I am so glad I don't live in Mass because I would be pissed off. I might just request a caveat on behalf of the good citizens of Mass....like the Prison system will only be required to pay for the surgery only once his victim takes her next breath. And, since this guy has been in prison for years, I doubt the prosecutors are much involved at all. I did a quick on line search and found that this judge was actually appointed to the Federal Court by right wing hero Ronald Reagan in 1985. So I truly believer your anger is misdirected. I do not see where President Obama has ANYTHING whatsoever to do with this.

Sorry Number#3, you are wrong, the answer to every ill in these United States is not President Obama. I know it must be easy for you to assign the blame to him, but just stop and think. This is Massachusetts, where Romneycare is fully implemented, and still the blame does not go to Mr. Romney. It was an order given by the courts. Yes the courts, a separate Branch of the government often gets it wrong. Let us hope that the Corrections Dept., if forced to do this, can assign this fellow or woman something productive to do and pay him or her 15 cents per hour for the rest of his life, and thereby recoup the cost.

This is completely outrageous. This clearly falls into the category of elective surgery and is not something that taxpayer's dollars should be paying for. There is absolutely no medical necessity for this surgery. What is next, forcing the taxpayer to pay for an inmate's plastic surgery to fix a crooked nose or breast augmentation for female prisoners. I certainly hope that this gets appealed and that this ruling is thrown out. The idea that any judge would hand down a ruling like this is absurd and the judge should be removed from the bench. All - I don't really see this standing up on appeal. If the Mass. DOC has staff lawyers, it really won't cost them anything to take it all the way up. The 1st Circuit Court of Appeal just might be liberal enough to affirm, but not the Supreme Court. They'll rule that corrections/security concerns outweigh the mental anguish of a murderer.

First of all, Amendment 8 of the Constitution has to do with excessive bail....it doesn't say ANYTHING about allowing sex change surgeries. That's the main source of revenue for these companies. The money that they make of people and companies paying premiums is secondary. Fully transitioning from one gender to the other can cost much more than $30,000, depending on what all is done. But, the overall costs can go as high as $100,000. However, since the surgery will be paid for by the DoC, I doubt they will be willing to pay for all the additional cosmetic modifications. (Breast implants, Adam's apple removal, etc.) Most likely, the only thing they'll pay for is the genital reassignment surgery which costs around $20,000, give or take. But, even that, understandably, will probably be unacceptable to the people of Massachusetts.

Simple solution: Take the cost of the surgery out of the judge's salary for the next 5 yrs in annual increments..........why should tax dollars pay for cosmetic surgery?

From the comments I have read since I first posted yesterday, I have a few questions. Is this person in a federal prison for the murder of is wife? Why did he not just get a divorce instead of killing his wife? Several companies like IBM, Dell, possibly 3M and a LOT of others have insurance that covers trans-gender surgery, why did this person not get a divorce and find a job with a company that had that type of insurance?

Obamacare will include trans-gender surgery, so those that need it will get it. Obamacare may not have gone into effect yet, but they are already supposed to be setting aside money for it.

I stand by what I said earlier. I do agree that the judge should have to pay for it since he ruled for it. The people of Mass. should really be in an uproar about this. This ruling should definitely be appealed and changed. Just for the record, my name is Sonya and I live in Texas. Yes, I am a redneck as well. I had hoped for a lot better changes from Mr. President Obama, but I am entitled to my opinion just as everyone else is. I do not mind my comments being collapsed, and even though this type of surgery has become classified as a valid surgery by the government, I still do not approve of it in this case. If this person is in a federal prison, then everyone will be helping to pay for it. We have a lot more of this type of surgery to pay for when Obamacare goes fully into effect.

I'm responding primarily to the person who asked if there was any argument to support this judge's ruling. I think the article says that his opinion was over 100 pages long, so I have to confess I haven't read it, but I have a general understanding of the area of law.

First, let's clear up some misconceptions. The guy is in state prison for murdering his wife. Murder is almost never a federal crime. The judge is a federal trial court judge. He's interpreting federal law (the 8th Amendment), so the Mass. Supreme Court can't overrule him. And the people of Mass. can't vote him out.

Now, on to the merits of the ruling.

Courts have interpreted the ban on "cruel and unusual punishment" to include a requirement that prisoners receive adequate medical care. This case is just exploring the limits of that idea. (Don't get me wrong, I think the case was wrongly decided, as I'll explain.)

What happened here is undoubtedly that this fellow got himself a really impressive expert witness to go on and on about how this is a recognized disorder and that there are medical treatments and that his anguish is every bit as much as that of someone with an untreated broken leg.

And that may all be true. I still think it doesn't matter.

I think the courts will ultimately recognize that there are some non-life-threatening inborn dissatisfactions with life that are perfectly treatable, in order to make you feel better than God made you, but that are inappropriate given the nature of being a convicted murderer in prison.

For example, if the guy in the next cell over is addicted to pain pills, the "least intrusive" means of medical treatment is to keep giving him pills. I guarantee you we're not going to do that.

Giving this fellow sex-change surgery presents impossible problems for running a prison. I suppose the easiest thing is to put him in with the women once Mr. Happy's gone, but I have a feeling the women won't like that so much.

This is elective surgery that I'd venture to say most people out in the population that want it can't afford it and will never get it.

Wow. I have a "friend" who's son is an ex felon. He was paid by the gvt. to go to school once he got out of prison and the gvt paid his tuition at a 4 yr university. He got a degree in accounting and now can't find a job....BECAUSE HE IS A FELON. So....now his wife is in school, gvt tuition paid and living expenses from gvt. including child care. And, my kids have to pay for their college, maintain jobs, pay childcare...my kids come from generations of tax paying, law abiding citizens you would think this whole concept would be reversed.

This was a federal judge (apparently appointed by -- wait for it -- Ronald Reagan) ordering the state of Massachusetts Department of Corrections to provide medical care to a prisoner. This has nothing to do with the ACA. It doesn't even have anything to do with Romneycare.

I don't agree with this particular decision, but the principle involved is a perfectly good one (or do you hate the Bill of Rights?). If you break your leg, even on death row, the state has to give you a doctor.

Mental disorders that manifest through self harm are treated in a mental hospital and THAT is where this guy belongs. How little you know about socialized medicine in "INDUSTRIALIZED COUNTRIES!" Australia has socialized medicine and anyone with a decent salary gets private health insurance. When I lived there I had private health insurance and got the best treatment. I had workers on socialized medical care and it was terrible. More than once to get the worker back to work quickly, I paid out of my own pocket for private medical costs. Socialized medicine wanted to wait three months for a fractured nose! Socialized medicine wanted to wait 5 months for an allergy test. Meanwhile the worker could not work and would be on welfare! In Canada, those who buy dental insurance get immediate care. Others have to wait months. Don't talk about socialized medicine until you have been through it.

This criminal is costing society about $30,000 a year to house him, feed him and guard him. Then after he gets his "surgery" there is medical maintenance costs to pay. About $1500 for hormones and psychiatric care. All because he wants to look down and see an artificial vagina instead of a penis. The prison should have let him kill himself.

It doesn't work that way Jim Comfort. You have to go thru a psych evaluation for a couple of years before it goes to the next stage of surgery.

I'm still trying to understand how this is "adequate medical treatment"... as far as I am concerned the keyword here is "selective" not adequate. Do insurance companies typically cover this? I think not. Most insurance companies even have a cap for amount that will be paid for psychological counseling. Our prisoners have no such caps. Can a free living/non-prisoner civilian get their state to pay for this? How about a soldier who is serving our country? Anyone who suffers from this very psychologically based (meaning the brain tells them they need/desire to be/are one sex though the body hefting that brain around is the opposite) should not get this paid for by the government and/or taxpayers monies. Should concessions be made to assist his mental state? Counseling I can concede to... help with how to deal with it on a daily basis which is more than many of our law-abiding citizens have access to. Yet if an inmate is a threat or under threat, the prisons have safety measures for those individuals. That in itself should be enough concession. He should have to live his life with the consequences of his choices that put him there and receive no special selective concessions.

Didi lives in a state (cali) that had a judge award $1,000,000 to a home invasion suspect because the victim allowed the roof tiles to fall into disrepair and the dude fell straight through to the floor and broke his neck. He was awarded for loss of income and for pain and suffering. The homeowner was elderly and living on social security. This happened over 30 years ago and people reading it in the paper laughed and then cried - depending on where their empathy was at the moment.

Living in Texas, if someone fell through my roof while trying to rob me, I would have shot him. No question about that. I guarantee that fool would be dead before the police were called. I feel sorry for the citizens in states that are not allowed a gun to protect themselves. I carry a gun most of the time due to things like the coke dealers that live across and up the street from me. I have called the police about them, but things have stayed the same so far. I just hope they are doing something undercover gathering evidence for now.

Cosmetic surgery of any type is not insured, except for those that were in accidents or was born with a disfigurement. Most people who have this type of surgery has to pay an eye tooth for. This is why many actors and actresses have this surgery, but it enhances their ability to get work in their chosen field. They can afford this, where 92% population can't.

So the Tax payers get to foot the bill for this degenerant's "ELECTIVE" surgery? Maybe it is the Judge in this case that needs to be locked up!!

Waste, Fraud and Abuse...as a federal employee, I am subject to UCMJ (jail time), if it is determined that I was responsible for using taxpayer funds in a frivilous way.

I agree-if a procedure is considered elective and not covered for those out of prison, it shouldn't be for those in prison. Likewise, if something is covered by all/most insurances for the non-incarcerated, then it should be preformed for inmates (since we have laws about the humane treatment of prisoners-to deny basic healthcare could be considered inhumane depending on what the procedure is).

If he has the money for the procedure (which is how it would be for anyone else), then by all means allow him to have the surgery.

This is almost as stupid as giving a liver transplant to someone on death row! They won't allow that, but they'll allow this? Amazing!

Federal judges can be impeached. Don't ignore the fact that this judge just created case law that ANY prisoner can attempt to follow.

contact your congressman and demand impeachment over this crazy act which has just gone TOO far.

At the federal level, Article Two of the United States Constitution (Section 4) states that "The President, Vice President, and all other civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors." The House of Representatives has the sole power of impeaching, while the United States Senate has the sole power to try all impeachments. The removal of impeached officials is automatic upon conviction in the Senate.

This is another case of judges being out of control pushing their own social agenda. This is a travesty, and it is impossible to conceive of how this surgery can be considered a right! The judge needs to be removed from office ASAP.

This judge is obviously not fully mentally competent and we should all stop beating up on the unfortunate among us..............why is such a person allowed to remain in a compensated position that they are unqualified to fill in a competent manner?

Well, since technically after the surgery "She" will be female, then by law she would HAVE to be changed to a female prison since she would legally no longer be a male.

Number- I would be perfectly fine with having universal health care here, and having this procedure covered. I'm not fine with having a criminal get this procedure for free when the people that work and pay taxes to support his murdering ass may not be able to afford going to the doctor when they're ill.

This decision was handed down by a judge appointed by a republican.. And while i agree that prison shouldn't be a nice place, there is a reason they give them certain privileges... Helps keep the beasts docile..Now of course i will hear about "beasts" and how it's not PC...oh well..
