While some illegal immigrants and their advocates heralded the Obama administration’s announcement Friday that it would no longer seek the deportation of most undocumented youth, others expressed skepticism, saying it was a grab for Latino votes and wouldn’t make a big difference.
“We’ve been hearing for a long time that this administration is supportive of undocumented youth, he supports the Dream Act, always says it. But at the same time, we’re literally fighting deportation case after deportation case,” said Mohammad Abdollahi, one of the founders of National Immigrant Youth Alliance. Abdollahi said he was “very skeptical” of the announcement and didn’t “buy it at all.”
Abdollahi spoke with msnbc.com from the Obama campaign office in Dearborn, Mich., which he says he and other protesters had shut down recently in an effort to force Obama’s hand on the issue. Young illegal immigrants also have been occupying such offices in Cincinnati, Ohio, and the California cities of Oakland and Los Angeles.
Noting that they believed last year’s guidance to give prosecutorial discretion in deportation cases wasn’t helping illegal immigrants, Abdollahi said the new guidelines outlined in the government memorandum released Friday would not provide categorical relief for Dream Act-eligible youth and would be applied on a "case-by-case basis" by local offices who were "very set on deporting each and every one of us."
“If this administration wants to tokenize us, then give us something for it,” he said. “It’s just ridiculous that we have to get deported and he is still winning his Latino vote.”
Obama administration won't seek deportation of young illegal immigrants
The Department of Homeland Security announced that effective immediately the government would no longer seek the deportation of illegal immigrants who were brought to the United States as children and would allow them to apply for work permits if they meet certain criteria.
A senior administration official said in a conference call with reporters that as many as 800,000 undocumented immigrants stand to benefit from this change. Homeland Security Secretary Janet Napolitano said the shift represented neither immunity nor amnesty -- buzzwords for conservatives who oppose illegal immigration -- but instead represented an instance of "prosecutorial discretion" in which the government had re-evaluated its priorities in enforcing the law.
The announcement represented a major policy shift, and its political implications will be significant.
Cesar Vargas, who started DRM Capitol Group, LLC, to advocate for people in his position -- he illegally entered the country from Mexico when he was 5 years old -- welcomed Obama’s announcement: “We’re speechless.”
“A lot of the work that dreamers have been doing … it’s showing fruit, so we’re a little bit shocked, a little surprised and definitely excited,” said Vargas, 28.
But he also noted that while it was great that young illegal immigrants were no longer being targeted for deportation, he wanted to make sure it wasn’t just a “political announcement.” He said the White House had called his group and “assured us that it’s a very meaningful process that’s going to be set up.”
“Hopefully, he is serious and I think it’s great, but right now we are going to continue all our campaigns,” he added. “Obviously, he is giving us a reason to fight for him so we’re going to continue our pressure on Mitt Romney 110 percent right now … he (Obama) took a chance with us, you know, we’re going to stand by him.”
Obama immigration order poses dilemma for eligible illegal immigrants
The shift essentially accomplishes many of the legislative intentions of the DREAM Act, an immigration reform bill that had stalled in Congress due to Republican objections. President Obama favors the legislation, while presumptive Republican presidential nominee Mitt Romney has said he would veto that law.
In the memorandum to immigration enforcement officials, the government said it would not pursue immigrants who met five criteria: those who came to the United States under the age of 16, are no older than 30, are currently enrolled in school, have graduated high school or served in the military, have been in the country for five continuous years, and have a clean criminal record.
For Yelky Ramos, a 20-year-old recent college graduate who came from the Dominican Republic when she was 13, the change means she should be able to get a job. That will provide "great relief" to others like her, who have finished university, and provide an incentive to youth in high school, she said.
“We just hope that the way they’re going to implement it is going to be fair to the undocumented youth and it won’t be a trap in which people will be applying for this type of deferral and then find themselves … (in) legal proceedings that might lead to deportation,” she said.
The change won’t have an immediate impact on her parents since, who don’t have any status in the United States and are planning to return to the Dominican Republic.
“They know that immigration reform is very far from happening here in the United States with this political arena,” she said.
Chung-wha Hong, executive director of the New York Immigration Coalition, called the move an “amazing,” “historic” victory and said it would "lend huge momentum" to fixing the immigration system.
“ … it’ll change the fundamental direction of where our country is going,” she added. “Now, we’re going towards the kind of reforms that will … really affect the lives and the futures of so many more people.”

This administration keeps telling us how many jobs they have created in the last couple of years. Didn't the republicans gain a majority in the House of Representatives a couple years ago? And what did Obama do from 2009 through 2010 when the dems lost the House? He squandered $800 billion dollars paying off his constituents (public employees, greens and campaign donors) with Porkulus, and rammed through Obamacare, which will shortly be declared unconstitutional. The dems had full control of the government for 2 years and their policies did nothing to improve our economy. In fact, they made things worse. The voters recognized this and gave the House to the GOP to prevent more dem policies from being enacted. In 2012, we will finish the job and take over the Senate and White House.
The GOP-led House has passed over 25 jobs bills, which the democrat-controlled Senate (led by the moron, Harry Reid) refuses to allow to see the light of day. The GOP has done what they can, but with the dems in control of the Senate and WH, their ability to advance legislation is very limited.

If it was REALLY high on Obama's priority list, why did he wait 5 months before the election to issue his 'Executive Order"? He could have done this years ago if he really wanted to - It's timing is the obvious answer to that question.
This could be overturned in only 7 months by a new President. So do the illegal immigrants register for this program and perhaps move their names to the top of the deportation list when it's overturned?
Obama may be putting them in a very tenuous situation - all to pander for votes.

Most importantly, there was no political will to enforce the law against employers. The 1986 IRCA amnesty failed and actually led to millions of more people entering the United States illegally.

While at least paying lip service to enforcement of laws, Clinton assured these leaders that there would be no mass deportations. There were about 7 million illegal aliens residing in the U.S. when he left office.
Bush repeatedly pushed mass legalization (amnesty) schemes for illegal immigrants using the well-worn line that they "are doing jobs Americans will not" or "are not" doing.
When did personal responsibility disappear? I don't give a rat's backside who brought who here. If one wants to become a citizen of this country, there is only one way to do it. I think many keep on forgetting that there are three branches of our government and either of the other two can find a way to make sure this does not happen if they choose to do so. Many people are ready to jump down our president's back (this also applies to past presidents) if they do not see the changes they want, but many conveniently forget that a president can not get anything done if the legislative or judicial branches are not for it.

Our something for nothing culture doesn't want to spend the day picking vegetables or cutting lawns. Don't believe me? Look into the Georgia program that put parolees (typically hard to employ people) to work picking veggies all day. The parolees didn't even last a week. Some threw down their buckets and walked out before their first day was over. So people in our society would rather be in prison than do the work that illegals do. The illegals get paid minimum wage for the back breaking labor that they do. If the same back breaking job paid $20+ an hour and offered insurance more of our citizens would be willing to do it.

That being said, I personally believe that if they spend four years in the military fighting for our country, they deserve to reap the same benefits of the GI bill that our native citizens receive. I hear post after post stating that this is good because children should not be punished. The problem with this is these children will then be used by the parents as excuse for staying here, and if you doubt it then go to any boarder and you will find children crossing into the USA for schooling and medical treatment while they still live in Mexico, the parents came over here to give birth so their children would be American citizens (can not say without compassion that I blame them because I would do the same), but there has to be a line drawn, and to use children and compassion against us is wrong. The amount of stupid statements is astounding.
1. They have to have lived here 5 years. So dropping kids off won't help anyone. Most people cannot get a work permit while living in our country. They would have to be deported and then apply. This lets them apply while still living in the country they have lived in for 5+ years.
2. Giving tax cuts to the people that own businesses doesn't help people buy their products. It just means less employees because of less demand. The business owners aren't buying their own products.
3. Most the people that let Walker stay in office said it was because they were against the recall and said they plan to vote for President Obama in November. Get your facts straight before talking rubbish.
4. Most these people have been working here and paid their own way through college, but need this to be able to work in the field they got an education in. Usually jobs that are having trouble finding people qualified to do the job. So they aren't taking jobs just filling ones that no one else is qualified for.

That would be an incredible mistake. The economy can't grow and create new jobs if we're hobbled by a lack of people with the right skill sets (engineering, for instance) and capital. What we need to do is close our borders except for people with technical skills or capital to invest. I've heard proposals that anyone who graduates with a PhD from an American university gets an automatic green card. That's probably a great idea.
In the longer run, it would be great if we could educate enough engineers, computer programmers, etc... that we didn't need to "import" them. But, as long as we have a culture that denigrates intelligence, we're going to be reliant on other countries where education is prized and not looked upon with suspicion (Santorum's attitude towards higher education being a prime example).
Every person in the U.S. pays taxes of one kind or another. Whether or not they are legal they pay taxes. Stop acting like you are paying for the world when you probably barely pay for the things you use daily...like roads, police, firemen, teachers, and much more. Most people that complain are the ones getting help and are afraid of losing it.

And in my opinion, people should stop using credit cards to pay for things they don't need and if possible get rid of all their credit cards. But that's my opinion.
If you are someone struggling, try a secured loan. The bank or (what I use) Credit union can loan you money you have saved. They of course get a fee for this service, but you keep your money while spending it as long as you pay it back to yourself. Your credit rating goes up as you make regular payments. If you get in trouble and cannot make the payments, you let the bank/credit union take your money which shows you as paying off your loan in full. If you made enough payments, you get to keep some of that money. It's a win, win and you don't have to worry about losing what you bought.

I am a first generation American. My grandparents brought their children here legally from Mexico. My SAT scores were high enough to get me into an Academy. I served 23 years in the military. I say that to emphasize that the illegal immigrants who are eligible to seek work permits will not be applying for jobs in the fields as migratory workers. They will be going to college and competing with everyone else for what few jobs are available.

The timing of this announcement just happens to preempt the US Supreme Court decision on SB1070 and beat Marco Rubio's version of immigration reform.
Also, this is not an executive order from the president. This was an announcement of a policy from Homeland Security regarding the enforcement of deportation actions. Unfortunately, because it identifies a specifically defined group of people...it is a change to the written law. Prosecutors have broad latitude in making exceptions on a case by case basis. This new policy is a "blanket" exception that excludes a defined group of people. That is a violation of federal immigration law.
Allowing law-breakers to officially remain free in order to garner a few more votes ... what a great country we live in.

My wife's best friend was born in Vietnam. She came here *legally* 22 years ago. She spent YEARS, and her OWN hard earned money EARNING her American citizenship. She is now a successful small business owner.

He and his entire family worked through the citizenship process - spent untold hours doing so and spending their own money to get it done. I think it has everything to do with the Social Security Fund which our "trusted members of Congress" have raped and stolen from for so long - and NEVER repaid - making SS effectively nothing more that Congressionally approved Ponzi-scheme. Many of the "12 million" (more? ... probably) illegal/undocumented workers in the US are working under STOLEN social security numbers - yours or mine could easily be included. Those workers are paying into the Social Security System, paying into the system yet are never going to be able to collect against it. IF any Administration (Republican or Democrat) were to actively start truly enforcing imigration laws, and deported those illegals (who can EASILY be identified Social Security any time they want to simply by looking at payments made by employers), then how much revenue would Social Security overnight.
If Social Security is already on the brink of collapse, then how much sooner will it collapse if the revenue from those "12 million" undocumented workers were lost.
If ANY Administration WANTED to deport those workers - they could could do so VERY EASILY. The employers payment records are in Social Security databases RIGHT NOW and show the last payments made- so they KNOW where these people are working RIGHT NOW.
So, in my estimation, if you were to look "under the covers" - this is really a "non-partisan" issue because it is really about money that is funding Social Security.

It *should be* very simply to find out : Drive down to your local Social Security Office, bring your birth certificate and passport, etc - and ask for the information: Where are the payments coming from (other states, etc?), Have any benefits been paid out that I am not aware of?
You would THINK that since they are YOU benefits, something you are counting on later in life, information like that would be readily available to you, right?
Well, go down to your local Social Security office and see what happens.

Eric, allow me to say that at a time in American history, children who were born of slaves were automatically slaves themselves, even though they were not brought to the United States in chains as slaves. It stands to reason that the children were slaves because of the status of their parents. Subsequently, there was an amendment in the Constitution that any person born in the United States is automatically a citizen. That change in the constitution was a remedy to the status of children born of former slaves. However, we have seen how that constitutional amendment benefits other people who were not slaves or whose ancestors were not slaves. Regarding children of undocumented immigrants, I am not for or against anything that may benefit a child who was brought to the country without his or her consent. If something beneficial is done for them, then, good. I am merely making a comment following the argument that the actions of a parent may canot affect the child. Unfortunately, it can; and it is the parent who should bear full responsibility for putting the child in that situation. If the government wishes to use its discretion to help the children, then that is something the government wishes to do. I, myself, I'm a legal resident privileged to live in this great country for the past 31 years. I am proud to call myself an American. My wish is that the divisiveness in this country stops, otherwise, we may no longer have a country as great as the United of America.

The immigration issue has become so complex and convoluted that it's very difficult to find a viable solution to it. Remember, I said viable! It is completely unrealistic to expect the government, either federal or local, to deport hundreds of thousands of people en masse. I'm no liberal when it comes to immigration. As far as I'm concerned, all immigrants should learn English well enough that they don't need multi-language documents or translators when dealing with the government (with no exceptions for age), they must give up any foreign citizenships when becoming an American citizen (no one can be truly loyal to two countries, and the right of naturalized citizens to sponsor foreign relatives for immigration should be eliminated. If you don't want to be separated from your sibling in Mexico, then don't move to the US. But, I believe in practical solutions, not pie-in-the-sky idealism.

You do know that in Texas, they've had over 16,000 minors dumped over the border this year alone? All this does is encourage minors to either voluntarily cross the border, or the parents to dump them over the border. It's called tough love, and we have laws for a reason.

Sue ... while I agree with you in principle, if employers are allowed to exploit illegal workers with impunity, they'll have a tremendous incentive to hire illegals instead of citizens/permanent residents. We could get around this if there were more sanctions on employers, but that's not likely to happen soon. Just last week, Republicans defeated legislation that would have required agricultural employers to advertise open positions and given Americans priority in hiring. They said it was too much of a burden on the employer.

The one thing that may keep families put while applying, the safety of their kids, just flew out the window. This WILL bring more illegals to the US.

I used to transcribe Immigration hearings for a living in the late '90s. It was amazing what people would say to stay here (illegals). The judges used to send them back to their own countries. I returned to this line of work in 2007. What a difference!!!! The judges were more than willling to let these illegals stay in this country. People fleeing China because they want more than one child in their overpopulated, overburdened country were kept here because it was now a human rights issue to give a woman an IUD. And to top it all off, they can stay here once they have a child born in this country. Back in the '90s, the child was sent back with them and told that the child can come back when he/she reached the age of majority and then petition for his/her parents to come here LEGALLY.
I know too many people who applied to come to this country legally. It IS a slap in the face to all of those. Why aren't all of these illegals applying for citizenship if they want to stay here so bad???? The article mentioned illegal college students. Who paid for them to go to college??? I'm pretty sure it wasn't their families. Scholarships???? My own children who were born here couldn't get money to go to college, yet these ILLEGALS get to go and on taxpayer money.

So what happens if the SCOTUS rules SB1070 constituational and we have one state deporting people that the POTUS says shouldn't happen? Something needs to be done but I don't see it being appropriate that one man, even the POTUS, could dictate how the country handles people that have broken the law. SB 1070 is a State Bill which infringes on Federal jurisdiction. How would feel about a state bill that wanted to exercise choice over whether their citizens could fight a war declared by the country as a whole? States are solely a domestic polity and simply do not have the authority to deal in immigration or any other international matter.

It' not a matter of my opinion or those expressed i the WSJ article. The point is that there is already decades old precedent from the Supreme Court itself that federal law trumps state law.

In order for SB 1070 to stand the court would have to disregard previous interpretations by former justices and that is something jurists are loathe to do because so much of jurisprudence relies on precedent and precedent is therefore considered relatively sacrosanct.

That being the case one could wonder why Judge Susan Bolton did not strike down ALL of SB1070? But the fact remains that significant portions of SB 1070 were not affected by her ruling and are now law in the State of Arizona.

Sorry omega1, I ran a landscaping company in NJ from 1987 to 2001, I hired 4 AMERICAN workers and we had contracts at golf courses, hospital grounds and colleges, we even did small jobs for homeowners. Starting in 1997 our contracts weren't getting renewed, we were being replaced by contractors using illegal aliens, they were paid less than what I paid my guys. Soon I had to let 2 of my AMERICAN guy's go, when I tried to bid on a contract my bids were too high and the contractor with the illegals won the contract, by 2001 the company was gone. I am tired of people saying that illegals do the jobs that Americans won't do, I had Americans doing the job but the illegals drove the price of doing business so low that it was impossible to keep my business afloat. If you have a job today it can be taken tomorrow by an illegal who will do that work for less than half of what you are getting paid.
Anybody ever heard of a guest worker program? Lots of countries manage to run them. Yes we want the cheap labor. We just want it above board.

My parents are truck drivers. Driving in a state they watched a van carrying illegal immigrants lose control and flip over. People were ejected from the van, before my parents could react, they ran a guy over. He lived, but lost a leg. He was illegal, crossing state lines illegally. They can't manage to learn the language, but they sure know how to work the legal system. And why not? We provide interpreters free of charge for illegals suing American citizens. It's a one-way street, though. If they cause damage to you, they flee the state and can't be found.
They get paid under the table, get free and reduced health care, lunches at school etc. Many studies have shown that they take more than they put into the system. Not to mention the amount of money they continiously send back to their "home" countries. Tax funds (State & Federal) and it would put a good dent in the State & Federal deficients.
So it makes sense to blame the lower wage illegals rather than the contractor who hires them to compete with you? Why focus on those laborers who are just trying to survive and instead fine or jail the contractors for unfair business practices? They're basically just outsourcing their labor pool without having to move to another country to do it.
