Suspected Auburn shooter turns himself in to federal courthouse

The man suspected of shooting six people near Auburn University surrendered to U.S. Marshals Tuesday. Auburn Police Chief Tommy Dawson updates the press on the latest developments in the case.

 Updated at 10:54 p.m. ET: The man suspected of killing three people, including two former Auburn University football players, during a party Saturday night turned himself in Tuesday at a federal courthouse in Montgomery, Ala.

Desmonte Leonard, 22, suspected in the shooting deaths of three people at a party Saturday night, turned himself into the federal courthouse on Tuesday evening.

Desmonte Leonard, 22, is suspected of shooting six people; he has been charged with three counts of capital murder.

Leonard arrived at the U.S. federal courthouse just before 8 p.m., walked through the courthouse doors and surrendered to U.S. Marshal Art Baylor, previously the Montgomery Police chief. 


He is being held at Montgomery County jail.

He is being represented by Susan James, a defense lawyer in Montgomery, Ala., according to WSFA.com. She contacted U.S. Marshals to discuss the terms of her client’s surrender.

“I think he was just tired,” James told WSFA. “He wanted somebody to tell him what to do.”

She said the story of what happened Saturday night may be different than what most expect.  

"I wanted to make sure they could get him into custody without someone trying to take him out," she said.

Saturday through Tuesday, police homed in on Montgomery, where Leonard lives. On Monday, they surrounded a house where they believed he was and piped in tear gas. Police said they heard coughing but ultimately did not find Leonard.

Police did arrest two other men: Jeremy Thomas, 18, was questioned for hindering prosecution, the Atlanta Journal-Constitution reported, and Gabriel Thomas, 41, was arrested late Sunday for allegedly providing false information to police.

The shooting occurred before midnight on Saturday at the University Heights apartments, a large complex near campus favored by Auburn University's students and athletes. Leonard apparently fled in a white Chevrolet Caprice, which he later ditched.

When police arrived at the scene, Edward Christian, 20, was found dead on the sidewalk. Christian was a student and former offensive lineman for the Auburn Tigers football team.

Ladarious Phillips and DeMario Pitts, both 20, were transported to the hospital, where they later died. Phillips was a student and former backup fullback who gave up football in April, according to his coach. Pitts lived in Auburn.

Police Chief Tommy Dawson said at a news conference on Sunday that he believed the shooting was "a fight that obviously got out of hand."

The shooting has shaken Auburn, a city of 53,000 that revolves around the football team. The Auburn Tigers have won two national championships, most recently in 2011 against the University of Oregon. Cam Newton, a quarterback, won the coveted Heisman Trophy that year.

My old neighborhood always had someone coughing out a window - usually right after a bong hit. Damn, that was a fun block, my current residence is zombieland.

I agree with this young mans lawyer, there will be a lot of story changing now. This fellow is guilty of self defense, he was assaulted and hit in the head with a beer bottle and was probably being attacked by the others that were shot. The last guy that died was on the sidewalk in front of the apartment, which would suggest that he was pursuing the shooter. The incident occured in the rear yard by the pool.

When I first heard what happened, I believed it was self-defense as well. However, most of the reports I've read say that he left the party, then came back, blocked the exit and began shooting. Now, self-defense or not, you don't just start shooting people in a crowded area as small as a walkway from the inside of the pool area. I believe he's been arrested for carrying a firearm illegally in the past, so what's the precedent if the weapon was unregistered?

Holy S%$*@!!!! For the first 3 or 4 minutes all that guy did was thank and re-thank every single law enforcement agency in our whole country, along with it seemed every other person he knows or has ever met. WTF was he thinking? He must have written that speach prior to the man turning himself in. He must have wrote that expecting him to be caught rather than him turn himself in. I mean why else would he be thanking everybody? They didn't do a damn thing, so he should have by all rights thanked Desmonte first and formost for coming forward and doing their job for them, I mean the guy VOLUNTARILY turn himself in??? It will be interesting to hear the other side of this story. If Desmonte was the one with the gun that shot up the group at the party it seems obvious that he is guilty. But......our laws say that you are assumed not guilty until you are given a chance, in court or otherwise, to prove your innocence so it will be interesting to hear his side of the story. If he was not guilty then why did he flea the scene and hide? I will wait to comment further till I know "the rest of the story". Hopefully he will confess and straight talk and put an end to this tragedy and that Jesse, Al and others will stay away and let the police and justice system do their jobs according to our laws (not like the Trayvon case).

I don't love my guns any more than I love my screwdrivers. It's just another tool. And I believe that the "cost" of the 2nd Amendment is much less than the cost of no 2nd Amendment.

So does everyone else I know! Most of the kids I grew up with had them in their homes. I have 5. My friends have as many as a few dozen each. I think most of my coworkers own at least a handful of guns.

we love our guns. Per the 2006 FBI figures, 29000 were killed by guns. Of those only about 100 were justifiable self defense.

1000 were justifable [olice shootings, most of which wouldnt happen if the bad guys didnt have guns

Bottom line - 290 killed for every life saved. A really lousy bargain

Same eyar in England where its almost impossible to get a concealable weapon

84 killed, population adjust 5 to 1, do the math , the USA has 55x the rate of gun deaths

I have my guns. Had them for well over 40 years. They don't sneak out at night and kill people. I keep them locked up. In hunting season I provide for my family. Off season I shoot paper and clays. Funny how you convientantly left out more recent FBI reports which show a gerneral decline in murders nationwide, even after an explosion in gun sales thanks to Obama's election. The ironic part is that much of the unjustifiable gun crime occurs in urban areas with strict gun control. Stanley James, out of that 29,000 deaths 17,000 were suicides, which doesn't figure into the discussion of crime and self defense. Counting only the times a criminal is killed in self defense doesn't give you a remotely close number of times people defend themselves with guns.

Two studies in the 1990's showed there were around 2 million instances every year of stopping a criminal by having a gun. A lot of the time they just had to show they were armed to stop the criminal. The LA Times challenged that number and they could only get it down to 700,000 instances per year. Even if the number is in between, around 1.4 million instances per year, that's well over 3000 instances per day of people defending themselves with a gun.

In the 10 year period after Great Britain outlawed guns, their violent crime rate went up 84%. They have one of the highest violent crime rates out of 35 industrialized nations. Their rate is 3-4 times higher than the US.

Guns are a deterrent to violent crime.

I'm sick to death of this ongoing and going nowhere gun debate. Every single solitary time there is a shooting that results in injury and/or death, the gun advocates and the gun control advocates come out of the woodwork. Hey! Be kind. . .REWIND! People are dead and one young man is now facing at least 3 capital murder charges. In this particular case, a gun was used to kill those 3 individuals and that's not good. Why don't you people duke it out on the NRA's website and leave the human beings with an ounce of empathy to mourn the loss of young lives. Oh, and for the record, I read an article today about a father in Texas who found a house guest in the act of molesting his 4 year old daughter. Want to know how he got control of the situation and, subsequently, inadvertently killed the molester? He clocked him upside the head and to death with some random object he found lying around nearby to make sure the guy stopped molesting his young daughter. No gun, no swooping in with his firearm arsenal. . .just plain old common sense and, for better or for worse, the molester lost his life. There will be no charges filed against the self-defending father because there was no intent to kill nor was there premeditation. Chew on that for awhile, Boys!!!

Do you people understand what the 2nd amendment is all about? The main reason behind it isn't for you to protect your house or your valuables or even yourself and your family's from criminals who want to do you harm. It was made to make sure that you always have the opportunity to defend your country and to take it back if ever the govt. becomes too powerfull. That way you will have something to fight them with besides sticks and rocks. We have the right to form militias and use those militias against our own govt. if they ever get too powerfull and forget that they are there to serve us, not the other way around. If we ever become that stupid, to allow the govt. to repeal the 2nd amendment, and allow them to take our guns away, we as the citizens of this country will have lost any chance of being able to get our country back when our govt. becomes too powerfull. We already have had some pretty extreme losses that directly deal with the 2nd amend. One of them being the fact that somehow, someway down the line we had forgot what that amendment was there for. And we allowed our govt. to regulate what kind of guns are now available to the public. Mainly that our guns should only be suited for hunting animals and not what it really should be for, which is to protect us from our own government. I honestly believe IMO that all guns should be allowed to be purchased by any law abiding citzens in this country. Once they do get our guns, it's over. They than can do whatever it is that they please and we will have no way of defending ourselves. This was so important to our founding fathers who created this country that they made it the 2nd most important thing in the constitution. Because they knew that in order to completely control the population, first you have to control their weapons. Once you have those, you can do anything you want and no one can stop you...

        I'm a proud alumni of Auburn University, and I wasn't aware that a school with a history of more than 150 years revolves around the football team. Assumptions like that rip the credibility out of an otherwise routine story. The Auburn family has rallied around this incident not because of its impact on the football team, but its impact on the Auburn family, the school and the otherwise safe community.

              Here in "Dixie" a smaller man will not usually start a fight with a crowd of six giant-like men. These giants weigh 300-350 pounds, can run a 4:40, bench press 400 pounds and believe that they own the world and all of the pretty girls. Just saying, in this case Leonard had an equalizer and he use it. Down here we do not like to start fights, especially when the odds are so heavily stacked against us, but we always try to end them- in our favor. I am happy that Leonard surrendered and when all is said and done, he will probably walk.

              From what I heard, which may or may not be true, he was "trying to get with" one of the player's girfriends. What sane," smaller" man would deliberately go to a party when he knows those giants will be there, drinking, and show his face, much less approach the players? If he had avoided the party, he wouldn't have needed an "equalizer". He should have stayed in Montgomery. He went there looking for trouble, whether he or his friends will admit it or not.

                Well...two of them were thugs....Demario Pitts, who "accidentally" shot and killed his own cousing a couple of months ago, and of course this idiot, Desmonte Leonard. Neither one of them were college students. Demario Pitts was a big part, of instigating this fight with Desmonte. Just so happens Leonard's gun was bigger than Pitt's bottle. I feel for the two college students and their families; but, as for Pitts...Leonard just saved the taxpayers a lot of money. As for Leonard...plug in the electric chair.

There are many reasons to quit. he may have been a walk on without a shot at making the team, he may have had an injury that would not heal right or any other personal issue.                     Actually, if you would read the articles, you would know that one of the killed was not an athlete. The one football player that was shot and survived is still on the team. As for the two that were killed, one decided to transfer schools, probably due to playing time which is not uncommon. The other that was killed was medically unable to play but was planning on continuing his education with his scholarship.

                                  As a white teacher of inner-city children, I believe the only way this will change is for black men to grow up and begin leading their families and taking responsibility as fathers. This will not change in my generation, I don't believe. But I do see a movement among black men to mentor the young boys who don't have fathers. It won't be enough but it's a start. It breaks my heart every day to see these young boys growing up in poverty with so much anger and no strong male role model. These idiots on here who claim it is genetic or inherent are so ignorant it's astounding. They should volunteer with some of these children. It may not be their personal responsibility but culturally we're doomed if this divisiveness continues. It would help them, also, to look into those faces and eyes and learn to love these children rather than hate their race.

                                  You make quite a few bold statements that no one else who is Black is willing to make. You should be a leader on some level. You are needed.

                                  Some people look at the problems within the Black communities and simply want to throw more money at them knowing that it will never work. It does work to get their votes, though, and hence the saying that they are "still on the plantation." And, indeed, they are. White and Black.

                                  Until people like yourself begin to make moves to change the people from the inside out, no amount of money will be a solution. That’s just another form of slavery under different names. Welfare, etc., and it’s being bred into our youth so fast that it’s astonishing. "I deserve this or that." There’s no man (or apparently strong enough woman) to say, "You don’t deserve a thing you’re not willing to work for. Now, you either open that damn school book and learn or bring it to me so that I can beat some sense into your skull."

                                  You may not know it, but you asked the real question: "Who taught being a man ..." Problem is, same as happens in the White communities, too few children have real men around them to guide them and teach them principles, values, morals, work ethics, etc. Some women have their so-called "PRIDE" and shove the fathers out the door as fast as they can so they can move onto another one...who will also be shoved out or either leave for another one. And on the cycle goes. We breed another generation that's worse than the one before.

                                  Doesn’t matter the color. Show me a teenaged boy who is into drugs, ill-behaved, has pants dragging the damn ground and listening to music that would make Satan himself blush, and I’ll wager you that there’s no real man in the kid’s life. And, like I mentioned above, not a mother of much character either.

                                  I know how difficult it is to raise kids these days, but it’s not impossible to raise them well. No. It’s easier to spend the time and sacrifice to raise them well enough that they don’t cause you misery the rest of your life by cheating them out of life’s valuable lessons.

                                  Kids are too precious to be thrown to the wolves of our society today. It’s up to us to take what time we can with them. Even at a grocery store with strangers’ kids, we can take a second or two to be social and shed some grace onto every child we encounter. Never know. It may be that two seconds that helps the child dare dream to achieve.
