Chief Judge William B. Sylvester presides over the accused movie theater shooter James Holmes' first court appearance at the Arapahoe County on July 23 in Centennial, Colo.
The judge in the case of Colorado shooting suspect James Holmes ruled on Monday to keep nearly all relevant court documents sealed from public view, and keep a gag order in place, saying disclosure of records could damage the investigation, and the defendant’s access to a fair hearing.
Arapaho County Court Judge William Sylvester denied most of a legal motion by 21 news organizations to open up the court records on Holmes, who is accused of killing 12 people, injuring 58 more in a shooting spree at the midnight premier of the latest Batman movie at a theater in Aurora, Colo. on July 20.
The consortium, including NBCUniversal Media, was seeking access to a range of records in the Holmes case — including affidavits of probable cause, arrest warrants, search warrants, and request for or court orders for production of records — citing the public’s right of access to public records.
Holmes "stands accused of a shocking mass murder" as well as arming his apartment with explosives apparently intend to kill first responders, said the 85-page motion to unseal the records.
"The public has an obvious and legitimate interest in knowing on a timely basis the actions being taken by the government officials… responsible for the prosecution and trial of the Defendant. Yet, virtually all records now on file with the Court in connection with this case are under seal, entirely unavailable for public inspection."
In its 85-page motion, the media group was also asking the judge to lift a gag order that prevents the University of Colorado from discussing the case. Holmes had recently withdrawn from a PhD. Program in neuroscience when the attack occurred.
That request was denied.
"Simply put, there is a very real potential for untold harm to the case, and that cannot be allowed to occur," Sylvester wrote of university records related to Holmes. "The investigation of this matter continues and the court FINDS that any release of the University of Colorado records at this time would interfere with the investigation and may cause irreparable harm."
There existed "no less-intrusive alternative exists" to the gag order, the ruling said.
The prosecution argued that the investigation was still in its initial stages, and there were still hundreds of witnesses and victims to interview.
The defendant argued for documents to remain sealed, because "this case is precisely the type of rare instance in which pre-trial publicity alone has the potential to actually deprive a defendant of a fair trial," according to the ruling.
Sylvester ruled that he would release some court documents in the case.
Members of the public will have access to a list of documents filed, as well as some submitted by attorneys, including Holmes' defense attorney's request that their own experts be present for scientific testing of evidence, according to the Associated Press, which is part of media consortium seeking to unseal documents.
Steve Zansberg, the attorney representing the media consortium said that Sylvester's partial release of documents brings "much needed transparency to this judicial proceeding," according to a statement cited by AP.
But he added: "We are disappointed that the affidavits of probable cause remain under seal at this time, but are hopeful that the Court will revisit that issue sometime in the not too distant future," it said.
Holmes is charged with 142 criminal counts, including 24 counts of first-degree murder in the attack at the premiere of "The Dark Knight Rises" and possession of explosives.
After arresting Holmes — who had dyed his hair bright red, and referred to himself as "Joker" according to information released by the police at the time — authorities found the suspect's apartment was booby-trapped with a jumble of explosives and incendiary devices set to be triggered by tripwires. It took experts several days to disarm the devices.
No clear motive has surfaced from the limited information that has been made public.
At a hearing last week, lawyers for Holmes asserted that their client is mentally ill.
In Scott Robinson, a Denver defense attorney not connected to the case and a legal consultant to NBC News, says references to Holmes' mental illness by his attorneys and their allusion to a university psychiatrist he had contacted signal that the defense team likely will pursue an insanity strategy.
"By alluding to Holmes' mental problems, it's clear the defense is sowing the seeds for a defense of not guilty by reason of insanity," said Robinson.
Appearing in court last Thursday for the third time since his arrest, Holmes had the same dazed demeanor that he has had in previous court appearances, according to the Associated Press.

First off, CBS has already previously reported that James Holmes never said he was the "Joker" to the police.
I have a post with a list of questions (fully referenced) the MSM (Mainstream Media) has neglected to ask, which could shed an awful lot of light on this horrible tragedy. You can read the post "Questions the MSM doesn't ask about James Holmes" at which includes:
1. Why does the MSM report that James Holmes was acting crazy in jail, yet the local Colorado news station reports that he is completely normal?
2. Why do victims report that James Holmes methodically picked his victims, in contrast to the media's reports that he seemed to randomly spray gunfire?
3. According to news reports, James Holmes was an "outstanding marksman", however no one seems to be seeking out how he received this training?
4. Why did the University of Colorado remove Dr Lynne Fenton's (James Holmes psychiatrist) web page, and not disclose that she had been reprimanded on 3 different occassions for ethical violations in prescribing psychotropic drugs, one of which James Holmes admitted to police he was on at the time of his arrest? (The page reappeared but looks slightly different than the web archive page)
5. Why does the prosecution admit, yet the MSM is not reporting, that James Holmes did NOT tell the police about the notebook, and that no one has seen the contents of the notebook (It is reported that he told police about it, and that there are stick figures shooting other stick figures).

And question #6, WHY do you think the press has ANY right to publish 'details' that are only rumors? And why does the PRESS have the right to TAINT a jury with its supposed NEWS (read:gossip)24/7 in order to get ratings?
Does ANYONE actually believe that after the hatchet job the MSM did on George Zimmerman that he can get an impartial jury?
Or ever live a normal life, even if acquitted?
George will only be able to start a new life in another country. The judge won't even let him leave the county.
All of these are very excellent questions which, however, the Washington bought-off mainstream media will never seriously address. Why? Because a certain gang of conniving politicians in DC are only interested in how this tragic incident can be manipulated and twisted to advance their gun control agendas, and because they want to cover up any hint of more than one person being connected with the shooting.

The judge did the right thing be keeping the case sealed, I hope other judges learn from his actions.
Im so glad you posted, Why does a proven person with ability turn psychotic almost overnight? What or who was instrumental in helping him change. Why does the government keep him under wraps, show up in court with an absolutely dazed and confused look on his face? Im certain that he was drugged to keep him from making an outbust that might help America on focusing on the real problem, that being a manchurian candidate operation. Everything that has been part of this kids life should be made public since his arrest. Anything else and it does look like a coverup. If we dont get to the bottom of it it will get swept under the rug allowing it all to happen again and again. Force your government to tell the whole truth.
Why do you think any of your questions are important? Why would anyone suggest some kind of conspiracy because one newspapers source stated something different from another one? Maybe their source isn't the same one. In any case he's a nut, he'll fry case closed.

Most of your questions are irrelevant, at this time. If by chance they become relevant during the trial, we'll hear about them then.
The judge is doing all he can to keep this from being tried in the media, as he should.
With so many people involved in this tragedy, we're going to hear conflicting reports, and while we're all curious, it's best to let the investigators sort things out.
Look at the different stories that came out in the Zimmerman fiasco, and there is only a small number of people involved.
What's there to be tried in the media? The nutcase killed 12 people and injured 58 more people. He was caught in the act as well as had set his apartment up with explosives in such a way as to hurt or kill as many more people as possible. It's open and shut.

Look at the trial of public opinion Nancy Grace held for the Anthony trial. She had the nation all frothed up looking for an execution.
Tell me again what the verdict was in that case?
Name me one news outlet that hasn't. Just one will do.
The Anthony trial got far more coverage thanks to Nancy Grace holding her public opinion trial and how many years were handed down in that sentence?
This case is in no way comparable to either the Anthony or Zimmerman cases where there were no actual witnesses other than maybe hearsay. In this case, the perpetrator was caught in the act and arrested on the spot.
I agree the judge is correct, but I disagree that this is a case where opinion can be swayed by the news media other than maybe the news media attempting to sway public opinion to spare a guilty verdict by reason of insanity and even in that instance, the horrifics of this persons crimes were to the point that even in such a verdict, this person should never be allowed to walk the public or private domains as a free nor escorted citizen again other than to and from courts and institutions.
This is just another liberal trying to make a name for himself. A number of them have moved to Duango and have become pretty vicous there. They think they are free to do what ever they want by what ever means required. Pretty liberal if I might say.

I'd like to know where you got your information. Seems you have a lot of insider info, how do you know what the police and DOC know?
This was obviously a sick person, but was it mentally sick or criminally sick...that's up to the legal system.
If you have information the courts don't than come forward. Yes, a lot has been speculation but its been redacted by your so called MSM as factual information has come out.
Why is Zimmerman et al being brought up. The closest you can relate this to is Laughlin in AZ and he just plead guilty. Laughlin was diagnosed and the medicated and now pleads to life with no parole.
Give this 1 1/2 years and it may turn out the same way since the precident has been set...very unfortunate if it happens.
The real questions are:
Who cares weather or not he's insane and...
Why do we care about anything other than weather or not he committed the act?
The insanity plea is reminiscent of the old drunk driving defense in which the defendant was not held responsible for an accident because he was drunk at the time.
The fact that he can never be rehabilitated even to the extent of living a "normal" prison life is all the more reason to execute him... this guy's not gonna wake up someday and feel any remorse or anything else for that matter.
Rabid dogs are "insane" too and we don't keep them alive.

Yes seemingly normal people wake up insane all the time. It usually happens to young men in their late teens to early twenties.
I watched it happen to a friend of mine our Junior year in college.
He wrote on his girlfriend's door in blood "Here's my blood, next I'll see yours" He ran around thinking that "they" were coming. That there was a vast consipracy or government officials who had discovered that he had woken from the "Sleep" they put on him and that they were going to kill us all. For whatever reason in his delusion, I was on the good side and he decided he was going to "protect me" he baracaded himself into my dorm room for hours, threatening to kill anyone who came through my door. Luckily by the time he ended up in my room, others had already realized that something was very off, his girlfriend was a psych major and they had called in campus security and a medical team. He was hospitalized for weeks while they worked on fixing his mind and getting him on the right medication. It took a while, but he's better now, as long as he takes his meds. He was diagnosed with paranoid schizophrenia. I don't know if that's what is wrong with this guy, but I do know that it makes a hell of a lot more sense then him having been brainwashed by the government to kill people in a theater.

And apparently there are 85 other pages besides just that! (but I don't have time to read them this morning) Kudos to the Reporter who chose this one particular "summation-slant" statement, out of 85 pages, to be in this article.
Legitimacy, "alleged" substantial deference and timeliness exists only on the "Prosecutorial" side of things? Under Equal Justice (for all) Under the LAW? There is no "responsibility" and "accountability" to the Public on the Defense side of things? "Entirely unavailable" for Public inspection? Are not "Public Defenders", in this case, inspecting all and investigating "for" and on behalf of "the Public"? (de Facto, by proxy, whatever?) To then be responsible and accountable to the Public for whatever is/is not then presented in "Open Court" for a "timely" Full Public Viewing within the bounds of a Due Process of the Law arena/forum/venue?
The physical and photographic evidence in this case is not consistent with a mass shooting of 60-70 people. There is photographic evidence in the back of theater that shows ONE blood trail leading INTO the theater not out. The aerial footage of the front of the theater after the shooting shows the entrance of the theater impeccably clean ...not one blood trail, pool of blood, blood stain etc....SO how did 50-60 people with gunshot wounds run out of the front of theater and not leave One drop of blood???
Multiple witnesses came forward and stated there were multiple shooters.....photographic evidence shows two gasmasks at the crime scene...
The police audio recordings from the night of the shooting are saying there are multiple suspects...but the very next day the media amd polcie come out and say there is only one suspect???? So they had time to investigate all possible leads as to multiple shooters in 8 hours???...
Those who refuse to believe that everything about this case stinks simply have their head in the sand and refuse to look critically at the evidence....
People....turn off the TV...do your own research......the evidence does not add up....
They are trying to cover-up the fact that he was assisted... there are multiple eye-witness reports from theater goers that he was aided by someone else.
only, an eyewitness in the front row who witnessed the person sitting next to her received a phone call, answered it and walked to the exit door, opening it while still on it, then came back and sat down again next to her. could have been coincidence, could have been unknowing friend who was to meet him there, and left it unsecured so holmes could gain entry. who knows. that's the only public account i heard from an eye witness. the second shooter i thought was hysteria second hand reporting to journalists. not eyewitnesses. stand me corrected, please.

this eyewitness doesn't mention a second shooter, at all, he talks the whole time of one shooter. listen to him. he does reiterate the guy who got the cell phone call, who probably was an innocent friend who's petrfied to come forward in fear of being prosecuted, or, he knew what holmes was up to. doubt we'll ever know.

Wow! I thought that Holmes was about as nuts as they come until I read the conspiracy theories here. You all should be held for psych evals! Fortunately the feds are probably already checking your ISPs and getting your addresses so they can watch you. They probably have a thick file started already.

James Holmes is a patsy... He was set up to keep his dad quiet about global fraud.
Robert Holmes of FICO was set to testify before the Senate on LIBOR and other fraud just prior to the shooting. He has not testified. (I would bet that James is sentenced to some sort of lesser charge or given an early parole option that will closely match the statute of limitations for whatever fraud charges the elites should face... assuming dad plays ball, James will get out of prison within a few years)
The whole thing stinks like $hit, I'm really happy to see how many people have woken up to the fact that we have an entirely corrupt government that will do anything and everything to exert it's diluted goals of global governance.

It may sound crazy to the layman, but if the Government wanted to be pro-active with its efforts to impose greater gun control restrictions in an on-going effort to completely undermine gun ownership in this nation, they would create numerous scenarios with any number of James Holmes types to create and carry out their works of death in order to scare an already paranoid society into accepting further gun restrictions. And these scenarios would come in small, medium, and large sizes. And they will continue until they get what they want. And folks, gun control is just the tip of the iceberg.
Why is it that the goverment can't do anything right when it comes to spending money or controlling commerce but the same people think that the goverment can deploy vast conspiracies and no one ever talks.

No justice for anyone in that theatre, not one BIT. I'm supposed to feel SORRY for the shooter? HELL no! He chose his path, and now he NEEDS to pay the consequences of his actions. Look at photos of the crime scene; where the clothing was dropped and where the face mask was dropped...in the opposite direction of the car they found him sitting in.

It's pretty apparant you've not done much research on 9/11 if you still believe the "official" story.
It's not that there isn't enough evidence for the so-called conspiracy theories out there. In fact, there is plenty of evidence for the real conspiracies. Unfortunately, there isn't enough intelligent people around to both comprehend the fraud and take the correct action to address them. The vast majority of people in this nation don't have the courage or the guts to take a stand against those who impose frauds against us, even if they understood it. In order to correct these gross crimes, we'd have to reach critical mass with enough people in the know who were willing to stand together as a single force to oppose the corruption. Sadly, with the vast ignorance that permiates this nation, we'll never reach the numbers necessary to effect change. This is how we became slaves, in the land of the free, and this is how we will remain slaves pending a miracle. Gack!
9/11 is a tough one. Lots of conflicting evidence to hear and digest. The one thing that burned into my thoughts was that 3 towers dropped at free fall in one day. A tower or skyscraper has never collapsed, straight down in a free fall from any fire or natural or unnatural event in the entire history of the world. EVER. Only in a carefully planned and executed demolition job that takes several weeks of preparation.

I will never block out information. I like to learn new facts, thoughts, and points of view. I might debate people up and down here for hours at a time, lol, but, believe me when I say I do listen and retain a lot of what people say and think. I would be a fool not to have an open mind and look at things from another's prospective. I think I can always learn something new or different and makes me a better person for it.
scawarren, actually, i've done tons of research on 911, gone to therorist meetings, bought and watched the videos they sell there, and, at the end of the day, it's all conjecture and not one piece of real evidence to suggest otherwise. that's why they're called theories, until there's hard evidence, that's what they'll always be. we're entitled to believe whatever we want, but, unless facts and evidence make the case, it's all theory.

Can't argue with that....but having a little common sense.....I can wait for access to the information until the possibility of it interfereing with the criminal proceedings no longer exists.
Perhaps we should define timely access as the point at which the fair trial has been completed.
I don't think waiting for access is violating anyone's right to know...but if info is released too soon, it can definitely impact a fair trial.

Good ruling. The judge got it right. Due process and the demands of a fair trial precludes the journalistic desires of the 24hr media machine. Finding a jury is already difficult if every document is released it will be next to impossible.

Yep, the judge got it right, let the media wait to get the info and evidence at the time of the trial, not before. Just look at how the florida justice system botched the martin-zimmerman case.

I am glad that the gag order is still in effect and papers are sealed. The media is so concerned with grabbing headlines, they no longer have any understanding of ethical reporting.
I want to find out what is going on as much as any one else, but I prefer to have unclouded facts and hard evidence, not some attention hungery selfserving unethical journalists point of veiw.
The victims and thier families deserve justice. And Holmes should be tried in a court tht has not been tainted by media slant regardless if the slant is left, right, up, down or ass backwards.
Lets not give him any grounds for appeal if he is found guilty. But lets make sure that he is guilty. If there is a medical reason for what happened then lets find it out. (i.e. The Texas Clocktower shooting In Austin, he had a brain tumor that contributed to what he did)
Maybe if the media were ethical and not selfserving and truly had the best intrests of the people of America in mind maybe Judges wouldn't have to seal documents or place gag orders.
Until the news media gets thier @!$%# together and starts reporting the news in a responsible manner with consideration for the impact of how their reporting on this the people of this nation, I am very OK with gag orders and sealed court documents.

It's a free country so you shouldn't be able to hide your information and everything should be public. No reasonable right against search and seizure because nothing should be sealed, according to you, so your privacy should be out in the open (if you're doing nothing wrong, you have nothing to fear!). Guess that also kills any thought of due process in your world since everything being out in the open destroys any chance of impartiality.

I remember hearing a witness on TV say that someone told him that there was another gunman in the lobby so they could not exit that way. We will probably never hear of this again and it's interesting how already that account is questioned. I mean, really, does everyone think that they heard every account from every source that day? Bravo.....it's my firm opinion that the so-called "free and impartial" media need to stay out of criminal trials all together. In every case where the media is allowed free reign to have their fun (Oj Simpson, Casey Anthony, Kopolino, Sam Shepard, countless others....) the trial is always contaminated irreparably and the defendant usually ends up getting set free.
These news organizations are NOT fighting this because of OUR right to know every little detail and development of this countrys next "show-trial"........they fight it so they can systematically rape every penny they can out of this case by preying on out morbid pleasures and aggravating our already too vengeful (and fearful) natures . It's exploitative, unethical, and unnecessary.

look, jarad laughter might have not gotten the death penalty, which i would have preferred, living in arizona i help pay for his stay in prison, which i resent, but, many of the victim's families were happy with life imprisonment. which may be the outcome of this trial. in laughtner's case, he suffered from schizophrenia and was made well with forced medication...he simply did not take his meds. that gave him the soundness of mind and even the awareness of the tragedy he committed and actually showed a degree of regret. being in prison, and forced medication will make him live with that regret the rest of his years and days. he was a sick pup, just like this one. facts are, years ago, schizophrenics couldn't access and amass weapons and knowledge of bomb making the way they can today with technology. this is the negative outcome of easy access.

Now, I think the juge did the right thing too. And for all you crazy ass conspisiracy theorists-please get some hardcore evidence before you all start spending absurd ass ludicrious fairytales. Please. Now there are some theories that I do believe but thats because they are relevant and they are logical. Because he cuould have been backed by up an anti-gun organization that wants the governement to abolish the second amendment.After all it does makes sense. Now back to the subject, the judge was right and all we need are the facts. The media should only report facts and not opinions. I agree with everyone on here that feels this way. Just like the the lady said, every single time the media gets involved the offender gets off free or either gets a lesser charge as we have seen in the previous cases. I do agree. Because Casey Anthony should and George Zimmerman should have received guilty of first degree murder verdict by the jury. She does have a point. So the media does need to stay out of this.

@Dveavo.......The photgraphic evidence just does not match what we are being told....at the back of the theater crime scene photos show ONE blood trail leading into the theater not out of it........Aerial footage of the front of the theater after the shooting shows an impeccably clean entrance...not one blood trail, blood stain, pool of blood....supposedly where 50-60 wounded with gunshots wounds some mortally wounded yet no evidence of any blood whatsover...
The cellphone video that maistream media shows us ad nauseum shows a man with blood on his shirt being escorted out of the theater but the police walks through the crowd and allows the crowd to remain at the entrance of theater as well as inside......do you really think if there had been a gunman with an AR-15 inside he would allow people to remain????
Police audio recordings from the night of the shooting talk about multiple shooters and suspects........witness accounts talk of multple shooters...

There was intensive long term planning put into his attack on the theater and setting up the bombs etc.. at his home. Most people who go off thier medications are so unstable it would be very difficut for them to concentrate for as much time as it had to have taken this guy to plan all of this out! Yeah he is a nut case but he sure as hell should not get a pass because he has mental health issues!!! This is a pretty cut and dried case. HE was there, he shot all those people and he planned on having more people killed trying to get into his home. Doesn'treally matter to me if he sits in prison or a mental institution as long as he never walks free anywhere in the country or world ever again!!!!
