
Former University of New Mexico President F. Chris Garcia was arrested in June 2011.
A state district judge has ruled that a website on which a former University of New Mexico president is accused of helping run an online prostitution ring is not illegal, the Albuquerque Journal reported.
F. Chris Garcia along with Fairleigh Dickinson University physics professor David C. Flory and others were arrested last June and charged with a criminal complaint of promoting prostitution.
Garcia was a professor emeritus of the university who served as interim president in 2002-2003.
He and the others are accused of overseeing a website called Southwest Companions. Investigators allege that the site had around 14,000 members, including 200 prostitutes, who were paid anywhere from $200 to $1,000 for sex acts, although payment was not made through the site.
The case was scheduled to be heard by a grand jury Monday, but the Journal reported that State District Judge Stan Whitaker said in a ruling that a website, online message board and a computer of Garcia's didn't constitute a "house of prostitution." He added that the website wasn't a place where prostitution was practiced, encouraged or allowed, the Journal reported.
Defense attorneys had filed a motion earlier this month to prevent prosecutors from seeking an indictment "for conduct, that as a matter of law, is not a crime," the Journal reported.
Whitaker agreed and told prosecutors that if they wanted to proceed they had to instruct jurors about the court's ruling.
"We feel vindicated by judge Whitaker's ruling that in essence says he (Garcia) did not and could not have committed a crime," Garcia's lawyer Robert Gorence told msnbc.com.
He declined to tell msnbc.com what the website was used for.
Prosecutors now must decide where to go from there.
Since the state has no laws specifically addressing the use of computers for prostitution, federal laws may apply, the Journal reported.
"If the website itself is not a place where prostitution is practiced, encouraged or allowed, and neither is a computer, is the room where the computer is stored?" Chief Deputy District Attorney Mark Drebing told the paper. "Because the purpose of the website is to arrange sex between prostitutes and clients."

Drebing told the Journal the state's options are to abide by Whitaker's order, come up with different charges or appeal the judge's order to the state Supreme Court.
He said that Whitaker ruled on facts that haven't been presented yet and that the defense merely offered a theory of the state's case in the motion, the newspaper reported.
Gorence told the Journal last month that Garcia never received a penny from any activities as a result of the website and that he didn't control or direct the activities of women who advertised as escorts.
He said Garcia's reputation has been harmed, the paper reported.

As the saying goes, you do not pay prostitute for sex, you pay them to leave when your done. Prostitution is legal and regulated in Nevada and that is the way it should be in every state. Trying to stop it is a losing battle that is not worth wasting money fighting. It is better to regulate it and make sure the women involved get regular health checks to prevent spreading HIV, STDs, etc. Instead of trying to stop it, the government should just make sure that it is done safely. If this is how a woman chooses to make a living, that is her choice. There are so many laws that people break minor statutes all the time without realizing it; we say "ignorance of the law is no excuse," but that attitude kind of breaks down when you have thousands of laws regulating things that don't need to be regulated.

Yes De Tocqueville, I had a professor like that. He believed that what he thought was CORRECT, and if we didn't think that way, we were wrong. I wrote a paper for the end of semester, and basically told him how I felt, and that I didn't agree with his views and why.

All societies regulate morality to one degree or another based on what might be seen as rather universal tenents of 'morality' - murder, murder for hire, assault, theft, number of spouses, etc., are all based on 'morality' (though number of spouses varies by culture, there is still some form of regulaton). Most, but not all, moral tenents relate to adverse outcomes caused by one to another. The key difference in the case of prostitution is the idea of 'no harm' between consenting adults. Knowingly spreading STDs is another matter which has already been addressed by the courts.
When I worked with law enforcement, the primary reason for going after prostitution wasn't especially the sex part but that many other criminal and health impairing acts very typically accompany it - theft, robbery, assault, drugs, disease and the like. However, legalization and regulation would eliminate most of these issues. Properly controlled, it is truly a victimless crime and clearly one that is not going away. One could argue that often money for these activities are syphoned from money needed to support the user's family but that would be no different than a similar argument for gambling which is legal in most states.
Legalize, regulate, inspect and tax. While this will anger many zealots it is the right thing to do for our country and will allow us to focus on the real issues of importance to our nation. No more distractions!

Does the Constitution says any thing about war crimes? I don't recall it ever being mentioned per se. Was abortion ever mentioned by the Constitution? I don't recall that either, but it was illegal prior to 1973, I think and the I think refers of course to the year. There are plenty of issues that seem not covered by the Constitution, but depending on the case, you can place it somewhere that pertains to it. Does the Constitution mentions the burning of the flag being unconstitutional? Again, I don't recall, but congress has tried to make it a constitutitional issue and the supreme court has said, not the retard that we now have, but previous supreme courts, that burning of the flag is guaranteed by the Constitution because it falls within the parameters of freedom of expression.

I would suspect some rapes are performed because the guy is horny and can't get any. It isn't fair to state that rapes are ALL performed because of some very specific reason as you suggest. I would expect that if prostitution were legalized, the rate of occurrence of rapes would be mitigated by some unknown (unknown to me AND you) amount.
In fairness to both of you, we have no idea of any substantial link between rape and prostitution. The only reason to think that legalizing the latter would decrease the former is if you think of "sex" as a total supply versus demand thing, with the supply side containing every possible means of obtaining it all mixed together. That's a rather crude way of conceptualizing complex psychological matters.
