Sandusky convicted of 45 counts, plans to appeal

Updated at 11:37 p.m. ET: BELLEFONTE, Pa. — Jerry Sandusky was convicted of 45 counts of child sexual abuse Friday night and faces spending the rest of his life in state prison. His attorney said he would appeal the verdict.

Sandusky's attorney, Joseph Amendola, asked Judge John Cleland to allow Sandusky to be released on house arrest, but Cleland summarily rejected the request, saying: "Bail is revoked. Mr. Sandusky is remanded to the custody of the sheriff."

Sandusky was immediately led out of the courthouse in handcuffs as a large crowd of onlookers cheered. Sentencing was set for late September.

Sandusky, 68, the former longtime defensive coordinator for the Penn State University football team, had denied all 48 counts alleging that he abused 10 boys over 15 years. Two grand jury reports accused him of having used his connection to one of the nation's premier college football programs to "groom" the boys, whom he met through his Second Mile charity for troubled children, for sexual relationships.


Several of the counts are so-called mandated felonies, meaning Cleland has no discretion in sentencing. NBC News reported that he faces a minimum of 60 years in prison.

Cleland, who is a senior judge in McKean County, was brought to Centre County to oversee the trial after local judges recused themselves.

Reaction to the Sandusky verdict

Amendola, who was interrupted by hecklers outside the courthouse several times, said he had expected the outcome and respected the verdict of the jurors, who didn’t speak to reporters afterward.

Amendola said he believed Sandusky had legitimate grounds for appeal, saying his client had "an uphill battle" because of the extensive pretrial publicity.

"We said we were attempting to climb Mount Everest from the bottom of the mountain. Obviously, we didn't make it," he said.

Pennsylvania Attorney General Linda Kelly, whose office prosecuted Sandusky, said, "A serious child predator ... has been held accountable for his crimes."

Kelly thanked the victims, who she said "came forward to bravely testify in this trial and to finally put a stop to the crimes that were committed."

"We hope that our search for justice will help them and perhaps others looking on nearby and afar," she said.

Grace Gordon, 49, of Bellefonte, also welcomed the verdict but lamented the damage the trial had done to Bellefonte and Centre County.

"It's hard. It really is, to see a small town torn apart like this," said Gordon, who was outside the courthouse with her 23-year-old son and his girlfriend.

Gordon said her father, who worked with Sandusky at Penn State, "would have just been devastated to know about this."

"You'd never, ever have dreamed that he'd be that kind of person," Gordon said. "What he did to those kids is just horrendous."

The university that Sandusky served for decades said in a statement late Friday that "we have tremendous respect for the men who came forward to tell their stories publicly. No verdict can undo the pain and suffering caused by Mr. Sandusky, but we do hope this judgment helps the victims and their families along their path to healing."

The university said it would seek to "fairly ... compensate" the victims and invited them to participate in a program to "facilitate the resolution of claims against the University arising out of Mr. Sandusky's conduct."

It said it intended to get in contact with lawyers for the victims "in the near future."

Sandusky was acquitted on three counts: an indecent assault charge involving "Victim 6", a man who testified that Sandusky had given him a bear hug in the shower but at one point he just "blacked out"; an indecent assault charge involving "Victim 5", who said Sandusky fondled him in the shower; and an involuntary deviate sexual intercourse charge regarding "Victim 2", who former assistant coach Mike McQueary said he saw being attacked in a campus shower.

A trial that riveted the nation
The trial, which opened June 11, culminated months of intense attention that led to the firing of head coach Joe Paterno, who won more games than any other major college football coach in history, many of them with Sandusky at his side.

Paterno died exactly five months ago, a few weeks after the Penn State Board of Trustees dismissed him for not having done enough to stop Sandusky's abuse.

Jurors heard often-graphic testimony from eight of the 10 victims whose accounts were included in two grand jury reports. They told how Sandusky would first win their trust by giving them gifts and taking them on trips with the football team before progressing to hugging, kissing, increasingly sexual touching and, in some cases, oral and anal sex.

In a rare occurrence in an abuse trial, prosecutors also presented the testimony of a corroborating eyewitness — Sandusky's former Penn State coaching colleague McQueary.

McQueary said the boy had his hands against the wall and that Sandusky was standing up against him from behind. He said he heard a "skin-on-skin smacking sound" and that he had "no doubt" that Sandusky was engaging in anal sex with the boy.

Because they were sequestered, without access to computers, phones or any other way to hear news coverage, the jury of seven women and five men wouldn't have heard newer, potentially damaging information from two other accusers that emerged after they began deliberations.

Sandusky's adopted son Matt said he had been prepared to testify that he, too, was a victim of abuse by his father, according to a statement issued Thursday by attorneys who said they are representing the younger Sandusky.

(NBC News and msnbc.com generally do not identify victims of sexual assaults, but Matt Sandusky chose to identify himself in a public statement released through his attorneys.)

Amendola said Friday night that Jerry Sandusky abandoned plans to testify in his own defense because of the prospect of damaging rebuttal testimony by his son.

Nor would they have heard the account of Travis Weaver, 30, of Ohio, who attended Second Mile camps as a youth. Weaver told NBC News in an interview that aired Thursday night that Sandusky performed oral sex on him in the upstairs bedroom of the Sanduskys' home.

Weaver testified to one of the two grand juries but wasn't mentioned in the grand jury reports or called as a witness during the trial.

The end of the trial doesn't mean the case is over.

Two former top Penn State officials, former Athletic Director Timothy Curley and former vice president Gary Schultz, face perjury charges in connection with their grand jury testimony in December, in which prosecutors alleged that concealed what they knew about Sandusky's conduct.

Law enforcement sources have told NBC News that former Penn State President Graham Spanier, who was fired in November, was under investigation for possible similar charges.

let's just hope that the jurors have executed common sense and if there was one "rogue" juror the others were able to talk sense into him/her. This guys is a coward loser and he deserves the worst possible treatment possible. It will take time but same goes for Curley, Spanier, Dottie (wife), guidance counselor, Paterno, McQuery, the local police, the loca prosecutors office, and many, many more who turned a blind eye to these atrocities to protect "the program" and the cash flow that comes with it...

    Thank God for the Justice system in their state. Get these kind of people off the streets. People that guide our children down any path of education , or any other activities pertaining to school, no matter what level of education should obviously be required to take psych tests, before allowing them to be involved with our youth. This day and age you can not be sure about anyone person. Good Riddance and my thoughts and prayers go out to those who have looked up to this man assuming he was a leader and a good influence for what they were trying to accomplish. Mrs. Sandusky might not have had any maternal instincts at all toward her adopted children, because she was just a very marginal caretaker.

    As more of the sordid details of this matter came to the light of day, it became very apparent that many people were made aware of what was happening, and they made the choice not to do anything about it.

    I HOPE THERE IS A WAY FOR THE PROSECUTOR TO GO AFTER ALL OF THESE PEOPLE, because, when they failed to act in a responsible manner, they were sanctioning the sex abuse.

I was in the same position when I was a boy of about ten or eleven but I was fortunate that when I said no to the man he let me go without harming me. I cannot begin to imagine what the victims went through.

    And as to his attorney's talk of appeal, of course, but saying what? His defence wasn't that he was innocent, it was things like "I only showered with little boys, nothing sexual was meant by it" :o Along with further comments about players (and these kids weren't even college age, let along a member of his team) need to get used to that... WTF? Someone has to be seriously screwed up, to imagine that that, would be acceptible behavior. Here's a clue Sandusky and your lawyers, that, in and of itself, should be enough to get one on the sexual preditor's database... It is not OK to show one's self to kids, in that manner, period, end of story, now go to jail ;) Then the defence went onto arguments of "histrionic personality disorder", no of which suggests, not guilty. All of these statements from Sandusky and his team are excuses for his sexual deviance.... So umm yeah, appeal when it isn't just the prosecution demonstrating guilt? Yeah umm, whatever... Now if this guy had one ounce of common sense, he'd realize the words that came out of his own mouth demonstrate his own guilt...

    Oh, and forget breakfast, he'll figure out something is up if/when he makes the mistake of dropping the soap during the morning shower :o

    They just didn't have respect for them when these same victims came forward to report Sandusky years ago when the university told these kids it wasn't happening and they just misunderstood what was going on.

    Adults in the presence of children "not your own" need to behave as positive role models. Sandusky engaged in deviant sexual behavior period. An adult male or female has no logical reason to shower, dress, undress with minors under their supervision and in their trust. Alter boys included. If we were a healthy society, we would be having discussions with our children about deviant behviors imposed upon them at any time or in any situation and to identify a trusted adult to go to. If we were truly civilized this wouldn't be so rampant and schoold bus monitors would feel able intervene bullying behavior.

    Be honest. Haven't you seen enough verdicts come down that defied belief? Didn't you have a nagging fear that somehow this jury was going to find a way to acquit Sandusky?

    This positively reenforces our curriculum; I new he was guilty, "disappointment again" I have to question all the time, where we send or kids, will they be safe? I use to love it when their was no doubt..

    However, hearing people cheer with joy in court, outside the court is so low brow, so lacking in professionalism. What is their cheer here? All those boy hurt, and people are cheering? They even boo'd the defense attorney. He's doing his job and doing it very well if you ask me. The worst criminals are entitled to have a good lawyer for defense, even Sanducky.

    This is not a football game people. This is a very serious matter and real people got hurt. There is nothing to cheer about.

    Let me say right off the bat that it's clear that Sandusky is guilty of sexual abuse of a child. Several, in fact. Still, this trial was NOT a shining example of American Justice. There SHOULD have been a change of venue outside the state and possible outside the boundaries of Big Ten states. I agree with the defense attorney that a fair trial wasn't possible given the pretrial publicity and the in state trial. Nevertheless, as I said, I believe he was guilty of at least SOME of the charges so "apparently" justice was served.

    What bothers me more is the ongoing bloodlust of bystanders watching the show. This guy is a sickpuppy NOT a mongrel. Everyone is acting like he raped AND MURDERED every child he came into contact with. Now before you all go screaming "what about the victims"... I speak as a victim. The only TRUE way to get past being raped is to give up the anger, betrayal, vengeance, and victimhood you feel and take control of your life. It happened, cycle through all the emotions, and then leave it behind and move on.

    As for those who are so angry and hateful who have been lucky enough to never experience this, get over yourselves. You're spending your energy on the wrong person. Spend it helping victims not seeking revenge.

    The man will serve the rest of his life deservingly in prison. The more disturbing thing to me is the huge cover up. Is the school talking aboUt compassion and compensation just because of the guilty verdict? Looks like it. Sandusky is just one of many that sounds like they should be in jail. Including some postemous sentence for paterno "just for the record, to be on his legacy of records". This university will and should always have a dark cloud of shame over it and forever disgracing its honor..What more needs to be said about putting the pride of a program over everything and ultimately "money".     He had been investigated years and it went nowhere because the victims were still too young for any of the adults in charge to take them seriously. It appears that not only were each of the victims left to twist in the wind with their guilt and shame, there was a hierarchy of officials at Penn State who just "turned a blind eye" to protect the integrity of the organization.

    Now that they've lived through the pain of knowing that he got away with what he did to them, and most of them not knowing about his other victims--leaving them to think they were the only one--justice is served. Very Brave men, if you ask me.

    I think his defense team knew they'd lost the case after the Costas interview. They should have just told him to acknowledge his guilt, suck it up and take his punishment like a man, and save the taxpayers all the money that it cost to prosecute this case. I think the jury made the right decision. Now I guess we have to hope that the sentence reflects the verdict. (Crosses fingers)

People that guide our children down any path of education , or any other activities pertaining to school, no matter what level of education should obviously be required to take psych tests, before allowing them to be involved with our youth.     @loooong, that is the real travesty here. Penn state realizing that they will be paying dearly for all of those moments when someone in the chain of command could have ended it years ago, are attempting to cut their losses.

    The university said it would seek to "fairly ... compensate" the victims and invited them to participate in a program to "facilitate the resolution of claims against the University arising out of Mr. Sandusky's conduct."

    I personally think the victims should seek compensation on an individual basis and make this as painful for the school as possible. They only care about helping now that it is going to cost them a sh!t load of money.

    Unreal how this all played out, except for the verdict, we all knew that was coming. What is wrong with people like this? He obviously knew what he was doing and the fact that it was over a span of so many years; why did no one say anything? To keep their jobs??? Who cares about a job when there's an old man raping young boys(America's Future), with the HELP of these idiotic people turning a blind eye and concealing these terrible deeds. Everyone involved with covering up details should be prosecuted to the fullest. These people are almost as guilty as Sandusky himself. I feel sick to my stomach even thinking about what he did to those young naive boys; on the flip side of that is that Karma's a Bitch, I bet there are hundreds, maybe thousands, of inmates getting ready for their opportunities to "return the favor" to Mr. Sandusky, lets all hope that he enjoys whats coming to him. There's a line in the end of "Red State" that sums up what will be happening to Sandusky; the tides have turned and now hopefully he will feel more pain and suffering than all of his victims put together. The scariest part about this is that there are more people out there like him and we need to find these people and stop them before they ruin as many lives as Sandusky has. Thanks to anyone who reads my venting post. Maybe we should go back to common law for a few hours of Sanduskys time and tie him up somewhere in prison and have all the guards and cos take a break and turn their blind eyes; personally I don't think that he'd survive that kind of attack, but he sure does deserve it.         @marchant, I don't have a problem with defense attorneys and the job they do, even in defending people who I believe are "blood on the hands" guilty. It is fundamental to our judicial system and constitutional rights that everyone have access to legal representation. Certainly, every good attorney could turn down the case, but then the court would assign a public defender. The PD has a legal obligation to defend whatever position his client wants to take. If he's guilty and the evidence supports it, then no amount of legal wriggling will set him free. Again, it is YOUR right as well as Sandusky's to have an attorney whether you are guilty of committing a crime or not. I'd like to keep it that way.

            I have followed this trial from the very beginning. I think, what makes me more mad than anything else is, all the people who came out and reported to the media, speaking in his defense, that him taking showers with little boys in a communal shower room was normal. One that said they came in and heard slapping noise that would make me believe it was circumstantial of a deviate sex act, said that he was just soaping up the boy, helping him bath. EXCUSE ME!... I have two children, one 10 and one 11. I have not helped them soap up their bodies for a shower since they were 3 or 4. I may have helped them wash their hair, since it was long (daughters), but even then, I did it in the kitchen sink. This guy is the poster child for "sexual pervert" and should be castarated. I hope in prison, those big gang leaders make him their girlfriend really fast and make his life miserable, for all eternity.                 I get your point but I disagree. An attorneys job is to take a clients argument into the court room not decide for themselves his guilt or innocence before the judge and jury hear the case. You have to separate the emotion from the legal rights and for that reason I don't think a guy like that harms his career. I doubt many defense attorneys ask their clients if they are guilty in the middle of a defense. And yes, it has the appearance that they are taking the case just for the money. But we all do things for money some honorable some not so. That is the job of a defense attorney.

                For example, I was intrigued with the OJ case. I thought the evidence was overwhelmingly against OJ and he secured high powered and high priced attorneys. In the end they successfully argued the probability that evidence was improperly collected, handled, tested and presented. Do you think they asked him if he killed his ex-wife and her boyfriend? It was the high point of their careers. I still believe he was guilty of the charges and they might as well but it's totally irrelevant.

                Thanks Independent Thinker--Bingo! It is absolutely NOT confined to a particular political affiliation, or religion (as much as I've seen people here post about all Catholic Priests being pedophiles--it was closer to 2%--still too many, imho, but nonetheless--many good men I've known have had to endure that public perception because of those individuals' crimes and the subsequent cover-ups)

                People who are pedophiles gravitate to professions and jobs where they will have access to children, and especially if that position will entail having unsupervised "guardianship" for lack of a better word of a child or children. That way they can use a whole host of psychological manipulation to keep their victims silent and keep repeating the crime. Not to say you have to be suspect of everybody who assumes responsibility for your child for any amount of time--just that if a child "feels sick" when they're scheduled to be in that person's company, or in other ways resists, or comes home to you in an angry or silent character--ask them what's been going on, and then LISTEN. Most children that this happens to are so afraid of not being believed (because of the mind tricks the molester conducts on them) and that is why they don't tell for so long. It sounds like for a lot of the men who testified for the trial or for the grand jury--this is the first time they've told the story and had anyone believe them. I pray for them, because now that they've had to dig up and tell what happened to them, after all these years of burying it, they're going to have a lot of emotions to deal with.

Anybody can fall given the right circumstances, even a good coach like Jo Pa who should have done more and went to his grave KNOWING IT.                         Laura, and for that matter the rest of you, you just don't understand prison. The prison raping of pedophiles for the crimes they did on the outside is largely a myth! A person is more likely to get raped for things they do in prison than for anything they do outside of prison. If Sandusky is no snitch he likely will never be raped in prison. Do you realize how many child molestors are in the prison population? Hell the whole bunch of them could team up and take over most prisons. Does rape still happen in prison? Sure it does and sometimes, like in the case of Jeffrey Dahmer, it is for what was done on the outside but that is the exception rather than the rule. Not to mention Sandusky is elderly and has medical needs. Sandusky will be placed in a unit designed to keep him from being a victim of crime and a unity fit for his medical needs. In other words you will foot the bill for him for the rest of his life. However better for him to be behind bars, at any cost, than to be out hurting kids. Good Day, Joe.

                        Joe and Spinaker, Sorry not the way it works. They do get it. It is no myth. Just watch if they let this vile scum into the regular population. They may not rape him as he is no pretty boy. But he will get taken care of. It may take years, but eventually he will get it. That will be the biggest thing for him to deal with in prison, the fear of what is going to happen to him next and when.

                        Happened recently to a guy in England who had molested a few kids. Ended up dead and the guy who did it was a hero to the rest of the prison population for doing it.

                        Sorry, Letloverule, but Joe is right. My brother is a registered sex offender and he was never bothered in prison nor were any of the other SO's who were there. The other inmates just don't care about them. He was in several prisons over the course of a few years and it was the same wherever he went. The idea that other inmates "take care of pedos" is a myth. Does it happen on occasion? Sure, but it is the exception and not the rule.

                        As one of his victims, trust me, I wish it was the rule.

                          In this kind of case, I'm not as inclined to say the system doesn't work. I believe the OJ fiasco was mainly due to incompetence by the prosecutors and the fact that their lead person had to sit it out because of a heart problem just as the trial began. Come to think of it, maybe that is the system not working.

                          However I am very confused about why the testimony of his adopted son wasn't presented. It seems like it would be a really damning contribution to his conviction. I don't get it; maybe there's something that they felt wouldn't help the case involved.

                          I certainly hope he's convicted and, as someone else mention, hope that his enablers are also held responsible. Paterno got the easy way out. I have no respect for the man and can't say that I hope he rests in peace.

                            Rick, I believe the reason the adopted son didn't testify was that he did not come forward until after the trial was underway. Because he hadn't yet been accuser, he wasn't on the witness list. So the prosecution couldn't have presented his testimony, because it would have been unfair surprise - Sandusky's defense team wouldn't have been able to prepare for that testimony.

                            However, if Sandusky had testified in his own defense, the prosecution, in the cross-examination, could have asked him about pretty much anything. And then the prosecution could have called the adopted son as a rebuttal witness.

                            Either way, Sandusky's goose was cooked.

                            They couldn't put Matt on the stand as an victim because the defense was not informed at the opening of trial and didn't get a chance to address his accusations. It would have caused a mistrial and everyone would have had to start all over. The prosecution COULD put him on the stand as a rebuttal witness if Sandusky testified that he had never raped a child, and that is why Sandusky did NOT testify. The prosecution told his attorneys if Sandusky gets up on the witness stand and lies, we are putting up his son to call him a liar.

                            Glad he got what he deserves and I hope he is first in line for the hell express.

                            Rick - apparently his son didn't come forward till towards the end and when he heard that his "father" was going to testify, the prosecution went to the defense and told them that Matt had come forward and they were prepared to put him on the stand. Sandusky apparently had 6 adopted kids. That house must have been a "house of horrors" with a pedophile for a father and a mother who turned a blind eye to the whole thing.

                            I believe they wouldn't call his son during this case anyways....They could use that testimony in a whole new case with a whole new trial with all new jurors if something went wrong in this one. Simply put, they had the monster on the line for enough already, keep that ace in the hole for the next hand if needed.

                            Plus, I believe the son's accusations are simply a financial blocker for the family...he's going straight to civil court, which they'll settle out of court for the whole estate, effectively transferring the family wealth to within the family....leaving the real victims with nothing left to go after....nice move, total BS and I hope they put a hold on all his accounts etc.

We can wish all of the bad things that we want on him, but he will have to answer to the Lord and that will be much worse than nething neone could do to him here. As for the other people who knew and didn't stop it....they are just as guilty as he is!!! and their punishment will be no less than his when it comes their time to be judged. Pray for all of those that he has hurt, because it is many more than just his immediate victims. Their family, friends, even those of us who dont know ne of them. What the hell is wrong with people!

                                  Though I haven't agreed with Rev on some of his prior posts, I agree with him on this! So many posters on these forums seem to be fixated on men who are sent to prison being raped. It is a comment found repeatedly on nearly every story about a man being sent to prison. I find it abhorrent what Sandusky did, but justice has prevailed and he will serve the remainder of his life in prison (and very likely in protected custody). That is how our justice system works. No one should be advocating for people to be raped or murdered in prison. That's your emotional reaction, but rational minds must prevail or our justice system becomes no better than vigilante justice. By the way, do you think you would turn into a rapist in prison?

                                      yankhadenuf - You are correct, up to a point. Wives should not be blamed for their husband's behavior, but many of these incidents occurred in the Sandusky home.

                                      If she's as tuned in to her husband as I am mine (and he is tuned in to me), you notice things. They may be small things or slight differences in behavior, but you definitely know when something is going on. My husband knows immediately when something is wrong, just by my body signals or behavior. Same thing with me. I know when he's not feeling well, when something is off, etc.

                                      Denial is a protective mechanism for all human beings, but when something is wrong, you talk to the person and get the truth or pretend to accept their excuses. Sorry, but child abuse should never, ever be tolerated just because you want to keep the status quo. Sandusky may have offered his wife money, jewels, trips - being the so-called "charmer" that he was - or he may have threatened her in some way. Even if she were threatened, I would hope she would have done the right thing and turned him in. That's the only way to stop such behavior. His wife will now have to worry about civil lawsuits. Depending on the probability of those and the monetary amount awarded, she may lose everything she ever had. Unless the house and property were put in her name alone. If she were smart, she would have had a separate bank account, cash or pawn any jewelry she owns and put it into her account. Then, she might have a chance of keeping something.

                                      Looks like Jerry won't be a threat to anyone anymore.

                                            It really pisses me off when the headline bigger than life states "Sandusky Verdict In" and when I read the article, there's no verdict. I hate the media.

                                                People, you need to remember Clinton & Edwards got into trouble for lying about sex, not having sex. Their sex partners were of age and able to consent. These boys on the other hand, were little kids. The coach got away with it for years because of the winning football team.                                                   I would love to see Dottie stay with him, share the same cell they can sit on each end off their cell and stare each other to death, it would be fitting. she had to know what was going on under her own roof, she is just playing dumb. all their assets should be sold off and awarded to the victims, remove both of them from society.
