Zimmerman lawyer delays second bond motion in Trayvon Martin case

Joshua C. Cruey, Orlando Sentinel / AP

After his bond was revoked, George Zimmerman returns to the John E. Polk Correctional Facility in Sanford, Fla., Sunday, June 3, 2012. Zimmerman is charged with second-degree murder in the shooting of Trayvon Martin.

SANFORD, Fla. -- George Zimmerman’s legal defense team said Tuesday it would hold off for “a couple of weeks” filing a motion for a second bond motion for its defendant in the Trayvon Martin shooting case.

The delay announcement comes a day after defense attorney Mark O’Mara acknowledged on his case’s website that Zimmerman misled a Sanford, Fla., court about his finances but vowed he would seek a new bond hearing based on his client being “forthright and cooperative” in all other aspects.

No reason was immediately given for the delay, but O’Mara said he would file a motion “well in advance of the hearing.”

Zimmerman's next bail hearing has not been set yet, but his legal defense team said it was not expected for a couple of weeks.

Key events in the Trayvon Martin case

Zimmerman, 28, surrendered to authorities Sunday, two days after Seminole County Circuit Judge Kenneth Lester revoked Zimmerman's $150,000 bond that was granted April 20. Prosecutors demonstrated that Zimmerman had at least $135,000 that he did not disclose in a special PayPal account he had set up to pay for his defense.

Zimmerman was charged with second-degree murder in the killing of Martin, 17, as he walked through a gated residential community in Sanford, near Orlando, on Feb. 26.

On Monday, O'Mara said in his statement:

"We feel the failure to disclose these funds was caused by fear, mistrust, and confusion. The gravity of this mistake has been distinctly illustrated, and Mr. Zimmerman understands that this mistake has undermined his credibility, which he will have to work to repair.

"At the point of the bond hearing, Mr. Zimmerman had been driven from his home and neighborhood, could not go to work, his wife could not go back to a finish her nursing degree, his mother and father had been driven from their home, and he had been thrust into the national spotlight as a racist murderer by factions acting with their own agendas. None of those allegations have been supported by the discovery released to date, yet the hatred continues."

To Motaba:

Each and every piece of evidence to date has proved that everything Zimmerman has said was accurate and true. (Are you serious? what evidence is that? Oh, his head was bleeding? Maybe it was bleeding because he got into a fight with a person fighting for his life and GZ could not beat that person; therefore, an injury does not solidify the fact that TM jumped GZ, at all. And have you seen those two black eyes yet? Neither have I, althought I have heard about it, never seen black eyes in any image so far; I guess that's probably one of those imaginary blackeyes, you think? ) This is something that got way out of hand and mistakes were made by both Zimmerman and Martin (Actually, it amazes me how you can say that TM made mistakes as well as GZ; was he suppose to NOT defend himself? Do you even know why he defended himself or are you only concerned with what GZ has to say because he is so honest you know. Both he and his honest wife on recorded call discussing their loot, but get in court and amazingly forget about that loot, after being asked about their funds. Oh, yeah, that was another mistake by GZ; please. See reality as it is!).

But I do not see this as Zimmerman searched out a Black 17 yr old to Murder in Cold blood as Al Sharpton and his like have said ( Let me help you see. He seeks him out because he was black; why? because other blacks had been breaking in around the complex. If he were white, he would not have done that).

Al Sharpton has his own agenda and does not care one iota about Martin or his Family, this is a way to get in front of the Camera and promote hate and racism ( Although I can't stand Al, in this case, he did what was right by at least bring attention to this matter; now that that has been done, he can step back and let the justic system work. The next time one of your family members lay face down on the ground with a gun shot wound, and dead, please call me up when the police does nothing about it and I will help you fight to at least know the truth of the matter. Especially, when that family member was only walking home from the store. There is not need for him/her to end up dead).

The prosecution in this case way over reached and charged him with to high a degree of charge which the Jury WILL find him NOT GUILTY on (I will reserve judgement on that, since I do not know what jurors will do and neither do you) and then Sharpton will get on Camera and get everyone riled up and cause Riots (people don't riot because Al says to riot, they riot because they are ignorant and feel a sense of despair, it has so little to do with Al, but you will always say that because you see Al as more important than we do).

This is a sickening situation where everybody is clamering for 15 minutes of fame...but we forget...a young man is dead and another is persecuted, this is the bottom line (What is more sickening than Al, is you. You seem to be of the mindset that the only way GZ got those bruises is because he was in the right; but, you never consider that he got them because he picked on a young man that had to fight for his life. Have you ever considered that GZ may have pulled his gun and was going to hold TM there until the police came? but, because he did not identify himself, TM felt he had to fight or die? Yeah, maybe there was a struggle, a struggle to live and that my friend, is a struggle that both you and I would have, if presented with the likes of GZ.

He is a liar, a documented liar at that; he is an aggressive being, a documented one at that, but you are willing to over look all of that because of the color of GZ's skin. If GZ was black, you would not be supporting his store, at all.

But yet in all your blathering on, seems that you have tried and sentenced Zimmerman in your mind already and he's guilty as can be. And that is the problem with hypocrisy. You have no facts, you were not there, you're simply going on about matters you know nothing about, at all. The truth will come out next year and Zimmerman will be cleared of any and all charges. And thanks to that stupid AG/Judge in Florida and her pandering to the race baiters Al and Jesse and kissing their butts by OVERCHARGING Zimmerman, she has single handedly set the country up for mass rioting by heathens and thugs when the charges are dropped. What a sad thing...... She needs to be hauled in, jailed, sent to trial and sentenced harshly.

@mikeme.....You can't be serious!! The sanford (Barney Fife) police force would have swept this homicide under the rug, if the family, and activist's would not have stepped up to the plate. And as for the riots, that has ALWAYS been the biggest fear of the white populus hear in America. BLACK INSURRECTION...look it up! But I'm sure in your little demented mind, Black folks revolt, and riot bcause they been treated SO GOOD here in America huh?? Lock your windows, and doors...THE BLACK PEOPLE ARE GOING TO KILL US ALL!! Your a sick pup Mike...

And I take it you were there, MikeMe? If you're so sure that Zimmerman "will be cleared of any and all charges" after the truth comes out, then aren't you just a wee bit guilty of the hypocrisy you're accusing others of? You can't have it both ways and as I see it, you're an even bigger hypocrite because you're going on and on berating people for exactly what you're doing.

So - Zimmerman was so afraid of the threats, etc., on the outside of the jail, that he lied to stay on the outside of the jail. OK!!!!

Also - neither Zimmerman nor his attorneys have substantiated the allegations that he and his family are so threatened by people that he cannot live his life.

Finally - the Special Prosecutor is not a "faction." Nor does she represent a faction. Your client is a murderer - whether or not he is proven guilty. He is still a murder.

I have a problem with the argument that the Zimmermans had no access to the money, yet were using it for living expenses and had transferred some into their private accounts.

Zimmerman and wife don't care they just want the money that's why they were hiding it trying to move it around into different bank accounts when they got caught.

His parents did an effective job trying illustrate that their son was innocent and Trayvon was wrong. Now they want sympathy. Where was the sympathy on their part for the Martin family? Please!!!!!!!!!! This man did not provide full disclosure about his finances for his bail. No sympathy!!!! The lawyer knows Zimmerman actions has hurt his credibility and now it appears he is trying to reach out to the public with the intent of swaying potential jurors to be sympathetic to Zimmerman and his family.

He knows better his father is a Retired Judge

The Retired Judge knows better too yet look at the whole family thumbing their noses at the court system.. George and wife were drawing 2,000 a month off the Pay Pal account for household living expenses and 50,000 was used to relocate them into hiding. the Lawyer said as much.. until Judge revoked his bail Zimmerman and wife were living off the donations a third party has been set up to manage it now it will only be used for his defense. if he has no money keeping him in jail is the safest cheapest option ... I bet he thinks playing block watch cop on Martin wasn't such a great idea now. The man has destroyed a bunch of lives his not being the least of them.

With that second passport he could have easily flown to Peru where he must have some family. Joran Van Der Sloot was there and the girl he murdered didn't even know who he was. So he could have been waititng for things to calm down before he flew the coop. This guy is no angel he knows exactly how hated he is. You would think he would at least entertain this idea.

I'm glad this guy is back behind bars. He definitely needs to do some reflecting on his actions. There seems to be something wrong with him mentally. A bit slow. But he also seems to not expect consequences to his actions. I do believe he profiled Trayvon because of the remarks he made to 911 - you don't say "coons" if you aren't racist. And the "They always get away" is very telling. I hope he goes down for second degree. I think that's appropriate. But it's Florida, so . . .

He didn't say "coons". He said "the as*holes always get away." That doesn't mean he didn't profile Martin; it just means there is no evidence that he did it for racial reasons. It is like the time that W.C. Fields made a disparaging remark about a black kid on the set of a movie. He was asked if he hated blacks. His response was that he did mind blacks; he hated kids! Zimmerman seems to have had a mindset that any young male out on a rainy evening was up to no good.

        #32.1 - Tue Jun 5, 2012 2:26 PM EDT

Dale, young black men were committing crimes in Zimmerman's neighborhood. Martin was a young black male. It was racial profiling. Race had something to do with it. I am not saying Zimmerman is racist. I'm saying he had a not unjustifiable bias against young black males. I do not believe he would have called 911 for a white or Hispanic male doing what Martin was doing, nor would he have thought a white or Hispanic male's actions as "suspicious" as he thought Martin's were.

@GOT NO GRIP ; I DO KNOW one thing, however: There should now be a new police department policy as to citizens' phone calls to the police. It should be the standard department policy for police dispatchers at the onset of the phone call to ask callers reporting a suspicious person IF THE CALLER IS CARRYING A GUN or FOLLOWING THE SUSPICIOUS PERSON.

@GOT NO GRIP ; If the dispatcher knows the caller is FOLLOWING the suspicious person, the dispatcher immediately can tell the caller NOT TO FOLLOW especially if the caller has a gun. A call to the police implies the caller wants the police to handle things. (Although, if it is a different kind of situation, the dispatcher will "walk" the caller through how to handle things before help arrives.)

                                    @MIKE ;

If the prosecution's narrative is the same as mine, that Zimmie assaulted Trayvon first, what do you think Trayvon's natural response would be, since he has a hand with skittles and a nice hard can of Iced Tea?

Don't you think the most natural response in the world would be to crack Zimmie upside the noggin with the can of ice tea?

I wonder where the can of tea is, and if forensics can do anything to prove or disprove this since the can was out in the rain.

Is the can dented? Bloody, Zimmie DNA on it? Where's the can?

Yup -I think the evidence so far makes it likely that ole Zimmie got his scratches from getting whupped with a can of Arizona Iced Tea -all that headbanging sidewalk stuff is disproved by witness accounts. So how'd Zimmie's head get scratched?

MikeMe, Angela Corey is one very tough prosecutor. She will use every trick up her sleeve to get Zimmerman convicted of something. From the evidence which I have read, she appears to have a very weak case. It is not uncommon for a hotshot prosecutor with a weak case to overcharge. The hope is that the defendant will be so concerned about the possibility of 20 years in prison that they may even plead to something when they are innocent. Zimmerman fits the model of a defendant who just might do that. (Of course, he also might be very guilty.)

I hate to agree with the pro-lynching crowd on anything, but Zimmerman has made many stupid decisions. First, he's doing neighborhood watch at night. Where is his flashlight? Second, the moment he lost sight of Martin, he should have immediately stopped and returned to his SUV. He should have told the police dispatcher he was concerned for his safety and kept her on the line. Third, Zimmerman allowed himself to be taken into custody and questioned for hours without invoking his right to an attorney! Fourth, he had weeks to find the correct attorney and now he is on his second one. (It could be that he has a trust issue, but only stupid people don't tell their attorney everything.) Finally, I would never have waived my right to a speedy trial. Win, lose, or draw, I would have wanted this circus to end.

Mikeme.... I see you have absolutley no formal knowledge of the criminal justice system in the US other than television shows. Over charging is a very common tactic used by prosecutors, as a psychological tactic against a defendant, especially when they have a very weak-minded one like Mr. Zimmerman. They encourage and increase the probability that defendants will make mental mistakes because they loose thier ability to rationalize (all they see is a long prison sentence) and they panic. Mr. Zimmerman has not made a single rational decision since leaving his car the evening he killed Mr. Zimmerman. His multiple lies to his attorney and court during the bond hearing are because of the over zeleous 2nd degree Murder charge, and he fell for it hook-line- & sinker. Wait till he sits in a jail cell for 6-8 momths, he'll be begging for a plea deal.

I think everyone will be happy with a plea deal at this point. Casey Anthony should have and OJ too. If George thinks he can beat the charge then by all means go right ahead and try too. I don't think Angela over charged tho. She did what she was asked to do and that was her job. A manslaughter charge was plain as day. But reenacting the event and gowing through all the evidence she saw enough warranted for a 2nd degree charge. Maybe it has to do with George's character and whole demeanor or maybe he did confess in the multiple statements he has given and maybe he did contradict himself a number of times.

This case is very different from the Anthony case because her credibility didn't prove she murder her kid. This case has everything to do with the credibility of George.

Shouldn't a laywer be working to keep you OUT of jail as much as possible? I smell a laywer about to bail (pardon the pun). I'm sure he'll submit a bill for services rendered though...

Victims my ass, had zimmerman stayed in his car after being instructed too. He knew about the PayPal account an made a with drawl of over $20,000.00 to stay safe. I don't believe his parents had to move, an if so it's zimmermans fault. Let the judge have his way the next time.!!! "NO BAIL"...!!!

Zim may be safer in the jail since the government will not protect him outside the jail. It is sad that the negros are allowed to make terrorist threats to kill him and his family. America needs to take note of how the Dems and Obama run this country.

I can't be to mad at Obama. Obama is doing a good job of killing the raghead terrorist in Afganistan. He needs to drone some of the terrorist here.

Well Dave it just so happens George is broke and needs a place to hide out. Why don't you invite him to come stay with you.. in your parents basement !! You can watch him do things like sit on his butt all day, gain 50 or 60 lbs and leave a permanent GZ butt crack sweat stain on your pull out sofa bed! You can sell it on E-Bay after his trial and make enough to get a place of your own.. maybe. Hey it's not a ticker tape parade .. but neither is your parent's basement .
