Prosecutors in New Jersey plan to appeal the 30-day jail sentence given to a former Rutgers University student who used a webcam to spy on his gay roommate, Tyler Clementi. NBC's Mara Schiavocampo reports.
Updated 6:12 p.m. ET: A New Jersey judge on Monday sentenced a former Rutgers University student accused of using a webcam to spy on his gay roommate's love life to a 30-day probationary jail term.
Indian-born Dharun Ravi, 20, was facing up to 10 years in prison after being found guilty of bias intimidation and invasion of privacy in a case that exploded into the headlines when Ravi's roommate committed suicide. Ravi also was facing the possibility of deportation, but the judge recommended Monday that he be allowed to stay in the country.
Tyler Clementi, 18, jumped off the George Washington Bridge on Sept. 22, 2010, after finding out that Ravi saw him kissing another man and appeared to encourage others to watch his romantic encounters through a camera on his computer.

"This individual was not convicted of a hate crime, he was convicted of a bias crime, and there's a difference," Superior Court Judge Glenn Berman said.
"I say that because I do not believe he hated Tyler Clementi. He had no reason to," Berman said, adding that Ravi's crimes were committed out of "colossal insensitivity.”
"I heard this jury say, 'guilty' 288 times -- 24 questions, 12 jurors. That's the multiplication," Berman said. "I haven’t heard you apologize once."
Ravi's sentence also includes three years of probation, 300 hours of community service and a $10,000 fine.
Prosecutors said they plan to appeal the sentence.
A New Jersey judge sentenced ex-Rutgers University student Dharun Ravi to a 30-day jail term and recommended he not get deported back to his native India. Ravi was found guilty in March of bias intimidation, invasion of privacy and other charges after using a webcam to spy on his roommate's intimate encounter with another man.
"While the Middlesex County Prosecutor's Office did not request the maximum period of incarceration for Dharun Ravi, it was expected that his conviction on multiple offenses of invading the privacy of two victims on two separate occasions, four counts of bias intimidation against Tyler Clementi, and the coverup of those crimes, would warrant more than a 30-day jail term," Prosecutor Bruce J. Kaplan said in a statement.
As Clementi's father, brother, and mother addressed the court, holding back tears at times, the image that emerged was of a "vulnerable" Tyler "shaken by the cold, criminal actions of his roommate.”
"Nobody other than Tyler understood how vulnerable he was," Tyler's father Joseph Clementi said. "We are seeking justice and accountability, not revenge."
A judge sentenced the former Rutgers University student to 30 days in jail and three years of probation for spying on his gay roommate with a webcam. NBC's Mara Schiavocampo reports.
The family spoke about their long-running ordeal as the media and several court hearings picked apart every detail of Tyler's last days.
"My world came crumbling apart in September 2010,” Tyler's mother Jane Clementi said, adding that Ravi had come to Rutgers with preconceived notions about her son.
"He never really knew Tyler," she said, describing the day she helped her son move into his new room at Rutgers, when Ravi ignored Tyler.
"He could never have known the viper’s nest he was walking into,” Tyler's brother James Clementi told the court, adding that an apology from Ravi would now be empty and spoken without empathy.
"I love my brother and I will mourn for him every day for the rest of my life,” he said.
The court also heard a statement from "MB," the man who was watched via webcam as he kissed Clementi. MB described his emotional pain and a combination of embarrassment, emptiness and fear in the wake of Clementi's death and subsequent court proceedings.
"I do wonder if it has ever entered [Ravi's] mind that he has caused me a great deal of pain, and yet he knows nothing about me," MB's statement read.
Ravi did not wish to address the court, but both of his parents spoke, expressing their belief in the American justice system.
In her grief-stricken statement, which was often interrupted by tears and sobs, Dharun's mother Sabitha Ravi told the court his son's life and health have been devastated by the events that occurred over the past 20 months.
She said her son now only eats one meal a day, and has lost more than 25 pounds.
"He was absolutely devastated and broken into pieces,” Sabitha Ravi told the court, as she wiped away tears.
"Dharun’s dreams are shattered and he has been living in hell for the past 20 months," she added, hugging her son after finishing her statement.
Dharun Ravi also cried.
"Contrary to the false propaganda, we are not a homophobic family," Dharun's father Ravi Pazhani told the court. "Dharun was not raised to hate gays."
As the hearing began, the judge noted the court had received letters and petitions asking that Ravi be pardoned. Gay activists also made public pleas for leniency in recent days.
Ravi must report to Middlesex Adult Correctional Center on May 31.

It was as if he felt there was no way he could be convicted, so he would just smirk for the cameras. He could at least show respect and sympathy for the family. I dont know about life in prison that is a bit harsh, but this guy should be made an example of so others will think twice before invading someones privacy, This (privacy) is a precious commoditty, and when broken with such flagrant disregard as this guy has done should be punished acccordingly. He can be blamed for the suicide, but then ask yourself, can you sentence someone who is cheating on their spouse for the others suicide, over their actions, blame yes . sentence, well thats a tough one?
Its a case of bullying, and he deserves some punishment. I'm torn on whether he should have a criminal record over it. Either way, I doubt he will serve much time. Having this crime on his record will hurt him the most. I don't know, or remember, what he was studying for, but he may be forced to leave the US to pass a back ground check for his career.

It really doesn't matter how angry you are, or how much I dislike him personally. His punishement needs to fit the crime. He is a total a-hole, but didn't intend for this to end in suicide. He won't get anywhere near 10 years.

I'm torn here. On the one hand, we have a young man who tragically cut his own life short over this guy's actions. However, on the other hand, I could see how the other young man might not have understood what he was doing to his roommate. He thought it was funny. Was it malicious or just a prank? Only the perpetrator knows for sure. As for his demeanor, you have to remember that he is from a different culture. There may be subtle signals that we do not recognize. I remember meeting several people from India while in college. They often seemed arrogant to me when I first met them. But after getting to know them, they weren't really at all. It was the mask they were taught to wear for the world by their society. Seems in some parts of the world showing emotion is seen as a weakness and is frowned upon.

He is guilty of violating his room mates right to privacy, he deserves some punishment.

Tyler's suicide was a combination of other issues, his suicide was not solely a result of being filmed.

No case here. It's sad that this kid decided to jump off a bridge, no doubt about that. Can't prosicute someone for anothers suicide. That falls under thought crimes which is very dangerous ground. Is he a major tool and a pig, yes. Unfortunately that's all there is to it.

First of all hello. Here in NJ there are HUGE Indian communities. Did I mention HUGE? lol. I have worked with many people of Indian descent, whether Americanised or fresh off the plane. I've never seen a smirk put on during any pressure or stressful moments. There were no reactions or customs that wouldn't be considered normal in American societies. This guy simply wanted to show that he did nothing wrong and felt there was no way he would be convicted. The smirk melted away the moment he was found guilty. He is a smuf a-hole. But, like I said my thoughts of him have nothing to do with his guilt. I don't think he deserves to spend years in prison. A deportation would be a worse punishment.
I don't think US tax payers should have to work for his upkeep while he is in prison. Just deport him. He is a morally bankrupt person and we really don't need any more of them in this country.

Ravi was convicted based on something he was not even charged in, Clementi's suicide. The jury and everyone else wanted someone to pay for Clementi killing himself so they convicted Ravi. This is completely wrong. The verdict was based largely on emotion rather than law. There was evidence that Clementi and his partner even knew that the web cam was on the second time and said nothing. This was a childish prank that got out of hand, it was not done with the intent of driving someone to suicide. The jury had to show how enlightened they were and convict Ravi instead of seeing this for what it was. The charges and the verdict were politically motivated from the start. Give Ravi probation and community service working for a support organization for gays and leave it at that.
You do have an expectation of privacy in a shared dorm room!!!! Just not from your roommate... He put the video for others to watch.... You shouldn't and don't expect to have your privacy violated in such an obscene way....
Clem killed himself, I have no sympathy for anyone that takes their own life and sure as hell don't think sending someone to prison for another persons decision/action is justified. invasion is the only crime I can see, you people need to grow up and get off of your pity pots. if it was the other way around this would not be a case.
Clem was a weakling and chose to depart, sending someone to prison wont fix that. the kid didn't even have the decency to leave a note saying why he killed himself. it could have been a multitude of things, get the Nazi attitude out of our courts, enough with the finger pointing.

Believe me I am shocked at how many personal attacks occur here just because people don't agree with a point of view. It's needless, and I don't expect that everyone agree with everything I say just to get along with them. While you saw me pushing buttons in another article, I typically avoid arguments.

This guy deserves whatever punishment he gets. His actions were malicious and vicious, without any regard to the consquences to the victim. He didn't do it once, but several times. As the D.A. said, this case will act as a deterant to other meatheads who think about pulling a stunt like this. Law enforcement needs to take a hardline in cases like this, because it is happening more and more with devasting consequences to the victim. Even if the victim hadn't killed himself, the video was still out there to haunt him for the rest of his life. Ravi needs to pay for that.
I have to agree with TFNJ on one point. I watched the trial and am now watching the sentencing. He has never while I've been watching shown anything that looks like remorse. He's has continually had a"yeah whatever" look. I don't believe he thinks he didn't anything wrong and still doesn't.
And the only other thing I'll say is that by the responses it's pretty easy to tell who were the bullies in their schools.
Regardless if he recorded a gay couple or straight couple, it is illegal to tape others without their knowledge and consent. Thus, Mr. Ravi needs to be held accountable.
Further, perhaps if he had shown just the slightest in terms of remorse, his outcome might have been a little different however, he showed the court and the jury, on a daily basis, nothing but arrogance, smugness and the inability to accept his personal responsibility. Thus, he needs to be held accountable.
While his actions were indirectly responsible for Mr. Tyler's suicide, he is still responsible for the events leading up to Mr. Tylers suicide. Perhaps a nice jail sentence will give him time to reflect on what he personally has done and will learn to finally take responsibility for his actions.
There are others here who feel that he shouldn't be sent to jail - why not? What he did was illegal and his appearance of indifference shows he clearly does not feel he should suffer the ramifications of his actions. For every cause there is an effect ... Jail and deportation for Mr. Ravi. Plain and simple.
There is a case here. He violated another person's privacy and, if he did it because Clementi was gay, it was a hate crime. However, you are right that he shouldn't be prosecuted for Clementi's suicide. His suicide, especially in a state that, except for the anti-gay governor, is friendly to gays was not reasonably foreseeable.

Look how many sex tapes have launched some 'celebrities' careers after someone posted it on line without the person's permission. I do not recall the poster getting jail time either.
Why make an example of this particular guy for supposedly invasion of privacy? What about those ctv cameras and the various cameras people have set up in their home so the police and others including family/parents etc can watch the public for criminal acts, watch their house hold staff or their teenager etc. What about touchy feely and peeky TSA and the various other places one does not have any expectation of privacy any more including in one's home, car, or telephone conversation or even on the internet etc?
If the guy was sharing a dorm room how much expectation of privacy did he think he had? Since he was sharing the room he had no expectation of privacy imo. Why would anyone engage in any intimacy or sexual intimacy in a shared dorm room unless one does not care if one's activity is observed or not?
If the room mate had not committed suicide would there have been a case at all? The other room mate's behaviour may have been crass but he did not kill his room mate immaterial of how arrogant, insensitive, idiotic or stupid his behaviour may be or look in court.
If the other student wanted to be intimate -sexually or otherwise- and wanted to make sure that there was no possibility of his activity being observed then he should have gone elsewhere or not been intimate. He was at university after all, where young folks still act and do stupid stuff no matter how bright or smart they are supposed to be.
With all that is shown in the movies, on reality tv, sexting etc, also that most computers come with a camera so one can telecommunicate with others, and everything one does, immaterial how inconsequential, stupid or even assinine, is posted on Youtube or FaceBook and elsewhere, where does on draw the line if all these activities are supposed to be normal or no biggie?

I feel the case's dominant issue is not a harmless prank gone awry, but a malicious intent to humiliate Tyler. Maybe a lack of maturity played a role, certainly Ravi never expected the outcome to result in suicide, but even with the shortsightedness of youth, Ravi had to realise his actions would be horribly damaging to Tyler. An 18 year old college student should have a grasp of reasoning.
Lock him up, deport him, set an example. We shouldn't fear the privacy of our sexual encounters to be publicly displayed, to be victimized for humiliation purposes. I have a keen interest in this crime, for I am Rutgers Alum who also happens to be a gay man, this story is one I take personally.

JH - I understand your frustration. It seems like any crime is a hate crime because you certainly don't commit one against someone out of love. However, the reasoning is that some people think they are justified in injuring or even killing someone of a different race or sexual orientation, and the law either doesn't apply to them or they'll get away with a slap on the wrist. This is meant to drive it home that whether or not YOU think it is right, it is still against the law. You would think such Captain Obvious measures wouldn't be necessary, but, unfortuantely, it is.
I hope they make a real good example of him. My last college roommate was clearly some creature from hell who I found out was stealing jewelry and prescription medications out of my room to support a drug habit. Then when I confronted her she said that, as insurance to keep me quiet, she had planted cocaine in my room and if I didn't cooperate I was a phone call away from getting busted. Fortunately my cousin owned a retired DEA dog, he brought him over and Brutus didn't find anything, so obviously she was bluffing, and I moved out. I didn't have a legal leg to stand on because I had no proof other than her confession which I didn't record. Twenty years later I still have nightmares about it, and I haven't had a roommate that wasn't related to me since.

He does have the right to be gay, privately or publicly .However, he does not have the right to knowingly violate someone else's privacy. I feel really bad for all parties involved. If they send him back to India, they hate gays there, that might be a hell worse than jail. Community service, he has no remorse that would not work, I don't believe it would work, send him to school on top of that,I don't think so. Do 6 years and then put him , ban him from skype,web cam in the future so he can't do it again. Well, I just finished listening to the Ravi's father make his statement to the court and now I know where Ravi got his attitude. Instead of personalizing his son and making him more sympathetic, the father spent his time lecturing the court and blaming the media. What the heck. I feel bad for Ravi. Didn't his lawyer tell the family this is NOT the time to argue his son's innocence. He was found guilty. This is when you talk about what a good kid you brought up. I don't hear anything about charitable works or kind acts. I'm listening to his mom and she's not doing the kid much good either. It's all about how this is hard on their family and kid. When Ravi graduated HS and decided to attend college, he gave the impression that he was a mature adult - meaning this wasn't high school, this was a University - he should be mature enough to know that Pranks end during high school and people can get hurt... emotionally and physically. He didn't realize that if it were someone recording him and his partner (female or male) and showed it around campus - he would have been very quick to file Invasion of Privacy and claim it as being racist towards him being Indian. He needs to be sentenced to time in prison so he can FEEL what its like to be stripped of all your privacy and then deported to India - and make sure that Department of Homeland Security has strict guidelines on that. NJ 2C:14-9. Invasion of privacy, degree of crime; defenses, privileges
a. An actor commits a crime of the fourth degree if, knowing that he is not licensed or privileged to do so, and under circumstances in which a reasonable person would know that another may expose intimate parts or may engage in sexual penetration or sexual contact, he observes another person without that person's consent and under circumstances in which a reasonable person would not expect to be observed.
b. An actor commits a crime of the third degree if, knowing that he is not licensed or privileged to do so, he photographs, films, videotapes, records, or otherwise reproduces in any manner, the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, without that person's consent and under circumstances in which a reasonable person would not expect to be observed.
c. An actor commits a crime of the third degree if, knowing that he is not licensed or privileged to do so, he discloses any photograph, film, videotape, recording or any other reproduction of the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, unless that person has consented to such disclosure. For purposes of this subsection, "disclose" means sell, manufacture, give, provide, lend, trade, mail, deliver, transfer, publish, distribute, circulate, disseminate, present, exhibit, advertise or offer. Notwithstanding the provisions of subsection b. of N.J.S. 2C:43-3, a fine not to exceed $ 30,000 may be imposed for a violation of this subsection.
d. It is an affirmative defense to a crime under this section that:
(1) the actor posted or otherwise provided prior notice to the person of the actor's intent to engage in the conduct specified in subsection a., b., or c., and
(2) the actor acted with a lawful purpose.
e. (1) It shall not be a violation of subsection a. or b. to observe another person in the access way, foyer or entrance to a fitting room or dressing room operated by a retail establishment or to photograph, film, videotape, record or otherwise reproduce the image of such person, if the actor conspicuously posts at the entrance to the fitting room or dressing room prior notice of his intent to make the observations, photographs, films, videotapes, recordings or other reproductions.
(2) It shall be a violation of subsection c. to disclose in any manner any such photograph, film, videotape or recording of another person using a fitting room or dressing room except under the following circumstances:
(a) to law enforcement officers in connection with a criminal prosecution;
(b) pursuant to subpoena or court order for use in a legal proceeding; or
(c) to a co-worker, manager or supervisor acting within the scope of his employment.
f. It shall be a violation of subsection a. or b. to observe another person in a private dressing stall of a fitting room or dressing room operated by a retail establishment or to photograph, film, videotape, record or otherwise reproduce the image of another person in a private dressing stall of a fitting room or dressing room.
g. For purposes of this act, a law enforcement officer, or a corrections officer or guard in a correctional facility or jail, who is engaged in the official performance of his duties shall be deemed to be licensed or privileged to make and to disclose observations, photographs, films, videotapes, recordings or any other reproductions.
h. Notwithstanding the provisions of N.J.S. 2C:1-8 or any other provisions of law, a conviction arising under subsection b. of this section shall not merge with a conviction under subsection c. of this section, nor shall a conviction under subsection c. merge with a conviction under subsection b.
TFNJ - I didn't miss anything. I still don't think there is a case. And to a bunch of other people, you don't convict someone just because they are "smug". Hell - 1/2 the population of this country would be in prison if that is the case.

To add to Donna's legal post - thank you - the couple was not having s*x in public. Clementi and his partner were alone in the dormroom - Ravi had set up the webcam so that it could be operated from a remote site. And yes, as a volunteer crisis phone counselor I assure you that you don't have to be gay to be mortified that your roommate and their friends are slimeball pieces of excrement who would do this to you. It happens more often than you know - it just doesn't make the news because not all of these kids end up committing suicide over it, fortunately. But they wouldn't be calling the crisis line if they weren't in serious pain.

I just listened to him say that they can't send a message that Ravi's behavior is ok and there is no real punishment for such behavior but then he goes and hands out a toothless sentence. Light sentence as predicted. Not too sure I understand the "Stay" process, but he got off easy. His family will probably easily pay the $11 k fine. I also heard the judge mention that this can all be expunged in the future. He got a slap on the wrist.
A little sanity people. I just watched the sentencing. As the judge noted, he did this filming 2X. Moreover, he destroyed evidence and tampered with a witness. He got really lucky on the sentence. However, as a non-US citizen, there is still the chance he could be deported down the road. He should do everything he can to keep his nose clean.

This was overcharged from the beginning as I think was the Sanford Fl. case. Hate crime is never charged fairly. It is only charged against some segments of society and that is wrong. If a gay were to kill a hetero hate crime would never be charged even if he was yelling his hate at the time he did it and the same goes for black on white crime.

As far as I am concerned, the jail term seems appropriate for the crime at this point. VERY LIGHT sentence though which continues to re-enforce heterosexual rights to discriminate against gays/lesbians.

That being said, 30 days seems way too light. I don't think people should necessarily be held accountable for other people's actions. You never know when an off comment made to someone under any number of circumstances will be something that pushes that person over the edge.
The simple fact that he video taped a couple (any couple!), and then shared it with others, to me, would warrant 1-2 years in prison. If not able to anticipate suicide, Ravi had to know at the very least that it would be harmful to Clementi in some way. I think Ravi did it, not out of hate, but just because he thought it would be funny.

I work with elementary school kids. I cannot begin to tell you the number of times I have been told "I didn't mean to do it" from a K-5th grader who I have confronted about incorrect behavior...sometimes even in the presence of a crying peer! NO REMORSE...NO REGRET! Just a CYA mentality! So many young people (even those in their 20's) are just not interested in taking responsibility for their own choices! What a generation! I think we have just discovered the tip of the iceberg in the ocean of Denial!

What Ravi did was totally stupid and immature! It's obvious his parents didn't show him boundaries and respect for other people's privacy. Nor awareness and compassion for what other people might be going through! What he did was morally wrong, regardless if the other person was gay, straight or his own parents ! RFK said this weekend that he did not cause his wife to commit suicide. The left and the media wholeheartedly agree that she was sick and weak. However, he also was going to trial this next month to take the children away and reduce monthly money paid to his wife. So yes, he didn't make her kill herself, but he sure gave her reasons to do so. So he pushed all the buttons that ONLY he would know the results since she had threatened suicide many times before.
This is what happened in the above case. The convicted didn't force the deceased young man to kill himself due to the act of kissing another male, but it was enough to push him over the edge and take his life. Did the roommate know the deceased well enough to know it would be devastating for him? Maybe...like RFK.
I feel that Ravi's sentence is fair. He unnecessarily invaded his room mates privacy and posted it to the internet for anyone to see. Also, people who say that, as it was a shared dorm room, Tyler shouldn't have expected any privacy, you're slightly mistaken. Yes, in a dorm room, there are many privacy issues that you deal with, but when the room is empty and you don't expect your room mate to be back for a little while, it is perfectly acceptable to become intimate with a significant other as no one really expects their room mate to record them via webcam. Whether this was a homosexual or a heterosexual couple, it was still a breach of a persons privacy and is wrong and seeing as how much this whole situation escalated, then the sentence is highly appropriate. Ravi is not to be blamed for Tyler's suicide, but he was helping no one with his behavior.
Also, Paul-1261354, I believe that you need to go read a recent article on MSN about a psychologist who is currently apologizing for attempting to find a "cure" for homosexuality. He is now admitting that it is not a disease and you would do well to at least respect others enough to know that saying someone loves another because they are sick only causes more cases like Tyler's.

It seems Ravi's awareness about gay people comes from his education at home and his culture. I don't think he intended to cause anyone's death. It was a prank that got out of hand.
As for Clementi, it's sad he decided to end his life, but I think his decision came from other issues as well.
Ravi's sentence was a travesty of justice. I believe that the court caved in to the pleas by gay activists for leniency b/c of fears of a backlash against the gay community with a harsh sentence. Ravi faced up to 10 years and he should be serving at least a few years in my book. This slap on the wrist reinforces the ridiculous notion that it was just a prank gone wrong. Really sad. I hope now that a civil case will ensue so that Ravi can be haunted for a long time.

Such an absurd sentencing sends a message "your life ain't worth jack". It gives freedom to bully, humiliate and push a young gay person over the edge just for the "fun" of it. Here's the thing- I live in NJ and have been following this case pretty closely. Those who are most outraged by the sentence clearly were not following the trial and are reacting emotionally to what they think happened.

My opinion - the guy's a douche. But those calling for his head are asking him to be punished for not being nice, for not liking someone. Was what he did mean spirited? absolutely. He's a teenager and has been made to feel that he killed his roommate and has been through a trial while having never been in a court before this trial. he's not a Hollywood actor to pose with remorse, apology because the cameras were focused on him. I'm sure he was doing what his attorney told him to. Taping someone else and posting it online is very wrong and should be punished, and that's what he's getting. Being an adoloscent, he certainly needs counselling after this ordeal, so that he really understands what he got wrong and why he is being punished the way he is. The parents of the boy that killed himself need to take responsibility for the death of their son - they didn't help him overcome things such as someone invading his privacy and move on with life. They didn't make him feel safe after his (probably) secret private life was made known to them. The judge is right - the parents will not find closure blaming someone else for their son's death
The real problem that everyone seems to be missing is that it is taking longer for our children to mature. I would expect this from but be very disappointed in a child of 13-15 years old. This child was 20. Children like this watch Hollywood films that show pranks like this so these children think it's ok. I blame the parents. Too bad the world is filling up with more and more of them.
15 months before this event occurred, getting caught having gay sex was punishable with up to a 10-year jail sentence in India where Ravi was from. That isn't a good excuse when a foreign student comes to America to study, but it might help explain Ravi's level of bias some. This event happened less than a month into Ravi's first freshman semester, after a request for a roommate change was not acted upon quickly by school staff. There are still plenty of places in America's South and Heartland where an openly gay college roommate who insisted on having gay sex in a shared dorm room could very well face the same kind of behavior out of American college students too. I am fully in favor of gay rights myself, but I feel that the university could have done a better job than to place a foreign student from a country with a much different tradition involving homosexuality into a housing situation where he would immediately be exposed to a situation that he might be very uncomfortable with based on his own background and long-standing beliefs, and as such, the university should bear some of the responsibility for the outcome too.

This was a prank based on longstanding foreign political and religious beliefs that could have been avoided if the university had been more sensitive to the belief systems of foreign students. How was anyone to know that Tyler Clementi was so incredibly sensitive, and not just from Ravi's actions, that he would choose to end his life over multiple issues, only one of which was because of Ravi's actions, which were intrusive but non-violent.
How many kids commit suicide because someone caught them masturbating? Should the person who happened to walk-in on an event like that get charged with murder or manslaughter over it because they told someone else about it, if the "victim" decides to kill themselves later over multiple issues?
Yes, I'll agree that some message needed to be sent in this case, and that message may yet include a lawsuit against Rutgers University, whom I feel could have done a much better job than to place a foreign student from a country where homosexuality was felony crime just 15 months earlier into a living situation with an openly gay student here. When I was a college freshman in 1975 many schools did not allow sexual relations of any kind in their dormitories, gay or straight, so in my day many students exercised discretion and went to motels instead of forcing their roommate out of their dorm room. If it were not for the suicide, this never even would have been discovered. Because of the death, the press whipped this into a frenzy and the prosecutor used this for political gain *SHOCK*.
Because of yet another suicide by a gay man, the GBLT alliance have attacked this Ravi person as the worst thing to ever be born. As to the sentence, it appears to be appropriate. The judge had to give him some jail time, yet the real time is the three years probation, the 300 hours community service, the fine and the sensitivity training classes. There was no finding of a hate crime. There may have been some bias, but being biased is not a crime (yet...)
As to Dharun Ravi (and his lawyer) he should have at least made something of a remorseful statement. As has often been said, show you care, even if you have to fake it. The guy is still an insensitive jerk, he should not have done this in the first place. Failing to show the world that you care that another person has died, a person you did know, just shows the world that you are a jerk and don't really deserve leniency.

Frankly, the fact that Clementi killed himself is irrelevant to this case. Ravi wasn't on trial for that. However, it WAS a hate crime because Ravi violated Clementi's privacy because Clementi was gay. He could have been dumped by his boyfriend for all you know and by all accounts, he had a huge falling out with his family when he told them he was gay. I'm suprised that some justice prevailed! The suicide didn't have anything to do with Ravi. It has everything to do with an individula with a genetic defect that didn't get the help he needed.
Another case of lawyers taking someone to the cleaners. Justice prevailed. It is utterly tragic what Tyler's family is going through. I also believe Dharun is at least part responsible for Tyler's death. However that doesnt make Dharun a criminal.

He'll be there a bit over two weeks most likely. In order to be sent to prison, in most states, you have to be sentenced to more than a year.
The real problem for Ravi's family appears that they are dissapointed that their golden child will not be a candidate for President in the future. First, he made a video of someone who was engaging in private behavior (and not in a public setting) without his knowledge. In the given state, that alone is against the law. You also can not use your camera phone in a public restroom to make a video of someone--even if you never showed it to someone else--because that is a violation of privacy.
There was also a violation of the law regarding tampering with evidence. Further, there was a violation of the law in terms of tampering with witnesses.
There are some other laws/codes that the person violated--most of them are relatively minor, but they were enhanced because this person picked his victim specifically because of his sexual orientation and not just at random. Still, even without the enhancement, this person still was clearly guilty.
He was offered the chance to get a very light "sentence" in return for pleading guilty to a very minor charge--it would have involved no jail time. This person either got very bad advice from his attorney, or he really is so narcissistic that he believed he would not be found guilty (and probably still thinks he will eventually get off). People from India in the highest caste (and this person probably is very high caste) do not believe that they can be found guilty just like "common criminals." They expect to buy their way out.
I don't know that this person actually has to go to jail--perhaps the sentence was "stayed" while he is on probation, this story isn't particularly clear. I think that the sentence for this person, as a whole, is fair enough. It is not as though he drove Clementi to the bridge and egged him into jumping. Something else happened--I don't know what--that set Clementi off. It was probably tied to this particular incident, but we'll never know as Clementi didn't share it. Perhaps he was told in no uncertain terms that his career as a professional violinist was over because of this video--and, you know, that might have been true. A person's life can be destroyed quickly by some video on the Internet.
The lack of remorse for the consequences (intended or not) of his actions--and whether or not the young man was smirking, he did not do the obligatory apology in court--really does sway people. He is lucky it did not sway the judge into throwing the book at him. He should pay his fine, do his community service, and hope that he doesn't actually have to serve any time at all (well, not above a weekend).
But, if anyone really thinks that this young man did nothing wrong, I hope that you get videoed the next time you use a public restroom and that the video is posted on the Internet. You might change your mind, then.
Do you have an expectation of privacy in a shared space like a gym or public BATHROOM? Of course you do! Try running a webcam in there and see if you don't get beat down. In one's BEDROOM, which is what a dorm room is, there IS an expectation of privacy, albeit it can be violated when your ROOMMATE is THERE, when you are alone, an expectation of privacy is the norm.

I think the judge was fair in his decision. While this young man was not directly responsible for someone else suicide( can other bullies be sued for that too?) , he was caught lying to the police and deleting evidence.
I think the gay community is making too much of this. If a heterosexual person was videotaped kissing and then it posted around the school, there would be some notoriety for it, but for the most part the talk would have died down by the end of the semester. Rutgers is a liberal school, so I'm pretty sure that would be the case. Tyler obvioulsy had other emotional problems that his parents' didn't teach him how to deal with for which, led to his death.

WRONG. it is only legal if you are a part of it, and you know about it and consent -- you do not necessarily have to get the consent of the other party to record. However, if you are recording someone else's activities in a shared space that you do not have sole property rights to, and you are not a party to the recording nor does the person recorded consent, you have just committed a crime.
Tyler had just as much of an expectation of privacy in HIS shared room as Dharun had, and Dharun had no right to record Tyler's activities and broadcast them on the Internet without Tyler's permission. Tyler was committing no crime, but Dharun was.

How is this a big deal out of nothing? What if it had been someone you know that was video taped and shared with a group of people? 2 weeks ago I read a story on MSNBC where two high school students tricked a woman in Louisville, Kentucky and video taped her under her dress and broadcast it on youtube. This is a crime and it is a big deal regardless of the victim. The fact that some in our society are more into protecting heterosexual rights than granting equal rights makes this case just a bit more sensitive.

There are lots of people posting here who think that Ravi's smirk and attitude should be punished by 10 years of prison. I am sorry but in this country we don't send people to prisons for being @!$%#s. The question here is - what law was broken and what the commensurate punishment should be - as per law. Not as per how you feel about Ravi's smirk or his lack of any apparent remorse.

A fourth degree invasion of privacy crime is when a person sets up a recording device to record someone without their knowledge or consent.
A third degree invasion of privacy crime is when a person sets up a recording device to record a SEXUAL tryst between two people without their knowledge or consent such that their private parts are visible.
Dharun Ravi should have been charged with the first. It carries a maximum sentence of 3 years.
But instead he was charged with bias intimidation. Which means he recorded Tyler Clementi with the intent to intimidate him because he had a bias against gay people.
The prosecution could present not one person who could testify that Ravi ever displayed any kind of bias towards Tyler. The prosecution could not prove that Ravi wanted to intimidate Tyler.
Even one of the juries who returned a guilty verdict was later recorded on camera saying he did not believe Ravi should have been charged with Bias intimidation (They why the @!$%# did you return a unanimous guilty verdict you dick !!!)
Instead, the prosecution (and the juries) used a little known aspect of the law in determining Ravi's guilt. They determined that Tyler reasonably BELIEVED that Ravi intended to intimidate him out of bias. They charged Ravi by imagining what Tyler might have "believed" after Tyler was dead.
The very basis of our modern jurisprudence was turned on its head by this case. Whenever there is crime - the basic question that is asked in the court of law is - What was the motive. What was the intent of the perpetrator. But not in this case. Ravi's motive and intent were of no consequence. The only thing that matter was what Tyler felt. Infact, No.
The only thing that matter was what the juries THOUGHT Tyler felt.
And that is why this case is what i would call a total bloody bull@!$%# and i am happy to see the judge concurred and prevented a colossal miscarriage of justice from taking place.

Fred - your analogy of a public bathroom is irrelevent - The public bathroom isn't YOURS. You don't lay claim to part of it. A dorm room that is SHARED is rented by multiple parties. There aren't separate areas. If it were the apartment style dorm room where each person had their own bedroom, then yes, you could expect some privacy. But, when it is the typical double room, then no, you cannot expect privacy, ever. And a public bathroom is just that.. public.. NO expectation of privacy. You take your chances when you use one.
There is some expectation of privacy in dormitories on the part of the ones who are renting the particular rooms. Tyler certainly had an expectation of privacy in his own room, but not in the hallways, common areas, etc. Furthermore, he certainly did not consent to being videotaped, nor did he consent to the broadcast of the tape. If Dharun wanted to tape his own bed and his own things, that would have been different -- but he had no right to point his webcam at Tyler's bed to broadcast Tyler's activities.

If only Tyler had been black, Dharun Ravi would be found guilty in the press of a hate crime and charged with 2nd degree murder for causing Tyler's death. If he was born in the United States, he is an American citizen. You can't deport a citizen. Just because his parents are immigants does not make him an immigrant. Well, the judge has passed sentence. He got 30 days probationary jail term and the judge has recommended that he not be deported. It sounds like the judge recognized the highly political nature of the charges and the verdict but did not want to let him off completely. This is really a very light tap on the wrist, far less than I was expecting. I did not expect the judge to hand out any jail time but I did expect some community service. Ravi got very lucky as this sentence is even less than what the prosecution had offered as a plea bargain at the start of all of this. I am sure that there are many who will be outraged at this verdict, but in all, I think the judge got it right. He looked at this entirely unemotionally and recognized this for what it was, a stupid prank by a college freshman that got a little out of hand. Ravi was not responsible for Clementi committing suicide and that was the real basis of the jury's conviction. I think the judge realized that he did not do enough with his instructions to the jury to try and prevent this from happening and corrected his mistake in the sentencing. Clementi had serious emotional problems before he ever met Ravi even if Clementi's parents refuse to admit it. After all, to admit it would mean accepting at least part of the blame for Clementi's suicide on themselves. From other less biased stories I have read, Clementi's parents were not exactly accepting of their son's lifestyle before this happened and that had a lot to do with his problems and his suicide. Maybe one day the parents will be honest with themselves about their role in what happened to their son.

I agree with JS, Ravi was so incredibly wrong but he did not kill Clementi. He bullied him, he intimidated him and embarassed him. He is paying the price for those crimes, more than the 30 day sentence as he will never live a normal existence. I cannot imagine the grief of the Clementi family as no one deserves the outcome they had to endure. But the crime did not cause the suicide, the struggle that Clementi was facing prior to ever meeting Ravi is what caused his end. This entire situation does provides a lesson to those that are paying attention, unfortunately, kids live in the moment and are egocentric. Most will not believe that they are causing such harm and can be punished for similar acts. Very sad.

This is an invasion of privacy type of crime... the "bias and hate crime" aspect is way overblown. He should get probation for 1 year and 500 hours of community service and some fines. He did not cause Clementi to kill himself. In US Criminal Law, the punishment should fit the crime. In this case any jail time is too much, and I think the Appeals Court will reduce his sentence (whatever it may be)

It's about time - How is it a sex offense? They didn't watch them have sex. Again testimony during the trial revealed that what was seen on the video was about 8 seconds worth of kissing. Once with clothes on, the second time with shirts off. There was no intercourse seen, no nudity. Just two dudes kissing. If it was a guy and a girl this would have never even gone to the courts, it wouldhave been handled internally by the university.

That's why he trained the camera only on his victim's bed, not on his own things as he claimed was his reasoning for having the camera on. His roommate's sexual preference is not the issue. No one has been charged with any murder or homicide of any degree. The privacy law that protects his roommate is the exact same law that would protect you from some creep putting a secret camera in your room. There's no difference. Shared living space is not a factor, the law still applies.
And I've been to college...all four years I had roommates in the dorms...there was NO WAY i had any acceptance in my head that my personal business was not my personal business and open to public viewing. and i can guarantee if I knew anything about any secret recordings. The suicide brought this to our attention. Ravi still violated college regulations and federal laws. He still tampered with witnesses and evidence. He still lied to police.

If you only knew how difficult it is to come out to your family if they're ultra-conservative, you wouldn't have made that comment. We face being ostracized by the only support system we know. We risk being thrown to the wolves by the parents who are supposed to love us no matter what, during a time when we're most vulnerable. A time when everywhere around us, people are getting away with gay bashings, assaults and murders. When we hear people all around us, like yourself, telling us everyday that we're not wanted or appreciated, using some of the most hateful speech imaginable. We are in fear for our safety and well being from an early age; and in some cases, need to be nurtured in order to get to a more stable place in our minds and hearts because of the trauma & mental anguish involved with coming out. We often aren't sure where our parents loyalties lie, because we get mixed signals from them; and therefore, are sometimes afraid for them to find out about indiscretions (or experimentations) until we're sure if they'll be supportive, or turn they're backs on us, as you are doing. All these things are on the mind of someone who is questioning their sexuality; and they're in a fragile mental place, that someone with low morals can manipulate or take advantage of. I hope that one day you will have a bit more compassion and understanding, and try to get to know a person who identifies as LGBT. Perhaps it'll make you a better person (and christian) in the long run.

When I went to College after attending Junior College and living in a dorm for the first time my Freshman room mate wanted to establish 'rules' for when he or I bring girls over. The classic hang the tie on the doorknob type stuff.

OK.... So he was convicted of a bias crime. Not Hate Crime. Difference is that he didn't physically assualt Tyler. The jury of peers convicted him on 24 counts. Look them up. More than just bias crimes...also trying to cover up the crimes and witness tampering. He knew he was wrong...did it anyway. What is justice? Can you be charged with a hate crime for video taping someone? Probably not...but you most certainly are in violation of the law of that state which clearly states that you can't video tape someone engaged in sexual activity without their knowledge or consent unless you are working in an authorized capacity. And the mere fact that you share the room...doesn't authorize anyone legally.
