This is ridiculous, Zimmerman lies to the court and then gets a new judge by claiming the one he lied to is biased against him. You reap what you sow, when you lie to a judge your credibility is shot, this should not entitled you to a new judge. I wonder what he will find to complain about with the next judge. Zimmerman will keep trying to get the judge on the case disqualifies until they assign one to the case who is a card carrying member of the NRA and believes in shooting first and asking questions later. The only thing the judge did was call Zimmerman on his lies to the court, this should never have been grounds to remove him from the case. The appeals court is basically rewarding Zimmerman for his bad behavior by granting his request for a new judge after his own actions pissed off the current judge.

Her in Ohio the supreme court is elected and no party is permitted to be displayed on the ballot. Party identification is permitted in newspapers so their party can be known. Interestingly enough people in Ohio have a tendency to elect more republicans than democrats to the Supreme court. But on offices where party affiliation is displayed have a tendency to elect Democrats.

By electing judges, we have a tendency to be more aware of the decisions they make, and vote at election time accordingly.

Zimmerman is innocent. The reverse racists are just going to have to accept that fact and find the next white person to vilify when there's a black victim. It's funny, but according to the FBI crime statistics, 97% of black murder victims are killed by African Americans, yet the media and leaders in the black community don't seem to care. But whenever a case falls into the 3%, that's when the marches and rallies begin. It's both pathetic and embarrassing to the people who get sucked in by this.

The only question left now is whether or not white people will dance in the streets when GZ is acquitted, just like blacks did with OJ. I for one will not. There were no winners on either side of this case; what we had was some thug teenager confront a middle-aged loser who felt the need to carry a gun around to feel big. In the end, one ended up dead. There's no doubt in my mind that if Trayvon had been packing, the opposite scenario would have happened. In the end, the verdict doesn't really matter. It's time to everyone involved to move on.

Define 'unjust'. Is it a judge that does something illegal, or is it one that rules based on different political affiliations from your own? Judges exist to protect protect our individual rights, and often times by doing so, they are forced to make rulings which may be unpopular to a large segment of the population. Allowing people to vote them into office only encourages majority rule, which is a horrible thing.

I really amazed at how little respect liberals have shown for the legal rights of George Zimmerman. Normally these people are the first to tout constitutional rights and the idea that we are all innocent until proven guilty. What I've seen on the boards and in the media is a blood-thirsty crowd that has already convicted him before the trial has even started. Seriously, what is the matter with you people? Perhaps you'd be more sympathetic to the defendant if he was a black drug dealer who was on trial for murdering a cop. All defendants have a right to have their day in court, even white people.

Please, try to remember that, in America, the suspect is 'presumed innocent unless and until proven guilty in a court of law!' If either of you, above, were witness to this particular incident, it might behoove you to contact the prosecuting attorney or the defense attorney to lend your eyewitness testimony to this trial, when it occurs.

The following article pertains to two individual, seemingly nice looking and respectable young men (although not as cute as Trayvon's 11 year old grade school picture), who were suspected of being involved in a crime. Both men selected their jury, their witnesses, their judge and their preferred method of punishment, just seconds before ultimately deciding to commit a crime. One of them screwed up, had bad timing, the other died for his efforts. The one that 'screwed up' has a pending murder charge against him because he was carrying a toy gun in his robbery effort.

The point I'm making with this article's inclusion is to substantiate that, even nice looking young gentlemen, may attempt an assault in Florida and, while it is all recorded on film, suspect number 2 is still presumed innocent until proven guilty in a court of law.

I don't know if Ms martin is using her son's trademarked name for financial gain or not, but getting a trademark on the name is the best way of preventing others from doing so.

Look up 'Sunshine Law in Florida.

Some years back there was a case in FL where questions came up afterward of judicial misconduct in suppressing evidence that shouldn;t have been suppressed. as a result FL passed a law that said all pertinent evidence in a case should be released.

That's why all of this evidence was released in the discovery phase, that way neither side can claim the other side hid anything and things will be fair for the defendant.

Ok maybe I'm lost here- searched Google for Martin family donations and found NO references where either of his parents made any money as individuals. Also the fact that Zimmerman claims he was acting in "official" crime watch capacity when this incident happened DOES make the HOA liable if there was a criminal act by Zimmerman while acting in that capacity.

Are people really bringing up the instructions of the 911 operator as if they actually meant anything? These people aren't law enforcement officials, they're dispatchers that earn less than 30K a year and have minimal emergency response training or common sense. They literally provide scripted responses to every situation and alert the proper authorities to respond. They don't want people pursuing criminals not because they believe it will result in the best outcome, but because they want to limit their liability in the event a violent confrontation occurs. If I ever call 911, it's to explain the emergency so the police, fire department or paramedics can respond accordingly. After that I'm hanging up. I don't need an untrained professional playing armchair quarterback from the comfort of their desk.

I know for a fact the dispatchers for our police department are trained, by the way the training is on going, to give professional instructions and when in doubt to turn the call over to the officer on duty. The fact remains he was told to stand down. He said it was self defense, an unarmed person mind you, and he shot him? Hells: the State Trooper that pulled me over asked if I were 'in a hurry/late for work' and then asked if I 'knew how fast I was going'. That was BEFORE he wrote me a citation. I don't know about any of the rest of you but if someone were to attack me and start beating my head to the ground and I had any form of weapon I could get my hands on I would use it if I needed too. The transcripts i have read show Zimmerman returning to his car when he was attacked. I would use whatever I could get ahold of to stop this young man ( not kid ) from killing me or hurting me further. The young man simply made a bad call when he chose to get all up in Zimmermans face. It has been shown Trayon was not an angel so he likely was capable of what Zimmerman claims IMO. Avenger: Great comment. Common sense. Zimmerman told the dispatcher that he had lost sight of Martin. Instead of Martin taking that opportunity to get off the street and into his father's house, UNOBSERVED, he CHOSE to double back and blindside Zimmerman, broke his nose, took him down to the ground and got on top of him bashing his head on the ground. Zimmerman never laid a hand on Martin, and Zimmerman did not have the gun in his hands. It was Martin who tried get it in his own hands. Martin already had the upper hand, why go for the gun? Two guesses. And Martin didn't jump Zimmerman because of the gun...the gun was concealed, Martin didn't even know he had one until he already had Zimmerman on the ground pummeling him and bashing his head. Too many people on these boards DON'T WANT Zimmerman to have a FAIR trial. They don't want to take the CHANCE that the truth and evidence may show that Zimmerman did act in self defense.

This was kind of stupid, what if he ends up with a worse judge then this one. This judge let him get away with allot of things. If I was him I would have stuck with this one. If he gets a black one that will make it even worse.

To all the people that are basing their entire argument on the premise that "We don't need you to do that" is a direct order and Zimmerman is guilty because he disregarded. Couldn't you argue that Zimmerman was also "ordered" to follow Trayvon? The dispatcher did tell Zimmerman to "Keep an eye" on the suspicious person and didn't tell Zimmerman not to follow until Zimmerman was already out of his truck.

Furthermore, does anyone have any proof that Zimmerman disobeyed that "order"? From the tape, it certainly sounds like Zimmerman stopped running shortly after being told he didn't need to follow. Zimmerman can be heard on the tape a minute after being told not to follow that he "doesn't know where this guy is" so I don't know why people are jumping to the conclusion that he kept chasing Martin.

Yet the presumed innocent is locked up just like any other criminal till a verdict is reached. Till there is a verdict is there really any difference ? Quite the conundrum isn't it. Besides, it's not presumed innocent, it's not guilty till proven guilty. There actually is a difference. Innocent is not committing a crime at all. Not guilty means it simply has to be proven beyond a reasonable doubt. Unless jury members were there when it happened, no one can prove innocence.

It' won't be up to the judge but a jury. And that jury will not be able to find him guilty "beyond a reasonable doubt". Don't burn your neighborHood down when it happens.

I think the new judge will drop the charges in the up coming trial for dismiss the charges against him. Under SYG Z is not guilty and should not be tried. He has met the standard and was not arrested. The Police knew what they were doing and did not arrest him for a reason.

According to Geraldo Rivera the Queen is a wantabe gangsta' or thug afterall she's been spotted wearing a hoodie - just like Trayvon Martin (TM). If you recall Geraldo felt that wearing a hoodie (in the rain) was the reason Zimmerman felt that TM was a thug (gangsta wantabe).

Judge Lester - as well as his actions, accusations, reprimands, etc. - became an issue in this case during the initial bond hearing. During that hearing, he questioned Shellie Zimmerman, who appeared by telephone, concerning the Paypal account which had been established to assist George Zimmerman in retaining an attorney to defend him against the charges upon which he was arraigned. Judge Lester (and the prosecutor) made very weak efforts to determine the balance of that account, and asked very direct questions to that end. Shellie could not provide Lester with an exact balance "right now" in response to the questioning, but she provided him with the name and phone number of a person who could give the court exact information about the account. The Court (Judge Lester and the prosecutor) decided to continue the bond hearing without that information in hand.

A month later, when the prosecutor learned that the balance was significant, she returned to the court and presented a motion to the court for revocation of bond based on the fact (as she alleged) that the Zimmermans had provided false and misleading information to the Court concerning the balance of the account. In an attempt to place the blame for the minimal bond ordered in the first hearing, Judge Lester accused the Zimmermans of intentionally misleading the court. However, anyone who reads the transcript of the original bond hearing can determine that the Court dropped the ball.

Judge Lester took exception to the fact that Zimmerman had ample funds with which he could mount a defense to the charges against him, and most likely was further swayed by members of the Martin family and sympathized with public persons who had aligned themselves with the Martin family and who had mounted vociferous protests to every point in procedure with the case. Under this pressure, Lester revoked the original bond and during the second hearing, sought to improve his own public image by reprimanding the Zimmermans instead of accepting responsibility for his own failure to obtain all pertinent financial information prior to setting the bond originally.

Legally, as well as ethically and morally, Lester was obliged to recuse himself from the case following that second bond hearing. He voiced prejudice, feigned being victimized, and by doing so, he revealed that he could not remain objective and neutral in the matter, and thus could no longer preside over the case. Justice with an attitude, as Judge Judy likes to call it, is not justice at all - it is prejudice, and under our constitution, there is no place for prejudice among jurists - judges and jury members included.

This is a good and fair move. Regardless of how you feel about the case, it's important that the process be fair, and this judge has shown a definite bias against the defendant who should be presumed to be innocent until he is proven guilty. In his comments during the whole bail process ("You are preparing to flee the country") the judge made comments that showed a definite bias. Judges need to be fair, and this one was going to do everything he could to make sure that George Zimmerman was punished, which isn't his job as the trial judge.

Zimmerman's father was a magistrate in their former home state of Virginia. So far as i am aware, he never sat a bench in FL, so the majority of people in the judicial system would probably not be too familiar with Mr. Zimmerman. Zimmerman's mother did work for the FL judicial system--a court reporter or some administrative function, and adminitrative assistants are, by and large, invisible to the higher-ups.

The judge orchestrates the trial and the jury brings the verdict. If the judge rules in favor of the the defense during certain events at trial it can effect the outcome a great deal. We shouldn't allow the defense any favors or leniency especially after abusing the system on a continual bases. Let's see who the new judge is. Steve stfu Martin didn't create anything, numbnuts .

Re-read the 911 transcript and look up the legal meaning of stalking and you will find you are wrong on both counts....but you already knew that.

You're watching too much TV. Blood doesn't always come spraying out of a wound, I would say especially so when wearing a loose fitting article of clothing such as a hoodie. A large percentage of crimes do not end with a conviction. Many guilty parties escape punishment. That does not mean a crime was not committed. Because a trial results in a 'not guilty' verdict it does not automatically translate into the defendent being innocent. Our justice system is set up to err on the side of the accused to lessen the chances of people being wrongly convicted. That means some guilty parties will go free.

In the event the eventual verdict in Zimmerman's trial is a "not guilty", it will mean there was insufficient evidence presented to find him guilty "beyond a reasonable doubt". We still won't know for certain if he is innocent.

Regardless he is entitled to a fair trial, and appointing a new judge would seem a good decision by the appeals court to try to ensure that is what happens.

First of all ProudAmerican, prior to Zimmerman getting out of his truck, he was told to keep an eye on the suspicious person and let the dispatcher know if he was doing anything. You could make the argument that the dispatcher had instructed Zimmerman to follow Trayvon.

Second, Zimmerman was told he didn't need to follow Trayvon AFTER he had already gotten out of his truck.

Third, do you have proof that Zimmerman didn't stop following Trayvon when he was asked to stop? On the tape, it certainly sounds like he stopped running right after he was told to stop. About a minute later he even says to the dispatcher that he "doesn't know where this guy is." Doesn't sound like he continued following Traycon to me...

The crime that was committed was failure to follow a direct order from the police, which led to the scuffle that ultimately ended the teenager's life. If someone you didn't know continued to floolw you around, you would want to defend yourself as well. That had no idea who GZ was? He never identified himself nor did he have on a uniform to show he had probable cause to even question the young man. As far as GZ is concerned, once the police told him we do not need you to follow him, he should have stopped. (allow that I listened to it only once) That is not a command, it is not a direct order, it is not disobedeance to a law enforcement officer nor a violation of any laws for Mr Zimmerman to continue following or trying to maintain contact with his suspected individual until the police arrived. Mr Zimmerman was lawfully in his own gated community at the time the alleged suspicious behavior came into his view. He did not leave that community's public areas nor confines to follow Mr Martin nor did he make an physical attempt to stop Mr Martin's free movement within that community.

Mr Zimmerman's behaviour is not unlike what might occur in your community if you observed a suspicious character who generaly met the description of suspect in previous burglaries and thefts within your community. You don't know that Mr Zimmerman never identified himself to Mr Martin and your belief that 'having a uniform on' constitutes 'probable cause' to question an individual is probably very mislead. It is not necessary to 'defend yourself' from someone who is just 'following you around.' There is no justification for a 'defensive' action until you are confronted with an articuable immediate threat to your personal safety. Lastly, your belief that he would not be facing this charge is predicated on your belief that Mr Martin would still be alive. As a trained EMT, the wounds that the Zman suffered seemed very light. All I could see was that he got punched in the nose. The wound on the back of his head is not consistent with his head being repeatedly smashed into the concrete. There is very little soft tissue on the back of a person's head, but lots of blood flow, so if someone had their head smashed into concrete, blood would be everywhere, on the back of his head, blood running down the back of his shirt or jacket, if not blood, then bloody bandages. The man had none of these signs. His clothes were clean, his wasn't bandaged, the medic said he was okay, he didn't even go to the hospital, no way he had his head repeatedly smashed. Looks to me that Trayvon punched the Zman a few times then the Zman killed Trayvon. Trayvon probably deserved it too, walking around while black, in Florida!!

He probably WILL get off because of the infamous "stand your ground law", however is NOT innocent. Had he not profiled this young man as a criminal or punk, etc. he wouldn't have called the dispatcher and probably wouldn't have continued to follow the young man after being told not to do so. In life there are many who are found innocent in court, but are by no means actually innocent (IE: OJ, Casey Anthony,). I have to agree with Tom near Seattle. I am white and was a victim of a home invasion. I was robbed, kidnapped and shot twice. There were three guilty of the crime, however, one turned states witness and testified against the one that shot me and the one that pistol whipped me in the head. Four days after leaving me in critical condition the same three guys invaded another home but got caught because he had a security camera. Last week a jury acquited the two; one that shot me and the one who beat me because of a technicality. I had NOBODY to get on television and demand justice for me. I was all alone and continue to be all alone. I am devistated and unsure of the judicial system. My life has been forever changed. I am partially crippled because these people came onto my property, into my home to take my belongings and money that I have WORKED for. Two other victims were at my home when this occurred and they will never be the same either.

The guy that testified against his codefendants came forward like a man and serves time but the others go free. I applied for a pistol permit yesterday, I will be armed in the future and I don't forsee being approachable. I would have appreciated anyone in my neighborhood reporting suspicious behavior and having shot those people the night of my incident. I wish I had a neighborhood watch program and I wish I had neighbors like George Zimmerman. I hate the boy lost his life but he should have been at home with his parents and not in an area that singled him out as suspicious. If you were GZ and was supposedly watching the neighborhood and thought TM was suspicious and 2 confronted each other, would u identify yourself ? I would. Any reasonable person would especially when the other person has noticed that u were following them. Then ask yourself who would have more reason to approach the other after the initial contact, gz who is suspicious of tm which is fact or tm for no other reason than wanting to fight cause u believe he's a thug. What injuries do u need to see ? Can someone not be in a fight get the best of another person w/out incurring injuries. What if martin was defending himself ? The lack of injuries sounds more consistent with zimmerman not being able to physically match martin so he pulls out his gun. Such evidence doesn't demonstrate zimmerman defended or provoked. Unfortunately since zimmerman wasn't treated for his hands, we'll never know if his knuckles were damaged.

All of the non emergency phone call activity took place over at the Clubhouse....GZ hung up, drove over, closer to the T, got out of his vehicle, and followed Trayvon BEHIND the homes...where Trayvon had stopped to finish his phone call.

GZ then, CONFRONTED Trayvon and most likely tried to detain him, until police arrived.

There is zero evidence that Zimmerman is the one who started the physical confrontation. There is zero evidence to support your assertion that Zimmerman was attempting to detain Trayvon. Trayvon has no defensive wounds. His only injuries were a cut on his knuckle (offensive wound) and the fatal GSW.

The timeline of events don't support the idea that Zimmerman would have been able to catch up to Trayvon. We know that Trayvon had at minimum a ~1:30 head start (that's about the time Zimmerman said he didn't know where Trayvon was to when he hung up the phone) The first 911 call comes in about 1:45 seconds after he got off the phone with the cops and the fight is already underway in the background. How did the slower Zimmerman manage to locate and catch up to a faster Trayvon Martin so quickly?

Isn't it more likely that Trayvon, for some reason, decided to circle back and confront Zimmerman? Based on the evidence, I think so.

Tom, he was already charged with murder (second degree to be exact) and the fact that he lied about his finances will most definitely be considered by the court IF the defense tries to put him on the stand, as it pertains to his credibility as a witness. FWIW, I can't see how the defense can effectively argue its case without putting their ONLY eye witness to the shooting on trial.

Thanks Michael, you have just, inadvertantly, helped me prove a point; that being that we can disagree and hold differing opinions and still be civil to each other. I'm not now, nor have I ever been an attorney, nor even a student of law so my thinking is perhaps partially based from ignorance of the law but, I try to follow the stories as best I can. My recollection was that the murder charges were not filed until after the appointment of a special prosecutor following the race based furor and media splash that forced an issue to find Mr Zimmerman guilty of murder, only then did the murder charge appear.

I don't know what charges, if any, Mr. Zimmerman might be tried for but, it's my understanding, (perhaps dillusional) that the burden of proof is still on the state. I'm sure we'll learn more after the weather cools down a little bit and the court decides to make the move to release Mr Zimmerman back into the jungle.

jas57, I'd be happy to host Mr Zimmerman, at my trailer, after he is released, I think we could learn some valuable lessons from him. I live in a nice community, although certainly not totally crime free but, at least it lies within an 'Open Carry' and 'Shall Issue' state so people that pass through here, for whatever reason, understand the risk they might face should they decide to be naughty while they are here-abouts.

Sure he can when their is evidence hinting that he was preparing to run. Which there was in my opinion. His job is to decide his flight risk, thats what "bail" is all about.

The judge was not commenting on the evidence of the case, but on Zimmerman's lies in the bail hearing about his financial status and funds available to him to post bail. His comments should not be considered prejudicial to the case.

Not all judges are biased and not all judges stick together, And for you to think that is ridiculous. The first Judge removed herself for personal reasons, This Judge was a Joke he already found Zimmerman guilty. And no you cannot call someone a liar in court, or say there going to flee which is why they removed him. I guarantee a jury will find him not guilty or Hang the jury and there is nothing the next judge can do about it.

It is the job of a jury to evaluate the testimony and the evidence to determine if he is guilty or not guilty. It is not the job of one person to decide if he is guilty or not guilty and that is what the DA tried to do considering the police were planning on charging him before the DA told them not to. If he is so innocent why would he be afraid to go to trial? If there is no evidence against him, why would he be afraid to go to trial? If the evidence proves beyond a reasonable doubt that he is innocent why would he be afraid to go to trial and get exonerated? Why would he be afraid to let justice be served? Especially in Florida.

Deciding what cases warrant prosecutions and what cases don't is actually a big part of a state attorney's job.

And you are presumably innocent in this case, should we try you for it? Since you are clearly innocent, you shouldn't be worried about taking it to court, right? And since (in your world) only a jury can decide if someone is innocent, a prosecutor saying there isn't enough evidence to try you shouldn't be sufficient.

Judges recommend charges all the time. Especially when a witness implicates themselves. Unless the wintness have immunity of course, which they usually dont. There is nothing inappropriate about it.

Complaints included advocating additional charges, continuing threats of additional charges.... wrong behavior that resulted in the Florida Appeals Court decision - Lester's disqualification.

The above is NOT accurate in the least. There was an investigation by local police, immediately following the incident. The local police interviewed eye witnesses and verified GZ defense wounds to his head and marks on his back from being pounded on pavement/ground by TM. He was taken into police custody and further interviewed that very night. Forensics also verified GZ's account of the actual shooting being at point blank range (whie he was on his back being beaten by TM).

Furthemore, due to the biased reporting of our national media, the FBI got involved and sent more investigators. By the time GZ was arrested, numerous DA's and law enforcement officials had ALL REVIEWED the facts as they were at the time. It took the FL Gov appointing his own DA (an obvious political move to satisfy the public outcry) to even get charges brought up.

Keep in mind that when the second degree charges were filed, it was NOT due to NEW EVIDENCE. She had the same info as every other DA and investigator before her.

That depends on a great number of variables, arguesforsport. For instance, what exactly was Trayvon Martin doing that caused George Zimmerman to be "suspicious" of him? To date, he has not been able to detail any activity that Martin was engaged in that would create reasonable suspicion. Check out all of his various statements. Secondy, George had already notified the police of Trayvon's presence in the neighborhood, using, I might add, the non-emergency line (not 911) to do so. That is presumptive evidence that this was not an emergency situation and neither George, nor anyone else in the neighborhood, either person or property, were in imminent danger from Trayvon Martin. Therefore, there was no reasonable need for George Zimmerman to follow Trayvon Martin. Further, after explaining the situation to a dispatcher (not a 911 operator, but a police dept. dispatcher), Zimmerman was advised, "We don't need you to do that." in regard to following Trayvon. Now, argue whether this is a direct order or not, but you cannot argue the fact that this was coming directly from the dispatcher at the Sanford Police Dept. and the "we" in that statement can only be interpreted as the "Sanford Police Dept." In other words, "The Sanford Police dept. does not need you to try to do their job for them and follow this young man."

So, you see, there are many, many things that become involved when deciding who was the aggressor in this situation; the least of which is the possibility that Trayvon Martin punched Zimmerman in an attempt to get away from him. Had Zimmerman not done exactly the opposite of what he was advised to do by the spokesperson for the Sanford Police Dept., he would never have been in a position for Trayvon Martin to throw a punch in defense.

George looses the possible suspect and parks his car then gets out on foot while he dials 911. As George is telling 911 whats going on, 911 asks him his location. During that period of silence, George was looking for a street sign to tell the 911 operator the exact street he is on. The 911 operator tells George to get back to his home as police are on the way to handle things, George says "OK" hangs up and proceeds to go back to his parked car. As George is almost to his car, the thug Trayvon Martin confronts him by walking toward him in a fast and aggressive manner while using profanities and telling him that he is going to kick George's azz. George tells him the police are on the way and that when the physical fight begins. Trayvon grabs George and kicks out his feet from underneath him. Trayvon leaps in anger and furry landing on top of George and so begins the whirlwind of hay makers and barrage of fists beating Zimmerman in the face. As Martins adrenaline reaches heights never known to the wanna be thug before, he starts yelling at George and telling you "Your gonna die tonight mother f****r, your gonna die tonight" As Georges head is bouncing off the concrete behind his head, Georges "fight or flight" kicks in. It's impossible for George to choose flight because the thug Martin is pounding away like it's an initiation into a gang. George does the one thing he never wanted to do in his life ad that was to grab his loaded gun which Martin seen and went for himself and obviously George just happened to have the faster reaction.........End of story. Civil actions are extremely against the City of Stanford but the State may have to pony up aswell. The law is clear & GZ was subject to Malicious Prosecution & Wrongful Imprisonment . He may get MILLIONS ! They have destroyed his life while legally defending himself !
