Tim Smulian, a 65-year-old British and South African citizen, and Edwin Blesch, a 71-year-old American, met in 1999 and have been together ever since – though that has entailed moving countries every six months at an enormous financial cost since they can't legally marry in the US. Despite years of stress, both said it has all been worth it and feel being part of the lawsuit is an "obligation to continue the struggle."
Same-sex couples, in which one partner is a foreigner, have filed a lawsuit challenging a federal law that prevents them from getting a green card for their spouses, just ahead of the start of a related court battle that some predict could bring the issue of gay marriage to the Supreme Court.
The lawsuit, filed Monday on behalf of five binational gay couples, targets Section 3 of the Defense of Marriage Act (DOMA), which blocks federal benefits for same-sex couples -- including the right of an American to sponsor their foreign spouse for a green card. The lawsuit claims that DOMA violates their constitutional right to equal protection.
“Our couples can’t just wait any longer … we’ve spent the past year working with the Obama administration to encourage them to place green card applications for gay and lesbian couples on hold until DOMA is struck down by the courts or repealed by Congress, and they have declined to do that,” said Rachel B. Tiven, executive director of Immigration Equality, which filed the lawsuit along with Paul, Weiss, Rifkind, Wharton & Garrison LLP. “As a result, we really have no choice but to sue.”
The couples in the lawsuit have been together more than a decade – in some cases more than two – and have struggled to cope with the law while maintaining their relationships.
“They’re at the end of their viable options to stay here as a family,” Tiven said Tuesday. “They’re out of visas … they’re out of work opportunities that would enable them to continue to stay.”
DOMA, enacted by Congress in 1996, blocks federal recognition of same-sex marriage, thereby denying various benefits given to heterosexual couples, such as the right to immigrate. Thirty-nine states have defense of marriage acts, while six states and the District of Columbia allow same-sex marriage, according to the National Conference of State Legislatures. There are an estimated 36,000 binational gay couples in the U.S.
One of the couples in the lawsuit is American Edwin Blesch, 71, and his husband Tim Smulian, a 65-year-old British-South African. The couple married in South Africa in August 2007, where gay marriage is legal. Their union is also recognized in New York state, which approved same-sex marriage last year.
For some gay couples, fight goes on to marry — and stay in the US
“The last years have been probably the most exhilarating in our lives in that we’re together and we both now have the … soulmate that we’ve been searching for all of our lives,” he said.
But the legal restrictions have made life more stressful for the couple, who live in Orient, NY. Smulian’s visa has expired, and though federal authorities have given him an additional year to stay in the country in what is known as “deferred action,” that time will be up Feb. 7, 2013.
“We’re now in our retirement years … there’s not a whole lot of time for us to dawdle around waiting for things like this to be settled,” added Blesch, who says he has HIV/AIDS and needs to stay in the country for his medical care.
The lawsuit notes that if the couples were heterosexual, the federal government would recognize the foreign spouse as an immediate relative of their American partner, who could apply for an immigrant visa for them.
“Solely because of DOMA and its unconstitutional discrimination against same-sex couples, however, these Plaintiffs are being denied the immigration rights afforded to other similarly situated bi-national couples,” reads the lawsuit, which was filed in U.S. District Court, Eastern District of New York. “This is an action to remedy that hateful, harmful, and unlawful discrimination.”
Immigration Equality and other advocates of couples in this situation have urged federal authorities to put the green card applications on hold, rather than deny them outright, while the legality of gay marriage is addressed through legislation or by the courts. They note that immigration judges have opted to put some deportation proceedings on hold while the law is in flux.
“There’s no requirement in any law that says a (green card) denial must come immediately,” said Lavi Soloway, a lawyer representing same-sex couples, whose law practice – Masliah & Soloway – created Stop The Deportations: The DOMA project.
“Press the pause button, don’t destroy people’s marriages,” he added. “Even for a short period so that we make sure we don’t make any premature denials and cause irreversible harm to couples and families.”
Soloway said two other cases were filed last year – one in Los Angeles and the other in Chicago – on the same issue as the Immigration Equality lawsuit, coming amid a number of legal challenges to DOMA.
On Wednesday, a federal appeals court in Boston will hear an appeal over DOMA’s denial of federal benefits to married gay couples – a case Soloway said experts expect to make it to the Supreme Court.

I dont care about the sexual preferences of consenting adults so long as they dont harm anyone. Im dubious that same sex couples should receive the same tax payer benefits the heterosexual couples receive, but at the same time there are MANY heterosexual couples who dont deserve to get taxpayer benefits either. The simplest solution would be for our government to stop subsidizing marriage.

What, exactly, are these "taxpayer benefits" that you are objecting to? This specious line of argument comes up in most gay marriage arguments, and serves mainly to show how little people know about what marriage license means and what the "benefits" of marriage are.
The reality is that the more accurate phrase is "benefits, privileges, responsibilities, and duties of marriage" because almost every benefit of marriage is balanced by a duty, and those benefits flow not from the government, but from your partner, to who you owe responsibilities as a part of the marriage. i.e. you have benefit receiving half your partner's pension should you divorce, but you also have the responsibility to provide your partner half your pension should you divorce. The taxpayer doesn't even begin to enter that equation.
Sure, there are some benefits of marriage with regards to how you file your taxes, where a married couple can count their income together for purposes of paying lower taxes, and a widow can collect social security based on a deceased spouse's income. But that's simply a function of acknowledging that married couples frequently make decisions where one will be the breadwinner while the other cares for the home, children, etc. It only seems fair to treat their income as pooled at that point.

In this day and age, that's a rather outmoded view of things. In a great many marriages, both partners have jobs and share in child-rearing. But, if you want to persist, the same dynamic can exist in same-sex marriages, where one partner may work and the other care for the home/children. So, why shouldn't same-sex couples receive the same consideration.
Your posting makes it sound as if the governmental benefits for married couples are no big thing, but benefits/rights such as social security, tax-free inheritance of property, guardianship, etc... are all important and life-changing for the people who receive them.
I'm not saying that the benefits are no big thing. I am saying that by and large, they do not cost the taxpayers a dime. I'm arguing that it's spurious to deny marriage benefits to gay couples on the grounds of taxpayer cost, as it doesn't really exist. It doesn't cost taxpayers a dime to give legal residency to a foreign-born spouse of an American citizen, straight or gay, and in fact, in many cases it raises tax revenue by having more people LEGALLY working in the US.

Full civil rights for US citizens who happen to be gay, lesbian. transgendered, or bisexual is inevitable.
It's just a matter of time and there is nothing homophobic (probably closeted), close-minded bigots can do to change it. For proof simply consider the progress GLBT people have made in the last 15, 10 and 5 years. Not only is the change occurring, but the pace of the change is accelerating.

In Exodus 20 (see Ex 20:1-2, 3-4, 5, 6, 7-9, 10, 11, 12, 13-16, 17, 18) we find the "Ten Commandments" which embody the essence of God's Law. For simplicity one can divide the OT Law into the following 3 categories (although in fairness it should be noted some commentators recognize only a moral and ceremonial division)...
(1) Moral, as for example the 10 commandments in Exodus 20 (all but the Sabbath are also commanded in the NT). We are called to love God with all of our heart, soul, mind, and strength, and our neighbor as ourselves.
(2) Ceremonial, which includes the Tabernacle, the sacrificial system, special days, weeks and feasts.
(3) Civil or judicial which dealt with laws specific to Israel such as the cities of refuge, stoning for certain offenses, etc.
The moral law is still in force for believers but as explained below is now written on our hearts and is to be obeyed in the power of the Spirit and under grace (not "under law").
The ceremonial law was fulfilled in Christ, Who was the substance of all the OT shadows (see Col 2:16, 17-note, Heb 10:1-note). As we see especially in the book of Hebrews, all of the types and shadows pointed to and are fulfilled in Christ. E.g., Jesus Lamb the Father provided for the sacrifice, so there is now no need for a better or fuller sacrifice for sin. In short, the ceremonial law vanishes with the coming of the One it was designed to foreshadow.
The civil law specific to Israel is no longer relevant to the NT believer. And yet so many NT believers today remain confused about their relationship to the OT Law and issue addressed in this "excursus".
Christians do not need to resort to Leviticus when discussing immorality. We have the teachings of Jesus that are quite clear. He stated that ALL sexual activity outside of the marriage of a man and a woman defiles you before God.

I have been waiting for this for a long time! I was forced to leave the USA to be with my husband from Brazil many years ago because he was not allowed to immigrate to the USA after his student visa expired. We tried every legal option. The last US consular official even told us (privately) he should just have an (illegal) arranged marriage with an American lesbian, because he would then be able to immigrate! The agent literally said since he is good looking (very) and masculine, if he married a pretty girl no one in immigration would even question the reasons for the marriage. I met him in January 2001 when I was 25 and now we have been together over 11 years. However, I have had to leave all of my relatives behind, except my mom, who moved here to be with us, and I only get to visit the rest once in a while. I have missed a lot of my niece growing up, and haven't been able to help my sister (widowed) raise her. And the US is also losing skilled workers with this discriminatory policy...I have two Masters Degrees and a PhD in Strategic Management from top universities. What I really can't understand is why people think a binational gay couple doesn't deserve the same immigration rights as heterosexuals after 10 years or more, when US law still allows "mail order brides", with the only requirement being that the couple has met in person, even if it is for only a few minutes! Thankfully, Brazil is way ahead of America in allowing gay rights, including marriage and all of the accompanying benefits, including immigration. The bad thing about living in Brazil is not being able to watch college football, as the only way to get the games is to find them rebroadcast on the internet! (Roll Tide!)

"Sounds like you should" work on reading comprehension! I am still in Brazil sweetheart and we have a very good life, as we are one of the fortunate binational gay couples. We own (paid cash) a 16 acre farm (with a full time caretaker and maid) in a 400 year old colonial town that is big with tourists in the middle of a national reserve in the tropical Atlantic rainforest, and have horses, dogs, tropical birds, etc. We are only 30 minutes from beaches and tropical islands, and 1 hour from a city of 2 million and international airport. I make over US$100 per hour doing academic translation at my leisure, which gives me plenty of time to do my own research and publication. Oh, and while the property values in the US have plummeted, (I sold my US property in spring of 2007 before the bubble), our farm has increased in value close to 400% since we bought it in 2006! What I have been waiting for is the US to offer equal rights to ALL American citizens, and the CHOICE of living in the USA with the person I love if we want to. "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."
