Jerry Sandusky's lawyers failed to blow holes in the testimony Tuesday of former Penn State assistant football coach Michael McQueary, allowing prosecutors to score a big win in their child sexual abuse case.
Beginning with its opening statement, the defense has tried to demonstrate that the alleged victims have been coached to implicate Sandusky and have financial motives to make up their stories.
McQueary powerfully undermined that theory Tuesday. If he saw Sandusky in the shower with a young boy in a compromising position — and the jury will not doubt that he did after his testimony — then it seems much less likely that the young men were motivated by greed or prosecutorial influence.
But the defense missed several easier opportunities to show problems with McQueary's account.

Rather than zero in on significant discrepancies in McQueary's accounts of when the incident occurred — given in previous testimony before a grand jury and in a hearing in December — the defense started off with a weak point: that McQueary previously claimed to have seen Sandusky and the boy in the shower two times rather than the three he described Tuesday — once in a mirror, again directly and a third time after he slammed a locker door to make it known that they were being observed.
Sandusky's lawyers also failed to confront McQueary about his reluctance to intervene in the situation.
McQueary has said he did not ask Sandusky what was going on and did not call the police the night of the incident. McQueary, in fact, volunteered the fact that he did not physically intervene during his cross-examination Tuesday, but the defense seemed almost oblivious to the gift McQueary handed them amid the devastating answers he provided to their other questions.
When Sandusky's lawyers did get around to asking McQueary about the inconsistent dates he has offered in the past, their pattern of questions allowed him to give an easy explanation.
Rather than confront McQueary directly with his testimony at a preliminary hearing during which he expressed absolute certainty about the date, the defense simply asked about his prior testimony in general. That let McQueary remind jurors that in interviews, he has also expressed uncertainty about whether the events occurred in 2001 or 2002 and declare that he did not dispute the prosecution's timeline of events.
Perhaps most seriously, the defense failed to establish that McQueary could not have seen the most serious crimes he believes he saw because of the relative height of Sandusky and the young man he saw in the Penn State shower.
At a hearing in December involving perjury charges against former Penn State athletic director Tim Curley and former senior vice president Gary Schultz, different lawyers skillfully pointed out that McQueary could not have seen any sex unless Sandusky had been holding the boy in the air.
The failure of Sandusky's lawyers to address that testimony may lead the jury to conclude that Sandusky did engage in sex with the young man — even though at the end of the Curley-Schultz hearing, it seemed clear that McQueary's testimony was insufficient to prove that any sex occurred.
Finally, the defense was unprepared for McQueary's cross-examination. Apparently expecting him to say yes, defense lawyer Karl Rominger asked McQueary whether he had played in a golf tournament run by Sandusky's foundation after having witnessed the alleged shower ecounter. But McQueary said he did not play, and Rominger was not ready with documentation to challenge him.
McQueary's account Tuesday had real problems, but it was not effectively challenged, and his testimony ended up being a slam dunk for the prosecution.

Prosecute this case to the fullest extant of the law Mr. Prosecutor. Don't let up for a minute. Get this guy locked up for the rest of his natural life. Do it slow, rub it in hard so Jerry Sandusky has to suffer every painful human emotion known to man. Do it so there is no excuse for appeal and that justice will prevail for the victims and their families.
Why do they say they were engaging in sex. No. Just no. Sandusky was sodomizing the young boy. Sandusky is such a vile person.
Hmmm... All of us need to remember the basic premise - Mr. Sandusky is totally innocent, until proved guilty by a jury of his peers.
However, having said that, it is possible to examine some of the testimony so far. After doing that, one must conclude that it looks and sounds like Mr. Sandusky is a serial pedophile - no ifs ands, or butts about it.
I am not a psychic, but stay tuned for a mistrial in this case. Something is bound to happen that will cause the judge to declare a mistrial, necessitating the retrial, new jury, etc.
Upon conviction, one would hope the judge will sentence Mr. Sandusky to 50 years in prison, without any early release. That should make society safe, while Mr. Sandusky learns new rules of behavior behind bars.
Agreed Whistle. It sounds like the defense team has no real defense and is intentionally throwing the case. Desperate and unethical move, but Sandusky's only chance to stay out of prison is to shoot for a mistrial. I hope this strategy backfires.
In cases of rape and murder, especially when the victim is a child or several children, there should be no plea deals or out-of-court settlements. I felt that was wrong in the Michael Jackson case. I would never have settled for money and let a child rapist go free to rape more children if I believed that person raped my child! They need to go to jail and never be released upon society ever again! But the wealthy live by other laws than the rest of us!!!
I am sorry but on this guy's testimony I would not believe a word he says. Now he has to go through with it but there are too many different stories he has come up with. I have no idea how it even got into the trial. There are no witnesses who also observed the alleged incident. As far as perves of this nature they usually do not perform their nasty business in such a public place. This guy now says he saw this go on 3 times and that is a real blow to the integrety of his testimony. Paterno said when this guy called him the first thing Paterno said was no he did not have a job for him. That rang a bell and may be why Paterno gave the info to a superior and went on about his business. There will probably be enough testimony to convict this guy but it should never be on this.
I am far from knowledgeable when it comes to law, but it seems as though the defense is doing a 'halfassed' job. What if the defense lawyers are pulling some trick, and are intentionally giving a poor defense, so that Sandusky can later argue for a mistrial? Can they do that? Again, i am no legal expert and was just curious...
The defense was not slack. They are among the very best defense attorneys. Pushing McQueary hard would have reduced him to tears. They couldn't have that.
We all know why McQueary failed to physically intervene on the child's behalf. Sandusky had a close relationship to a most revered coach. Sandusky had enormous influence, power and wealth. Sandusky could have easily persuaded the parents to pressure the boy to deny everything McQueary witnessed. McQueary acted out of self-preservation in an impossible situation.
I'm sure we would all like to think we would have rescued the boy and punched Sandusky senseless. I'm also equally certain that we would have been painted as a villain seeking to destroy the reputation of a very valued and trusted pillar of the community. McQueary faced certain destruction of his career and family name versus abandoning a child ( in the boy's greatest hour of need ) to survive long enough to stop this monster from hurting another child ever again.
I pray that none of us ever have to make such a decision. This poor man will carry the image of the horror he witnessed that day to his grave. Knowing that many of us condemn his decision must make every day of this trial a living hell for him. I hope he also knows that many of us appreciate his predicament and fully support him. The actions(or lack of actions) by very clever defense attorneys prove that he did the only thing possible to stop this evil creature forever. God bless him.
A question. If his account had "real problems", how is it a "slam dunk"? Biased much? Sigh. I wish they'd do a better job reporting than trying to control public opinion. Sandusky is innocent until proven guilty, and if the account given has glaring, large holes in it, then it's not a slam dunk. It's lying. He's trying to save his own arse, or drive Sandusky into a plea deal. Even then, I doubt they even need his account. At this point, Sandusky will likely end up guilty no matter what, and it won't be from evidence or witness testimony. It'll be from the people who, Day 1, were already calling for his head.
Then again, this is American justice. Less justice, more finger pointing and Salem-style Witch Hunts. This emotion-charged, knee-jerking has really got to stop. That said, if he did do it... let him burn from his own stupidity. Also Commonsense... really? Horror? Horror is the scene of a battlefield. Horror is a massive car accident on a highway. Horror is walking into a Wal-Mart late at night. By the way you're imagining it, there's creepy carnival music playing in the back, everything's grayed out, and Sandusky is probably wearing a Hitler mask, when really, you would have seen something that was roughly the same thing you could see on the Discovery Channel. I'm not saying what hes accused of doing isn't disgusting, but seriously... it's thoughts and overaggeration like that which will cause a mistrial, or force a plea deal rather than seeing any justice here. Chill out, keep a cool head, take in all the evidence without bias, and try not to let your emotions control you. That's how the system works best, and the last time something like this happened, it was with Michael Jackson. They made his life Hell, and it was only after his death that his accusers started stepping forward saying mommy and daddy were the ones that made them do it. I've been on the Internet for 12+ years now. I know what terror is, and it's about as close as a visit to Youtube or a trip to certain image boards. I don't think what Sandusky did measures up to a war that swallowed our country whole from the inside, causing thousands upon thousands of people to die.
I'm sorry, I just don't see what Sandusky did as being anywhere close to as horrible as the bombing of Hiroshima. Last I checked, the potential victims of Sandusky still had their skin. Children that survived Hiroshima don't exactly have that luxury, and you demean the horror of what happened to them to further your own opinions.
Besides, by what I've seen in our glorious country, it's better to be a pretty young woman accused of murdering your infant with overwhelming evidence against you than to be an old man accused of sticking it in the poop chute of a few boys with no evidence whatsoever. This is the same attorney who allowed his client to do a live interview with Bob Costas - one in which he left no doubt that he was a child molester !!! Is anybody surprised how terribly he would be prepared to handle this case? As I read the article that's the first thing that popped into my mind; that he's deliberately doing a crappy job to lay the groundwork for the appeals courts. Personally, I hope he never sees the light of day again. The Costas interview erased all doubts for me.
Elizabeth-2017812, I think appeals courts grant retrials for incompetence of counsel only if it affected the verdict. By the time the prosecution gets finished here, I don't think there will be a shadow of a doubt that Sandusky is guilty as charged, whether he had the best or worst of attorneys.
Maybe he's being inept on purpose? Take Jerry's money and f##k up his case just enough to guarantee a prosecution victory but good enough to beat an incompetent counsel claim. Perhaps his lawyer's a genius.
Sandusky has 2 alleged lawyers, Amendola and Rominger, a/k/a dumb and dumber. Rominger is a publicity whore without the courtroom chops to actually cross examine anyone with an IQ higher than a bag of hammers and Amendola seems to actually be working for the prosecution to help convict Sandusky. Neither of these guys will be writing any books about their malpractice in this case.
Not that I am on Sandusky's side, but honestly his attorneys are obviously and purposefully providing an inadequate defense, therefore tainting the entire process, which denys the accused due process. It could lead to mistrial. They should be disbarred.

so if this assistant coach said that he saw this older man having intercourse with a child or a younger man(mind you it wasn't once but three times) why didn't he intervene to stop it? and when he didn't stop it at least call the police?

@nevets: do you think the police would have arrived in time to witness anything? Especially if it was coming from the university showers? If the child couldn't scream out while it was happening, do you think he would have pointed a finger at Sandusky right after the abuse? As disgusting as this was, I can think of about 30 reasons NOT to call the police.
Nevets, colleges have a way of shutting up those that complain or show the "old gal" warts and all. The assistant was a very low assistant and the other witness was a janitor. Not exactly positions where one can survive doing what is right when it hurts the reputation of the school and exposes them to lawsuits. Whistle blowers are usually the ones that get screwed. Just like the Catholic Church and other wealthy organizations and people they have a way of just making problems "go away". For years colleges were able to cover up on campus crime and hide the truth. Until this day they still can to a lesser extent. The real question was and is why didn't Joe PA. take the assistant coach to the State College PA. police when he was told what the assistant and janitor saw. Penn State would have never done anything to the assistant or the janitor if Joe PA. had provided a shield for them. Even he felt the need to buck it up through the college administration.
Most people who work for these institutions are bound not to do what you jsut said outside of the normal chain of command. Anything that has to do with the police and an employee has to be handled by administration. That's how they keep "the good name of the school" alive and well. They are skating around on thin ice because of hitting Alum donations and outside grants and other money thing. Tough to say sometimes it gets in the way of doing what should be done. Knowing this for a fact I know its wrong but so are a lot of other things. In this case since we have heard rumor was he was a perv before may have made some think nothing of it. Also you have to look at the fact the prosecutor refused to indict him once....

And we all know how easily swayed and stupid juries can be. Analysis indeed. Let's wait and see what this jury decides. There have been other "slam dunk" cases that didn't pan out quite like everyone had expected, need I site examples? I hope Sandusky swings, but crazier things have happened in our lousy, tainted, corrupt jurisprudence system. I bet he walks, pleads insanity, or gets a federal rap for crossing state lines, thereby giving him a "walk in the park" sentence in a federal prison.

sam this is not a humorus topic, and I don't see anybody defending Sandusky's actions. Perhaps it the general public's lack of knowledge about exactly how the judicial system works that leads someone to be confused to the point that Sandusky is being defended. Lets try to clear some things up.
In the USA, the accused is presumed innocent until proven guilty. Guilt is not determined by the media, the police, or your neighbor. Guilt is determined by a jury except in cases where a defendant waives his right to trial by jury, then guilt is determined by the presiding judge.
In the USA, the accused has civil rights, which include due process. He/she has a right to an attorney and to a fair trial. This may not be popular as our society (who used to have rational thought ) now has "witch hunt" mentality. Nevertheless, civil rights are there for everybodys protection.
In the USA, if convicted of a felony has the right to appeal decision to a higher court. Appeals are granted on many grounds.
Translation: Like it or not Sandusky is at this point still innocent until proven guilty and entitled to a vigorus defense. If his civil rights are shown to be violated at trial level, it may lead to any convictions to be reversed on the appellate level, or in a mistrial. The conduct of his attorney is a gross miscarriage of justice. Just as Sandusky is entitled to a fair trial, so is the prosecution. These attys are making a mockery of the system. They should be brought up on charges and be disbarred.

Sandusky won't be sexually abused in prison. Bubba likes them young, but not quite as young as Sandusky likes them. Sandusky's money and powerful friends will likely buy him protective custody for awhile. A guard, who may be the father of a young boy, will likely become temporarily distracted as Sandusky's prison justice will be met at the end of a "shiv", not a penis.
I admit that my sense of justice does not meet with state or federal "correctional" facilities. I disagree with most of my fellow Americans. I don't condone a prison that fails to protect it's inmates. Caging even a dangerous animal without protecting it from predators is inhumane. Sandusky should face natural death after years behind bars to fully contemplate his evil deeds. Death, for most evil men is preferable to life-long imprisonment. Men like Hitler and suicide watches for convicted killers come to mind.
He will become a trophy, for any inmate who can liquidate him.
I can't believe that NBC would post this at all. It's a "How To" guide for trying to take apart the testimony of a man who reported the worst acts committed in sports history. It tells the public not to come forward when they see things like this, because they'll be destroyed in the media.

I've heard several discuss the 'position' and impossibilities....It may be that the defense already knows the position and would prefer not to have the jurors hear the details.
Lets see, the redhead said he heard flesh slapping on flesh, saw a grown man and a boy together like white on rice and the author thinks that could have been blunted and undercut by some discrepancy on times, a tournament and some other minor difference. No way José. Juries are not stupid, and nobody ever remembers things perfectly. Any nibbling at the edge of this thing would never sully the central fact of sexual activity. Sandusky's goose was cooked in one day with one victim and this witness. Lock him up and throw away the key. Better put him out of the GP though.
I agree, Zankudo. Sandusky is toast, thank God. Yes, it's easy to poke minor, irrelevant holes in the testimony of someone trying to remember the exact sequence of an event from a decade ago, but it doesn't change the fact that he knew what he was seeing, and now, so does the jury and so do we.
I suppose, yes, technically, it might have been impossible for McQueary to see the actual act of penetration, but does anyone believe that Sandusky was in that shower doing a very lifelike, but entirely innocent, Hollywood-style simulation of raping a child? Who one earth would believe that?

Well, obviously, the defense is grasping at straws, but they're not even doing that in an enthusiastic way. There's not a lot of grey area here, and when you've got sexual abuse victims sobbing on the stand, you probably ain't doing your career any favors. They DID have a chance to really make McQueary uncomfortable up there though, and they didn't take it. I mean, the dude saw a kid getting raped and his immediate solution was to slam a locker door. My male friends range from redneck conservatives to hippie liberals, but I don't think there's a single one of them that wouldn't have physically ripped Sandusky to pieces right then and there.

Wow, sounds like the defense is almost sand-bagging its own client. What do the posters who think Sandusky is going to get off think of this? Thing is, the worst part is the coverup by Penn State and even the local authorities. Sandusky is just one sick individual, it happens; what is harder to understand is how he was allowed to get away with it for so long. I've wondered lately about Sandusky's behavior AFTER he was literally caught right in the act of raping a child.
That had to have been the biggest panic of his molestin' life: to get caught right in the act, let alone by somebody who knows you. So why would he then continue molesting more boys?

Mcqueary has been criticized by so many for not stopping Sandusky in the shower, he was a young man. If the police had been called, doubt that Sandusky would have admitted it Or the boy (he still hasn't, embarrassed I suppose) Mcqueary would have probably been facing assault charges with the school backing Sandusky. The janitor, who was much older was shocked when he saw Sandusky & another young boy in a sexual act but didn't report it to anyone, afraid he would lose his job. Maybe that was a Penn State policy, Don't embarrass the school. Mcqueary is the only one that did anything, he reported what he saw but nothing was ever done. He is still telling the truth & it has cost him.
So a coach walks into a locker room shower and sees a 50+ year old man and a 14 year old boy showering naked and they appear to be having some type of sexual contact. But because Sandusky is not "holding the boy up in the air" - the coach cannot see any actual penetration.
They are calling this a defense? This guy deserves to rot in prison for the rest of his life - but his lawyer's incompetence may get him off!
