Tough-minded judge assigned to take over George Zimmerman case

A Florida judge assigned Thursday to take over George Zimmerman's case is being described as ambitious and willing to hand down tough sentences.

Circuit Judge Debra Nelson got the case after a Florida appeals court on Wednesday granted Zimmerman's request for a new judge.

The Orlando Sentinel reported that Nelson recently sentenced a robber to 27 years in prison after he'd rejected 20 years in a plea deal.


"You don't mess around with her," Lake Mary attorney Isadore Hyde Jr. told the Sentinel. "She's very nice, very nice. You can tell her what's on your mind on or off the bench, but she will send your a-- away."

Zimmerman, the former neighborhood watch volunteer charged with second-degree murder in the Feb. 26 shooting death of Trayvon Martin, had said the judge presiding over his case has made disparaging remarks about him.

The Fifth District Court of Appeal wrote in a decision that Circuit Judge Kenneth Lester Jr. should "enter an order of disqualification which requests the chief circuit judge to appoint a successor judge."

The opinion said: "Although many of the allegations in Zimmerman's motion, standing alone, do not meet the legal sufficiency test, and while this is admittedly a close call, upon careful review we find that the allegations, taken together, meet the threshold test of legal sufficiency."

The appeals court ruling was 2 to 1 in favor.

The dissenting judge wrote: "Although the trial court's order clearly manifested an exceedingly strong belief by the trial judge that Zimmerman 'flouted' and 'tried to manipulate' the system, I do not believe the order 'crossed the line' so as to require the granting of this motion."

Zimmerman said in the appeal that he feared Lester was biased against him and he wanted a new judge to handle his case.

Zimmerman has pleaded not guilty to the killing of Martin 17, in a gated community in Sanford, Fla., saying he acted in self-defense. He remains free on bail.

Zimmerman's attorney, Mark O'Mara, had argued that Lester should disqualify himself after he said the judge made disparaging remarks about Zimmerman's character and advocated for additional charges against him in setting his $1 million bond in July.

Well Georgie Boy might have just made the biggest mistake in his life. I hope she is a no nonsense judge who feels when you lie to her you have obstructed justice and should be penalized. Embezzling from his legal fund wasnt a smart thing to do. Hope she sees through his lies and gets this trial underway so there can be some closure one way or another soon.

He will be fine..this whole thing is a joke forced on us by Obama and Sharpton and is a farce.

We recently had a police officer found a guy so drunk and stumbling around he decided to call for backup before confronting him..he lost sight of the guy who ended up in a citizens home kicking in the bedroom door. He was shot and killed.
If this can happen to a trained police officer, than how can the fact that Zimmerman lost sight of the kid and was jumped by the kid be so unplausable?
Zimmerman is being railroaded and no charges should have EVER been filed against him. One more reason to get rid of our POS president.

I for one look forward to the trial where all the evidence will be heard and the truth will come out. Not what the media misrepresented or what someone read. FACTS. Unfortunately there are people who already decided guilt or innocence on one side or the other and unless there is a miracle there will be violence and bloodshed in the name of Trayvon Martin. regardless of whether he is guilty or innocent, if he had a judge who openly did not like him, I don't blame him in the least for wanting a new judge! Isn't that what our American justice system is supposed to be about, getting a FAIR trial? Its already going to be hard for the jurors to look at this case in a 100% unbiased matter because of all the national attention, the last thing that would be fair is to have the judge overseeing the court proceedings openly hating him. I don't think that means at all that he was trying to get an "easier" judge, just one who at least wasn't going to act openly biased. He is very within his rights, whether he is guilty or not. Now I pray the jury, no matter what decision they make, pay attention only to the facts presented at trial and not the mess the case has made in the rest of the world.

I'm guessing Lester was either in the pocket of the Black Panthers or some other white hate group or he was scared of them. What happens to the judge when he/she sets GZ free? Hoping this judge isn't threatened by them.

I can't say for sure if TM was good or bad or whatever. But wearing a hoodie is not a crime. Carrying a beverage and a bag of skittles is not a crime.

GZ initiated the confrontation between them, and for that he can at least be considered grossly negligent and causing the death of TM. If you drive your car carelessly and kill somebody, you go to jail for it. If you carry a gun and needlessly initiate confrontations and it results in death, you should go to jail.

GZ probably never intended to kill the kid, but his careless actions (which he was TOLD NOT TO DO), caused the death of a teenager who did not deserve to die.

Some people on this forum act like the kid deserved it because he smoked some pot and wore a hoodie. Give me a break.

Most of your post i agree with. The only thing that is speculation is that Z initiated the confrontation. We don't know for a fact if he did. Regardless...we do know that words were exchanged before anything happened. Up to that point no one did anything illegal. Its going to come down to the prosecution showing Z initiated physical contact first....will be interesting to see how they play it out.

I think the prosecution admitted in the Bond Hearing that they didnt know who threw the first punch, which in order to defeat Zimmermans self defense claim they are going to have to prove. Youve got two guys, one is beat up, one is not, I doubt if a jury is going to think the beat up guy is the one who struck first. If they cant prove it, GZ walks on reasonable doubt.

A highly debatable point. Following someone and asking who they are/what they are doing is not considered a confrontation. At most it would be considered VERBAL confrontation.

TM, on the other hand seems to have started the physical part when he blind sided GZ at his car and jumped GZ. Ironically GZ had stopped following him at this point. So one could EASILY argue that TM started the confrontation (physical). Now factor in that TM had got the better of of GZ and had him on his back and was ponding his head into the ground and you have a clear case of self defense.

Don't need a trial, don't need a judge. Zimmerman has already been tried online. He is guilty of brutally and willfully killing a saintly young man after tying him and hoisting his screaming body up into a tree where he then shot him. He would have dismembered and disposed of the body if a witness had not appeared after he lowered the body to the ground. At the same time, in his last breaths, TM was praying, yes praying, that the Lord would forgive Zimmerman and prepare a place in heaven for both of them. TM cared only about the goodness of his fellow man and how he could work to bring that out of those who exhibited less than goodness. A true saint.

I have no sympathy for George Zimmerman in no regard whatsoever because if Trayvon Martin was white and George Zimmerman was black he would not be free on bail and by now he would have been charged with first degree murder and in jail. GZ is NOT on trial for perjury, not on trial regarding his website for donations, he is also not on trial for being disliked by a certain segment of the population. When a police dispatcher tells you not to follow, and let the police handle it, and you continue to follow anyway, you're looking for a confrontation. Being Florida has a stand your ground law, you know you can shoot someone and claim you felt threatened. Being that NONE of you clowns were there, and have NO idea what transpired , you have no grounds to spout your opinions. Blackjustice, you may be black, but you have a lot to learn about justice. A situation that is truly the problem with the black community in this country. If someone insists on dressing and acting like a criminal (those baggy sagging pants ARE derived from prison attire) and committing crimes (even if it is only smoking pot which Martin WAS guilty of) then they are going to be seen as being a dangerous criminal. Trayvon Martin was 6 ft 2 in. That is NOT a little boy, that is a well above average height MAN. He was a varsity football player which means that he was probably in pretty good physical condition. He was in an area where he wasn't known. Being asked who he was and what he was doing there is NOT a physical confrontation and "being dissed" is no excuse for resorting to violence. Reports are that Martin was not exactly a choir boy either. There had been multiple burglaries in the neighborhood by perpetrators who matched Martin's description. Zimmerman had been asked to form a neighborhood watch to try and combat the criminal activity of people who looked and dressed like Trayvon Martin was dressed that night. There is a difference between whites and blacks when it comes to crime and watching the nightly news shows the difference, despite the media's attempt to hide the facts. More of the crime in this country is committed by the black minorities than the white majority. When the Black community stops the nonsense of blaming it all on whites and cleans out their own cesspool, there won't be any discussions about this crap. But as long as blacks tolerate and excuse the criminal activity of a significant percentage of their community, the honest, law abiding (neither of which term describes Trayvon Martin) blacks will face discrimination. BTW exactly what do you think would've happened had a white teen wandered into a black neighborhood? Look at the statistics and the numbers don't show that he would've been greeted with tea and grumpets. So if you want to see a freaking racist, look in the mirror.

    I am truly saddened by the racial madness in this country - I am the first to admit that while not everything is about race, to try and deny that racism continues to exist in America is just hiding ones head in the sand. Had TM been a white youth sagging and wearing a hoodie I'm sure GZ would not have assumed he was a thug, called 911 and followed him. The problem is GZ should never have gotten out of his car (period) he could have followed TM from a safe distance.     speculation. I'm willing to be Z would have stopped a white kid he didn't know. The only reason i believe somewhat he is saying is because i live in an area where there is an increase in crime. A dead end street that everyone knows everyone. AND i stop everyone i see walking around if i don't know them just as my neighbors do. 15 kids between 5-12 will make you worry when alot of predators are registered in the area. Nothing Z did was illegal has bad as you want it to be.

            I think that Zimmerman will regret complaining about the last judge... I think he's on the road to a second degree murder charge...

            He was trying to play the system when he and his wife lied about finances... They thought they had got away with it and complained when the first judge called them on it...

            Maybe Trayvon Martin's family will have some justice after all...

            The biggest problem with all of this is the 911 call, GZ was told NOT TO FOLLOW the person, HE PUT HIMSELF IN THIS SITUATION. We all have the right to wear a hoodie, most youngsters do at some point. If someone you didn't know was following either of you, I am sure it would scare you as well. I know I would defend myself if it happened to me. I am quite sure GZ didn't introduce himself to this boy. We all need to realize he was only 17, how much rational sense did any of you have at that age? This goes beyond what your biased eyes see.

            Raider, As a trained EMT, I must tell that the injuries to the back of the Zman's head are inconsistent with it being pounded against a concrete sidewalk, or as you put it, "beating his head into the ground". As big as Trayvon was even one smash against concrete would have caused way more injuries to the back of the Zman's head, one smash. With his head being pounded there would have been blood everywhere, all over the back of his clothes, the back of his head, or else he would have been bandaged, big time.

            Raider, Get a round green, not a ripe, watermelon, put a pair of gloves on, hold said watermelon about 6 to 8 inches above a concrete slab, smash in down 5 or 6 times then see what the bottom looks like, then take a look at the back of the Zman's head as he walks into the police station, see if they match.                           I could agree with you Mr Sharp, bastardizing the man's name is certainly disrespectful but, I think defining Mr Martin as a 'child' is perhaps a little far fetched.

                          A six year old girl, killed while asleep in her bed by a stray round from a drive-by shooting in Watts, is a child. A six foot tall seventeen year old assailant, will, by some definition, still be referred to as a 'child,' but that does not put him in the same catagory as the normally accepted use of the word 'child.' While Mr Martin's death is unfortunate, the media really needs to portray 'facts as they have been reported' as opposed to drawing a picture of a big bad white guy who just killed this cute little black kid.

                          The prosecution has a lot of things they are going to have to overcome, and with the evidence we've seen so far, I dont think they can get past reasonable doubt. The only way they can get past self defense is to prove that Zimmerman threw the first punch, and they dont have any way to do it.

He was following an order from a 911 dispatcher to break off following him when the attack occured. Fact is this defense involves the use of a handgun and the second amendment right's of Americans to do so. Liberals want all guns banned and this case is about that and that alone. Right or wrong George Zimmerman is going to be found guilty because he and others who defend themselves violate the right's of criminals to have victims who wont hurt them. Justice has nothing whatever to do with it or Mr. Zimmerman would never have been arrested, a multitude of evidence proves his story.

                                        No evidence has proven his story....that's why they have a trial to present the evidence. All you have is what Zimmerman says happened, and his story has changed a couple of times. To say nothing of the fact that the police dispatcher told him to say in his truck and not follow TM, that the police were on their way. If he would have done what he was told (and what a neighborhood watch person is instructed to do) and not confront TM then TM would still be alive and he would not be in jail. He would have had no reason the "defend himself" if he did not force a confrontation.

                                        You are so right. He has already been found guilty in the eyes of the media who constantly twist and turn the facts to make it a more interesting story to follow. If both were of the same race, no one would have ever known that such a tragig event ever occured. Prime example of the media being bias is the first picture shown of the victim when he was what 12 - where he appeared to be like any normal 12 year old - innocent, care free and enjoying the life of a kid. Yet, compare it to his true appearance when the incident occured and you see a totally different person who has lost that look of innocense. This shows that the media now determines the cases that are prosecuted verses our legal system.

                                        For all who want to judge - anything can happen tomorrow and you do something to defend yourself or a loved one and if 1 thing does not go with your story - you could find yourself in the exact situation as Zimmerman.

                                        In regards to his story changing, etc... whose to say that his lies are not out of fear. No matter what story he tells, he is still accused of murder and being racist. Would that not scare the s---- out of anyone and they not be 100% truthful either - because no matter what he says - it does not change the public opinion that has already found him guilty.

                                        Never judge someone unless you have walked in their shoes. Our society is as messed up in how they think as our judicial system is in how they determine who is guilty and who is not...

                                          GZ was supposedly inside his truck (per his own statement at the time) when he was told by the Dispatcher not to follow the kid. So, if he wasn't pursuing TM, really interesting how he magically ended up in that courtyard between the apt bldgs on the sidewalk where TM was walking, quite some distance by foot from his truck in the parking lot. (I haven't seen/heard/followed later conflicting statements by GZ.)

                                          As to who struck who first, when and how, this would be up to Forensics experts to determine and present at trial, regardless of GZ's statements.

                                          He was already out of his truck trying to find out which way Martin was running, after the dispatcher said "he's running, which way is he running", when the dispatcher realized that GZ was out of the truck is when he was advised that "we dont need you to do that", after which GZ replied OK and started back for his truck. None of this makes any difference, unless the prosecution can prove that GZ threw the first punch, he walks because of reasonable doubt. Zimmerman doesnt have to prove himself innocent, the prosecution has to prove him guilty.

                                          Zimmerman pulled the trigger. He needs to be held accountable. A lot of other people saw Trayvon that night but it is still GZ that pulled the trigger. If trayvon had pulled him out of his vehicle, you might have something to argue your point.

                                                @ Robin....which would not have happened at all if he would have stayed in his truck as instructed by the police dispatcher who told him not to follow, that the police were on their way. But this guy had to get out of truck, didn't he!? Plus, anyone who is involved in a neighborhood watch will tell you one of the things they insist on is that you don't follow or confront someone, you just call the cops.

You can plainly hear the door open...the car make that beeping noise when the door opens...and the door shut. I'm not specifically targeting you.                                                   Perhaps you could make your position a little easier for us to accomodate. Please, just post a sign on the doors to your residence, your car and your place of employment and perhaps your t-shirt, that advises us not to confront an attacker, burglar or armed robber in your defense.

                                                  Some of us may appreciate your effort to help keep our local police budgets in check, we can just eliminate their weapons, fast cars and expensive communications equipment. Just call them up, if you should need them and, I'm sure, they'll get to you in due course. There's much less paperwork for our local guys if your body is found in another county or jurisdiction, and that can truly save the taxpayers some money. I, for one, would not necessarily appreciate your cost savings efforts as I work at that donut shop near your place and we truly need their business.

                                                  If you should find your community under assault by a rioting, looting and pillaging mob participating in civil disobediance, it could behoove you to have already prepared a very large sign to stick in your front window where you would adamantly state, in large capital letters, so everyone can see, not to assist you as you've already called 911.

                                                  Mr Martin would most probably not have been killed in that altercation if he had not been involved in it.

                                                    As a Retired Federal Employee with a Law Enforcement background including medical knowledge of force blow traumas;despite what Zimmerman did Martin did step over the line when he jumped on top of Zimmerman. Bottom line, Zimmerman is lucky to be alive !
