A middle school band director is accused of exchanging dirty texts with a 15-year-old student. KXAS-TV's Ellen Goldberg reports.
Days after being named teacher of the year at a Colleyville, Texas, school, a band director was arrested on accusations that he sent nude photos to a 15-year old-student.
John McDaniel, 32, is charged with solicitation of a minor online and carrying an improper relationship with a student.
McDaniel confessed to exchanging nude photos with a girl who was in his class at Colleyville Middle School last year, Grapevine, Texas, police said.
“The information we have is that there was some sexting going on, by way of the cellphone and some explicit emails,” Sgt. Robert Eberling said.
According to the arrest affidavit, McDaniel and the girl began chatting on Facebook two years ago. The victim told investigators that McDaniel told her she was pretty and wondered what she looked like naked. The affidavit goes on to say that she shared topless photos with him and he responded with a photo of his genitals.
Investigators said they have not found evidence of physical contact between the teacher and the former student, CBS DFW reported.
The victim's brother discovered one of the emails over the weekend, according to the affidavit.
“When you send your child to school, you hope they are placed in a safe, stable environment," Eberling said. "It’s unfortunate that this happens."
No one answered the door at the north Fort Worth home McDaniel shares with his wife.
McDaniel is out of jail on a $10,000 bond, but police said he could be arrested again if they find other victims.
“Unfortunately, when you are dealing these type of offenses and the people that perpetrate these offenses, generally there are other victims,” Eberling said.
McDaniel has been placed on administrative leave. He has served as head band director at Colleyville Middle School since July 2009 and just won a ‘Teacher of the Year’ award.
“If the police investigation substantiates the allegations, the district will immediately proceed with termination procedures," the Grapevine-Colleyville Independent School District said a in statement.

Victim? Yeah OK the guy showed extremely bad judgement but let's face it you don't go all the way to 17.99999 years of age being 0% responsible for anything you do and then when you reach 18 you are 100% responsible. Well I guess legally that might be the case but not factually. At 15 you have some responsibility for your actions. I wouldn't call her a Victim.

It never ceases to amaze me... "in this day and age" how ANY person... let alone, a fairly young High School teacher... who, of ALL people... should be "more than aware" of how many people have gotten in all kinds of trouble, accidents and death for improper or "real STUPID" use of a cell phone.

Sounds like this girl is just as much to blame as the teacher is if she has been leading him on for an extensive period of time, outside of school with the intent of a personal relationship for over two years. Of course, the teacher is in the wrong, I'm not disputing that in any way. But I don't think it's appropriate to call a girl with this much indiscretion a "victim", as she was aware of what trouble she could potentially get herself into. People are so used to looking at only one side of the spectrum that it's almost a subconscious reinforcement for the kids to feel it's okay to partake in this kind of dangerous activity. In other words, if parents actually disciplined their children not to do things like this, it might happen less altogether. But we all know that won't happen and this is just another headline for the endlessly-expanding list. Take it from a youth that knows first-hand how these immature kids behave.

This is attrocious, what t he guy has done. The part that confuses me is the publicity it is getting. I mean, in my home town, there were 2 teachers who were fired over the similar disputes. One high school teacher had sex with a student and then she cried rape (she was over 18), then there was a jr high teacher who was sexting pictures and comments to multiple jr high girls (he was a very respected member of the mormon community in my town). So, why is it that this one particular case is so special?
Something needs to be done about this epidemic of pedophiles posing as teachers in schools.
Part of the problem is the different treatment male and female pedophiles receive when they are caught. The way it currently stands, it is like an incentive for female teachers, because even after being convicted of molesting their students, they are not given more than probation and loss of their jobs. The male teachers, however, are hounded out of civilization, and have to exist in isolation in prison. Rarely do they get sweat-heart deals from prosecutors.
This must stop, and training should be a required for any person hired to teach children. If there is a test to detect pedophile tendencies, it should be a required test for anyone wanting a license to teach.
This guy deserves some jail time: are there no, thirty plus year old women in this town, dude has to be a nut case.
Its a testament to how not ready for the adavnces in technolgy. Same thing as Congressman Wiener. We are just not prepared for the technolgy we now have.

A 13 yr old, no matter if they stand outside, naked and offer themselves to every man who passes by, is still a victim.
The ADULT is supposed to be the ADULT. A kid has SO much growing and developing to do, and they are NOT CAPABLE of making all of the best decisions for themselves. YOU may say they are responsible, but if that were YOUR daughter, you'd be trying to do like the Texas dad, recently, and beat him to death.
