Miami valedictorian who faced deportation gets to stay - for now

A Florida high school valedictorian who was on the brink of deportation has received some good news: She won't be forced to leave the country - for two years, anyway.

Daniela Pelaez, 18, came here when she was four, when her parents entered the U.S. illegally, according to local news reports. And on Monday of last week, a judge ordered her, and her older sister, out of the country.

Daniela "texted me that afternoon, 'Life sucks, I can't believe this. I have to get out by March 28th,'" Emily Sell, Pelaez's best friend, told msnbc.com over the phone on Wednesday. "And I said, 'That's not going to happen. I'm not going to let that happen.'"

Sell started a petition for Pelaez, which she said collected more than 15,000 signatures, and organized a protest at North Miami High School, where nearly all of Pelaez's 2,600 classmates joined in a walk-out last Friday in solidarity, according to The Miami Herald.

"Over my dead body will this child be deported," Miami-Dade Superintendent of Schools Alberto Carvalho, holding Pelaez's hand, said on Friday, reported NBCMiami.com.

High school students fight valedictorian's deportation order

But it wasn't until Tuesday of this week that Pelaez's attorney heard from Homeland Security thatdeportation order had been deferred.

"Two years is good, but it's not the goal," Pelaez's attorney, Nera Shefer, told the Miami Herald Wednesday, adding that Pelaez is "very happy she’s going to be able to finish high school and go into finals with a clear mind."

Superintendent Carvalho echoed those sentiments on Thursday.

"I'm elated over what I believe is a temporary win," he told msnbc.com. "I hope this incites a national dialogue that will address the sentiments of students and young people who find themselves in no man's land. It's time for the nation to take on this issue in a non-partisan way."

The Pelaez family -- both parents, as well as Daniela, her brother, Johan, and her sister, Dayana -- came to the U.S. in 1998. The Miami office of Immigration and Customs Enforcement would not tell msnbc.com why it chose to defer, and not dismiss or uphold, the deportation decision, saying it had “exercised prosecutorial discretion in Daniela and Dayana Pelaez’s case and will defer action for two years."

ICE uses "prosecutorial discretion," in which an agency decides what charges to bring and how to pursue legal action, on a case-by-case basis, the agency said.

"ICE is focused on smart, effective immigration enforcement that prioritizes the removal of criminal aliens, recent border crossers and egregious immigration law violators, such as those who have been previously removed from the United States and returned,” Nestor Yglesias, a public affairs officer, said in a statement.

Repeated calls to Shafer, Pelaez's lawyer, were not returned on Wednesday.

Not everyone agreed Pelaez should stay.

"She should be deported," Linda Simmons, who has a son in ninth grade at North Miami High, told NBCMiami.com last week. "Her parents broke the law."

Read Pelaez's story on NBCMiami.com

Sell, Pelaez's best friend, told msnbc.com she received a lot of hate mail while she was campaigning for Pelaez.

"But I've gotten more positive emails, and I deal with a lot of the hate emails. It's worth it in the end," she said. "She would do this for anyone."

Best friend: 'She helped me through the foreclosure'
Sell told msnbc.com that she met Pelaez two years ago when Sell transferred to North Miami High School.

"I actually transferred to the school sophomore year because our house got foreclosed," she said. "Daniela and I always clicked. We were always close academically. We became friends very quickly. She helped me through the foreclosure. That was a very hard time for me. I like repaying her for that."

The two girls are in an international baccalaureate program, which Sell says has just 80 students, at their large high school.

"In our senior class, there are 30 [students]. We're very close. For Daniela to get deported, it's like a family member to get deported," she said.

Pelaez was invited to meet Sen. Mark Rubio, R-Fla., on Wednesday.

Before boarding her flight to Washington on Wednesday to meet with Rubio, Pelaez told NBCMiami.com, "I'm excited because I've never been to Washington ... I'm very happy and relieved that there's gonna be some help."

Rubio, as well as several other Florida representatives, had publicly supported her staying in the U.S. Pelaez's school superintendent told msnbc.com he reached out to his state lawmakers as soon as he heard about her predicament.

"From the very first day that I learned about this, which is the day that the judge issued the deportation order, I called a number of politicians, and the result has been pretty obvious," Carvalho said. "I'm pleased that people of good minds and good intentions have been able to find common ground."

Pelaez told NBCMiami.com last Thursday that she has no memory of Colombia and loves her friends and this country.

"I've been asked the question before: 'Do I feel American?' or 'Do I believe I am?'" she said. "And I don't think it's a question. I'm American. I know the national anthem. I know the laws. I know what it is to be an American."

Her older sister, Dayana, is 26, and couldn't go to college because she's not a citizen, Sell told msnbc.com. She works to help support the family.

Pelaez's older brother is in the Army and is a citizen; her father obtained citizenship through her brother, NBCMiami.com reported. Their mother had divorced their father and returned to Colombia for health reasons shortly after moving to the U.S., said the station.

Pelaez has a near-perfect GPA and has applied to numerous Ivy League schools, and she dreams of being a cardiac surgeon, Sell told msnbc.com.

She's the best in bio," Sell said. "She did a medical program with the University of Miami, and she was literally salivating at it! She was like, 'I looked at cadavers today!' She wouldn't get to do that in Colombia."

Pelaez has been overwhelmed by all the attention her case has garnered, Sell said, but hopes it brings change for other kids like her --  whether they're class valedictorians or not.

"Immigration is extremely controversial," Sell said. "A lot of people have polar feelings on it. Immigrants can make it in society. Daniela is destined for so much greatness. There are so many other kids and adults that aren't exactly like Daniela, but they deserve to stay here just as much."

Yeah, let's deport this girl. We need to send a message to all these freeloading, college-bound valedictorians that they'd better think twice before allowing their parents to bring them here at the age of 4! It doesn't matter if she's spent virtually her entire life as an American. If you popped-out on foreign soil, you're not welcome here!

This is America! We don't need more snobby college students or socialist cardiac surgeons.

" Daniela is destined for so much greatness. "

Ok, so if you are destined for greatness, you can stay. So how do we draw this line? Who is "great" enough to be allowed to break our laws? What are the criteria? This is BS. Illegal is illegal. Period. And we are not going to take all 280 million Mexicans here because "they all deserve it". Read your history. Look at Nazi Germany, and the ultimate solutions. We really don't want to go there. Really. Do they?

She's not the felon. Her Dad is a US citizen, her mother went back to Colombia shortly after coming to the states. Why should SHE be deported. She didn't break the law ten years ago, her parents did. Why punish this girl for what her parents did?

Hello !!! Breaking Federal Immigration laws is a CRIME. Prioritize deportation ? Pick and choose AGAIN !!

Daniela Pelaez, 18, came here when she was four, when her parents entered the U.S. illegally..

Hello !!! "Her parents entered the U.S. ILLEGALLY..." but her father GAINED citizenship through Daniela's BROTHER (was he her dad's son or not).

Yep, two more years and everyone in her family will be granted Amnesty. So, what are Federal Laws for anyway ?

Wait a minute, 41 Obama White House staffers, and some aides along with hundreds of "elite" elected Congressional Representatives have FAILED TO PAY THEIR BACK IRS TAXES which is against Federal income tax laws also. Guess we can throw out the tax laws for the common folks also since our "elected officals" can ignore the laws THEY draft and vote on. Wait a minute....these folks have NOT BEEN charged with a Federal crime. Pick and choose again !!!!

Absolutamente! I don't care if you're Albert Einstein or a genius from Iran: If you're here illegally, no matter who your parents are, or have lived here since age 2months, you go home and come into American society the correct manner, and stand in line. People die every day in America or fighting for America in wars to have the right to be an American and that doesn't include freeloaders, illegals or someone who bought their way in or brought in by ObamaLama. If my parents can stand in line from Sicily to be part of America's greatness, then a Valedictorian or foreign leader with 2 billion dollars can enter in the immigration legal lines. Pitiful socialism at its best to stack the socialist' agenda of votes by giving America's rights away though illegal immigration!!!!!!!!!!!!!!!!!

If someone is here illegally, deport them. I do not care if you are some award winning scientist, a doctor who discovered the cure for cancer, the valedictorian of a senior class, or some dope dealer. If you are here illegally, you are here illegally. It does not matter how you got here, and how long you have been here. Allowing people to stay here as adults after they came here as children is only rewarding them for their parents breaking the law. It is only rewarding their parent for coming here, by having their children get a US education.

If my father robs a bank and then gives the money to me, can I keep the money if it happened a few years back? After all, I did not rob the bank, I only profited from my fathers breaking of the law.

Is it tough on kids when they have lived here most of their lives and then get found out to be illegally in the country? Sure. But the fault completely lies with their parents. Every person found here illegally should be summarily removed from the country. If they want to appeal, they can do it from whatever country they are from. Build more prisons to hold the illegals. Confiscate any property or money they have acquired while illegally in this country and use that to fund the program.

So we should allow everyone to come to the US? And then only deport the ones that drop out of school or are not stellar students? We owe it to Colombia to deport her. They need more highly educated people and to keep her here deprives Colombia of a citizen with a bright future.

Here brother probably got his citizenship by being a soldier. We should not take people that are illegally in the country into our armed forces. Then he sponsored her illegal father. Another thing that should not have happened. He should not have been able to become legal or a citizen when he was either here illegally, or left and filed from Colombia. When people are caught here illegally, they should be permanently banned from ever returning to the US.

This is completely unfair. The Cuban Gonzalez boy who was legally in the country was ordered kidnapped by Janet Reno on Bill Clinton's orders and returned to Cuba, where Castro has made him a celebrity every year in his anti American speeches.

Truth be known, this action by Clinton cost Gore the election due to the fact that the Cubans voted in mass against Gore owing to Clinton's action of returning the Gonzalez boy to Castro.

We need a solid law that covers everyone and everything.

We are too many people in the world, 7 BILLION and the U.S. can't accept everyone. One exception leads to another and another and the people who are here legally are denied their rights by the illegals.

The U.S. has to increase the quality of education and life for those who are here legally and are allowed to immigrate legally, but soon the spigot has to be closed.

Obama doesn't want to have his representatives look at the school systems that work and devise a national plan to educate our youth to the highest abilities they have. All one has to do is look at Urban Prep Charter Academy where all graduating seniors are accepted to 4 year accredited universities. The joke is on Obama. All the graduating seniors are black young men from the ghetto area that Obama represented and were chosen by lottery to be educated at this charter school. The cost per year per student is a little bit less than the cost per year at public schools that are turning out failing students.

Jerry, take your nostalgic ass back to Sicily please. I don't like people talking like today is still the 1800s, and thinking that life in Colombia is ohsoezmodo - if she goes back to Colombia, she may die - or suffer a fate worse than death.

And given her intelligence, and an environment that is alien to her, that would do us more harm than good.

Here's a hypothetical situation, and I want to see how you and others react to it: What if, let's just say, a German/Italian/French/Polish family snuck in here - would you be reacting as hard to this?

Or how about a more logical approach? Let's say a Canadian illegally immigrated here (somehow, by devil's luck) - would you guys be reacting with as much hate?

Every bloody time we have this debate, it's always because someone SOUTH of the border (a Latino) snuck in. Perhaps if it were an Afghani woman and her children, we might call 'em terrorists and deport their asses, even though what awaits them back home is the cruelest fate I'd never wish upon anyone.

Latinos, Africans, and Muslims - the biggest target of the White Church of the Grand Old Parrots, allies of the Ku Klux Klan, and the chosen children of the Divine Lord Rick Santorum, Descendant of the Holy Emperor Jesus Christ That Rules All Phenomena.

May Lucifer have mercy on our souls. So mote it be.

You are right Jim. My sympathies are with the girl but there are probably 3-4-5 million just like her. Students who are being educated and costing the tax payer and taking time away from U.S. citizens and legal residents. Great that she is intelligent, worked hard, overcame the breakup of her parents but she is COLUMBIAN and not a U.S. citizen or legal U.S. resident. So now we have to give to all the million other illegal students special dispensations to stay in the country?

The law is that you have to pay your income taxes. Try and not pay them. The law is that you pay your property taxes, try and not pay them. The law is that you pay for driver's license renewal, see what happens when a cop pulls you over. The list is enormous.

Now we have an illegal who for many years fed off the system and now we have to say, poor girl you can stay but the other 3-4-5 million have to leave?

The Cuban Gonzalez arrived legally and lost his mother in the ocean. Clinton ordered Reno to send armed marshals to break into a home and take him. Clinton and Reno made a new law to break an existing law.

That was not right. And if you now ask Gore about it, his comments probably would not be printable.

Jim - Which would you rather have: an illegal who ends up getting us OUT of this recession through her sheer intelligence, or an illegal who holds your sons, daughters, nieces and nephews hostage whilst every day he rapes the hell out of them?

Given the choice, I'd deport the latter and keep the former. I'd trust a Latina with a brain and common sense any day over a Latino Pedophile and a Whitetrash lizard who lost his in a fallout caused by Ye Olde Cross God.

Does everyone realize the reason that she was given the two year reprieve? Her father is a US citizen. As such, he can sponsor her for a greencard. So before she has to leave, he will sponsor her, she will become legal and never have to leave. Probably exactly what happened with her father, being sponsored by her brother.

I say deport them both. I do not care if you are a nun or a drug dealer. Here illegally, get caught, get deported.

I say this as a person that has many friends and family that all immigrated LEGALLY. I have also lived in many countries around the world. Always LEGALLY. And I would have been deported in a second had I been caught ILLEGALLY in any of those countries without deciding if I was a good person, or had skills.

CrimsonCujo Are you here legally? Do you own or rent? What would happen to you if you didn't pay your real estate taxes or pay your rent. You know. And when the sheriffs come to take over your house or remove you from your apartment you are renting are they going to ask you about your nationality?

Of course not! The judge who signed the eviction papers asked about your nationality? Of course not!

Did the city who asked the judge to take away your house ask about your nationality? Of course not?

Did the landlord who wants his rent ask about your nationality no?

You bleeding heart is not in the right place. She should go back and join her people in the fight against Chavez. Become a member of congress and take back her country.

That is the problem now with Mexico. The intelligent people are leaving due to all the problems: corruption, kidnappings, murders, drought, extortion, bribes, failing economy, poor wages, terrible living conditions, terrible water, sewage, exorbitant costs of water, electric, telephone, gas, increasing real estate taxes, fear, the running out of oil, decreased tourism, skyrocketing food costs, lack of protection in their homes, insecurity from police and politicians, and on and on.

Send the Latinos back to change their homelands for the better. The time that the U.S. could babysit every illegal and enter into every war and world wide problem is OVER.

The only problem is that we have a president who doesn't have the qualification, intelligence and common sense to resign!

Aside from the issue of whether a rare exception to the enforcement of our immigration should be made for a truly brilliant and accomplished student, Pelaez's claim that she knows the laws of the U.S. is either false or she believes that they do not apply to her--- either way, it's not a good thing. It's her sense of entitlement that she deserves special treatment and is above U.S. law that is particularly offensive!

And Miami-Dade School Superintendent Carvalho's comments are DISGUSTING and patently OUTRAGEOUS --- IT'S HIS GEORGE WALLACE MOMENT)! Feel free to give Carvalho a call for his despicable statement that U.S. law will be enforced "over his dead body"---- (305) 995-1430!

CrimsonCujo First it was nationality and then intelligence. Now what are you going to do about the 3-5 million students who are here illegally and jumped the immigration process leaving millions of other people to wait 5-10 years to enter the U.S.? Where are your sympathies for them?

They are doing the right thing, signing up, applying, doing the paperwork, waiting, praying, hoping, wanting to be legal and able to do everything that an American resident can do!

Why should they be all pushed back to the end of the line because other people cut ahead of them and now are forcing these people to wait and die before they get the chance to come to the U.S.

You don't have an answer for that. The U.S. CAN NOT KEEP ACCEPTING OVER A MILLION NEW IMMIGRANTS EVERY YEAR! IT IS PHYSICALLY AND ECONOMICALLY IMPOSSIBLE!

3-5 million? Something about those numbers seems off.

Furthermore, would you support these illegals going back to their countries to be genocided by the groups over there? Just answer me that.

Because if I recall correctly, genocide is mass murder, and we're already condemning abortion as murder. So in other words, you're REALLY okay with murder, as long as it ain't you. And you're fine with raping women, even if they have children.

And do note: genocide is what's happening over in Syria. So tell me: any chance you want the Latin American communities to go through what Syria is? I don't think you do.

EDIT - I just want to answer Wood's question: that would be too much to sift through, and also too surgical to not leave a mark on our country. Do your homework please, and learn the current situation over in countries like Colombia, Peru, Chile, and Mexico. Please do me that.

Then you'll understand why you're just making people suffer to make yourself feel better about being a White Christian.

Jim in Auburn Times have changed and you know that, the U.S. is broke and we are paying for that. Time to let the other countries find out for themselves what they have to do, why and go through their own political revolutions. In Syria, the Europeans, Turks and Arabs should help the Syrian people. They have the money and man power.

In North Korea, the South Koreans, Indonesians, Japanese, Australians and New Zealanders should take that responsibility, the U.S. has been there too long and we should let the countries there figure it out. North Korea is broke, not going to bomb anyone as what little they have will be turned to cinders. Let them wither on the vine.

Get out of Iraq and Afghanistan and let them revert to their stone age mentality.

Put up a giant wall on the south, put in the National Guard, use the drug bracelets and stop the illegal immigration and drugs. Stop the Mexicans from driving trucks into the U.S. and only use American trucks and shipping containers which have not been specially modified to ship illegals and drugs.

Of course Obama has no idea what he is doing and has been doing allowing the Mexicans and the Mexican trucks come into the U.S.

Who would prevent blacks, latinos, asians, and non-xtians/LGBTs from being eradicated via genocide?

Do tell me who has a better shot of not driving the US into the ground to the point where the rest of the world sees a great opportunity to eliminate us.

This country may not want war, but if you aren't careful, you'll bring it upon us - and we won't be the ones on the offensive.

        #1.35 - Thu Mar 8, 2012 12:57 AM EST

CrimsonCujo What are the number of illegal aliens? Anywhere from 11-20 million. 4 people to a family=1-4 million kids. A lot of illegals have a lot of children they bring over.

When I lived in Mexico, every worker admitted to me that they were easily smuggled into the U.S. Made their money and came back to Mexico to buy a lot or build a house.

The people who are returned have the responsibility to change their government to be better. Nobody asked them to come to the states. Every country I lived in over the world, I had to legally get residence. And I had to obey the laws. You don't want residents to obey the laws of the U.S. then leave and make room for someone who does.

Yes I am proudly pro choice. The world is over population and the population is growing exponentially,

In 1800 the population of the earth was 1 billion. 200 years later it increased 700%. You can't imagine what it will be in 2200 without serious birth control.

I am responsible, two children, fed, clothed, educated and well mannered. My father-in-law was one of 17 and he had a cousin with 36. That sound better to you?

Countries have to have their own people stand up and help themselves, that is not the job or necessity of the U.S. Those times are over. You want to volunteer to go over to Iran, Syria or North Korea, please do not wail for the U.S. to bail you out.

Genocide is part of the human failings and as it stopped in Europe, it will stop in other countries when the population wants it to stop.

I lived in those Latin countries and know more about them than you.

It is for those people to change and improve their governments. It is not the responsibility of the U.S.

If you ask a question and get a complete answer, then you have the responsibility to respond to the questions from other people or don't comment at all.

They have the lowest birth rate, highest scoring on intelligence tests, use less of U.S. government services than any of the races in the U.S. They are more cohesive and better mannered than any group in the U.S. The established Latinos in Southern Texas are polite, well mannered intelligent and very nice to deal with. I travel extensively and talk with many people all over the world. Australians are very racist. They have no illegal alien problem. The Australian people report anyone and everyone who they think is an illegal and they are immediately picked up and held in detention cells until a hearing and then shipped out. New Zealand is the same way. Mexico, the police will throw you in a cell with a straw floor and ship you out on a bus.

The homosexuals and lesbians have rights in every state to form civil unions. If they do not cause trouble like trying to pick up a straight, nobody is going to harm them except for idiots that are in every population.

CrimsonCujo Obama has driven this country into the ground and onto its knees. I have lived through 17 presidential terms and have never seen a president so divisive. He is a fool, a fake and a fraud.

He doesn't have the sense to pull all the troops out of Afghanistan and Iraq. He has no education, no leadership, no charisma, no ability to build a consensus and no ability to get people of all races, economics and education to work together!

He had an all democratic congress for two years and fought daily with them. He had a bipartisan congress and fought even more. He has no experience. When he was in the Illinois State Senate of the 130 laws he proposed none were even voted on! He refuses to show his education transcripts or show how or where he worked to earn his money to get into junior college, Colombia or Harvard.

He had bin Laden killed. He did not order a capture/kill mission. He ordered a kill mission. You always try to capture the general of the opposing army to get the information he has. He had a body disposed of Obama said was bin Laden's before the DNA tests were completed! That is the height of absurdity!

Obama gave a Finnish Car Company $500,000,000 to build electric cars in Finland to compete with General Motors. Why??????? Why didn't Obama let the capitalistic economic system work so that G.M. and Chrysler could work their own ways out of their economic problems? Why did he use your money?

woodlawn1--This girl's father and brother pay taxes. She could not have committed a crime by coming into the US when she was 4, because she was 4. Her parents committed the crime. She is here by someone else's doing. Her brother is a citizen, and her father is a citizen, and she qualifies (if they sponsor her) to become a citizen if she meets certain criteria.

A person can get citizenship in the US very easily--look at Rupert Murdoch. One just has to invest a certain amount of money in the economy, and one's citizenship is fast-forwarded.

And, if you don't know the effect of population density on a country's economy, then Google is your friend. The population density in the US is 84 people per square mile--below Latvia and above Laos.

There are way, way, way too many countries to list out--but to give you an idea of a high population density, Belgium has 889 people per square mile, Switzerland has 490, China has 365, and France has 289. Seriously--if Switzerland has about 5 times as many people, and sits at the top of global competitiveness rankings for 2012--then the statement is obviously true. Belgium is number 15, China is number 26, France is number 18, and the United States is number 5--these countries are all on the top 30 list for global competitiveness. There is no relationship between population density and success of the country.

Seriously--when someone tells you something is a fact, maybe it is better for you to go get informed than to sit back and demand that others enlighten you. If we have to spend all our time educating the intentionally ignorant and intellectually lazy, we aren't going to get much done--are we?

Oh, and just in case you missed it, Switzerland is one of those nasty European Socialist countries--with a booming capitalist system. In fact, three of the four countries that now rank above the US (it has been dropping one place per year since 2008)--Switzerland, Sweden, and Finland--are all nasty European Socialist countries. So, if you want to suggest that world rankings matter--then maybe becoming a "European Socialist-style" country might be a good idea? I don't think so, but the point is that they aren't doing badly--and population density doesn't matter.

So her father's a citizen and her brother's a citizen, and her mother is not in the country illegally because she returned to Columbia of her own volition... so... why is this girl not a citizen?

Last time I checked, quite a few countries have higher population density than the U.S. and they are doing just fine...

Yeah? Which one of those countries do YOU want to live in - CHINA????

We have borders for many reasons, not the least of which is not wanting to end up like a filthy cesspool like these other countries.

But of course, we'll end up like that anyhow because we reward filthy criminals for breaking the law so I guess THAT point is moot.

This girl's situation is a tough call, there are two sides to every coin. Granted, her parents were illegal and brought her to this country illegally; she may not have asked to come here, but has benefited from the results. However, living under the radar for 15 years doesn't make it any less a crime.Illegal is still Illegal. On the other hand, the Immigration Laws in this country are a convoluted mess. There needs to be a streamlined process, that does background checks and expedites citizens who want to legalize their status.

In the meantime, until the laws are changed they need to be honored and enforced. Why have laws if your going to pick and choose which ones to follow. My real question in this case is: Why hasn't this young girl applied for citizenship? Her brother has applied and was awarded citizenship; as well as her father. At the very least, she should have applied for legal residency as a sponsored alien under her brother or father's citizenship. You can't cry foul when caught, if you don't take any steps to correct the problem.

Promising future or not, illegal is just that illegal. INS has given this young girl a temporary two year deferred period to correct the issue. This young girl has two years to apply for sponsorship and legal residency via her naturalized family members. If she chooses not to take those steps to correct the problem when the opportunity has presented itself to her; then we are back to square one. She is illegal and should be deported.

Sometimes you have to make the hard calls to show equality and fairness to others. Just remember there are a couple of million people from around the world, who have applied for entry and citizenship to America through legal channels. Some of these immigrants have been waiting for years. America has limited these legal immigrants; largely due to the illegal problem in this country. We can only support so many. If illegals want to stay here, its time they made an effort to correct their status, instead of sitting back and waiting for a government hand out on amnesty, that may never come.

unreal. now the precedent has been set for every future illegal to say "i do no bad, only do good. you let her stay, why not me too?" i'm sure the aclu lawyers are thrilled for the windfall of federal court (taxpayer $) billable hours that just landed in their laps.

this is about as "yes or no" as an issue can get. social security #/valid visa=ok to stay. otherwise, GET THE F**K OUT!!!

and to all that disagree/employ/have knowledge of/help these illegals stay here, YOU SHOULD BE DEPORTED TOO!

i literally can not believe with the condition of this country these days that ANYONE with a functioning brain and IQ above 50 thinks that this is the correct solution. somehow this plays into obama trying to get votes from minorities, and don't even get me started about the general uselessness and/or corrupt dealings by our elected officials. this is the greatest country on the planet and likely in the history of civilization, but there sure are a lot of people doing their "best" to try to screw it up...

Obama can't settle his own immigration problems with his own family. You think he's going to address this on his campaign? Think again. It would mean deporting his aunt and uncle who ARE HERE ILLEGALLY. So yes, I do believe he will use this to get the minority vote. I have had relatives deported. They were also intelligent and could have brought much to the US. But once they returned to their home country, they did just as well there.

It would have been nice for our families to have stayed together, but I do understand ( as they do)that the law is the law. So what makes this girl so different? And no, I'm not white. So that kind of prejudice, doesn't apply to me. Our immigration laws need to be reformed. This is one topic that Obama keeps avoiding. Anyone can see it.

As much as I feel badly for this girl, I feel even worse for the American citizen who has also worked hard and will now not be able to get the scholarship needed to get their Ivy League education like this girl will be allowed to do. So sad, when American citizens are denied their chance to succeed because there are illegal immigrants that people feel sorry for.

With all her futuristic greatness that some people seem to tout, maybe she should go back to her home country and apply that American educated greatness at home to help her homeland. She got her free high school out of the American education. Isn't that enough for the tax payer already? Or are we supposed to be on the hook for her college as well? I have an idea that there are some very exceptional American students here now that are legal that can help this country just as much as she can and maybe more.

Allison, I had a 4.0 GPA and was accepted into the number one Aerospace institute in the country. However, there were 12 scholarships available to women at the time and 11 of them were stictly for minorities only. Being that I am caucasion, I was not able to get the only one available to me and my demographic. Needless to say, I started working in an office for minimum wage the day after graduation. Since then, I have never been unemployed and have worked 2 jobs at times just to make ends meet. So, I definitely know what it feels like to do everything right and still get screwed by the system. Nice try.

cmstumbles so you decided because you couldn't get a scholarship for the very narrow field that you chose with a 4.0 that you would rather be unemployed with no education? You blame who for that? You should look in the mirror, the generation going into college are feeling way too entitled these days. America is the land of opportunity but its up to you to make that happen. There are students across the country that have 4.0 averages, and probably do community service and play sports to help their application process.

"She should be deported," Linda Simmons, who has a son in ninth grade at North Miami High, told NBCMiami.com last week. "Her parents broke the law."

So by her totally idiotic thought process then when she breaks the law, we should be able to take her 9th grade son and make him pay for her indiscretions and mistakes. Makes sense to me in a bass ackwards kind of way.

Besides, this family has been here for 14 years and probably been good members of their community (I am guessing, I dont know this to be fact but since their daughter is an honor roll student, I would bet they are pretty good people). Its not like the snuck over the boarder last month or last year. There has got to be a grey area people. Not everything is black and white. And these kids, who where little, shouldnt be made to pay for their parents 'mistake' trying to better themselves and their childrens lives.

Linda Simmons, you are a worthless, loud mouthed individual who should stop speaking because people can see you for the fool you are. Enjoy your day.

Wow Jan, I'm not sure where you grew up, but when you grow up in a trailer park in a rural town in the midwest, there aren't a lot of opportunities. I did plenty of community service, through my school clubs, through my church, and through the American Legion. Unfortunately, I'm not athletically gifted so that wasn't really an option. My parents couldn't even afford to let me go to a community college. Also, just so you know, although aerospace isn't really that narrow of a field, I would have studied just about anything to futher my education. But, alas, being a poor white person just doesn't trump the poor minorites for sympathy in the scholarship selection process. So, please don't attemp to know me or what I have gone through to be barely making it financially knowing that I am capable of so much more but was never given the chance. By the way, I don't know what your education was, but if you could read, you would have noticed that I said that I have never been unemployed and most of the time have held down 2 jobs.

Time for the legal citizens to send a clear message to Washington, do your job or be voted out of office in favor of those that will.

There is nothing good about keeping an illegal in the USA. When the students in Ca. put the mexican flag above the American flag and turned the American flag upside down, they should have been put on a bus and shipped back to Mexico. Also, English is our Language not Spanish. If they don't want to be an American and become an American the right way, send them home, where ever they came from. We have American kids that can't afford to go to college and yet we pay for the illegals to go to school, go to college, health care, and all their living expense. She should have been sent home. She knew she was here illegal, so she is as much to blame as her parents. When she turned 18, she should be sent back home with all her family.

Few problems with your "he deports more that past administrations" One more are headed here than in the past because they are fleeing their countries and know they are less likely to be deported once here. Two- this administration counts those caught at the boarder as deportations unlike past administrations who did not, kind of padding the numbers if you will.

Fact Obama's illegal alien uncle was caught drunk driving and was placed on an immigration hold for not leaving in the past, then oops he is set free, wonder why?

Why shouldn't any illegal alien be deported on the spot, we have one of the highest unemployment rates since the great depression, an estimated 11 million + illegals are working here now, that's 11 million jobs that should be done by legal citizens.

I hope and pray that every out of work American, their families and their friends vote out any politician that won't enforce our sovereign laws and put Americans first. It is time to send a very loud and clear message the Washington, PUT AMERICANS FIRST.

@ 1.3 bloggitt. It's very similar to which women deserve respect and which ones don't. Easy answer, tho. If you agree with Obama, he will even call you and "apologize' for the hurtful things somebody said about you. If you don't agree with Obama, though, it's ok for people to call you c*** and tw*t. And Obama will take a million dollars from the person who called you filthy names. Obama has proven to me over and over what a hypocrite he is.

dirt, little known fact, he did not take Mahers million dollar check.

From what I can see though that Maher, Schultz and Limbaugh are all scum of the earth filth and yet conservatives continue to idolize Limbaugh while most democrats don't like Maher and Schultz and both saw penalties for their actions. Talk about hypocrites, the republican party shows their lack of real leadership more all the time.

The moment you began to use personal attacks is the moment your post lost all integrity. To further emphasize my point, her parents probably paid just as many taxes as any other American. We all try to avoid them (lets be honest here). She would have had to pay sales taxes and the likes over the years. Finally, if she becomes a surgeon like she wants to be, she would be paying taxes that are in the higher end of the tax bracket in America. So, she would not be freeloading. Even more likely, she would end up paying even more taxes in her lifetime than the average American. Of course, this is all speculation along with a lot of other debates over the immigration issue. One thing that we should all agree on, however, is to leave the snide remarks that add nothing to the discussion at the door so that we can all sound more intelligent.

Lets put the rubber where it meets the road, simple fact is the libs could care less about illegals except for the fact that the Dems have to have the Hispanic vote if Obama doesn't want to loose by the largest margin in history, he is going to loose but just how badly is still up in the air.

Obama has lost the majority of the black vote already, and this is straight from all of my friends down south who are involved in politics, but since the Hispanics out number Blacks in this country now Obama had to pander to them. I would be completely surprised if he and the Dems. in Congress didn't try and push though amnesty and voting rights before the election.

All Americans regardless of party needs to demand that any politician running for office put America FIRST, and let them know that this is the only way they will get your vote. We have got to have the 11 Million Plus jobs back from the Illegals that stole them. They are stealing from us every day, 5 Billion dollars (yes BILLION) every month are sent back to Mexico by illegals working here, that is 5 billion of our economy that is not spent here or taxed here. We Demand real change and we are sending an other Tidal Wave of change to Washington like we did in the last election, and if those already there won't do it we will elect those that will.

They would probably be thrown in jail until they could be deported, and then all of their possessions would be seized by the police/government/agents that arrested them.

The illegals do not pay taxes and do not want to be citizens because then the government can get them for NOT PAYING TAXES. If they are illegally here the government cannot prosecute them for NOT PAYING TAXES but they will confiscate all a taxpayers assets for not paying taxes. Idiots like you are the real problem. Stupidity embraced is what you represent. Good grief you are a moron.

Comments like this is why I'm 100% positive that people who are virulently anti-illegal immigration have absolutely no idea how our immigration system actually works. They must still think that the current immigration system works like it did when their great-grandparents came here, where they just signed a book on Ellis Island. 'Why don't they just become legal/come here legally?' Yeah. And while we're asking oblivious questions, why don't people inside a burning building just use superpowers to fly away to safety?

You apply for a visa to come to the US. Most will not get them. But that is fine because the US cannot hold everyone from all over the world.

My mother is a legal immigrant, my aunt is a legal immigrant, my wife is a legal immigrant, my friend is a legal immigrant. Come here legally and that is fine. Come illegally, get deported and banned forever.

The problem is that no news site has covered a Canadian illegal immigration (and Canadians also are not that stupid to leave a place better than this rathole).

I mean, compared to a majority of illegals, both this girl and Canadians actually have a brain and actually LIKE using it.

And before I leave, I'd like to ask you to read the article again and figure out your own error. Give you a hint: it has to do with the word "Mexico".

You will not see many news stories about illegal Canadians because there are very few. Of the 20+ million people here illegally, 90+% are from south of the border.

Given that her father is an American citizen, she shouldn't be going through any of this.

I find the folk who rigidly argue a law is a law is a law and neither circumstantial interpretation nor accommodation of any sort should be allowed to be dangerously shallow and motivated by a xenophobic bigotry rather than reason. They are also the minority, as the signed petition and student body walk out in favor of the girl being allowed to stay clearly indicates.

That is the oldest game that minorities play. I should know. The better judge of those minorities are the people who are minorities themselves. Which I am. This girl went through all years of high school and she probably learned from and early age that she was illegal. Her parent's probably taught her how to play "hush, don't tell them" in order that they wouldn't be given away. Her parent's were probably waiting for the day, her brother joined the military so that she could be sponsored. This is why giving amnesty is so bad. All minorities know to do is if they wait it out long enough, the govt. will just give them citizenship.

How about treating people on a case by case basis? This is America after all. I think all my relatives entered legally but, don't actually know. What matters is they made good. If we treat "aliens" like every other country, what sets us apart? I understand the frustration expressed by so many posters. The unemployment problem and outsourcing, loss of identity and seemingly endless foreign aid for all kinds of bottomless issues, iraq, afghanistan plus the lack of transparency in government have many people very angry with "foreigners" and rightly so, but to paint all with the same brush is to throw the baby out with the bathwater. The foundation of our great nation is equal justice. This girl and her family are actually contributing to their adopted homeland. I for one support here and her efforts.

You need a Social Security Number to do a lot, and obviously she had to steal hers from someone else. That's IDENTITY FRAUD. I wonder how all these morons backing illegals would feel if an illegal stole THEIR social security number and started getting in trouble... not everyone is a Pelaez case, afterall.

"As far as sad story that sister cannot attend college-why not? Fla. has no laws barring illegals...."

Yep, some States even provide In-State Tuition Assistance for Illegals:

And the SCOTUS has declined to review the case against these States.

You can see where our government is taking the slippery slope for self destruction.

It's a case by case basis. You group everyone in by race, not only do you get branded a racist tyrant, you also lose potential voters.

For example, Holy Prince Santorum will probably want to make being anything but white illegal in this country. While I'd be safe under THAT specific law, I know many people here who are my friends who would not be spared. And I'd die for my friends, rather than the White Church of Christ.

This story has some huge holes;how can older brother be in military? In order to enlist, one must be a LPR or green card holder-illegals may not enlist.

First of all, illegals can and do enlist, I know because I served with some in the Marine Corps. Second, reading comprehension must not be your strong suit because in the same sentence it said he was in the Army it also stated that he's a citizen.

Pelaez's older brother is in the Army and is a citizen; her father obtained citizenship through her brother

How is sister supporting herself? She cannot work without a SS#.

You do not need to prove your citizenship to get a taxpayer id #, it's the height of inbred retardedness to think that the only way to obtain a SS # is to steal someone's identity... people who think that are invariably criminals themselves and thus can't imagine that there would be legal paths to obtain something you want.

Illegals are CRIMINALS and DO NOT PAY INCOME TAXES and they ALL MUST BE DEPORTED and FORCED to come LEGALLY, period. Idiots make excuses for their crimes.

Mexico needs valedictorians more than anybody

Seriously. If Mexico is ever going to change for the better they need to become more educated and develop an intellectual class. Every advanced society has done this in history. However, the power holders there don't want it because it would eventually challenge their authority.

Just dump everyone on the Americans. They'll glad pay for them.

dmar - You know, it's funny; everyone who is anti-immigration thinks that immigrants only come from Mexico (because to them, there's no such thing as South America). These people also think that Colombus doesn't exist, and that the nation of America was founded by the New Apostles of Christ, whom have recently chosen their next in-line: Prince Rick Santorum the Holy One.

Personally, for me, I'll vote Obama - because right now, all our other options look pretty bad (and that's an understatement, trust me). Then I'll find the nearest cantina and throw a fiesta with all the Latinos here - and we'll burn effigies of Bush, Cheney, Santorum, Romney, and of course, Jewsus.

He told me in English if WE are going to be living in THEIR country ( USA ) we better learn how to speak their language. And he walked away. HELL no. ILLEGAL is ILLEGAL!!!!! I don't care how smart this girl is, shes illegal and thats all that should be said about it. But nooooo... you have those bleeding hearts who just want these illegals to live a wonderful life... The law only applies when they think it should.

TexasLaw - It's harder for a Colombian to get into the US than it is for a Mexican. A Mexican has an easy land route to cross (the security on the border is a hard bit, but that's irrelevant). Since Colombia is the first country to connect South America to North America via the small strip of land in between the two, a land route is not only risky, but outright longer than going through Mexico, since you commit many more illegal entries that way.

Going by sea is much easier, since the TSA and Border Patrols don't monitor our waters, and I don't hear much about the Coast Guard these days. I mean, hell, the Cubans do it. Shows how easy a Colombian can do it.

Not everyone travels by land or air, Texas. Remember WHY the seas exist. Remember WHY our Navy exists. And for Enki's sake, remember why the @!$%# at Pearl Harbor was even possible.

Since when do people here illegally get to dictate changes to our laws!? Other people take a number & wait their turn; you are not too good to do the same. WE have the right to verify that you are not a criminal back in your own country. If you are a criminal, we don't need you here. If times are tough where you come from, we have plenty of U.S. citizens who are having a hard time too. They need the jobs you are going to take. You are not welcome here.

People who break the law the moment they set foot on American soil should be sent back with their family. If they are willing to break our immigration laws, what other laws will they break? They do not have permission to be here. Because a country shares a border with the U.S. does not give its people any more right to enter our country than those from the other side of the world.

If an American is in another country illegally, imagine that American marching in the streets to DEMAND he be given his "rights". Let me repeat, if you are in this country ILLegally you don't have any stinkin' rights. Go back to your country, apply for a visa and get in line!

Her father, who brought her into this country illegally, is now a citizen. So is her brother who entered illegally at the same time. It makes no sense to deport her since her father and brother have both become citizens even though they entered illegally.

Yes but no where does it mention that she has ever tried to become a citizen. For 14 years or so she hasn't done anything and now she complains. I do feel for those caught in the middle but as others have said she should have been found and deported years ago. Police aren't even allowed to ask if someone standing on a corner looking for day work is illegal. (Hint: if they don't speak english the answer is probably yes.)

This can't be said enough. First, I'm for LEGAL immigration and I don't care what you look like. Come legally. Now, you know who has the hardest immigration laws in North America? You got it, Mexico. If you want to move there you have to "qualify." You have to demonstrate your financial worth and much more.

You know who has the most fortified southern border? You got it, Mexico. They don't want others from central America coming up or coming to pass through to the USA. Nope. It's for them only.

                                    It's total hypocrisy.

We have a system. The problem is the government chooses to ignore it's own laws, and ignores the majority of it's people in their demands that those laws be upheld.

its easy to demagogue this issue in either way, but really we should be deporting millions of others ahead of this student. we should always have the flexibility to pick and choose who we as a country allow to stay here: persecuted persons, highly skilled, etc. one thing is certain-she should not be getting any free or welfare services that a citizen would receive, and make a condition of her stay she doesnt ANCHOR BABY!anyhow, deport about 12 million mexican illegals who are overwhelming many communities and changing the national identity in those parts, then we can talk about the exceptional cases staying or leaving.

That, and everyone will hero worship you, and Bill Gates, and say great things at your funeral about how creative a genius you were stealing the idea of the mouse from Xerox.

Time to overthrow our government at the election booths. Vote all Republicans and Democrats out. The time is now to take our country back.

Illegal aliens now have more rights than us, without the tax burden we have been paying all of our lives.

As far as i am concerned , her family is a band of crooks that defrauded the U.S. government.

I say vote all of them out...They take an oath to protect the citizens of this country and the laws..They will not be voted out because we have finally reached the saturation point of---there are more people getting entitlements/welfare/fake social security cards, etc to be able to continue to vote these jack rabbits back in time after time..They do not want change because they are getting things for free..A young woman from Detroit is still getting food stamps after winning the lottery..Her excuse is that she has no income and has two houses to keep up and pay for..No job!! Well, boo-hoo..And in Michigan this is not against the law??? How many of us that work, etc have two houses?? It is time for the people to stand up and say enough is enough!!

It seems to me that as United States citizens, our bill of rights has been taken away and given away to anyone who has come here illegally. Our constitutional rights are being taken away as well, slowly and methodically. They have taxed us to death taking our money against our will, they give most of it to people who hate us, they allow anyone into our country who can make it here and give them a free ride, then borrow trillions of dollars in our name and print money till the printing machines smoke and whine, then give themselves raises during recessions and take our guns (took mine).

We know who is doing this. The Republicans, and the Democrats. These parties have to go.

We should overthrow our government, and rewrite our constitution, our government is now our enemy.

I love the U.S.A. , but hate our government with my fangs out !!!!!

If she knows the laws, then why did she continue to break them? And, I guess according to her breaking the law, and doing nothing about it and being her ILLEGALLY is what it means to be American?

F*ck her! what a slap in the face to all of us who are here legally. And, i would love to have people petition for me when I break the law, so I dont have to face the conseqences of my inaction, disrespect and total negligence. And, this criminal gets to go to Wash to meet Sen. Pelaez? He should be hung for treason!

This seriously FUBAR! Now, criminals get pardoned and get to go to Wash where she will be celebrated for pursueing the American Dream? yeah, F*ck everybody that has a right to be here and lets have all the criminals get a pat on the back.

ICE's response to this is a clear indication of who they are loyal to. And, dont give me this @!$%#e about this Admin deporting more than any other...oh yeah, only those with a criminal record, hahaha. You mean like being here ILLEGALLY.

Sonar Guy: Actually, with her brother being a US citizen and serving in the Army, and her father being a US citizen, and both paying their taxes, I fail to see how she's been particularly expensive. I'd have to say that her brother's service to our country while we've been in a constant state of war for a decade probably pays off any family debt the kids inherited. And she's made good use of the public education offered to her, much better use than most kids, citizens or not. I don't mind my taxes paying for anybody to get an education. Half the American-born kids can't even bother to graduate from high school.

Her parents broke the law and we reward them. We should send them back to where they came from and bill the country that they are from for all of the expenses we incurred by their citizens. These illegals are breaking the law mooching off of our system and getting benefits meant for Americans. If they want to be citizens do it the legal way.

She is a valedictorian and will probably end up doing well in college and getting a high paying job to pay taxes and provide a service. What's your grand contribution to this country?

I would have to agree with Novus Ordo Seclorum on this one. It appears you would rather make this a racial or political issue rather than a legal matter. That's what happens when you know you are wrong and have no legitimate argument.

I got an idea! How about we let her stay because she is smart, and in her place we deport one of you jackasses who contribute nothing significant to society other than your hate spewing online behind a monitor where no one can see you.

Seriously, she has been here since she was 4. All she really remembers is the USA, are we really so inhumane as to dump one of our best and brightest into a land they don't know just because of our broken immigration laws? An unjust law is no law at all. And yea, I did say "our", because she has lived almost her whole life in this country, gone to school here, family and friends here, etc. She is just as much American as you or I no matter what some paper may say.

Her parents broke the law and should have to suffer a substantial fine, or something to that effect. And we should work to keep it from continuing to happen. But I am not ok with deporting people who have been here their whole life - who would be thrown into a strange land they know nothing about.

Apparently this is a minority viewpoint, judging by the posts on here. If that is the case then not only do I want her to stay but we NEED her to stay, to counterbalance you idiots.

I am totally disappointed about this decision on many levels. I am not heartless, but a law has been broken and broken by an illegal. Why do we even have any laws on the books. It would appear immigration laws only apply to those coming from Japan, the Philipines, etc, in other words, you wait your turn. Why would there be an exception?... just because she is smart. Okay, then why not let everyone just pick the laws they want to obey, pay the taxes they want to pay, etc? It would not work.

The laws are for everyone.. legal, illegal.

And as a side note.. I am citizen and so is my husband, our kids have worked hard and graduated from the state university with honors, yet no one has asked them to go to Washington D.C., nor have they received special consideration when searching for a job, etc. Our families have played by the rules to a fault. Never received any special assistance of any kind in the 100+ years our families have been in this country.

USA2011 - I understand.... My ancestors came over in 1851 (legally) and we also have contributed with the 100+ years and not been here with our hand out.

This girls crime was holding onto her mother's hand crossing the border illegally when she was 4.

Since then, she has in her short life, been a model citizen. She should start the process of becoming a U.S. citizen (Which she might be barred from because she came here illegally). It will take political maneuvering to solve this problem.

We ALL came here from somewhere else. Some longer ago, some recent, some legally, some not.

Those that have come here illegally - and contribute to society in a positive manner - should be allowed to stay and become citizens. Those that sneak in and are a blight should have the door knob of the U.S. hit them on the A$$ on the way out.

Daniela - Don't squander the 2 years - you may not be so lucky the next time.

Ford Man 4 life, be prepared for another four years cuz Obama isn't going anywhere. Be patient cuz those four years will be up soon and you will be back to cutting social programs, starting wars, running up the national debt and giving tax breaks and subsidies to elite corporations.
