More than 1,000 students at North Miami High School in Miami, Fla., protest the deportation order for 18-year-old Daniela Pelaez, the school's valedictorian. WTVJ-TV's Jeff Burnside reports.
MIAMI -- Classmates of a North Miami High School valedictorian facing deportation protested Friday morning.
An immigration judge on Monday ordered the deportation of 18-year-old Daniela Pelaez, who was brought illegally to the United States by her parents when she was 4 years old.
Holding signs and shouting "Education not deportation" and "let her stay," the students filed out of their classrooms around 9 a.m.
Pelaez met with Miami-Dade Schools Superintendent Alberto Carvalho, who later walked out with her to joining the protest holding her hand.
"Over my dead body will this child be deported," Carvalho said.

Emily Sell, Pelaez's best friend and the organizer of the protest, showed up at the school bright and early Friday to help her friend.
"We've been making posters like crazy," said Sell, the school's salutatorian. "I hope this march brings the proper attention to the issue of deportation."
Pelaez expressed her appreciation for her friends' actions when she arrived for school before the protest.
"They're the vanguard," Pelaez said.
Pelaez left Colombia in 1998 with her parents, who entered the United States illegally and divorced before Pelaez could become a citizen. She told NBC Miami Thursday that she has no memory of Colombia and loves her friends and this country.
"I've been asked the question before: 'Do I feel American?' or 'Do I believe I am?'" she said. "And I don't think it's a question. I'm American. I know the national anthem. I know the laws. I know what it is to be an American."
Pelaez has earned nearly all A's in the school's international baccalaureate program, but her ability to go to college is threatened substantially by her immigration status.
Late Thursday, Immigration and Customs Enforcement released a statement saying it will not take further steps in the case until the conclusion of Pelaez's appeal on the judge's decision.
Not everyone agrees Pelaez should stay.
"She should be deported," said Linda Simmons, who has a son in ninth grade at North Miami High. "Her parents broke the law."

If she is truly here illegally, then let her finish her high school career, but then send her and her parents back to where her parents came from and offer her, not her parents, the ability to become a US citizen. She is the by product of her parents poor choice.

I agree that this is a very sad situation, especially for the kid, but I feel that it is important not to have a double standard.
Fact is, this should have been caught a LONG time ago, before she had time to go from being a 4 year old, freshly illegal, to a high-school graduate that doesn't even remember her home country.

If she is 18, she can stay here without her parents. Send her parents back, but let her stay. We then need to take a look at our overall immigration policy so there are fewer of these cases.
First all, it took my parents, POWs of WWII, who worked for the English hospitals, and the American army, about five years to get into this country while Nazi scientists were given the "go." I agree deport her after her graduation from high school. Why doesn't Florida just open the floodgate and allow all illegal aliens to come to their state for welfare and an high school education. Let's just add another couple a million aliens to the population of Florida. Then all the working people would have to support the couple of million illegal aliens that entered Florida. They've have to change the spoken language from English to Spanish to cater to the aliens. Florida is a screwed up state anyway.

The students and principal demonstrating for her to stay should be responsible for the cost of the benefits she and her family illegally received. Fatibel: I don't know whether undocumented immigration is a civil or criminal offense, but I completely agree with the rest of your posting. Has anybody looked recently at a statue(tte) of Justice? If I remember, she is wearing a blindfold, but part of it is pulled down, so that mercy may enter into proceedings/decisions, etc. By the way, I am a rather conservative democrat. This is a tough call, considering that she was brought into the country illegal, but spent all of her developing life growing up as an American it would be hard to say she isn't naturalized in the same way a person, who was born here, was. I am inclined to let her stay but make her parents pay a fine. The fact is that it is unfair to those who have decided to immigrat legally, and face our byzantine immigraiton laws to boot. I am consistently floored, and angered, when I see how hard it is to get into this country. I know very bright individuals who came to he US to be educated but had difficult time finding work. Their sole goal is too eventually assimilate,m work hard, and make a life for themselves in this nation but our current laws have forced many recently graduated students, who wanted to follow the rules, into illegals because they do not want to go back to their home countries. Torn on this one. Most times I see it in black and white, but this is the only country this kid has really known. I am familiar with the IB program; she received a very rigorous education, and earned nearly straight A's. She's not a social miscreant, from what I can tell, and deporting her would only serve to be an asset to the country she was from. We need educated people. I am not sure if I want her deported. Her parents are to blame. That being said, I really resent the fact illegal immigrants come to our country, and then protest about immigration--which is (in my opinion) a totally different subject. After all, I am opposed to illegal immigration, not those who came here legally. That being said, I really am torn on this one. She is obviously bright. Why not provide her with a chance, and ensure she becomes a productive member of our country? If she was a lowlife, I wouldn't hesitate. This one for me is a tough call....

Then we come to the 'double standard' issue of the case by case judgement. This is true, but what truly p!sses me off is someone useless like Obama's uncle (stopped for DUI, hiding here illegally for 20 years, and still hasn't even bothered to learn English) has people making the case he should be allowed to stay just because he's related to President Obama (which I think means nothing more to him than a ticket to stay in this country). It is not her fault her parents think it is OK to break laws her parents should have to foot the bill for her, as for her she should be given the oppertunity to get her green card as she was just a child when brought here, but her parents should be deported till they get there paperwork in order, they knew the right way to get into this country, as she does now.

Yes, she is an illegal immigrant and yes, there are laws that address this issue. My problem with all of you heartless posters is your lack of morality. We have become a society where institutional laws take priority of what is morally the right thing to do. This is how we torture each other over these immigration problems. we fail to secure the border, let the folks come in, in her case she is here 14 years. I don't know why they didn't deport the family 10 years agor or 12 years ago. But we have this HS kid about to graduate and now we want to deport her. Secure the border now. Let people in on visas but take , photos, finger prints and DNA samples. MAKE them report in at appropriate intervals. But be prompt with deportations when called for. IT is torture to constantly put people through this process of letting them stay til they put down roots and then decide they need to go. IT totures all reasonable people - not just the ones involved directly. Secure the damned border !

I respect her for her academic achievements, but she needs to go back and apply for legal citizenship like everyone else. It makes me angry that people are fighting for people who have broken the law. Arguing that we're breaking up families and sending children back to countries they don't know is useless. These are the consequences that her parents very well knew when they brought her here illegally. Plus, she wouldn't be alone... I'm assuming her parents will be deported back with her too? So what's the problem?
Don't get me wrong, I am all for immigration - LEGAL immigration. I know so many people - fellow classmates, colleagues, neighbors, friends - who have either experienced the legal immigration process themselves or their parents have. It takes years of legal red tape, bureaucracy, papers, and time just to get a green card. Yes, it is frustrating and I agree that there should be some sort of immigration reform, but so many people struggle to become American citizens the legal way and illegal immigrants are only making it harder for honest people.

Overstaying a visa or crossing a border without inspection is a civil misdemeanor, and it's only an infraction the one time it is done. (It's "illegal" in quotes because if the native American Indians who've been in the US for over 13,000 years have no seniority to decide who's "illegal" then no one else who came after them should be able to label anyone "illegal").

Entering the U.S. illegally is a criminal offense ONLY if the person was previously deported in which they can be sent to a federal prison and then deported once again. Sneaking into U.S. illegally is one of those weird legal situations in which it is a crime but then again its not. I know this because I work as a legal secretary for a law firm the handles immigration cases on a daily basis in Seattle. We work with almost every immigration situation a person can be in.

Second all sides must be Heard.

A. How long did 18-year-old Daniela Pelaez know she was at the US illegally?
B. Can US Taxpayers afford to pay for ALL Illegal Aliens Education from whatever age they first enter the US without affecting the Education of Legal US Citizens's Children? As this sets a Legal Precedent.
C. Was/Is there a Legal Precedent for previous cases like this one. This is a Rhetorical Question (Citing Legal Cases since President Eisenhower).
D. Did 18-year-old Daniela Pelaez Parents know the consequences of their Actions. Has this happened before in other Cases (Also a Rhetorical Question).
E. Did 18-year-old Daniela Pelaez or her Parents commit any Criminal Offenses while at the US. Like Felony Criminal Tax Evasion to avoid detection as Illegal Aliens. Document Forgery? And the other one Perjury (usually at the bottom of most documents, example: school enrollment forms).
F. Will a Favorable Ruling for 18-year-old Daniela Pelaez actually solve the situation, or create further Legal Problems within the US.
G. Does this violate any International Treaties or International Laws. (another Rhetorical Question).
H. What is the Purpose under US Law for Punishment? Is it a deterrent to Future similar Illegal Actions and Violations of US Law or does it become something else?
I. Does Rule of Law override Emotions and Opinions (the Lynch Mob Mentality/Psychology). Does US Law only apply for the Few or Everyone? For those of you crying about how this illegal alien is being "punished" for something her parents did.... you have it exactly backwards. We are removing the benefits her parents illegally obtained for her. Do we allow bank robber's children to keep the money their parents stole from the bank? Why not? It would surely provide a better life for them. We don't allow the children of bank robbers to keep the money their parents steal because the children, regardless of their socio-economic situation, are not entitled to it nor do they have a "right" to it. I see that, as usual, some are making the claim that entering the United States illegally is not a crime, but simply an "administrative" offense. This, of course is a LIE!!
Illegal entry is a violation of the UC CRIMINAL CODE. First offense is punishable by a fine and up to 6 months in prison.
The only administrative part of the statute is the governnment's option to DEPORT the offender administratively. This way, the taxpayers don't have to pay for the illegal's imprisonment, lawyer, and jury trial.
This is beurocracy for the sake of beurocracy. By the black and white letter of the law, what they are doing is legal, but is it what SHOULD be done? This girl's life is being turned upside down for something she wasn't responsible for 14 years ago. She is an intelligent girl who has only known the United States, and now instead of a bright future living her dreams, she is going to be taken away from the only home she has ever known and sent to a foreign country.

I believe that because she is the valedicatorian of her high school class she should be allowed to graduate from high school. Her parents need to take responsibility for her situation and freely return to Columbia. Once there, they should apply for the required passports and visas for themselves and be allowed to return once they have gone through the proper checks including background and health screenings.
As for the girl, herself, she should report to the nearest Immigration office and apply for a humitarian relief, since Columbia, her home country, has nothing to offer her except a life of abject poverty.
People, I support the deportation of illegal immigrants, but when it comes to the minor children of adult undocumented citizens I support allowing them to remain as a goodwill gesture. These children deserve a life that is free of poverty, disease, illiteracy, and homelessness not to mention being in the crosshairs of the major drug cartels.

So many people are clamoring for the deportation of young person who would obviously be a credit to the country, who has demonstrated an ability far above the average natural born citizen, and is here illegally through no fault of her own. We came from Cuba (1964) and were "SPONSORED" by our aunt who was going to be responsible for all of us (4) Father, Mother and my brother. She contacted friends to help her with money to get our airplane fair, without any goverment help, except from Senator Carl Hyden from Arizona who worked hard to get us a VISA waiver to immigrate here. It took us 3 years to get out of the Communist Hell Hole of Castro. We got our LEGAL resident green card and more than 5 years later we were able to become (all 4 of us) American Citizens. So dont tell me that you need a lot of money to immigrate to the US, what you need and this illegals don't do, except send all their money to the country they came from, get a family sponsored who will be responsible for them after they come in here legally... No, it is very easy to come to this country and apply for welfare, go to the hospitals and get free medical coverage, dont pay for liabillity insurance on your car and get food stamps, all courtesy of Uncle Sam...

There have been many such cases, but I want to bring up the case of the Texas (I think he is) man who was charged as a sex offender at the age of 18 by the mother of his then 16 year old girlfriend. They are now in their late 20s. He married the girl....the mother tried to take back her accusations to get his name off the sex offenders lists...but to no avail, he is still listed as a 'pedophile'...he's even lost a couple of jobs over it. But technically, he was a pedophile, right? And once a pedophile, always a pedophile, right? That's black and white...the letter of the law, right?
So this girl was brought to America when she was 4. She grew up knowing only America. She turned out, by dedication and hard work, smarter than YOUR kids. But that doesn't matter, right? She was way too young to know she was a criminal, or what made her a criminal, but that doesn't matter, right? It was her parents who committed the real crime, but that doesn't matter, right? America is the only life she's ever known, she'd be an virtual 'alien' in Columbia today, but that doesn't matter, right? It's the law, and the law is black and white, absolute, always right in every case, right? And you STILL can't see why proceeding on a case by case basis is necessary? @thrakenglarv I never said that it wouldn't be a huge loss to America to deport this girl, because the fact is it would be. While she may not have had intent to break the law as a four year old, the instant she realized that she was here illegally she should have taken steps to either 1) get a visa, green card or passport or some form of legal authentication for her to be here or 2) take steps to become a naturalized citizen. I'm not so blind, however, as to think that once she admitted her illegal status that she wouldn't have been sent back to wherever she was from right then and there, but true respect for the laws of the land comes from continuous obedience to those laws even if we don't agree with some of them. Law is how peace is maintained.
Having said that, you didn't address how she would be a valuable economic asset to America should she stay. She can't do that, legally, if she is an illegal. As far as I'm aware, US businesses are still supposed to check the status of a person's citizenship (be they native-born or naturalized or by other means legally allowed to be here) before they hire someone. In terms of foreign exchange students, they are here on a student pass. If that term is coming, and more than likely they are aware that it is coming, they too should take steps to stay in this country legally if they want to stay here. From what I can tell though, many elect to go back so they can bring their "skills" and "education" back to their country of origin. I do not know why, it is their reasoning and that's not for me to judge. For those who do stay, is it difficult and arduous? Yes, in fact a co-worker of mine just got his citizenship about two months ago because his student visa was going to expire and during the whole time he was going through the process he complained about the studying he had to do and the hoops he had to jump through.
And to the naysayers about everyone who isn't Native American is an illegal immigrant, or the descendant(s) of, I'm going on a limb here and guessing you are also referring to yourself and all I can say is "practice what you preach." If you honestly believe that, then you likely should not be here yourself.
And as far as I'm concerned, the "Dream Act" is nothing more than the government saying it is okay for illegals to come here with their children, take up space in our overcrowded and underfunded schools, get an education at least of at least a high school diploma (which by my understanding is still greater than many countries with the exception of China and Japan) and then either be sent on their merry way or get the "higher education" and take jobs that legal US citizen working families try to get their children to attempt to earn. It's time to start thinking about how to deport all these illegal alien/invaders. There are no steps to take for her to gain legal status in this country once you have entered this country illegally. (exception: if you are the victim of abuse you may qualify to stay) All forms of legal immigration require that you start your process in your home country. (exception: asylum, refugees from war, and people coming from communist countries) Once she realized she was here illegally, she also realized the only solution the US Government had for her was deportation.
As for the immigration status or citizenship status of employees, no business is required by federal law to to check. Employers are required to ensure you have a valid SSN (to pay taxes), but they are not required to make sure it is legally yours. If they have a suspicion (most don't it keeps labor cost down) it has been obtained illegally they are to report it, but that is about it. So her ability to contribute is quite high.
As for foreign students most student visa do not allow a students status to change, they are most often required to leave the US 2 weeks after they graduate. I would like to see this changed and make it easier even for someone like your co-worker.
I understand your concern about people being their children here to become American citizens. I think we have had families come here for centuries with there children in hopes for a better life. Allowing the brightest and most dedicated to stay here will not harm this country, only strengthen it.
As for the lost opportunity of a legal citizen, you yourself have pointed out that if she were to remain here without a change in her legal status, she will have to work her life in a shadow economy. Most parents would not be all that interested in their child working under the table or at less than a legitimate job. If her status was to change then the job goes to the best qualified applicant.

By then any economic opportunity will most likely have been lost as she will have established a successful life in her home country by age 28. My solution is to let her apply for citizenship, review her application based on merit, and any other person here illegally should be allowed to do the same. Export the criminals and allow the good immigrants to apply for citizenship and stop the madness of destroying families. Yes, you make a good point. But, there are two problems with that. First is that the US doesn't need more people and the second is that too many of today's immigrants are not will to assimilate. They demand that public schools provide education in their native languages. In many areas, including my states, even ballots must be in multiple languages. They may be coming here, but they clearly consider their native country to be their true home and allegiance.

Actually, Mark, I work for a school system in my town, and if my personal taxes didn't go to this particular illegal woman (she's 18), they absolutely have and are going to the children of illegals here in the form of free breakfast, free lunch, free dinner, and free childcare until 7PM. That's at 3 of the schools in my district. And when they or their parents need medical care, they can go to any of our hospitals and get free care ... again -- paid for by my taxes. There are free English lessons for the parents, and the children are taught in their native language until they can speak English; my taxes pay all those teachers. My state also has a lot of Puerto Ricans living in it ... they're legal, but most of them are on welfare AND we pay for every one of them to take a round-trip to Puerto Rico every year. Frankly, I think I've done my part ... and it's only that I don't live in Miami that my taxes haven't gone to educating this woman. HER MOTHER IS IN COLOMBIA, by the way, and her sister is going with her ... it's not like we're sending her to a completely foreign country where she knows no one! Are we seriously to believe that her parents never contacted relatives in Colombia and that she won't have any aunts, uncles, or cousins she's known from afar all her life surrounding her? I read part of what has been said in the replies, but what I want to know is what will happen to her parents? If she is allowed to stay, they will start that her parents need to stay because that will break up a family. ANYONE who is in the USA illegally should be deported. No one needs to be exempt from the law. I agree the girl worked hard, but that did not give her a right to a free education that we paid for with our tax payers money. Second, I am sure that if they live within a community, they receive the same education as all the other children; if they live on a reservation, they are educated there. A scholarship? I never got a scholarship, and my father worked three jobs to be sure that he could send my siblings and me to college! She's already gotten an Associate's degree at our expense ... now she's 18, an adult, and if she were an American male and had a draft because of a war, she could be sent anywhere in the world. An 18-year-old who surely has relatives in Colombia should be able to manage to do well there or apply to re-enter the U.S.

I do think that should she leave the Country she should not be treated as if she had been deported, and be allow to apply for a resident visa, to obtain a green card, and further her education, and naturalization if she still wants to live here.

Why not allow her to apply for a student visa and while she goes to college apply for citizenship. I understand that she was brought here illegally by her parents 14 years ago when she had no say in the matter, but now she is an adult and should seek to rectify the situation not just be turned loose with a free pass. If, at the time her student visa expires she has not applied for citizenship and followed through on it she should be deported. I think that would satisfy the law and allow for her unusual circumstances. It would give her the opportunity to correct the situation and if she does, OK. If not, it was her choice to not follow through with the conditions of her being able to stay. Either way, problem solved, and it would be totally up to her.
Because there are only two ways to apply for residency/citizenship. You either have a parent, sibling or child who is a US Citizen and sponsors you, or you have an employer who sponsors you. If you don't have one of these, you are out of luck.
According to the articles I have read, her father is a "resident," which I would think means citizen; if they're sending this woman and her sister back, you'd think that if he's illegal they'd send him with them. Her mother is already back in Colombia.

Yeah, because before 1939 to be in the USA legally all you had to do was to be white and show up... There were no limits or quotas for Europeans coming to USA.
These days the path to citizenship is impossibly complex and it can take up to 20 yrs and 10s of thousands of dollars in legal expenses. The only way you can ever be int he USA legally is: marry a US citizen (the simplest and shortest path - only about 6 yrs to citizenship), being granted refuge (don't know anything about that path) and being a professional in high demand (the lucky ones can get citizenship in about 7 yrs, takes about 10 on average and in some cases - like mine - it wil be more like 17 yrs).
Although I have no particular love for illegal immigrants, in a case of a minor being dragged to the USA by parents - such person should be deported back with parents if below 16 yrs of age, given an emancipation option between 16 and 18 and being able to stay if they are past 18 yrs old and been living in the USA at minimum for 5 years as a minor below the age of 16.
Deporting a person that knows only USA for her/his entire life as far as they can remmeber to an essencially foreign country is inhumane.

They had no hard and fast borders, or immigration centers. No applications were required to enter North America, and Native Americans themselves came here from elsewhere. So basically until 1921 you could just show up as long as you were from Europe. After that time there where number limits but no impossibly complex procedures of today. YOu showed up, you got processed and you got your residentship. Today it is harder to come to the USA as a turist than it was in 1920s to come to stay.
