A knife-wielding man was shot by police officers responding to a domestic dispute on New York City's Upper East Side Monday, law enforcement sources told NBCNewYork.com. The suspect's mother was also struck by the gunfire.
It happened at about 2:14 p.m. ET at 408 E. 65th Street. Police said a woman called 911 to say her 22-year-old brother was holding their mother at knifepoint.
"The police trucks started coming in, and sirens were going all over, cops were running," Amy Emery, who was in the area attending a job interview, said. "People were running around, they were actually screaming and running away from that area."
Responding officers arrived to find Edgar Soto and his mother in the sixth-floor hallway outside their apartment, authorities said. The officers called for back-up, and a sergeant arrived with a stun gun and deployed it on Soto, to no effect.
That's when Soto turned to approach the police officers with the knife, police said. Two officers fired a total of five shots, and Soto was shot in the abdomen, side and groin.
His mother, identified as 49-year-old Flora Soto, was hit in the buttocks, police said.
Both were taken to New York Presbyterian Hospital with non-life threatening injuries.
It's not clear what sparked the dispute.
Longtime friends of Edgar Soto said there was no warning for what happened.
"It's shocking," neighbor Steve Letavish said. "I knew the kid for awhile. I give him a high-five when I see him. You don't believe it until you hear it for yourself, and you can't go home because of it."
Another neighbor, Daniel Brown, said, "My heart hurts for the father. I've known him for a long time."
Edgar Soto's father is said to be a longtime city sanitation supervisor. He could not be located Monday.

Can't explain how or why? I say 9 times out of 10, it's because of drugs and/or alcohol. VERY, very rarely does someone go off the deep end who has been sober for a prolonged period of time.

I thought cops were trained not to shoot if innocent bystanders were behind the perp. Surely the cops could have positioned themselves so that at least one was able to shoot with no one behind if the guy charged with the knife.

Hard to say yet, but it is possible that the mother got hit because once her son turned towards the cops she may have gone after him to save him, stop him. Granted, she wasn't safe with her son whatsoever but a mother's instincts may have still kicked in.
No one knows the family dynamics, but it's hard to believe that if this wasn't drug induced he hadn't been in some way abusive before. We may not get all the details, because stories like these don't always warrant following up as so much more, and worse, happen daily....

@oilman - As to the shooting quality: Look at the distance (point blank in the hallway) and shot placement (1 miss, 1 hits the hostage in the buttocks, 3 hits on the perp: groin, side, buttocks) - yes, it is piss poor shooting IMO. At quarters like that, a lack of single chest hit from trained police officers is a disgrace. I will not call you names, but you know very little about proper firearms use by trained personnel.
Oilman: I think Max's reference was to the number of shots fired, and the fact that no one had life-threatening injuries. Just an example of how the police can't win when they draw their weapons. If they shoot to kill, they're trigger happy. If they shoot to disable, they're poor shots.
It's all in the objective they're trying to accomplish....

@Had Enough - there are rather clear procedures for the police in hostage situations once it has been determined that firearm use is justified - it is shoot to totally disable the assailant (translation: shoot to kill). There is no doubt that the officers TRIED to do just that, but their shooting skills were rather lacking.

The article did not say he charged the police when they shot. It stated that he turned to face them. So, why is it necessary to start shooting (and hit the hostage)? Was he going to discharge the knife and the police would be shot with it? The fault lies with the perp of course, but police need to use good judgement instead of always itching to shoot someone. I don't want to hear about how tough they have it. If you can't do a job properly, then do something else. That's what happens to the rest of us

@HE - If you do not have a clear shot, you do not shoot, period. But they managed to hit the perp 3 out of 5 times, which makes me believe that he was quite open. Low hits at such a close range usually means that the shots were fired almost unaimed, and that is why the hostage was hit as well. Since the guy did not have a gun, the officers had a clear advantage and should have aimed a lot better. I really doubt they were aiming at this guys crotch and buttocks - these are not disabling shots.
1. Look at his age, 22. Very possibly a young man entering the throes of schizophrenia, which tends to first manifest itself in the teens.
2. Knives are considered to be as dangerous or more so than a than a handgun. There is a very disturbing but informative film from Caliber containing interviews of law enforcement personnel attacked with an edge weapon. The police had no real choice but to shoot. It is possible that the mother ran into the path of gunfire when she heard the shots.
3. In a gunfight from a distance of 20 feet, most shots will miss, according to statistics from the FBI.
You sure are happy to jump on the Cops, for doing their jobs. They tired a stun gun on him first. and it did nothing, Sounds to me like he was on drugs or something, usually a stun gun knocks you on your rear. No one was there so they don't know how close he was to the police, how wide the hall was, there are so many what ifs. If you do something stupid like hold a knife to your mother, and the police are called something is so going happen depending on what the persons reaction is. Poor conduction? Low batteries? Could be any number of reasons. Pepper spray is so much more reliable.
If a person is on PCP, that sometimes happens. I'm sure there are quite a few reasons though.

Both prongs need to stick to create a circuit, if one of the prongs gets stuck in clothing or misses.. it won't work.
Bad aim...perhaps drugs, its easy for someone high on certain things to not feel the pain its even easy to train yourself on being shot with a stun gun...If you are a criminal, this is a good practice.

Cops need more effective non-lethal weapons. If the suspect didn't have a gun on him, there is no reason to shoot him. Bear spray would've worked perfectly fine. These cops are no less maniacs.

@AB-1981: you may want to do some research before flapping at the gums. A knife is a deadly weapon and a person (one who is not on drugs) could cross the span of 21 feet under 1.5 seconds. With a knife, that is a deadly weapon. That is why the "Tuellers Drill/Law" exists. This is the 21 foot rule: (for Law enforcement) if someone has a knife out, and is within 21 feet the gun MUST be drawn out of the holster and at the ready otherwise that person with the knife could cross that distance and stab the officer.
Not sure if I spelled it correctly but I have done the tests and the average was 21 feet and the time about under 2 seconds. How long does it take you to process an event? You may want to try it and see because your brain must first process the information being witnessed before the brain can come up with a defense and if there is not a trained defense then ...... you become the victim.
I teach these classes all of the time, have the experience and have done the needed research. Dont be so quick to bash law enforcement (which I am not, never have been) because in some cases they may be the only ones you have left the help you.

As disabled vet said above, a person with a knife can cross the distance and put that knife in your throat before you even get your gun up and to the ready. It's basic protocol to treat a knife as a deadly weapon, because they HAVE proven to be deadly vs a gun. Even if shot, at close range a person weilding a knife can still do some major damage or kill another before collapsing. An individual with a knife within 20ft is very serious.

What all of you experts fail to take into account is the 10 second law. A person shot, even with a fatal wound, can still attack and kill for up to 10 seconds. That is why the military and mafia use the two shot rule. In close fighting, one in the chest, one in the head.
1. in a hallway with a hostage, I would bet the police already had their guns out.
2. At 35 feet, even the worst cop can hit the triangle.
3. I believe they were aiming low to stop him, not kill him. 9mm's at close range will break arms and legs.
R. Scalzo, civilians have access to spray containing 17% capsaicin. Cops can get an even stronger version. You pulled the 2% figure out of your butt. Bear spray is better in this situation because it can be used from 20 feet or more, is immediately and potently effective, and is completely non-lethal. Moreover, as Mark Stephens-4334123 said, even after taking a bullet shot, the person technically still has time to use the knife. I appreciate the info provided by Disabled_Vet-2153438, however.
Amazing... shot 3 times and considered non-life threatening. I guess the cops could be considered to be really good shots (not killing him) or really bad shots (not killing him and hitting the victim as well).

Unfortunately, some of the LEO's do not train or practice enough with high stress practices with their firearm. Many locations only allow the officer to go shoot ONLY if there is another LEO instructor present. This means that they are limited in practice time. Some locations will allow the officers to practice on their own but just because they wear a badge does not mean they know courses of fire that will increase their speed and stress reactions.

I was wondering the same thing. You get shot in ANY area that that the story describes (abdomen, groin) you'd better get medical help and quick. Sounds like the writer got a little lazy proof reading.
Many officers to not get enough practice even in the range. I have multiple family members who are LEOs and I get to the range and fire my carry weapon more in a quarter than they do in a full year.
Also, stress does some horrendous things to your aim. I know a guy who teaches cops to shoot under stress and almost all of them come in scoring <20% accuracy when you have them shoot under stress. And that is a situation where they know their life is not in danger. So put a cop in a real world situation (or anyone for that matter) where their life is in danger and they have seconds to react and take down a threat, and you are going to see a drastic reduction in accuracy is most cases. Only in the movies do the cops hit dead center each and every time.

Don't know, of course, I wasn't there, but it seems that in the US cops now do not have the patience for long term psychological negotiation.
Wouldn't it be better to have trained shrinks and negotiators deal with people who are having psychological problems like this rather than go in with sirens and stunguns (which would most likely heighten the stress and tension of the whacked-out person)? It would be better in a case like this to have the situation dragged out and end up with less injury (and possible death).

This definitely does not sound like the kind of hostage situation where they had time to wait for a negotiation team.
If an armed person is getting ready to use lethal force NOW, the cops have to act NOW.
I would have to say they are bad shots, as the idea is you shoot to kill as a wounded suspect can and sometimes does shoot or harm the officer(s).
I am tired of these people thinking that the police need to find less lethal methods. It doesn't work. Because of "these people" we have officers endangering themselves and the public with these stun guns that may or may not work. A Glock works well.

Warning shots went away because the bullets fired "in the air" to warn others to stop or listen or conform...have to come down somewhere. This becomes a liability issue. Also, any shots fired requires a report and bullet count. Do you know of any LEO's that like paperwork? I dont.
Im no expert but you cant just shoot warning shots whereever you happen to find yourself. Everyone of those rounds have to accounted for and what if one of those warning shots came down and hit someone or bounced of a wall and killed a innocent child? This is just what i think when i think about the situation, these situations (take if from a Vet) is never as simple as civilians think.

Many of you all, make me sick. Granted, there are times when the police have been known to use excessive force, but it sounds like to me, in this article, that they did there job effectively. So, the mother was hit in the buttocks by a stray bullet, but she is alive and by God, she had best be thankful for the efforts of the law enforcement. Do any of you, at all, reallize that perhaps the reason the police become so disgruntled with civilians, is because THEY ARE under appreciated, and blame for the smallest things that go wrong when it comes to dangerous situations. These men and women, just like our armed forces, put there own lives on the line to protect you and I, and all we do is complain about their actions that they are FORCED to take in order to protect the public. You all who are complaining should be ashamed. This guy was probably doped up on some sort of drug, hence why the stun gun did not work, and I have heard of many occassions where peper spray just would not work on a combative suspect. If, as one individual had in this vine is correct, and that assailant had been able to cross 21 feet in 1.5 seconds, just what were the police to do, plead with him to stop, were they suppose to take a knifing and NOT go home to their families. Hey suspect is alive, the mother is safe, the the suspect WILL see his day in court. But ALL YOU PUNK A S S individuals who complain about their actions, go out there on the streets, pick up a badge and a gun and stand in the shoes of an officer, for a day or week, see how you will have to deal with the negativity of the public, the constant dangers they are faced with, the pressures of their job. I'll freely appologize for the use of my language, but I get sick of those individuals who complain about the police, and then THEY will be the very first ones to call 911 and want the police when there is an issue or problem. It's frustrating to see them complain and just makes me angry.

I think the police did an excellent job, and it is obvious to me that they did not shoot to kill. If three bullets hit this young man in his lower extremities then it is obvious that the police were aiming at his lower extremities in an effort to protect the mother who was probably being held hostage by the son. Had they aimed higher there was a chance that the mother would be hit by a life-threatening shot. I agree with GregJ, people are always bashing officers until they need them. These officers, in my opinion did an excellent job.
Calm down, they're only human beings. I'm sure they make mistakes just like everyone else. They are not perfect.
Greg and Disabled must be one and the same. Regardless of a drug crazed person's ability to to sprint a relatively short distance quickly, these police were firing wildly at him. That is why they hit both him and the mother. They need training. They also need to do a better job of checking out/maintaining their equipment. The taser likely was ineffective due to weak batteries. They are supposed to be professionals. My privates were more professional than these clowns and could have dropped him without hitting the bystander.

Olde Sarge: If all parties involved were standing still, and there were no stress involved, I'd agree that the only injury should have been to the suspect. But, I'm willing to bet that the scene was more than just a little chaotic, with lots of confusion to be sorted out... screaming family members (including the one who ended up shot), probably a struggle, maybe even the Mom was trying to protect her son...
But I must say that I'm not sure how my privates would have reacted...

While the officers were definitely justified in shooting, one of them needs to spend more time at the firing range. Maybe a lot more.
Have you every shot anyone during a adrenalin filled event? In this event, people were yelling, moving, harassing, everything but standing still. My guess is you would have missed completely or possibly shot the woman in the head and then try to explain that later. NO ONE WAS KILLED AND THEY GOT HER AWAY FROM A SERIOUSLY DRUGGED NUT CASE! I appreciate the work that police do for us every day. They respond to events most of us would run from; they run into those situations! If I need help, they show up! They take crap from horrendous people every day in and day out, yet they still get up every day to do their job. Most people would never consider the job and I surmise most people complaing here could never do a police officers job even in the best of worlds. You cannot judge the majority of police officers as worthless based on the actions of a very few.

Most cops pray they never have to fire a shot anywhere other than at the range. Turn off the TV and go out and meet some real cops. You might just find that they are mostly great people who are highly trained and very professional. I'm not going to say there aren't any bad apples, but name any profession where there aren't a few.
Most cops really care about their communities and will go above and beyond to do the best possible job.
