Jailed killer had dad, girlfriends cash unemployment checks

A convicted murderer awaiting trial in the Los Angeles County jail system had family cash nearly $30,000 in unemployment checks, the Los Angeles Times reported.

Anthony Garcia’s father and two girlfriends reportedly cashed those checks, $1,600 a month, and also deposited money in his jail account and that of other gang members.

His father, Juan Garcia, 47, and girlfriends, Sandra Jaimez, 45, and Cynthia Limas, 25, were charged with unemployment fraud, the Times reported.


The investigation into the benefits fraud lasted a year and a half, from October 2008 to March 2010. It is illegal to receive unemployment benefits while in jail, according to California's Employment Development Department, but it is unclear whether Garcia, 26, could be convicted of a fraud-related crime as the money was deposited into his account.

Garcia was charged with the murder because he had a detailed murder scene inked on his chest. A detective investigating a 2004 murder case was looking through snapshots of tattooed gang members – who are photographed with their shirts off so that police may catalogue their tattoos – when he came across Garcia's tattoos. Garcia had been photographed after being picked up for a traffic stop.

Garcia’s tattoo spans his chest and bears the words, “RIVERA KILLS” above a liquor store lined with Christmas lights. There, John Juarez, 23, was gunned down. Rivera is a reference to the gang, Rivera-13.

Garcia was booked, and sheriff’s detectives disguised as gang members coaxed a confession out of Garcia in his cell.

Ahhhh, a gang member having his family and "girlfriends" cashing unemployment checks. I wonder if the checks came from California or Federal coffers ? If Federal, this guy should be sent to FEDERAL court, then to a California court.

Wait, what about his father and "girlfriends" ? Have they been screeneed for citizenship status ?

I also wonder if this guy filed for an IRS Refund ? Might was well since other inmates do it.

Might as well "kill" two birds with one stone......jail.....then deportation IF you get out of jail.

I'm sure these types of crimes occur in other states. Maybe California is more lax in keeping records than the other 49 states. Based upon this story, there's no way to know.

I am not understanding the issue, he was incarcerated. How else was he to cash his check if he couldn't go to the local check cashing joint? And, Johnny N., he's likely a US citizen, where would they deport him to? The city he already lives in?

that's convenient how California takes your unemployment insurance payments (money paid by your former employer, rightfully yours) when you get thrown in prison. As long as he's working in prison, he should definitely get the balance at the end of every week...

To be eligible for unemployment you have to be available and actively seeking work, in that light the inmate is an accomplice to the fraud crime since he recieved money from the cashed checks. California authorities may figure it out eventually

"That's California for you...." Who cares? I would think the employer was in on it, all they would have had to do was tell the EDD the guy was not at work because he's in jail. As in any state, you pretty much collect if the employer doesn't object. Since the checks weren't mailed to the jail. Also, what state isn't broke? Becuase the Stae is broke, alot of people who could have been employed looking into these things aren't.

What about public officials receiving retirement income from a previous public position as well as a pay check while serving the public.

In many well run states (which apparently excludes CA) you need to periodically show up at the unemployment office and show effort in finding work....................apparently not in this state that is bankrupt because of its generous handouts.

OBXRon.... Unemployed persons in California haven't had to periodically show up at the unemployment office for at least 20 years. However, you need to be ready and able to show up for work, which I somehow don't think that Mr. Garcia was able to do. Unless this has changed, in order to continue unemployment you need to call into a call center and enter your unemployment information. And I would like to know what type of job Mr. Garcia held that he was able to collect $1600.00 per month.

doyourhomework,America! you are joking right? When you file your weekly claims it clearly asks if you are availbnle to work - someone sitting in prison is not available to work so his girlfriends that called the claims in or filed them online all committed fraud.

And SusieCue - why would you ask what kind of job he had? 1600 a month is 400 a week - so what? Unemployment is based on your wages when you did work. Alot of people that have decent paying jobs would qualify for the highest payouts plus Cali might give extra amounts for any dependents one has.     The investigation took 1-1/2 YEARS to complete - 18 months at $1,600/mo.?! Why does the government move SO SLOW? There is ZERO reason for a fraud investigation to take that long.

    Again I say, there should be an IQ requirement to be employed/elected to a government job/office. If you cannot pass the IQ test, you cannot have the job. Bet things would move a lot more quickly if intelligent people were working for us.

    I do not understand the man is in jail AWAITING his trial, he has NOT been convicted of anything, so why should he lose out on his unemployment? This is neither former President Bush nor current President Obama's fault. This is the fault of someone within the unemployment commission system that dropped the ball or looked the other way on purpose. I have to deal with the unemployment commission for three different states in connection with my job. The ones most difficult to deal with are Florida and Maryland.

          He was probably collecting unemployment when he got locked up and his father and girlfriends decided to just continue cashing his checks. I doubt that anyone dumb enough to have a murder scene tattooed on his chest dreamed up the idea of committing this fraud. I also can not believe that the state does not do any kind of cross check on social security numbers between those collecting unemployment and those locked up in prison. It seems like a pretty easy check to do in order to avoid this kind of fraud. It makes you wonder how many more people there are that are fraudulently getting unemployment benefits. What I do not understand is why it took them a year and a half to put a stop to this. This is not an involved fraud that takes much effort to unravel. It is pretty clear that the guy was in prison and that the checks were still being cashed. A simple check of the bank's security tapes would have told them who was cashing the checks. There is certainly no excuse for allowing these checks to continue to be issued to the tune of $30,000, which it is doubtful the state will ever be able to recover.

          In Oregon you have to check in weekly, and I have had to list the places where I've submitted applications and resumes, and the dates submitted, and if I talked to anyone. There's also a time limit and an amount limit on a claim.

          @ldo - prisoners are not entitled to unemployment but they are entitled to IRS refund checks. IRS refunds are monies that belong to the persons who overpaid or overwitheld taxes. If a prisoner overpaid or overwitheld taxes, then they are absolutely entitled to any and all legitimate refunds. Tax refunds ARE NOT government monies. If the prisoner has judgments against them, including child support, the refunds WILL get intercepted and go to paying the judgments before the prisoner ever gets the money credited to their prison or jail account (prisoners DON'T get to have cash in prisons or jails).

          This problem is more widespread than the government would like you to know. Being that gang members were getting their share of his checks, I would think it would be safe to say that most of the gang members are doing it as well when they can. Its not just California, its widespread. I would bet that he was getting food stamps in his name too. The illegal immigrants and the gangs have this country all figured out when it comes to milking the system. They have the time and the population to seriously hurt this country financially, and they keep getting away with it because it doesn't "PROFIT" someone in the government to stop it. Medicaid, Medicare, Social Security, and other programs are being exploited and run into the ground financially, and our fine government just stands around letting it happen in front of their noses.

            Isn't unemployment run by the government? Isn't it bad for the country no matter who pays? Is it not a true statement that our government is so screwed up and drowning in red tape and corruption that no matter what it tries to do, it fails miserably?

            Have you ever been to or seen a government run job site? You will see 5 chiefs and one or two workers at a job. The job doesn't get done any faster or better than if there was one chief and two workers. In fact, the same patch of road will still have the same or worse pothole in less than a year. Its the same with any gov run operation. 5 chiefs for every two workers, and still nothing works properly. But they all got their fat paychecks though.

            Meanwhile, we have state and federal branches of governing that are bilking and corrupting the system just as bad as the illegal immigrants, gangs, and other such criminals. They run sleazy campaigns to get elected, then once elected, they rarely fulfill promises that they made, then after one or two sessions of something you could barely call legislating,(more like bribe class 101, or letting lobbyist pay for your vote in one way or another), then they sit around and argue over who has the power, go play golf, and then its time to run for re-election. Its no wonder they have no idea who is screwing who over, they are just too damn busy. LOL.

            floyd: I've spent nearly 30 years working in a government office, and unemployment office to be specific and your picture is massively flawed. We have 60 claimstakers and it is not uncommon for all of them to be on the phone taking claims or listening to people tell obvious but unprovable lies while nearly 300 callers are waiting on hold.

              As a 30 year state worker who has paid out millions of dollars in Unemployment Insurance, and can say that, with the number of unemployed people in this country, the employees charged with paying it are almost completely overwhelmed. The only answer is more people to investigate fraud. But that would require more workers. And that would require a way to pay for them. And that would require someone to pay more in taxes. And, from what I understand, no one wants to pay more taxes. So get used to this. As government agencies are strained by overwork and less money, this is going to be an even greater problem. Look at what goes on in Medicare fraud. What some doctors fraudulently steal is vastly greater than what this guy took in Unemployment Insurance benefits and there are not enough Medicare fraud investigators on the payroll to catch even a fraction of them.

                  Thats the problem with our system. People can easily commit fraud but people who actually work and now need help never get a penny.

                  That's a good question, here in MN you have to request it with a number of current answer questions, plus report job search, do they not do that in Cal? Additionally, just how long is this supposed to have happened, at least over two years. You get a percentage of your former salary up to a flat limit. Strange story.

                  I have a friend in CA who was getting it and he not only had to reconfirm info on the phone, he received paperwork asking about job searches in the mail but I guess his family could field the phone calls and paperwork.

                  Shelia: I read a little while back somewhere that it was possible to get well over $400 a week in calif. unemployment. Not too hard to accomplishment for a construction worker or other high paying jobs since they use your highest quarter out of the benefit year. The real crime here was that he was never cross referenced. Computers should be interfaced by this day and age to head off this stuff before it gets past one week. The figures they gave makes it about one and a half years so he was certainly on a fed. extension.

                  They need to be able to place the unemployed with any available job, rather than just let the people say that they are looking for work.

                  My renter applies for jobs that he knows he is not qualified for, and that he won't ever get in a million years (Microsoft, Google, on the stock market, bank manager, Calculus teacher, etc,).

                  He "fulfills" the requirement that he be looking for work, but he's not really looking.

                  These people would be irate if the unemployment agency called and told them that they found them a job shoveling snow, picking up trash, etc.

                  It would be HILARIOUS.

                  It's not hard to collect that much. $1600 a month would be $400 a week. It would come out to $39,600 with all the federal extensions.

                  What are you complaining about? You are getting your rent aren't you? If you feel this is somehow fraud report it. Of course you will whine when their checks stop and you lose your rental income.

                  Where do you come up with 12? She was asking how someone could get $30,000 in UE. He was getting $1600 a month that would come out to $400 a week multiply that by the 99 weeks UE is $39,600. It was 99 weeks back last year when I was on UE counting all the federal extensions. I didn't say he got all the weeks. In GA the max. is $329 a week multiply that by 99 weeks is over $32k so a lot of people get over $30,000.

                    This just shows that even with all the computers and technology, how antiquated most state Government agencies are. When someone gets convicted of a crime, it should automatically send out messages to any unemployment, welfare etc, with the new address, and status of prisoner. Same when someone dies. Solution hire more computer nerds, and update all Government systems!

                    The IRS has spent $ 3,700,000,000 (and costs continuing) over the past several years to upgrade their computer system and ARE STILL HAVING PROBLEMS sending our fraudulent IRS REFUND checks.

                    First thing: FIRE the incompetent "white collar" management people.......then get down and dirty with the computer systems.

                      They need to require a thumb-print, which they need to keep in a computer file, before anyone can cash those checks. Might cut down on the fraud...and this guy's prints were already on file somewhere.

                      So many people could go back to work, but would rather get that unemployment check.

                      The checks are too high of a percentage of the actual wages; cut it to 50% and they'll go back to work.

                      I have a renter who hasn't worked in 2 years because his checks are so much money.

                      Well, look at it this way. For every lazy person who dose not want to get a job and dose not work, that is just one more job for people who do want to work.

                      Your tenant's income source is none of your concern as long as he pays, and even if he dose not, your still not entitled to worry about his source of income. Your concern is a safely maintained building and the occasional eviction.

                      Oh, and please no "but his unemployment jacks up my taxes" You think that even if there where no entitlement programs that you would not be paying high taxes? Think again, The government will always find some reason that they need your money.

                      As for the guy in the story. He slipped through the system. It can happen. Contrary to popular belief, computers are certainly not infallible no matter how old or new they are.

                          We had an employee caught by the police breaking into our jobsite trying to steal our tools and materials. He went directly to jail but somehow managed to file for unemployment. Maryland Unemployment actually asked us "if it was written company policy that employees were not allowed to steal from us." If not, he was eligible for unemployment. This story does not surprise me at all!

                          Keep in mind that in Maryland the employer pays the unemployment, not the dirtbag employee.

                              Tommy D. in Osceola County Michigan allegedly collected $1800+ in food stamps (added to his Bridge Card) while serving 6 months for assaulting a police officer (2nd offense).

                              No one did a thing when he was reported. I'm sure he sold them for 50-cents on the dollar when he was released.

                              His fat pig of a parole officer is his friend and gave him a $250 fine for the assault (the parole officer gives the sentencing recommendation to the court/judge); no anger management; no community service; and Tommy D. isn't even paying the court ordered $20 per month for stealing logs/lumber off of a businessman's property.

                              Those bleeding heart liberal ladies at the Family Independence Agency love to throw money at single non-working mothers; drug addicts; and career criminals.

                              Tommy D. has 7 kids and supports none of them.

                              FIA buys them washing machines; firewood; etc. and they just sell it on Craigslist.

                              If you report them, the ladies at FIA look at you as if you're a snitch...

                              You talk a lotta BS, mtr8. I have not heard you say one time on here about the thievery of the government, or, the wall street guys and the bankers. Oh I know these things must be ok with you; you know your buddies and all. What this guy has done is not nearly as bad, as all the white collar criminals whom over the years have plundered the average working mans retirement. You act as if you never cheated on your taxes and just listening too you tells me you have.

                              While I'm not condoning what this guy has done, he isn't the only one and more than likely never will be.

                              What surprises me the most, is that Nancy Pelosi isn't trying to get them re-instated, she must be slipping in her old age! Well move along folks nothing to see here just another day in California.

                                Think about it....an investigation that lasted a year and a half???? And on funds deposited right under their noses in his "jail account"! This is absurd beyond belief. Now let's fast forward to his trial. He'll probably be found not guilty in 2025 or so... Can't be found guilty based on a tatoo!
