate sarcasm as much as the next guy, but using the words illegal immigration is just hurtful. Maybe you could rephrase that and have it go something like "...an unfortunate undocumented worker who is tragically addicted to alcohol was brutalized twice, once by the post traumatic stress of an accident caused by the callous disregard for safety by not having warnings on alcoholic beverages in three languages and a second time by being sentenced to a cruel and unusual prison term for being a victim of a disease." How's that read...a little gentler?

Hey, U.S. Congress ----- be implemented as soon as possible. First; The Federal Government needs to PLACE A BOUNTY on illegals in this country. Second; There needs to be a revision to our laws allowing, no, demanding, that illegals are to be deported within SEVEN DAYS. In the meantime, they have to be held in "holding facilities" in the southern border states. Facilities such as the TENT CITY in Maricopa County, Arizona would do nicely. There are no "comfort" amenities there. Third; MOST SEVERE PENALITIES have to be given to those who hire illegals including crushing monetary fines and MANDATORY IMPRISONMENT IN A FEDERAL FICILITY for those who hire the illegals. Special courts and judges, designated to handle the hearings for the illegals, would be designated to do so in a very rapid manner and to serve EXCLUSIVELY in that capacity. Anything less will not suffice. Efforts so far have not wrked particularly well, if at all. Finally, our country needs an administration that will promote and enforce the strictes of measures. This is not draconian. It is simply the result of our immigration laws being ignored by a multitude of parties. This simply has to change, AND NOW !

If you stop and realize how this series of events transpired. And just what goes through the minds of these illegal interlopers, then you will come to the OBVIOUS reason I came too! These people who come to this country illegally and manage to stay longer and longer, have it in their minds that they must be able to get away with just about any GOD DAMN THING they want and NOT have to worry about a thing! Even being Prosecuted and jailed.

You are all overlooking the obvious, which is that the man now has free room and board for 20 years at the expense of the US taxpayer. If he had been deported after the first offense, the nun might still be alive and taxpayers would not have to foot the bill.

    I'd rather have us make the mistake of sending them away, then make the mistake of keeping them here. Last weekend an illegal was drunk and crashed into my car and broke my arm. Funny thing is he also had a prior DUI (AND no insurance obviously, AND tried to flee the scene). He should have been long gone by now. Get em outta here ASAP.

    I hope you exhaust all legal options to make sure this individual pays, especially if he used his employer's vehicle. They need to be held accountable. Do not pay anything out of pocket and insist your insurance company recover costs for your injuries. If you can't get anything from the illegal and/or employer, most states have victim's funds that would pay medical bills etc. as you are a victim of a violent crime.

    Too many people do not pursue legal options because "it's too much trouble". I hope you don't like getting walked on or in this case, getting your arm broken.

    That's not the immigrants taking jobs from anyone. That's lazy, entitled Americans giving away their jobs because the work is "too hard" or "too demeaning" and the pay is "too low". That's greedy corporations who look the other way when they should be doing background checks. Taking jobs, taking taxpayer money, destroying the economy?       Unfortunately I have an in-law who is an illegal. He cant find work because he refuses to work for illegal type wages. He drives around repeatedly without a drivers license. He has been arrested many many times while driving. They take him in and let him go after paying his fines. Even though he is family, this type of treatment disgusts me. Our laws have no teeth in this department, and all police look the other way. Serve and protect who.

        I'm certainly not suggesting that killing anyone is anything but what it is; murder. But for a church that is always complaining about being unfairly attacked, why is horror for killing a nun worse than killing anyone? I think that even the nun would agree with me if she were alive. Would the driver have been a better murderer if he were "legal"? We need to get over the emotional/sentimental drivel and get a grip on reality. I think that our level of judgment has become the moral equivalent of a Hallmark greeting card.

        Unless you are reading something from a different article or I'm just completely missing it, where does the church say anything about the deaths? If it was a mother that was killed the article would go over her history as well, including any bit about her family and the tragic loss. The fact that these women where nuns serves only to let people know about the human life lost and who they where. Personally I would rather be emotional and sentimental then impassive and apathetic.

        I'm sure this is a bit of a hard ass statement, however if you are convicted of drunk driving and have a blood alcohol level over a certain point, it should be immediate jail and fine. Any other convictions after that involving drunk driving should be a longer sentence, possibly life and a removal of any driving privileges. There is NO excuse to drive drunk. For this man to be out and drunk again shows a reckless regard for the life of others, he deserves the lengthiest sentence possible in his own country.

        In the state of Maryland if you are convicted of driving under the influence (.06) you get 5 years in prison, even if you are a 16 year old kid. Driving while intoxicated (.08) you get even more time. I LOVE their law and think every state should adopt the same policy and laws.

        The illegal immigrant should send back to his own nation for the first time DUI. They should not have Driving Lic. in the first place if they are illegal come to U.S.A. DMV should immediately report to the INS or simply police.

        Now he accumulated the fourth time DUI to which it ended up to kill people. This is a ridiculous legal system.

          That's what I thought, seriously? That's his third DUI - the 3rd time he was caught doing it. This guy isn't ever going to stop doing it - he needs to be put away permanently so he doesn't kill someone else.

          Perhaps Chirs150, since he's seen the errors of his ways, he can drive you and your family around town, everywhere you need to go - would you want to let him drive your family, or be driving in another car near your family's car?

          This is a horrible incident but I fail to see what him being an illegal has anything to do with it, other than incite some racism. Having lived in New Mexico for many years, I have witnessed so many of our citizens that drive drunk with no concern of fellow citizens.

          Drunk driving should be made a federal crime and should caryy the same punishment as 2nd degree murder if you have someone die because of your actions. The only reason, this has not been made a major issue that so many people will and have driven drunk.

          Any crime being committed while committing another crime should be a multiplier in terms of penalty. For example: rob a convenience store = penalty A

          rob a convenience store with a weapon = penalty B

          rob a convenience store with a weapon and cause injury or take a hostage = penalty C

          Most states already have laws to escalate penalties so a first time offender who steals a candy bar when they are drunk or stoned simply get misdemeanor theft. Add a gun and it becomes a felony in aggravated robbery or theft.

          Illegal aliens should be charged the same way. Illegal crossing, auto deportation. committing a crime once you arrive (including transportation of drugs,money, humans or contraband over the border), mandatory jail time as a military POW and return to the custody of your government at the end of your term.

With the existance of USA Dept. of Homeland Security, the Judicial branch judges are aiding illegal aliens to commit terror on citizens while under the influence of alcohol with an automobile. I think religious zealousness and freedom fervor has made american judges pope wannabe dumbasses.
