Video purportedly shows NYC student making out with his teacher

A New York high school senior allegedly won a bet with four friends to see who could hook up first with their 26-year-old global studies teacher, the New York Post reported.

A video recorded Friday by a Manhattan Theatre Lab High School pupil shows fellow student Eric Arty, 18, kissing a woman on a park bench in lower Manhattan.


Arty denied to the Post that the woman he is seen with at Bleecker Playground in Greenwich Village is teacher Julie Warning.

“Yeah, that’s me. I’m kissing a girl,” Arty told the newspaper when confronted with the photo. “That’s not my teacher that I’m kissing in the picture. It’s just a girl I know.”

Arty refused to say who the woman was.

The teacher also denied the involvement, telling the Post: “He is my student, but I’ve never had a relationship with him or any of my students. That is inappropriate. I think that this is a misunderstanding.”

A spokesperson for the city's school district confirmed to msnbc.com the incident was being looked at.

Laurel Wright-Hinckson, public information officer for the Special Commissioner of Investigation for the New York City School District, told msnbc.com an investigation had just been started, and would take at least a couple of months to complete.

The student who filmed the two kissing said Warning is "the most appealing teacher in the school.”

“She always wore nice skirts, and she had appealing tattoos all over her body,” he told the Post.

Arty and four of his friends each contributed $100 to a pool, the newspaper said. The first to win Warning's affection would win the cash.

Some students told the Post that Warning tried to resist the teenagers’ flirtations at first.

“She would try to avoid it because she was [Arty's] teacher," a student told the paper. "She was a nice teacher and didn’t want to report him, and she would throw him and his friends out of class for trying to flirt with her,” the student said.

According to the Post, Warning was reassigned on Tuesday to an administrative position at the school, which is north of Manhattan's Lincoln Center.

A Department of Education spokesperson told msnbc.com Warning didn't report to her new desk job Wednesday.

It wasn't clear whether Warning reported for her reassignment on Thursday.

Job at stake, but no possible charges
Warning does not have tenure at the school and could lose her job, but she wouldn't face criminal charges because Arty isn't a minor.

The teacher's father, Pete Warning, told the Post this didn't seem like something she would do.

“All of her students, like 85 percent, are gonna pass their Regents for the first time," Peter Warning said, speaking of the standardized tests students take in New York State. "They all love her. My heart’s broken.”

Earlier this week, Mayor Michael Bloomberg, the school chancellor and State Senator Stephen Saland announced new legislation to better protect New York students from inappropriate sexual contact with teachers.

Under current law, outside hearing officers decide on these cases and impose penalties – including whether or not a teacher is fired. The new legislation would make it easier to remove a teacher who is found to have engaged in sexual activity with students.

“If a school employee is found to have engaged in sexual behavior or made sexual comments towards students, the chancellor should have the final say on what action to take and the legislation we are proposing would provide that authority,” Bloomberg said Tuesday in a press release.

“Every child deserves a safe learning environment and every parent has the right to know that his or her child is safe while at school,” he said.

I don't believe the students for 3 reasons. 1) The student in the video insists that was not his teacher. 2) other students observed her throwing this miscreant and his friends out of the class for flirting 3) she's a competant teacher.

If they throw her out it'll be a tragedy.

Even so I understand there is a difference here If it were reversed yes it would be bad but we are not talking about an older male teacher and a female student we are talking about a male student that was 18 and a hot female teacher. Sorry mom I know you are a mother but you are not a male. Males understand no crime was perpetrated here just juvenile youth behavior with better who can get her first maybe detention for the boys and a stern warning for the teacher that is all. @Overlord, the problem is because the older of the two is also in a position of authority. Those in authority have been known, in the past, to use their position to gain sexual favors. So schools now have a strict no tolerance policy concerning sexual misconduct between staff and students. If she were his 26 year old pizza delivery girl, there would be no problem (he is above the age of consent). But she was his teacher. Not to say he really was kissing her since they both say it wasn't her.

    There is no way from the poor quality of that video that anyone can say that he is kissing the teacher. Both the boy involved and the teacher deny it as her. What it comes down to is some juvenile bet by a bunch of high school kids is ruining the career of a woman who may have done absolutely nothing wrongs and is apparently a very well liked and very good teacher based on the academic performance of her students. If the video is of her, then she deserves to be fired. If the video is not of her I hope that this kid is prepared to face a serious financial liability for the rest of his life paying off the damages she will win in a lawsuit against him for claiming it was her in the video to start with, and just to win a $500 bet. He will end up losing a lot more than the $500 he won in the bet. The kids parent should be counting themselves very lucky that their idiot son is 18 or they would be on the hook for any damages she wins. Of course I am basing this on the expectation that she will sue this miscreant for the damage he has done to her career with this stupid move. With absolutely no evidence and both parties saying it was not her in the video, I would like to know what justification the school system had for removing her from the classroom. In addition, I certainly hope that the five students involved in this bet were all suspended from school, if not expelled for their actions. it is pretty clear that this whole thing was started by the students, not the teacher and they should be forced to pay the price for their actions. The students should not get to walk away from this without being severely penalized for their actions. Maybe being suspended for the rest of the year and having to retake their senior year will teach them that things like this are not funny or innocent pranks.

    I remember Ms. Johnson, fresh out of college for my junior and senior year. She was slender and beautiful (to my lil teeny brain, but I digress). All of the boys took English Lit. and Poetry to be in her class. I remember doing my analysis on Metallica's Fight Fire with Fire for poetry and she was gushing over my work. I thought I had her right there and then, but a las she was a professional.

    No matter how smooth the young man is or was, it is the teacher's job to send his ass to the office or not fall for it. I hope it was not her on the tape, but even if it is not, the damage has already been done. Why does kids now a days have to record everything?

      I was in love with my 4th grade teacher, so I asked her out. She accepted since I was such a charming young man. I took her to a little league baseball game, she drove of course. After the game we went back to her place. I didn't think it was my place to make the first move so I waited and waited and waited for her to start something but it never happened.             I agree! There should be more legislation protecting teachers. Teachers should have more protection from the kids! They can conspire to get rid of a teacher just by making unfounded accusations.

            Besides, in this situation the teacher and student would be consenting adults. Why should there be any difference regarding her job. What if she was a servant or maid in the boy's household, would that be a different situation?

            I am not saying that kids should not be protected, but looking at the majority of America's youth today, there is no question in my mind, that on the whole, teachers have more integrity.

            Too funny... look at all you fools jumping down someones throat over something that has yet to be proven. And another thing, why in the hell would anyone go after the teacher in this story or even assume it was the teacher in the video in the first place? Because some kid said it was that particular teacher and student in a video that doesn't have any type of clarity to distinguish anyone or anything? Were any names said? Were any faces clearly seen? And how is it that the story of a kid, with more then enough reason ($400 to be precise) holds more weight then the story of an adult with absolutely nothing to gain or lose? What makes more sense, a kid faked a video to try and win a bet, or a respectable teacher that has shown objection on multiple occasions towards the advances of a group of students and has witnesses to the fact has completely jumped out of character and decided to make out with a student? I think its also quite offensive the way that MSNBC painted the picture of this unfortunate woman as well. Why does the fact that she may or may not have tattoos or look good have any bearing on this story? Answer? It doesn't. It gives a biased opinion of someone because people tend to believe attractive women with tattoos are easy or trampy thus leading one to believe that the allogations made against this poor woman have any merit. They do not. Both parties already claimed that they have never had any extra curricular engagements and even the student said it was a hoax to try and win that bet. Lastly, stop coddling these nitwit kids. They aren't stupid and are more then capable of forming educated decisions. They are in high school not in kindergarten. That means they aren't exactly getting into a white van for the promise of candy... they are getting into the van for the promise of nookie and it was their conscious decision to do so. If they aren't smart enough to know these things that the only person at fault is the parents who didn't teach them enough. But as I found out just yesterday when I went to the casino and some older gentleman decided to try to cut line claiming he was hadicapped and that was the reason he deserved to take the spot I waited for a good 15 minutes for, people will use any excuse to get an advantage or as an excuse for their wrong doing. In this case their excuse is because they are only students, but in reality if this was done, say, to one of the girls they went to school with, you should all know it is a criminal offense.

                  That is exactly what I was about to bring up. These students are not innocent and we should not act like we still live in a world where this is the case. This whole thing began where "18" year old adults made a bet. Though she "may", because she is not guilty currently. If people are going to go after all teachers in the press like this (please do not assume I am condoning such acts because they are simply bad) then it's very simple we are going to have to write some more rules that provide better protections for teachers. One example being after two reported situations where there is the evidence that a student might have flirted with a teacher, the student must be reported to the local authorities to be investigated on the rounds of sexual harassment. Will it piss the prospective student's parent off? Probably and a whole lot more people myself included because of the additional resources this might incur. The point I am trying to make is this isn't one way, there are two people who I view as adults involved here and we will have to afford them both "equal" protections. Failure to do so could start opening up districts to more lawsuits.

                  Becky - you are correct. Teachers are not worth very much to American society. Just look at how low their pay is - a high school graduate makes about the same four years after they enlist in the military.

                  And they (the teachers) can be attacked in a classroom (has happened in the past), will be penalized for false accusations (as is happening in this story), and must tolerate the abuse of the Republican party in all 50 states (attacking teachers pay for being so high).

                  Bottom line is - why would anyone want to become a teacher in the USA? My wife used to be one, and she left as soon as she could.

                      So a teacher who is sexually harrassed by students - to the point where she had to remove them from the classroom - may lose her job because the students made a bet? Plus, she was removed from a classroom position because of this harassment. All the students should be held to the school's sexual harassment policy.

                      yes, this is the part that most of the posters seem to not understand. this teacher, from the story, did nothing wrong, yet she might lose her job because of some horny man/children.

                      That's because our kids have no respect and no sense of consequences for their actions because parents can't be parents without some other person who doesn't agree with them turning them in to the authorities.

                      We also have a school system who is afraid to punish kids sexually harrassing a teacher while at the same time suspending kids who are doing good things like bringing awareness to bullying in todays world.

                      They have no respect because the 'system' in place today always protects them...and has them played out as the victim. Just look at these kids that call the cops to report their parents for abuse just because they were sent to their room. Or were not permitted to go to a party. The cops come to the house, listen to the complaints on both sides, and even if there is no indications to believe the kid...Child protective services STILL 'potentially' end up getting involved. All because of the kid not getting their way.

                      I don't know if this teacher was involved here...you cannot make anything out in the video. But by looking at the picture that is at the very beginning; the picture of 'them' on the cover of that paper, it doesn't look like her. Look at the nose of the teacher from Facebook, then look at the paper...the noses look different. (Though it could just be a crummy picture). Either way, I don't feel she should lose her job. Both were adults....and when you have Celebrities in Hollywood that are 50+ yrs old, MARRYING teens, (anyone remember the 'Lost' actor marrying his teenaged girlfriend?)...and THAT was allowed with no repercussions to either of them...it simply blows my mind when 2 ADULTS...bet, no bet, she being harassed, or not being harassed and she truly did kiss this kid....why 2 ADULTS should be 'punished'.

                        The Lost actor wasn't in a position of authority over the girl, and her mother signed for her to marry him so technically there wasn't anything to complain about (you may think it was inappropriate, but her mother didn't). As far as statutory rape, it is only an assumption on anyone's part that they had sex prior to marriage, so unless there is proof of that there is no misconduct. Odds are good that teenager was the more mature of the two.

                        When there is a dominant/subordinate situation, then there can be problems with coercion. I'm not saying that is the case here, from the article it sounds like the teacher was the one being harassed by the students. But the opposite situation has occurred enough times that school districts tend to err on the strict side when dealing with potential cases of sexual misconduct. Everybody knows teenage boys are the most manipulative creatures on the planet when it comes to 'getting some' (made even worse in this case because of the competition and the 'bet'). If there actually was a kiss (not saying I think there was).

                        My only point was that the 'Lost' actor, with permission from his Bride's Mom or not.......MARRIED a teenaged girl. Not kiss, as this particular article is about, but MARRIED.

                        And yeah, I understand the whole 'position of authority' issue. Her being his teacher, him, her student....Things like this are not 'supposed' to happen. People tend to view it as 'unacceptable behavior'. I get all of that, and I'm not attempting to belittle it at all. Yeah, if this was a teacher in her 30's for instance, and he was 17 or younger....THEN I'd have an issue with it....AND her. But they're both adults, this incident happened off of school property apparently....so no, I don't have an issue with it at all. ONLY because they were both adults.

                        Why is it that no one takes issue over a boss at work sleeping around with a secretary? We ALL know that has happened before...and most likely still does. (And no...I was never involved in such)...That's 2 adults, one in a position of authority over the other....Yet there is no 'GASP....HORROR....OMG!!! We need new legislation! chants, rallies, and protests happening?

                            I love how these 18 year old students that have physical relationships with their very attractive teachers need to be "protected". So long as the student is of legal age, and a willing participant... it should just be a slap on the wrist for the teacher.

                            Unless I'm missing something, the article does not state the teacher is in fact the person in the video. The adult student claimed she was not. Even if the facts prove she was not involved, the damage is unfortunately done.

                            I saw the video it's extremely out of focus and at one point the "teacher" looks right at the camera. If it was the teacher I'm pretty sure she wouldn't have allowed it to be videoed. I don't think it's her I think the kid wanted the $400 and him and his friend got some other girl that had hair similiar to the teacher to do the video and they split the money. These kids repeatedly were thrown out of her classroom for trying to flirt with her. She obviously didn't want it and yet they persisted. The only thing she did wrong was not going to the Principal when they didn't stop. Now she will lose her job over their stupid prank.

                            It seems that about fifty percent of the posters have substandard reading abilities, having either not gone beyond the come on headline, or not being able to read for context and see that the students involved are claiming it was a hoax. A hoax that will generate some serious lawsuits I imagine judging from the Scarlet Letter leaps to judgment seen here.

                            With fine upstanding children like this, please explain, in a three paragraph essay, why teaching is an excellent career choice.

                            You know age really is just a number. All persons of the same numeric age are NOT the same age on other levels. Additionally, there are huge benefits to both parties in age difference relationships. Yes, it is not good when one person is an authority figure over the other; but often it is not the "authority figure" that pursues these "relationships", because they KNOW they will not be the one scrutinized.

                                Twentysomethings should not be allowed to teach high school. The ages are too close...especially with seniors! For those boys to be confident enough to make a bet like that proves she was letting them know she was down with them. If she was a true professional they would not see her tattoos.                                   Some of the best teachers I had in high school were also the youngest. Unfortunately with the monolith of teachers's unions and tenure, they were always the first to be let go.

                                  Too bad this "kid" wasn't a high school dropout at the time. Even IF it is the teacher in the video, it would have just been two consenting adults kissing. Really - are we going to insist that the 18 yr old pursuer was a VICTIM of any sort?

                                  Could we please get some clarification on a NATIONAL level about the difference between an 18 year old and his firends actively pursuing a hot high school teacher vs. a middle school teacher coercing and molesting an 11 or 12 yr old.... ? Load of crap.

                                  Speaking of poor judgement, you decide who is professional by what they do in their personal time? That's just silly. My ex used to teach and has tattoos (she generally keeps them covered at work). The reason she no longer teaches is because she works for the D.A. now.

                                  Will all of you please read the article. It clearly states the teacher states she was not the one in the picture, and the young man also states it was a girl- not a teacher. The whole point of the article was to make the point that these young, male, adult students made a bet about making out with a teacher, and the teacher is the one paying the price- but the fact is that they did this, and the fact is that there are so many idiots out there that can't read at a sixth grade level. Not all teachers are perverts, but we all pay the price when students make accusations or pull stunts like these young men did.

                                    These Boys, I refuse to call them men, are stupid, immature, and worthless. The odds of these boys making any significant difference to anyone is astronomical while the Teacher may in fact influence someone to become better and work harder to become something more.

                                    I will not say I didnt have thoughts about some of my hotter teachers even so far back as 5th grade but thinking someone is hot and then making a video to win a bet and potentially ruining someones life is beyond crossing that line. The line is not even on the same planet at that point.

                                    The boys should be sued for defamation of character, and or serve real prison time.

                                      As a high school teacher in my' twentysomethings' I resent your comment. My students' maturity level is, in no way, comparable to mine, and I act in a profession manner at all times.

                                      If this teacher did engage in a physical relationship with a student, she is absolutely in the wrong, however it seems quite an unfair generalization to assume that all us twentysomethings would also use such poor judgement. What, are we supposed to wait until we are 30 to start our careers? Seeing as these incidents occur with teachers in their 30's & 40's, age is not the issue: stupidity is.
