Kerry Kennedy says car accident caused by seizure

Kerry Kennedy, a daughter of the late Robert Kennedy, says she believes her recent accident on a New York interstate was caused not by drugs but by a seizure. NBC's Craig Melvin reports.

NEW YORK -- Kerry Kennedy, the ex-wife of New York Governor Andrew Cuomo and daughter of Robert F. Kennedy, pleaded not guilty on Tuesday to a charge of driving while impaired by drugs and said her accident was caused by a "complex partial seizure."

Kerry Kennedy, 52, was found slumped behind the wheel of a white Lexus of Friday morning in the Westchester County town of North Castle an hour's drive north of New York City. A witness said she had hit a tractor trailer and left the scene.

According to a police report she was swaying, had trouble speaking, and told a police officer she may have accidentally taken a sleeping pill on the morning of her accident.

Speaking after her arraignment in local court, Kennedy said she was "confused and erratic" when she spoke to police and denied that her accident was caused by drugs.

Investigators say Kerry Kennedy admitted she had taken an Ambien after being arrested for driving while under the influence on Friday, but family members are now suggesting the mother of three may have suffered a seizure. NBC's Jonathan Dienst reports.

"I have never had any history of drug or alcohol abuse," Kennedy, who is known for her work in human rights, told reporters outside the North Castle Court. She was flanked by members of her family and her lawyer.

Kennedy said she did not remember anything after entering a southbound highway from her home to go to the gym and before finding herself stopped at a traffic light with a police officer at her car door.

Tests at a local hospital soon after the incident showed no alcohol or prescription drugs in her system, she said, and further neurological tests led her doctor to believe she had suffered a seizure for the first time in her life.

"This accident was not caused by a sleeping aid, but a complex partial seizure," Kennedy said. Kennedy said she would continue to receive treatment for the condition and should be able to live "symptom-free."

Results of urine and blood tests are still pending, a police report said. These would be subject of her next court appearance on August 14, her lawyer Robert Gottlieb said.

She apologized to the driver of the tractor-trailer she hit and other drivers on the road Friday morning

Kennedy's accident came two months after her sister-in-law and close friend, Mary Kennedy, killed herself. Mary Kennedy was the estranged wife of Robert F. Kennedy Jr., the son of the late Senator Robert F. Kennedy and nephew of the late President John F. Kennedy.

First the Commerce Secretary had these complex seizures that caused 3 hit and runs.. Now this? It is amazing when people that can actually afford to have an accident always get out of it becuase they have these never before existing "complex seizures" that cause them to still be able to drive but only have seizures when they do something wrong. Take their licenses if they use this BS defense because they are a danger to themselves and others. It's just rich people taking care of rich people and using less fortunates as "examples" to the other less fortunates when they stand trial. Class Warfare is alive and well in the USA it is a battle fought daily by the rich politicians and their government cronies. My, what nasty people.

I have a niece who has epilepsy and also worked with people with developmental disabilities, many of who also had epilepsy, some years ago. Epilepsy can occur at any age--it can also be the first symptom of a brain tumor, incidentally.

My niece was presumed to be a drug user in h.s. as her seizures started getting worse with puberty, were not well-controlled with medication (complex partial seizures can cause strange behavior, like wandering out of the classroom), and the medication itself was keeping her zonked out.

Ms. Kennedy is likely to lose her license for at least a year due to a medically documented seizure.

"Losing your license" is not automatic. I was able to bring my seizures under control with medication very quickly and was never reported to DMV by my doctor. Where I live, they only have to report if you have a medical condition that cannot be managed medically and you are unsafe. I just followed her recommendation to not drive. I did chuckle when I read that she will live "symptom free". The medicine can kick your butt and give you a whole new host of symptoms! But--it is better than seizures.

You need to be seizure free for 6 months before you are permitted to drive again unless your seizure was caused by something other than epilepsy (ie abnormal EEG). And I agree, the drugs have nasty, nasty side effects. Wouldn't be worth taking them just to pretend you're epileptic to get out of something.

Some of you are ill-informed and just awful. She tested drug free- prescription and otherwise. But I guess jokes at other peoples' expense are always cheap and easy, now aren't they?

As far as seizures go, yes they can make you do some funny things. I have had epilepsy for 14 years now, and I will do stupid things, unbeknownst to me, in a seizure enduced fugue. I once was at a business function, roamed the hotel in the middle of the night topless, and "woke"up in the elevator. I've come to in the middle of conversation I didn't know I was having, I've lost days and weeks of memory, I've wandered into busy streets, I've stopped breathing, I've lost teeth- well I've done a lot of things. Seizures have stolen a lot of my life- it's easy for you all without this problem to joke, but I have organ damage from medication, and cannot have children. I have slight brain damage, so I slur my speech, and juxtapose my letters when writing. Everyday begins with a headache and 7 pills. I'm not even 30. It is perfectly reasonable for Ms. Kennedy to have had a seizure while driving, and then drive away, or say things she doesn't remember. The brain is complicated my friends.

Hopefully, her type of seizures are not re-occurring, because this is not an easy disorder to live with, and if they are a new part of her life, I hope she gets good treatment, and it can be treated with medication, with the least amount of side effects, because that's no fun either. Yes, people are awful. Since Joe made his millions the family has been in a scandal of some sort for every decade, if not more, people are going to poke fun at them. Yes people, HER doctor stated there were no drugs in her system. Let's see what results the state get. If they get the same results then good for her. I hope she can get treatment.

Sometimes I think that nothing on these discussion threads can surprise me anymore. But I am still a bit surprised by the vitriol toward this woman. Prior to this incident, how many of you who are posting nasty, judgmental comments had ever even heard of Kerry Kennedy?

How is it possible to jump from "never heard of her" obscurity to dismissing her value as a human being because of this widely reported incident?

What if it turns out, when all is said and done, there were no drugs or alcohol involved, that she suffered a seizure as a result of a medical issue which was previously unknown?

Is it that surname; "Kennedy"; Is that what it's all about?

Seriously? This woman, 52 years old, and regardless of whatever good deeds and personal accomplishments during her lifetime, is condemned because of her last name?

If this incident had occurred in our own community, and the woman's name was Kerry Smith, and we knew nothing more than the "facts" reported so far ... would we condemn and prejudge this person and dismiss the rest of her life's worth, or would we be interested in finding out what happened to her and concerned whether a seizure or bad reaction to a prescription medication caused this incident?

What does this say about any of us? What does this prejudgment and vitriol say about you?

I used to have seizures. The memory loss is common. I was lucky, I grew out of them shortly before I turned 14. Not sure why I had them, but some of the female relatives on my father's side used to have seizures, according to some relatives of mine, so the most probable cause at this point appears to be genetics.

First time, I was 6 and at cape cod. My dad told me he had to take me to a clinic, my mother told me I threw up. I don't remember any of that to this day, that was 16 years ago. I was also told my sister annoyed a nurse at said clinic to the point of insanity -- I can't recall that.

As if having one on vacation wasn't bad enough, I had several more in school in front of classmates. I was the weird kid who had seizures and would wake up on the floor with drool or vomit coming out of my mouth post-seizure. I hated it, especially since the meds they put me on didn't seem to help for long or had nasty side effects. A memorable side effect of one medication I was on was alopecia. Hair loss at 11. I was not happy.

So, unless there is something in her blood work when the results come back, those of you hating should shut it since I doubt any of you have had a seizure in your life. Those of you who mentioned having seizures or knowing someone who does, you're in my thoughts.

This whole story is really pissing me off. As someone who has a history of seizures and how it affects you during and after having one, I can tell you that you simply don't come out of one with a clear head or even have any control of your body during it. Simply be virtue of the term, "Seizure", your brain does exactly that...it seizes...and let me tell you once you have one, you are done for the day and need time to rest...you don't come out of one...la de dah...and go for a walk...It doesn't work that way. These people are so full of $hit.

I have a friend who suffers from complex partial seizures. She acts a little odd during seizure, and then has little or no memory of the event. It isn't funny. And yes, such an event can happen to an otherwise healthy person with no history of epilepsy. In my friend's case, though, it's a recurrent problem.

Maybe we could give this Kennedy lady the benefit of the doubt? Nah, let's bash her 'cause she's a Kennedy. Yeah, that makes me feel good.

Having seizures myself and having them not start until mt mid 20's I can understand Mrs. Kennedy. About 3 years ago after not having any for over three years, I had one behind the wheel while crossing a bridge. I remember getting on the bridge, but nothing else until I came to in the bushes of a fast food restaurant that I ran into after hitting four cars. Several of the people that I hit actually helped to break me out of my car, including a local sheriff. Try to remember, Just because you can't see someone's illness doesn't mean it doesn't exist.

Like all the rest Joe Jr. too was a jerk. During the war him and his brother JFK came home on leave which I believe was very unfair to all the others who had to wait until the end of the war before coming back home. While at home JFK showed off his medal which he did not deserve and Joe got all upset and so he went upstairs into his bedroom to pout "why did he get a medal, I should of got the medal, it's just not fair". He only cared about self glory. To keep him happy daddy promised him two things, one he'll make him into a president after he returns home from the war and two he'll make him into a war hero with that useless mission which got him blown up. Actually she allowed them to take blood and breathalyzer so if anything came back from that we'd of known. I know for a fact that a seizure can cause you to wipe out a car because my hubby wiped out two of mine while having one and his mother who also suffers from the disease would end up in far off places and couldn't account for how she got there while driving and her license was just recently taken away. They just placed a medical hold on my hubby's. You wouldn't beleive what it takes to get it taken away from people with seizure condition. My hubby is stubborn and I don't like the kids to ride with him unless I'm in the car and can see if one is perhaps coming on so I can take the wheel.

If you are a Vet, perhaps you should respect your fellow patriots who also served their country in many capacities. Perhaps you should research seizures...they can happen to anyone - they are equal opportunity.

Patrick Kennedy, her cousin used the Ambien Defence....which was her 1st. excuse...but he had to plead guilty. Now being better informed of Sec. of Commerce claiming seizure and having no charges against him, she just gets the Kennedy Family Neurologist to say she had one of those Upper Class Seizures....

Ever hear of a MOB Doctor...the ones paid well to do whatever is requied by "The Family"...

Being the ex-wife of New York Governor Andrew Cuomo, doesn't hurt either....

I have taken Ambien. They are classed as a Sedative/Hypnotic, and are only to be taken as you are literally about to go to bed for at least 8 hours. Here is what Ambien can and most likely always would do to a person if they took one and did not go to bed...I know, I did just that because of an accident with my son that occurred 5 minutes after I took one at 11:00 PM. You KNOW you took something, but do not really get sleepy. From what I was told I appeared confused and drunk. I did not remember anything after getting in the passenger seat to head to the hospital, yet I was told that I was awake, yet acting "out of it."

Some people experience auditory as well as visual hallucinations...all I remember was not feeling the floorboard of the car I was getting into. I was later told I was not putting my foot on the floorboard, nor was I all the way in the car! Some people feel very relaxed and can remember bits and pieces of things, but like I said...I remember nothing after sitting down in the car. I woke up the next morning in bed, but for a while did not even remember that my son was injured or anything else. I have never taken Ambien again and I never will.

If she took an Ambien and did not go to bed, I don't know how she could say one way or another what she did. I am glad that I was not home alone with my son, or I most likely would have tried to drive, when normally I would have known better. If you take Ambien...go to bed!

In New York, a person must be seizure-free for one year in order to drive again, BUT there is a huge loophole that allows for exceptions at physicians discretion. Ms. Kennedy should hire a driver for a year--or take the bus or train--and go without driving, then review her health over the past year before resuming driving herself.

I had to sit my little girl down at age 15, and explain that the seizures that showed up out of the blue when she was 11 years old were enough to keep her from even taking the "book" portion of drivers' ed, let alone ever possessing a driver license. In our state, a person has to go six months without a seizure to be allowed to drive, and a physician must approve. In my kid's case, she will not likely ever go that long without a seizure and the physician would not give approval in any case.

Ms. Kennedy could take up a new cause, to push for safe and reliable public transportation for people like my kid, who will have to rely on such for her entire life.

Sorry for your daughter but many of us are tapped out and disgusted. Unhappily, we are not all in this together anymore. Also, I doubt Kennedy was sober. Another Kennedy was stopped at the capital a while back and that was put under the rug. They are a despicable family.

While I can agree with most every post regarding the Kennedy's, I would like to know how her doctor can be so sure that she had a seizure. My brother, luckily was not in an accident, but suffered a seizure of some sort while driving. They do not know the type of seizure or what caused it - he has to be having a seizure for them to diagnose the type and if in fact it is a seizure. So for her doctor to say it was a seizure - I don't buy it! My guess is one too many ambien in the morning!

Not true. Perhaps your brother had a neurologist who was not a specialist in seizure disorders. An EEG detects abnormal rhythyms in the brain. A seizure is not necessary. The testing can be done over many days by wearing a monitoring device attached to electrodes which are 'glued' to the skull.

    There are many types of seizures. Most people are familiar with grand mal seizures where the person is totally out of it and shaking. My daughter with Rett Syndrome has partial complex seizures. There are many types of seizures including absent, myclonic, simple, etc. I am not saying that she is telling the truth about having a seizure but it can happen as an adult and it is possible to have only one in your lifetime.

      Let's wait for the results of the blood & urine analysis. If there is no evidence of drugs in either sample, then the state is going to have a hard, if not impossible, task to prove that she drove under the influence. The state could still try to prove a hit & run charge since she did not stop after causing the collision. But let's wait & see.

      Siezures can be caused by something as simple as flashing lights or rapid changes in surrounding colors. Friend of mine has epilepsy and it is not a pretty sight to see. Mrs kennedy has taken blood tests to determine if she in fact did have a siezure which can happen and tests will prove yes or no. This just gives the Kennedy hater a right to spew once again cause they are jelous of anyone who helps other people like they do.

      You must have a loose screw in your head if you believe the Kennedy's should be admired. Old man Kennedy made his money during the depression by bootlegging liquor. Then he built the Merchandise Mart in Chicago by paying men just $1 a day for morning to night labor. You call this someone I should be jealous of. He bought the presidency for his son with mob money and and then they paid the ultimate price by being shot. The third son then kills a young girl after a drunken night out and doesn't call the police until the next day. You can go down the line of the Kennedy's and find drunks, cheats, drug users and killers. Camelot in the 60's was nothing more than a revolving door at the white house for actresses and prostitutes for the Kennedy brothers. What role models to look up to. Be real, get your head examined.       I'd have never even paid attention to this story, except that something like this happened to my neighbor last month......when she totalled her car BACKING into her assigned parking spot at our apartment complex. She jumped the curb & took out a nice chunk of one of the corner units as well. Doctors found some sort of growth on her brain ( I didn't press for "details"....as she was obviously upset ).......but it WAS a seizure of some type. Just yesterday, she was telling me she has to go in for surgery later this week....to have a "stint" ( ? ) put into one of her carotid arteries......because it's too narrow.

        I know there are a lot who want to throw the book at the extended Kennedy family for their track record of political corruption, lies and throwing their money around to get out of being accountable for criminal behaviors over so many decades. But at least this one happens to be known for actually spending so much of her time doing charity work.. I believe in giving people the benefit of the doubt no matter who they are. I can't call myself fair if I go around labeling people based on the family they happen to be born into. This woman does not have a past record showing she has cheated, lied or performed any previous scandalous acts. I believe in taking each person separately for who they are and giving them a clean slate with which to let them leave their mark on. If they then say one thing, but facts and objective finds bear out another conclusion, then I know that person's level of integrity or I should say lack there of.

        Windancersong-I agree with your benefit of the doubt approach to life. Unfortunately in this case that fails to deal with a unique reality. It is very unlikely that this Kennedy, who may be a fine person on a standalone basis, has anything to do or say with the public position or explanation being offered. The massive Kennedy spin machine is larger than any one Kennedy. Do you think for a minute they would let this Kennedy smear their name? In the case of the Kennedy's I have extinguished all benefit of the doubt I had in me. After so many gave Ted Kennedy a life time of benefit of doubt when he was responsible for the death of a woman I am done. There are countless other Kennedy incidents where their guilt or innocence was lost in the liberal media smoke machine.

As a physician, I know it is very unlikely to suddenly develop seizures in your 50's without a head injury, brain tumor, etc. Another rich weasel beating the system with an army of doctors and lawyers fabricating a ridiculous claim of a seizure. She was driving impaired, period. Many drugs that cause one to be impaired do not show up on routine drug screens that we do in the ED. The rest of us mere mortals would be charged with a DUI and have our license suspended. The uber-rich are indeed different.

          I was thinking the same thing Allen. My understanding is that seizurescommonly appear at age 20. Certainly not as late as 50 something for a first occurrence.

          And what does she mean by "I might have accidently taken a sleeping pill in the morning"! Tells me she was taking some kind of pill that morning. Did she get the script bottles mixed up? What was she intending to take? You're right, a routine blood and urine test can't possibly detect everything.

          Allen, then as a Physician, as you stated that it is very unlikely to happen, it DOES still happen. Seizures can also occur with someone who has a high grade fever, brain swelling and increased pressure on the brain as well as chemical imbalances are common causes of adult seizure activity. Metabolic issues like low blood sugar, low blood sodium, elevated blood ammonia associated with severe liver disease, and electrolyte imbalances related to kidney failure, and sometimes...it just happens!

          But, what would I know. I'm just a pee-on CNA who has spent the last 4 years working with 2 Neurologists, going through many, many tests trying to figure out why, at the age of 27, I started having Tonic-Clonic seizures and now just about every seizure there is, when 4 years ago I was perfectly healthy.

          All of the Kennedy family political, using their money to buy their way out of trouble aside, IF this is what happened to her, I hope that she gets the help that she needs. This is not a fun way to live. If it's not what happened, then she needs to have justice served to her the same way the normal American person does.

          Nonsense my friend did not develop his symptoms until he was 45. She was on her way to a gym. She may have suffered a slight injury or sometimes trauma can do harm. I dont know many physicians who would make a gereralized remark like your then follow it up with anti Kennedy spew.

          That is absolute nonsense. I have lived it. I had no symptoims whatsoever when all of a sudden I had a series of seizures at 47. They could not figure it out and I haven't had one in 6 years now. As a physician Allen you should be ashamed for telling a lie. Your statement is an absolute falsehood. You may develop siexures at any time in life for no reason at all. Just ask my friends who had to pick me up after I had a siezure and fell into a glass table. You may be a Dr. (questionable) but I had 5 neurologists try to figure my seizures out and they never did. That includes two that I had right in front of them. I had to take Neurontin for 2 years and now still take Trileptal. So please don't spout untruths O.K.? People on here may believe you.

          I had my first seizure at the age of 41. Fortunately, I was at home with my family. After I also had the extended test and spent 5 days in the hospital with electrodes attached to my head which showed I had seizure activity on the right side of my brain. After much internet research and talking with my specialist, he determined that it is a condition called Catamenial Epilepsy. This can effect young girls and women is strictly hormonal. Do the research.

My father is 70 and had his first (and only seizure so far) back in March of this year while walking around outside at his camp....actually, he had 2 back to back. So now he has someone drive him around town incase of another seizure. So far, so good.

            Kennedy said she would continue to receive treatment for the condition and should be able to live "symptom-free."

            So, she is being treated for "they don't know what" but should be symptom free from "whatever it was". To help insure complete recovery, she has been given a pre-signed prescription pad as well as the cell phone number of an undocumented pharmacist..

            Not really. What I notice is that some people seem unaware of what middle-aged women look like when we are not wearing makeup other than lipstick.               I have a good friend who had a grand mal seizure at the age of fifty. He had never had one before. He never had another one. To this day, doctors are baffled by his case, but it has been fifteen years since it happened, so he doesn't worry about it too much. BTW he doesn't drink, or even smoke, and he is drug free.

              giving her the benefit of the doubt, however, most regular drug tests do not cover, nor look for some medicines that cause drowsiness. (such as sleeping pills, or stronger aspirin derivatives that can cause those symptoms when taken on an empty stomach. ) Acid Flashbacks can re-occur at random intervals. The symptoms behind the "seizure" type claimed here can also be Food Borne Illness related as well. Early onset cancer, Fear ( maybe she was almost in an accident prior to having one) creates tunnel vision . (Much like walking in the forrest, thinking you see a snake, instead of picking up a stick to kill it you pick up the snake)

Because I had my first seizure at age 47 without having a head injury or other obvious cause. According to my doctors, including the several neurologists, epilepsy can happen at any age. Sometimes due to injuries or illness suffered at any point in one's life, including childhood. It can also happen without any cause ever being found. Sometime medications can cause it as a side effect. I was not on any. With complex partial seizures, one can lose their responsiveness, as this type of seizure involves the whole brain and has a preceding event which can include several possible affects. Including disassociation, deja vu,euphoria, and tunnel vision. Loss of memory is also known as the hippocampus is affected. As for the blood tests, the reason it is taking a week is because it is also sent out to a lab, not being done in the hospital so a more thorough examination can be completed. It is the standard procedure in all the counties of my state that I am aware of, for all suspected impaired drivers to have their samples sent out to independent labs to be checked. We send those out so when their cases go to court, there is a second independent confirmation besides the hospital's. It also backs up any field tests that had been given. Otherwise, it doesn't take a week for the hospital to do those blood and urine tests. I still go to see my neurologist who checks the blood level of one of my medications and I can get my lab result the next day. The bottom line for me is, I would still rather give the benefit of the doubt and be proven wrong, the judge someone guilty who ends up being innocent. There are already so many ready to hang others with out proof. As we have sadly learned by the hundreds released, our jails contain innocent people sent there because folks were so eager to judge quickly because of labels and preconceived notions.

                  @Winddancersong: You are absolutely right! I posted above that I developed them at 47 for no reason. You're a voice of reason for giving the benifit of the doubt. According to Allen (A physician? above) It's bull to develop symptoms that late in life. LMAO. It's a little different when it happens to you.

                  Even I as a lifelong Democrat find the Kennedy's a pitiful bunch....self-absorbed, pretentious, and condascending. All save for Maria Shriver. Now that lady is a class act. Too bad her heart rules her mind when it comes to her pathetic husband.

                        I completely understand the comments about the Kennedy excuses and thinking that this is just another in a long line. However, I'm wondering why NBC would both have the reporter call her "behavior" bazarre, and then report that a seizure may have been the cause, and also talk to an expert who explains that a seizure could have caused her symtoms. If there is a chance it was a seizure, how is that bizarre (i.e. crazy)? Epilepsy is a serious disorder that should be taken seriously - and even if it was her first seizure -- it is not a joke. (if there was evidence her statement about the seizure wasn't true - why bother calling on the neurologist as an expert in the story???)
