Nidal Hasan is seen at the Bell County Jail near Fort Hood, Texas, in November.
The judge in the trial of Fort Hood shooter Nidal Hasan delayed pre-trial motions Friday when he ruled the defendant to be in violation of the Army's grooming standards.
Hasan showed up for the half-day administrative hearing sporting a beard, which military prosecutors said was a violation of Army regulation 670-1 and court-martial rule 804(4)(1). Judge Col. Gregory Gross then went on record saying that Hasan's beard was a disruption to the proceedings.
"It is a disruption. The judge felt it was," Fort Hood media officer Chris Haug told msnbc.com. "He's in violation of the Army's dress and grooming standards,"
Army regulation 670-1 dictates the appearance of Army uniforms, while court-martial rule 804(4)(1) states the accused shall be attired in dress or uniform as prescribed by a military judge.
"He's an active-duty soldier and should be in full uniform and clean shaven. That's what all active-duty soldiers are supposed to do," Haug said.
It was the first time Hasan has shown up in court with a beard.
According to Army rules, all males must be clean shaven when in uniform or civilian clothes while on duty.

The defense indicated it would file a request for exception to the policy for religious accommodation for Hasan, an American-born Muslim, to the Department of the Army. There was no indication how long it would take for a decision to be made on such a request.
The pre-trial motions will resume when Hasan adheres to the Army regulation or when a closed-circuit feed can be set up for him to observe the trial from a different location, the military said. A location has not been determined should the closed-circuit option be needed.
The motions scheduled for Friday included a request for further continuance, resolution of discovery matters and whether the accused should receive the services of an expert neurologist at government expense. It was unclear when the motions would be addressed.
Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder. If convicted, he could face life without parole or the death penalty.
Eight soldiers and five civilians were killed in the Nov. 5, 2009, attack on the Army base in Texas. Hasan was wounded and paralyzed from the chest down before being captured.

Wheel him out of the court room with instructions that he has 15 minutes to shave or the guards will dry shave his mug. Problem solved.
f-uck a courtroom. take him out and let the relatives of the troops have him
Execution by firing squad, nothing less.
Bassai... you and I don't often disagree, but personally, forget the trial.... it's a formality anyway. Execute him now and try the corpse..... it's all he deserves.
A question for those of you who advocate extra-judicial and immediate violence and execution of the accused.
Do you differentiate yourselves and your personal characters from the accused?
Ad if so, on what basis do you consider yourselves different if we are to judge you based upon your own words?
An extremist is an extremist, and your words betray your character.
Who the hell let him be wheeled out of his cell unshaven.
Is he not under guard and under medical care that is at least supervised by military personnel? Is he not partially paralyzed? I can't believe his keepers couldn't hold him down and scrape his face before his court date!
What wusses!
This guy should have been beheaded on the spot, and his head placed on a pike at the main gait to Fort Hood. Treating these less than human, murdering, thugs like they deserve a trial is a waste of time. Shave him?! Hell, put the beard in a wheelchair and wheel it in but leave the rest of him for the dogs and the buzzard to consume outside.
What I want to know is why the hell is did it take this long to come to trial? This is ridiculous. 2 1/2 years?
To all the imbecilic moronic thoughts that merely add to a lower than creature intellect persona, making such comments to "bow up" and bark your self-serving thoughts as if howling at the moon? No one, no one is owed a judgement in court and the execution of sentence without a fair trial. The more fair the trial, the more emphatic the punishment and the more righteously the sentence can be carried out.
If our judiciary departments and officers were more righteous, more genuinely qualified to occupy these seats, the less we would need ridiculous laws that allow criminals to continue their pleas and appeals lasting 20 years after sentencing, or insane measures that produce such aggravating delays as this.
As some people here who possess above average intelligence have stated, in comparison to some of the idiotic throat warbling of "Hang him without a trial", it was the guard on duty ignoring protocol that allowed the inmate to be presented to a military court without being in dress. Maybe his attorneys wrangled the affair to cause such a disturbance in the calendar of events concerning the trial. In any case, the people to blame need reprimanded and punished.
We all are supposedly granted fair treatment, and a fair trial with sentencing even though some may be guilty of inhumane treatment of their victims, in order to protect the innocent and to prevent the constant continuous abusive, oppressive actions of incompetent judiciary and incarceration personnel or worse the monstrous treatment by those improperly running the very judicial system which tends to be far more threatening to us than the criminals could ever be.
It's silly to delay the process b/c of that. He knows he's getting convicted and will get the death penalty, so obviously he'll do whatever he can to drag things out and delay the day of reckoning.
All the judge did here was play into his hands - smart thing would've been to continue the proceedings while imposing some kind of penalty for contempt of court or whatever.
djdrew, take your arrogant attitude and..well, don't have to say it. This guy is guilty, what will a fair trial prove? That he was justified?
I do agree that the judge played into his hands. Get the trial over with so that justice may be served!

REPLY: No, Linda. What a fair trial will prove is what every fair trial in America reiterates: That the United States of America is a nation of laws, and that we believe in a duly codified system of justice in which an accused -- every accused, no matter how heinous the crime -- is granted the presumption of innocence.
What a fair trial for Hasan will prove, will illustrate to others like him, is that the people of the United States of America will not abandon our ideals and the guarantees of equal protection which we hold dear because of the actions of a terrorist.
If you take a moment to think about what terrorism seeks to accomplish in America, the very best defense we have in opposing it is steadfast and unwavering adherence to our own laws and ideals.
Robert,, stay in Oregon. Saying a thing is much different from doing a thing. This animal needs to be euthanized. Yes he has a right to a trial, yes it's the American way and in reality we all believe it is the right thing. Also as Americans we have the right to voice our outrage on behalf of the victims and their familes.
Oh and Robert, check the Childcare RCW and Licensing regulations in almost every state Licensed Childcare Providers are stripped of the right to be innocent until proven guilty, the right to remain silent, the right to privacy in their home and business. The list of abrogaions to the Constitutional Rights of American Citizens goes on and on. You sir live in a fools paradise
REPLY: And you sir, judging only from your own words, the views and opinions you espouse, live in the wrong country.
Your code of justice is very much attuned to the world that Hasan reveres and the jihad he follows. Food for thought in considering what sort of person YOU wish to be.
I, on the other hand revere the United States of America, and our American code of justice (warts and all). If that makes me a "fool", I shall wear the moniker proudly and with my head held high. God bless America and the American right to a fair trial.
I disagree. This man needs to be tried as an American soldier, not an Islamist militant, as the beard would suggest. The judge did the right thing.
The judge is doing his best to prevent a mistrial, allowing the trial to proceed would have biased the court-martial panel against him. Let the facts do that, not appearances. At the en of the day this is America, if we insist on invading other countries because tehy execute and jail with out trial then we should surely do our best to avoid the same.
Why is the judge nitpicking? Try him, sentence him and shoot him.
Remove everything from the neck up, problem solved.
Would have to agree. The man murdered 13 people in cold blood, who cares about his facial hair?
Lyrica, this isn't about facial hair. This is about Military Standards.
He's on trial for murder, so I'm guessing grooming standards aren't causing him much concern. Ounces don't mean much when you're dealing in tons.
That is why I said have the guards dry shave him if he won't shave. I think he will start to care after that.
The artist's sketches, not shown here, show a full-blown beard. Guess he wants to express his 'religious' freedoms by looking like a terrorist, which he is.
You think he didn't grow this beard on purpose to throw it back into the military judge's face... he is using his cult's corrupt ways to delay justice... he should not become another burden on us taxpayers...
In his case, I hope there isn't any jail time and only firing squad... though spend the bullets after giving him a bath in pig's blood and guts... then shoot him... 10 bullets would cost, what $10...
For the military: I hope you keep better watch on these POS muslims/islamist cultists you have in your service... obviously you cannot trust them all - this guy wasn't an enlisted man, he was an officer for criss sake...
Death would be too good for him, but Leavenworth's prison farm does have lots of hogs that need to be slopped.
Amen...a firing squad and get rid of this muslim scum bag. And yes, it's way, way past time to get rid of every muslim in the service, there is not a single believer in islam that could ever be trusted.
Yes Jack, Yes Pete, lets the right solution is obviously to throw out every single person who associates with Islam in any way. People obviously have to earn the right to die for you, to protect your freedom to insult them as people and further their religion.
If some one desires to serve than the should be able to serve. The whole freedom of religion thing that allows you to worship whoever you want also allows the same for all Muslims. One bad apple does not mean you should automatically assume that all of the Muslims in the United State's armed forces are evil and should not be trusted. I guarantee that there are plenty of Muslim's out there with much higher security clearances than either of you will eve hopefully have.
Yes, TexAg2013, and Hasan had top security clearances and what good did that do ? What good did security clearances do in respect of the killers that have killed various military members in Afghanistan, such as the CIA team ? Muslims follows the koran, and the koran instructs them to take over the world and kill those who won't join their evil cult, so how can and why should we trust any of them ?
When we were at war with Japan, we interred the japanese. I do not agree with that course of action these days, but I do say that it is reckless and downright stupid to be employing muslims in the military, carrying and accessing weapons, at a time when we are fighting muslim extremists. Sure, use them undercover but ensure that they are kept under close supervision, searched regularly, and above all, maintain on-going security checks and not just as pre-employment checks. This hasan guy should never have been allowed to have continued in his position while it was known that he was consorting with extremists killers.
So after all this time, almost 3 years now, this is the first time we hear about this murdering terrorist and it's because he hasn't maintained his military grooming standards. He's in custody, military custody I'm assuming and those in charge DID NOT think he might need to shave??? Shame on them as well!!! Their fellow soldiers and Americans were murdered by this @!$%#, you'd think they would want a swift trial sooner than later.
Air Force Vet
He's already a burden on us taxpayers- he's paralyzed-lots of extra care in that. If no firing squad then we will be giving him lots of care for a long time. They shouldn't hold him to military dress standards any longer-let him look like what he is- a radical and/or psycho.
I hate it when they can't even caption the pictures correctly. Bell County jail is not in San Antonio, which is Bexar County. It is in Belton, TX which is close to Ft. Hood, where the incident occured.
North of Bexar (San Antonio) you have Comal (New Braunfels), Hays (San Marcos), Travis (Austin), Williamson (Round Rock, George Town) counties, there's another I think before you get to Bell County. That's a funny and astute comment. San Antonio isn't even the nearest City.
Okay, I'll make this simple for the military. Haul him into court, read the charges, find him guilty, sentence him, carry out the sentence. Couldn't take more than 15 minutes. What's the holdup?
only hold up would be going through the long line of volunteers to pull the triggers
beard, no beard, it wont even slow down a bullet to the noggin of this P.O S, shoot him and be done with it already, or send his a&& to Gitmo withthe rest of the bearded clowns and let him rot
This shows the pettiness of the government agencies. Delay prosecuting a mass murderer because his grooming is not to standard issue.
Well, he is reverting to his roots. His radical jihadist roots. He is no more a 'soldier' than a maggot is a soldier. He is a terrorist, why is he not treated as a terrorist? Why did Obama call the crimes he committed 'workplace violence' rather than stating the truth which is he commited an act(s) of horrific terrorism.
I imagine the families of his victims are thrilled to realize that their loved ones were victims of 'workplace violence' and are also reassured that his 'religious' freedoms will be met.
I have little mercy for Hasan. It's pretty apparent that he did what he did. It's about time America quit pussy footing around with extreme radical Islamists. Convict him, sentence him, and carry out the death sentence on him. It's about time America stepped up to the plate.
Would the Muslim world do less to us ?
he should be sporting a noose...and i for one don't want to see him or that POS manning in a uniform of any kind...unless it is a govt issued body bag...don't even send them to gitmo because they don't deserve a high priced soccer field, cable and resume writing classes
Has this murdering traitor not yet been EXECUTED?
What a piece of chit. He was growing the beard all this time and his keepers thought nothing of dealing it before it became in issue? Sometimes the government bureaucracy borders on the stupid. Nothing but delays to protect his rights. He needs to be smothered in his sleep, problem solved....
kill the f-ucker. forget a trial
Cover his head with a paper bag with a bullseye drawn on it, get the trial over with.
To all you guys who are clammoring for this POS execution, wouldn't LIFE in prision be more fitting? Seems like death would be too easy for this fuc$er,and that life would really, really suck alot worse.
Maybe that's just my sadistic side comming out.
This is delay tactics by the government to avoid the inevitable verdict of guilty because they don't want to pass the only justifiable sentence that is acceptable to the American people and the rest of military personnel... guilty, death.
Anything else will completely demoralize our fighting force and the political leaders who run the military now don't have the balls to stand up to the Muslim community when it is clearly warranted to give a death sentence to a traitor and killer. Well, they keep saying they are "American" and when an American soldier kills his fellow soldiers on military ground it is treason. And treason calls for a death sentence.
No... they want to let him KNOW who's in charge and it isn't him. He'll shave himself or be dry shaved by the guards.
We'll see. Three years and he isn't dead yet for either mass murder or treason. And the reason he isn't is because he is a Muslim. It's the only reason.
He will not be executed. He will get life and will regurgitate his visage and his crime on our consciousness periodically for the next few decades as he demands special privileges based on his foul concept of his religion.
If he were a WASP, he'd already be fouling the earth!
His ultimate judgement day will come. What all you posters fail to recognize in the "war on terror" is that the US and our allies are defining what is terrorism and what is fair in a time of war. It doesn't take a ton of empathy to realize that the "terrorists" believe that they are fighting a war.
Right or wrong, brainwashed or true believers, PEOPLE who want to continue the "war against imperial America" will continue their fight.
Bush squandered an enormous opportunity after the Sep. 11, 2001 attacks. At that time, most of the world supported the USA.
Had we spent trillions of dollars educating, feeding, and healing, the American way would have been embraced. Instead we have wasted trillions of dollars invading, destroying, disarming, rebuilding, rearming, and withdrawing.
The only winner in this war has been Cheney and his military industrial complex buddies. I guess Al-Quaeda was also victorious when you consider the economic collapse and loss of freedoms (TSA & Patriot Act,) since 9/11/01.
My prayers go to all the victims of these stooipd wars - those in uniform and civilians.
Would you please wake up and face reality. Obama went out of his way to reconcile with Muslims and promoted constructive dialogues with Muslim Brotherhood; the result was letting radical Islam takes over Tunisia, Egypt, and Libya, and it is working its way through Syria, Jordan, Yemen, and the rest of the Muslim world. So if "we spent trillions of dollars educating, feeding, and healing, the American way," these liars would have taken our money and used it to propagate their twisted faith. Is that what you want?
Who are we to dictate what faith they should propagate? We are not inherently a Christian nation and the government is forbidden from pushing any religion in place of another.
That said, ideally, we would not have set our selves up as targets in the first place, we would have fallen back to our borders after the Soviets fell and secured ourselves at home with out a huge standing military and trillions in debt. Instead, we force our selves out there and set ourselves up to be hit over and over again. When was the last time you heard about a country minding its own business being hit out of no where.
The Muslim Brotherhood plan as stated by Hassan El Banna, who established it in 1928, was to spread their sect through the World, starting with individuals then families then communities, countries until it takes over the whole world and converted it (or as some Muslims like to say reverted it) to Islam. These goals were restated more than once and until today by MB leaders in countries such as Egypt.
You may think that all religions have similar goals, but the real difference is that in Islam they consider spreading their faith the ultimate Jihad, and they are allowed to use force to spread their faith in any county that try to limit their freedom to proselytize.
Al Qaeda, Nidal and most of radical Muslim groups are either spin-offs from Muslim Brotherhood, or espouse beliefs of similar nature.
So before you blame the West, learn more about Islamist's goals, here's some information, and even if you don't read the article you can see a picture of their slogan; a Koran and two crossed swords; or as they have always said "A BOOK AND A SWORD"
http://en.wikipedia.org/wiki/Muslim_Brotherhood
Would you like to explain what the difference is between Christianity's evangelism is compared to your version of Islams spreading, cause honestly both religions have similar goals. Islam makes up 21% of the world population so if it is truly as violent as you claim then the world would be a different place. Further, conversion by the sword does not count in Islam, that is why if a Muslim's life was ever threatened on the basis of conversion they could freely convert and it would not be a sin.
If you really want to play the you know nothing so your opinion is not valid game that is fine but maybe you should give people more credit than that an consider the fact that you are looking at a small subsect of a major religion, not the religion at a whole before you hate on it. The entire basis of Islam is submission to the will of god so its hard to find a fundamental problem with that.
The difference is that Islam was from the beginning spread by the sword, and what is happening today is that radical Muslims are going back to their roots and resuming their Jihad to spread their religion by the sword; examples abound from Indonesia to Nigeria, to Egypt. Even as a minority, they use the same vicious tactics in the West, including the subject of this article.
Now you may say that Christianity was spread by the sword, but this started to happen much later after the first few centuries, and today no Christian Church advocates using the sword to force the conversion of non-Christians.
Speaking of a small set, today we have about 15% of the Muslim World who is radicalized, so if you consider about 200 millions Muslims to be a small set, that's your choice.
TexAg, just to let you hear about what this small group of Muslims are doing on a daily basis, here's today's atrocity.

TexAg; and when it comes to violence, Muslims are equal opportunity trouble makers.

He needs to be DRT
The son of a whore should be sporting a noose.
Execution is this guys dream, this is what he wanted when he started shooting people, to go out in a blaze of glory. He believes Allah would have been there greeting him himself with all his afterlife prizes. Now he is paralyzed from the chest down with nothing to do but rot in a cell for the rest of his life. I say don't kill him, he wants this more than you. Let him rot. Let him spend the rest of his miserable life staring at the ceiling, walls and floor of his cell praying for Allah to rescue him.
Better yet, give him a TV that only plays the 700 Club. HAHAHA
Now, now. Wouldn't that be considered cruel and unusual punishment?...lol...
He will be so mad when he finds out the promised 76 'virgins' are either goats or sheep not human females.
there were no rules that stopped the killings why are there rules stopping justice being served, what a wast of time. military justice, is really an oxymoron, what a weak judge
Let's dry shave him with a chainsaw...
And the Obama administration refers to this terror attack as "workplace violence." http://townhall.com/tipsheet/katiepavlich/2011/12/07/ft_hood_shooting_classified_as_work_place_violence
You can't make this sh i t up.
