$2.1M tax refund, $150K shopping spree: Alleged scammer charged

PORTLAND, Ore. -- An Oregon woman was charged Wednesday with duping the state into giving her a $2.1 million tax refund that allowed her to go on a short-lived spending spree — an alleged scam that has prompted embarrassed state revenue officials to review how they process tax returns.

Krystle Reyes, 25, of Salem, filed an electronic return in January via Turbo Tax, reporting erroneous earnings of $3 million, authorities said. Her request for a $2.1 million refund was initially red-flagged by an automated system, but a subsequent manual review by Oregon revenue department workers OK'd the refund. Turbo Tax then loaded the full amount onto a debit card for Reyes.


Authorities say she spent $150,000 of the funds before reporting the card lost or stolen, at which point the ruse was discovered. The state has recovered roughly $1.9 million of the funds.

Reyes was arrested June 6, and now faces eight felony charges. In addition to tax evasion and theft charges, she is accused of computer crime and methamphetamine possession. She is scheduled to be arraigned on July 5.

Attempts by The Associated Press to reach Reyes, who is no longer in custody, have been unsuccessful and it was not clear if she has an attorney. Officials also have not released the allegedly falsified tax return because of confidentiality laws pertaining to tax matters.

Andrew Campbell, a senior assistant attorney general who filed the charges, has not responded to AP's requests for interviews.

A list of what Reyes purchased during the spending spree has not been provided, but police said video surveillance showed her swiping the debit card at various stores in the Salem area. Despite being a millionaire for a few months, Reyes paid $2,000 cash to buy a 1999 Dodge Caravan, the vehicle she had been seen driving in the month before her arrest.

'Human error'
The Revenue Department, which processes $7 billion in tax returns, is understaffed because of budget cuts and has an old computer system. But agency spokesman Derrick Gasperini said neither of those issues was to blame for what he described as a "human error."

The agency plans to release more details about its apparent blunder in the coming days, and how it plans to prevent a recurrence. There has been no evidence linking Reyes to anyone inside the agency, but officials want to make sure its internal controls limit the possibility of collusion.

"Catching this one, we all are concerned — here at the agency as well as the public — about 'is this part of a larger scheme, and who's involved in that larger scheme and does it involve anyone inside our walls?" Gasperini said.

State Sen. Ginny Burdick, D-Portland, the chairwoman of the Senate Revenue and Finance Committee, has said she plans to hold a hearing on the matter this summer.

"I'm not on a witch hunt, but I'm just very, very concerned that something this flagrant could have gotten through the process," she said. "We need to understand why it happened and what is going to be done differently."

State Rep. Vicki Berger, R-Salem, co-chair of the House Revenue Committee, told the Oregonian when Reyes was arrested that the revenue department "had some explaining to do."

"Is this is an anomaly? If so, let's make sure it never happens again," she said. "Or do we have a systematic problem in the way the Department of Revenue treats this and other transactions?"

Following the arrest, the agency reexamined the returns of 108 people who received a refund of at least $50,000 during the current processing season, and no new instances of fraud were uncovered.

According to the Oregonian, the state reported $559 million in delinquent taxes in 2010, primarily from unpaid personal and corporate income taxes.

oh boo hooo stop crying you men. women get less sentences because they typically do less crimes ergo have no previous record when in court. men go to court and they've got a laundry list of prior crimes so you get tougher sentences. Dear disapointed and ashamed.

It's not nice to make fun of Shellie Zimmermans twin sister. They were born a couple years apart. I know. But, it just ain't right.

A family that lies together sticks together. She's young, beautiful and smart.

Anyways I gotz to give her credit for looking after her own. All she is doing is trying to raise money for George's defense. Her plan was to donate it over the internet. ( Just like YOU did ) and write it off as a tax deduction. Only thing she did was make an error and filed the deduction before the money got into the account. She now has a lawer and all has been fixed. She doesn't have to pay anything back and the tax people already have sent another check to her for $1 million dollars do to their error.

    Confused. She filed a tax return, so it's unlikely that she's an illegal. Even if she had a stolen SS# she wouldn't be likely to file a return on that # as another return would most likely be filed by the actual holder of that #. If the IRS/State were questioning the return, they would most likely go by the initial name they have on file attached to that #.

    Paying cash for an older car makes perfect sense if you were planning on going on the run. Less paperwork.

    I watched a program the other day about Humans eventually evolving into 2 separate species. One more evolved intelligent. The other less intelligent/violent.

    Actions like this support that theory. She was just smart enough to do the scam, but not smart enough to cover her tracks and get the hell out before the scam was discovered.

    A month or so back, the major news outlets had a story about illegals filing false returns. Stories like the above; claiming 10 or so children to get the tax credits/returns, etc. It is costing the US citizens billions of dollars every year.

    Millions of illegals commit tax fraud in our country every year. And it isn't to pay money into the system.

      This is even more astounding than the IRS scam by illegals in Indiana getting $25,000 refunds for their nieces and nephews they claim, all of who actually live in Mexico. The latter was admitted by the guy, who needed a translator, who lived in the trailer house that at least 5 different filers used as an address. That's that earned income credit.

      About this, if she "earned" $3 million, she did not pay in $2.1 million in taxes. In the highest bracket she would have only paid $1,050,000 with no deductions. I just figured that out on my little hand held calculator. Something is way fishy in that tax department - like she has a partner in crime there. Also, don't you have to submit your forms from your employer?

      Also, I'm using Turbo Tax from now on. It got Geithert, our treasury guy or what ever his title is, out of paying taxes, and it got this girl a $2.1 million refund on nothing. This must be the way to go.

      @David- You say because she is a woman she won't get what a man would get as far as time and fines? It is a known fact that most of the paper fraud that is committed today is mostly done by women. BUT, you can rest assure that most women that do this has a man behind her either making her do it or influencing her to do it!

      I am having a hard time figuring it out myself as to why she is not still in custody. Especially since she hasn't even been arraigned as of yet! They do release people on P R, personal recognizes. That is for people mainly who have never committed a crime. Since this is such a big money crime she should not have been released. Even if she had been put on house arrest I think it would have taken longer and she would have still been in custody!

          When the auto flagged the return the person doing the hand sort should have checked previous returns by her. If the hand check had been done throughly and correctly this would not have happened. This is the person that should go from their job.

                          Maybe the GOP need to stand up and take notice -- this is what happens when you severely downsize a department, especially the IRS and it's offices. If anything, we need to "beef" up these offices to catch more of these types of tax frauds. The money saved in finding the fraud would MORE than offset the cost of getting updated computers, etc. This is just ridiculous! The citizens of the U.S. should be ashamed that this has been allowed to happen! There was even a report on this very subject from one of the Government offices that stated that it would be more beneficial to hire more IRS agents than to cut back on this particular department.                           @ Dogma Bites: I understand that Sheila's statement was ridiculous and completely unfounded in any truth or facts, however, I didn't really appreciate your comment towards women either. As a working mother (I am married, we don't have welfare or WICK or anything like that), there is a reason our jobs give us some time away from work after you have a baby. Do you know what happens to a woman after she gives birth. If you are one of the lucky ones that has live birth, it may not be as demanding on a woman who gets cut open to deliver the baby, but your body needs time to heal. You need time to bond with your child, and there is at least one thing that mommies are able to give to babies that "care providers" and daddies just can't give. My husband got the same amount of time off work as I did when our baby was born for maternity leave. Neither of us "demanded" it, as it's usually routine with most jobs nowadays. You have a baby, you get time off. That's just like if you have a surgery, you get time off from work. Post mortem issues are nothing to laugh at either. Hormones are going crazy in your body and it takes time for your body to get back to normal. I hope that if you have a wife who ever has a child, you will be kinder to her than you were to the rest of us women who obviously have brought this all on ourselves. I make more money than my husband does, my job offers much better benefits than his does as well, so the comment about marrying a man who doesn't mind footing your bills, that was uncalled for too.

                          How does a person lose a debit/pre-paid card with $2.1 million dollars on it? I would have drilled a small hole in the card and placed it on a chain to wear around my neck! It would never leave my site. She would still be out there and spending real money had she not called to report the card lost or stolen. It really makes me wonder if she was actually stupid enough to report the card lost (when it was not) in a bid to have two cards with over $2 million. Granted, she would have to be extremely stupid to think it would work out that way but who loses a card like that and then reports it? I think her stupidity has no bounds.

                                      FYI They now outsource the services through India. India outsources them again after they get their cut to Afganistan. Afganistan takes it's cut and deligates the work to the Taliban. And, since we have strayed into stereotypes, I also note (without prejudice) that the new truck driver was black.

                                          This typecasting of workers by color or nationality only shows the ignorance of people that use it. I've seen lazy people of all types and I've seen very hard workers of all types. It's the individual themselves...not what race or nationality they happen to be.

                                          Now this tax refund is stupid. How in the world would you get a $2.1 million refund on earnings of $3 million when she obviously never paid any money to the state on that income? Didn't they even look to see if she paid taxes on the income either through the state or federal? I know this was an electronically files return but good grief it should have been checked out with received data before giving up the money. Something doesn't pass the smell test here.

                                              DB 17- You are so right...there are no consequences for mistakes like this...just losing your job does not teach them anything...they will collect unemployment. We were to receive a little over $2000 dollars on our return...my husband and I are both out of work now and that money would have helped. Neither of us have collected unemployment EVER our whole lives (we are in our 50's)...and the IRS cut our return in half due to a numeric error...which THEY made and now we have to fight to try and get the money we paid the government back...I just don't understand???

                                                That was just one article that I found ,but there was also one video that I couldn't find of a news network investigating how wide spread this problem is and he was interviewing and illegal worker living here with just one child but he put down 12 children that were living in Mexico and received a $20,000 tax refund on his tax return. The IRS know about these frauds but can't do anything about it unless congress tells them to do something to go after these cheats. Now if I were to do something like this I would end up losing my house and thrown in jail with a big fine to boot. I think I'll change my name to Hosea.

                                                  You don't need a SS number, just a tax ID number. These are the same numbers businesses use. Anyone can apply for a tax ID number for any reason. Since they are not screened for who is applying for it, legal or illegal, it is a system begging to be scammed.

                                                  That's correct all you need is a tax ID number which the government provides you so that you can pay your fair share of taxes well guess what, It also has allowed 2.1 million illegal aliens to bilk the Americans out of 4.2 billion dollars of hard earned, and paid tax dollars. Now I ask you is that fair or what. One illegal alien even when on record (under condition of anonymity) that they see nothing wrong with what he did and that he is thankful because if the government did not help him his family both here and in Mexico nieces, and nephews no one else would. WELL DAMN IT the government doesn't help my family out. WAKE UP AMERICAN GOVERNMENT AND SMELL THE ROSES, you are being cheated on and not even kissed. The kicker is that the IRS even know this is happening and is being told not to pursue this, WHAT A CROCK. Yet if you or I or any USA citizen tried this we would be hung up by our short hairs. So my advice is don't make a fifty (50) cent error on you taxes they will nail you or I but let the real cheaters go scott free. Isn't our government wonderful.

                                                    Proudwestvirginian. 65% of American taxes go to foreign lands. Why do you think this country is in such bad economical shape? If they would keep the money here we wouldn't have so many people on welfare or out of jobs. The American gvmt. suppliments many other countries so that they can have a little control over them. You know it's the try to rule the world a little at at time game instead of focussing on ruling this country well. The people in all countries being helped monitarily by the US don't pay taxes either. But if you think about it, most states have state tax applied to every single item you purchase in a store. Much like most of us, they get a pension if they are in office 20 years or more, and just like most of us, they pay into that pension as well as have the opportunity to have a 401K plan.
