Enochs High School student Jordan Powers, 18, and James Hooker, 41, a teacher who recently resigned from the school, talk about their relationship on March 27.
Christopher James Hooker, the Modesto, Calif., ex-teacher whose romance with a student drew attention from around the world, was arrested Friday after being charged with one count of oral copulation with a minor in an incident that police said happened 14 years ago, the Modesto Bee reported.
The charge stems from a relationship Hooker is accused of having in 1998 with a 17-year-old student at Davis High School in Modesto, where he was teaching at the time, the newspaper said. Hooker was arrested at his home and booked into Stanislaus County Jail, police said.
Hooker entered a not guilty plea in Stanislaus County Superior Court, where a judge set his bail at $50,000 and assigned him a public defender, the Bee reported. A bail reduction hearing is scheduled for Tuesday.
Police were already investigating whether there was a criminal case against Hooker, 41, who resigned his job to move into an apartment with an 18-year-old girl he met while teaching in Modesto.
During the investigation of that case, police said, it was alleged that in 1998 Hooker befriended the 17-year-old student, developed a romantic relationship with her and sexually assaulted her.
After his recent relationship with the 18-year-old came to light, Hooker was placed on administrative leave Feb. 3 by Modesto City Schools and resigned less than three weeks later, according to a report at the Modesto Bee.
Hooker had taught business and computer classes. He left his wife and children to move in with Jordan Powers, an Enochs High School senior whom he met when she was a freshman at the school. One of Hooker's children attends the same high school.
"In making our choice, we've hurt a lot of people," Hooker told the Bee in March. "We keep asking ourselves, 'Do we make everyone else happy or do we follow our hearts?' "
Tammie Powers, the student’s mother, told the Bee she believes Hooker pursued her daughter, and she cited recent problems with her daughter’s grades and health. Her daughter had panic attacks, Powers said.
"I believe it was the stress of the lie," Tammie Powers told the newspaper.
After Hooker moved in with Powers, California Assemblywoman Kristin Olsen, R-Modesto, crafted legislation to strip teachers of retirement benefits if they have romantic relationships with students.
"My point is, whether you're 18, 17 or 14, the fact remains that a teacher is in a position of authority and influence over that student, and therefore, it is highly inappropriate," Olsen said.

For once, I am totally on the side of morality in the law. Or perhaps it is just common human decency. I doubt that there are many parents who would not object to what this guy has done. Kids have enough trouble finding their way without some wacko adult following his crotch. I hope the young girl finds out from the trial that she has been deceived by a sex offender who has pretended to be in love. She will likely find as she ages that he is out looking for another young lover to replace her. A bit of time separated may help her see that he is not really what she dreamed of.

I agree, he took advantage of his powers as a teacher to seek younger women. If this was my daughter, I am sorry but I would kill him. This will have a life long impact on this girl and I agree separation from him will do her good. Further more what kind of parent is he to his children who will also be impacted. He is talking like a teenager when he wants to follow his heart. This guy is sick and should be removed from ever being able to take advantage of young girls again.

If 18 isn't old enough to make your own decisions, please tell me at what age a person should be to be an adult. As for the 17 YO who waited 14 years to come forth with the accusation leave it to the courts. In CA the statute of limits for child molesting is 10 years you do the math

Actually, the article says he met the girl when she was a freshman. What's more curious to me is where the father has been in all of this. Are the girl's parents divorced? All I know is that if this were my daughter, this situation would never have reached the point where she would be moving in with this creep.

I think it humorous that if it was a hot female teacher going after a 17 year old male student, people would be giving him high fives. He could have met her on e-harmony and it would have been ok. This is ridiculous to waste the courts time and money. Simply ask her if she was willing. If she was, drop it.

And before everyone starts in, I have 3 kids two older boys and a 14 yr old girl. But being a realist, if she hooked up with a teacher at seventeen, age of consent, and was willing to pay for her college, I would shake his hand, not have him arrested.
It is sort of amusing at how many here are suddenly complaining about it's an imbalance of power when they were fine with the President and an intern. Also amusing that some of the same people were all about kudos to the various young males who have slept with much older women.
Moving in with an 18 year old student may be immoral but not all immoral acts are illegal. What he did is in my opinion very wrong but at 18 she is of legal age, and 2 years above 16 which is the legal age in some states and even most countries.

I have no issue with older men hooking up with a younger woman, happens all the time, for many different reasons, the point here is that he first met the 12 year old looking girl when she was 15 or 16 and she was his student, do you seriously think they just starting being involved since she was of legal age? and he was in a position of power and had done this before? are there others we haven't heard of? If he hadn't been her teacher would we have heard of this, would anyone really cared outside of the wife and her parents? I want my son and daughter to be able to go to school and not have to worry about a teacher, staff member or coach taking advantage of their influence to abuse them. As to this POS, there is no doubt in my mind that he has been molesting children for a long time. However, with his current conquest, he covered his tracks.
As Richard pointed out, 1998 was 14 years ago, they really had to do some pretty heavy digging. But, (since I looked it up) CA also allows prosecution within one year of when a sexual assault is reported to police, even if it is after the 10 year period......
In any case, why would the judge allow a $5000 bail. This guy needed to be locked up for a while so the girl he was brain washing could get her head on straight. There is no doubt he was using his influence as a teacher to take advantage of her.
Exactly my point. When I was 22, I was in a relationship with a 16 year old girl. She was more mature than most girls several years older and her parents had no problem with it at all. In fact they trusted me more than they did guys her same age. Of course, that was the seventies, before parents kept their kids from turning into adults. Now they're not allowed to make their own decisions until they're in their late 30's.

A little story. I had a karate instructor when I was much younger. He liked a girl that came to the studio. She was 14. he was 29. When she turned 17 they started dating. When she turned 21 they were married with her parents blessing.
They have been married for 15 years which is more than most marriages nowadays. Love is love. Labeling someone a pedophile can be entirely inaccurate, and trying them in public opinion can be damaging.
People assuming that he abused this girl is way out of line. Ask her. She is not claiming abuse, and is probably crying herself to sleep because witch hunters arrested her love.

Jerry... I am not by any stretch a supporter of pedophiles and agree on their being incarcerated, but it is a myth that they can't be helped or treated. Again that does not mean that they shouldn't be incarcerated.

Seems like we have yet to learn from the dozens of cases where people were falsely tried and convicted in the media with little information and then they later turn out to be innocent. I've yet to hear proof he did anything with a 17 year old and 18 is of legal age. Engaging in sex with an 18 yo student is definitely morally wrong, but wrong and illegal are two very different things. Also, you say people here like the idea of abusing kids? What evidence do you have of that? Is discussing what is legal and illegal supporting the abuse of children?

Are there Statutes of Limitations on Sexual Abuse Crimes in California?
California does technically have statutes of limitations (SOL) on some of its sexual abuse crimes that require lawsuits to be brought within a certain time period. However, there are huge loopholes that usually allow most anyone to bring up a sexual abuse lawsuit even after the statute of limitations has expired.
But It is important to remember that the statute of limitations that applies is the one that was in place at the time of the crime itself. So while the statute of limitations may have been lengthened in the time since, if the limitation ran out, it can NOT be reactivated.
Example: A man commits an act of molestation in 1965, when there was a 3 year SOL on the crime. In 1970, the legislature removes the SOL from child molestation. The man can not still be prosecuted, because the SOL had expired before the law was changed. If the law had been changed in 1968, however, he could be prosecuted.
If you are the victim of abuse, the first thing you must decide is whether you are pursuing something criminally or civilly, as the statute of limitation is usually different between the two of them.

Criminal Prosecutions for Sexual Abuse
For criminal cases, a prosecutor may file a charge of aggravated rape at any time, with no limitation (in California, an aggravated rape is rape that involves a weapon, more than one person, or seriously injures the victim). Prosecution for "normal" sexual assault has a statute of limitations of six years. However, there is an exception made for DNA analysis. Since it is a relatively new technology, if a DNA test can conclusively prove the identity of a rapist, prosecution can take place within one year of the discovery.
In regards to child molestation, there has been a series of great upheavals regarding the statute of limitations in California. In the early 1990s, the legislature passed a bill that retroactively waived the statute of limitations for all crimes of child molestation, meaning even people who were previously immune to prosecution could suddenly be arrested. This law was overturned as unconstitutional by the Supreme Court in a recent case, so now the law's retroactive provision is eliminated.
What remains is a 10 year statute of limitations for child molestation. HOWEVER, the crime can also be prosecuted within one year of WHENEVER a victim tells the police (even past the 10 year mark). This sounds rather contradictory, because this means that the 10 year limitation is essentially pointless, but it is the current law of the land. The California legislature is constantly debating about this, so the law may change in the near future. You should talk to a California attorney familiar with these cases for the most up to date information.

This guy used his position as a teacher and someone in a position of authority to prey on underage girls. I do not buy that their relationship was not sexual until after she turned 18 when he admits the relationship had been going on since she was 16. Even if you do buy his story, was in a position of authority over this girl and used that position to lure her into a relationship. He is scum and should be locked up. That said, these charges about something that supposedly happened 14 years ago are ridiculous. We have a statute of limitations for a reason. In addition, there can not possibly be any physical evidence to support the charges and it will be nothing but a he said she said if it goes to court. If that happens this guy will be convicted based on the jurors opinions of what he is doing with the 18 year old now and not based on any evidence, or lack there of to support the actual charges. To allow a case to go to charges based on an incident that supposedly happened 14 years ago would be an abuse of the judicial process in this case. It's over a decade later...seems to me this is a crusading prosecutor mad about the present case they can't charge him with currently, and going on a witch hunt to charge him for something waaaaay in the past. I think the man should be held accountable but I also think if these girls no better at the age of 17 and 18. She must of been looking for a daddy. She may well seem a mature young girl but the fact remains, she is still a young girl, albeit of legal age. She is only 18 and has nowhere near the experience of a grown woman. Her entire life will change many times before she reaches the age of 40. Her life is one of limited experience compared to someone twice her age. Think about when you were six years old. You thought yourself quite grown-up. You were going to school and you knew so much more than those baby four year olds. Then, when you were twelve, you laughed at how silly you were "back then". You laughed because, at 12, you knew you were so much more mature than a little six year old. But … at 24 you realize that little twelve year old knew so little about life. And, looking back from 24 or thirty or more, you can see that, at 18, you were not really as mature as you thought you were back then, either.

And, what's wrong with that is that she was a minor and that makes him a sexual predator. And that means, if convicted, he would go to prison for a long, long time and his latest victim will go back to her mother, get psychiatric therapy and figure out why she is attaching herself to father figures.
The article also says they were investigating him regarding possible charges in the current 'situation' when the new, er … old? … matter came to light. He is 23 years older than she and, being a teacher in her school since she was a freshman ... many young girls have a crush on a teacher in high school. Most of those teachers have the intelligence to gentle put them off. The ones who do not are merely reivers and the halls of the schools are their hunting ground. Unfortunately, it is nearly impossible to tell, before the fact, who is one and who is the other. Sort of like looking at a newborn and trying to foretell whether he or she will grow up to be a mass murderer, a model, or just somewhere in-between.

Sounds like a case of prosecutorial sour grapes here. They can't bust the guy for his present relationship so they have to go back 13 friggin years to find something to harrass him with- and even then its only an accusation. It seems to me that many Statute of Limitations (SOLs) that are set up like California's aren't SOLs at all, but legal double-talk that actually allows the state to disregard reasonable time Limitations and accuse a citizen of a crime decades after an incident is alleged to have occurred. But when someone 16 and up has sex with an older person they need to accept their own responsibility as much as the older one does. Oh Yeah, one last thing...Who do you think is traumatizing the girl here more- the man who "manipulated" her into her present relationship..or the publics and presses knee jerk reactions and condemnations of their relationship- which they know NOTHING about if truth be told. If I understand this right this all happened 14 years ago,he was 27 years old then and she was 17, so what is the big deal about this,I don't understand the problem she was not a little kid anymore when she let him move into her appartment,that he left his wife and kids is another story, you hear that too many times lately,that is a bigger problem i would say.

Years ago the daughter of a family friend married her h.s. teacher right after graduating. But it was a genuinely mature relationship which has so far lasted 40 years. And they married, they did not shack up. I saw this couple of TV and it seemed possible--barely--that his conduct was legal but he was definitely sleazy and, at best, narcissistic. It was especially interesting that he used his own church as part of his seduction.

Correct definition usage is important.... Pedophilia is an attraction to prepubescent individuals. These are usually 12 and under. Being attracted to a 17 year old girl who's gone through puberty isn't actually pedophilia. Acting on it may be stupid and against the law, but it's not pedophilia.

This sounds a little funny. Im not advocating it, BUT why in the world if this guy had a track record of this behavior WOULD he risk it all by doing what he currently is doing and being vocal. Sounds like a Vendetta, which is debatable.

The when he keeps getting away with it it loses some of the excitement because roller coaster ride wondering if he will get caught is over because he knows how to get away with it. In effect by doing what he has done he has raped every parent in the school system heck even the country because they were all wondering if some skunk was doing the same with their child.

Comparing a 17 year old to a 40 year old is absurd. The human brain doesn't complete its growth process until 25 years of age. So she does not have the critical thinking skills to make these choices--no teenager/child does. He is an adult and a teacher. He needs to go to jail for sexual abuse and abusing his power. Although if you would care to look you would find in Many cases there have been many who have done great things long before they were 25, And i guess we need to tell most of our parents and grandparents( many of them married as young as 15) that they did not have the skills and what they all did was wrong!

The story is refering to something that happend 14 years ago with another girl. For whatever reason he was not arrested and charged then. He had not been arrested for the current situtation because the girl is 18 now and considered an adult and there is no proof that they were sexual before she turned 18. He can't be arrested on the basis of what people think might have happened before her 18th birthday with out proof.

I wish it would have been explained how the police came to finally charge this jerk with an assault that happened back in 1998. There is a big piece missing here. This is the problem that I'm having with this case. Why are you going to charge him with something 14 years after the fact? Why was he not charged then? This is sounding like more of a way to get at him now, even though he hasn't committed a municipal crime by sleeping with this girl. That's just lazy police work, and I would hope the case would be dropped, because I can see a slippery slope happening from this.
To me though, there's no difference between a 17-year-old who's 1 day away from turning 18, versus an 18-year-old. The problem I have is teachers violating principles and sleeping with people they're supposed to be teaching.

Oh, val, she was a freshman in high school and not almost 18, and if the man was her teacher or a teacher where she went to school or even in the system...oh heck, he was a teacher and he liked underage girls. But as a criminal justice student, I thought there was a statute of limitations on crimes like this. 14 years to bring charges??? Did the girls' parents file charges or are they just finding out now? Why didn't the school find out about this sooner? And if they did know, why didn't have his credintials yanked? I am not blaming either girls...I just think that something should have been done sooner to stop his actions.
It depends on what the statute of limitations is in California for that particular crime. Here, I think it's about 15 years if I remember correct... and that's likely fairly standard for most other states I would think.
What remains is a 10 year statute of limitations for child molestation.
HOWEVER, the crime can also be prosecuted within one year of WHENEVER a victim
tells the police (even past the 10 year mark).

It should be law in every state that teachers including college teachers not to have a sexual relationship with their students. It also needs be a law that all teachers refrain from going into bars, nightclubs, and other places that serve alcohol. This is not good examples for students to follow. Of course schools are going to pay the teachers for 24-7 service right? If they want to call the shots in someone's off time then they damn well better be paying those teachers for that time. I shut up one boss I had who wanted to start making rules about people drinking on their off time by simply saying " Alright! We're going to get paid for 24 hours a day!" It was the last time we heard about rules for our off time.
