Woman's lawsuit against Roman Catholic college says roommate had too much sex

A New York woman has filed a lawsuit against her former Roman Catholic college in Boston, claiming administrators didn't do enough to help her when she complained that her roommate was having too much sex in their dorm room.

Lindsay Blankmeyer said in a federal lawsuit that she suffered from depression and attention deficit disorder before she enrolled at Stonehill College, but was driven into a suicidal depression after school officials wouldn't give her reasonable housing alternatives to get her away from her roommate at the school in Easton, Mass.

Blankmeyer said her roommate had sex with her boyfriend while she was trying to sleep just feet away and also participated in "sexually inappropriate video chatting" while Blankmeyer was in the dorm room.


After trying unsuccessfully to persuade school officials to force her roommate to move out or to give her an acceptable private room, Blankmeyer ended up living at a hotel, according to the lawsuit filed earlier this week.

"Stonehill refused Lindsay's request for a single room and in the following weeks and months Lindsay fell into a dark and suicidal depression requiring her to take a leave of absence from school and undergo extensive psychiatric and medical treatment," the lawsuit states.

Blankmeyer eventually completed her final semester of school at her home in New York and received a bachelor's of arts degree in September 2011. Blankmeyer enrolled as a freshman in 2007 but the lawsuit said problems began her senior year.

The lawsuit, filed in U.S. District Court in Boston earlier this week, seeks unspecified damages.

Stonehill spokeswoman Kristen Magda said the college responded "swiftly and professionally" to Blackmeyer's complaints about her roommate, first trying to resolve the dispute through mediation with a residence director, then by giving Blankmeyer "multiple options" for campus housing, including a private room.

"At no time did the student notify college staff that her concerns involved her roommate's sexual activity," Magda said Friday.

Blankmeyer's lawyers did not immediately return calls seeking comment.

In the lawsuit, Blankmeyer says the college offered her two options, one was moving to another dorm where she would live in a room that was previously used as a study lounge and was a "small cubicle-like space." The other option was to move to a dorm with a reputation as a "party dorm" to live with a girl Blankmeyer did not know.

No roommate should have to endure another roommate's sexual escapades. It's called common decency and common courtesy, and it's sad that the roommate completely disregarded what's decent and respectful.

I see it differently. No roommate should be forced to cut back on sex. Perhaps it would have been different if she went out more or if her roommate tried to hook her up with someone.

Of course earlier that day I would have left signs around campus notifying everyone of the free sex show. Since that couple likes doing in front of her, they wouldn't mind a few hundred other people watching now would they?

It's college, your living in a dorm, not everyone shares your values. Moving in with a girl you did not know? It's college, you live in a dorm. If you can't deal with it, take the cubical room, the unknown roommate, move off campus, or change schools. Does this girl expect that everyone on campus & living in the dorms would be a childhood friend? I can't even count the number of times a room mate was getting it on across the room. Crap, people do it on plane flights next to a couple hundred of strangers. Is it always in good taste? Probably not, but at least it's natural & at times pretty darn entertaining! There are worse things in life to take up the sword against.

johnny, from what i read, ms. fluke didn't talk about sex during her testimony. she was there discussing a classmate who had ovarian cysts and couldn't get her prescription paid for that would have taken care of the issue-the scrip being for BC pills.

rush was off the mark; he should have made sure of what fluke was discussing before his latest idiocy. and now you've gotten sucked into that as well.

This lawsuit is a joke. She was given two possible options to rectify to problem and chose not to take either one of them. This is no one's fault but her own. She could have moved in with a new roommate or into a smaller room by herself. The college gave her these options and she made the decision that she would rather whine that take one of these options to solve the problem. Not only should this woman not get anything in the way of damages, she should be forced to pay the colleges legal expenses in defending this ridiculous lawsuit. The bill should be split between her and her shyster lawyer who filed the frivolous suit to start with. I am sick of these scumbag lawyers clogging up our legal system with baseless, meritless suits. It is time they started paying the price for wasting the court's time and resources with these cases.

I gota be honest i have to agree with UnitedStates1776 way up top on this one. She was clearly given alternatives that are reasonable. Heck im living in the dorms here and it clearly states that you can ask to be moved at any time but THEY will pick where you will go. She clearly just didn't want to even TRY to move someplace else. Realistically she should have just moved to the other dorm options and at least TRIED them out first.

This arguement that this activity caused her to have "suicidal depression" is not only ludacris but BLATANTLY an attempt to get money because... i mean for rea? Who gets suicidaly depressed over this? If it's true she was suicidially depress it had more to do with herself or something else than with her roommate.

I agree that nobody should have to endure having a roommate engage in sex with another person, while she (or he) is in the room.

However, the college gave her a couple of alternatives, including another, private, if small room, and transfer to another shared room.

But, horror of horrors, the other, private room was too small for her liking, and she did not already know her prospective, new room mate [whom seems to have unknowingly dodged a bullet here].

College life does not promise perfect living conditions, only reasonable comfort. From the story, that obligation appears to have been met. Were I on the jury in this case I would not award her one thin dime.

Taking money for sex?...that's pretty much the context he used the words slut and prostitute.

The Obama calls HER and apologizes, commiserates with her, offers her his support. Just like he did with Karzai. AH, but what a PERFECT story to DIVERT, DEFLECT, attentions away from his apology to Afghanistan for a few defaced books being accidentally burned. Does he demand an apology from Karzai for the Afghans MURDERING 6 American troops? NO HE DOES NOT.

In Wisconsin the teacher's union sued the school district for not covering Viagra in their health care plans. They eventually dropped the suit because of bad press coverage over the issue. It still cost MPS (The school district) $20,987.50 on legal fees.

Why are so many idiots bringing up "Viagra" being covered on health plans and assume their political opposition are demanding it? I would wager it is just plain liberal ignorance of the actual facts behind the issue.

The only Catholic College is Easton is Stonehill, where your child spends roughly 47,000 PER YEAR on tuition and room and board ONLY. I'm sure some of the kids are nice citizens - this one, however, sounds like an entitled brat with a father who is a lawyer.

I didn't care when my roommate had sex, I slept with earplugs or music headphones anyway - unless I was having sex.... didn't bother me in the least when she did. Our only rule - boys out when we get up in the morning. I didn't even like a particular roommate - but what she did on her side of the room didn't matter to me at all. It's called "tolerance." This girl needs to get some serious help if her roommate having sex made her suicidal - that is crazy.

This is common in campus housing. The problem is that you have people who are young adults but really still pshchologically children. She probably felt embarassed to be that specific in her complaint. Has the school produced documentation to show options were offered? At this point it is their word against her word. It is common for the person being sued to deny knowledge, so I am not impressed with the school's claim. It is also common on campuses for the adminsitrators to ignore compaints in hope that they go away.

No one has to spend their nights just feet away from others engaging in sex. That is not a reasonable suggestion on any level. Nor should she have to be exposed to the video chattting. Really?

For those that are not aware, if she has the diagnosis that are listed in the article, the school was aware of her challenges. Documentation is submitted upon enrollment so that if health services are needed they can provide the proper care. The school had a duty to move her or the roommate. That is why this lawsuit is viable.

The only problem with the solution that Chris from Y.... proposed is that the girls would have found herself in court defending herself as the kid from Rutgers.

This is a common problem among every college in the the country where boys are allowed in the women's dorm rooms(some colleges don't allow men to be there). Perhaps she should have looked into one of those colleges or should have paid for a private room. I can't believe she filed a suit over this!

I know from experience that you are allowed to change roomates at the beginning of each semester. I remember having roomates that used to keep me up at night partying. In all likelyhood, she was probably failing her classes and was looking for someone or something to blame it on.

A few people dragged Rush into this thread, so I thought I'd share how he checks his facts. I was listening to him a few years ago rail about Texas changing the way we select people for jury duty. The names used to come from the list of registered voters. The problem with that was that a lot of people wouldn't register for fear of jury duty. So, the legislature changed the source to licensed drivers. A local attorney named Connie Williams (I'm a lawyer and have known Connie for years) was asked by some national news agency to comment. Connie said that it was a good idea as it drew from a larger pool and we would see more diversity in the jury pool.

Rush was enraged and said something like 'can't you just imagine this smug, skinny, pasty-faced woman with no make-up representing criminals.' I saw Connie the next morning; he said he didn't know Rush commented about him. And, he's black. Rush, an admitted drug addict, may have fallen off the wagon . . .

    "Cubical dorm room"? Most dorm rooms I have seen aren't all that big to begin with. Most singles are just big enough for a twin bed, dresser and a desk. Sounds like this woman had no friends and stayed in her room most of the time. My kid had a problem with her roommate being a fall down drunk. The little princess had constant supervision while a child and let the badger loose once mom and dad where miles away. She passed out in the hallway once. My kid was constantly being woke up by her because she was too drunk to make it back to the room. Then my kid would call her boyfriend and they would have to go and help her. The girl drank so much one night she was rushed to the ER with alcohol poisoning. My kid got together with another kid who was having roommate problems and they just put the two offenders stuff in one room and took the other for themselves. Problem solved. This woman sounds like a friendless prude of a little princess who can't think and act for herself.

    Chris from Yucaipa; there are Web sites that pay college kids for their group sex tapes - far more than 100 people see them. I think I'm pretty open minded, and though this sounds crazy to me now (at age 56), I could see myself getting partied up enough in my youth to get naked and buzzed - and see what happens. If I did that now; they would pay me to stay clothed.

    Depression can come from just about anywhere - it's a judgement call....unless you are living what that person thinks they are living, you can't convict using a blanket defense. If I was forking out the amount a private college charges - and started to fall behind because some juvenile who has never been away from home - wants to make up for being at an all girl school for 12 years...well, screw her - students don't pay the money they charge these days, and not get to have a voice. I tried to take 3 Accounting classes in one semester in 2009 - you fall just a tiny amount behind...and it's panic time...you don't get to slow down the run-away train.

    Colleges are the biggest dictators you will encounter when buying a product - in this case; an education. We pay less a year on a car loan - and one small thing on it doesn't work right - we come un-hinged. So at least let her rant - sometimes it isn't about if you win or lose - it's about taking on the fight.

                Chrissy- Satanick (and you) may be right. In fact, I'm sure you are. But, 99.9% of people reading the article would have known exactly who the writer was referring to. I don't understand why people waste so much time debating less than perfect grammar on here. See, I've wasted too much time on it already. Now, horrible spelling...that's another matter.

                  Oh GROW UP!! Everyone deals with annoying crap from their college roommates. Anyone else notice that her desire was to either kick her roommate out or for them to give her another PRIVATE room. Most colleges are perfectly accommodating to roommate issues but they're going to offer her another room with another roommate. You don't get to turn a roommate issue into a private room. I knew lots of people who swapped roommates more than once, it is not a big deal. Clearly she was looking to get a bonus prize by whining as loud as she could. Oh ... and suicidal depression .... as a college student???!!!! I'm shocked!! That must be such a rare occurrence on college campuses, it must be so unheard of that they probably don't even offer any kind of student counseling.

                  Now that it's over & she didn't get her way she wants to try the legal system to get herself a monetary bonus prize. I just hope the college doesn't bow to the pressure & give her some kind of settlement just to shut her up.

                  Even-though this is gonna sound a bit rude I'll say it anyway. Perhaps if she was getting a little herself she wouldn't have been so depressed.

                  My husband grew up a straight-laced Christian all his life, and I mean SHELTERED! The boy in the plastic bubble was not as sheltered as my hubby! Then he met his college roommate and my husband got quite a different kind of education! His roommate "Joe" was a total alcoholic. My husband would try to ensure that a drunken Joe vomited in a trash can beside the bed after a night of heavy partying; sometimes he rang it, sometimes he missed. Joe would do crazy stunts in the dorm that gave them BOTH bad reputations; my husband got his bad reputation by association. And through it all they went from thinking the other was a total freak to being great friends. And not once did my husband suffer from suicidal thoughts or deep depression as a result of his roommate's hard living. College is the ultimate test to the ability to survive away from home and if you can't pass, you're in trouble. Sure, her roommate was a total slut, but honestly she seems a little silly about it. If you couldn't figure out how to survive THAT, how are you going to survive REAL LIFE? Oh, and for the record, both Joe AND my husband are both upstanding members of the community and great family men. How about that?

                  My daughter had a very difficult freshmen first semester: her roommate would wake her up all hours of the night when she had 7 am classes just to be mean...like every hour on the hour. After one semester of this, my daughter was becoming ill and her grades were falling. No one was listening to her. Finally, I had to step in and speak to the Dean of Students. She got her own room the next day, her grades went right back up and she graduated with honors.

                    Betty: your daughter would have been better served if she took care of the problem herself (I'm guessing she is an "adult" over the age of 18), with some strong advice from you on what to do. I always question whether any of my children actually have done everything that they should when there is a problem. Usually, they will own up to not taking care of something they a capable of doing. Unless you want to care for them until you die (or they do) a parent should only have to assist their adult children when no one really is listening to them. In these lawsuit happy times, no school will blithely ignore issues of harrassment, bullying and abuse.

                      I wouldn't want to live in a dorm room with a roommate who has no concept of privacy or decency, but I agree that it sounds like she was trying to get a nice, private room all by herself without paying more. From previous experience, private rooms ALWAYS cost more than doubles. Heck, I lived in an apartment with 2 bedrooms, six girls, and one bathroom. You'd be surprised what you learn to live with. I don't think she should have had to suffer through her roommates escapades, but I'm sure the college offered her alternatives. Suing the school is just taking things entirely too far.

                      I had a roommate in college who was a drug addict. He would do drugs in front of me. I didn't want to go to jail so he could do drugs. So I handled it like a reasonable person. I asked for a new roommate and asked for a single room next year. I got both and was perfectly willing to pay extra for the ability to better control my own space.
                      She was not being reasonable. Having sex isn't illegal. She felt entitled to a single room. Find me a person who didn't have at least one lousy roommate in college and I will tell you that person either commuted or is the exception, not the rule. This lady needs to grow up.

                      That so reminds me of when I was in college. Streaking (guys and gals) had become popular and on our campus, brought out a pervert who "visited" the women's dorms hallways. Since there were about 200 of us women on campus out of 4000 students and less than half lived in the dorms (science and engineering college in the early 70s), he didnt have many options to "exhibit" himself. The fourth time he visited, he "revealed" himself to the wrong person. He opened his coat and she burst out laughing while pointing to his "part" so loud that many came running and he ran out, never to be heard of nor "seen" again. He should have realized that women aspiring to be engineers and scientists, especially back in the 60s and 70s, would be phased by a "minor" male annoyance. We had already had to deal with the bid ones - the male egos in reaction to women wanting to become engineers and scientists. When I obtained my B.S.MA, the ratio was 1 woman to 17 men ... a generation later, when my eldest daughter matriculated in aerospace enginineering and became a "rocket engineeer", the ratio was 1 woman to every 16 men enrolled. The only difference was less attitude from the gents.

                      Streaking continued till the weather got cold, and then the fad faded away.

After the 3rd time I would have been like, Dude look I got class in the morning you need to take her some place else. But mentally disturbed by it? Sounds like this girl has some issues on her own. While its disrespectful collage is a place to grow up. I had to put up with very similar issues and I did not go off the deep end because of it. A lawsuit is not going to fix this girls issues and neither is compensation. She really needs to be looking at why this screwed her up so bad and deal with that.

                        That is part of that religion. It is considered a sin. So what?

                        Muslims throw rocks at adulterers until they are dead. They also execute homosexuals in the name of their faith. The bible calls for the death of homosexuals as well.

                          Depends on the school and how full they are. I had a roommate from hell when I was a freshman and it took nearly three months for the school to agree to let me move because the only available room was in the upperclassman dorm. Most students lived off campus so there were only freshman dorms and one dorm for upperclassmen.

                          I remember reading about a big state school that got into trouble a few years ago because they accepted more students than they had room for based on the assumption that a certain percentage would also be accepted elsewhere. They got a big shock when more students than expected enrolled and had to scramble to find rooms/apartments/hotels for them to live in.

                                You're right it does. And I think most people would have no problem paying for it IF it were for just that one thing.                                   My room mate in college would mention to me that her boy toy was going to be spending the night with her. I just grabbed a blanket and pillow, went to the common area, joined the other girls who was doing the same thing because of their roommates actions. No big deal.

                                  Who, except for stupid people, want to watch other people have intercourse? But in college, trying to find a private place to have sex can be hard to find. So a lot of nights, the common area of the dorm was a place to sleep, and no one was bothered, but yes, stories were told about who your roommate was doing it with.

                                  And almost every female I was in college with spent time in the common area, or their roommates did. It wasn't a big problem. And yes, women do at certain times, get horny just like the men are all the time. Big deal, who cares, except the pugbags?

If the attorney can escalate it to a "class action" suit, he might make 100 or 200 million dollars to defend her honor.                                       I'm going to assume that you have no idea how group litigation works, if you think a single, poorly supported case can be somehow magically spun into a class-action. Furthermore, class-actions usually result in large figure settlements not because of greed, but because restitution has to cover a larger number of claimants. If this lawyer were able to find fifty or a hundred people who had experienced the same circumstances (which seems unlikely, as the college did attempt to rectify the situation when it was brought to their attention) and file a class action, Blankmeyer would likely stand to receive less than the sum she's seeking in her suit now.

                                        Riiiiight! This bitch became so suicidal that she decided not to throw herself off a bridge but, instead, to file a frivolous lawsuit in the hopes of scoring a big payday without having to work which, undoubtedly, would relieve her of her suicidal tendencies while she enjoyed a long Mediterranean vacation paid for by anyone other than herself.

                                        Actually, she would probably use the money from such a suit or settlement to hire some blind male prostitute since it's obvious she can't get laid any other way.

                                          TOO PERFECT.

                                          I too, had a similar situation in college. First roommate was afraid of me. No idea why, never did drugs or any kind of difficult behavior to deal with, but she was nervous around me and actually started sleeping out in the hall. Resident Life assigned me to another room for a roommate swap. Then I got my at first friendly Catholic girl soon turned moody hypocrite.

                                          You see, she didn't like my boyfriend. He had long hair (and he treated me like I was special and was very sensitive to my insecurities of being in my first relationship.) Bad stuff. Sat me down and dictated that I was not to bring him in over night nor do any kissing or schmoozing in her presence. Fast forward two months, and little miss devoted Catholic got drunk and had sex with a random guy in our dorm room while I was sleeping.

                                          Thankfully, I sleep like a rock.

                                          She never saw him again. I dated my first man for 10 months.

                                          However I never took it up with the college that my roomie was a moron and instead confronted her on her hypocrisy, and certainly never thought of suing.

                                          Ridiculous. Welcome to the real world. I hope the judge laughs and kicks this stupid lawsuit out the door.
