This is a tough call, considering that she was brought into the country illegal, but spent all of her developing life growing up as an American it would be hard to say she isn't naturalized in the same way a person, who was born here, was. I am inclined to let her stay but make her parents pay a fine. The fact is that it is unfair to those who have decided to immigrat legally, and face our byzantine immigraiton laws to boot. I am consistently floored, and angered, when I see how hard it is to get into this country. I know very bright individuals who came to he US to be educated but had difficult time finding work. Torn on this one. Most times I see it in black and white, but this is the only country this kid has really known. I am familiar with the IB program; she received a very rigorous education, and earned nearly straight A's. She's not a social miscreant, from what I can tell, and deporting her would only serve to be an asset to the country she was from. We need educated people. I am not sure if I want her deported. Her parents are to blame. That being said, I really resent the fact illegal immigrants come to our country, and then protest about immigration--which is (in my opinion) a totally different subject. Let people in on visas but take , photos, finger prints and DNA samples. MAKE them report in at appropriate intervals. But be prompt with deportations when called for. First off, undocumented immigration is a civil offense, not a criminal one.

And what other "non Civil" laws did they break? How about "borrowing" a social Security number to obtain work, social services, education, etc. ? Whether it is civil or criminal, they and she are still breaking our laws. What other laws would you suggest we ignore? How about Drunk Driving? Or maybe the Securities and Exchange Code (Bernie Madoff would like that)? Or perhaps the theft, shoplifting, fraud, etc laws; is that OK with you? I respect her for her academic achievements, but she needs to go back and apply for legal citizenship like everyone else. Don't get me wrong, I am all for immigration - LEGAL immigration. I know so many people - fellow classmates, colleagues, neighbors, friends - who have either experienced the legal immigration process themselves or their parents have. Entering the U.S. illegally is a criminal offense ONLY if the person was previously deported in which they can be sent to a federal prison and then deported once again. I see that, as usual, some are making the claim that entering the United States illegally is not a crime, but simply an "administrative" offense. This, of course is a LIE!!

Illegal entry is a violation of the UC CRIMINAL CODE. First offense is punishable by a fine and up to 6 months in prison.

The only administrative part of the statute is the governnment's option to DEPORT the offender administratively. This way, the taxpayers don't have to pay for the illegal's imprisonment, lawyer, and jury trial.

And before anyone flames me on the technicalities of that law I'm aware of how a few overzealous and uncouth individuals may use it to push an agenda of racism and "purity" but the law is the law and no one is above it. While she may not have had intent to break the law as a four year old, the instant she realized that she was here illegally she should have taken steps to either 1) get a visa, green card or passport or some form of legal authentication for her to be here or 2) take steps to become a naturalized citizen. Having said that, you didn't address how she would be a valuable economic asset to America should she stay. She can't do that, legally, if she is an illegal. As far as I'm aware, US businesses are still supposed to check the status of a person's citizenship (be they native-born or naturalized or by other means legally allowed to be here) before they hire someone. In terms of foreign exchange students, they are here on a student pass. If that term is coming, and more than likely they are aware that it is coming, they too should take steps to stay in this country legally if they want to stay here. From what I can tell though, many elect to go back so they can bring their "skills" and "education" back to their country of origin. I do not know why, it is their reasoning and that's not for me to judge. For those who do stay, is it difficult and arduous? Yes, in fact a co-worker of mine just got his citizenship about two months ago because his student visa was going to expire and during the whole time he was going through the process he complained about the studying he had to do and the hoops he had to jump through.

There are no steps to take for her to gain legal status in this country once you have entered this country illegally. (exception: if you are the victim of abuse you may qualify to stay) All forms of legal immigration require that you start your process in your home country. (exception: asylum, refugees from war, and people coming from communist countries) Once she realized she was here illegally, she also realized the only solution the US Government had for her was deportation.

As for the immigration status or citizenship status of employees, no business is required by federal law to to check. Employers are required to ensure you have a valid SSN (to pay taxes), but they are not required to make sure it is legally yours. If they have a suspicion (most don't it keeps labor cost down) it has been obtained illegally they are to report it, but that is about it. So her ability to contribute is quite high.

As for foreign students most student visa do not allow a students status to change, they are most often required to leave the US 2 weeks after they graduate. I would like to see this changed and make it easier even for someone like your co-worker.

I understand your concern about people being their children here to become American citizens. I think we have had families come here for centuries with there children in hopes for a better life. Allowing the brightest and most dedicated to stay here will not harm this country, only strengthen it.

As for the lost opportunity of a legal citizen, you yourself have pointed out that if she were to remain here without a change in her legal status, she will have to work her life in a shadow economy. Most parents would not be all that interested in their child working under the table or at less than a legitimate job. If her status was to change then the job goes to the best qualified applicant.

The intent of the immigration laws are to keep criminals of other countries out...not to keep good people out. Some of you mentioned the Ohio boy as a similar case but it was not. The student in Ohio broke the law by selling drugs which put his case before the immigration board. He's now dead.

Is that what you want to happen to this Miami student? My solution is to let her apply for citizenship, review her application based on merit, and any other person here illegally should be allowed to do the same. Export the criminals and allow the good immigrants to apply for citizenship and stop the madness of destroying families. Anyone raised in the US for most their young life may not be able to survive in their native country and sending them back could amount to a death sentence.

Wow! Really have to wonder about some of you. Okay so I guess in your special, special world four year olds have the resources, maturity and knowledge needed to immigrate to another country(in other words it's even remotly possible small children have even the smallest say in where their family lives). Even if they had the necessary resources they don't want to leave behind their friends, family and pets.
Having worked with refugees I can tell you that even when coming from unrelenting violence and poverty children have to be drug here kicking and screaming. They don't want to leave everything that they know behind. Young children have a well deserved reputation for resisting change.
Given the recent lack of innovation needed to fuel the job market and economy, and the fallout we all now suffer from because of that lack...If a super genius four year old is able to make their way here on their own(like so many of you apparently think that this girl did, again WOW) then I say welcome and please quickly invent or innovate some jobs for our children because at this point they don't really seem to have any options (other than caring for our growing elderly population)

It is a sad thing, but where do we draw the line. Illegal is illegal. Do I as a taxpayer in a state that is going bankrupt feel the need to support either through taxes to pay for schooling, or social services and food stamps for a person that is here outside of the law. Sadly she is the victim so send her home and put her parents in jail and let them work off what we the taxpayers paid to support them and her while they were here illegally. And once this student is deported she should have the right to be put in the front of the line to come here legally, because this is all she has ever known.

I know this may suck, but we have borrowed through two administrations to pay for wars we are fighting. We are borrowing money to pay our enemies so they let us fight a war while they are using these same funds against us. I am at the point that outside of a democratically elected society we need to pull all funds from them. If you want to have your religious places that you are supporting teach to kill us then not only should we cut you off but freeze all your assets. We need to tell the tree loversr's that in the name of national security we are going to ween ourselves from foreign oil (and yes it can be done, we have enough oil in Alaska to supply this nation for the next sixty years, not to mention that we have a problem with a country that we are giving money to (Russia) has gone to the north Pole and planted a flag and started building fortification there because of the natural resources found there. So why are we helping them out and giving them money. We need to look to our own, to become independent rather then give our money to corrupt regimes or governments that hate us and fund their religious institutions to teach to kill us, we have fought for them to keep free and how do they repay us, they gouge our money and do everything they can to run us under.

We need to seal off all our boarders, change the laws to allow foreign workers to come here and work the jobs that we do not want to work, but tax them like SSI, and us the funds to secure our boarders, administer the programs for their workers vista's and enforcement and what is left over put back into the coffers of SSI that both parties have stolen from us the payers.

And I can say this because my grandparents came here legally, my wife came here at three months old out of camps in Thailand, because her people were under assault by the Communist Vietnamese trying to kill them for supporting us. But they came over here legally (and for you morons that believe they get tax free status, free houses and cars, use your computer you are reading this on and you will see they come here with nothing and get very little help from the government while they are getting settled in.

So let's for once worry about us, change the laws to make illegals born in this country be citizens of the country their parents came from, and the violent ones we need to rid of with extreme prejudice, and if they die in the process then one of our citizens will be free from being terrorized by them if they sneak back over here again.

She should be immediately deported.

Her parents and any collaborators in the fraud they committed against the United States government, as well as the Florida, and North Miami and it's school district should be arrested and tried for their crimes against us.

They should promptly be deported after serving their time, and be required to pay for the education, and any other benefits they illegally received.

Those benefits are paid for by United States citizens, and are there exclusively for United States citizens only.

From now on, all school districts should require proof of legal citizenship, visa, or immigration status before being admitted.
