McDonald's worker in South Carolina arrested after phlegm found in tea

A teenage McDonald's employee has been charged with unlawful and malicious tampering with food after customers found phlegm in their tea, police in South Carolina said. WYFF-TV's Mike McCormick reports.

A teenage McDonald’s employee has been charged with unlawful and malicious tampering with food after customers found phlegm in their tea, police in South Carolina said.

Deputies in Greenville County said a mother and her daughter ordered sweet tea from the McDonald’s in Simpsonville on Saturday.

After getting the tea they noticed it was not sweet, according to deputies. After returning the drinks, the customers realized that the order was still not correct, deputies said.

Deputies said rather than going back to the restaurant, the victims went home to add their own sweetener. They said when they opened the tops they noticed a large deposit of phlegm was found floating in both drinks.

Deputies said Marvin D. Washington Jr., 19, was arrested and charged with unlawful and malicious tampering with food.

According to an arrest warrant, Washington was seen on video leaning his face down to the drinks before filling them with tea.

John Kennedy, owner/operator of that McDonald's outlet, released a statement asking people not to rush to judgment.

"Nothing is more important to me than the safety and wellbeing of my customers. I want to assure my customers that my restaurant has the most stringent food safety and quality standards and I caution anyone from reaching a conclusion without the facts," he said.

“As this is a pending police matter, it would be inappropriate to discuss further and, as such, any additional questions can be directed to the police department," he added.

Absolutely disgusting, inappropriate, immature and leaves to wonder why.

That said, it reminds me of the old adage of never upset the people who handle your food or your money.

These activities are the major reason I don't frequent these establishments but then if people really knew what goes on, not only in fast food chains or restraunts but in the food industry in general, they'd choke. I've worked quality control in a few food industries and what I saw made me leary of any processed food. Cigarette butts in the mix, spoiled meat mixed in with fresh and other things I can't comment on. Not saying it's all bad.... most isn't but your certainly taking your chances.

This has been going on since I was a teenager. And that's a long time ago. It's pretty common if you piss someone off in the fast food industry. I remember spit, wiping the floor with the food, picking one's nose and wiping on food. The drive thru fast food restaurants are perfect for that. Enjoy.

The only remarkable thing about this is he got caught - idiot forgot to stir :D

I worked at McD as a teen, and stuff like this happened all the time. I think that's the reason their restaurants nowadays have those open cooking bays where customers from the lobby can see all steps of the food preparation process.

Idiot needs to remember that there are nut jobs out there that may come back for a little payback. A knife in the gut, bullet to the brain, severe beating, etc. Was it really worth it, when you consider that the mistake was his to begin with? They ordered sweetened tea. He wasn't paying attention, so they sent it back. Whatever happened to "Opps, sorry. My mistake. I'll fix that for you right away! And the drinks are free!" Little a$$hole needs his butt kicked.

The kid made a mistake on the order and instead of just politely correcting the error, he decided to act like an idiot. This type of behavior is, unfortunately, not all that uncommon these days. Customer service has gone down the tubes and you can forget about the old adage of "the customer is always right." Now this kids stupidity is going to result in his having a criminal record following him around for the rest of his life.

I have to laugh at the owner of the McDonald's with his comment:

"Nothing is more important to me than the safety and wellbeing {sic} of my customers. I want to assure my customers that my restaurant has the most stringent food safety and quality standards and I caution anyone from reaching a conclusion without the facts,"

How many more facts does he need on top of the video showing the kid spitting in the cups, "[a]ccording to an arrest warrant, Washington was seen on video leaning his face down to the drinks before filling them with tea," and the fact that their was phlegm in the drinks. He should be apologizing to the customer and making it known that this kid has been fired, not trying to support the kid by saying people should not jump to conclusions when the facts are pretty obvious.

    #1.22 - Thu Apr 19, 2012 12:09 PM EDT

Yes, "... never upset the people who handle your food or your money." When I eat out, I always, always wonder what the staff, behind closed doors, do to my food. I'm always polite and I tip well but, you never know.

When I was a teenager, back in the sixties in Shreveport, Louisiana, I worked at a (today's largest) fast-food restaurant and was told by another teenage employ who had transferred jobs from a competitor that one of his co-workers, at the other restaurant, had conducted a vile act on the grill which was hidden from view unlike our grill/prep-area which was visible through windows to folks on the outside--they could see everything we did. (Notice that the prep-areas of the world's largest fast-food restaurant are hidden from view now-a-days.) Rather than spread ice or water over the hot grill to simmer and, later, be scraped to remove any stuck, burnt meat on the grill (a common procedure conducted at my restaurant as well) into the catch basin for grill drippings, this young person, at the other restaurant, peed on the grill in lieu of ice/water to be humorous. Then, he laid out the next batch of hamburger patties. I'm sure the heat of the grill destroyed any chance of (enter your worst nightmare here) from being transferred to any of the patties but it's the thought of the act which is sickening.

As businesses cut back during the current economic mess we find ourselves in today, adults (higher-paid employees) in supervisory positions are considered to be unaffordable luxuries (Is your business reputation not worth it?) to be cut loose (fired, sacked or not hired to begin with) leaving young, low-wage earners free reign in your stores. I'm not knocking young people except to say that they haven't, yet, developed the maturity to know the importance of, what seems to them to be, small matters which can become disastrous. Remember the YouTube incident from a popular pizza restaurant chain a couple of years ago where a female employee recorded her male co-worker, supposedly, doing nasty things to pizzas? No adult supervision was present that day/evening. That restaurant no longer exists. (Then of course, we have adult members of the Secret Service misbehaving which, almost, blows my argument.)

The point I wish to make is that adult supervision is not only necessary but it should always be a requirement in all businesses.

When I was a kid (16) and worked in a fast food joint, they cleaned the grill with acid and cooked on them at the same time (area). We called them acid burgers..! The oil for the chicken fryer was cleaned about every 4 days.. dirty oil is crispy chicken! We use to have tartar sauce battles in the walk ins!

I heard about guys there who used to piss in the Dr Pepper .. so go figure!

I actually need to respond to articulate what I was implying? Remember, I'm not accusing anyone of anything; the facts do that for themselves. Consider:

Jessie Jackson criticized president Obama over the Jena 6 case for "acting like he was white". What exactly do we think Jessie was implying?

Jesse Jackson once referred to Jews as "Hymies" and to New York City as "Hymietown".
Unknown to Jessie, his comments were published forcing a faux apology from him.

Jessie Jackson was among the first to condemn and convict (in the media) the Duke lacrosse players in the rape allegations. He said that all white men fantasize about raping black women, saying this fantasy goes back to the master/slave days.

A little research will uncover much more but I trust I made my point.

When I was young,I was out riding around with 3 friends one night, one of them had a pal who worked at a nearby McDONALDs, and he suggested that we stop over there and see his pal who would give us free food...so we stopped by, my friend ran in,spoke with his pal and ran back out to the car......

We drove around the back and his pal runs out the door with a tray of about 40 freshly cooked hamburgers and we ate well, well, as well as you can say for McDonalds.I asked my friend how it was that his pal could get away without someone noting 40 burgers were missing..."Easy," he said, "They only keep tabs on the numbers of hamburg patties, not the buns, so when he makes up the next tray of "BURGERS", he does NOT put any meat into them, but he just goes extra heavy on the ketchup, mustard and pickles....and people buy them and never come back with a complaint !"

The reality is, that those burgers are tasteless anyway, all you taste is the mustard, ketchup and pickles.....YUMMY.

Ok howieCA, what this has to do with the article is; do you think this fellow would have thusly contaminated these drinks if the patrons were black? Jessie didn't spit or otherwise do anything to food ordered by black people either, and you don't see any correlation. Ideology is certainly a debilitating condition, isn't it?

Ideology is certainly a debilitating condition, isn't it?

Now you're really confusing me. What - and whose - ideology are you referring to? I don't have any agenda here. I merely asked what you meant. This was an article about a (black) teenager spitting in someone's food. You said Jesse Jackson did so to white people when he was young, and asked "Does that tell us anything?" Umm, no, it still doesn't tell us anything. So what if there's a similarity? Do you think Jesse Jackson is out there *teaching* kids how to "get whitey"? And do you even know that the victim was white? And why should it even matter? It's disgusting, and a felony, and he should be punished for his crime. Race is irrelevant.

It's not just fast food restaurants this happens in. Back in the 80's I worked in a "high class" restaurant (which is still in business) I would see the chef take a spoon and taste what ever he was making and use the same spoon and stir it. I have seen sweat drip off of them as they were standing over the food. A piece of meat would drop on the floor they'd pick it up and cook it. Sh!t like this happens in all types of restaurants not just fast food.

@ Crying shame do you also figure in the cost of the gas and time it takes to go to McD's ? I think you will find your costs being higher than you think.

Just me not if McDonalds is 3 blocks away or at Walmart when you go shopping. The same corners in my town that have the grocery stores also have McDonalds, KFC, Burger King, Subway, Jack in the Box, Pizza Hut, Whataburger and Pilos Mexican restaurant.

I've been to other countries and fresh food is definitely tastier, so it's just you rkb5555.

Well a "cook" at a chinese joint locally made a name for himself when he was caught adding the secret ingredient to what became known as "cum drop" soup.

Marvin D. Washington Jr, I'm surprised they didn't title it "Black man spits in complaining crackers tea". I'm sure Jessy and Al can prove that the phlegm was a justified response to these white women harassing the black employ. Stand proud McDonald's workers, demand justice, demand equality, demand the right to spit in peoples food if they disrespect you.

This is the culture of America's youth nowadays. It is pitiful that young workers have this attitude. Not all of them, mind you, but a big majority. No pride in their work, no integrity, and no work ethic.

Instead of being helpful because they made a mistake, they took the attitude that the customer was being unreasonable, and was interrupting.

                                        God help us.

They most likely learned it from adults. I've seen videos of adults at work pissing in the coffee pot, pissing on their boss's chair in his office.

Sandie- I saw this little post you put in, maybe you should look into your own "problem". I will admit, I did think it was funny, retarded, but funny.

This was written by Sandie- "Look at the lengths white people will go to in order to cover their, IMO, flat behinds. Deny and obfuscate all you wish, the truth is not in your denials and lies, however, the day is coming soon when you will see the truth, right in your face. Then what?????

Julie, you are just a little late with the Chinese ENtitlement issue, the U.S. paid their reparations for being in the internment camps during WW2 a while ago. I know you are so very tired of hearing the bull about slavery, so on and so forth. Well Julie, I guess you could have simply ignored this forum and gone on about your lily white day. But, my goodness, it seems you chose to post your rant so I guess you really are not tired of hearing about all the bull. Faith and begorrah, or whatever the Irish go on about. Kiss the Blarney stone much?"

tea - Unfortunately, this type of thing has been going on for ages. It's definitely not just youth. I've been waited on by older individuals who behaved as if the world was coming to an end because they had to ring somebody up. Perhaps folks who are that easily perturbed by a customer asking for what they actually ordered or annoyed by customers in general, should seek a profession that isn't in a service industry.

Nowadays? You're more than just a little naive.

This has been happening for a very, very long time, and adults do it just as much as kids. You get any food prep work with behavioral issues, and you never know what sets them off.

And almost all of them lived in Northern cities so you can also stuff your Jim Crow BS. I need apologise to no one in this country.

Just for you know what and giggles, I clicked the link you provided, It was, as expected, much ado about nothing. There is no identifiable source for that "article." Anyone could have written that. It looks and sounds like something the Aryan Nation would put out. The fact that you treat it as a fact, somehow, does not surprise me. Heil Hitler y'all.

I took note of the name John PekkANEN. I look him up as well. I also took note that the site is an "educational" parody (their phrase, not mine) so I, obviously, question the motive(s) regarding the quality of the "educational" material.

Very wise! I once worked in a very, very upscale restaurant-waiters all in tuxedos, etc. Whenever someone returned their food, the chef would spit on it/in it or sometimes worse. NEVER RETURN FOOD!!!

This is what one (me) expects from minimum wage workers!

Low pay and fast food are not a good mix.

Low pay and food handling, period, are not a good mix!

Not to mention low pay and manipulation of actual hours worked to avoid paying overtime to increase profitability, a common practice among McDonalds franchisees. What this dirtbag did is abhorrent, and so are the practices of some franchise holders.

TonyinWyo has made several comments about race on here already. He has said enough to make me think that he is just an angry bigot. I would disregard anything else he has to say. It's not likely to be an informed or intelligent comment.

Thing of it is, TonyinWyo, the kid was a white teen, not a black teen. Stupidity is equal opportunity (tho’ it seems the GOP has more than it’s share now).

I suppose the fact that the President is black is not why the call him muslim, debate the birth certificate idiocy, say he’s not from this country, ad nauseam?

That’s just like saying Romney’s a member of the KKK and has multiple wives is not because he’s white or a mormon...

                                              Gawd... stupid people shouldn’t breed.

Not only are some of Macs less then caring is serviing the public, but at times they can be rude. Those million hamburgers numbers could drop easily, too many competitors out there and Mac does not have the corner market on cost anymore.

As for the manager, ho ho ho ...no rush to judgement on this. I'll pass on the morning breakfast.

Must not have wanted the job; must not have needed the money. I'm sure the medical tests he is to undergo to check him for communicable diseases won't cost him a dime. Soon this will become front page news; the McDonald's will close; throwing dozens of people out of work who may need the the job and the money. This is Marvin D. Washington Jr.s 15 min. of fame. How proud his parents must be.

I've got lots of friends in different areas of food service from fast food to very upscale, and the only time someone messes with the food is if they're complete @!$%#s. Nah I'd be a real law abiding citizen and sue his parents for everything they have and the restaurant. Might as well make a buck off of it.

Doesn’t matter if the woman and her daughter were “teetotaling bitches” about it. They were customers, his job was to fill the order correctly and move ‘em on. Are you saying that if they were real beaches, the hocker in the tea was OK?

What an incredibly inane thing to say or even suggest. If the customers were rude, then send them on their way. Tell ‘em to get lost. Don’t ever do anything that could possibly harm them. Why? Because at the very least, they could sue the pants off you. Worst case is daddy could come back after you got off work and teach you a lesson you wouldn’t soon forget.

What ever happened to civility and common decency?

Like I said what he did wasn't right, but obviously those of you who are bitching have never worked in the food service industry, there are people out there, who will never be happy no matter what, and they will treat you like you're the scum of the earth, used to happen to me all the time, what they didn't know was that this was my THIRD job so I could pay my way through college while trying to raise my daughter. You know not to be a welfare mom, I never did anything to anyones food, but I thought about it more than once.

You people are obviously from the North and have no idea what sweet tea is, sweet tea in fast food places are just like regular tea it comes pre-made then you "boil" it through the big metal tea jugs y'all see.

civility and common decency would be to not treat the Fast Food worker like they're less than human in the first place.

If Mr. Washington was under-paid before, he is unemployed now. I can only wonder what his next job will be.
