On the one hand, it was a mindless prank, almost to be expected from teenagers. On the other, it was a clear sex offense, for which they should be punished. They will likely be classified as sex offenders and have to register for the rest of their lives. I think that a bit extreme for this kind of offense. Either there should be two classes of sex offenders or this type should not require lifelong registration. Those who exploit children or actually make physical contact ought to have "Sex Offender" tattooed on their foreheads in large print. A picture is not likely to do the same harm but these kids should have known better. Can't say I feel sorry for them. A week in solitary and a food bit of community service, followed by another week in solitary ought to be enough to keep them out of trouble. If they do it again, give them the max prison time.

Times have really changed and I'm not talking about the technology............I'm talking about the teachers. When I was in school those guys wouldn't want to do what they did as all the teachers were like 80 years old. My youngest daughter actually had a Dallas Cowboy Cheerleader as a teacher in elementary school........I volunteered for those teacher conference sessions.

Unfortunately today many parents will not hold their children accountable and if these kids are truly 18 then they are legally responsible. So just working it out with the principle and parents is typically not an option.

Should they be jailed for years? No. But this teacher's upskirt video will be out on the internet forever and probably attached with her face and name. Their punishment should be fitting, perhaps a year of working every weekend cleaning up behind cows at a dairy or the local trash dump. The punishment should include teaching these kids values and not just going to jail to learn how to live on the tax payers dime. Maybe even film them working and put it youtube.

If this was simply a violation of the schools code of conduct then yes. However, they posted it on YouTube making it available to any viewer. They should actually be very grateful that they were not arrested by the FBI and brought up on federal privacy rights violations. Actually, they can still be charged with violating civil rights (right to personal privacy).

Because these boys posted it in the internet it goes beyond the school and parents control system. I wonder how many of the girls in the school they may have done this to or other women. These two young men(?) have just showed what they are, shuck and jive, and that's all they will ever be their whole lives. BUT for the like of it I cannot see why people feel, that have no connection to these kids, that they have to appoligize for them. The appolige for them is step 1, the punishiment should make the teacher feel vindicated. In fact allow her to suggest the punishment and if seams like it fits, impliment it. Personally, I think the school district and all others in the state should refuse to allow this pair to graduate until they can pass a general civics class exam on individual rights in America.

If they are found guilty....I hope the teacher involved can get a civil judgement for $500,000 levied against each of them....they will spend the better part of their lives paying her back for their stupidity. The problem is my friend that these types of things lead up to larger things in the future. These guys are 18, which means they have grown accustomed to this type of behavior and show little respect for women in doing so. Without getting into a big lecture about it, these two have probably been involved in this type of behavior for a while which has more than likely gone unchecked for one reason or another. To sit these two down in front of a principal with their families would have no effect. They would say 'I'm sorry', maybe get a suspension, but ultimately wouldn't care.

It is akin to assault in a basic form in that this teacher has been violated, and that's something that cannot be given back. For these guys to do this and then post it does place their actions as criminal and sexually exploitive. The only thing to do would be to give them jail time. For how long, I don't know, I'm not a judge, but long enough for them to understand that their actions cannot be tolerated.

Putting them on a sexual predator's list is absolutely appropriate. It will protect the people in the communities where these two live while also serving as a daily reminder of their actions. It may seem harsh, but sexual crimes, unlike most other, intensify with time starting slow and working their way up. Not trying to be rude just ask any criminal psychologist.

I do not know who this Powell woman is or why her opinion means anything. Was MSNBC so desperate for a comment to include in their story that they grabbed the first person they could find with any connection to the school. In any case, she is an idiot for thinking that this should have been handled privately by the school. Once these two adults (yes they are 18 so they are adults not kids) posted the video on-line this went well beyond the school. A case could be made with charging these two with illegally making and distributing pornographic material. The fact that they posted this on-line could have resulted in them being charged with federal crimes, and this may yet happen. These two definitely need to do some prison time for this and should be placed on the sex offender registry. To treat this like a kids prank as some have suggested and let these to off with a slap on the wrist and some community service would not get the point across as to how serious an offense something like this is. Being 18 does not make you an adult. Human minds do not fully mature until the early to mid 20's. The law uses 18 as an adult now, but it used to be 21 and probably still should be. Mr. Skaggs, the fact a person is sent to war does make them an adult. Children much younger than that are sent to war all the time, and historically it was not unusual for children as young as 12 or 13 to serve as drummers, powder monkey, or infantry. I am a vet, who joined the airborne at 18 and I can tell you that neither myself or the guys I served with were truly adults. Military service, and war in particular, is tough and requires the energy and the childish belief in your own immortality that only the young have. As they say "Old men start wars, young men finish them, and the next generation pays for them".

As long as dresses are worn, most men will look up a dress when given the opportunity. We called them "squirrel shots" in high school many years ago. I also don't think these two are 'sexual predators.' They obviously have no respect for women and exercised poor judgment. The Ky. law also includes videotaping nipples. By your interpretation is it video voyeurism if a woman with a sheer top or tee shirt and no brassiere is videotaped? What if she had a pair of shorts on or swimming trunks. When does it become genitals? What if someone videotapes the genital area while she is wearing pants. If there is a camel toe would that make it count in your mind?

The plain statement in the law says genitals, not genitals covered with some particular thickness or type of clothing.

If I'm on a jury, they are definitely not guilty of recording a video of genitals.

Not sure what country you live in, but sexual harassment gets you fired from your job, not put in prison or stuck on a registry. They did not commit a sexual crime, and there was no nudity at all in the video they took. The crime the police are attempting to charge doesn't hold water and they will most likely end up with community service, unless they plead guilty, and no lawyer in his right mind would let them do that. These so-called 'lily-livered school administrators' have had their hands tied by the liberal public. Their options are limited to items of discipline that would have no effect on these two knuckle-heads. And why just have a turned-off policy for cell phones? I don't think they should be allowed on campus, period. In my time, if you had something that was prohibited or did something inappropriate with something that was allowed, it was confiscated, often for the balance of the school year. School officials are not allowed to do that anymore, appparently. Of course there is a big difference in parents, too. The parents no longer support the teacher in teaching respect. They undermine the teachers by making a big stink every time the children are disciplined, instead of telling the child "you knew what would happen, don't do it again."

There is no presumption of privacy, however video voyeurism (ie secretly filming up someones clothes and then posting it) is a crime in many jurisdictions.

Of course we're all so comfortable saying to lock them up, but we fail to realize that out prisons are overcrowded for a reason... prison doesn't work. You send people to jail as dumb kids and they come out as criminals. Same reason you get sick when you go into a hospital full of sick people. These kids need fathers, not prison sentences. (and before you post about who their fathers are, I mean visible fathers, not emotionally absent fathers) Personally I think parents should be tried for their childrens' crimes, because babies learn from mommy and daddy. I would assume that dad treats mom like crap, and the boys learned that its okay to completely ignore the feelings of women. But that's just me making assumptions like the rest of us.

Theres white people on welfare too, as well as people of other races. Theres men of all races that have trouble "keeping it in their pants" & "have tons of kids running around from diff. women", "not working driving fancy cars, not working getting free housing." Plenty of men of all races who dont want to work & want things handed to them freely. Only an ignorant person would think it was just one race who do such things. Why people chose to try to throw statistics in each other's face to prove what race is worse, is beyond me & in my opinion pointless. Not one race is better then the other, every race has its fair share of good people & bad people. The only way a race would have "right to brag" & say they "are better then the rest" is, in my opinion, if noone of that race ever committed a crime(caught or not.) But since that will never happen & humans of EVERY race will continue to committ crimes, no race is better then the rest. Sadly, that is why racism will continue to live in our country & will more then likely never die, because there will always be the ignorant ones out there who will judge a person soley on the color of their skin, & they will continue to pass that hate & judgement down to their children & so on & so forth.
