Sen. Dick Durbin's warning to immigrants to be wary of unscrupulous 'notarios' and lawyers trying to take advantage of them raised a ruckus among immigration attorneys.
So-called “notarios” operating in Spanish-speaking communities, some hiding under the guise of travel agencies, translation services and other businesses, are offering to help undocumented immigrants navigate the process of applying for relief under the Obama program, known as Deferred Action for Childhood Arrivals or DACA.
Notarios can charge hefty fees for services that are unnecessary or that they are not legally authorized to provide, officials say.
“Don’t Get Scammed!” reads a consumer advisory posted by the American Immigration Lawyers Association, which has held conference calls with U.S. Citizenship and Immigration Services officials about notario fraud.
The association has also established a website, stopnotariofraud.org, aimed at keeping immigrants from being victimized. The website warns in bold letters: “Notarios will take your money and your dreams!”
“It’s pervasive,” says Josh Deere, a Colorado immigration attorney with the firm Hanes Hrbacek & Bartels. “We talk to people almost every day who have at one point or another had contact with or hired these people who are unlicensed.”
Nevada Attorney General Catherine Cortez Masto is among a host of public officials who have warned about the proliferation of immigration services scams as the new deferral policy goes into effect Wednesday.
“Notarios cannot make eligibility decisions for those seeking advice on their immigration status,” Masto said in a press release last month. “Receiving the wrong advice can hurt you. Be wary of the often unscrupulous notaries and those, especially non-licensed attorneys offering help with immigration services.”

What's in a word
The Spanish word “notario” has different meanings in different parts of the world. In some Latin American countries, “notario” refers to a lawyer with special credentials. In Hispanic communities in the U.S., unlicensed, underground notarios have been peddling legal services or offering to help fill out the application forms for young undocumented immigrants seeking a reprieve and work permits under the new Obama policy.
President Obama announces that the Department of Homeland Security will no longer seek the deportation of many young illegal immigrants.
People who need help with immigration issues should be careful before paying money to anyone who is neither an attorney nor an accredited representative of a recognized organization,” Masto said. “Scammers exploit the word ‘notario.’”
In New York, Gov. Andrew Cuomo plans to set aside $600,000 for a legal team of immigration lawyers who will help undocumented immigrants who apply under the new policy. It’s part of a state plan aimed at shielding illegal immigrants from fraud.
“I think there is going to be a great deal of fraud, and these young people are going to need a great deal of help responding with the kinds of documents the federal government is going to require from them,” New York Secretary of the State Cesar A. Perales, was quoted as saying in The New York Times.
“It became clear to us that this was going to be a golden opportunity for scammers.”

“Immigration consultants run rampant throughout the immigrant community. New immigrants get confused and believe that an American Notary has the same power and place in our society as that of a Notario in their country,” New Jersey-based immigration lawyer Moses Apsan recently wrote. “The immigrant believing that a Notario is the same as a licensed lawyer, hires the Notario and in many cases, find themselves in legal ‘hot water.’”
In a follow-up telephone interview, Apsan added: "I’m really worried that they’re all going to take advantage of these kids and get them to lie or submit phony documents."
The DACA program, announced by Obama in June, provides temporary deportation relief and work permits to young undocumented immigrants who meet certain criteria. Unlike the better-known DREAM Act, legislation that has never passed Congress, DACA does not offer a path to citizenship.
The Migration Policy Institute estimates that as many as 1.76 million people could be eligible for an extra two years in the U.S. under the new DACA policy. Each applicant must pay a $465 filing fee to the government.

The potential for fraud in the immigrant communities has even caused a rift between politicians and lawyers.
Earlier this month, Sen. Dick Durbin and Rep. Luis Gutierrez, both Illinois Democrats who have been longtime advocates of immigration reform, put out a video – with Spanish and English versions – outlining who would qualify for deferred status. In the video, they told constituents to be wary of notario fraud.
“Do not hire a lawyer or pay a notario,” Durbin stated in the video. “… Virtually everyone will be able to go through the process without a lawyer.”

Lawyers quickly blasted the lawmakers’ message as misguided and doing a disservice to the class of people they are ostensibly trying to help.
Karin Wolman, a New York immigration attorney, said the video perpetuated “a dangerous source of confusion” between unscrupulous notaries and trained, licensed attorneys.
“This is a one-shot opportunity. Applicants must get it right on the first try, or else they face a discretionary denial that is final and cannot be reviewed,” she wrote in a blog post.
Durbin and Gutierrez pulled the video after receiving a torrent of complaints from immigration attorneys and others.
“I think it became clear that he overstepped the bounds of common sense,” Wolman said of Durbin.
The U.S. Citizenship and Immigration Services website (www.uscis.gov/avoidscams) includes tips on filing forms, reporting scams and finding accredited legal services.
The agency will begin accepting Deferred Action for Childhood Arrivals applications on Wednesday.
The requirements for applicants:
1. Were under the age of 31 as of June 15, 2012.
2. Came to the United States before reaching your 16th birthday.
3. Have continuously resided in the United States since June 15, 2007, up to the present time.
4. Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS.
5. Entered without inspection before June 15, 2012, or your lawful immigration status expired as of June 15, 2012.
6. Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States.
7. And have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

But it's not a scam. Didn't you get the memo?
There are US District courts out there that are ruling that stealing your SS# for loans and jobs is not technically identity theft because illegals aren't buying anything with your credit card, just your name and identity.
Who cares if they ruin your credit or put you in debt when they can't pay off loans? Who cares if the IRS comes after you on unpaid taxes for a job you didn't know you had?
Remember, it's not considered a scam, because it is done for a "noble" cause!

As the daughter of legal immigrants, on three sides of my family, I, too am outraged by illegals and their continual criminal behavior, handouts and expectations and demands of the taxpaying citizens of this country. None more outrageous than the a-holes in office who cater to them and their whims...
Did you ever notice how in these bleeding heart interviews with these children of illegals there is never any acknowledgement that their parents broke the law?
All I hear is "It's not my fault, don't punish me for my parents' mistakes!" And yet there is never a single apology or sign of remorse from the parents for breaking the law and putting their kids in the middle of all of this. If I personally made life more tough than it needed to be for my kids to live here, I would show at least some sign of guilt in order to gain public support.
You know why we don't ever see that? It's because those that are breaking the law actually feel entitled to do so! They stand there demanding the same rights for them and their children but when you ask them what they are doing to personally take responsibility for their own legal status they look like a deer caught in headlights!!!! They don't want to answer because they don't feel the need to pursue citizenship. And why should they? Why bother when the gov't is providing the ability to skip that step completely!!!
I would have much more sympathy for these immigrants and their children if even one of them stood up and said, "You know, I messed up. I couldn't go through the correct path to become legal at the time and I am sorry for lying and cheating my way into this life that I have now. I want to make it right for me and my kids".
But that will never happen because not one of them thinks they did anything wrong. So why should they get my sympathy?????

Romneys plan would bring 1,250,000 high tech workers into this country claiming there isn't enough Americans to fill these jobs even though unemployment rates in these fields are double what they were before Bushs meltdown. He does claim they'll create lots of support jobs for Americans, like selling them Big Macs. He just wants cheap labor.
Obama is allowing some already here to stay here temporaraly. Romney plans to pay the airfare of twice as many and give them permanent residency.

I am afraid that there is nothing that can legally be done. Even if I weren't, what difference would that make? My ancestors (my mother, who came a five with her parents) and (my grandmother who came at three with her parents and siblings) waited to come to this country legally and not only flourished and thrived, they became assets to the people of this country.
They all learned the language, because schools, especially those in the 40's, did/do not cater to Greeks and Norwegians learning English as a second language. ALL FOUR of their parents learned to read, write and speak the language within a year of stepping foot on United States soil, as well as all their children. My Grandfather not only spoke Greek and English, he spoke Spanish (not Mexican, but Castilian Spanish, as well). Both side started successful local business, my Mother parents receive 'The Key's to the City" when they retired and sold their dry cleaning/shoe repair businesses. My Grandmothers father sold his part of the refinery business to his brothers son, at the time daughters were 'kept' and didn't work for a living and my other grandfather (the one who's ancestors came to this country at pretty much it's inception, indentured slaves) did overseas construction. He was in charge of building highways in Thailand in the late 50/early 60's (he passed away in the 60's). He learned to speak Thai (remember this man was a multi-generational American man), read some as well. My grandmother, Mom and I are part of a philanthropic organization, that gives back to the community. We pay our taxes. Never served time in jail. My father, and grandfather served in the military, my father is a Vietnam Vet., grandfather a WWII Vet.
My mother, father (both now retired), myself and my brother all finished school, college included. Have pretty good careers, Careers no 'illegal' is ever going to be able to take our place at. I'm a nurse, my brother works for the state, at the DWP. We all own our own homes. Our kids are doing great too! My son is on the road to a good university, being an straight 'A' and 'B' student, especially for a kid who's dyslexic.
None of us joined gangs, live in ghetto filth, dropped out of school, had a kid before we could pay for them. We don't have our hands out for others to pay for us, because we're too stupid to figure out that working a job under the table, for crappy wages and no benefits, illegally, gets you no where. I live in Los Angeles California, I see illegals every single day. I know the crap they bring, the mentality they have, they forget this isn't Mexico and they bring that disgusting 'culture' with them.
The 'shame', but more importantly the 'disgrace' is theirs...

This policy of Obamas in nothing more than a disgusting attempt to increase the voting population of the Democratic party in the future. While I do have some sympathy for those young illegals wanting a better life, they are and continue to be a drain on this country's resources that are needed by our citizens and legal residents. A line in the sand has to be drawn somewhere. The problem is that Obama and his minions refuse to draw that line! I live 6 blocks from the border fence in SE Arizona and am sick and tired of the illegals using the alleys behind my house as transit routes heading north! Obama and his minions have no plans whatsoever for realistic immigration reform and are actively and deliberately hamstringing the U.S. Border Patrol and Customs people from effectively doing their jobs in the field to stop the flow! The leaders of Mexico are not stupid, think about this: They encourage their citizens to cross illegaly, especially the real poor and destitute, which by the way is mostly Mexicans with a lot of indian blood or pure indian. Mexico is a country that wants most of its citizens to look like the citizens of Argentina, Anglo looking. Mexico has always blamed its problems on the indians in the country, so if it can get them to leave, and send money home in the process, they believe the better off their country will be.
enough is enough. Let start taking care of AMERICAINS first. Shame on you all politicians, all you think is about votes and Americains are paying for it same as Europe. Some retired people cannot food, prescriptions etc but you have no problems paying welfare etc for people that shouldn't be here at the first place. Used to live in Cal for 20 years and I couldn't believe that illegals worked under the table and received welfare and the people taught it was okay. I wonder if people feel the same way now that they are broke. I am very tired of seeing peole on bridge card here as well , if their family brings them here to live here why should we pay for them. I don't care where they come from but they now the system and abuse it. If we stop giving money or welfare to people , they will stop coming here and go somewhere else. It goes the same for people that are too lazy to go to work and use the system. I am tired of paying for them. This is not fair to people that have worked all their life and obey by the rules.
