Philadelphia swim club discrimination case settled

The Justice Department announced a settlement agreement Thursday in a Philadelphia-area racial discrimination case dating back to June 2009.

During that summer, Creative Steps Day Camp of Northeast Philadelphia paid The Valley Swim Club in Huntingdon Valley for pool access for summer campers. After their first day of swimming, the camp's money was refunded and campers were told not to return.


Several campers claimed they heard pool members making racial comments while they were at the club.

The settlement agreement for $1.1 million is to be split among the 73 African-Americans involved in the case.

At the time, Valley Swim Club officials said race had nothing to do with it and that there were too many children for the lifeguards on duty.

The Justice Department spent months investigating along with the Pennsylvania Human Relations Commission and found it was racial hostility that prompted club members to ban the African-American children from the pool.

The Valley Swim Club filed for bankruptcy in November 2009. It was sold in June 2010 for $1.46 million.

According to the settlement, $65,000 will be set aside from the proceeds of the property sale to create a diversity leadership council between members of Creative Steps Day Camp and former Valley Club members. The council will work together to provide activities between the groups to include swimming, field trips and camps.

The settlement agreement is awaiting approval from the Bankruptcy Court for the Eastern District of Pennsylvania. It's already been approved by a District Court judge.

Well, any group is capable of discriminating against another, regardless of their being a "minority group" or not. I've seen plenty of blacks in Camden (where I work) acting in a racist manner towards whites, almost on a daily basis. Hypocrites come in all forms, it's just that some groups prefer to bury their heads in the sand, acting as if they're always right/innocent.

This settlement provides significant opportunity to children who were denied an opportunity based on their skin color.

I have a strong suspicion the campers were actually banned because of their behavior, which the camp justified because of their skin color. It seems odd that the pool would agree to let the camp pay for full summer access, but then swallow the loss of refunding the money and telling the camp not to return. That would hurt most businesses, regardless of the race of the kids involved. Philadelphia is quite racially diverse, so they ought to be used to black kids. Were there enough lifeguards on duty to watch the same number of white kids, but suddenly there weren't enough because the kids were black, and black kids tend to do whatever they want, ignoring any instructions from white authority figures? The same pool would have been sued into bankruptcy if one of the kids drowned due to goofing off, or being dunked too long by a friend. The camp might have given this pool no choice but a lawsuit, leaving the pool to choose between bankruptcy and bankruptcy, so now the pool is bankrupt.

Let me give you some perspective. I live in Phila.
Huntington Valley is a very Jewish suburb, right outside of the city. Many
residents are refugees from Phila. They would have happily spent the rest of
their lives in their old neighborhoods, but were forced to move because of
change.

I bought my first home in 1986, in a very stable, and for
many generations, proud working class neighborhood. My neighbors became alarmed
shortly after I moved in, when some minorities started to rent there. I thought
nothing of it, but by 1992, I (literally) saw the writing on the wall, and also
fled. Twenty years later, that proud neighborhood is an overgrown, burned out,
boarded up, graphitized, broken bottled, hoodlums on the corner, dirty looks
when you pass through, disgrace. There are a few nice mixed neighborhoods in Philly, but they are very rare. These are non-prejudicial facts.

I am not racist. I voted for Phila. Mayor Nutter, President
Obama (and will again), have black friends and associates. That doesn't mean I
want to live in their neighborhoods. Can you imagine what these swim club
members thought when they saw what was going on? Do we have to move once again?

I love how people who have no idea what really happened are the first to cry racism. Before accusing someone else of racism and saying how do you know were you there? Maybe you should ask yourself, how do you know...were you there? You know by defending these kids just because they are black and not knowing the whole story you are being racist too.

Maybe these kids were actually acting up. Anyone who has ever lived in the city knows exactly how inner city kids act no matter what color they are, especially at the pool. It may have been too much for a bunch of retired folks to put up with, and maybe they just wanted them gone. Of course you narrow minded people only see the poor black kids being mistreated. Not the rowdy black kids fighting, and knocking stuff over, and dis-respecting the adults. No that never happens in your ideal world does it? It must be nice to live in the suburbs, have a nice house, and a fancy car and stand up for the poor disenfranchised youth. The ones you more than likely only see on TV.

Again none of us were there so WE don't know what happened do we? So stop calling people names, and jumping to conclusion that anyone who doesn't agree with you must be racist.

I am white and am being discriminated against. I'm not allowed on BET Black Entertainment Television, NAACP won't help me, Al Sharpton won't help me, I'm not allowed to audition for Miss Black America and also the Black Panthers state I'm not welcome. Wow, hard to believe that it's still going on.

In 1954 or there about, big news in the country was that 4 black kids were not allowed to swim in a public swimming pool somewhere in the "states". I was going to school in new mexico at the time and said that since it was a "public" pool the black kids had as much right to swim there as anyone else. Hoo boy, you think that went over well? You can guess what I was called by most of the students and several teachers. I reckon I still feel the same way today.

However, if a group does not have systemic power and control over another group, the first segment of people cannot discriminate against the second group. However, probably you are referring to harassment. Harassment happens across racial, gender and religions lines.

So all it takes is for a "member", not staff, not the owner but a "member" to say "Why are there so many blacks kids here today?" to be sued?

Any pool, not used to or prepared for an additional 73 kids is going to be overwhelmed. Added to the task, the children were inner-city kids from low income single parent homes which probably created challenges they weren't used to. It may have been nothing more than they "bit off more than they could chew" but became the unfortunate victims themselves of insensitive members.

It's possible, this a privately owned pool had NO racist intent but got branded as racist w/out having any direct involvement and didn't have the money to fight the lawyers and the Justice Dept? Is this really a win for either party involved?

black adults can't be fired, punished etc for their bad behavior and neither can black kids. you think this business would've turned these kids away if they weren't a problem? The NAACP does not have a racial requirement for membership. They do not ask what your race is and they have members from many races. Please feel free to join, they will happily accept your membership fee.

BET is owned by Viacom a huge multinational media organization that also owns Paramount Pictures and MTV Networks (Country Music TV, Nicklelodeon, Comedy Central and more). The president is Sumner Redstone who owns 70% of the stock, he endorsed Bush in the 2004 race. Many, many white people have appeared on BET programming. Have you ever applied or auditioned for BET? What talent do you have to offer?

Have you ever asked Al Sharpton for help? Then how do you know what he would and would not do.

FYI I would not help you either, I am white but have no interest in helping the ignorant.

And I am certain you have never met a Blank Panther in your life, especially since the organization is defunct and has been for 20 years. So no an organization that has not existed in 20 years is not likely to help you.

The Miss BlackAmerica Pageant was created because the Miss America patent did not allow blacks to participate at the time it began. As it is a beauty patent for women I doubt you (as males) would really fit in all that well. However the official rules do not require you to be Black or a woman, only that you are not and have never been married and you are within the age requirements. So feel free to apply.

So I have debunked your every claim. THough I do doubt you would win Miss Black America...Men rarely do. Perhaps a sex change will help you though.

Now, for me to get a promotion, its the same, i have to pass skills tests to get my raise, show i am learning my job in progression to DESERVE a raise. This is fair to everyone, as it is called a "criteria review sheet", seeing i meet the the standard of knowlege to the pay i recieve. not much different than these people who were playing race-card poker.

As I'm an outspoken Democrat, I don't think the finding was right, I hate the right but they are correct, this was a privately held company, what right does anyone have to dictate policy, if that's the case they can tell whom you have to let into your home, not everyone is the same and people I don't care what Race or color have their prejudices, and I'll be damned if anyone will ever tell me who I have to let in my home and this is what has just happened unless they were getting government funds to operate the government had no right to tell them who they have let on their premises, people need to think about what just happened!

Your "example" is an example in your life. You cannot extrapolate your example and state that when neighborhoods become racially integrated, a "national decline" occurs. You have "black friends?" Because of the richness, spirit and complexity that is woven in African American communities, the culture in their communities remains vibrant, soulful and unique.

I hear your point being made by Mark Thompson all of the time about race and racism and I've certainly spent a lot of time thinking about it especially when he brings it up.

Your position that Black to White racism, also called reverse racism, cannot exist because black people do not have systemic power. I do not agree and for these points. Systemic power may not be controlled by black people but that is on a macro scale. Unfortunately, no one in the world lives in, and very few people can affect upon a macro scale. We all, for the very most part, live and exist on a micro scale. We work in places with a limited set of people, we live a particular part of town, etc. People in Philadelphia are not concerned with what's going on locally in a small Idaho town and vice versa.

Reverse racism on the micro scale can certainly exist. For that white couple out on a date, getting on the wrong train in NY and ending up in a black section of town, within their entire reachable surrounding the systemic power lies with the black community, not white. So when they are approached by "7 or 8" black men, poking, pushing, reaching into pockets, yes, those 2 white people are absolutely powerless, there is power in the situation, in the surrounding neighborhood, it is systemic on a micro scale and it is abused. This is from a recent news story I heard.

So, I would say that across the nation as a whole, yes, racism against white people from black people is a difficult position to support, but in the microcosms of America it is very alive and very well and the people affected are every bit as affected.

What part of the south is that in? There is more racism in the north than the liberal media will allow to be seen. I didn't know what racism was (as a Child), until I went to visit people in NY. Now there is where the real racist dwell. Then there is the Head Racist in Charge from Illinois.

    I live in Queens, Astoria to be exact. There is a pool in my neighborhood, but I stopped going years ago due to the unruly animals from the projects that started going there and yes, they are black. Sorry, but those are the facts.

    I don't know what idyllic town that you live in, but I live in Philadelphia.
    There really isn't racial harmony in the working class neighborhoods here.
    Minorities move in but don't integrate, they dominate and push the generations
    who have lived there out. The Northeast section of Phila. Is working class,
    with a strong Jewish heritage A lot of the residents in Huntington Valley are,
    as I already stated, folks that fled the city.

    I am not saying that Phila. is a racially charged bubbling cauldron of hate, there are melting pots throughout the city.But these are not working class areas, but more urbane, expensive and sophisticated neighborhoods. In my 40 years of living here, I have never seen a blue collar
    neighborhood improve, only decline, when the tables turn. This includes all of
    the cities that surround Phila. too, like Camden, Chester, Trenton, Coatesville
    and Norristown. They were stable some years ago, but are all either dead or
    dying.

    I said the club members had to wonder, not the owners. The members were the ones
    who used racial epitaphs.

    I used the example of black friends and voting record to show you that I am not
    racist. I sincerely wish the best for African-Americans.

    I live in Center City now, which is a very cosmopolitan enclave. Yes, we welcome
    all, regardless of race, creed or income level. But I can walk 15 blocks and
    enter a blighted neighborhood. Again, why would I want to move there? When
    looking at the destruction, I know why Whites can be so jumpy. Why would anyone
    wish this for the place they've called home for decades?

      aloprazolamerica - I live in Philly too. South Philly. Outside of Pennsport on the edge of the DMZ between there and the 'Italian' neighborhood. Where I live is predominantly working class, people of all races. The worst people have been white - the classless single woman who screamed abuse at her kids, the douchebag next door who thought it was appropriate to have sex outside in front of a childs bedroom window. There's been classless black people too, yes, but not the worst examples of it.

      The blighted neighborhoods in Philly tend to be mostly black, yes, but they also tend to be the poor neighborhoods. IMO it's correlation, not causation.

      Rob80-4249854, I too live in South Philly, Bella Vista, but we kinda consider ourselves Center City now. I will be the first to admit that the old guard Whites there are pretty trashy, it's true. But at least the white neighborhoods in SP are not blight areas.

      I agree that poor neighborhoods are Black, but whites in these working class areas aren't exactly rolling in dough either, yet they don't become blighted.

      Case in point, the woman who screamed at her kids constantly threw trash in her back yard. the yard was full of it, and she let her kids play in it. Was disgusting. The idiots who own a lot a couple of doors down let the building go to rot and the city had to pull it down. It now gets overgrown (till someone from the city comes to clear it after numerous calls) and the sidewalk is, literally, gone with just dust left. I don't know who exactly those owners are, but if they could afford to keep that lot of over 7 years they can't be 'the poor'?

          Where are the people who race to judge the kids and the organizer as reverse racism, defending the rights of the management of the club to help the members to discriminate. Glad to see the club membership dwindle to a point of no return. Just wondering why the Aryan Clubs not helping to do charity or defense fund for a club that help their causes?

          The fact of the matter is that some people don't want to mix with other people. If that's the case then they should be smart about it. Have pool partys in private pools and then you can legally control who comes to swim. I've had run ins with blacks quite a few times--when I was a boy and went to the shrine auditoreum in Los Angeles a black boy sucker punched me in the stomach when I was walking into the men's restroom, knocking all the air out of me. Then he and his gang of friends ran off. When I was in high school I was robbed by two black men. I had a black man threaten me for no reason when I was 18 when I was walking near the Tennis courts at Los Angeles City College, he said he just wanted to beat someone. Just the other day I got into an altercation with a grown black man because I wouldn't let his son cut in front of my son while we were waiting at a stall in the men's restroom at the Ontario Mills Mall. Luckily, this black man had some sense and backed down when I held my ground. There are many other examples. I know some black people that I like but for the most part I'd rather hang around my own kind because I don't feel comfortable around blacks. This is a person's right in my opinion. But of course if you go to a public pool or business pool then you can't control who goes in. Like I said, do the private pool thing. Is that racism? No.

          Join the country club, blacks won't pay the membership dues. I prefer my own kind. When I was growing up, we had a jewish family move in across the street we couldn't play with the children, their parents wouldn't allow them to play with non Jewish kids.

          I have been called "illegal" or "go back to your own country", even thought I have been in US for more than 15 years and I came here when I was under 18. I also am a US citizen for more than 10 years.

          JoeCal, I can relate with how you feel. I used to be completely non-racist in college (true by the way even if you don't believe me) but after moving to a big city and working in a predominately black/hispanic area, my attitude had turned negative toward black people. I won't go out of my way to denigrate them or give them a hard time but i'll avoid them if I can, at least the ones I don't know personally.

          we have all been treated unfairly, been harassed, been profiled or stereotyped..prejudices, sometimes maybe we should just suck it up...and I say that because, there is a good chance this pool will never open again, financially how could they?. So now many many many kids will not get the opportunity to go there...I just don't see how any one got anything except $$ in their pockets...but the only message I can see is, now no one gets to swim. I would have rather seen certain individuals be held accountable (with a punishment that fits the crime, how did this financially hurt those who were being talked about) , instead they shut out every kid needing a chance

          What I am is not racist. What I have when I have feelings of dislike toward someone, black, white, jewish, hispanic...etc. is not racial, by any means. However, if I were to talk to one of my friends, of the same ethnicity, about someone, of another ethnicity because they are doing something wrong or stupid, I do believe it would be taken as racial, even if it is something slight. However, if it were turned around, and I was on the butt end of the conversation, it wouldn't be taken as racial. How can it be racially motivated, ALL the time for white people to say ANYTHING bad about against or around black people, but when it is turned around it is not looked at as the same toward the white race. I am simply just asking, honestly. My relatives came here from another country, many years ago. I have been taught to love everyone. I have taught my children the same. They are of mixed race, how are they supposed to go far in life if they are to be made to choose, eventually, in the real world, which race to stand behind. It is a sad time, when "people" can't just be "people" anymore!!!!

            JoeCal - Hmm, that's funny because I've only ever been abused/assaulted by white people (and I'm white). When I was a kid I was bullied by another white kid. When a teenager I had my bike stolen by an older teenager, who pushed me off my bike to steal it. When in my twenties I was assaulted by 2 white youths on a night out. They smashed a bottle over my head and beat me to the floor. The only reason they didn't get away with anything (money, phone) is because a street cleaner came by and they scarpered. I've never, ever, had a problem with a black person... that I can recall anyway. Does this mean I should disown all my white friends and make friends with only other races from now on? I hope not as most of my friends (and of course my family!) are actually white. I think what I'll continue to do is to take everybody as an individual.

And I have a right to live mine the way I want. I have also had run ins with whites and hispanics and an asian once. However, these were few and far in-between.                   Sounds to me that there was some misrepresentation involved. The swim club, which was private, made a deal to let another group to use their pool. Fine. I do not care if the other group was white or black. The swim club had to know that they were primarily black, but who cares? The number was false. If my swim club gets invaded (or taken over) by a bunch of kids, I don't care what their race is, I'm kicking them out. In this instance one day was enough. There are other patrons.

                      I've had some experience with discrimination complaints of various kinds (I have a son with a disability and we ran into some issues with his school, but I have also helped other people write complaints over discrimination of various types). My experience--and anyone who has done this has probably run into the same thing--is that it is NOT easy to establish that discrimination has occurred, believe it or not. When you file, whether with a state or a federal agency, there is a lengthy process, you HAVE to have detailed evidence, you HAVE to specify what, where, and when the discrimination occurred, and you HAVE to have proof. The other side has just as much opportunity to rebut, and you don't get to see their information (until after the issue has been decided, in which case you can do FOIA requests if federal, otherwise whatever state process there is). You also have to provide the legal framework--because in a completely private setting, there are no laws against discrimination. You may have a very good case that is dismissed on narrow technical grounds. Just alleging discrimination does NOT get you a decision in your favor. I helped a 70-year-old guy file one against Walmart with the EEOC. When hired he told the HR person he had neuropathy and could not walk long distances, therefore could not be a cart wrangler. She said she would assign him to a stocking job, which he said he could do. A young smart-alecky manager started making him round of carts. A standard Walmart superstore is 18 acres, much of that parking and people leave carts all over. The guy did what he was told for a few nights since it was only part of his shift. He did notice that he and a young Native American kid were the only people being told to do that. Then the mgr made him do it for a full shift on a night when temps did not fall below 80 and the humidity was high. Then yelled at him because by then it took him 10 minutes to walk from the lot to the break room for his break, so the mgr told him his break was already over. He told the mgr then that he could not keep doing the carts because of his legs--he's had diabetes for years and had quad bypass a few years ago. Mgr said everyone has to do carts (not not everyone, just him and the Native American kid) and it was part of his job, then told him he had to quit and made him sign a form saying he was resigning for medical reasons. He told the mgr he did not want to quit, he wanted to do the stocking job he had been hired for, but the mgr would not hear of it. He had been upfront with HR, which SHOULD have had him do any paperwork required to establish reasonable accommodations. He had told her he could give her doctor's statements but she did not pursue it. It's a year since we filed the complaint, it has gone to EEOC regional office, from there to a field office, from there to a state agency that is conducting the actual investigation, each time he has to do (mostly identical) paperwork all over again to keep the process going.

                      With these kids, racist remarks from members would be one thing. But then the club added to the problem when they "solved it" by making the kids leave. If they rent use of the pool to others, then that probably makes them a public accommodation so the "private property" excuse does not work.

During that time I was called many names not my own and not of my ancestors but I just figuered it was their upbringing! Perhaps I should have sued the entire city for allowing this type of behavior!

                          Evidently, you don't know your history. African-Americans have done a lot on their own (established colleges and universities, businesses, clubs, etc.). If you own a facility and agree to allow people to come in and they plan a trip and upon their arrival you decide you don't want them to use the facility because of race.                           Golly gee, did the Justice Dept. do the same level of "investigation" when the Black Panthers intimidated and kept voters away from the polls in 2008. Go back to the story and simply substitute white voters where it talks about black swimmers and we see the discrimination. As the civil rights movement was proud to chant, "no justice,no peace".

                          Hi John,

                          All of the organizations that you have listed, were begun decades ago out of need. and the civil rights activists that you have mentioned grew up in an era when without these organizations, there was very little chance that they as black people could have gotten an education or a good job.

                          Further more, few of these organizations actually discriminate. Watch the BET awards program. You'll see lots of people from other "race"s and even nationalities. Things are changing. Do you remember MTV in the early 80's? There were no black or asian artists featured. Then came Michael Jackson, Whitney Houston and more. We are going through a process, and just because some of us are happy and content in our comfortable places, does not mean that everyone has found a seat at the table, or even into the banquet hall.

                          Siting The United Negro College Fund is interesting. First off the name of the organization signals that it was started in the prime of Jim-Crow. Hear the word "negro" much lately? I just wonder; who decides when we are "equal enough"?

                          Besides, there are scholarships for Jewish-Americans, and Irish-Americans, and Native-Americans of various nations (tribes). There are scholarships for kids from rural areas, and urban areas, and scholarships for Christians of all stripes, there are programs to help women ("Ride! Sally Ride!"), and sports scholarships are a near "sacred" part of the American higher education system, even though there have always been detractors. What is wrong with recognizing the problems that a section of our society my face and putting together the funds to help young people overcome them?

                          To call these organizations and these people "racist" is like calling our founding fathers "anti-British". Better yet, its like calling members of the underground Jewish resistance to Nazi Germany, anti German.

                          There were, and unfortunately still are reasons for these groups and other groups like therm to form and to exist. Just as both race and religion is still an issue for Israel, race and equality are unfortunately, still issues in America. We have come a long way, but the this swimming pool incident shows that we are not "there" yet.

                          MLK was spoken of in the same negative terms that you now speak of Al Sharpton and Jessie Jackson. Remember, the man was murdered. The history that you are speaking so off handedly about, happened not that far in the past. Lots of us lived through it (on both sides of the color line) and it still effects us.

                          If you can't understand what the fuss is all about, then join the conversation. You'll hear about lynchings, and kids beat-up or just kept out of school. You'll hear about folks dying because they were not allowed to enter hospitals, you'll hear about victims of crimes: rape, robbery, battery, land-theft and murder that had no hope of justice. and this is stuff that I lived through, and I'm just a, (hate to say it) "middle aged guy". This "recent history" is also why the Trayvon Martin case sent off alarm bells. To say that only black people were upset is to deny reality.This is a shared history.

                          King, Jackson and Sharpton, are all black men, but they have all fought for the rights of other groups as well. MLK was perhaps as hated for his work with unions and the fight for better pay for poor people of all colors as he was for his work against race discrimination. Jackson and Sharpton, have always been involved with equal pay and rights for women, and Latinos and more recently, equal treatment and rights for the LGBT community. They don't call their organization "the Rainbow Coalition" for nothing.

                          Things are better, WAY better. I was one of those people people that kind of fell down in a sobbing heap when Barack Obama was elected President of the United States. This seemed more improbable than a moon landing. I wish my parents could have lived to have seen that day. But even an American President of Color does not mean that "the problem" is solved.

                          I think I can speak for all of us involved in equal rights movements in saying that we all hope and work for the day when these efforts are no longer necessary.

                          I think I will apply to a all black collage and see how well the system works. or join a all black club like the one in Minneapolis that asked me to leave because my color offended some patrons, even though there were plenty of white women there. And I was there by invitation and some of the members were very hospitable while others were simply intolerant about the white honky SOB's in their club. there has to be a better way to deal with this problem then forcing something into bankruptcy, how does that make friends? do you see what is happening here, sure lets build on hate, lets magnify it 100 fold that is stupid. no one was hurt so there were no medical bills to pay the reasons were buried under claims of discrimination and the money was returned, so why the extravagant settlement, I cant buy racism because they were welcomed to begin with. this is as unjust as it can get.

                          If your only problems are with people wearing their pants too low, then have a dress code. Last I checked, you'd catch as many, if not more white kids. Besides, then it would be a choice. An individual can't stop being black, but he or she can pull their pants up.

                          Make realistic, constructive, fair rules, and I think you'll be surprised at who supports you. I don't really understand why kids want to show their underwear. And I do understand why some folks don't want to see them. Didn't some guy get put off of a plane for that? Well, that works for me; no matter what his paint job was.

                          If you have an individual who doesn't wear his pants too low, neither does he carry a concealed weapon, nor does he sport offensive tattoos, who is clean and polite (when in you institution) and who respects other people's property; and yet you deny them entry because of race or sexual orientation or religion or what ever arbitrary reason, and then you welcome with open arms some foul-mouthed, unwashed, loud, destructive, swastika and confederate flag tattooed, gun toting, graffiti scrawling kid of European descent, then not only can we assume that you are racist, we can assume that you have your priorities mixed up.

                          "Black" does not equal "bad", and "White" does not equal "fine and dandy".

                            I am a college student, I had a college club ask me to join their club. I was amazed to see that college clubs segregate themselves. I asked the leader of the club why they felt it was appropriate to create a one cultural club and name themselves so. I said how would you feel if you seen a whites only club. A lot of questions fell on deaf ears. I declined to be in the club, when you create segregation for yourself you cant bitch that you are being segregated.

It doesn't matter that I have graduated from the #3 High school in the nation for academics, and that my college and Professional is probably more successful than the people writing these terrible comments. What matters is that I don't smoke or sell crack cocaine, I'm into hybrids over gas guzzling ozone destroyers, and what's probably most important is that you find JESUS and that you understand that no matter what the pay out was (It must have been fair for what these families went through because the pay-out amounts were Given by the USA fair court system); please pay attention to the hatred in your heart and just let it go.                               ACORN is a voter-registration group which even the Republican party used to work with in order to mobilize people in poor communities. They had a bad habit of hiring people from poor communities to staff their facilities, not stopping to think that their motivation probably wasn't typically doing good (just taking whatever job they could get). While there were a couple of locations with poor quality employees and poor quality supervision, other locations were of high quality. The ditz who went from ACORN location to ACORN location did not show all the footage he got--just the footage of the poor quality locations.

                              This group was, in fact, investigated at their invitation by former Massachusetts Attorney General Scott Harshbarger--he did find some poor behaviors but nothing criminal. They were not investigated further because, frankly, no one had evidence of criminal conduct. Even if the people at ACORN advised criminal conduct, they did not aid and abet it. As a recent court case found--even a person who encourages the murder of an individual, if that person does not take any action to make it come about, cannot be prosecuted even if someone goes and murders that individual as they suggested. Advice does not become criminal unless there is an act that goes along with it or except in certain other limited circumstances (such as advocating the violent overthrow of the government).

                              The "New Black Panther Party" is considered a hate group by the Southern Poverty Law Center. This means it is considered a hate group by the FBI, almost certainly. If you want, you can request the file on the New Black Panther Party from the FBI under the FOIPA. Be prepared to pay about a dollar a page for what they find (costs of copying and administration fees), and be prepared to get a document with a lot of blacked-out boxes. The Department of Justice does not do investigations into groups of that nature--that is handled by the FBI, other federal law enforcement agencies, and local law enforcement. The Department of Justice typically investigates civil rights violations--the New Black Panther Party, if they are doing something amiss, are probably breaking criminal codes.

                              The Valley Swim Club declared bankruptcy after it lost members due to the incident of racial discrimination. And, there was no question of it as a member got into a heated argument with someone affiliated with this group--and her racial comments were undeniable (the woman was also a teacher at the same school that these children attended). It would not look good for any well-to-do European American to be affiliated with such a group. Also, by declaring bankruptcy, they probably hoped to thwart any lawsuits. It didn't work--but it was a clever tactic. The Club was SOLD for about a million and a half to someone else--it was worth up to ten million--and is being operated by a different group. The amount of money these children got could probably not (by law) exceed the amount that the club was "worth" (that is, the amount it was sold for).

                              The building was sold to a synagogue (probably with the same membership that had technically pulled out of the Valley Swim Club), and the synagogue now uses the building for its own members and as for recreation--they don't have to pay taxes on it now, and I doubt that they rent it out without knowing to whom they are renting it out. As a "church," they don't have to have the same transparency as others and can easily reject people by saying that members of the synagogue want to use the pool on that day. It is very common for Jewish people to be anti-black, and it is also very common for them to have enough lawyers working for the group that they can wriggle out of lawsuits.

                              If you want to know the evidence--try Google. But, this was a club--and like any country-clubish organization, it wasn't really a "business." It is still in operation, and is still frequented by the same upper class individuals who were operating it before. No one was "put out of work." You know, seriously, it was not hard to find this information. Try looking things up before you start asking rhetorical questions that have no substance.

                              You are right and blacks can't seem to grasp that it is not for the color of skin that decent people shun them,it is for their lack of personal cleanliness, totally obnoxious rude attitudes and the prevalent double standard they live and flourish in. Why is it that if you own an establishment you have no say so who can enter and who can not, should you deem the person(s) unacceptable especially if they are black ? Why is it legal for only the blacks to discriminate? Why is it ok for blacks to be with just blacks but if a black wants to push his way into a non-black situation if you don't bow down and give them their way you are a discriminating racist. Maybe its because the line of people waiting to be accepted into blackdom is so short it bears hardly a mention,after all no respecting individual would raise a fuss because he wasn't rubbing elbows with the folks in black-town. And for you people who say this is b-s. Lets see the list of whites who are suing to get into a black establishment.Then compare the list of blacks suing to get into a white establishment.There is something wrong with this picture! Lets face it blacks were freed over 147 yrs. ago and whites prefer whites and blacks prefer to try to be around whites if for no other reason than to aggrevate and try to bring them down.                               That is such a generalized statement you've just made. As an African American woman I have come across people that are not clean of various nationalities and very obnoxious attitudes as well. And the reason why you really don't have say over who can come in and out of you establishments is because most people who are racist will take the actions of a few people and hold an entire race accountable for it, as if we are all one person. There are good people just like there are bad people in all walks of life but for some reason those who are creating these stereotypes has this sense of entitlement about themselves. They seem to have this " it belong to us" attitude and we are not entitled to anything. I've seen white kids destroy neighborhoods just like I've seen blacks, don't get it twisted whites can be just as destructive as the next person. People should be able to live, have fun or just enjoy the moment where ever they like, no ones asking you to bow down to us but what you can do is stop with the obnoxious stereotypes, or the prejudice act and then maybe you won't be accused of being discriminating. And just to set the record straight I don't think there is a black woman or man that is press to be in the presents of anyone white, I do believe this world is large enough for us all to live in and not have one group claim ownership of everything that exist in it just because we're there. So please do yourself a favor and get over yourself because in your world blacks and whites will never like each other, but in everyone elses world we've evolve from that BS. Maybe if you open your mind a little more you'll see that most of the world has moved on from that back wood, hang 'em cuz he's mentality. It's people like you that keep racism and bigotry alive just because of your insecurities. If making other feel inadequate empowers you then damn you're a weak individual.

The truth only offends those that are in denial of its authenticity when it cannot be legitimately argued as the truth that it is. It's easy to justify the behavior of ones kind by pointing the finger at hypothetical happenings and accusing others of actions that you and the like are known for having the propensity to act. You seem to be trying to speak for your whole lot,but your words and your(their)actions don't line up.                               Southern Man - I am a white woman and I am disgusted with your post. If you have never met any decent black people than you are not looking. Blacks have been moving into my suburban neighborhood for years now and they are no different than any of my white neighbors. Having lived in the neighborhood for 30 years I have seen no significant changes due to blacks moving in. I have no fear of walking down the street alone. I have no fear that they are going to damage my property or attempt to steal from me. Having been involved in a youth organization for the last 22 years I have dealt with all kinds of people and I can truly say that the majority of the blacks whose children were involved were well brought up by good parents and no different than the white children. You seem to be the one that can't take facts.

                              As manns said, you are the type that keeps racism and bigotry alive. You look at a person of color and you prejudge them. Open your mind and get to know some of them you will be surprised at how much they really are just like us. You have scum from all walks of life, from all races and all nationalities. I can't say that I like every black person that I meet but then I don't like every white person that I meet either.

                              Hey, John Australia, I do hope that you would go into the very Irish community that I live near and tell them the same thing... that they should remove all of their Irish flags and that they should not call themselves Irish-American anymore. While you're at it, you can go to the Italian neighborhood and do the same thing.

                                It's interesting that the Obama DOJ found racism here, but it didn't find any problem with the black supremacist hate group the New Black Panthers who swung bats at white voters to force them away from the polls in November 2008.

                                      MrShin, when whites are no longer promoted as the standard of beauty in the media, when they aren't more likely to be targeted or killed by police officers, when they aren't more likely to be called in for an interview over a guy with a "black"-sounding name (but who has the same credentials as you do), then you can complain about whites being a target of racism. Last time I checked, whites were still systematically the favorite in this country, even if Hispanics/Latinos will eventually outnumber whites in a few decades.

                                      You see more white people in the media not because of racism, but because there are more white people in the country, so that is the target market. Police officers are 5 times more likely to be killed by a black suspect than a white suspect - maybe that is the reason the officers 'target' blacks more than whites. As far as 'black-sounding' names - the same thing happens with 'white trash' names so get over it. I know that not all people in a group are the same - white people included - but until people are held accountable for their actions, nothing will change. As long as people perpetuate the stereotype, the stereotype will exist - right or wrong.

                                        It's fine to have discrimination and racism in the highest levels of government by allowing the Congressional Black Caucus, Hispanic Caucus, Asian Caucus, etc. in congress that don't allow members from other races in thier private Cliques. It's OK for Obama to sign an Executive Order giving preferential treatment to Black Students who are failing in school. It's no problem that obama took it upon himself to sign an executive order which negates the law of the land and primarily aids the illegals in the Hispanic community. Discrimination, racism, preferential treatment is perfectly acceptable when sponsored by the Federal Government.

                                          Hi alienjon,

                                          Most of the issues that the NAACP are dealing with now, are problems of poverty. Therefore, any gains that are made are shared by all poor people all over the country. They are also working with single parent families, and education. Even if some of their efforts are focused on the black community, if the families that they help become less dependent on the government, that is a boon for us all.

                                          So what's your problem? As a black man from an earlier time, I always resented being asked to specify what kind of hyphenated "American" I was. I think it is really strange that some white folk seem to be envious of those of us who had to fight to be included.

                                          I hear folks complain on this vine that black folks don't do enough to take care of our community, and then the same people turn around and trash talk our flag ship organization for "trying to take care of our community". As stated above, "our" community goes beyond just black folk.

                                          So Alienjon, what exactly do you want? And by the way, any one can join the NAACP. Just like any one can join an Italian Opera society. You just have to like Italian opera. Or you just have to want to do something positive in the black and greater American community.

I don't see any mention about asians,hispanics,whites,american indians or any other race except coloreds. Now why don't you do yourself a favor and learn how to be truthful. It appears that these people that you claim need educated are already far educated above your estimation of yourself. Be advised just because you say something is true intelligent people are capable of discerning the truth. And that is definitely a quality that you are lacking in or are more interested in twisting to make your viewpoint more acceptable. A lie is a lie and the truth is the truth you need to learn to tell one from the other. Be it from a book or whatever means you claim to be educated from.

                                                If the attorneys took 1/3 of the settlement then the remainder divided by 73 comes out to a whooping 5,022 dollars. Everybody gets a new tv and a months worth of crack.

                                                Maybe the campers were not respecting the club or behaving like normal people. Not one of us were there nor where the justices. It is the right of any private club to include or exclude anyone they see fit. Oh and if you are a justice or someone investigating you do not want to be called a racist. Does anyone really think that the people who complained or made the racist comments give a darn, they just went to another swim club.

In Australia job adverts state 'Aboriginal and Torres Strait Islanders encouraged to apply'. You are not allowed to advertise 'caucasians encouraged to apply'. How racist is that.                                                   Garpo I used to teach the Aboriginal Torres Strait Islanders and we had to drop the education requirements so they could pass tests. They dont require normal standards of education that the rest of the Australians which included Asians, British, Indians, Chinese, New Zealanders and every one else had to achieve so the standards were lowered. If you don't believe me - contact anyone at the coal face in the indigenous communities in Australia. I am not a racist - I don't care what colour your skin is. Just act like a normal civilised person and come out of the dark ages.

                                                      I guess the freedom of association in the Constitution only applies to blacks. They're free to associate with whomever they choose whether the others want to associate with them or not. Sorry folks, but private clubs do have the right to deny membership or services to others on any grounds that they choose. For that matter, has anyone considered that the "campers" might have had a hostile and obnoxious attitude towards their hosts and the club members didn't like it? I know that if I had paid a bunch of money for a membership to a club and the club contracted to provide services to a bunch of unruly, loud mouthed and foul mouthed kids, I would be none too happy about it. While it certainly is possible that the kids involved were perfect angels, the number and severity of the flash robs that have occurred in Philadelphia would lead me to believe that the opposite was probably the case. I guess under the current administration and all Democrat controlled agencies, stating the fact that the black community has a significantly higher probability of committing crimes than whites, Asians, or legal Hispanics is considered racist. Blacks, if you don't want to be discriminated against, get your damn house in order. Get an education, stay off drugs, don't have kids out of wedlock and don't commit crimes or tolerate those who do. A black felon was shot in Dallas two weeks ago after running from and then assaulting a police officer and the black "community" was on the edge of rioting because "They didn't need to shoot him" Gee, if I were a cop and had chased some idiot for umpteen blocks and he had attacked me, I think I'd probably have capped his arse too. The punk was 30 years old and had been convicted on two previous felonies and was back selling drugs AGAIN. Black communities want to whine about the police not patrolling their neighborhoods but then turn on the cops when they do take out a violent repeat offender in self defense. I lived in a black neighborhood in Phoenix for years. My property was burglarized repeatedly in broad daylight and no one ever saw a thing. I had an alarm system and a big dog in the house, but I hadn't been out of the house for a month before someone tore a window out of the wall and ripped half of the interior of the house apart. Now the Dallas PD are going to have to carry the only moderately effective Taser. How soon will it be before someone who is tased pulls out the electrodes like Rodney King did and then kills the officer who tased him?

                                                      That's not all blacks. FYI, more than 60% of welfare recipients are White. There are just as many if not more, foul mouth white kids. In fact, there are some black colleges that compete against large white colleges in business competitions and WIN. You won't hear about that in the media.

                                                      I watched the owner of this pool company speaking about what happened and there was no racism involved. The owners had provided a Monday for a discount for military and churches. The one claiming racism couldnt do the Monday and asked for a different day and the owners said no only Monday. Here is where then all of this started. Here again MSNBC is merely race baiting instead of reporting the issue properly. Some of you here need to actually listen to the owners instead of MSNBC. Oh, the owners business on the Monday discount day was so hugh, they were having trouble keeping up. The business is only open season to season then closed the rest of the year.
