Updated at 3:30 p.m. ET: American-born Taliban fighter John Walker Lindh testified Monday that the U.S. government is forcing him to sin by denying him the right to pray daily with other Muslims in the highly restricted federal prison unit where he is detained.
He made his comments during the first day of a closely watched trial that will examine how far prison officials can go to ensure security in the age of terrorism.
Lindh was captured in Afghanistan and imprisoned in the United States after the September 11, 2001, terror attacks on the United States by Islamic extremists.
Lindh testified in federal court in Indianapolis that the Terre Haute, Ind., prison where he's serving a 20-year sentence for aiding Afghanistan's Taliban government before its overthrow allows prisoners to eat, talk, play cards and exercise together, but bans daily group prayer. He contends this violates a 1993 law barring the government from curtailing inmates' religious expression without showing it has a compelling interest.
Lindh, 31, adheres to a school of Islam that requires group prayer five times a day, if possible.
"I believe it's obligatory," Lindh said. "If you're required to do it in congregation and you don't, then that's a sin."
Attorneys for the government maintain that Lindh's own behavior since he was placed in the unit in 2007 proves the risks of allowing group prayer.
The government says in court documents that Lindh delivered a "radical, all-Arabic sermon" to other Muslim prisoners in February that was in keeping with techniques in a manual seized from al-Qaida members that details how terrorists should conduct themselves when they are imprisoned.
Lindh's sermon proves "that religious activities led by Muslim inmates are being used as a vehicle for radicalization and violence in the CMU," the government claims.
The prison warden halted daily group prayers in 2009 and allowed them only on the holy day of Friday.
Lindh accuses the government of going too far in its drive for security and trampling on his freedom of religion by restricting group prayers among Muslim inmates.
A cluster of U.S. marshals surrounded a shackled Lindh as he was brought into the courtroom on Monday morning. He was wearing an olive green prison uniform and a white prayer cap. He smiled at his mother, who was sitting in the third row of the courtroom gallery.
The bearded Lindh was led out after two hours of testimony.
With the help of a glossary for court officials, Lindh guided the court through a series of lessons on Muslim prayer traditions.
Lindh has been held in the federal unit at Terre Haute since 2007. He was charged with supporting terrorists after his capture by U.S. troops in Afghanistan and later pleaded guilty to lesser charges.
Muslims are required to pray five times a day, and the Hanbali school to which Lindh belongs requires group prayer if it is possible. But inmates in the Communications Management Unit are allowed to pray together only once a week, except during Ramadan. At other times, they must pray in their individual cells. Lindh claims that doesn't meet the Quran's requirements and is inappropriate because he is forced to kneel in close proximity to his toilet.
Thomas Farr, a former diplomat who now teaches at Georgetown University and studies religion and terrorism, said common sense suggests that the prison's need for security would outweigh Lindh's religious rights.
"The foremost responsibility of prison officials, as de facto proxies for the American people, is to prevent Mr. Lindh from obtaining any capacity to plan or carry out attacks on them," he wrote in an email. "That is why he is in prison, and if that is not a compelling state interest, I do not know what is."

The American Civil Liberties Union of Indiana, which is representing Lindh, contends the policy violates a federal law barring the government from restricting religious activities without showing a compelling need.
"This is an open unit where prisoners are basically out all day," said ACLU legal director Ken Falk, who noted that inmates are allowed to play basketball and board games, watch television and converse as long as they speak English so the guards can understand. "They can do basically any peaceful activity except praying," he said. "It makes no sense to say this is one activity we're going to prohibit in the name of security."
Falk said Lindh's speech wasn't radical and was given during the weekly prayer that inmates are permitted. He said Lindh was not disciplined for the speech.

The self-contained unit in which Lindh resides has 43 inmates, 24 of whom are Muslim. Inmates are under open and covert audio and video surveillance, and except for talks with their attorney, all of their phone calls are monitored. Prisoners are not allowed to touch their family members when they come for their tightly limited visits. They must speak English at all times except when reciting ritual prayers in Arabic.
Without such tight security, the government claims, the prisoners would be able to conspire with outsiders to commit terrorist or criminal acts.
Joe Hogsett, the U.S. attorney for the Southern District of Indiana, said he believes decisions about prison regulations are best made by prison officials, "not by convicted terrorists and other dangerous criminals who reside there."
"Mr. Lindh is allowed to pray in his cell; he's allowed to pray wherever he happens to be as many times every day as his religion suggests to him that he should," Hogsett said. "Where the rules must draw the line is, how often must prison officials allow prisoners to congregate together?"
According to court documents, daily prayers were allowed from the time the unit opened in 2006 until May 2007, when Muslim inmates refused to stop in the middle of a prayer to return to their cells during a fire emergency.
The lawsuit was originally filed in 2009 by two Muslim inmates in the unit. Lindh joined the lawsuit in 2010, and the case has drawn far more attention since then. The other plaintiffs have dropped out as they were released from prison or transferred to other units.
Lindh had been charged with conspiring to kill Americans and support terrorists, but those charges were dropped in a plea agreement. He is serving a 20-year sentence for supplying services to the now-defunct Taliban government of Afghanistan and carrying explosives for them. He is eligible for release in 2019.

Prisoners have the ability to attend church services every Sunday in most prisons. When you cherry pick which religion you allow this for then you ARE in violation of the right to freedom of religion because this exemplifies the gov'ts favoritism of one religion over another.
I am not too familiar with protocols for Muslim prayer, but if doing it in groups and away from toilets is required then why can't they try splitting the prayer into small groups of 5 and be supervised by 1 or 2 guards in each room in case one of the prisoners tried to incite a riot? And if they do have offenders only they will be confined to their cells. Provide some incentive for good behavior. But since Lindh has already started trouble amongst groups he should automatically be omitted.
That way no one's religious practices are being compromised and any dialogue outside of prayer can be closely monitored.

Is t he inmate treated like a human being? Is the inmate feed 3 meals a day? is the inmate allow to have recreational activity? is the inmate allowed to pray? yes to all three, then everything else is gravy.

Lindh was a member of Al Qeada, not the Taliban. The equivalent of the Taliban in the US are the Evangelicals, the New Apostolic Reformation and their Prayer warriors". I think one religion is as detrimental to society as another, I do not think any religion should be allowed in prison, especially not the three that are causing all the problems in the world today, Christianity, Islam, and Judaism. If you say no prayer in prison then that should hold true for every religion, not just Islam.

They are still allowed to pray together once a week, just as the Christains attending church on Sunday are allowed to pray together once a week. They are simply not allowed to pray together 5 times a day every day.

There is an easy solution to this. Don't let the Christians (or any other religious group) congregate for prayer and then you're not picking one religion over another. For all of you that can't read, they are given the chance to pray, in group, once a day on the holy day of friday, just like the christians are permitted to pray together on their holy day of sunday. Just cause this A$$clown wants to waste his time by praying in group 5 times a day(to me any religion that requires that is a little strange, but to each his own), then he can pray five times a day by himself.
On a different note, how can one religion have so many different requirements, depending on the sect/group you belong to. I mean depending on who you talk to, rules go from one extreme to the other. In one, women are allowed education and must maintain limited coverings. On the other side, women can't leave the house and when they do they must be covered head to toe, with only a small slit for eyes. Now before anyone declares jihad on me, I'm just curious.
It isn't required to pray together, but one should have a valid excuse. Being incarcerated would be one of those. I have looked through the major fatwa web sites and I have read Quran, Ha'dith and Sira.

Why not just put them in cages to keep them from harming each other in a room with a holly man of their faith. No one would need to guard them and they could riot all they want. I know of no religion where people have to hold hands or get physical in any way, so a cage or cell for each in the same building wouldn't infringe on their rights to fellowship and go to church if that's what they want.
A 20 year prison sentence? Really? Mr Lind joined the army of a foriegn country for the purpose of participating in that country's civil war.
That act was not and is not illegal. The goverment that he fought for made the mistake of supporting the Al'Qaida terrorist organiztion. Is Mr. Lind to be held responsible for all of that government's actions? Are all US Vietnam era service personel criminals because the USA lauched a criminal illegal war against Vietnam? Mr. Lind was offered the opportunity to join the Al'Qaida terrorists, and he declined to do so. The US government has never presented any evidence whatsoever that Mr. Lind attacked or even planned to attack US citizens.
The Bush administration railroaded Mr. Lind into prison as a scapegoat because of its failure to capture or kill Osama ben Ladin. I do not believe that Mr. Lind is, or ever has been, any threat to the security of the USA. He should be given a full pardon and released immediately.

what part of of "kum baya" are you trying to sing? Lind was an armed Taliban that was part of the group that killed that CIA officer during the prison break - even if Lind did not pull the trigger. Check the law that if a crime is committed and anyone (good guy, bad guy etc) is part of the group, they are liable and prosecuted and then punished for their part in just being there.
Lind was there under his own volition, as a member.

JackfromJax: M. Lind was an unarmed POW at the time of the prison uprising where Johnny Span was killed. He has been castigated for his failure to warn US personel about the uprising. Put yourself in his position at that time: he was trapped in the army of a country that the US declared war on. You can't just walk away from a situation like that. If he had been taken aside, given security from the Taliban forces, and then failed to disclose the danger, that would be one thing. But that never happened. What if he had ratted on the Taliban without being removed from being locked up with them? Do you think he would have lived very long?

In 2001 the Bush administration gave the Taliban about 43 million dollars in arms, supplies and money. Mr. Lindh went to Afganistan to fight in that country's civil war against the Nothern Alliance. He declined all opportunities to participate in attacks against US citizens. It has never been a crime or treason for Americans to participate in the civil wars of other countries. Our prison systems are divisions of our government(s), accordingly, the prison system should be making no laws or rules regarding religion. Allowing the individual inmate, his freedom of religion along with his choice to pray or not to pray as he pleases, is not compromised. Beyond that the prison system should make no other accommodation in respect to an inmate's religious beliefs.
Neither designating a time nor a place or a manner, nor any other conditions unique to an individual or groups' religious interest, is a matter for the government agency(ies) to consider. A person's religion, if any, is a matter between him and his god, he needs no special accommodation to pray and the prison system has no authority to intervene in any manner not consistent with equal enforcement of all rules for all inmates.
What next? Giving the muslim inmates six year old girls in arranged marriages?

I agree that even a prisoner should have the right to practice his or her religion. However, according to prison officials, this guy is fomenting hate and advocating violence among other prisoners. That, he does not have the right to do. He is in prison for a reason. Apparently so far he has no remorse for what he has done and plans to continue his violent behavior.
