A man in Florida is arrested after scaring moviegoers by pacing and yelling at a showing of "The Dark Knight Rises." WTVJ's Ari Odzer reports.
A Miami Beach man is in custody after he caused a panic in a theater during a showing of "The Dark Knight Rises," police said Tuesday.
According to a Miami Beach Police arrest affidavit, 44-year-old David Martin Escamillo was at the Regal Movie Theater late Monday night when he got into an altercation with another moviegoer, left the theater and returned wearing black gloves and screamed "This is it!" from the back of the theater.
Escamillo's actions sent a hundred moviegoers fleeing for the exits, the affidavit said.
When officers responded to the theater to a call of shots fired, they found three moviegoers detaining Escamillo, who was screaming, "I didn't shoot anybody," the affidavit said.
James Butler said he and his brother were two of them. They waited outside the theater and chased Escamillo down and held him until police arrived.
"My instincts kicked in, and I was like, let's get this guy. He was screaming, 'I never shot anyone, I never hurt anyone,'" Butler said.
Escamillo, who sounded irrational and had a strong smell of alcohol on his breath, was taken into custody, the affidavit noted.
"We were able to determine there was never any weapon, it was just this individual with the two black gloves saying, 'This is it,'" Miami Beach Police Sgt. Bobby Hernandez said.
Witnesses said Escamillo had left his seat during the movie and was going up and down the stairway several times, according to the affidavit.
The witnesses also said no shots were fired and no shell casings were found, the affidavit said.
When officers searched the theater, they found several sandals that were left behind by moviegoers who fled the scene.
Escamillo is facing disorderly conduct and affray charges in the incident and has a warrant for battery, jail records showed. He was being held on $8,000 bond and it was unknown whether he has an attorney.
The theater declined to comment Tuesday.
The incident comes just days after 12 people were killed and dozens injured in a shooting in an Aurora, Colo., theater during a showing of "The Dark Knight Rises."
Police said they responded with massive force here because of what happened in Colorado.
"We can't take any chances, and we also understand the sensitivity of that, everybody's thinking Colorado, it's on everybody's mind," Hernandez said.
He added, "Had that incident not happened in Colorado maybe none of this would've happened, maybe people would've just thought, here's another nut and let's just keep watching our movie."
While some may be thinking about the scare, other ticketholders say they aren't going to let it affect them.
"If we focus on the negative energy, we're giving more power to them, so I try to avoid that," moviegoer Jose Salaicez said.

And if someone knows about them but says nothing or does not try to get them help, who's fault is it then?
As is the case with the Colorado movie shooter. It seems his problems were known for a long time before this happened. Even to authorities, so now who do we blame? Are not these people with advanced knowledge at least equally liable?

Everyone is totally on edge after the horrific incident in CO. This idiot blurted out what most perceived to be a threat. AND...it was at a theater. I would do what the rest of the audience did....run, hide and thank the people that assaulted this complete and utterly insensitive moron.

In the video the Police Officer said somebody could have shot this guy for doing what he did and it would have been justifiable homicide because of what happened in Colorado. The man is an idiot and is lucky he didn't end up with a Darwin award. He did nothing wrong? He threatened a theater full of people. What if somebody had been trampled in the mass exodus from the theater this guy caused? He may not have had a gun but he still endangered people. Folks are a little freaked out and paranoid after Aurora and I bet this guy was using that. He's lucky there wasn't somebody with a CCL who was packing and willing to shoot. Justifiable or not, he'd be just as dead.

A conceal carry license is no substitute for common sense. A crowded theater, especially in a panic situation, makes dealing with a moron using a gun a risky proposition. It would be far too easy from a panicked person to step into the line of fire just as the trigger is pulled. Ending in a bystander getting killed. If you wait until the crowd thins out, then you face possible manslaughter charges, as the threat had pretty much ended.
I carry a gun daily. I have a CCW and I know you must weigh the need to deal with a threat along with the possible legal consequences. Criminals seem endowed with far more right than the law abiding. Being "willing to shoot" can put you on the wrong side of the law very quickly. Killing someone unintentionally carries prison time, killing someone a DA later decides wasn't a threat to your life and well being does too. There's much more to it than playing John Wayne and blasting the perceived bad guy. The laws apply and they are many and convoluted.
That said, suffer no illusions, if there is an armed idiot shooting around me, I would have no problem dropping them like a bad habit. This guy was not armed, so my guess is a DA would have a problem with you blowing him away.
You're correct. I was repeating what the Police Officer said in the video understanding he is not judge or jury. And I agree that a CCL is no sub for common sense. In fact more common sense is required of folks with CCLs because of situations like you discribe. My point was the guy was lucky there wasn't a dumba** with a gun in there who was willling to use it. In fact the people in the theater lucked out in that regard. The guy is still an idiot because somebody could have killed him or somebody else. When I heard the Police Officer "spokesman" say that if someone with a gun "did what they needed to do" and shot him; with it being a "Justifiable Homicide", I couldn't believe he said that. Imagine the lawyers going after a case like that. I'm amazed that the spokesman even made it through the academy! This mans actions absolutely could have resulted in one to dozens of people suffering minor to major injuries and perhaps even death. No, actually it is a crime and it's what many don't understand about freedom. Personal freedom extends only as far as one's nose. When one's actions place others in peril, it ceases to be freedom and becomes public endangerment. There is no such thing as absolute, inalienable freedom in a civilized society.
He was charged with disorderly conduct, which in Florida is basically drunk and disorderly; and affray, which is fighting. They are both misdemeanors. He wasn't charged with anything serious, or anything involving terrorism. It's always been illegal to get drunk and get in fights in public.
I was taught in my American Political Science class that freedom of speech is not what people take it to be. If he caused panic like he did, then he can be charged. :)

For one...disorderly conduct and public intoxication. For two I'm sure there is some type of law about inciting panic. Harrassment could be another charge.
The "fight" response can get you thrown in jail if you are the instigator. You have to be very careful in judgement when you choose to fight. Had this guy hit or even swung at anybody then a fight could potentially be justified as self defense. But just swarming him and attacking him is assault.
inciting a panic is hard to prove though. he could simply say that he said "this is it" cause it was at a part of the movie that was really good. the people in the theater were on edge on their own since it was reported that shots were fired when a gun wasn't even present. there are cetain things you can't say as they are purposely attempting to incite panic but "this is it" isn't one of them.

Sigh....The movie theaters are one of the few "luxuries" still around for the common man. Baseball game? Forget it. Bring the wife and kids and at least $200. A concert or play? If it's a "known" name, forget it. Ticket prices at $100 are the norm.
The movies have always been a magical place my entire life. For a reasonable ticket price and a couple of pre-purchased candy bars, you can lose yourself, forget your troubles and become immersed in something incredible.
Thanks to this dickhead and those like him, movie theaters will soon become like the airport and of course they are going to have to hire people to pat down your nether regions so the ticket price will go up. Maybe they will have to hire movie "marshalls" like they do on planes. We just keep inviting Big Brother into our lives and he will come on in every time.

In light of the recent events in Colorado and the media coverage the incident has received, a reasonable person would interpret yelling out "This is it!" in a late night viewing of The Dark Knight (especially since this same person had previously been showing agitated and potentially violent tendencies) as a threat of an act of violence. This is a crime and it is called inducing a panic and is a felony in many states. A reasonable person could also interpret his behavior as disorderly conduct and possibly public intoxication. Both crimes.
So, no, they were not charged with assault. They were performing a citizen's arrest, a completely lawful action. They witnessed an individual commit a crime or crimes and they detained him until police authorities could arrive to formalize the arrest.
And your other argument is specious. He was not really excited for a particular scene. Besides this just being false, a reasonable person is not going to make that assumption. And that is the key word in our justice system - reasonable. Reasonable doubt, reasonable suspicion, reasonable person standard. If you robbed a bank and went into court and argued "Your honor, I was stealing that money from the bank. I was just taking it for a walk. I was going to bring it right back." the jury would not be obligated to set you free because it might be true.

Speaking for old folks everywhere, we old folks wait until it comes out in video and watch it in the comfort of our homes. Because if we go to the theater, there are young @!$%#heads shouting, talking, spilling stuff, crying, dry humping in the aisle, texting, snapping their gum, laughing inappropriately and belching for effect.
My popcorn costs about 11cents per bucket, and my butter is real butter and not the lizard sweat they pour on the stale, made last month popcorn they sell in the theater. If I want to go to the can, I push "pause" on the remote, and take my time. and if someone runs into MY theater and interrupts my movie, I can legally shoot them between the eyes, and then back the movie up to where I was before being interrupted and watch some more while I'm waiting for the cops and the meat wagon.
and yeah...we like Batman just fine. Just not orange-haired butt monkeys that hallucinate they are entitled to act out in the theater.
