A retired Navy SEAL could face legal action for his upcoming book about the raid that killed Osama bin Laden. The Pentagon is threatening to file criminal charges against the man who wrote the book, "No Easy Day," under a pseudonym. NBC's Jim Miklaszewski reports.
Updated at 2 p.m. ET -- The lawyer for "Mark Owen" -- the pen name of the former Navy SEAL who wrote "No Easy Day," a book describing the Osama bin Laden raid -- on Friday said that Owen did, indeed, seek legal advice before publishing the book and he disputed other claims made by Pentagon.
"Mr. Owen sought legal advice about his responsibilities before agreeing to publish his book and scrupulously reviewed the work to ensure that it did not disclose any material that would breach his agreements or put his former comrades at risk," Robert Luskin wrote in a letter addressed to Pentagon General Counsel Jeh Johnson. "He remains confident that he has faithfully fulfilled his duty."
Furthermore, Luskin said a non-disclosure agreement Owen signed -- which the Pentagon claimed he was "in material breach" of -- doesn't require Owen to submit his book for review. "As you are well aware, the Classified Information Non-Disclosure Agreement, which you attached in your letter, invites, but by no means requires Mr. Owen to submit materials for pre-publication review," the letter said.
A Pentagon spokesperson on Friday said it is unclear if the book actually contains damaging classified information. "I'm not going to say whether the book has classified information in it," spokesperson George Little told reporters.
On Thursday, Johnson said in a letter that Owen is in violation of the non-disclosure agreement.

The letter, sent via the attorney at Penguin Putnam publishing, explained that Owen signed two separate non-disclosure agreements on Jan. 24, 2007, and that he has an obligation to "never divulge" classified information.
"This commitment remains in force even after you left the active duty Navy," Johnson wrote.
Pentagon's top lawyers reminded the ex-Navy SEAL who authored the tell-all on the bin Laden raid that they are considering legal action against him for publishing "classified" information. NBC's Jim Miklaszewski reports.
He also signed a "Sensitive Compartmented Information Debriefing Memorandum" when he left the Navy around April 20, 2012, according to the letter.
"The Department of Defense has obtained and reviewed an advanced copy of the book ... In the judgment of the Department of Defense, you are in material breach and violation of the non-disclosure agreements you signed," the letter said. "Further public dissemination of your book will aggravate your breach and violation of your agreements.
"The Department is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation."
A senior Defense official on Thursday said, "There has to be consequences" for someone who violates the non-disclosure agreements prohibiting the release of classified information.
The official also suggested that by revealing "tactics, techniques and procedures" employed by the Navy SEALs during the raid, "it could put other operators at risk and future operations in jeopardy."
"No Easy Day," written by a former Navy SEAL who helped take down Osama bin Laden, claims the al-Qaida leader did not defend himself during the raid. The book will become available on Sept. 4, earlier than the anticipated Sept. 11 release date. NBC's Jim Miklaszewski reports.

Distribution and sale of this book should be immediately halted and the author arrested. Since the book has not yet gone on sale in book stores nor has it been distributed to those who pre-purchased it on-line, the dissemination of the classified information can still be contained. Based on the Pentagon's finding that the book contains classified information, any judge in the country should be able and willing to issue an injunction stopping all distribution. The author needs to be immediately arrested and imprisoned without bail pending trial for the illegal, willful disclosure of classified information and possibly for treason if any of the information would provide assistance to the enemies of the US. I know that the the rants will start about well if Obama and the White House can leak classified information how can you prosecute this guy. To them I have two things to say. First, what the White House has done is also illegal and if and when the person responsible for those leaks is identified they should be prosecuted and second, since when does one person committing an illegal ever make it OK for someone else to do it. Just because one person is lucky enough not to get caught and prosecuted it does not mean that everyone else has a free pass to commit the same crime. It is time to put a stop to people who think it is OK to run their mouths about classified matters.
CME management: When you are in the military, and you have access to anything that is classified, such as a document or a procedure, or in this case, information of a sensitive nature, you are not allowed to diseminiate it. Not while you are in or after you get out. This is not something new - this has been ongoing since the US military was formed, and even before there WAS a US - in any military. If it was secret, it wasn't told. In some militaries, you could be killed for just thinking about telling someone. This man signed and swore, multiple times, that he would not divulge classified information. Not while he was in or after he got out. This is why Bradley Manning is in prison now, and is going to be tried. I don't know why all of a sudden military people think it's OK for them to "forget" about the contracts they signed and divulge classified information but it is NOT ok, and it never was. This man should be jailed for treason, and the document destroyed. If the publisher publishes it, they should be held liable for all legal aspects including disemination of classified information - which would be akin to espionage.

In regard to "need to know, if the DOD decides something is classified, the information can not be circulated to anyone, but those with the proper clearances. Period. End of Story.

I find it funny that I'm seeing names on here calling for prosecution against the author of this book; some of these names are the same ones that argued in posts past that pvt. Manning is a hero and should be released. I believe that the author should have run this past the DoD first. That said; I have a problem believing that the book contains classified information if the author was truly professional. How does anyone know if it hasn't been released yet? Ok, let me get this straight. It's OK for the Discovery Channel to run a version of this raid several times, in full detail, yet a former Navy SEAL cannot write a book? Discovery got their version from the government, someone leaked it to them. It is uncanny how closely it resembled Obama's version of events. the Administration put together for the press a detailed account, do the same laws they are quoting now not apply to them as well? I'm sure the same disclosure laws apply to Obama and his Administration, so either they are prosecuted, or precendence has been established that the disclosure laws are invalid. Leave the SEAL alone, allow him to tell his version. Equal application of the law is required in this case. Or, perhaps the President and his minions do not want this version out there, for it might just dicredit their claims of brilliance.

Sorry but the pathetic claims about Free Speech have zero relevance in the case of this book. He only received access to classified information because he swore an oath the law. The law says he is not to reveal that information and that failing to obey that law is punishable by XXXXX means. Manning swore the same oath, signed the same non-disclosure agreements and then violated them. That's why he is in jail. Neither of these guys are whistle blowers entitled to any sort of protections as such.

This is not about the first amendment, free speech, or any of the other phrases the liberals are throwing out there. When you join the military you voluntarily agree to make yourself subject to the rules of the military. Even more importantly, when you apply for a security clearance and when you are granted one you voluntarily agree to limits on your free speech. You sign documents both when your clearance is granted and when it is terminated that you will not divulge the classified information you are given access to, under penalty of law, without getting the permission of the organization that holds the classification authority over that material. That penalty can be anything up to and including execution if the unauthorized disclosure is done during a time of war and the information released aids the enemy. In peace time the maximum penalty if life in prison without parole. Just because this guy had left the SEALs and the military behind does not mean that he is no longer bound by his oath, the oath remains in force for the rest of your life. In fact, most people who have higher level clearances take it very seriously and will not even discuss the fact that they have a clearance or what level it is unless it is necessary as part of their job. It is not something they go around bragging about.
Another point is that this material remains classified an disclosure remains subject to prosecution until the material is declassified or it becomes public knowledge. While at this point the classified information in the book has been divulged to unauthorized people, this does not constitute it being public knowledge so the government can still prevent its publication. Once the book is published the government could not take action against anyone who subsequently republished classified information in the book, but the original publisher could still be prosecuted if they were aware ahead of publication of the classified nature of the material, which in this case they obviously are. The publishing house is taking a huge risk if they allow this book to be released and the offices of the company, as well as anyone involved with the decisions to release the book could face criminal prosecution.
I fully support free speech and think that it is one of the most important rights we have in this country. That said, this is not about free speech, this is about honoring an oath. Contrary to what some liberal idiots shovel out there, the public does not have a right to know everything about our government and every action our government takes. Certain things are kept secret for the safety of the nation and for the safety of the people who risk their lives to protect this nation, not to mention those rights we hold so dear.

Signing both of those confidential agreements is a legally binding document of the utmost of importance to insure the safey of all Seals that deploy and how they do it.

You know, I find it fascinating that all you jackasses keep claiming that Obama and his Administration leaked classified information when you have absolutely no proof that even happened. What I find even more fascinating is it doesn't take much at all for a person to actually think, and use their own intelligence and gather information about a situation, but instead, someone whispers in your ear about President Obama and you believe it. I voted for Obama because I believed in him. I do no longer, and will not be voting for him come November. The only impact his presidency has had on me personally was that his Obamacare plan has doubled my medical expenses and it hasn't even been implemented yet. Simply because medical insurance companies are already increasing their premiums in anticipation of the changes it will cause once it goes live.

If there is classified information in this book, stop the printing and distribution. The author has broken the non disclosure agreements he signed according to the DOD. Prosecute. The book has not been released yet, however everyone is wanting to kill this guy for writing about "his" experience with this mission. Nobody, including you and I, haven't a clue what is in book. But since there is such a big stink of (presumed confidential) information being released, let's hang this guy and be done.
There has been hundreds of books written about soldiers life in combat and there has never been such an out cry for this guys head. Maybe, just maybe Obama's administration are worried of what the truth might do.

I did a hitch in the Navy many years ago, and it never ceased to amaze me how many idiots they paid to sit around and rubber stamp 'classified' on any and every document (including copies of newspapers which had already been in public circulation) in their possession for some arcane reason. It's not unreasonable to assume that higher levels of security were dispensed with an equal lack of discretion. The first thing we learned in boot camp was to say good-bye to anything resembling logic. As to the 'code of honor' so many have mentioned here, I never once saw any officer display it toward an enlisted man. As for 'tradition', that was the old chestnut rolled out whenever most other arguments proved less than compelling. It was clear from the beginning that much of the web of secrecy about the armed forces was maintained as much to cover the mistakes and abuses of authority by officers as it might ever have been to conceal actual tactical advantages. Much of what was contained in this article sounds like the DoD trying to further extend its authority on into the realm of civilian affairs; do they really need that much more power? I know that a lot of die-hard vets tend to support any such actions, but for the sake of anything that is left of American democracy, we might be better served to set some boundaries, and while we're at it, de-staff this sort of commission to cut back on expenses.
1). I agree with those who argue above for an immediate injunction against the publication of this book.
2). I also believe the federal government should take action against the two news organizations which violated the law by disclosing the authors real name. The names of all of the members of Seal Team Six are "classified." The DoD has stated the reason the names are classified is to protect all members of the team and their family members from acts of revenge or retribution by our enemies.
The disclosure of the name of one can lead to the identities of others by simple tracking of his associations. I believe I read that those news organizations who disclosed this classified information were CNN and FOX News (someone please correct me if I am wrong).
3). I do not agree with those stating without equivocation that the President has leaked information about the Osama bin Laden operation. Disliking a person is inadequate justification for slanderous claims.
We should not be so quick to decide that previous leaks of information even originated from the White House; several departments of government were, by necessity, involved in the planning and execution of the operation. That is the purpose of the ongoing investigation; to find the source of the leak(s).
We should see where that investigation leads first. And if it does in fact determine that a White House staff person or persons were responsible for the leaks, we should then make a judgment of the President based upon the actions he takes in response to the findings of the investigation (dismissal, arrest and prosecution of the leaker if classified information was leaked and laws violated, etc.)
As Americans we should extend the same fairness of judgment to those whom we disagree and dislike that you would want to be extended to those with whom we agree and revere. That is the American way, isn't it?
Somewhere I assume this was already said. Freedom of Speech does not apply when you join the military, you sign that over. Some things need to remain secret and its in your oath that you take. I was in the military and there are a couple things that all details I will never say. I guess those that feel he should suddenly be free to talk now that hes out would think it was fine if say someone working on the Manhatten Project who left wrote a book about it. SOme things are secret cause you simply dont need to know. You dont need to know exactly step by step what hapened that night. Ecspecially seals. They take some of the most dedicated oaths and beliefs in this country. All mlitary people I know are not happy and a couple friends in the Seal Circle are sure not happy. So for those folks screaming "Free Speech!" you all agree that if a nuclear engineer wants to post detailed schematics for a nuclear weapon and a detailed description of how to properly assemble it on a publicly available internet site, he should just be able to do it because it's "free speech" right? In most cases classified information is classified for a reason, and in most cases eventually that information is released to the public (though it may be a couple or three decades later). In point of fact, the government/Department of Defense is legally mandated to declassify information wherever possible by both statute and executive order.
There are very few things that are "permanently" classified, and most of them are very much the kinds of things that make sense to keep classified (WMD related material, etc...)
All that having been said, if I broke my NDA, I'm pretty sure I'd get thrown in prison, and at the very least suffer significant professional and personal repercussions from it. If this SEAL did break his own NDAs he deserves no less, no matter what operations he was a part of while he was active.
If anything scares the power elite in the United States of America it is their right hand men divulging their dirty little secrets. They should, and do have real fear of special operations soldiers starting to divulge "classified" information from illegal operations (not Bin Laden Raid) which is the entire basis for their "secret" or "top secret" classification. Make no mistake, the vast number of classified operations are "classified" after the fact only because they are illegal under our own laws and our leaders/politicians do not want to follow the law or suffer the consequences. Just like they admitted the Gulf of Tonkin was a lie after most involved were in the grave, we will one day find out about the things they do today to promote their corporate masters welfare. The only reason the Gulf of Tonkin information was classified for years turned out to be because it was a CIA/Govt. Conspiracy. A Lie. Learn your history or be doomed to repeat it. It seems to me that the DOD would have foreseen these situations and would have a "clearing" process for books and such. I'm sure they realize the fantastic Public Relations opportunities and the benefits of having the taxpayer enthused and showing even greater support for our men and women in the service. Hint - We might start nagging our politicians to make sure that they don't cut defense spending to much. Nothing works as well (usually) as making it feel personal. Also while I enjoy reading anything on this subject I in no way want to have any information that could hurt any of our men and women's safety and well being.

I agree with buryyourhead. Washington can release a cooked up story of the events on this and it's all fine, but let a guy that was actually there say a word and everyone wants his head on a stick. Also, the first oath this man took was when he graduated bootcamp. That oath is to the constitution and soldiers are sworn to protect it from all threats both foreign and domestic. That said I didn't realize what a huge issue this has become - I see it from my personal side PRIDE, in my countrymen. Reading the above comments I will have to defer to those who seem to know more or at least understand the ramifications, so I will not purchase the book.
@ david-475776: I've spent several years working on various declassification and FOIA programs. I kept my language general because quite honestly most people aren't going to care about the specifics (For instance, the difference between NSI and RD/FRD, or information protected by DOD classification guides vs. FOIA exemptions) the bottom line is that certain information is protected for (usually) good reasons, and most of what remains is eventually declassified. As someone that "works in the field" you should probably know that, but apparently you were too interested in taking cheap shots to think about such things.
Which of course makes me strongly question your claim that you work in the field at all.
PS: Check out Executive Order 13526 (preceded by Executive Order 12958), since apparently you're one heck of an ignorant teacher. The President DOES have authority over classification and declassification guidelines. He does not, however, personally determine which specific bits of information are or are not declassified (or at least he shouldn't).
However, having seen it first hand, when someone in power wants something declassified, it can happen with extreme speed unless it's something unbelievably sensitive.
The entire matter is very easy to understand:
1. He signed a non-disclosure agreement.
2. He violated it.
But as usual many of you want to drag the POTUS into this when he has nothing at all to do with it.
1. The POTUS is NOT jealous of someone "Stealing his thunder".
2. The POTUS did not leak classified information.
3. Discovery channel showed a sanitized version of the events so as not to compromise anyone.
Some of you are so wrapped up in a fantasy world that you wouldn't know the truth if you were presented with it. I signed a non-disclosure agreement when I left the military just like many other service members have and I have never violated it. When you sign it during debriefing it is explained to you in great detail what you are signing and why. You are told what will happen to you if you violate it so there is no wiggle room here and no conspiracy. This SEAL knew what he signed and he sure as hell violated it period.
Same old arguments. If it's anti-Obama the Republicans are 100% for it and the Democrats are against it. Can't some of you put politics aside for a minute to see that this SEAL broke the code of honor? He signed an oath to never divulge classified military information so he should be held accountable for his actions if indeed he did divulge secrets that were not approved by the military.

The only people the Pentagon wants to keep secrets from is the American Public. Namely so we cannot confront them when the reality of a situation completely contradicts their press releases. I personally care a lot more about this man's service and hold that in higher regard then the Pentagon's proported 'secrets'. They may be able to go after the Ex-Seal specifically but as another poster said, the first amendment is going to protect everyone after that. debnran, you are correct in all that you wrote. However, I think the point that is enraging other people is that the Obama administration itself has leaked quite a bit of classified information. It seems rather hypocritcal of this administration in particular to go after someone who has done far less damage than them. Especially since they are basically handing the information over to Hollywood for a nice, sanitized, yay Obama version of events.
IMO, I feel anyone that releases "classified" information or shows our current use of tactics is in breach of contract, if they were in that kind of position and/or treason. Everyone, including and up to the POTUS. I do not feel any of it should be allowed, not until it is obsolete and deemed unclassified or whatever. Is natural to want to stick up for the author but does the information in the book endanger current service members unnecessarily? If it does, then the author should do some soul searching. Is a big can of worms and double standard. Every other day I read an article that says MSNBC, NYT, Wash Post etc, has obtained statements from anonymous Military/Government sources that aren't authorized to make a statement. What about all the retired analysts quarterbacking from T.V. news shows?

Nobody knows what's in the book except the DOD, the publisher and this guy. You can tell a tale about how you killed Bin Laden and not violate your oath or your NDA. It's public knowledge that you rode in on a helicopter into Pakistani airspace and shot the guy in the head. It's public knowledge some of the tactics used. It's public knowledge most of what happened afterward. The details are classified so there is no way they can legally say that just telling the story of how they killed Bin Laden and how he was feeling that day are disseminating state secrets unless he leaks specific details that have been redacted on the official report. They don't have a leg to stand on or they would have already slapped him with an injunction.
Classified info would be naming names and methods and describing how the stealth helicopter works.
Unclassified would be elaborating on what is already publicly released information. There is nothing secret about blowing down a door, walking in a room and shooting people. We know that happened.
How he felt about it and what part he played in an event that is public knowledge is not treason or in violation of any NDA or law I'm aware of. It's all in how you frame it and how many details you release. I'm sure the publisher's lawyers went over all of this to make sure none of it wasn't already publicly released information.

But simply put, yes, it is amazing that someone would join a military branch like the Navy Seals (no sacrifice there, right?), go out on god knows how many missions, risking life and limb on every mission, with the grand plan of writing a book and making some money. Simply outrageous, and I'm sure that's exactly what he was thinking when he joined the military.
On the other hand, had you read the entire article, or contained the aptitude to comprehend what your read, rather than doing the knee-jerk liberal attack, attack, attack tactic; you might have noticed that he (our former Navy Seal) was utterly disgusted with Obama's leaking information (being a whore to the Liberal News Media) all for the sake of being re-elected. In other words, Mr. On-It, the REAL whore is Barry Seotoro (aka Barack Hussein Obama). You remember him, the president who sealed all his personal records, took 18 grand vacations, and is currently running a re-election campaign that can mention nothing, absolutely nothing, about accomplishments. Like I stated in other Posts, so therefore; if the President does disclose "Classified Information" then that "Classified Information" is fair game for anyone to include in a Book. Ever since other Presidents (All Political Parties) leaked "Classified Information", you honestly believe that the US Military and Intelligence Agencies disclose all "Classified Information" to "Elected Officials" that do not give a sh!t after their Term of Office is over; there were reasons why this was mocked in movies like Independence Day, ID4, about Area 51.

My curiosity is the only thing that wants the book to come to light.
However, I am with everyone else that states it shouldn't be released, because, he did take his oath and sign a disclosure agreement (more like signed several of them). My brother in law was killed in Afghanistan, my other brother in law is still serving, and my husband is a Marine. I wouldn't want any of their lives in danger because some ahole wants to publish a book that details too much information about tactics and training. And NO freedom of speech doesn't apply to this deal, sorry but the government gets that say when you sign your life to them. There is things my brother in law can't tell us because of his forms and there is things my husband cant discuss because of his.
Obviously someone wants it stopped at the pentagon, because it does contain classified information. Stating the Obama released information and not citing any sources doesn't give y'all any credibility. I could run around and say Bush leaked information or Romney has leaked information and it doesn't make what I say the truth because I said it with no facts proving it. What political motive does a Navy Seal have to write this book? He's been outed, his life threatened and now is being scrutinized by the DOD, all that for political gain? I suggest that for those of you who have never "seen" the CLASSIFIED INFORMATION NONDISCLOSURE AGREEMENT, to go out and read it... you really do not have to like it, but if you signed it then you acknowledged, which was witnessed:
"11. I have read this Agreement carefully and my questions, if any, have been answered. I acknowledge that the briefing officer has made available to me the Executive Order and statutes referenced in this Agreement and its implementing regulation (32 CFR Section 2003.20) so that I may read them at this time, if I so choose."
He may have "consulted" with the DoD, but did he receive permission to publish... in writing, see section 8:
"8. Unless and until I am released in writing by an authorized representative of the United States Government, I understand that all conditions and obligations imposed upon me by this Agreement apply during the time I am granted access to classified information, and at all times thereafter."

Not a russian: when you enter into the armed forces, you have to sign certain documents and swear that you will obey orders. When you go into a field which will take you into contact with classified information, you must have a security clearance. As a part of that clearance, you swear that you will not divulge classified information and you sign a contract as such. As you go up the degrees of security clearance, you continue signing and swearing. By the time he is a seal, he should have done this maybe 3 or 4 times, AND as a part of his training, he is told that if he divulges anything from his missions, it can affect future missions, and they don't want that to happen - he's ordered not to say anything. When he gets out, he signs non-disclosure documents and promises to keep quiet about his missions. Have you seen many other seals talking about their missions? He's not theonly one to go into a sensitive situation - but they all have kept their word. I wonder what the other seals have to say about this. I bet they are livid because he is hurting that brotherhood just for money. What he's doing is not just illegal, but it's putting many other lives in danger.

I suspect that if the DOD prosecutes this guy, the burden of proof will be on the prosecution to show that he actually violated National Security in some specific way, due to the publicity. Here's what would have ocurred under Bush/Cheney regime: Intelligence confirms exact location of Bin Laden. Bush order airstrike using B2 bomber and a couple laser guided 2 ton bombs. Report to the press that Bid Ladin is dead and you just have to take our word for it. Done.

First off, is there some proof that classified information was provided to the producers of "Zero Dark Thirty?" If so...to what end, given that the film does not release until well after election day? Seems a pretty poor plan to try to "beef up" the President's image with his Hollywood buddies (as is being implied) if it comes over a month too late to do any good.
"Military cooperation" with the film doesn't automatically entail sensitive information being shared, unless you have some tangible proof of same.
And as far as other "White House leaks" by all means tell us who in the White House leaked? Finding such things out is rarely an easy task. Look how long it took for Scooter Libby over the Valerie Plame business. Nevermind that in some cases what is being called a "leak" was simply the President getting the message out before someone else (for instance, the Pakistani government) did.

When you sign that contract, there is a reason for signing it, That reason, is to protect those involved in the mission and those that are still out there that may be compromised by his failure to comply. He should have already been charged, and all those involved with this publishing of the book. When you join the Military you sign a non-disclosure agreement for life. Only the military brass can releave a person of that agreement and that is rare. President Obama signed no such agreement. Right wrong or otherwise he is not bound to not release information. I am sure the Joint Chiefs of Staff and Security agencies read an approve any information he releases. Now having served yourself if you release any information you can be held accountable for breach of contract and arrested.

If you went to work in a company and they told you that you had to sign a confidentiality agreement and a non-disclosure agreement about working there, you worked there for a while, and when you quit, you signed another non-disclosure agreement and they spoke to you about your confidentiality agreement, and then you decided to write a book about your experiences, or go to their competitor with your experiences, you'd be sued by that company. The same with the federal government. The only other thing is that with the classified information he shared, someone could be killed. If people are going to disclose classified information, and others killed because of it, those people who opened their mouths should be held responsible for their deaths, or injury.

The fool - I mean the ex-seal - and his supporters may talk about the importance of disclosure, freedom of speech or some other reason for writing this book. However, this seal has made himself and his fellow seals targets for enemies, foreign and domestic. This guy disclosed that he comes from a small town in Alaska and it will not take much to track him down. It took 9 years to hunt down bin Laden. There's probably someone out there ready to respond in kind. The U.S. has less to fear than this guy and those he has put at risk.

1. He MAY be in violation of his nondisclosure (probably but I'm not a lawyer)

As a former naval officer, you also know that when you go to get out that if you have had any dealing with anything of a classified nature that you are never allowed to disclose it. If you say otherwise, I call BS on you being a navy officer. I was in the Army for many years, and wasn't involved with anything classified, and I know you aren't ever supposed to talk about it.

I hope he is made an example by the military ....telling American military secrets cannot be allowed...And this publishing company is willing to publish this book...how patriotic of them. There's a couple of good articles regarding zero dark thirty. Emails from the Obama administration specifically stating that they wanted it released prior to the election so that it could help his reelection. It was originally slated to release prior to the election, but Sony pushed it back amid controversy.

Now in the interest of fairness, I don't know if "Mark Owen" did in fact publish classified information in his book. I haven't read it and have no interest in doing so. If he did, he deserves to suffer the full personal and professional repercussions of violating his non-disclosure agreement.
I also find the timing of what amounts to an attempted smear campaign to impinge the President's reputation on National Security Matters a wee bit less than coincidental. Not surprising in the least, but pathetically transparent. Yep, people kill people. They use tools to do so, knives, etc... People who provide the weapons (including knives) that people use to kill other people, are complicit if they knew beforehand that they would be used for that purpose.
Attorney Holder fits that bill. I suspect that Obama fits that bill as well. The ONLY reason I believe Obama knew... is because of the claim of executive privilege. I believed someone high up in the Justice Department had screwed up and would end up on the chopping block... all the way up until the Executive Privilege claim. At that point, it became apparent that there was an attempt to hide the truth.
What good would publishing the tactics used to get to Bin Laden do for anyone in our armed forces? We aren't talking about torture in Guantanamo. Non-service personnel have no "need to know" how teams like Seal Team 6 are trained. This can only end in a bad way for future servicemen. The book, if the DOD is telling us the truth, and they have read it before it has been put up for sale, has classified information in it, rendering the author liable for its contents, which the DOD are not willing to disseminate among the general public, so some wacko-squads can assemble Pseudo-Seal Teams to attack their enemies with. The tactics are the secrets of the military and we do not have a "need to know"! I know people hate to hear this, but the lives of servicemen hang in the balance, and I, for one, would not want classified information to be passed out to make a buck off the military who trained me, while putting my fellows at future risk!

Actually Charles, aside from disputing a few of Obama's facts (which considering he wasn't there.... isn't that surprising) this book only relates the same information that Obama has already released to the public. He can no longer be prosecuted once the information has already been declassified and released by the White House.
What is so hard to understand about this? Why is it so hard to accept that this kid is in breach of a non-disclosure contract with the military and is in violation? Does it have to be a case of DoD is embarrassed? Not necessarily. Personally, I see their point when they say that what is to deter future authors from springing up and outing national security secrets or strategies. The DOD doesn't threaten to prosecute if you publish. They arrest and destroy the book. The fact that they are threatening, means that they have no case to do that, and are trying to strongarm the Seal and publisher into not releasing the book.

This sounds like Counter Intelligence. When the government has control of the media, why would they go, "HEY EVERYBODY! CHECK OUT THIS BOOK WE DON'T WANT YOU TO READ!!" The whole Bin Laden raid story is full of holes, then the Seals involved die in a helicopter crash. Come on now. The only stuff that's going to get out, real or not, is going to be done with the approval of CIA/FBI.

If you mean the General that wrote the letter I agree with you. Governments should not be able to keep secrets from its people in fact it should even go in the other direction. We need to know what our Government is doing in our name.
For example if the Government is killing civilians in another country I want to know about it and I want those responsible to face the consequences of their actions. They are acting in my name as the person that elected them and I do not agree with said hypothetical actions. The Government works for the people, the people cannot have an active role in any meaningful way in Government if secrets are being kept hidden away.
This is why watchdog organizations and whistle blowers need to be protected and celebrated when they come out with their stories.
So you would have told the people about the Ben Ladin planned raid on his compound. Does that mean you would have posted the names, and locations of the Manhattan Project, too? Why not give the chemical makeup of the Stealth material the US uses. It is ok for the president to leak secrets, but not the Seal team member. I agree with Mario.

I'm confused. Are you berating the Seal, or Obama? There's no information in the book that hasn't already been released to the public by the White House (except for some information that contradicts Obama's official version).

I am not talking about those kinds of secrets. I am talking about the kinds of secrets that our Government is keeping from us, not from others. Secrets like the ones exposed by Wikileaks, like the footage of that Blackhawk that was shooting at unarmed civvies in Afghanistan. The stuff the Government wants kept secret because the truth makes them look bad.
The true secrets, like what you mentioned (the stealth material formula) that we as a nation are keeping secret from the World are secrets that should be kept secret. Ops like the Bin Laden raid should also be kept secret until they are over, but when they are over they should be instantly declassified. No more covering up facts, truths, or events for 60 years after they happened. That only casts suspicion in my mind, not as much as the conspiracy theorists mind you, but still some.
