Wrong stillborn baby given to Brooklyn family to bury

A Brooklyn family whose baby was stillborn has filed a $5 million lawsuit against the city after learning they buried the wrong body in their native Poland because of a mix-up at the medical examiner's office.

"I'm hurt to the point where I can't move forward," said Justyna Sliwa, who was pregnant for five months before her baby was stillborn in May. "I want my baby put to peace."

Sliwa and her husband, Rafal, held a memorial service in Brooklyn on June 16. The funeral home sent the remains to the couple's hometown of Lomza, Poland, where a Roman Catholic funeral was held June 19.

They learned weeks later of the mistake. Now, they said they have filed a $5 million claim against the city for mixing up the baby they named "Angel."

Information on the other family was not made public. A spokeswoman for the medical examiner's office, Ellen Borakove, said the babies had "strikingly similar names.''

The office is investigating how the mix-up occurred.      

Borakove called it a "tragic, unfortunate error we have to make right.''

Five Million will make her feel better. Sorry I just lost any sypmathy for her. I have had two stillborn

babies so I know what it is to lose them but this is just rank opportunism.

Why people come to USA and then wants or send loved ones to be buried in the country where they had no opportunity to live a happy life, if there is that wonderful, then move back there. Five months miscarriage with two fetus side by side is a hard way to identify. Yes, they should had put wrist tags on them, but some parents don`t even do funeral for miscarriages like this one. It`s smelling Easy Money!!!

      one stillborn baby another stillborn baby, they are 2 dead bodies in the ground now. exhuming and a $ windfall because.. ??? c'mon people our priorities are f$$$$'ed up! we got better things we could do with 5 million, like feeding starving people in india.

        5 million dollar claim because they put the wrong rotting carcass in a hole?

        People's obsession with death is interesting. So what? they do not need, nor should they get anything over the funeral costs they incurred. It is a rotting carcass...nothing more.

        Get pregnant again and push out a kid that is not weak genetically, thus is born alive.

        It is always sad to hear of a life that never got a chance to start and it is also sad to see what I believe in this case is that the parents are wanting to profit over what was obviously an error on a professionals part, but to say that that error is worth 5 mil.
