Leaving Arizona? After Supreme Court ruling some illegal immigrants may go, others vow to stay

Although the Supreme Court only upheld the 'show your papers' part of Arizona's controversial immigration law, some undocumented immigrants worry about being stopped while out in public. NBC's Mike Taibbi reports.

The U.S. Supreme Court ruling that struck down much of Arizona’s strict anti-illegal immigration law but upheld one of its most controversial provisions has some illegal aliens on edge. But will it prompt them to pack their bags and leave the state anytime soon?

Some may leave but more likely than not most will stay put, say immigration-rights activists and illegal immigrants contacted by msnbc.com.

“The main thing we’re focusing on is advocating for families not to flee Arizona, to stay here and help fight for their rights to be here,” said Opal Tometi, a member of the board of the Puente Movement, an Arizona-based immigrant rights group, and national organizer for the Black Alliance for Just Immigration


Leticia Ramirez, a mother of three who lives in the Phoenix area and says she is undocumented, said the mixed Supreme Court ruling could make day-to-day life harder for her family but they plan to stay anyway.

“If we fight together it’s going to be better for us than just one person fighting  for all the community,” she said.

The Supreme Court struck down key provisions of Arizona’s SB 1070 but said the state could go forward with a much-debated portion requiring police to check the immigration status of anyone they stop, detain or arrest for other reasons if they have “reasonable suspicion” that the person is in the country illegally. Even there, though, the justices said the "show me your papers” provision could be subject to additional legal challenges and advised states not to apply the law in such a sweeping way that it would become unconstitutional. They also said officers can't arrest people on minor immigration charges.

Tometi said the provision requiring police to try to determine the immigration status of a person stopped for other reasons might deter some undocumented immigrants from coming to Arizona. But she says it’s unlikely to lead to full-scale departures from the state, especially for families that have been in Arizona illegally for years -- and even decades.

”I think that people will stay,” she said.

“What we’ve decided as a community in Arizona is that we’re going to do community organizing and defend our families, whether they’re documented or undocumented,” Tometi said. 

Both sides declare victory in court's immigration ruling

She said activists are establishing “barrio defense committees“-- volunteer neighborhood committees that provide a network of support services for people who might be swept up in detention or deportation proceedings.

Ramirez, who said she has been in the U.S. for 18 years, said the ruling will make routine day-to-day activities “difficult” for her family.

“We’re not going to be living a normal life anymore. We’ll be afraid when we get stopped,” she said.

“We’re not going to be able to take my kids to soccer practice, to soccer games, to movies, to the mall because I’m afraid we're going to be stopped. I don’t want to put my kids in that situation. A lot of people won’t even want to take their kids to school because they’re afraid of being stopped.”

She said while some illegal immigrants might leave, she’s determined to stay.

“Leaving Arizona leaving is not going to resolve anything,” Ramirez said. “I would say to my community: Stay so we can fight together. People want to raise their kids and have a family. They’re going to risk it.”

Fernando Lopez, 21, says he experienced the provision firsthand -- being arrested after an Arizona Highway patrolman asked for his papers. The Mexican national living in Phoenix is fighting deportation and says even if he hadn't been caught he'd still fight to stay in the U.S.

"My brother left two years ago when the law was passed," he told msnbc.com, but "running is not the solution."

"The least we can do is organize as a community," said Lopez, who does acknowledge it's easier for him to stay since he's not married and has no children. 

The Arizona DREAM Act Coalition, an organization of immigrant youth and their supporters, said the section that was upheld is "conducive to racially profiling citizens, legal residents and undocumented immigrants."

"We will continue to educate our community on how we can overcome the implementation of this section so the impact to the people in our state is minimized," the group said in a statement.

"We encourage the community to stand firm, to not panic, and to stay informed."

Natalie Cruz, 24, also plans to stay and hopes the DREAM Act will give her some protection while she studies in Phoenix. Among her family, one aunt said she'd return to Mexico if the court upheld the police provision, Cruz said, but others plan to stay.

That's not to say life will be the same. "It is going to change how I do things -- like driving," Cruz said.

Jim Gilchrist, founder and president of the Minuteman Project, a California-based group that advocates tough enforcement of immigration laws, says the Supreme Court opinion is unlikely to have a dramatic impact on illegal immigrants in Arizona.

While local police can inquire about the legal status of someone they stop for probable cause for something else, “that’s apparently all they can do,” Gilchrist said.

“It doesn’t put any serious teeth into enforcing immigration laws,” he said.

The U.S. Department of Homeland Security says even though the agency expects a lot more calls from Arizona police to check people's immigration status, deportations won't necessarily increase because federal officials are only targeting those who have been convicted of a felony or present a securty threat.

Until citizens of all racial and ethnic backgrounds start boycotting stores and businesses that hire illegals, and start fining them, the government and charities stop giving them food and shelter, and people start shunning landlords that rent to them.. they will keep coming. Seriously. What ass-backwards reality do we currently reside in? How people who arrived here illegally have the audacity to start making demands in order to "maintain a normal life", is the most mind-blowing concept I've ever tried to wrap my head around.

Law-breakers who have complaints about existing and proposed laws - if that's not irony, I'm not sure what is. Go back to your country of origin, or stay in the US illegally with the threat of being asked to provide papers - your choice...weigh the pros and cons.

We as a nation have taught a great many residents of other countries a lot of wonderful skills and a tremendous amount of education that should be put to use in those countries to help them become beacons of hope and change. It is very selfish of us as a nation to hoard these extremely talented and superbly educated individuals to our selves, they are valuable assets nay they are national treasures that these countries and their peoples should demand be returned to their rightful home.

In the long run it is a far better investment than sending billions of our tax dollars to these less fortunate countries that their leaders will only spend on vacations, booze and porn anyway and instead return these national treasures so they can take all of those great skills and education and use it day after day to improve their home countries.

I for one believe we need to be helping those countries less fortunate than us, so by sending them back to their countries is a win win for everyone, how can liberals and democrats not see that this is the best course of action to help stabilize those less fortunate countries.

It's up to us, folks. The U.S. government doesn't care about its legal citizens. You can do your part to solve this clusterf**k by not hiring illegals, not patronizing businesses that hire them, and not purchasing products made by companies that hire them (most large meat packers come to mind there). Do some research before you make purchases. Buy locally as much as possible. And please, pay a little more when you need a painter, babysitter, garden help, etc., and hire an American. Do not contribute to nonprofits, universities, or any charity that assists illegals. We the People are the last line of defense here. If we dry up their sources of income, many of the illegals will self-deport. But it's up to each of us.

The more important words in the article were "mother of three" to describe one of those complaining about Arizona. How many illegal alien "mothers of three" should be considered acceptable ???

Our country spent some thing like $3 billion last year just running vaccination programs for low income people. Mothers of three do not come cheaply.

It is time to impeach the right wing 5 (Not so) Supreme Court justices. Have you forgotten that this western land belonged to Mexico? They are the real native Americans along with the Indians. In fact, our treaty with them gave Mexicans the same rights we have in the United States. We have ignored this treaty. I welcome Mexicans to our country. There will come a time when Hispanics and Asians are the majority here and I hope they will have more empathy for us as a minority than we have had for them as a minortiy. I believe in a country without borders where people are free to travel and live. Honestly, our economy does not work without that.

It was actually not recognized by the Crown of Spain as an independent nation until after Spain recognized Texas as an independent nation because we bet the crap out of Santa Ana's army.     Isn't it ironic that illegal immigrants are now saying that they are afraid and can't live a "normal" life because of the AZ ruling?? What they are saying is that the lack of immigration enforcement created a mindset that they could do whatever without the chance of being impacted. That's crazy! If you are doing something illegal every day of the year you shouldn't be comfortable in believing that you'll never get caught. Why have immigration laws if you aren't going to enforce them?!?

    Also interesting, DHS or "big sis" has vowed not to receive AZ's immigration status calls! That is, the federal government isn't going to help AZ enforce it's Supreme Court approved right to check a person's immigration status. To this I have to say "Please just do your job you political hack." Your mandate is to protect the "homeland" but all you appear to do is play politics and that's a great disservice to the country. Look, it's not about political party, it's about protecting the nation's interests. It appears that DHS' version of immigration reform/enforcement is "don't ask, don't tell". Crazy. Again, I feel very bad for any immigrants attempting to stay in this country legally and abide by the laws.

    What is going on? What makes these people think they can come to the United States and not be deported? Someone please put a stop to this. If you are here illegally go home to your normal life we can't feed, house and educate you or your children. You have brought nothing with you but burden and theft. You take jobs from American's and over crowd our schools. You burden our emergency rooms to the point people are unable to get the help they pay for. We are a country built on immigration and with laws that limit how many and who can migrate here. If it takes years to get that slim chance to come here then it is only because we can't take everyone at once.     What this Supreme Court ruling has basically done is told AZ you are free to identify those who are here illegally, but you are not allowed to do anything about it. If the federal government choose not to do it's job and remove the illegals then you have to continue to put up with them and support them through your schools, hospitals, etc. Oh, and by the way, do not expect any money from the feds to help pay fr this burden they are placing on your state. This is absurd!!! The federal government under Obama s failing to enforce the laws of this country is time to get rid of Obama and the rest of these liberals and take back our country.     So the court said they connot arrest with out a warrant , but it's OK to stop people for another purpose then ask for proof of ID and run the ID through the Fed db. But without a warrant, no arrest. IF drunk driving it is possible the perp could be held for DUI and a warrant for immigration could be sought. The person would still be in custody when the warrant is issued. But a simple stop sign violation the person can't be held for, they could split before a warrant comes in for immigration violation. So I see why illegals would be concerned that this ruling is bad for them. But the reality is probably not as good or bad as is being claimed by both sides today.

    While I agree with the vitriol over the Feds refusing the enforce the laws, and then subsequently fight for its right to refuse to enforce the laws...this is not just an Obama or a Left vs. Right issue.

    This is a political football that both sides enjoy punting back and forth.

    This problem is purposely not being solved because it is not a federal issue...it's a state issue, neither party wants to do anything reasonable to solve this.

    Take a look, even CA has tried in the past to protect itself from the cost of illegal aliens (estimated to top $20 Billion in CA alone)...but the higher courts struck down Prop 187.

    Find me (a) candidate(s) that will fix this, and I'll vote for them. But I feel pretty confident that both sides benefit far too much to do anything about it.

    That is the real issue here, if we all start questioning ALL politicians regardless of party currently running for office at any and all levels about their stand on Illegals and let them know that they will not get your vote unless they will support demanding illegals leave or be deported .

    This is has to start now, don't wait, engage any and all politicians demanding enforcement of our immigration laws, if they support or defend illegals let them know they well not be getting your vote, this is the only thing they understand.

    Also as one poster pointed out quit doing business with any businesses that uses, supports or panders to illegals, hit them in the pocket book. A lot of locals here have stopped shopping at Walmart because they have been turning more and more of the store over to products from Mexico. We pay increased prices to have bilingual information on American products only to see whole isles filled with products without a single English word on them. This why I will pay a little more at stores that don't pander to the illegals.

    @seven2seven #1.3--It is still illegal to employ an illegal immigrant in Nebraska. In fact, as long as illegal immigrants can find employment "under the table", they will continue to take the risk of crossing the border. It is within all states' rights to hold all employers accountable by mandating the use of e-verify. Increase the penalties for employers caught knowingly employing illegal immigrants or failing to use e-verify. Once the jobs start drying up, they will leave on their own.

    I for one do not have a problem with undocumented workers here that actually work.

    I went down to Phoenix two years ago and up here in my state, I see these Mexican's working in 110 degree heat, and working hard. I mean they are busting their behinds something serious. Some even serve our country in the military.

    Workers that put everything they have into their work deserves some respect in my opinion. Especially those who serve. After all, I see documented (American) workers not working so much, or at all and many never serve. Yet there is a sense of "entitlement" just because they were born here. Which I find overly convenient on most cases.

    If you served this country like I have, OK, you did your part for God and Country.

    If you didn't serve your country, frankly you're a notch below a veteran, in my opinion.

    Illegal immigrants don't have to be on edge because Federal courts are as slow as snails, they only go after the big fish.

    Involving the states to regulate illegal immigration would speed up the enforcement, but federal courts would get backed up.

    When I was in DHS, we would hand over violators to the local enforcement. For the reason there's only one federal court per state and to have a person prosecuted by a federal court means that they would have to be detained in a cell until a court date or decision could be made. In the case of illegal immigration they would just get cycled back into the population.

    You know, I do feel sorry for the people who were brought here as little kids/babies and have only known the US as their home. It's hard to blame them for something that their parents did. BUT, this "we have the right to be here" statement doesn't fly in middle America. The article painted those interviewed as being fairly "militant" (ok, that may not be the best word) with statements like the "barrio defense committees".

    Sadly, and I know everyone here likes to make things one party against the other, the reality is neither party wants to REALLY do anything about the issue, just play a smoke & mirrors game. For Republicans it affects the wealthy business owners (cheap labor) and for Democrats it's votes from the Latino community. Economists will probably tell you illegal immigrants function as a new "slave class" that props up (or at least differentiates) the middle class. Let's be honest, both parties have had ample opportunities to address the issue but instead talk about silly ineffective things like "building a wall" or the "dream act". Neither does anything either way to address the problem.

        Seems like Arizona is trying to follow Federal Laws, but the Federal government is stopping them. I understand their plight, but their indifference to the huge financial problems is astounding. They don't care that they are drying up local economies with health care, food stamps, jails, ect... When communities have to let police, fire, and teachers go because of budget constraints, think about all the illegals that use those services. The business' that hire them should be charged with treason. By knowingly hiring illegals you are purposely destroying the local economy. When a US citizen can not afford his house and car because his job now only pays half the wage he worked his life for so a business can hire illegals is wrong. Or when a student who receives a scholarship that was taken away from a US born citizen. If you want to come here, do it the right way. What if the US allowd anyone to just come here?         It is unconstitutional for the State of Arizona to try and have State law supercede Federal law. The States have no right to enforce Federal law.

        States have no legal constitutional authority to deport anyone! The court stuck down section 6 which was the heart of the Arizona law, the part that remains was further limited by the court and it will be struck down when a case comes up the ladder and reaches SCOTUS.

        Judge Scalia exposed his Republican underpants yesterday in his ranting, partisan, unintelligent dissenting opinion.

        The Republicans are the ones who want to destroy the Constitution.

          My grandfather came over here from Germany when he was only 16 back during the German Depression, before he came he had to be sponsored from a family member in the US.           Janet Napolitano needs to rename ICE. You can't have ICE without "enforcement". I can't believe that we have a president who is purposefully refusing to uphold the laws of our great country. The US Supreme Court has stated that it is the federal government's responsibility to enforce immigration laws according to the US Constitution. The president took an oath (twice) to uphold the US Constitution and he makes a mockery of it. Last week, he said he was not going to enforce immigration laws against a defined group of people. He does not have the authority, even as president. Yesterday, he withdrew section 287g status from Arizona law enforcement and directed Immigrations and Customs Enforcement to provide no assistance to Arizona law enforcement. This action circumvents federal law. If illegal immigrants violate state law and it is determined that they are in the country illegally, where are law enforcement agents going to take them if the federal government won't take them? They don't have the authority to deport them.

          I can't imagine 4 more years with this arrogance.

            This is just inaccurate though. I am a white American and perfectly legal, but I think that your statement that "If you are LEGALLY here in the United States you have no worries whatsoever." is abusurdly inaccurate. Why not just ask any African American who has been trailed through a drugstore for not stealing if they are living an equal hassle free life??

            This ensures that any person who is Hispanic or has an accent must carry papers at all times whenever they leave their home, which is EXTREMELY cumbersome whether or NOT the person is a legal citizen. Whatever you think of illegal immigration, that is a crazy position to take.

            This reminds me of the people who were defending the US policy after 9/11 of indefinitely holding Muslim Americans for "questioning" without attornies and then insisting that if they were "innocent" they had nothing to fear.             I think alot of you are missing the big picture here. Illegal immigrants are violating FEDERAL LAW, that means FELONY. There is no such thing as a misdemeanor felony.             I think the point Go_Obama is trying to make is that how many people on here actually carry proof of citizenship? I do not carry my passport or birth certificate everywhere i go. Yes, racism is alive and very prevalent, and our age/skin color/appearance makes law enforcement (who typically are reactive individuals to begin with) stop and question (or harass) people all the time. If I go walking in a wealthy neighborhood wearing a Metallica t-shirt with spiky hair and metal piercings I guarantee the police are going to stop me. But if I wear a 3-piece suit and drive a fancy sports car into some impoverished areas the police are also going to stop me (on the rare occasion that police are actually IN those neighborhoods). If I get on a plane wearing Islamic clothing, or for that matter go almost ANYWHERE dressed that way, I guarantee law enforcement is going to watch me. Is it fair... no, but it's a shared reality for many people and you learn to deal with it (I make sure my hands are in plain sight when a cop pulls me over because I know he is already on edge).

            And aside from legal reasons, it's best to carry some form of identification with you anyway. If you get hit by a bus walking to the store it's going to be a problem when nobody can figure out who you are.

            That is not what this law does now. Those parts were stricken down by the Supreme Court. The only time police can ask for your citizenship status and proof of it is if you are pulled over for some other reason in which there is reasonable suspicion to do so. Cops cannot pull you over because you are Hispanic or look of Mexican descent.

            Not that I 100% agree with the law but they are here illegally. Force them to obtain citizenship, green cards, or face deportation.

            What's extremely cumbersome about putting your wallet in your pocket? He knows that he's not getting the Hispanic vote anyway so why not show some balls and take a stand firmly against illegals?             In Indiana, adults are required to present a Photo ID if ask by a police officer. If you don't present one you will get a ticket or be held until they know. If you aren't breaking the law you shouldn't have a problem with the police asking you questions. If you act scared, mad or suspicious in any way the police will hold you longer and make sure there is no reason they should arrest you. Criminals don't like police. Law abiding citizens like police and don't mind seeing the police do their jobs.

            Go_Bama, everyone carries ID on them every day. It's whatever license or Photo ID you carry. I still carry the original SS card I got when I was 16. If you are a legal Immigrant you should have your green card on you.

            All of those things will prove you are a US citizen or are legally in this country. At least one of those things is in every LEGAL US citizens wallet at all times.

                          Anyone who admits to having invaded this country in violation of our laws should be arrested by ICE and deported.

                          Unfortunately, business that wants illegal labor will win the battle because MONEY ALWAYS WINS.

                          Our best move would be to annex Mexico and make it our 51st State and then they would all be legal and our employers would not want them anymore.

                          They only want illegals as long as they are illegal because they can't complain about being cheated on wages or workplace safety conditions. Since illegals are illegal they can be abused by greedy employers and the illegal worker can't complain to the authorities.

                          Alternatively we could grant citizenship at the border and that would end the desire of employers to hire them too.

                          Employers don't want to pay American wages so they import cheaper labor.

                          Make the illegals citizens so they are covered by the workplace safety laws and wage and hour laws and they are no longer a desireable hire.

                          I, personally, think every single illegal should be deported .... but what I think doesn't really matter because BUSINESS will get what it wants. They own the Supreme Court and most of our Congressmen.

                            They came here with permission. They worked, they contributed, they paid their taxes. They had children and grandchildren who did the same. I am proud of them and happy they lived long enough to see most of us prosper.

                            They came here and learned the language. They worked here and wanted to be USA citizens. They wanted that for their children and grandchildren.

                            If you came here, knowing you were breaking the law, I may understand why you did it. But you are owed nothing. Nothing except maybe a bus or plane ticket to your original home.

                              As a matter of fact Zach I do have a wallet size certified copy of my birth cirtificate that I obtained from the state I was born in. I got it when I used to go to Mexico on vacation before you used to have a passport. I do carry it. Sorry about the first part of this, not intentional :) recently a law was passed that you do have to have proof of residency and citizenship to get a drivers licence. Where I live anyway I thought it was national but I may be wrong, have been before.

                              All illegal immigrants should immediately decide whether they are going to LEAVE or follow the LAW and try to gain permanent residency the LEGAL way. Otherwise, they are BREAKING THE LAW JUST BY BEING HERE. This goes for people from ANY country who are here illegally. File the paperwork and get legal or GO HOME!

                                Hey...why should America/Arizona have to deal with this issue. A simpler solution would be to bring our troops home from where ever and declare war on Mexico(maybe call it The Dream War) and reverse the invasion process. Hell America could than expand its southern border and do away with its costs of enforcement. A win, win situation-get all of Mexico annexed and call it Arizamerimex.

                                Time to stop allowing these illegals to live free...but have them live under the umbrella of freedom in their native land. We're being invaded here, were being taxed with no representation, were seeing our schools and way of culture threatened, were being asked to bear too much for nothing.

                                While I think this country is in MAJOR need of immigration reform, I am against anything that threatens our Constitution and the rights of our people.

                                Some people are so obsessed with "getting those illegals" that they very ignorantly and stupidly have no problem giving up their own Constitutional rights to do it.

                                I do NOT want to become a country where we have to "show our papers" during our daily walks and activities - One of the Freedoms that many died for was the ability to move freely in our Country without harassment.

                                And, no, showing your driver's license for the "priveledge" of driving is NOT the same thing.

                                As Benjamin Franklin said, "Those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety."

                                Are some of you people really naive enough to think that the government will be eager to give back to us the rights that we freely give up?

                                No-one has to show their papers during daily walks or activities We are not giving up any constitutional rights since they have to be in the commission of a violation or something illegal before they can be asked to prove their citizenship. Stating that they are going to demand that anyone who is walking down the street must prove their citizenship is nothing more than trying to make it look like it is going to take away citizen's fundamental rights is a line of BS. It doesn't make any sense since it is totally incorrect. If you are doing nothing wrong there is nothing to worry about.

                                Donna: Let's say you are driving to work and failed to come to a complete stop at the red light before making a right turn. The police pulls you over for a moving violation. He asks to see your drivers license, registration and insurance. Two blocks down he does the same thing to a Hispanic motorist. But this time in addition to the drivers license, registration and insurance he asked the motorist for proof of citizenship. Should the motorist have had his passport or birth certificate with him/her? Why weren't you asked for that information and if so, would you have it readily available to show the officer?

                                I agree with you about reform, but here's the thing about "getting those illegals"...

                                We are INNUNDATED with extra costs from schools educating the children of illegals, "Anchor Babies" scare politicians into not deporting the parents because of the tears and outrage the cameras would catch, and so for every child born here, there are countless family members we have to support w/ food stamps so as not to split the family up, and the ER's are utter nightmares in flu season because they come in to somewhere they have to be treated. SOMEONE has to pay for all that. We are BROKE, and can't even help our own legal citizens.

                                The negligence of politicians in BOTH parties has gotten us to this point of "asking for papers". If they would have done their jobs, this could have been nipped in the bud a LOOOOOOONG time ago.

                                I'm sick and tired of subsidizing illegal activity. If you don't like the laws, change them as you mentioned, but I REFUSE to be labeled as ignorant, stupid, and/or a racist simply because I believe people should respect and obey our laws.

                                And those who think Arizona is a swing state...Obama can kiss that possibility goodbye. The outrage is palpable, to say the least. This issue irritates more people than just those living in the mayhem that is Arizona. Immigration is in the top 3 of issues voters are concerned about following the economy and healthcare, and he has blown his chances too many times.

                                Donna, your comment is not accurate. Going by the wording, they do not have to be "in the commission of a violation or something illegal" to be asked for ID as you say.

                                It applies to anyone they "stop, detain, or arrest". Stop for what? to ask a question? Detain why? because they jaywalked or "looked illegal"? because they spoke "broken" English? How about the citizens of Puerto Rico who can be here legally on a visit? Even though they teach English in their country, there are many who are bad at it like many people here are bad at learning a second language.

                                One of the most frightening (and ignorant) remarks any American Citizen can make is the one you made "If you are doing nothing wrong, there is nothing to worry about". Talk about throwing the Constitution out.

                                So - according to you - any member of law inforcement has the right to go into your house anytime if you have nothing to hide. If you are arrested falsely, there is no problem because if you didn't do it - you are safe from jail or erroneous prosecution. You have no problem submitting to searches so any cop can look in your vehicle any time. Do you know how many "Rights" you have willingly thrown away by your statement - Rights that many people and soldiers have DIED to give you since the dawn of this country?

                                I have no problem enforcing immigration laws. The woman named in the article in my opinion should get a visit from ICE. Social Security sends a notice to companies who have "errors" in social security numbers of their employees. Many of these "errors" are illegal aliens using duplicates or phony or deceased IDs. Do you know what happens to companies if they don't fix these "errors"? Nothing.

                                Banks like "Bank of America" opens accounts without Social Security numbers for illegals. If all American citizens need social security numbers to open an account here, I have no problem with ICE checking out the ones that don't. Illegals can also file federal taxes by getting a "tax number" to pay federal taxes. Why doesn't ICE check out the IRS files for non-social security filed forms?

                                We already have many of the laws we need for immigration - many are just not being enforced. There is a "blind eye" turned toward the problem because people like Obama need certain "latino" votes.

                                We already can make a dent in the "illegal alien" problem if we want to WITHOUT sacrificing the Constitutional rights of our citizens.

                                Is the woman in the article going to get a visit from ICE? probably not. Bank of America had advertisements proclaiming that they were opening accounts without social security numbers. Did ICE check that out? Did you know that some illegal aliens file federal taxes by asking for a "tax ID number"? Does the IRS notify ICE? Nope. Remember the lawyer who sued someone on behalf of some illegal aliens? He filed their federal back taxes for them during the suit so it would look "respectable".

                                The social security office sends out notices to companies if there is something "funny" about the numbers they put in on employees so the companies can check it out. Nothing happens if 20 illegal aliens are using the same number. the company just gets notices with no penalties.

                                California Bar just said illegals aliens can get law licenses. Why is that ok?

                                We have many of the tools we need to enforce WITHOUT infringing on Constitutional rights. Instead, we stupidly allow the government to "play" us by taking away our rights and not enforcing the laws we already have. Somehow we think this will solve our problem, when the problem isn't only the illegal aliens - it is our government who is more concerned with power and elections then they are with serving our country and its citizens.

                                If your "daily walks and activities" involve things where you are "lawfully detained" by police, then it looks like you have a serious problem. The law doesn't allow police to stop someone who they suspect is here illegally, that was leftist media propaganda, instead it allows police to verify the status of someone they HAVE "lawfully detained". No rights are threatened there as the Supreme Court ruled.

                                If you are so concerned with the "Constitution and the rights of our people", then you should be more concerned with a President who refuses to enforce our laws and protect our borders.

                                I hear and agree with everything you are saying. My point was: don't assume people are ignorant and stupid just because they are desperate to make the bleeding stop.

                                Yes, I am PAINFULLY aware of all the things you mentioned, anyone paying ANY attention at all would be. We are in a horrible situation, and because people are more than willing to let politicians from BOTH perties conduct business as usual, some of us are now at the breaking point and are willing to risk losing an arm by applying a tourniquet in an attempt to avoid losing so much blood that we bleed out entirely.

                                Go after the politicians who made this mess, NOT the people Obama and his administration have abandoned, adding insult to injury. Your comment:

                                I wasn't actually "assuming" people (some, not all) are ignorant or stupid (no offense). The definition of ignorant generally means "lacking in knowledge about a subject" and the definition of stupid generally means "making foolish decisions".

                                It was not necessarily derogatory as everyone has been "ignorant" or "stupid" in situations throughout life, myself included. I was basing my comment on many of the remarks I hear when illegals are mentioned - its as if rational thinking goes out the window.

                                I liked your analogy about the tourniquet, very appropriate. And I do agree with you about the politicians - both parties - who have abandoned their people. Speaking of Obama, I wonder if ICE ever visited his undocumented relative. Guess not.

                                I am curious, though, if many people realize that their produce - almost all farm produce - will almost double in cost if illegals are deported. That the IRS received about $50 BILLION from 1996 to 2003 from ITINs (non-social security numbers) from many illegals on federal taxes. that 28% of dishwashers in restaurants are generally undocumented. 31% of roofers, and 40% of masons. That Businessweek ran an article last year about being a "Patriot" by hiring an undocumented worker. The list goes on.

                                We need major immigration reform, but it should NOT include harrasment of anyone nor infringement on rights.

Those who lambaste the opinion on this issue are as erroneous as those who crow about it being "upheld." In all likelihood, unless AZ moves carefully on this, the issue will be resurrected in the Court when it is ripe and today they delivered a clear warning as to how they will view it when that time arrives.

                                      “If we fight together it’s going to be better for us than just one person fighting for all the community,” she said.

                                      Ms Ramirez speaks about fighting for her rights but doesn't see fit to go back to her own home country and fight for a damn thing. Ms. Ramirez speaks of fighting for her community but, that would be a community of people who blatantly disregard the laws of this country. Ms. Ramirez seems to believe she has a right to some sort of involvement in the American Political and Legal process and yet the only place she holds in that is one of the self-imported disenfranchised illegal immigrant who has no voice in our political process and for her greed and self-serving, out spoken position should be deported and at no time ever allowed to come back into this country.

                                      Ms. Ramirez should understand that there are many like me who will fight for our communities of legal citizens and legal immigrants. Those who actually have some skin in the game and who should be directing our Political and legal practices. Those who live honest lives and value the lives, health and safety of our children beyond what illegals wish to import to the United States of America. Ms. Ramirez should understand that there are citizens who will stand and fight against those who wish to impose their corrupt, political and personal agendas on those who wish to bottom feed off the American working public.

                                      Now I truly hope Ms. Ramirez finds herself in the position of a broken tail light and well gets pulled over, asked for her documentation and then gets deported. It isn't a far ride to the border in Arizona.

                                      So to those illegals in this country who think they need to participate in the political or legal process...I suggest you go back to your home countries and do just that....participate and make a difference in the corrupt system that spawned you. Support the cartels in the home country that spawned you, we don't need them here. Support the gang mentality that suggests that you do what feels good in your own country. Take the criminals you support with you and be on your way.

                                      Gosh Invisible Hand....go figure when we moved abroad for a time we actually followed the immigration policy for Britain. We didn't overstay a visa or pay drug runners to transport our children in the dead of night with God knows who. We completed the appropriate documentation and actually lived out in the open with the British and other Expats in our community. It is called having respect for the people who host foreign families. It is an absolutely acceptable and respectful practice.

                                      Yes I am fortunate that my fore-bearers, puritans, came to the new world who's descendants actually fought for the start of this country. I am fortunate that I have family that immigrated to this country through Ellis Island as witnessed by their signatures. I have distant relatives who legally immigrated to Texas and then had to fight a vicious dictator for the right to their lands. So yes I am blessed and fortunate for my circumstance of birth.

                                      That whole BS about risking life and limb yadayadayada is just sensational rhetoric....the illegals overstay visas...what risk is there in that all they have to do is fade into their surroundings, they cross at the border using another person's id...oooh that's so risky. They place their children in the hands of the cartel to traffic them across the border and are surprised when they ask for more money or favors or when their daughters are sold for $5 an hour to another illegal immigrant for sexual pleasure. Just for that they should be expelled or imprisoned. So fear of prosecution or deportation...really once prosecuted or deported they come right back using a different stolen ID. They sell drugs, they steal, they murder and rape...But their worst offense beyond the identity theft, the abuses to their own kids SS#, the debt that is incurred because now that they are here they wish to put their hand out and take from Federal programs, state programs, lenders that they easily walk away from, health care bills they walk away from...the worst offense is the damage they have done to our legal system of immigration by reducing our effectiveness to foreign nationals who come here with a desire to work legally or to become an American Citizen. Who risk everything to apply for membership in the greatest nation on earth. Those who wish to come here and participate fully in society and not just take what they want or recreate the corruption they escape here. These who want to be Americans who are required to jump through every hoop and pay tremendously for the opportunity are the ones who suffer most. The people that we gladly wish to be our neighbors. Those who bring the best of their individual nationality to our melting pot, not the worst and certainly not a blatant disregard for our Society. They are the ones who suffer because the greater the criminal diversion the harder it is to screen good people who wish to be a part of our nation of laws.

                                      If those people who toil truly wish to achieve the American Dream here is a clue....follow the law. Go home and apply, get your Aunt, Sister, Cousin, God Mother to sponsor you to come to this country legally. Then go for that American Dream as a real American. Of course if the Aunt, Sister, Cousin, God Mother or the immigrant that they sponsor can't pass a background check then you shouldn't bother to apply to come here.

                                      txmom32, I thought that you might be interested in the fact that colleges, and high schools, are teaching that people should NOT join the melting pot, that you mention in your post, that is America. They should rather, keep whatever their home countries way of life was, and not become, "Americanized."

                                      You see, the argument that people like you and I are having with the White people who think, that they are bad; they are teaching this in school too, and everyone else who thinks that they are entitled; yes, school again, they should try the stuff in their home countries that they pull here, is impossible. There is an entire Socialist Based school system out there, everywhere, and out of our control, teaching those in school that it is unpatriotic to be a proud American, they should not be part of the Great American experience, and that America does bad things; no good things, just bad things and therefore, they are bad too.

                                      When a kid starts learning lies and Socialism at the age of four, what do you think that you or I can do to fight the madness, the gullibility, that they bring to the table when they argue/debate with us? They think that we are from another planet. And we can't understand how anyone could be so ignorant of life, laws, and their own country. Our children, and our children's children are being educated into ignorance. This is a very bad road that we are going down.

                                      AJV...I'm not sure what your point was but here is my experience. I have lived out of the country and the only person who ever spoke ill of America was a young Dutch boy who's mother was an American and who's father was Dutch. I can guarantee that his distaste for America did not come from his Mother as she wished for her Husband to be transferred to America...when his transfer came through they were off to the Netherlands, a move that sent her into a great depression. Her biggest concern was the fact that they could not escape open drug use and the openness of prostitution. The second concern was to untangle their financial history so that she could preserve her share in the United States. I do think that her husband had contempt for the US and that is where the young man adopted his attitude.

                                      As for my day to day now...I live in an area where most of the homeowners have a different home country. Some have gone through the process to become citizens and others are passing through so that they can rise within the ranks of their companies. I live in an area that is supported largely by international business. If the company sees a good for an employee they offer them a foreign assignment because, to grow with these companies a foreign experience helps open minds. In order to work with these companies it is very important to have a healthy respect for the immigration laws of any country that you live or work in because if you pi$$ off immigration you are just not welcome back, if you work with a company. This should hold true at the personal level as well. Please understand that I love my neighbors and I certainly respect the cultures that they bring to the community and they do so respectfully. It is a source of pride to me when I look around on Flag Day, Memorial Day and the Fourth of July to see more and more flags going up every year. It isn't because we have a great turnover of real estate, rather more and more of my neighbors have completed their requirements and have become American Citizens. Those flags are very important to them. As I said above they can adapt and still bring the best of their heritage with them.

                                      As for school...I personally miss the International School my kids attended in Brittan. It was a good education but also a constant party to celebrate the important dated of every nation. It was respectful and tasteful and the kids learned to take away the best in everyone. The schools they have attended since we have returned do teach a bit of a different value system as their curriculum. Fortunately, they talk to me and fill me in on their information stream. When they came home and started telling me how all white people were horrible for the way they treated slavery....I had to find resources that supported the fact that it was actually White people who set up the underground railroad. It was actually White males who could cast a vote to abolish slavery, as it was White males who truly made the difference in allowing women to vote. Just an example I could go into more.

                                      It seems to me that schools will naturally teach socialism and some sense of apologist for being American because that is the system that gives them rise. Public schools by their very nature are socialist havens. It takes the collective to support a school. So it would be counter productive to them to promote an ideology other than what makes them function. This is why we should encourage our children to talk to us about their school days and about what they are learning in Social Studies. Public Schools are terrific for guidelines but they certainly are not the end all a be all for an education. Example: my daughter had to do a paper for her 9th grade social studies class. The topic she chose was the most recent recession and how to emerge form it...I resisted the urge to help her with this project even though she was not working with a partner. I did touch base with her more for the support of keeping her on task so the paper and power point would be completed on time. What I found out was that she was using a campaign site to support the paper instead of a viable source. I asked about it and that was the source information that her teacher directed her to when she was having trouble doing a search. So, the mom that I am, directed her to a couple of credible, non propaganda sources. She ended up with a 90 on the paper and felt she could have scored higher if she had used the teachers source.

                                      The fact of the matter is that if parents just leave the schools to educate and do not get involved we are going to have a hugely messed up generation of people taking over America. We as parents need to keep up with our kids and teach them critical thinking so that when they grow-up they aren't dependent on someone else for their every thought.

                                      This will be challenged in court the first day...........either you check every speeders papers or none. Anything else is profiling.......period and the Supreme court said as much. They know it will be back as early as next session.

                                        Thing is Kathryn....If a cop stops someone for a traffic violation they should ask everyone for the drivers license, registration and insurance. If a driver can't produce that information the officer should automatically request citizen documentation, proof of address etc.

                                        The reason this has had to be placed into legislation is that illegals don't usually possess a drivers licenses, typically don't have any insurance. Then the illegal community complains that they are harassed or profiled because they do not comply with the law so the statistics are skewed against them when it comes to violations. At that point groups like La Rasa can claim some conspiracy against Latinos. So absolutely fabulous that a police officer is able to request more information from a driver if they do not produce the commonly requested 3 pieces of information...Drivers License, Registration and proof of insurance. If you are a foreign national who is driving in the US then the proper form of documentation would be a DL from the home country and a pass port, green card etc. The only reason not to comply with a request from a police officer is if the DL or pass port is not physically on their person ( then you go to court prove your situation pay your fine and go about your business) or if they are criminals who fear a background check (because they do not wish for the cop to check and find a suspended license or warrants) or if they are illegal and just wishing to skate around US law. In this case they should absolutely be sent to detention, placed in front of a judge and deported with the condition they are never welcome in the US again...ever.
