A young man known as "Victim 1" and who testified against former Penn State coach Jerry Sandusky is suing the university claiming it cared more for its reputation than it did about child safety. NBC's Lester Holt reports.
HARRISBURG, Pa. -- A young man who testified against Jerry Sandusky sued Penn State on Friday for its "deliberate and shameful" handling of complaints that the former assistant football coach behaved inappropriately and sexually toward boys.
The suit filed by the person known as Victim 1 at Sandusky's trial said university officials made deliberate decisions not to report Sandusky to authorities.
It described their actions as "a function of (Penn State's) purposeful, deliberate and shameful subordination of the safety of children to its economic self-interests, and to its interest in maintaining and perpetuating its reputation."

The complaint was filed electronically in Philadelphia state court Friday night, Slade McLaughlin, a lawyer for Victim 1, told The Associated Press. The young man's initial accusations sparked the investigation that led to criminal charges against Sandusky and two university officials.
Sandusky, 68, was convicted in June of 45 criminal counts for sexual abuse of boys, both on and off campus. He awaits sentencing that will likely send him to prison for the rest of his life.
Penn State ex-president Graham Spanier: Freeh report on sex scandal is wrong
Victim 1 and his mother reported Sandusky to the boy's high school and the Clinton County child protective agency in November 2009. Their complaint triggered the state investigation that last year resulted in the criminal charges.
Former Penn State administrator Gary Schultz and athletic director Tim Curley, who is on leave, were charged with perjury and failure to report suspected child abuse. Both deny the allegations and are expected to go on trial in January.
Famed football coach Joe Paterno was fired. He died last January.
The suit draws heavily from court testimony, grand jury investigations and Penn State's own investigative report, conducted by former FBI director Louis Freeh. The report details how university officials handled the claims against Sandusky and Sandusky's behavior. Victim 1 is known as "John Doe C" in the complaint. The suit names no other defendants than the State College university.

University spokesman Dave La Torre said the school has no comment on the pending litigation.
"The university takes these cases very seriously," La Torre said, adding that the current president and board "have publicly emphasized that their goal is to find solutions that rest on the principle of justice for the victims."
The suit claimed that a "special relationship" between Penn State and The Second Mile, a Sandusky-founded charity for youth, gave Sandusky a respectable public image and connections that enabled him to perform criminal acts.
The young man known as "Victim 2" in the Jerry Sandusky sex abuse case spoke out for the first time through his attorneys about how the former Penn State coach abused him and stalked him with phone messages. NBC's Ron Allen reports.
It alleged "(Penn State) believed its reputation and economic interests would be adversely impacted if the public learned that a man closely associated with the school's football program was, in fact, a pedophile."
The Second Mile's future remains uncertain, subject to a legal dispute.
'Numerous victims'
According to the lawsuit, Victim 1 met Sandusky about eight years ago, when the boy was 11 and a first-year participant in a camp sponsored by The Second Mile. In his second year, the boy drew Sandusky's attention and accepted invitations to spend nights at the coach's State College home and to attend professional sports events, the suit said.
Over a three-year period ending in 2008, the suit said, Sandusky assaulted the boy more than 100 times, including fondling and oral sex. The lawsuit claims Sandusky attacked "numerous victims over a span of 30 years," but noted that his criminal trial was limited to a 15-year period and 10 victims.
Following Victim 1's testimony, Sandusky was convicted of all six counts that related to him, including involuntary deviate sexual intercourse for instances of oral sex.
The suit alleged negligence, fraudulent concealment, intentional infliction of emotional distress and civil conspiracy. It said Victim 1 has suffered physical and emotional injuries and will likely need medical and psychological help well into his future. The suit seeks compensatory and punitive damages.
Another Sandusky accuser has filed a federal lawsuit related to the scandal and a second victim has filed a court notice that he will file complaint. Lawyers have suggested others may take legal action.

People were raising concern (Florida, Arizona, Minnesota) about some "strange people" taking flying lessons..they weren't concerned about take-offs/landings. At Penn State there was a "preonderance of evidence..multiple complaints by mothers, Penn St Grad Asst, etc. Cops, District Attorney, Penn St Administration all ignored it. Like SMU "death penalty" in Football, Penn St should get the same. The chronic flaw in Penn State administration DEFINITELY should put the ENTIRE SCHOOL under severe penalty.

What puzzles me is why Paterno and the Penn State administration allowed Sandusky to bring boys to the gym, locker room and showers when they KNEW he was a pedophile. It went on for over a decade!
Sandusky used the Penn State facilities and his access to the football team as bait for his victims. After they essentially fired him in 1999--knowing he was a pedophile-- why did they let him keep abusing boys ON THE PENN STATE CAMPUS?
It's clear what Sandusky gained by his association with the school and the football program, but what did Penn State have to gain by their association with a serial pedophile who was a ticking time bomb?
It might be worth re-considering sending your kids to a school where the people in charge were so plainly and simply stupid.
.....and that, kaybeetoys, is the question that Penn State is going to have to defend against in the victims lawsuits. They had knowledge that there was a problem with Sandusky and young boys, and continued to allow him access to use the Penn State football program to facilitate the sexual abuse.
This is just the first of many lawsuits.
Frankly, between the upcoming legal bills and the settlements/trials, I don't see how Penn State can survive.
Sandusky was doing this crap, Paterno ran the program and had heard the rumors and still employed him with the knowledge of his work with children.
An outright rape was reported to Paterno, and instead of simply calling 911 like any sane person, he went into coverup mode for a decade and a bunch of kids were scarred for life.... end of story.
Paterno deserved jail, but I guess he's in hell if it exists.
Penn made the mistake of it's life not settling this before a court case because the award will be staggering... as it should be: this kids going to need millions of medical care and psych care over his life and he will probably still never be normal.
Penn can and should afford to give him the best care possible.... instead of shamefully going into corporate defense mode.... again...

To perhaps answer my own question, there are allegations that Sandusky was pimping out Second Mile boys to wealthy Penn State donors.
If that turns out to be true, it would explain why Penn State kept him around even thought they were fully aware he was a pedophile.
If that turns out to be true, what has come to light so far is just the tip of the iceberg.

Paterno didn't "employ" Sandusky - he had little to no contact with him after his 1998 "retirement". His access to Penn State facilities were granted to him as a part of this retirement package, as negotiated by Paterno's superior, Tim Curley - which is ludicrous in its own right.
If you call 911 on campus, where these crimes occurred, you get the University Park Police. The University Park Police is headed by Gary Schultz - the very person who Paterno's superior, Tim Curley, went to. So Paterno did in fact complete that side of his responsibility as you suggest.
Simpletons will look for the easiest explanation possibly and go after the obvious and big name, but where the real issue lies here is in the complete incompetence of law enforcement. Seriously - what legitimate police report ends with "Told Sandusky not to shower with boys anymore - Case Closed"?

Children who are victims of these people are "honored" to be selected by the people who are held in high esteem by the community. Afterall a man married for decades, a head college coach, founder of a charitable youth program, Church affiliation? Boy Scouts? so on and so on and so on...
Children in these situations are nurtured and raised to comply with sexual favor as as are young girls and women in similar situations. The Object is Sexual domination of a youth to satisfy the desires of the perpetrator at the cost of the souls of Children. The term used that applies best is "Learned Helplessness". Sexual orientation is irrelevant since the object is control of a victim without remorse. The victims are simply objects to be used of self gratification.
I saw this psychological manifestation of "learned helplessness" misdiagnosed as many other summations when I was with Social Services. The caseworker is the EXPERT in a case of Social services because they are privy to all the information pertaining to a child. This valuable resource is almost always disregarded to the detriment of the children. Children within the system are used and abused before and during their stay with the Social services departments around the country. When a knowledgeable social worker decides to make a positive change, they are punished for rocking the boat of accepted protocol much the same way a child who was victim to a Sandusky predator/pedophile. A socio-path that preys on society is accepted as Normal because they have friends up high in the system. If a child were to speak out against the perpetrator, he would be himself victimized by the protectors of the "Norm". A social worker that speaks out against the accepted protocol of the system, they are victimized for rocking the boat of a government system and is pressured to termination. That is why we often see a child that endured a terrible life that leaves scars for the duration of their life and why you see social workers and government workers that have the glassy-eyed stare as they perform their job each day. It's been about the money ever since Penn State tried covering this thing up. It was THEIR money on the line (in the form of hundreds of thousands of dollars just in tuition that could potentially be lost), and that's why they turned a blind eye on it the whole time. People should be really careful about saying spurious things against the school. It has 95000 students at one time from all campuses and online courses. That's graduating an awful lot of students every year, and lots and lots of certifications general interest classes etc. Can you actually see what you're saying, that the school had some profit to having a nut case like this working in their midst?

I don't deny the part about it being money all together. The Winningist Team. School Pride, Grants, Good Players want to play on good teams that Pro Scouts look at. Add these all up than you can really be in the money part of it. I went to collage for a couple of years, although I went to the Rallies and most games I wasn't there for the Sports.

Scapegoat: In modern usage a scapegoat is an individual, group, or country singled out for unmerited negative treatment or blame for the mistakes or wrongdoings of others.
Joe Paterno is not a "scapegoat". He was himself guilty of mistakes and wrongdoings- as were others. Being held accountable for your own mistakes does not make you a scapegoat, even if others are also guilty. People besides Sandusky and Paterno will probably be held accountable in the future- this is not over.

The school made money off the football operation while covering up (aiding and abetting actually) the action of a pedophile that was on their payroll. And they covered it up because it would have cost them money to come out in the open. They chose to protect their financial interests by closing their eyes and allow Sandusky to continue to abuse children, often time within their own property.
They paid Joe Paterno and their administrator plenty, now they need to compensate the victims. Period.

My niece is a recent Penn State grad and gave me a really nice sweatshirt from them while she attended. Needless to say I will never wear it again and, going against my grain, won't even donate it to Goodwill. I won't even use it for rags. It belongs in the trash, along with Penn State's reputation.
My niece, who worked really, really hard for her degree, is stuck with a Penn State degree. The dirt will never wash from that name. I won't be the least surprised when I eventually read about lawsuits for "tainting" a graduate's degree. She paid good money for a good name on a sheepskin, not one from good 'ol "Molest U".

I live in Pennsylvania and I agree, Tom Corbett needs to be sued as well. "One Term Tom" needs to be kicked out as Governor as well. He has screwed higher education in the Commonwealth. Penn State has a fantastic graduate school program, but I will be applying to go to Pitt instead for my Doctorate.

For years the University covered this up because Joe Paterno was on his way to a record breaking coaching career and something like this would have only stalled that or stopped it. Everyone knows sports is the most important program in higher education. Coaches threaten teachers to give students certain grades so they can play, sholarships are awarded hand over fist to students who can play sports and nothing comes between the coach/player/team relationship. The university covered up the entire thing for years and the more it went on the worse and deeper it got. Notice, ironically, that a report to a high school is eventually what triggered the investigation and brought down this ring of pedophile/pedophile enablers. Thank God the high school was doing and did their job. Look at how many people this possibly prevented Sanduscky from destroying. So YES the university has a huge stake in the liability of ANY claim that this SOB be-friended and ultimately ruined.

What evidence are you using to base your statement they covered anything up? If you say the Freeh report, you should actually read it, and not just he summary. And then read the emails in chronological order, and not the order Freeh put them in.

The Catholic church got sued for covering up pedophile priests, shifting them off to other places to molest more kids. They deserve to be sued, same goes for Penn. No one and no institution is above the law; you want to cover up, you pay. i know.i live near there and penn state had a great reputation.good education,good sports reputation,it was somewhat impressive to have that on a resume.but,now every time i hear "penn state",thats the first thing that comes to mind.and the rest of the country too.i hear jokes on late night tv.Penn state will take years and years to get past this,if ever.
My daughter took Penn State off her prospective college list recently and I had to cancel our visit. She didn't want Penn State's stigma to hang over her for four years, and didn't want to deal with comments from people if she said that is where she was attending college.

The suits should fail. In spite of Freeh's conclusions, there is no evidence presented in his report that, prior to the grand jury investigation, any one person other than Mike McQueary had enough information to connect the dots. The 1998 investigation was closed by the District Attorney concluding that there was no evidence of criminal wrong doing. Shortly thereafter Paterno told Sandusky that he would never be head coach, and Sandusky subsequently resigned.
Quite WRONG rick. A criminal trial needs a finding of fact that is 100% without any doubt. A civil trial finding is based on the preponderance of the evidence, which is far easier than a criminal court requires. The lawsuits against the school and all those who SHOULD have helped the kids will be won. The victims will never be made 'whole'. They lost their youth, they lost their ability to trust and they lost their ability to have a normal relationship.
I hope each POS is sued along with the school and that each defendant suffers the public humiliation, the loss of every single thing they own and that they may never find any job anywhere for the rest of their miserable selfish unmanly lives.

The DA's nephew reported that his uncle complained bitterly that PSU was stymying the investigation (so then he had no choice but to drop the case.)

All the money in the world.......cars, trips, "stuff", is not going to change the emotional damage that has been done. What Penn State can do for them is provide them with the best of psychological counseling that money can buy for the rest of their lives. What happened was devastating for those boys/young men, but all the monetary compensation in the world is not going to change what happened nor make what happened better. They need professional counseling as well as their families and Penn State can offer that. It is unfortunate that the academic program will suffer as well and for the current/future students who dreamed of having a college degree from such a prestigious university. I have seen over the years that if a college is going to suffer a major scrutiny it will originate from their athletic program.
Uh! Go to college, get a degree, find what your passion is no matter how trivial you may think it is, persue it and whatch the cash start flowwing in. And you dont even need to screw over anyone to do it.
