Daniel Chong, the UC San Diego student who was left in a Drug Enforcement Administration holding cell for nearly five days, said the time spent there was a life-altering experience. On Wednesday, the DEA apologized for the incident.
The 23-year-old spoke with NBCSanDiego and said he was increasingly worried throughout the days he spent in a 5-foot by 10-foot cell. “They never came back, ignored all my cries and I still don’t know what happened,” he said. “I’m not sure how they could forget me.”
In a statement, DEA San Diego Acting Special Agent-In-Charge William R. Sherman said he was troubled by Chong's treatment and extended his "deepest apologies" to him, The Associated Press reported.
Sherman said the event is not indicative of the high standards to which he holds his employees, AP said. He said he has personally ordered an extensive review of his office's policies and procedures.
NBCSanDiego was first to report Saturday that the DEA confirmed its agents were investigating an incident in which a suspect, arrested April 21, was detained at their office for several days and allegedly forgotten about.
Chong said he was at a friend’s house in University City celebrating 4/20, a day many marijuana users set aside to smoke, when agents came inside and raided the residence. Chong was then taken to the DEA office in Kearny Mesa.
He said agents questioned him, and then told him he could go home. One agent even offered him a ride, Chong said. No criminal charges were filed against him.
But Chong did not go home that night. Instead, he was placed in a cell for five days without any human contact and was not given food or drink. In his desperation, he said he was forced to drink his own urine.

“I had to do what I had to do to survive …. I hallucinated by the third day,” Chong said. “I was completely insane.”
Chong said he lost roughly 15 pounds during the time he was alone. His lawyer confirmed that Chong ingested a powdery substance found inside the cell. Later testing revealed the substance was methamphetamine.
After days of being ignored, Chong said he tried to take his own life by breaking the glass from his spectacles with his teeth and then attempting to carve “Sorry mom,” on his arm. He said nurses also found pieces of glass in his throat, which led him to believe he ingested the pieces purposefully.

Chong said he could hear DEA employees and people in neighboring cells. He screamed to let them know he was there, but no one replied. He kicked the door, but no one came to get him.
By the time DEA officers found Chong in his cell Wednesday morning Chong was completely incoherent, said Iredale.
“I didn’t think I would come out,” Chong said.
He said when employees discovered him in the cell that they looked confused and nervous. A DEA employee rode with him to the hospital, where they paid for Chong’s visit.

He spent three days in the intensive care unit at Sharp Hospital and his kidneys were close to failing.
Chong and his lawyer spoke to the media on Tuesday afternoon to discuss the claim they will file with the federal court system on Wednesday.
“He was at the wrong place at the wrong time,” said his lawyer Gene Iredale, who compared Chong’s experience to the torture suffered by inmates at in the Abu Ghraib prison in Baghdad, Iraq.

The incident also caused Chong to miss his midterms at UCSD. He said he does not know if he will return to school, as his perspective on life has changed since his isolation.
San Diego defense attorney Gretchen Von Helms said the victim could get millions if he files a lawsuit.
"In all my years of practice I've never heard of the DEA or any Federal government employee simply forgetting about someone that they have in their care," she said.
"There has to be repercussions if people do not follow the safety and the care when they have a human being in their custody."

The DEA is an agency which never should have existed and is in desperate need of being shut down.

This is by all accounts an atrocity, and one that the DEA will pay lip service to but has no intention of doing anything to prevent this from happening again.
Sure, he will file suit and get millions of taxpayer dollars but until those responsible are held criminally responsible, there is no incentive for the DEA to prevent such abuses of people.

The DEA people responsible are completely protected from prosecution by various overlapping "shield" laws. If the guy sues (and I hope he does) there will be no criminal penalty against the DEA employees. The absolute worst that can happen to them is that some are fired or reduced in pay grade.

I recall watching a show about D.E.A on spike. These guys are the scum of the earth they lie, entrap and threaten Innocent people to extract information. On one episode they pulled over an innocent man because he came out a store they believed sold weed, again had no real proof. So they pull him over open his bags, searched his food, they found nothing, then the one @!$%# dumped the poor guys lunch in the bag spilling it everywhere. then the he laughed about it. There are plenty of Attorneys in San Diego who specialize in Federal Tort Claims against the Federal Government. These are BIG Cases when they are brought to suit. Notfiveo: You aren't thinking straight: a NURSE is NOT a pathologist. The nurse removed a glass-like substance that had been "glasses." It would be analyzed in pathology. Plastic in glasses is hard plastic, glass-like, and a lot of times is made of poly-carbon.
But what if it isn't his glasses? It was recently in the throat (they can determine that), and then how did it get there? Why would there be glass in the cell? Did they try to drug him and left a glass tube in there? And why was the cell smaller than a regulation jail cell in the first place? Something here doesn't make sense at all, that is all I will agree with.
This kind of horror is the fault of prohibition laws and anyone who supports them. It seems our once free and rich nation has become another worthless police state because of the use of law enforcement power to impose Christian Values upon the populous.

Those posting on this site are all or nothing posters. Life isn't like that. If the DEA for the most part accomplishes what the intention of that department is then it should continue to be funded. If it is failing the criteria on a regular basis then something is very wrong and a review is in order.

Suspecting his involvement in drug dealings, the DEA wanted to torture a confession from Chong. Their offer of driving him home was a ruse to transport him to a torture chamber. Senory deprivation, inducement of claustrophobia, and denial of water are the basic torture tools used by all evil government agents. Apparently, the American government has exposed its halo.

This is demonstrably wrong, according to no less an authority than the United States Supreme Court, which has consistently recognized that the purpose of the Establishment Clause of the First Amendment was to build or erect a wall separating Church and State, according to Thomas Jefferson, whose group crafted the clause:
"[A]t the first session of the first Congress the amendment now under consideration was proposed with others by Mr. Madison. It met the views of the advocates of religious freedom, and was adopted. So what does Paul say about these court decisions: "Through perverse court decisions and years of cultural indoctrination, the elitist, secular Left has managed to convince many in our nation that religion must be driven from public view. The justification is always that someone, somewhere, might possibly be offended or feel uncomfortable living in the midst of a largely Christian society, so all must yield to the fragile sensibilities of the few. The ultimate goal of the anti-religious elites is to transform America into a completely secular nation, a nation that is legally and culturally biased against Christianity." So this arrogant twit, who is not educated in law, purports to be a higher legal authority on what the Founding Fathers intended by the religious clauses in the First Amendment than the Supreme Court, the final authority on what the Constitution means, has consistently ruled since 1878.
To me, Dr. Paul resembles lots of conservatives, who rant about a variety of things being unconstitutional without knowing what part of the Constitution is purportedly being violated or without know much about the Constitution or how it's been interpreted by the Supreme Court. Actually, Paul is worse than most--he makes specious statements about both the intent of the Founding Fathers and about Constitutional provisions, thereby sowing the seeds of ignorance among his naive followers like you, HobokenOP.

Maybe I should have drunk my own urine once when I was stuck in a hospital room and denied food and water for days (not as long as Chong)-except that I was so dehydrated I didn't produce any urine! (I'm not kidding about this.) I also begged and pleaded but no one listened. One difference is that I hadn't been arrested and I was in horrific pain before I was even put into the room. (I also was not completely alone.) It's doubtful I'll ever get any recourse for my suffering because the hospital falsified my records, although you can find inconsistencies in the chart that prove I was given no fluids during the time period in question. The interesting thing is that I believe the reason I was denied food and water is that, sort of like the case with Chong, the hospital staff believed I was a drug addict, which was not at all true. What a horrible thing for Chong to have had to experience! For those who minimize Chong's experience by saying that he didn't die-you don't have a clue! I didn't die either, but I certainly thought about it quite a few times-in my case all it would have taken would have been for me to yank out my useless IV ports that weren't hooked up to fluids! Instead I prayed and sang softly to myself.
I am not for legalizing drugs-sorry all you pot smokers-but I am for common sense and decent treatment. Also, it seems that our country has criminalized pot way too much with the three strikes laws. If someone needs treatment, that's one thing-but it seems to me that there are far too many people in jail. If more people were really able to get decent help for drug addiction, perhaps fewer people would need to be incarcerated. (And don't give me the song and dance about pot being harmless-I've been around too many pot smokers and read too many comments to buy that. Just because some people seem to be unharmed does not mean pot is harmless overall. I've also read some of the studies that supposedly show how harmless pot is supposed to be; and the actual studies I've read were totally invalid based on what I learned about research at one of the top schools in the country.)

I don't plan on being a dealer and if I choose to use it I will in the comfort of my home. The only reason I would prefer it to be legal is so we can utilize the the plant itself.

While I think there may be some merit to the thought of legalizing marijuana, the NRA and gun manufacturers associations are totally against it. The resulting reduction in the need for firearms would cut too deeply into their profits. Also, the profit motive for privately run prisons would be greatly reduced.
The law itself won't be changed because LEO's like to have the threat of a felony drug conviction available to use as a club against anyone who has more than a liquid ounce of pot on them.

On the thought of legalizing and taxing marijuana: you have to wonder how many $billions are spent fighting against this fairly innocuous drug and how much could actually be made by legalizing and taxing it. While there will be people who try to circumvent the law (aren't there moonshine stills around ?) most people would rather buy legal pot than try to skirt the law.
In most jurisdictions, pot in quanitites meant for personal use is treated like a 17 year old with a can of beer. Its a misdemeanor with a minor fine. It is only when you have distributable quanitities that the police even really care.
Like untaxed cigarettes (yes, they do exist) the crime aint worth the time.

One of the biggest and main reasons that most of us are against marijuana being illegal is the fundamental VIOLATION of our constitutional RIGHTS. A vast majority actually virtually ALL of us are waaaay more responsible than boozers, when it comes to getting behind the wheel and toking up around children and other deeds and actions that require resposnsibility. I mean I am a grown adult in the privacy of my own home bothering nobody, minding my own business. There NO victim, the only crime being commited is being commited by the government. Who the hell do they think they are trying to tell me what I can and can't put into MY own body!!! Do they OWN me??? Do they OWN you??? Are we their PROPERTY??? The last I checked WE THE PROPLE abolished SLAVERY!!!!!! He definitely deserves a large settlement, it stinks that it will be at taxpayer expense, but it is deserved. The next step should be a few arrests and legal proceedings. I believe five days in a cell is wrongful imprisonment, assault both mental and physical, and a few other laws that I can't remember. The fact is the DEA agents that left him there broke the law so they need to be arrested, go to trial, and convicted. Bet that would be a wake up call the other agents won't soon forget.

The DEA has outlived its usefulness. Those who want to use street drugs will continue to get it. Local PD's don't actively enforce local ordinances neither does the SD County Sheriff's Office. Sad statement about our Humanity...the Health Department is a few blocks away from where this young man was imprisoned as well as other county offices. 420 does no harm to any community in anyone's private residence. Five days imprisonment without hydration or nutrition proves intent. False imprisonment with intent to do harm...good luck defending this one. Damages should come directly out of the DEA's budget as well as the agents' fat federal pensions. Coast Guard workd harder than the DEA when Maritime drug enforcement applies. Don't you think it would have been a "John Doe" buried or cremated somewhere in a big city pauper's grave with no marker, and the family thinking that some "serial killer" had done him in? The real serial killers are out there to cover up these kinds of crimes that probably occur more often than we know. In my city, a family was looking for their mother for a month, and the local hospital had "forgotten" to look for I.D.; she had collapsed and died on the street one day. It happened that her son-in-law was a lawyer, and knew how to look for her.
And I am also a grandmother who isn't looking for any trouble and doesn't take drugs, in spite of my rheumatoid arthritis and my husband's cancer that would really benefit by at least ingested marijuana. We go nowhere near the illegal drugs, because we must be able to state what we have in our systems because of drug interactions, and we have blood tests monthly or every few months that see everything, in order to help us. While I'm at it; I get really p'd off that the FDA does none of its own research into herbs and medicinal substances, but only accepts patented drugs from Big Pharma. It would be much better to know exactly what would be best for the liver and kidneys over the long-run, or what really controls symptoms, or even some of the better (and much cheaper) cures for cancer, wouldn't it? Put the DEA money into real research, for God's sake.

This incident, more than the secret service debacle, and even more that the GSA spending spree, is disgraceful for the Administration and the country as a whole. The GSA has always been a free spending, misappropriating agency. Having been a Federal employee I have witnessed abuses for twenty five years. I ran my department with a high degree of accountability and quarterly cost accounting for every contract with the GSA. Nothing new. The public is just now being shown the abuses that have been ongoing for a very long time. The Tax Laws need to be rewritten so that everyone is accountable for the condition our Country has deteriorated into. Deregulation has eroded our Goverment into a gross loss of accountability. Government is supposed to do the work of the People when the Private Sector cannot finance, staff train or maintain. It worked before the Neoconservatives became so far off of their philosophy. No taxation is not the answer. Agencies like the DEA need to have a system of accountability in order for them to work effectively and efficiently. Until human beings are made perfect, rules and regulations must be in place in order to hold their public relationships accountable. Look at the Banking/Shadow Banking that was allowed because of the Glass/Steigel elimination. Homeowners had their Mortgages sold to European Banks by the US Banks who wanted to profit from their preditory lending practices. The GSA thing is gutsy beyond all belief - they make a video mocking on their ability to waste money and get away with it and post it on the web !!! Talk about in yo face - come get us if you dare ! And the pussy congress does what ? This kid will sue em and get a bundle - only it'll be just another burden for the taxpayer to pay. Did you watch the Frontline series, "Money, Power & Wall Street" which aired over the last 2 weeks? If you did, you must have been sickened like I was to learn of the greed, lies, lawlessness and deception that has completely polluted every segment of society that is connected with, does business with and profits from Wall Street, Inc.
The banks, investment firms & brokerage houses were (and ARE still) allowed to gamble with our pension funds and investments like it was some giant casino. Then, when the whole ponzi scheme collapsed, the US GOVT handed over 7.77 trillion (taxpayer) bucks to the biggest banks with NO strings attached to bail them out (talk about enabling!). Those CEOs must have laughed like hell...all the way to their own banks.
That series should have been mandatory viewing for every US taxpayer. If it were, national guard troops would have to be deployed throughout D.C. to quell the uprising.

I believe this Horrible incident was caused by employees who work at this facility. Many people just go to work to get the paycheck, they don't care at all, they just want their 8 hours to be over so they can go home!

The Controlled Substances Act wouldn't exist without Joe Biden. Nothing in the article said he was actually smoking weed or doing anything illegal. It just says there was a party on 4/20 which is a day many people reserve for smoking weed. Doesn't mean that was really what his friend's party was and do you have any idea the number of people that would have to be at that party and the amount of pot each one would have to have on his person to warrant a full DEA strike force to raid it?

Stories like this are only going to become more common, there isn't any real oversight over abuses. Governments that don't find any moral problems asscociated with the torture of enemies, and face no public outcry over the practice eventually find their enemies domestically.
As far a suing, any award is going to be taxpayer funded and the budget of the offending agency with be increased to compensate for any loss.

That's an excellent point, Mjolnir-88974, and this war on drugs is just like the war against the Taliban: a bunch of pyrrhic victories that change nothing but leave many casualties in their wake. Nothing has changed since Nixon declared war. (Interestingly, not much has changed since Johnson declared war on poverty, either.) Just as many people, largely poor and black, use drugs... but now they're cycled in and out of prison and the ripple effect ruins the lives of countless family members.
This young man is a perfect example: all he did is smoke a little weed and they would just as soon sentence him to a slow death without even the benefit of a trial. I'll go with AG99 on this one. There was obviously a mistake made at the beginning which nobody caught. I seriously doubt this was done on purpose. And I doubt this is something that will become more and more common, as some suggest. But that only makes this story worse, for it betrays a deep-seated, callous arrogance which is built into the DEA. And I'd suggest it is the same for law enforcement agencies across the board, which are sold to the public as organizations who want to 'protect and serve'.
Why did they ignore his cries for days? There is only one possible answer: for every single person on the staff at the DEA, this guy was no longer a human who may or may not need help; he was an animal in a cage who was trying to make trouble, who simply needed to be 'beaten down'. That's an institutional attitude, and again, I think is not limited to the DEA.
Long gone are the days when enforcement treats people in their custody as fallible human beings. The false bravado and arrogance of power has become the norm. This guy deserves to be compensated, but that will not change anything.

ok, a mistake was made, but where were the procedures for people detained? they need food, water, etc. they have to be checked on constantly and nothing was done. the people who did this need to held responsible and better procedures put in place

Why was there meth in the DEA holding cell??? And how much of this did he ingest? How can you believe what he says happened when he was obviously super high on meth and having hallucinations?
Well we know the day he was arrested and we know the day he was taken to the hospital. If he was in DEA custody inbetween, then there's a paper trail on what his activities are. In the criminal justice system, everything is logged. What time the lights came on, whether the individual ate the meals provided, whether medical care was given. Then even log when the person receives laundry, rec and shower time.
Oh, and if you'd like to state that perhaps he refused food and water, it's usually policy that after the 2nd or 3rd refused meal the person is put on medical watch. Again there would be a log of that action.
He likely ingested the Meth because he was starving. He says that he doesn't exactly remember what happened, and they have pieced bits together based on the medical examinations later (such as ingesting the glass). He said he was hallucinating by the 3rd day (maybe the meth?), so he probably remembers very clearly what happened the first couple days. He would know that he lost 15 pounds because he would have probably known his weight before entering (most people have a general idea of their weight, if not exact), and could easily subtract his weight upon entering the hospital from his earlier weight. He was in intensive care for 3 days and his kidneys were failing. I think most of what he said was a reasonable extrapolation based on the evidence found by doctors and authorities upon his discovery.

I think he deserves something for being left in a cell for five days with no water, even if it was his meth and he had it up his ass when he got arrested. Umm, you guys are all misinformed. The article yesterday stated that the DEA did NOT do a full strip and cavity search. So yes it was possible for him to have brought the Meth in with him.

My God, what are the requirements for becoming employed by the DEA ? This is just terrible, and inexcusable. Seems all of our government top paying jobs are being taken for granted. I suppose once you get the job, it's almost impossible to get rid of you, so they just negligently do whatever they damn please, while on the clock. Either get rid of the DEA, or give those jobs to the younger kids, just out of college, who can't find jobs. Jeez!!! Yes, but more urgently, let's look at accountability. Fear of socialism? Why? Nope, he isn't. They had already decided to release him wthout any charges. No charges = not guilty. Not guilty means not a criminal. And as others have pointed out, even if he was technically guilty of a misdemeanor offense for smoking marijuana, that wouldn't justify this kind of treatment. I hope you get to experience something like this if you're ever mistakenly arrested, because that's what the DEA had already decided happened to him: he was mistakenly pulled in for being in the wrong place.

The actions of the DEA in his inhumane detention are criminal. He will NEVER be convicted for anything resulting from his detention, but he will collect a huge sum of our tax dollars.

If I walk past barriers and get hurt by construction, and I sue, I am abusing the system. If I am held in a cell w/o food & water after being told I am being released, my yells ignored for days, and I sue, I am NOT abusing the system. He may have suffered permanent physical harm. This also points out a flaw in the system that was nearly fatal to someone. Sueing is often the only thing that gets some folks attention.

The DEA busts up a house that gave people access to drugs. It makes me wonder why they would put this kid in a cell that did the same thing. Meth is the worst drug ever and you leave it in a cell with a kid that was supposed to be let go. The DEA needs to be cut from the budget. They cost America millions of dollars and do no good spearheading "the war on drugs". Prohibition makes it easier to access drugs, because the market is so saturated with young smugglers that can make a killing in the US off of whovever. It is plain as day why. The government gets millions in kickbacks from private prisons and big pharma that Prohibition will always be around.

The article didn't say he went to his friend's to smoke. DEA was going to release him - meaning they had nothing on which to charge him. How's that make him a loser, other than weight & health.
He wasn't at the wrong place at the wrong time, he was a pot head going to get high. Chong said he was at a friend’s house in University City celebrating 4/20, a day many marijuana users set aside to smoke, when agents came inside and raided the residence. Chong was then taken to the DEA office in Kearny Mesa.

Even if the guy were smoking pot, the DEA is a waste of taxpayer money and they are enforcing laws that are contrary to the notion of freedom that we Americans love to sing about. If you evaluate drug war funding, what have you gotten for your money? More drugs, more addictive and more dangerous drugs, more drug users, more invasions of privacy, more stupid political posturing, more militarized police forces, fewer property rights, and more cops, federal/state agencies, murders, gangs, violence, etc. Sounds like we are spending money to DESTROY this country, not "protect" people from drugs or get rid of said drugs.
