The man who was arrested in connection with an incident at a 'Dark Knight Rises' showing at a Miami theater says he was just yelling to a friend. WTVJ Steve Litz reports.
For Florida resident David Martin, a night at the movies earlier this week turned disastrous -- with police accusing him of inciting a riot and taking him into custody -- all due to what Martin says was a misunderstanding.
Miami Beach police said that Martin was at the movie theater around midnight Tuesday when he got into an altercation with another moviegoer, left the theater, and returned wearing black gloves and screamed "This is it!" from the back of the theater.
His actions set off a panic inside the showing of "The Dark Knight Rises" and sent a hundred moviegoers fleeing for the exits, police alleged in an arrest affidavit.
“It's almost like you're in ‘Alice in Wonderland’ and you don't believe it's happening. But it's happening, it makes me sick to my stomach,” Martin told NBCMiami.com on Wednesday.

Martin admits to saying the words –- but said he was looking for a friend.
“I looked and I finally found him and I said, ‘Leon, come on, please.’ I said, ‘This is it.’ I was saying ‘This is it, the movie is over,’” Martin, 44 (who police previously identified as David Martin Escamillo; Martin says he does not use the latter name), of Miami Beach, said.
He said he was in a rush to get out. He had asked a man to stop texting during the movie, and the man followed him into the bathroom and then threatened to get Martin after the movie.
Martin claims that's the man who shouted the real inflammatory words.
“I was coming back through and that's when I heard 'This guy’s got a gun.' Now I don't know if any of the other witnesses heard that, but I'm telling you that's what I heard,” he said.
Moviegoers scrambled out in a frenzy, many of them scared in light of last month's deadly shooting in Colorado.
Several men held Martin down while waiting for police.
His date, Valda Dedieu, said she tried to tell officers about the confusion.
“Three of them put me down on the floor, held my neck ... They tripped my daughter and put her down on the floor,” she said.
Martin is facing a couple charges from the incident, including disorderly conduct and inciting a riot.
“Look, the truth is the truth, I have nothing to hide. That's why I'm sitting here talking to you guys,” he said.

Eh, black leather gloves are common for both bikers and people who wear driving gloves. I actually see more people wearing driving gloves in warmer climates than I do cooler climates, since sweaty hands and poor grip (from being a pansy or just lack of hand strength) makes driving a bit difficult.
I know when i put on my gloves for my motorcycle, I tend to put them on in advance of the place I'm leaving.

I had a similar experience when my husband and I went to watch Batman the Sunday after the shooting. Some guy came in and yell something. I immediately froze. Apparently he's yelling to a friend. Come on people, nobody should be pulling any kind of "stunt" like this after what has happened. Everyone's still jumpy and anxious about the possibility of having a copy cat. Also, it is a movie theater, if you are looking for your friend or wanting to talk to them, go out and excuse yourself...we pay a lot of money to enjoy the movies.
So when this guy either isn't charged with anything, or gets off of whatever flimsy charges he gets to sue those men who assaulted him.
Wonder if the police will file assault charges...other wise this country will quickly become the wild west.

It probably would not have been that difficult to cause a riot anyway with everyone being on edge so soon after that mass shooting incident in Colorado. They were watching the same movie and probably all had that incident in the back of their minds. Something as simple as a car backfiring outside the theater might have set them off.

I live in Las Vegas and I see a lot of guy wearing leather gloves while they are riding the motorcycles as it provides a better grip. When I was riding I would wear gloves in the heat just of the sweat. I should also say that I see a number of people wearing driving gloves while driving autos.
Chloe18 - in the article above it mentioned that he yelled out to his friend at the end of the movie and not during the movie while everybody was watching. In the first article that NBCNews ran about this it made mention that they could smell alcohol on him so maybe he had been drinking which could have hindered his thought process about that he shouldn't have been yelling in the theater.

I guess timing makes a huge difference - with this guy it was at the end of the movie as you said and my experience during the movie. I agree with J-Doggin, it boils down to somebody's judgement and common sense.

In my experience, he yelled mid-movie because apparently he couldn't find where his friend was seated.
Then that would make you the biggest risk to everyone in the theatre and the one the police would arrest when they got there. I can see it now as the people around you seeing you holding your gun start screaming and panicking. I believe in the 2nd amendment and the CHL laws and have my own license but if that is all it takes for you to pull your gun out then you should rethink whether you should be carrying.
gtouch - I din't say I would pull the trigger. He probably would of even know I had pulled it. Pulling a fire arm is an event of escalation. I've never done it. I hope I never have to. But given the circumstances, if the situation required it, I would. in this particular situation, I probably would have un-holstered and discretely held my weapon. Should the event have escalated, I would have taken further action. The police and other attendees would have been unaware of my action unless the situation took a turn for the worse.
It is called common sense with the ability to equally protect myself. Others should try it.
And given Chloe18's remark, I wouldn't have even given it a thought to pull my fire arm.

When they are driving and I can tell they are texting from my car it does bother me, so I try to stay away from them.

I disagree that his argument is plausible. Who yells in a movie theater "This is it" DURING the movie while wearing black gloves? If he was looking for a friend he'd be yelling the name or walking down the isle trying to find them, he wouldn't be yelling something random like that nor would he have left to put on gloves. I spent 5 years in Florida. No surprise it gets very hot in the summer - gloves were a necessity to keep from scalding your hands some days. Now, it says this was at night, and I don't know what the temps were, but the mere fact he was wearing gloves in Florida is not alarming and in fact pretty common.

While in this article, the man says that he did this at the end of the movie, there are a few more articles that suggest that he possibly did this during the movie.

This doesn't sound like he got into an altercation in the restroom, it sounds like he got into an altercation in the theater itself. Screaming "This is it," from the back of the theater also doesn't sound like he was looking for his friend. This comes from the testimony of several witnesses. Also, if the movie was over, wouldn't he know where his friend was? Why would he need to scream at him?
If the movie was already over, wouldn't the people already be leaving for the exits? We saw the dark knight today, and almost no one stayed for the credits. When the movie was over, everyone got up and left. I just have a very hard time believing this man's story, versus what the witnesses and the cops are reporting.
Too many instances for this just to be happenstance. Some low-level thuggery to try to ruin the movie 's bottom-line or just some nut wanting to be seen. He should have been questioned extensively and fined thousands of dollars then maybe these nutjobs will stop thinking they are so clever. As matter of fact I have and I have certificates in two states. And not once do I remember the instructor stating that if you pull your weapon you HAVE to shoot someone. James Dahmer - come to Las Vegas and try to watch a movie in total quiet as it doesn't happen. My wife and I went to Battleship and some lady was talking about every scene to her husband and we had to tell her to be quiet a number of times. Plus this couple were adding seasoning to their popcorn constantly and shaking it every few minutes. I don't know how many people were having to tell them be quiet. I don't know how many other movies I have been to here in Las Vegas and people are either getting calls or making calls on their cell phones while the movie is running and they talk loud and won't leave.
You should move, Dean. Where I live (Eugene, Oregon), people rarely act like that. The phones get turned off. People using them during the movie get ejected immediately. Polite behavior isn't entirely dead.

I often put on black gloves when I am about to drive to get a better grip on the wheel. especially if it has been sunny, thus the steering wheel is damn hot. If I left the theater and came back and yelled something similar to my wife (who has to see every last credit at every movie we go to), should I be beaten by a crowd and then the Gestapo, I mean Police? I was born in Orlando and lived in Florida for the first 24years of my life and most of my family have lived and still live in FL since the late 1940's. The "Spanish" population in Fl is a much more recent influx of peoples from Cuba, Mexico and South America and quite a few are not "legal" immigrants. Miami and Dade county area is populated heavily with Hispanic and south American's today but that was not the case 30-40years ago. Just throwing my observations out there.

It's not a matter of whether it's legal to say something or other. It's whether it's a good idea or not. If you board an airplane and yell, "this is it!" you will - rightly, in my opinion - be escorted off the plane and carefully questioned about your intentions and frame of mind.

Given the events of recent years, anyone stepping into a theatre, onto a plane, or appearing in some similar crowded public venue shouting in an angry, menacing, or deranged fashion should be regarded with concern.
"This is it," "let's roll," "Here's Johnny," "Say hello to my little friend," "Eat flaming death, fascist media pigs" -- the words don't matter, it's the place, time, and manner of delivery. Context is everything.
Step onto a plane and shout most anything in an angry or unhinged fashion and you're in for a tough time. On the other hand, holler out, "Marge! I'm in the sixth row," in a loud but neutral voice, and it's no issue.
Seems like a common-sense issue to me.

Well it all depends on the context doesn't it? If you walked into a theater wearing batman gloves and shouted "this is it" don't you think that people might bolt for the exit? Especially in light of the recent mass murder? Common sense, eh? Whereas, the plane your on lands in the Caribbean and somebody says with delight "this is it" as in "were finally here, yay!" is an entiely different context, not likely to be interpreted as something threatening.

I don't have any personal knowledge of the guy's tone of voice. The crowd certainly found it menacing. "Stripping more rights from American citizens"? Sorry, but you're the one who sounds paranoid. Behaving in a threatening manner has never been acceptable. If someone's intentions are mistaken, everything is generally sorted out quickly.
It's hard for me to believe we're even having this discussion. Within a few days of a massacre in a movie theatre, someone steps into a movie theatre showing the same movie and shouts out what sounded to the movie patrons like a threat.
The moviegoers behaved admirably, in my opinion. They restrained the guy and called the authorities; they didn't beat him up or otherwise harm him. Presumably, he will show better judgment in the future.
I'm actually a huge proponent of civil liberties, and I decry the loss of freedoms we've experienced in the past 15 years or so, and especially since 9/11.
However, you seem to be fixating on the right to be a dick simply for the sake of dickishness. That's not illegal, but it will very often result in unpleasant consequences. It's always been that way.

..And they need to get ushers to start policing the theaters, stopping people from doing things to distract moviegoers, such as texting, talking on the phone, talking loudly in general, etc. There is a dearth of common decency in this regard - no one gives a damn if they are annoying you or not. It isn't as small a problem as it sounds - no one cares that you paid an arm and a leg to watch a movie, not listen to them. Anyone who has any self esteem would say something to them, and so you have a confrontation. It will never go well.
No one thinks of the alternative - go complain and get a free movie ticket. This will make a difference if enough people do it - theaters will start to clamp down on jerks who won't let others enjoy the movie.

and complaining to the managers for free tickets? yeah, not going to change anything...not even if the entire theatre of people complained. frankly, it'd take an awful lot for me to complain and request free tickets...because I understand it's not the theatres fault that other human beings sometimes just suck at life to the point of annoying me. in fact, it's kind of sad that you think the movie theatre is responsible for the actions of individuals who come there?
if someone is annoying you, come out and tell the managers and they'll go in an address it. if the person doesnt stop, they'll just remove them. end of story.
i've had to do that when I worked at the movie theatre more times than I can count...and it never goes well, stupid people dont take it well when you remove them...in fact, they make an even bigger scene and bigger distraction on their way out - usually. of course, I did always appreciate the applause - and took a few bows when my actions were quite extraordinary!
long story short: if it's that troublesome for you...dont go to the movies.
get it on dvd and watch it in your own home...the snacks are cheaper, the distractions non-existent...and the cost of the movie miniscule in comparison.
oh I know, it's not the same...that whole "experience" you are missing out on.

I've been to a few theaters that have employees that walk through the movies making sure that people are not talking and if they see people that are disrupting they will ask the individual to get up and leave. This needs to be done more today but some of the theaters don't want to do this as they are probably afraid of making some group of people mad as the person that was escorted out might say the theater was being racist instead of the real reason that they were being escorted out for being disruptive.
When I was growing up I remember a theater manager that would stop the movie and go out and lecture everybody in the theater that he wasn't going to start it back up until everybody was quiet. Let me tell you that the person that was being disruptive would shut up really fast as they didn't want to get into bigger trouble for everybody missing out on the movie.

Absolutely I were mine every time I ride, Hell at 106 the metal on my grips would give moderate to severe burns to my hands. I drove truck for over twenty years and wore either full or fingerless gloves all the time.

The black gloves I get, some people do wear gloves and not remove them because its not really a big deal. We do not know if their full gloves, driving gloves, etc.
I can totally see someone coming back in noticing their buddy did not follow them and say "This is it" or "This is all there is" etc meaning there is no after the credit scene.
So while I admit people are really jumpy right now it sounds to me like the guy who was texting incited this by claiming this man had a gun. Now this guy was not stupid for saying this just for saying it right now when everyone is thinking they have to bring kevlar to the movies.
I hope the police track down this other guy because it seems like he was the one who were saying things about guns and so on. And why did grown adults have a kid pinned down and why where they holding a women down by the throat if they where not doing anything aggressive.

Oh I misread he came back wearing gloves. As I have been to florida in July/August it is hot as hell. It is likely those are driving gloves (So they dont have to put their hands on burning hot steering wheels)
