Texas teacher sentenced to five years in prison for having sex with five students

Updated 8 p.m. ET: FORT WORTH, Texas -- Brittni Colleps, the Kennedale teacher accused of having improper sexual relationships with several of her students, has been found guilty on all counts of five indictments against her.

Colleps was sentenced to five years in prison Friday afternoon.

Colleps showed no emotion as the guilty verdicts were read on all 16 counts of the indictments. Her husband, on the other hand, was emotional and crying as his wife, with her bail now revoked, was led from the courtroom in the custody of the state.

Colleps was indicted on five charges of having an inappropriate relationship between a teacher and student after school officials learned of the allegations and took the matter to the Arlington police.

The trial began earlier this week with graphic testimony including text messages and a cell phone video that showed one of the alleged sexual incidents. The prosecution wrapped up their case Thursday before closing arguments began Friday morning. 

The five victims all testified to having a sexual relationship with the married mother of three in her Arlington home between April and May of 2011. All five of the students were in Colleps' senior English class in the spring of 2011 and all of the victims were at least 18 when the incidents occurred.

Brittni Colleps, shown in court on Thursday, has been found guilty on all counts of five indictments against her for having improper relationships with five of her students.

Despite their age, Texas law forbids sexual relationships between teachers and students, even if the students are legal adults and consent to the relationship. Several of the victims testified Thursday to not wanting to testify in the trial with one of them saying he didn't want to press charges.

After closing arguments, the jury took about an hour to render the verdict.

mellofello - Sure it is a law, but not a law I've ever heard about before. And I also can understand why that law may exist, like for the obvious reasons you mentioned, however 2-20 years in prison per count? to me that seems absurd! Sure I could understand the school firing her and I could even understand her being fined an or loosing her teaching license. But 2-20 years in prison? No that is totally absurd. But you are seeing more and more people being sent to prison over out dated or obsolete laws more often that I can ever remember. I believe it has to do with the privatization of the local prison systems and would not be surprised if Judges were getting kickbacks from the private prison sector.

I personaly think this is total BS she gets jail time for sex with adults yet im sure if her husband had sex with 5 18year old girls he wouldent get in trouble i can understand if they are under the age of consent that she get introuble but these are all adult age and it was at her house so what if she was there teacher this is like every young boys fantasy she is letting them live out they shouldent punish her for sex with adults fired yes maybe i can see that but jail time thats wrong and here i thought texas as a great state till this happened

I want to also say that if she were coercing these young men for grade status then definitely the law should apply, whether they be 18 or 28, but there is no mention that there was any coercion on her part in return for grade status. It seems she was just a hungery cougar.

OK I am not condoning what the teacher did but come on...really! We are so uptight in this country about sex. I mean she did commit adultry and that is bad but for God's sake...what would Jesus say? Those laws are in there for a reason, and that's because students have to remain in school if they want to graduate. Why should they have to attend with their predators working at the same site? Years ago such "relationships" were legal and even resulted in marriages, but districts are now extremely gunshy about this thanks to civil lawsuits. Sexual harassment of any kind leaves them open to such litigation, so they felt these power-imbalanced relationships had to be criminalized. You can bet anything lawsuits are going to result from this idiot's outrageous conduct. Predators should never be allowed to work anywhere near students.

To those saying that the state has the right to enact a punishment based on the fact that she is a state employee: well, you're right. This is why we require our teachers to be certified.

That said, 2-20 years in jail per-count is NOT a sentence that fits this crime. Removing her teaching license would be enough to make sure she could no longer carry out her crimes with 100% efficiency, as in this case the crime was a teacher having sex with her students. That's a kind of success that you just don't get with the kind of hard time this woman is going to be facing.

This, people, is why a GOOD piece of legislation can be hundreds of pages long and meticulously detailed. This one sounds like it was written on the back of a napkin during a campaign speech by a politician looking to show they're tough on pedophelia. If there's anyone down there in Texas who still feels some sense of responsibility this law will be revised to tone down the sentencing guidelines at the very least. Too late for this woman most likely given the near impossibility of getting any kind of appeal in Texas, but it would at least keep this travesty of justice from being repeated next time it happens (and yes, it will happen again, don't kid yourselves.)

Wait a minute here. If they were 18 years of age, these 18 yo are considered to be adults. Teachers have the right to socialize and have sex just like anyone else.

A 19-year-old testified that he had gone to Colleps' home twice with friends and they all engaged in sexual conduct.

So he apparently liked it the first time and wend back for seconds.

A former student who is now 20 testified that he engaged in group sex and recorded his last encounter on a cellphone.

Are they punishing her for having sex with the boys, or for having the boys to engage in gay sex at her home?

Three of them do not want her prosecuted, and personally for me, they were all consenting adults.

I think this is just wrong, and she should be be punished, but not sent to prison.

I agree @justoneguy if the genders were reversed the man would get multipe life sentences and the public would be calling for his head.

On another note, Texas laws forbids teachers from having sexual relationships with their students, and it is a good and reasonable law. If you are a teacher,you should know this. It prevents the"sex for good grades" scandals that would definetly happen if the law didnt exist,wether it a male teacher or a female. I dont however feel she should have to register as a sex offender as they were all adults. A minor jail sentence(seeing as she did break the law,not prison),loss of job and a condition that she never teach again(at any level) should suffice in my opinion.

If they'd have been younger, five years would be outrageously short. I do agree with others, that if 'teacher' had been a man, posters would be more incline to hang him by his balls. I am the parent of a high schooler, sure I'd be mad, but once my son is 18, I don't really have a choice of who he 'associates' with, do I? Neither do these parents, the school or anyone else...

Though a relationship between students and teachers seems unethical, it should not be a legal matter if the students were consenting adults. It should only be a matter of how the school wants to handle the situation. If the rules of her employment had these legal ramifications, then the rules of her employment were stupid.

The Texas Improper Relationship between educator and student law was enacted maybe 7 years ago. It applies regardless of the age of the student because it was a law intended to restrict the behavior of TEACHERS. All teachers in Texas are aware of this law and it's consequences if ignored. The constitutionality of it has been challenged and upheld in 2 separate cases and two separate Courts of Appeal. The law stands. The only short coming of this law in my opinion is that it does NOT require mandatory sex offender registration. I think there is no question that the TEA will revoke her teaching certification. My guess is that they already have been investigating the possibility, and now with the verdict they will take it away permanently. As they should. Do all the "high five-ing" that you want, but I guarantee the parents of the students stand firmly behind her prosecution and conviction. It is a whole different perspective when someone abuses their power and takes advantage of YOUR kid. Bottom line is....she knew the law...she broke the law....she faces the consequences of her behavior.

Colleps should go to prison!

That her "victims" were at least age 18 does not make a difference. She was a teacher who had authority over these boys/young men. Some of these boys may still have been impressionable. Colleps was hired to teach and to be a good role model. She knew that improper sexual relations with her students was against the code of conduct. Her behavior is no less offensive than a doctor having sex with a patient or a lawyer have sex with a client.

You are right and if it had of been a man teacher he would have got 5 years plus so if you are gonna do the crime then baby you better be ready to do the time is the way I look at it. She isn't the first and from the sounds of it most likely won't be the last. It all started with Mary K Laterano(sp) and then there is the one who was too pretty to go to jail as it would be like throwing meat to the dogs so she got probation and house arrest and with all of the other ones that have been in the news that woman is flat out stupid and she might even find a girlfriend in prison. Goes on all the time when they can't do without sex. Bubba in the mens joint and then there is big Bertha for the women. Having some young stuff isn't worth it cuz I like my freedom too much to risk doing anything that could cause me to lose it.

Whatever happened to her in that one month of time when she deviated from what was probably a shining record until then, we may never know because the inner breakdowns of human personalities mean nothing to us unless it is our own. Five students in a month. Besides the regret that I had no teachers such as this woman who would have prepared me for life better than any other teacher I had previously had, in a state with one of the highest unwed pregnancy rates in America, why is this a crime? Was there undue influence? Coercion? Did it happen with one student and the rest were blackmail payments? We do not get the human side of the event, only the crazed sexual fear side that is the root of Tejas' actual complete disrespect for abstinence. Five years in prison for this poor woman will do more damage to the minds of the 5 young men (unless they are psychopaths) than any activities they shared with her. Having been a 'young man' I can state this with absolute certainty. This is just a twisted christian "stone them all" Taliban-type reaction that is completely criminal to our American sensibility. She has already been disgraced and lost her life's work. The prison time is just pathological abuse. I trust the person who knows her best and still stands beside her and mourns deeply her unnecessary punishment at the hands of fundamentalist a-holes: Her husband. To him I wish the strength to help her make it through and back home to her family where she belongs. American Taliban is all these Tejas whackos and their politicians really are and this kind of perversity and Waco are their pride. "Don't mess with Tejas", it's enough of a mess already.

First of all, the court did not make a decision, a jury of her peers did. Second, she was a teacher, and she is a wife, and she is a mother... I don't know what her motivation was, neither do I care, the fact is she hurt a lot more than just herself. What kind of example was she to her children? What kind of example was she to impressionable young men who at the beginning of the school year weren't even considered men yet?

Young men are testosterone driven and need little, if any, encouragement as it is... Being seduced by a fairly attractive woman in authority over them is like putting a steak before a lion and saying "don't touch!" Right, and I'm Santa Claus's elf. SHE WAS A TEACHER! AND...SHE MET THESE YOUNG MEN AT SCHOOL! Not at some bar. What part of this are some of you missing? These "18" year olds are still kids, and are most likely living under their parent's roofs, not out making their own way as mature adults. As a teacher there is a moral obligation to uphold morality, and to do what you're being PAID to do...TEACH! As for you father's who would "high five" your sons, I wonder how you'll feel when it's your daughter these guys are gang banging? Huh? Maybe your sons should learn that it's not cool to allow out of control desires to rule their actions. If not taught moral restraint, someday there will likely be consequences for their actions. Unfortunately, in this case these boys are getting away with hurting a family, who has done nothing to deserve the hurt these boys have caused.

Finally, whoever said it's the state whose paying her salary, you're wrong. It's the taxpayers who are paying it...The parents of the community. As for jail, just more wasting of taxpayer's money. She is a sick woman and needs mental and spiritual counseling. No normal woman would act like this.

Most states have repealed their laws against adultery...However, I am sure there are still a few that have the laws on the books. The only place where adultery is still against the law and is enforced is in the military services. Adultery is a big no-no in the military I think mainly because it affects the moral and mental fitness of at least two service personel. Other than that adultery is not enforced in the US even if a state still has outdated laws.

        A lot of you guys are confused about the concept of consent. There is no legal consent, even if everyone is an adult, if one party has a position of power over the other. A secretary can't legally consent to have sex with her boss, etc. This makes sense if you think about it -- you can never trust the "consent" because there is always the potential for repercussions if the person in power doesn't get what they want. If this chick wanted to bang young guys she didn't have to go after her students (at least while they were still under her power). She had power to affect their grades, college applications, etc. They couldn't consent. Furthermore, you simply don't want schools to be meat markets for teachers -- it is certainly sick to think of of teachers surveying a new class and picking out students that she's going to try to target. This wasn't even a case like LaTourneau where at least it seems she actually fell in love or something -- this was just a serial predator who probably got a thrill at multiple levels.

        Anyway, there was no consent. The guys were raped whether they said "okay" or liked it, because they could not say no.

        JulianAb, there are no laws prohibiting sex with secretaries, coworkers, pool boys or hired help of consenting age. If there was, Republican leadership would be practically non- existent. Think Gingrich! An act like this may be grounds for dismissal for violating company policy at some businesses and government institutions. Such laws as this one are clearly unconstitutional.

        Those pompous hypocritical leaders fighting abortion, contraception and gay rights simultaneously have obviously only one goal in mind. A war on sex except when it is practiced as a dull marital chore for procreation according to their personal interpretation of their religion.

        I feel sorry that they have constant warring demons in their souls that prevent them from enjoying the God-given joy of sexual climax. I am reminded of an aunt during my childhood that was the mother of four of my favorite cousins (must have been immaculate conception all four times). They lived close by and we visited each other's homes often. Her picture is in the dictionary accompanying the definition of the word "Prude". Any word or phrase that could even slightly refer to sex was forbidden. Boxers or briefs? Never mention it in her presence or she would go into a raging frenzy.

        I think she loved animals much more than people (at least until she caught her pets having sex). She ordered this cute little monkey off an ad, much to our delight. I walked over one day to visit my cousins and especially the monkey. I walked into the living room to find my cousins intensely involved in watching "The Three Stooges" on television. I looked around to find the monkey and finally spied him on top of the curtains furiously pleasuring himself. This excited 11 year old boy blurted out, "Hey guys, look!. Jasper's je*king off!".

        My Aunt Evelyn came stomping from the kitchen faster than a speeding bullet (Yeah, we faithfully watched the old black and white television version of "Superman" too). She glared at me and then at poor Jasper( who hadn't yet missed a lick). She turned to me on her heel and smacked me smartly across the face. My last memories of Aunt Evelyn are the sounds of the screen door slamming (after my hasty exit) and her shrieking words, " Get out of my house and don't ever come back!".

        I met my cousins at school the following Monday. We nervously made small talk until I asked about Jasper in genuine concern. They lowered their heads and mumbled that he had run away. Fifty years later, I still wonder where the witch hid that tiny body.

        On a much more serious note, I'll be surprised if the case in this article does not go to the Texas Supreme Court and then the United States Supreme Court. I can understand the teacher being dismissed from the school for violating school policy. Imprisoning a citizen for participating in a sexual act with another consenting adult places this country on a very slippery slope. I'm hoping that it does not stand and willing to help in any way to assure that it does not stand.

        Seems to me that I have read about many cases of Grown Women Teachers having sex with 5th and 6th grade boys. Now, granted, "these boys" were 18, but still in the K-12 system. The message here, is that teachers are NOT TO HAVE SEX WITH STUDENTS in the K-12 system. Now, a contract is a contract and every damn teacher signs a contract, and that contract states that a teacher is NOT TO HAVE SEX with students -- is that so hard to understand? Most people are legally bound by contracts -- I am, you are, and so are all people (even a driver's license is a contract).           Hmmm, this is a dilemma. First...if that were my son, I would have slapped that heifer back to 1972.

          Secondly...18 yr old boys (and yes, they are still boys) will slip that pee pee into anything that twitches and she should have known better. You are a teacher and you KNOW what is right or wrong and clearly this was wrong. She needs to have her head examined but do I think she should be labelled a sex offender?                 Do you remember when you were 18 years old? Did you know any better than now, or do you feel you knew everything (although you really didn't). The problem here is not so much about age, but about a power-imbalanced relationship. A 28 year old who's in care of an 18 year old (yes, kids cause they probably didn't even have a job, much less support anyone on their own). Power-unbalanced relationships can be very toxic to the more vulnerable partner, for example at work, supervisors are usually not allowed to date their direct subordinates although they might be two adults. In this case, the employer of this "supervisor" is the state, and the state has an obligation to the tax payer's to uphold the law, and promote trust in the system. How much safe as a parent would you feel about sending your 18 years old daughter to be sexually harassed by a teacher who's supposed to be teaching, not sending pictures of his genitalia to his students? How would you feel if your 18 year's old cherry is popped on the day after he/she turns 18 by "the coach" because that information was available in the school system, therefore "the coach" using school's property would target those students "ripe" for the taking. Who's to say, a lenient punishment won't encourage more teachers to start thinking about having sex with their students, rather than act professionally and protect those student's who are under their tutelage.

                2 years minimum per charge? That's not justice, it shouldn't even be against the law. I'd say that's enough to lose her job, but seriously? 10 years in prison for sleeping with adults?

                That's what the law says... don't like it? Then become politically active to change it. The judge can only uphold it to the best of his ability as long as it isn't unconstitutional.

                  Plenty of them, 25Walker. For instance, in March of this year: The Arkansas Supreme Court struck down the state's law banning sexual contact between teachers and students, finding that people 18 or older have a constitutional right to engage in a consensual sexual relationship. These Justices understood a point here that so many of you missed; it's not just about the teacher here, it's about the students rights, and making sex illegal and forcing to testify against the woman with whom they had consensexual sex, the state of Texas crushed their rights as adults.

                  from what i can see Texas may be the only state where it is illegal for a teacher to have sex with a student who is of age. I admit i didn't check all the states on this list but spot checked many. I think Texas has it wrong. Jail for consensual sex with an adult should never result in jail time.

                    What you are failing to realize is that even if a student is age 18 or older, many states take into consideration the age variance of the student and the teacher. In terms of legality, many states have an age variance of 2-4 years. Cellops is older than her victims by 10 years. She signed a contract in which she agreed to a Code of Conduct and a standard of morality. She violated both. Because many students are victims of unwanted sexual harassment, many states are now moving to criminalize inappropriate, sexual relationships between students and teachers. Illinois, Connecticut, Michigan and North Carolina are just 4 states that have legislated or are in the process of legislating criminalizing such "trysts."

                    Importantly, the Washington Education Association has a directive that states: "Regardless of age, The Teachers' Code of Conduct prohibits sex between students and teachers."

                            She knew her responsibilities of her job when she accepted employment. And she was in a position of authority. Not to mention she was married with 3 children, had power over their grades, and should have known better. Yes, it IS a crime. I am a mother & I would call for her arrest & jail time if she abused her authority & had relations with my son. You all can say that they were 18, & maybe she thought that was her loophole out of this. I do not know her, I don't know how old she is, but it does make me wonder if given the chance would she consider a younger one? Hopefully, we'll never know. In any case, she too was over 18 & knew the consequences. And it wasn't just ONCE (which is still not okay)....there were 5 young men. She is a serial abuser. Her husband should have kicked her to the curb immediately after this happened, she sounds like a pedophile to me.

                            If a male teacher did this to five 18 year old female students, there would be lynch mobs and burning torches. The sexism is rampant, even in sexual predator situations. This woman was truly a sexual predator and took advantage of these yound men. She knew she could do it because men are peaking, sexually, right about then and can scarcely think of anything else. She is stupid and needs to go to prison for well over a decade and she needs to register as a sex offender for the rest of her life.                             You can not abuse an 18 year old MAN with sex. That is what we do and think starting at age 13. I think the guilt they will feel for the jail time she will surve will be more traumatic. Yes it was stupid that she had sex with adult students. However, if we had to jail people for doing stupid things, then we would have to jail all Christians for believing the bible, all climate change deniers, and evolution deniers.

You can not say you have never had the thought of being with a young man again when your husband is laying next to you fast asleep.                             I agree that she should have known better as a teacher. I am also a teacher and would NEVER even consider such actions. However, since the students were 18 or older, I do not think jail time is appropriate. If she had been out at a night club and run into these boys, there would be no issue. The issue here is the inappropriate abuse of power. This is similar to a boss that abuses power over his/her employees. Even more of a comparison is a freshman college professor engaging in sexual affairs with students (which happens all the time, yet no one seems to think jail time is appropriate in that case...even though many of those students are also 18 or 19). That sort of behavior should be cause for dismissal from her current position, and possibly her teaching license all together.

                            Its interesting to see that when a female teacher has sex with boys, she should be given a slap on the wrist and the boys get a high-five .... but, when a male teacher has sex with a girl, everyone wants to cut him up in little pieces and feed him to dogs. This was the same scenario with the teacher James Hooker in Modesto, CA. who had sex with an 18 y/o girl. I don't think he got any jail time for that incident, but the general public raked him over the coals, unlike they are doing here with Brittni.

I agree with most of the other folks - if the gender were reversed, everybody would be just fine with that. A person who does their 18-year-old students doesn't need to be a teacher, but they shouldn't have their life ended either. This is true regardless of the gender.                             I know law is law and everything and what she did was really wrong, but the guys were 18. Still wrong. But 2-20 years in prison? In Buffalo, NY, Dr. James Corasanti was driving very drunk when he struck and killed a young woman riding her long board home from work. The impact was so loud, neighbors were awakened out of a sound sleep. This doctor did not stop. The girl was lying in the grass dying and Dr. Corasanti went home and called his lawyer. His sentence? 1 year in prison for which he will most likely serve 6 months. No justice.

                              Contrary to common belief, men can and have been raped by females. I read a story, probably on this website that a NY man was raped by a gang of "females". It was a payback powerplay by the gang. It is not a common thing but it does happen and I am pretty sure it happens in one on one situations as well.                               They are not vicitms, but you can't have hobags teaching highschool students - and that is the bottom line. It is not okay for 18 yr old highschool students to be banging their teachers. The teacher has the power so the teacher is the one that has to say no.

                              That being said, I can only assume that she is a hobag based on the guilty verdict. If they somehow fabricated the story and the video, I can only assume her attorneys would have been able to prove that.

                              I guess I'm showing some gender bias, which normally I hate, but a married mother having sex with 5 students tells me she needs serious counseling more than prison time. If the student, either gender, shows he/she was manipulated or coerced or in any way wronged for it, then prison time would be needed along with counseling. But if the adult "victims" do not feel they were victimized at all then what is jail going to do. However, in any case they should not be teaching any longer and should go through mandatory counseling.

                              Again, I can't believe I am saying this, but kudos to Texas for having that law in place. Every state should have it. I just think sometimes prison isn't the answer.

Yes I do think it is wrong, no I wouldn't want my kids to do this or have happen to them, and I understand the law says its not legal since she is a teacher; this is regardless of if it was a man or women. However, 2-20 yrs for a legal age adult, sorry but no. Only if it was a case of rape which is the only way they could be victims, though pretty sure that is not the case here. Otherwise maybe some short jail time, fine, and can't teach anymore (in Texas anyways since it's a state issue). If she wasn't a teacher we wouldn't be hearing about this. As for the young men, they are 18 and technically they broke the law too, I think they need to have some punishment as well. Fair is fair.

                              NYMike, you made some excellent points. I don't understand why Marilyn and William made such an issue over Skipper's spelling. I have seen a lot worse.

                              I do agree with Skipper's sentiment, though. Even two years seems awfully harsh to me considering the circumstances. I do think she should lose her teaching certificate and that jail time is reasonable, but no more than a year in the county jail. Everyone was a consenting adult, but she did violate the trust that the public should be able to have in teachers.

                              Puting her in jail for an extended period of time will only cause more harm than good. She is a mom (and wife) who is in serious need of help. I hope she gets it.

                              For those of you who tend to think that all Christians are alike, I want you to know that I am a Christian, and a public school teacher.

                              One question that i would like answered.... is why isn't anybody in an uproar about the fact that five of these so called children in high school were 18? You know in a time not so long in the past an 18 year old high school student was nothing to brag about. If you hadn't graduated high school by then well...you were either a career disciplinary problem,a regular attendance truent or just an outright lazy SOB,or dumb as a post and should have been a routine candidate for the short bus program. I have a hard time believing that what were once reasonable standards and expectations of studious performance have fallen so far below the mark in just over 30 some odd years. I know they have...but Jesus Christ! Five of them were 18? and still lounging around in some home room leering at pre pubescent girls just a couple of grades their juniors? I'm not defending her honor...but i'm far more inclined to see the criminality of such complete and unabashed acceptance of fervernt mediocrity! It's just GD ridiculous to be sitting here discussing proffesional misconduct and "percieved" child abuse when the entire under achieving lot of them were old enough to be dodging bullets overseas with men of true worth,or at least worrying about ponying up their second year college tuition fee's!                                   Hunt-797031, You don't know much about Texas. They purposely withhold education from their football players. Hell, they might graduate and leave the team. Most of their 18 yr. olds are still playing on the freshman teams.

                                  My oldest son played high school football in Florida. My wife and I supported his athletic dreams(as long as his grades didn't suffer) and attended many of his games. One of his home games remain forever etched in my memory. The visiting team (in our conference) was from a small town 50 miles inland. Cattle country as far as the eye could see.

                                  I watched as they stepped off their bus. These guys were huge. I have seen younger players competing in the NFL draft. I taped the game from the bleachers. Our buff teen-age high school players looked like 10 yr. old Peewee football players defending against the professional New York Giants. Our guys never once flinched. They proudly lined up on that field and proceeded to get their butts handed to them with the physical beating of their young lives.

                                  My son barely managed to crawl into the backseat after the game. I heard him murmur something like, "We'll get 'em next year, Dad", just before I heard his snores of exhaustion. How old do these guys have to get before they are finally kicked out of public high school?

                                            Well, that's a tricky one there... If this was a male teacher and he'd had sex with grade 12 girls (even if they were all 18+) we might feel differently. We'd then be concerned about if the girls were truly willing participants, or were the girls worried about their marks? Even if the girls smiled and said 'yes', did they feel pressured or feel trapped - and what did it do to their emotional state and they self-worth and their psyche after the fact? Would it compromise their education and jeopardize their future, or would it benefit their education at the expense of some other student? It's not just as simple as 'getting lucky' in all situations.

                                            In cases like this, I think the issue is: was the teacher & students just all mutually consenting sex-partners, or were the kids trying to make sure they graduate? Can any teacher (could you or I?) have sex with an 18 year old student, and then could we truly treat them fairly the next day, and treat them 100% the same as any other student? What if the sex relationship beaks down, what happens to the marks and the learning and the whole education of the student in that case?

                                            So, I don't think that the Administration and the State of Texas are necessarily just a bunch of prudes when they made these laws. Perhaps they are... but I believe they were probably were thinking about the whole vast complexity of the situation.

                                            Don't get me wrong - I think 5 years is WAY out of scope, especially when we have rapists, child molesters, and kiddie-porn guys getting less than that. Also - I'm NOT a prude by any means - I had a teacher that I certainly wouldn't have minded some private tutoring from when I was 18! :)

                                            However, I'm am saying that sex between 18+'s isn't always just simply sex. There are many cases where it's illegal to have sex, and the laws and penalties aren't always just about the sex, they are often about trying to avoid the complications, and conflicts of interest that arise.

                                            In this case, it is not the same as a college professor having sex with a student, despite the fact that they are both of age. A college professor having sex with a student is not illegal. Unethical? Sure. Illegal? No. But for some reason, and despite the fact that these boys were of legal age, this woman did something illegal. This shouldn't be a matter for the courts.

                                            Hunt, the law in Texas says a child has to be 5 years old by September 1st to start kindergarten. That means if their birthday is September 2nd or after that date, they will be turning 6 years old just a couple weeks after starting kindergarten which means the vast majority of seniors in high school are 18 years old when they graduate. All states have similar laws, the dates might be different by a week or two.

All of the students were over 18 when the sex took place?? These are adults!                                               Granted the Sandusky type is the lowest form of life, but at a minimum you are looking at an inappropriate situation in the workplace.                                               You're right, Shelly. If the teacher was found not guilty, a lot of these folks would be pointing fingers at the teachers' unions and blaming them for her aquittal while playing the "those poor kids" victim card. But now that she's been found guilty they want to defend her despite the fact she committed adultery and violated the Texas law regarding teacher-student relationships. Sorry but you can't have it both ways; you either give teachers the freedom to have sex with their students, or you forbid it and enforce the law without prejudice or exception.

                                              We were just talking about this men vs women having sex with students the other day. I do think that most of the time women get off easier for the same crime. You know adult teacher having sex with minor students. In this instance I don't see the crime weather it was a man or women. All of the alleged victims were at least 18. So there was a violation of student teacher conduct ok deal with that. Fire her but prison for this? Just one more reason Texas sucks.

                                                  Well, this is much more complicated than that, and it's not just something you can spin into being just about Christians or just about Texans. For the record, I'm neither Christian or Texan. ;)

                                                  It's about having a law to try to protect people who are under the authority of other people, even if they are all 'consenting' and all 18+. There are laws like this, not just in Texas, but all across the USA and Canada - and the point of the laws are not just to prevent 'unmarried folk from having sex' or anything prudish or 'Christian' - the point of these laws are to try to protect people from become victims of coercion by someone who is in a position of trust and authority.

                                                  If there wasn't laws like this, then sooner or later, there would be students (18+) who would end up feeling pressured or trapped or coerced into sex. Even if they smiled and said yes and even if they fooled themselves into thinking it was OK at the time, it would (for someone, sooner or later) be a horrible, horrible thing. Some teacher would give better or worse marks, or would show favoritism, or would ignore the education of other students. Or the situation would become reversed, and perhaps the pretty 18 yr old female student would start shirking their homework, and when the 45-year-old-sex-partner-teacher tells the 18-yr-old-student to work harder or it'll be reflected in their marks, the female student tells the teacher she's going to get an 'A' or else! It's a very complicated issue with 100's of ways it can play out, most of them bad. It's a minefield, and I think that's why they have laws making it a crime.

                                                  For the record, when we have rapists and child molesters and kiddie-porn pervs getting less punishment than this, I do think that the punishment doesn't fit the crime here. However, this also isn't as simple as ''they were all 18+, so it's not a crime" and it's not as simple as just "Texan/Christians" on an anti-sex campaign.

                                                  Contrary to what some people think, consent simply is just a matter of saying "yes" and meaning it. If it is a situation of coercion, then you have to claim it and prove it. When people say "yes", we assume that they mean it, and that cases of force or coercion are cases that deviate from the norm. We don't assume that every time somebody says "yes" that they are actually being forced into it and we have to actually prove that they meant it.

                                                            They were students. It's funny that I'm an independent voter who's a moderate on social and political issues but I have to agree with the conservatives on this one, and don't understand why the liberals want to take a "What's wrong with doing what makes you feel good?" attitude when it's clearly a violation of the law. If they weren't in school it wouldn't have been a big deal. The reason why they have this law is to prevent teachers from using their influence to get sexual favors from students. For example; an 18-year-old high school senior is failing a class and in danger of not graduating, and a teacher pressures them into having sex in exchange for giving them a passing grade, and the student lies and says it was consensual in order to hide the truth. It's happened before, which is why the law exists. The best way to enforce the law is to enforce it across the board without exception or prejudice. If I found out a teacher coerced my 18-year-old daughter into having sex out of fear of failing a class and not graduating, I would be pissed and so would you.

                                                            My senior year, I was failing middle of the year...where was my teacher pressuring me to have sex with them so I would pass and graduate? It doesn't happen everywhere and it's up to the parents to be able to teach their kids to distinguish between what's right and wrong. Now don't get me wrong and twist what I say here, I am a parent and we can't hold their hands all the time. We all make mistakes. If either of my kids make a poor decision after they turn 18, that's their issue, not mine. They are my responsibility until they turn 18. After that, they're on their own. Yeah, I would be upset if at 18 my daughter (or son, I have both) made that decision, but THEY ARE 18. All you can do as a parent is hope that you raise them right until they are 18. Now here's to an argument. I had just posted for reference, not to start an argument. That's great they have the law, congrats to Texas for enforcing it, but all I was saying was that the age of consent in Texas was 17.

I was propositioned by a teacher when I was in high school and turned her down, only because I had a girlfriend however and think "cheating" is wrong. The teacher in my case wasn't married.

                                                              I have been on the bad end of this. As a teacher, in Ohio, I had a relationship with a student in our school. She was 18 and not even my student. I resigned to be with her and the state picked up charges. I took a plea deal and was sentenced to 1 year in prison (served 64 days), 5 years probation, and have to register as a tier III sex offender for the remainder of my life. <-- Yes, that is the worst of the worst! As for us, it has been 2 years and we are engaged to be married. I honestly had no idea I was breaking a law. I did know I could lose my job, and was obviously prepared to do so.

I am just so surprised how you guys defend these tramps---how do some of these women get away with this type of behavior in your minds? You send your sons(hopefully) to school for a classical education, not real-time sex education! And just so you know, even when these teachers rape 13-15 year olds many are still barely prosecuted---especially when they are white chicks.....Oh, silly me, they are ALWAYS OVER-SEXED WHITE CHICKS.                                                                 If the kids were 18, why aren't their names being used? If they get to make choices as adults, let their names be dragged in the mud for destroying a family. I blame her, but there were others in the room. They got video of that!

                                                                I am appalled; I started my career in education and have always admired teachers. She has destroyed her own family and given educators a black eye. At least the young men were 18 years old, they will escape this without much damage.

                                                                Actually no, Yelley. "Whore" is slang for "prostitute" and entails charging for services. Either way, calling women demeaning names because they are sexually active is the work of cretins. Sex has NOTHING to do with morality unless it is forced sex (which it was not in this instance) and it is very possible that her husband approved of her sexual escapades. Just because chuckleheads like you pretend that God demands that monogamy from humans doesn't mean everyone does.

Glad to see you've become more reasonable than before, but how can you judge that she is unrepentent now or in the future?. Also, "Judge not lest ye be judged" and God said "I shall repay"....not for us to condemn anyone; Jesus never cursed anyone to hell except demons...Of course, men have made laws to prevent anarchy, but some laws go too far. How many innocent people have been executed in Texas? The State will suffer for it, as will any entity that tries to be a god.

                                                                    Why do I find it hard to believe that these comments would be quite the opposite if this concerned a male teacher? I believe this is not a bad law but that the preponderance of these stories in the news is having a desensitizing affect on people. If my child was manipulated as a young adult into a sexual relationship with an authority figure I would want that person punished. Laws are a wonderful thing. They exist whether current opinion is becoming more lax or not. I am sorry that we as a whole have a lower standard in moral expectations of each other, however, when my children are involved I would like a higher standard enforced.

                                                                                The 5 on 1 aspect does make it a more interesting story. Otherwise, nothing really unusual. It would be interesting to know what emotional issues she is dealing with, as well as her husband who seems to tolerate this.
