George Zimmerman to plead not guilty to second-degree murder in Trayvon Martin case

Hours after Florida Special Prosecutor Angela Corey announced that George Zimmerman had been charged with second degree murder in the shooting death of Trayvon Martin, Martin's parents told NBC's Brian Williams that Zimmerman's arrest helps fulfill their goal of bringing their son's shooter to justice.

Updated at 7:09 a.m. ET: George Zimmerman is in custody in Florida and will be charged with second-degree murder in the shooting death of Trayvon Martin, authorities announced Wednesday. His attorney said he would plead not guilty.

"We did not come to this decision lightly," Angela Corey, the special prosecutor appointed by Florida Gov. Rick Scott to re-examine the case, said at a news conference in Jacksonville.

Corey had previously said she wouldn't present the case to a grand jury, which took first-degree murder off the table. Second-degree murder carries a maximum sentence of life in prison.


Zimmerman's attorney, Mark O'Mara  — who took the case late Wednesday after Zimmerman's previous attorneys withdrew — said Zimmerman would plead not guilty and that he would seek Zimmerman's release on bond. Zimmerman was scheduled for an initial hearing Thursday at 1:30 p.m. ET.

"I think he's troubled by the fact the state decided to charge him," O'Mara said. "I would think anyone charged with second-degree murder would be scared."

Corey said she decided last week to seek the charge but needed several days to make sure all details were in order. She said she had informed Martin's parents, Tracy Martin and Sybrina Fulton.

'A heart has no color'
In a brief statement in Washington at a news conference at a gathering of the National Action Network, Fulton said: "We just wanted an arrest, and we got it, and I say thank you. Thank you, Lord. Thank you, Jesus."

"I just want to speak from my heart to your heart, because a heart has no color. It’s not black, it’s not white. It’s red. And I want to say thank you from my heart to your heart," Fulton added, according to NBC News.

Trayvon Martin's mom: I believe killing was an 'accident'

(The National Action Network is a project of the Rev. Al Sharpton, host of MSNBC-TV's "PoliticsNation," who has played a prominent role in advocating for charges against Zimmerman.)

“I think they decided to review it based on public pressure," Sharpton said, according to NBC Miami. "Had there not been pressure there would not have been a second look."

“Tonight maybe America can come together and say only the facts should matter when you’re dealing with a loss of life," he added. "This is not a night for celebration. This is a night that should not have happened in the first place."

On NBC's Rock Center Wednesday evening, Fulton said that she found Corey professional. 

"I believe there is a human side to her," she said. "I believe she looked at the evidence, spoke with the witnesses and determined what (Zimmerman) should be charged with."

Ben Crump, the attorney for Martin's parents, said the decision was about "justice, justice and only justice." He said it was important that Zimmerman have a fair trial, even though "we believe in our hearts that he was wrong to kill Trayvon Martin."

Corey refused to discuss details of the case, saying she was committed to protecting the interests of both Martin and Zimmerman.

"So much information on this case has gotten released that should never have been released," she said.

Zimmerman, 28, arrived in a police caravan at the Seminole County jail about 8:20 p.m. ET. Under Florida law, he must be taken before a judge within 24 hours of his return to the county, where he has acknowledged he shot and killed Martin, 17, in the town of Sanford on Feb. 26. Corey wouldn't say where he was being held to protect his safety.

Scott, who appointed Corey after Seminole County authorities declined to bring charges, said in a statement that the matter "is now in the hands of the judicial system and I am confident justice will prevail."

Attorney doubts fair trial
Zimmerman, whose father is white and whose mother is Peruvian, says he shot Martin, who was black, in self-defense after following him in a gated community in Sanford. Police questioned Zimmerman but decided against pressing charges.

The lack of an arrest or charges had sparked protests nationwide, with critics alleging that Zimmerman confronted Martin because of his race. Zimmerman's supporters deny that.

Trayvon Martin's parents say they're thankful there was an arrest but that 'this is just the beginning.' NBC's Ron Allen reports.

The decision whether to arrest Zimmerman was delayed for several weeks because Zimmerman had indicated that he would argue self-defense under Florida's so-called Stand Your Ground law, which shields subjects from prosecution if a judge determines that the shooting was justified to protect life or property.

Corey called the law "a tough affirmative defense to overcome," but she said, "If 'Stand Your Ground' becomes an issue, we will fight that affirmative defense."

O'Mara, Zimmerman's attorney, told reporters that he didn't think Zimmerman could get a fair hearing "today" because "the emotions are just running high in Central Florida."

"I am hoping the hatred settles down," he said.

A federal civil rights investigation is also under way, but U.S. Attorney General Eric Holder said Wednesday that the Justice Department had to meet a "high bar" to bring any charges.

The main federal role is to "support the state in its ongoing investigation," Holder told reporters Wednesday morning in Washington. At the same time, he said, the Justice Department is conducting its "own thorough and parallel investigation" to try to resolve the case "in as fair and complete a way and as quickly as we can."

I say charge him with 1st degree murder. From the day he bought that gun, and joined the neighborhood watch (hunting) group, George's mindset was that he was ging to get him "one of those guys who always gets away". It was premeditated against someone of color, and Trayvon was just at the wrong place at the wrong time. Throw the book at him!!!

    Okay how would everyone feel if a black man shot a white 17 year old unarmed child and claimed the stand your ground defense. Would the black man be in right then. I don't care that Zimmerman is a white Hispanic man. I don't care that Trayvon Martin was a black teenager in a hooded sweat shirt. I only care that an unarmed teen was shot and killed by a man who had been told to quit following the teen around.

      I can adimit I may be wrong but I dont think this was killing about Race essentially. I believe It will turn out to be vigilanty justice brung onto an innocent victim.                             Yesterday on Hardball, Chris Matthews was asking the question, "What will it take to get Zimmerman convicted?" It's a shame Zimmerman hasn't had his day in court and already some have him convicted. Can't we at least wait for a fair trial and hear all the details first....and then hang him?

Amazingly, the whole of Black America who happens to be wearing a hoodie--or not--has now become potential suspects or poster children which ellicit abject dread and fear in the eyes of many (if not most) White Americans. GUILTY BY COLOR AN CLOTHING! The two are mutually inclusive. Interestingly, it doesn't work with Whites. When Whites wear hoodies, all is good and safe in "Pleasantville".

                            It seemed to not matter that Trayvon was the one who got shot. HE WAS THE VICTIM!                                       The decision to charge is the correct one. The "stand your ground"law is an affirmative defense.... it has to be proven to be appropriate. My understanding is that it has been alleged something like 120 times & only upheld 19 or 20.( contrary to what some people think, it is not a shoot first, ask questions later: license to kill, but a question of whether the defensive actions are appropriate under the circumstances) if the police have done a thorough investigation they would have collected evidence to be analyzed...... details that none of us reading media coverage have. These details will determine the appropriateness of Zimmerman's actions, in a court of law, as it should be. I am curious, if anyone in FL knows...... since they have charged murder2, can he be convicted of only that or could he be found not guilty of murder2 but guilty of a lesser included offense,.... negligent homicide , manslaughter etc?..

                                      It's been upheld 120ish times, and a few (less than 20) were similar situations (such as the guy who followed the radio thief to ask for his property back and ended up killing the thief.)

                                        I ask as a lot of people on here are ignorantly/idiotically making comments about Zimmerman "following" and NOT knowing what was said. Per NBC's tape, Zimmerman "stated" Trayvon was black, and when asked "are you following" stated YES...and THAT's IT...

                                        In the REAL tape...The 911 dispatch ASKED "what color is he" and Zimmerman replies "I think he's black" THEN

                                        the 911 dispatch asks "are you following him?" Zimmerman says "yes" dispatch says "stop" Zimmerman says "OKAY"..

                                        Unlike NBC/MSNBC/ABC/CNN/CBS the ReAL tape has this...so, for you MORONS out there convicting Zimmerman w/o a trial.

                                        I don't know if he's guilty or innocent, but it just kills me how many people have convicted him and MOST haven't heard the 911 tape. From listening to the tape, GZ did back off when told to...

                                        But by NBC's tape, he stated Martin is black, he stated he was following...but those are edited, leaving OUT the responses...

                                        The morons here that post based on NBC's tape need to have their voting rights revoked, as it's a shame and not America.

                                        Let the police do their job...celeb idiots like Sharpton, Jackson, Barr and Spike are nothing more than PR hounds looking for their next fix...

                                        I have heard all the 911 tapes, and Zimmermans in it's entirety. I did not really know people like Chris White Trash were so prevalent.                                         Myfamily he did stop following him. He was on the phone with the dispatcher in the back of the subdivision where there were no street signs. He was trying to find street signs and lost track of Trayvon. He needed to know his exact location to give to the dispatcher. Trayvon then jumped Zimmerman and started to beat him up. From their Zimmerman in self defense pulled his gun and defended himself with it. All this trial is going to be is a show. The state had to arrest and charge Zimmerman to stop the riots caused by the bias media.

                                        GPS in a GOOD (as in dedicated GPS unit) are typically accurate to withing 60 feet, some down to 20 feet. Phones are less accurate. even that 60 feet could be off as much as 120 feet and weather impacts consumer GPS greatly. That about covers the entire block the incident took place.

                                        is this another case of trying to appease black america.......like in OJ's case. This isn't about race, Zimmerman is a minority himself. The media is stirring up the pot, with pictures of a 12 year old smiling Trayvon. The facts arent even clear, because of so much trashing in this case. I just hope he gets a fair trial, as a human, if he is fairly convicted then so be it. I know nothing about the 17 year old , other then he left behind parents that love him, may he RIP.

                                          Shows that not only do you not know anything about what you are talking about, but that you never bothered reading the case facts or listening to the unedited 911 calls.

                                          1) a dispatcher is not a police officer.

                                          2) he didn't give him a direct order, and he couldn't anyway.

                                          3) Zimmerman, based on the sounds in the background ('wind noise' slows down, Zimmerman stops breathing hard) and the further conversation (giving directions, almost stating where he lived but didn't know where the kid was and didn't want to say it out loud, then agreeing to meet the officers at the mailboxes) did stop the pursuit.

                                          Yes you did George, you ran to catch up to him, when you got close, you reported you didn't know where he was, but you had come too close to him to give your address out loud, and you didn't want to meet officers at the mailboxes anymore.

                                          That's the narrative all the facts come together to fit into -George's mouth is all the evidence.

                                          Everything he did is on tape fitting together like a puzzle; a roadmap leading to his conviction.

                                          And that don't even include what the witnesses have told the prosecution.

                                          Zimmie better plead to a lesser charge -this woman can convict him of murder. He'll cop in a while.
