CHICAGO -- Illinois Governor Pat Quinn on Tuesday proposed a state ban on assault weapons in the aftermath of the July 20 movie theater massacre in Colorado in which a former graduate student is charged with killing 12 people with guns including a semi-automatic rifle.
Quinn, a Democrat, called himself a "strong supporter" of the constitutional right to bear arms, but said in a letter to state legislators that the proliferation of military-style assault weapons undermines public safety.
"There is no place in the state of Illinois for weapons designed to rapidly fire at human targets at close range," said Quinn, who also proposed a ban on high-capacity ammunition magazines.
States including California, Connecticut, Massachusetts, New Jersey and New York have similar bans in place, Quinn said. A nationwide ban on certain semiautomatic rifles expired in 2004.

Illinois, the only state without a law permitting people to carry concealed weapons, has Democratic majorities in the legislature. But Quinn's assault weapons ban proposal likely would face obstacles from legislators outside of Chicago.
Suspect James Holmes, who seemed dazed and unengaged in court last week, on Monday appeared alert and attentive as a judge told him he faced 142 separate felony charges. NBC's Mike Taibbi reports.
The earliest the issue likely would be considered by the legislature is November, according to Brooke Anderson, a spokeswoman for the governor's office.
Speaking to NBC station WEEK, Republican State Senator David Luechtefeld accused the governor of trying to take political advantage of the theater shootings.

The man charged in the Colorado shootings, James Eagan Holmes, was armed with a Smith & Wesson M&P .223 semi-automatic rifle, similar to an AR-15 assault rifle, along with other firearms. He was charged on Monday with 24 counts of first-degree murder and 116 counts of attempted murder.

A true assault weapon is a military firearm with a selector that allows switching back and forth between semi-automatic (one trigger pull, one bullet fired) and automatic (one trigger pull, lots of bullets fired) firing mode. The 1994 Crime Bill defined a semi-automatic rifle as an assault weapon if (1) it could accept a detachable magazine, and (2) it possessed two or more of the following characteristics:
Since automatic weapons are already prohibited unless you have a Federal license and most larger-caliber hunting rifles are more powerful than the weapons defined above, the only conclusion I can reach about semi-automatic assault weapons is that they were banned because they don't look right.

AR-15's are designed for use out to 550 meters (past 300 I recommend a scope of some type)
They can be used at close range, but are designed for long range.

I would imagine it would be in the Governor's power to demand the State Police disarm. I could be wrong of course, but for the sake of argument lets assume the State Police do fall under his authority and must follow his directions.
What possible use do the police have for weapons that is not shared by everyone else. The police after all enjoy no special rights (although they may have some delegated powers), it isn't like assault against someone who isn't a police officer is legal. So if no one needs a gun for use against human targets the police should disarm, today.

I don't need a so-called assault rifle. At least I don't at this time. I pray that never changes. All of my large and extended family owns guns and are proficient in the use therof. I think the craziest gun in the family is a 10 guage shotgun. (Better plant your feet firmly, son). We do however, have quite a few semi-automatic high powered deer rifles. We train our children in the safe and responsible use early and we have never had an accident even back to Great-Grandpappy on both sides of the family tree.
I don't think they should be banned. I do think they could be registered and titled somewhat like a car. Maybe a license to own? I could probably support the ban except for 2 things.
Sounds like a perfectly sane and reasonable request, which of course means that the NRA will do every thing they can to oppose it. The NRA would garner a lot more respect if they would look at this as a reasonable compromise and throw their support behind it instead of looking at this as an infringement on their second amendment rights.

The right to bear arms is the right to self defense. Self defense is an inalienable right, a human right.

Dandy416 well, most guns can "Rapidly" fire at humans, there are many non assult rifle guns that are semi automatic so if the shooter can rapidly pull the trigger than it can be rapily fired. why dont you learn anything about guns

In fact semi-automatic handguns fit the definition better than semi-automatic assault style rifles since assault style rifles are not really intended for use at close range. After all, semi-automatic weapons were specifically developed to allow for more rapid firing and handguns really have no purpose other than to shoot at someone at close range. Unlike rifles which are used for hunting, other than target practice, handguns really only have one purpose, shooting at people. And yes, I am being a little sarcastic here to show the fallacy in the governors reasoning and his definition of the weapons that should be banned. I do think that high capacity magazines should be outlawed since they serve absolutely no practical purpose in the civilian world.

hs321....unfortunately, the right to defend myself could conceivably now extend to nuclear weapons. Are you advocating that I as a private citizen should have the right to own nuclear weapons simply because they exist? Or my own stealth fighter? While I know this is an extreme, the intent and thought process is exactly the same, but on a much smaller scale. There is no real need for assault weapons. Keep your handguns and your hunting rifles, but please try to understand the sanity involved in attempting to ban needless assault weapons.
Are people so foolish to think banning any type of weapon will stop people from getting shot or killed? I hope not. I am a firm believer the 2nd amendment is there to protect the first. If you allow the government to take your weapons you will allow them to take your freedom. The criminals will get theirs no matter what the law says. If the public would wake up and realize that it wasn't the AR-15 that did the most damage since it JAMMED, but was the popular bird hunting Remington Model 870 12 gauge shotgun that actually did the most damage then maybe they would quit being lead around like a bunch of sheep.
On the Second Amendment the fact is the reason the Founding Fathers wrote that was first and foremost so the citizens of the US would have a way to fight back against a tyrannical government and help in case of invasion and second was personal protection/hunting. If one would actually study the Second Amendment and take into account that when it was written not only did the average Joe have the exact same weapons as the military, individuals also had their own Armies. That's what the Founding Fathers intended but the poor sheep want's to bypass what they wanted and basically do away with the ability to fight back if it is ever needed.

The description of so called "assault weopons" is really "how it looks", not on the action or mechanics or function . It's almost like saying that : "If it's all flat black in color and has a pistol grip and a detachable magazine ,,,then it's an assault weopon" ,,,and the ban would say no one should be allowed to have such a firearm ,,,,That's absurd to think this will keep the criminal element from aquiring them.
There is already regulations in place that restrict the "fully automatic" ,functioning firearms from the general public .
An "assault rifle" in the hands of a law abiding citizen is no risk.
Any weapon in the hands of a criminal is dangerous and deadly.
How about some statistics? From this weeks Time magazine - Aurora like "mass shootings" are plotted over time. The worst year (2003) had 30 with 135 deaths - vs. Chicago (the gun free zone) with 294 as of 7/23.
<1% of these crimes are committed with "assault rifles" (in fact recent reports suggest the Aurora CO shooter's "assault rifle" jammed and he used one of his other guns). The gun of choice? Handguns (80% of the time - and according to another Time articles the typical handgun of choice is the cheap, low capacity, small caliber variety - perfect for criminals), and who commits most the crimes? Criminals (95%) of the time. Where do they get their guns? Families/Friends (35% of the time). Average jail time for a felon? 16 months (US DOJ).
The answer isn't banning the gun it's getting the criminal off the street. Sometimes jail is just meant to separate the criminal from society.
With respect to comments on guns, and magazines, automatic vs. manual. Any gun in the hands of someone with average skill can be very deadly. We can be thankful that most criminals/sick individuals don't take that time.
But by all means disarm the 95% of the population than own guns (including over 4,000,000 "assault rifles") and go through each and every day without committing a crime.
p.s. I live in Denver, and this didn't get much airtime - but there was an earlier incident in Aurora - an armed criminal entered a church gathering and shot 1 person dead, before he could kill again a parishioner, legally carrying, shot him dead. Would the Theatre shooting turned out different if CCW permit holders were allowed to carry in there? Who knows, but at least it would have been an option. Naysayers say it would have turned into a bigger battle, but as a CCW permit holder 1/2 of our mandatory class is about making those decisions - and the decision not to use your gun is just as important as the decision to, the other half is demonstrating markmanship in rapid fire circumstances.

I have read of the deaths of 10 people by their family members, neighbors or mass murders and suicides while not one of a person protecting themselves the past three days. It is always that way. Stop the NRA and the slaughter of the public. We have a case this weekend of an 8 year old Wisconsin boy who hot himself with his family gun that was left out. What happened to the conceal part?
1.) When you attack the NRA remember you are attacking a group that is not a government organization, the NRA is made up of PRIVATE citizens who wish to protect the 2nd Amendment. You may disagree with them, but asking for them to be abolished is asking for the government to tell free, law abiding citizens they can not organize. DANGEROUS
2.) The Aurora gunmen used a Shotgun, a pistol, and a Rifle. Any assault weapon ban would not have stopped this from happening.
3.) The shotgun was the reason over 50 people were injured. The spraying of many small pellets in every round caused many people to be hit. The 100 round magazine int eh rifle actually jammed leaving him left with the pistol.
4.) You can change a clip in a pistol or rifle in a matter of seconds (less then 2). Any ban would not include already made and owned large magazines or rifles so you would still have millions on the market.
5.) Large M16 type assault weapons are not the idle gun for close range shooting. They are large which makes it more awkward to handle in close quarters. Hand guns are much easier and you could actually operate two at one time if you were skilled.
6.) As been repeated many times criminals don't care what laws you pass, if they want it they can get it and most of the time it's easier to get weapons illegaly then legally. Just ask yourself what is easier, buying illegal marijuana from your dealer, or spending money to go to a doctor who gives you a note that says you can apply for a medical marijuana card, spending money on that card and then going to a store to buy. You are now ON RECORD as having a medical marijuana card and any law changes could come back on you, or you can continue to stay off the books and save the doctor visits and get it from you co-worker or neighbor. Which is easier.
7.) We already have laws that make it so assault weapons can not be like those used in the military, and many of these weapons like the M16 can be used for hunting. M16's and other similar type weapons are actually not that large of a round and I would never try to use one for deer, but they are pretty good when shooting at unwanted skunks, racoons, and rabbits.
8.) Once you start limiting one amendment the others will become less solid as well. Freedom of speech already has limits as does your right to bear arms, how many more limits are you willing to take.
Take away guns and the nut job would have barrd the doors and started a fire.
In the US we allow crazy people to buy assault weapons but don't allow homosexuals to have a piece of paper saying they are married.

I would like to correct a misconception, the second amendment was put in to the constitution for the purpose of ensuring that force resided with the people. Government is force, this way the power resided with the populous. The exact reason was for the killing of other people, people who would corrupt a free nation and turn it into a tyranny. The right to keep and bear arms which can not be infringed (governments cannot regulate, ban, or in anyways legislate over this right) protects the people from the leaching members of society who will use governments to enslave and oppress the populous. The hireling police force and military seems to have turned their backs on the American people either because of fear over job security or from ignorance over financial and political matters but i do not think this ignorance will last forever.

I understand fully what you're saying. It's not a black and white issue. Read up and down these comments. Many use your same logic to say all guns should be banned, and I could use the same logic to say baseball bats should be banned. They are used to kill people and "there is no real need for baseball bats" except in the hands of trained professionals.

To the best of my knowledge an AUTOMATIC weapon has not been used in a crime in the USA since the NFA was implemented. Not even a MODIFIED one. Besides automatic weapons require local police sign off to purchase one legally unless one has an FFL.

I believe you are trying to use fear to justify your position, A militia is the populous, it is separate from any government controlled entity, it is not the national guard, or reserves or any misguided notion of the such. Government is force, therefore if the power resides in the pople, and the authority resides with them then they have the power which is the right to keep and bear arms. The exact purpose is to remove a government no longer doing the will of the people. Have you ever read the reasons for the declaration of independence? You should read them because our constitution was designed for the purpose of stopping those grievances from happening in the US.

Unfortunately I don't have the time (or do you) to write about the real problem in detail here, so here is the short version. Most of the anti gunners don't have the proper gun knowledge to make rational decisions about assault rifles. For instance, the gun the shooter used, IS BASICALLY THE EXACT SAME gun I use for deer hunting. Also, if you look back at any mass shooting in the last 25 years, look to see how many rounds the shooter got off with an assault rifle. The high capacity rifle mags really have not played a huge role in these. The high capacity handgun clips have done more damage. Now, do you ban those so only law enforcement can legally own? What about my home protection? I like the fact my 9mm ruger can hold 15rds, because I just might need them (I wish someone had one in that theater to end or slow down the killer). I think that theater had a no weapons rule. The only thing I can think of is the shooter didn't see the sign. Now, if we all had more time, I would teach you how anti depressant drugs, or A.D.D. drugs, have gotten into our society and are the real issue here. But another day. What he is describing is a fully automatic weapon - which are already illegal to own without a license. Not to mention most 'assault' weapons are not meant to fire rounds very quickly a close range - they are ranged weapons meant for firing at a optimum distance. These aren't carbines or SMG's we're talking about here.
Lets play with the carbine aspect for a second. Still, current regulations don't allow full auto weapons. So now we're talking about banning firearms that fire rounds as fast as the operator can pull the trigger. Sidearms are made for short distance shooting, along with shotguns. So this has nothing to do with banning 'assault weapons' but rather, banning all firearms.
The better option would be to limit magazine sizes. Though even that can easily be bypassed if one really desires to. The thing is - laws only work for those that obey them. How many criminals and murderers would think "oh s***, this firearm/magazine is illegal. Better not use it to kill people. I'll use the smaller capacity ones"

The reason that the 2nd amendment exists is so that if the Government ever got hijacked by the corrupt and we the people had to resist by force we would be armed and prepared to do so. If we were not permitted to have guns, we would be at risk of any number of military coups, tyrranical governments, etc. that have plagued other nations.
We like to think that the US is immune from the political unrest that has dissolved other nations into civil war. We are not. We have been lucky. But as the economy becomes increasingly volitile and I see the unrest that crumbing economies have caused in Greece, Spain, Italy etc. and I wonder how long it might be before we are in a similar situation. Guns are not a solution, they won't stop it. I get that. But if it ever comes down to a complete breakdown of society, I think the people who have guns will be in a better position to provide and defend their families than those without them. He also sold slaves and only freed some. The south was gearing up for, labor intensive, huge cotton production and needed many slaves creating even more value for each slave. The question might be better posed by giving the following scenario: I am a citizen who is actually concerned that the government is a threat to my personal liberty. I have built a missile and armed it with a conventional warhead I personally designed to cause damage to a number targets several miles away in a single use. Actually I prefer to protect myself by being aware of my surroundings and packing a legal handgun. However if I had to choose out of the two, I would personally prefer to get shot in the back. First, these are not assault weapons...the features that classify them as assault weapons have no real impact to how dangerous or not the weapon is nor it's ability to harm others. They are the most common sport gun used for target shooting and in most states you can hunt with them. They are also the perfect weapon for home defense. I don't desire to kill anyone but if four guys are breaking into my house when I'm away on business and my wife is home alone, much like what happened to Kim Cates in Mont Vernon, NH, that rifle would be the ultimate equalizer. Kim Cates was killed and even if she had a firearm, a limited capacity magazine could have left her with no bullets left and more attackers still standing. You've probably never fired a firearm let alone understand how to use them in self defense so don't speak on a topic you obviously know nothing about. In a home defense situation, the standard 30 round magazines probably wouldn't be enough and you'd need to carry one or two more to be prepared for a reload.
Really, we need some kind of way of vetting the people who don't know what they're talking about from those who own and use these firearms all the time...

I wish gun-lovers would think through their obsession with guns and see the logical conclusion.
There seem to be two main arguments for American gun-ownership.
1) When you suffer an armed home invasion or a Columbine type attack, the cops are minutes not seconds away and
2) Only an armed populace can resist a government that wishes to impose a dictatorship.
The trouble with the first is that if you make it possible to arm the mad, the bad and the sad and flood the country with guns, you make it almost certain that any intruder in your home or school will be armed, therefore fulfilling the condition that made you want to be armed in the first place.
On the second, it is clear from Afghanistan, Libya and Syria that even a well-armed populace cannot stand up to the military without extra help. To be effective the armed populace (read right-wing militia) needs either to have:
(a) help from the military – this is called a coup in most countries
(b) someone outside to impose a no-fly zone – any suggestions for foreign governments who might be prepared to try to do this in the US?
(c) recourse to more than even the powerful weapons allowed in the US – just trot along to your local Walmart and pick up your suicide belt and SAM missile.
Who can doubt American exceptionalism?
Any country where a substantial part of the population:
a) denies evolution
b) doubts global warming
c) believes that mass gun ownership brings increased safety
d) maintains that talk of "second amendment remedies" is compatible with democracy

Then you fail to remember that CIVILIANS and ex military sort of kicked the British out of here, with some assistance granted. Criminals don't care about guns laws or the Second Amendment. In fact, I doubt any of them know it. If a modification is needed to the Second Amendment, please, in the name of God, tell me how that will, in any way, modify criminal behavior. You see, that is the point, isn't it? So the existence of anything that can be used as a weapon will "make it almost certain that any intruder in your home or school will be armed,..." No-one is suggesting that modifying the 2nd Amendment will change criminal behaviour. The argument is simple.
If we are talking of personal defence, the more guns that there are the more they will be used by criminals, the deranged and the angry and an armed population is likely to make things worse not better. Can you imagine a shoot-out in a darkened smoke-filled cinema? Half the audience would kill the other half while the gunman slipped away.
The idea that the 2nd Amendment is a defence against tyranny is much more dangerous. At one level it appears to give individuals a license to assassinate anyone they feel is oppressing them, at the other it justifies armed insurrection against a democratically elected government. As I keep saying in my original post, which I will repeat until I get a logical refutation, armed insurrection in the US could not succeed unless the military were complicit and that is called a coup. So when is a coup legitimate? When you can't persuade the majority of your fellow citizens that you are right? When your subjective notion of freedom is not shared by others? It is a very slippery slope and the idea the bullet is as acceptable as the ballot is in danger of bringing the US to its knees.

Well here's the answer to your question: 99% of the time law enforcement officers have no need for an assault rifle, but that 1% of the time that the criminals (who have no respect for the law and can easily acquire any weapon they wish) decide to go on a shooting rampage with an assault rifle (GASP! They're banned!) or similar weapon, I don't want to be shot because some douchebag like you feels law enforcement officers are big scary people that should only be allowed to carry spitballs and peashooters. All in all, criminals don't follow the law. Law Enforcement deals with criminals, therefore law enforcement should be armed within a reasonable amount of firepower to combat criminals.

Gadhaffi's Libya and Syria, as long-time military dictatorships, have had a much larger ratio of soldiers to civilians than does the US. The military of those countries is as much oriented towards regime-preservation as it is towards defending against external threats. That form of military is held to be personally loyal to the dictator rather than to a Constitution or its principles. They are also usually formed from tribesmen loyal to the same group that the dictator is a member of. Those are dynamics lacking in the US.
The US civilian population also has a much larger supply of guns than the citizens of Libya, Syria, Iraq or Afghanistan. Controlling 300 million+ Americans would be a much taller order than controlling 30 million Iraqis. A civil war would collapse the economy necessary to support an expensive, high tech military. As far as rank-and-file soldiers, it would be easier to join a rebellion aimed at a government that has become the domestic enemy of the Constitution they swore an oath to than to kill brothers, sisters, parents and neighbors acting in good faith. (Compared to Libya or Syria when Gadaffi was asking his soldiers to kill people from a different tribe)
I am ex-military, am a believer in evolution, a believer in global warming, a non-Christian, and a person who doesn't want to live in a tyrannical nanny state that tells me what I can eat, drink, put in my body or how i can defend myself. The War on Drugs and Prohibition represent failures of nanny-statism.
I also find the arguments about "saving lives" disingenuous given that there are much better ways to save lives, such as switching transportation from cars to mass transit (30,000+ deaths a year), reducing exposure to chemicals that cause various cancers (which kill 500,000+ a year), or getting hospital personnel to use more bleach and prevent a hundred thousand hospital-acquired-infection deaths a year (which translates to 11 people dying every HOUR)

Poor terminology. What the governor wants to ban are assault style weapons. An assault weapon, as defined in the 1994 federal law, is a semiautomatic firearm that possess the cosmetics of an assault rifle.
Although, I think that there should be restrictions on the ownership of large capacity detachable magazines, I fail to understand how banning firearms based on cosmetics (style/appearance) will make anyone any safer. At short range, commonly available shotguns are as lethal if not more so than semiautomatic rifles. A Mossberg 930 Tactical shotgun has a capacity of 8 rounds. Using 00 buckshot (9 pellets per shot), it can fire 72 pellets without reloading. Each pellet is 1/3 inch in diameter and quite capable of killing a person.

First of all, as a Democrat, I disagree. I like the hunting weapons I have. I need them where I live, even if for no reason other than to scare something off. It's not about the Second Amendment, which will never be repealed so long as the South, the Rocky Mountain States and Alaska still exist in this country- it simply won't happen, and shouldn't. What this is about is allowing the manufacture of weapons that CAN ONLY be used to kill humans. That is what needs to end, and has nothing to do with the Second Amendment.

People seem to overlook the middle clause: "being necessary to a free State", a State free from crime, invasion or poor government. We are just saying that those who chose to legally purchase and operate their weapons be permitted to do so without everyone else thinking we deserve to be called the multitude of derogatory terms that get thrown at us.

Thankfully, the American people are ignoring the gun control idiots and voting with their dollars - after Democrats took over the House in 2006, gun sales took off. Then, the first year of Obama's administration, sales soared by over 40%, and continue at a fast pace. As a firearm instructor, I can verify the most of the rise in gun buying is due to NEW people who never owned a gun before. And they are from across the spectrum - Democrat, Republican, Independent, men, women, black, white, brown, gay, straight - I've had them all in my classes. And women, especially young women, are really getting on the bandwagon.

There were no gun fights in the old "wild west" frontier towns. (with the exception of the OK Corral)That's only in the movies. One reason there weren't any is because everyone carried a firearm. DB17, it doesn't take an Amendment banning the 2nd Amendment...it takes laws like the GC acts of 1933, 1968, and the Hughes Amendment to the FOPA of 86 to start chipping away at it little by little. The Amendment clearly states SHALL NOT BE INFRINGED yet we have laws restricting this non-infringeable right??? Imagine if you had restrictions on often you could go to church, or how many Bibles you could own, or needed a permit to go to church? These are restrictions some states and cities have...all violate the Constitution but the Supreme Court doesn't work for us...it takes getting arrested and years of your life and HOPEFULLY a Constitution knowledgeable SCOTUS to give you your day in court...by then you've had your finances destroyed...

There are no periods between well regulated militia and the right to keep and bear arms. Therefore what this means, regardles of how the SCOTUS interpreted it during their NRA days, is that our right to keep and bear arms is ONLY to maintain a well regulated Militia. Not to shoot our neighbors because they're playing their music too loud (texas case supported by their stand your ground law). Taking the words out of context to support your position only enhances how stupid you appear.

Truth: Weapons bans will only hurt law abiding citizens. Bad guys will get guns no matter what. Why? Because there are already too many guns available. No matter what laws you pass, the guns that already exist will be sold to criminals and there is nothing you can do to stop it. If a person decides to break the law, do you think they care about the added weapons charge? An increase of 31% murder, does not mean that guns are to blame....and furthermore does not mean anything will change by tightening gun control. If someone wants to commit murder and they don't have a gun, don't you think they will pick up a knife or blunt instrument to complete the murder? ................Truthfully guns are a very important part of our economy and our nation's ability to defend itself from foreign invaders. The existence of nuclear weapons requires that we have guns...period. If nuclear war breaks out, there will be anarchy and guns will be the only way to protect your family...think about it.
Gun bans are useless. Chicago has banned them for 5 decades, and the gun battles there result in 500 dead a year, and 12,000 wounded.
The real problem is in defining 'assault' weapon. Most modern guns are semi automatic. Automatic weapons requiring special Federal paperwork and background checks. If the gun is clip fed, it is semi automatic. The old definition of assault used to mean it could carry a bayonet.
The second amendment means what it says. We are permitted to bear arms. This means military style weapons.
Democrats seem to think that laws deter criminals. So wrong. They also seem to think that they will disarm the public, again wrong. Maybe they think a disarmed public is good?
