SHINER, Texas -- Hearing his 5-year-old daughter crying from behind a barn, a father ran and discovered the unthinkable: A man molesting her. The father pulled the man off his daughter, authorities say, and started pummeling him to death with his fists.
With his daughter finally safe, the father frantically called 911, begging a dispatcher to find his rural ranch and send an ambulance. "Come on! This guy is going to die on me!" the man is heard screaming on the 911 call. "I don't know what to do!"
A recording of the tape was played during a news conference Tuesday where the Lavaca County district attorney and sheriff announced that the father will not face charges.
In declining to indict the 23-year-old father in the June 9 killing of Jesus Mora Flores, a Lavaca County grand jury reached the same conclusion as investigators and many of the father's neighbors: He was authorized to use deadly force to protect his daughter.
"It's sad a man had to die," said Michael James Veit, 48, who lives across the street from where the attack happened in this small community run on ranching and the Shiner beer brewery. "But I think anybody would have done that."
Father's desperate 911 call
The family ranch is so remote that on the 911 tape, the father is heard screaming at a dispatcher who couldn't locate the property. At one point, he tells the dispatcher he's going to put the man in his truck and drive him to a hospital.
"He's going to die!" the father screams, swearing at the dispatcher. "He's going to f------ die!"
The tense, nearly five-minute call begins with the father saying he "beat up" a man found raping his daughter. The father grows increasingly frazzled, shouting into the phone so loudly at times that the call often becomes inaudible.
The Associated Press is not identifying the father in order to protect the daughter's identity. The AP generally does not identify victims of sexual assault.
"He's a peaceable soul," V'Anne Huser, the father's attorney, told reporters at the Lavaca County Courthouse.
The San Antonio Express reported that Huser said the father “had no intention to kill anyone on that day.”
“In our opinion, the story is over. You will not get an interview from (the father) or his family,” she said, according to the paper, asking for the family to be left alone.
The attack happened on the family's ranch off a quiet, two-lane county road between the farming towns of Shiner and Yoakum.
Ran toward his child's screams
A statement released by the district attorney said a witness who saw Flores "forcibly carrying" the girl into a secluded area scrambled to find the father.
Running toward his daughter's screams, the father pulled Flores off his child and "inflicted several blows to the man's head and neck area," investigators said.
Emergency crews responding to the father's 911 call found Flores' pants and underwear pulled down on his lifeless body. The girl was examined at a hospital, and Lavaca County District Attorney Heather McMinn said forensic evidence and witness accounts corroborated the father's story that his daughter was being sexually molested.
The father was never arrested, but the killing was investigated as a homicide.
Philip Hilder, a Houston criminal defense attorney and former federal prosecutor, said he would have been surprised if the grand jury had decided to indict the father. Hilder said Texas law provides several justifications for the use of deadly force, including if someone commits a sexual assault.
"The grand jury was not about to indict this father for protecting his daughter," he said.
Authorities said the family had hired Flores before to help with horses on the ranch. He was not born in the U.S., but was here legally with a green card. Attempts to locate Flores' relatives through public records were unsuccessful.
On Tuesday, a new "No Trespassing" sign was freshly tacked onto a gate barring entrance down a gravelly, shrub-canopied path leading to the barn and chicken coop on the ranch, which belonged to the father's dad.
At the father's house, the front yard could pass for a children's playground: Blue pinwheels sunk into patchy grass, an above-ground swimming pool, a swing set, a trampoline and a couple of ropes dangling from a tree for swinging. A partial privacy fence is painted powder blue.
No one answered at the father's home. A few miles away, at a home listed as belonging to the father's sister, a woman shouted through the front door that the family had nothing to say. Huser, the father's attorney, told reporters that neither the father nor anyone else in the family would ever give interviews and asked that they be left alone.
Veit, who lives near the ranch, described the father as easygoing and polite — down to always first asking permission to search Veit's property for animals that had wandered off the ranch, even though the families have long known each other.
Veit's son was a classmate of the father's at Shiner High School in a graduating class of about two dozen. Veit, 48, said the young father was never known to be in trouble.
"Just like a regular kid, went to dances, drank beer like the rest of the kids around here," Veit said.
'Traumatized for life'
Shiner, a town of about 2,000 people about 80 miles east of San Antonio, revolves around the Spoetzl Brewery that makes Shiner, one of the nation's best-selling independent beers. Even gas stations here sell it on tap.
Flores' death is only the sixth homicide the Lavaca County Sheriff's Office has investigated in the last eight years. Shiner residents boast their squeaky-clean image on a highway welcome sign: "The Cleanest Little City in Texas."
At Werner's Restaurant, customer Gail Allen said she didn't want to speak for the whole town, though her comments echoed what others said.
"The father has gone through enough," said Allen, 59, who has nine grandchildren. "The little girl is going to be traumatized for life, and the father, too, for what happened. He was protecting his family. Any parent would do that."
Patrons at Howard's Convenience Store told the San Antonio Express that they also backed the father.
“I think it's great, they should have given him a medal for what he did, defending his daughter,” Leroy Wagner, 79, told the paper.
“He was being a responsible father, any responsible father would have done the same thing,” added Joe Marek, 59, a local electrician.
And Victor Casper, 65, a retired county worker, told the Epxress, “If it was my kids, I would have done the same thing. I would have defended them, too.”

I'm from NH. I lived in San Antonio, Texas when i was young. I think '84 thru '86. I hated it. Everything I knew was in NH. Family and friends. It's very different than the northeast. I remember they thought they should be their own country. I ran my mouth like a stupid yankee kid and got my butt kicked, lol. I have always had spiteful thoughts about the state. It wasn't my home. I lived there for over 2 yrs and always felt like an outsider. Looking back, yeah it's a bible thumping gun state, but, I will have to say that it was culturally diversed. Some really good loyal people. Best mexican food you can find anywhere. The Riverwalk in San Antonio was awesome. Live music and open BBQ pits.
After reading this article I felt sick. What kind of person would do that? Ugh, awful. One thing that I have no doubt in is Texans are a great example of legally, and privately protecting the family. It makes me very proud of the outcome from such a horrible situation. No charges? Awesome! There are alot of states that wouldn't have gone this way. The father even felt guilt and tried to save this guy. What an example of a great man, father, human. One thing us libs could learn is sometimes the right thing is just that. The right thing. Anyone who could forceably rape a 5 yr old to the point where she is screaming in pain deserves to be pummeled to death. No soul in a person like that. I would have done the same thing. If he was trained in any form of self defense it would have made it wrong? If I'm not mistaken, the primary reason for taking self defense training is to protect yourself and loved ones in whatever way necessary, though of course there are always those with different intensions. I'm trained in many martial arts, and though I'm taught to use my skills as a means of last resort, if necessary I can, should and will do whatever is necessary to someone if it means to protect me or my loved ones even if it means taking someones life. The only way that being trained would make it wrong is if you use your skills with malice and pre-determined intent on killing.
I do share your sentiment in the hopes that mob mentality doesn't get the better of the populace. There's enough racial profiling and hate based on a few bad seeds in this world, we don't need any more.
Thank god there is justice in Texas and one less stinking scumball sexual predator loose to ruin the lives of other innocent victims. I wish all the states would have the same common sense.

No, but it would have validated an argument that the killing was intentional and purposeful. :) People trained in self defense don't kill accidently. They also know how to disable attackers without killing.
If he didn't know how to kill someone and didn't know how to disable them without killing, then the killing couldn't have been intentional.
I am a Pacifist who believes all life is Sacred, but in this case, even I have to say the father did the right thing. They guy was raping a little girl, and the father reacted as a parent would. He did so without malice, as shown by the 911 call, and seems to take no pleasure in what he did. He protected his daughter from a predictor who was in the act of attacking her. He suffered enough just witnessing that, so I am glad he will not be prosecuted. Texas does so many things to make me wish it were a seperate country, but in this case, justice was served.
You guys don't have clue on being trained in self defense! I've seen black belts get their butts kicked by street fighters without any training! There's a big difference between the streets, and a dojo. I might go along with it if the person was a professional fighter of any self defense system, where they've had full contact training and experience for quite awhile! And as far as the "people trained in self defense don't kill accidentally", that's about the dumbest thing I ever heard. The goal of any martial art is to take the brain out of the equation, and react (block, strike, kick, etc.) without thinking about it. Your eyes see the threat, and your body reacts to it. Thinking about it will get you killed because it slows down your reaction time in the street. And if the guy's got a weapon, you're a fool if you have the opportunity to run, and don't!

A trained martial artist knows exactly what he's doing. If he smashes someone's nose into their brain, he can't say "OMG sorry my body just reacted." This man was flailing around with no clue what he was doing. He just hit all the right places. It wasn't intentiontial.

Its funny how people are mentioning the Martin case as if there is any resemblance? In this case, a criminal was killed (molester). Martin committed no crime. Martin executed his right to stand his ground (persued by an unknown lunatic with a firearm).. and from Zimmerman's story was pretty successful. Bravo to Martin for fighting a grown man like a man...using his fists. Its a shame that cowardly Zimmerman started (by started I mean chasing Martin) and lost the fight and made the decision to end the life of an unarmed teenager.
Congrats to this father for protecting his home and daughter though.

I know what you're talking about. I lived in San Antonio for a few years, and I never saw any gas stations selling beer on tap either. I was just referring to what the article said in the first paragraph under the bold heading "Traumatized for Life".

It's amazing how people get sidetracked by "martial arts" and "beer on tap at the gas station." Who cares. In this case, the father did what he had to do to save the child from further harm. This wasn't taking the law into your own hands, it was protecting your child. Had the guy lived, he may have been put in jail for a couple of years and then let out to do the same thing all over again. Good riddance to bad rubbish.

That's a good question because they did report the father's age as 23. The attacker had to be at least 13, I guess, because he was hired by the father to work on his ranch, and I don't think you can hire anyone under the age of 13.
There is a huge difference in a martial arts trained man defending Himself and one pulling a rapist off his small daughter and hearing her still traumatized while you face her attacker. Its a moot point now and that is the best possible outcome.

I believe I read in an earlier story (either on this site or another) that the attacker (molester) was 47. I may be wrong. Also hallelujah to the people of Texas for not indicting this man!

Had it been me and my daughter, they would still be looking for the pieces of Flores. I wouldn't have stopped beating him until I was sure there was no way they could ever make him breathe again. The 911 call would have been about the rape and oh, by the way, there are pieces of the guy that was doing it scattered all over the place.

Thank God the little girl was screaming.... thank God the father got to her, thank God the media can't destroy the story by pushing more reporters to their ranch and thank God the family is keeping to themselves....no interviews, no publicity.... they deserve their privacy and family support. Based on the fathers actions of trying to save the life of the attacker, he will always feel some guilt. He did what a father is suppose to do, protect those around them. That won't shield him from guilt.

The father obviously didn't intend to kill the guy, but as a father myself, I can certainly understand him losing control after seeing his daughter in that situation.
Hopefully the thought of having protected his daughter will outweigh any feelings of guilt he has.

If they charged the father, he'd get off no question about it. He could then sue the prosecutor for malicious prosecution and any jury would award him a record judgement! There's no guilt involved here, no more than anyone would feel for putting down a rabid animal!
I know what you're saying, it appears he feels some sense of guilt (because he seems to be a decent human being). I only meant that I HOPE he doesn't feel as though he did anything wrong. This little girl will be scarred for life because of this animal, and now her father will be scarred for life too.....all because of this waste of a human being.
Killing a man with your bare hands is an extremely intimate act, and the father will probably be able to remember the rapist's bones crunching under his fists for the rest of his life, and be horrified at his own violence. But he did the right thing at the right time. If the father feels guilty for killing that monster, he should know he feels that way because he's a GOOD man, not a BAD one. I imagine he'll take no satisfaction from his actions - although I do. Whenever he thinks of his justified killing, he will also have to remember his daughter's rape. The daughter is 5 years old and must have seen her father kill her rapist, so if she doesn't block out the memory of the incident, she will remember both the violence that came out in her father WHEN SHE NEEDED IT MOST (we are all still animals in the deepest part of our brains, no matter how deeply buried), and remember how much he loves her. I hope knowing she has her father's protection helps her through her pain.

Just imagine what would it be in "progressive" (which means criminal friendly) states like California or Vermont!
Texas is bad with many things, but they're amazing when it comes to clear-cut cases like this one. Sadly, the same can't be said for many "progressive" states. And the distinction between a reckless guy and an evil criminal isn't clear in most states.
Hey maciej: Watch out what you say about Vermont. F. ex., the state gets an A+ from the NRA. (The only people prohibited from carrying are convicted felons and people with an established history of domestic violence. No "pistol permits," just a background check at point of purchase.) Furthermore, IMHO, you wouldn't find a grand jury in this state that would indict a man for doing what this dad did. The big difference between VT & Texas is this: Had the perp survived, he would have got a life sentence w/o parole, b/c VT does not have the death penalty.

Hey Me, There was not precedent set here. Justifiable homicide like this has not been prosecuted for years, especially in Texas. This case defines justifiable homicide. It occurred during an attack (no premeditation), the man applied force necessary to subdue his daughter's attacker, the force happened to be lethal and the attacker died. The father even called 911 to try to save the man. This father is awesome. This would be the same thing that would have happened had the police arrived. I am progressive. I am liberal. But there is no way in hell this father should be prosecuted for anything. If we take the power away from the people to protect themselves and their family, we have failed as a society.

I sort of understand what Me is saying. I have no problem with the fact that the molester was inadvertently killed by the father. I have no problem with the concept of justifiable homicide. What I do have a problem with is comments let by people who would cheerfully kill people when such force isn't required, and then call it justified. We live by rule of law. There can be exceptions to rule of law based on individual circumstances. Saying however that the exceptions should be the norm, and that the molester in this case "wasn't human", that certain people deserve to die NOW , not later, after a trial, creates a scenario in which even lynch mob actions could be justified.
Keeping an attacker or criminal alive, if possible, can also assist law enforcement people in solving other, possibly related crimes. What if this molester had abducted a child in another area and had her tied up in a shack somewhere? This will now not be known. Again, I support the dad in this instance, he tried to protect his daughter, but people who suggest that all "decent" people have a right, as individuals, to kill abnormal people or perverts (as defined by them) are not of the same caliber.
I'm pretty progressive too, and I absolutely agree that this father did the right thing. I also believe that McQueary should have done exactly the same thing when he saw Sandusky molesting that kid in the shower. Only he should have grabbed a baseball bat first. We adults have a moral obligation to protect kids when we know they're being victimized.

This isn't a precedence. It has always been legal in this country to defend yourself or family against harm. There weren't even any new limits set in this case. The grand jury decision to not indict was in accordance with existing Texas law.

This had nothing to do with the law. Clearly, in this case, the law was not going to help this man, or his daughter. If the father had decided to call 911 when he saw the attack, the attacker would have not only finished raping the little girl, but would have also gotten away by the time police arrived.
Please remember that police are under NO LEGAL OBLIGATION to protect you, and they cannot possibly guarantee 100% success in that department. The father was not taking the law into his own hands, he was instead taking the safety of his daughter into his own hands. That is one of the most basic responsibilities of any parent.

First let me say, had the molester been a relative of mine and I had any knowledge of his/her abusing any one, much less a baby, I would have done the deed myself, or maybe I would have turned them in. Let me tell you, this happened about 200 miles from my home town. I actually saw the video of the shooting from cameras at the airport. Mr. Plauche shot the guy then turned, put the gun down, raised his hands and was arrested. No resistance at all.
I can say that everyone I know, and most of us around her I'm sure, were outraged that Mr. Plauche was arrested at all much less tried and convicted. He pled no contest. His sentence was suspended and he was ordered to do 5 years probation. In MHO, that was the outrage.

This is so much better than the police getting him. Not only would the 5 year old have had to endure the rape, she would have had to have a rape kit...which is traumatizing on its own after a rape. I will say that my own experiences contribute to how I feel about how rapists should be treated. I wish that pain on no one. The next time a man tries to rape me, I'm going into kill or be killed mode. I would rather be killed than live through that one more time.
Jessicalc: Well said. I refuse to be a victim, that just gives the abuser power. I am with you all the way on how rapists, especially child rapists, should be dealt with. My opinion; they should be strung up by the body parts they weild as weapons with piano string and be hung up some where far, far back in a deep dark swamp and left to the wiles of the wild life that thrive there.
As for survival mode, absolutely correct, it is either him or me and I fully intend to be standing in the end. The local officials will have to take the perp off my property, or where ever, horizontal and feet first. End of story.

There's a difference between taking a life with regret, and taking a life with shame or guilt. There was no shame or guilt attached to this life having been taken under these circumstances, but if you remove "regret" from the equation, then you open a floodgate for such behavior because, hey, certain people aren't "men" or "women". Let's kill them.
I know police officers who have killed justifiably but who regretted having to. Same with soldiers. We can at times kill others without shame or guilt, but the element of regret is what makes and keeps us human, makes us better than "them".

One noticeable thing here is that the news media says it wants to protect the family and then gives an incredibly detailed and very specific description of the yard and other aspects of the property, including a powder blue privacy fence. While I suppose the only people who would recognize that description of such a remote ranch are local people who already know what happened and to whom, if the media is so concerned with the privacy of the family there was no need for such a detailed description. Don't think we need to know about powder blue privacy fences and details of that nature.

What I do feel though, is a tendency toward watchfulness, as I hate seeing children suffer what I have lived my entire life with, through no fault of my own. Pedophiles are predators who prey on the innocent, and only repeat when they are caught. They have no conscience. They sentence these innocent children to a life of guilt and feelings of inadequacy. So where in your mind is the justice for the child? I'm glad you're not responsible for watching over my grandchildren.

Having had the same experience I pray that this little girl gets the help she needs to over come and realize that this molester was the only one responsible for what he tried to do to her. I must say that had this happened to my child, at anytime in his life much less such a young age, I would have done the same thing. Google Gary Plauche, Baton Rouge, Louisiana. Also see This happened in 1984 I believe. Mr. Plauche was brought to trial and convicted, however, his sentance was suspended as time served.
Again I say, these fathers are heros. There is no room in this world for sick pedofiles preying on our innocent children.

The dad was sentenced to time at hard labor served and 5 years probation. We, in this neck of the woods, were disappointed with the probation sentence because many of us felt he didn't deserve it. A lot of rumors swirled regarding the mom having an affair with the instructor, however, Jody Plauche sets the record straight on that issue. There is also a video clip of the incident.

ME-824303 - Americans have the right to protect themselves and their families, and they should always have that right.
There will always be people who take things too far, but citizens should not have anything to fear if they are protecting themselves or their families. Politicians, law enforcement, and lawyers have grown so powerful that they seem to have reversed this right in order to line their pockets and feed their egos.
My heart goes out to this family, as they have experienced what most people hope they will never have to go through. I wish them all peace, and I hope the press will leave them alone.
