Fugitive rapist who fled during trial captured in Texas

Eric McGowen, 20, was captured Tuesday after vanishing on Aug. 29 during a break in the proceedings of his rape trial in Texas.

A man who fled his Texas rape trial in late August was back in custody on Tuesday, after reportedly being found on the toilet in a Houston-area apartment, authorities said.

Officials arrested 20-year-old Eric McGowen without incident, in an apartment complex in northeast Houston at 9:15 a.m. CT Tuesday, Click2Houston.com reported. Officers told Houston's CBS-affiliate KHOU that he was arrested and handcuffed while sitting on the toilet. The U.S. Marshals Service says authorities were able to find McGowen with information provided to the Gulf Coast Violent Offenders Task Force.

McGowen had been charged in the repeated group sexual assault of an 11-year-old Texas girl. He fled his trial for this case on Aug. 29, the same day the now 13-year-old victim testified about the attacks in Cleveland, Texas, about 45 miles northeast of Houston. Authorities had been looking for McGowen ever since.


The trial went on without McGowen, and on Aug. 30 he was found guilty of aggravated sexual assault of a child. He was then sentenced in absentia to 99 years in prison.

McGowen was among a group of 20 adults and juveniles who were accused of sexually assaulting the girl on at least five occasions over a three-month span in 2010, Click2Houston.com reported.

McGowen was the first to stand trial. All six juveniles charged and six of the adults have pleaded guilty, according to The Associated Press.

I'm glad he's back behind bars, where he belongs. He deserves every minute of his 99-year sentence.

But it does need to be said that a black teenager from a poor area rapes a girl and gets 99 years.... and a rich white kid from Chevy Chase MD kills his girlfriend and gets 23 years.

Black kid rapes and gets 99 years.

White kid kills and gets 23 years.

The difference is 76 years. Most people don't even live to be 76 years old.

I don't have a problem with the 99 years, I have a MAJOR problem with the 23 years. But hey, liberty and justice for all that can afford it. God Ble$$ America!

I guess I am used to seeing cases like these with 20 something years of a prison sentence thats why my eyes popped out at the 99 year term. I think he probably got that sentence because he was on the run at that time. I really don't hink bringing race into everyhting is necessary.

I think the reason he got such a heavy sentence is because it was a gang rape that happened numerous times with a juvenile and, this guy used a foreign object ( a beer bottle) to sexually assault her on at least one occasion. While I wonder how much time the other participants who plead guilty will be given, 99 years for this scum bag is still to short IMO,

Funny how you would even compare the two crimes but that is a typical of a small, narrow minded person like yourself.

The creep that raped an 11 year old little girl got exactly what he deserved because he is a child predator. While the other case is just a murder of a 22 year old woman. Big difference between the two.

But I guess you would like to have lighter sentences for kiddie diddlers just to have them out on the streets again and raping your daughters wouldn't you?

I believe the sentence was so harsh because of the fact that the guy had escaped and was on the run! Obviously NOT ready to admit his wrong doing and pay his debt to society! He was on the $hitter hiding out somewhere!

True that 20+ years for a murder is definitely not adequate. I say 99 for both crimes!

Do you think - did you consider at all - that he was on trial for raping that 11 year old child 5 times during an extended period and helped confine her as others did the same? I don't know -for me that would have made a whole lot more sense that the sentence was long. The crime was more than just rape. Rape is bad enough. Raping a child and holding her down while others did the same - and then repeating that behavior on multiple occasions. Regardless of color - not the same crimes at all. Sentences that reflect that do not give me pause. The fact that someone brought race into it doesn't surprise me either sadly enough.

Now if you have MORE information about that other case you mentioned that you want to share - I am willing to look and even consider. Based on what you presented, no - I am sorry the difference in sentence does not appear to me to be based on 'race' but on the crimes convicted.

You are right, We should have a mandatory death penality without appeals for the perpetrators of Rape on children. You seem so worried about the rights of the criminal when the child that was repeatedly brutalized will NEVER be whole human being again.

That is what is missing here not that our criminal courts are fair. My sister went to prison for defending herself against a known fellon and she got 25 years for killing the scumbag. do you know what the lawyer said? I could get her off tomorrow if I weere to employ money to the right places." He was wanting the family to come up with 100,000.00 dollars in legal fees even though he was a court appointed atty.

She took the plea deal that kept her from the death penalty. You liberals always want to reach for the race card when it does not exist. However, the gap between rich and poor is wide and privilaged rights are hidden but not invisable. She is white and we are poor, but honest. The man she killed was terrorizing her over a period of time of months. She armed herself and when he came at her, she shot him repeatedly with a small caliber pistol.

When OJ murdered his wife and got away with it, it was because of money and his Dream team of layers and Cockran. The last time I checked OJ is black. Had he not been famous, rich and well connected, his but would have never made the news. The liberal press can either condem a preson to being castrated in the public, or can be portrayed as a victim, go figure.

    I've lived in four States in my adult life, Colorado, Michigan, Minnesota, and Ohio, and in none of them would this sentence have been half this long. In fact, the average sentence for rape is probably only 10-15 years among these four States, and reading about this sentence, which is essentially a life sentence, makes me feel strongly that this judge is guilty of a serious human rights violation. Does Texas have the kind of money necessary to grossly violate human rights the way that they have, in this case and in many too many others, or do outrageous sentences such as these make it necessary to cut and underfund other more-beneficial social and educational programs which might help reduce violent behavior among young people?

    In the old American South of just 50 years ago it was common for African Americans accused of serious crime to get lynched and to die horrible deaths at the hands of their local communities, and tell me how this sentence is not a modern-day lynching? This is America for God's sake, a country that at one time used to respect human rights and promote such values all over the world. What this kid did was wrong and he deserves to serve some time to think about what he did, but he also deserves another fair chance at life on down the road a bit too. I can see 10-15 years based on the seriousness of the crime, but the victim didn't get killed, so why kill the offender? The SCOTUS has already ruled that the death penalty for rape is unconstitutional, so why is a life sentence legal? All this sentence does is to permanently destroy a life with no hope of reform, for a non-death crime, and it saddles the citizens of Texas with another several million Dollars worth of additional debt too!

    Is revenge worth it when it makes it more-likely that violent acts like these will continue unabated?

          Think about the other charges here, in addition to the actual rape:

          Rape of a minor

          Assault and battery of a minor (raping her with a beer bottle)

          Sodomy and/or sodomy of a minor (the sodomy itself may be a separate charge also depending on laws of the jurisdiction)

          Intimidation of witness (threatening her with harm to her parents and siblings)

          Creation of child porn

          Posession of child porn with intent to distribute

          Distribution of child porn

          Conspiracy to commit rape

          Conspiracy to cover up a crime

          Trespassing (on the trailer)

          Sex trafficking of a minor (it was reported that the 19 year old brother of one of her classmates offered her a ride home from school, which was how she first found herself in that abandoned trailer. If this is true, then it's human trafficking.)

          Add evading arrest and you'll have a pretty good picture of why he got 99 years. He probably wouldn't have gotten such a lon sentence if he'd stuck around! Judges get pretty pissed when you leave before the case is over...pretty much clarifies your guilt.

          That's actually something I've been wondering ever since i heard he was able to leave the courhouse and disappear in the middle of a trial. (let's leave out the fact that he only got $30,000 bail and so was out before the trial and not sitting in the courtroom in belly chain and prison jumpsuit. I wonder if someone helped him slip out a side door, gave him a coat or hat to cover his clothes or face, who helped him get away from the courthouse and gave him money and the wherewithal to hide from the cops. Whoever it is--or if it was multiple people--is in some serious trouble.

          The difference isn't necessarily "black teenager from a poor area rapes a girl", (I don't know if the black man is poor or not, but Cleveland is just a small town, not a "poor area"; vs. "a rich white kid from Chevy Chase MD kills his girlfriend and gets 23 years." In Texas, we take violent crime very seriously, especially rape of a child. I'm sure you know about the high execution rate for murder here. Maryland, seems to be rather lax on violent crime.

          The only problem I have with Texas justice, is sometimes the parole rate is too short. My sister-in-laws murderer got life rather than death since they did not locate the murder weapon. He was eligible for parole after 15 years even though he was a third time offender. But he murdered another inmate, so he will be in prison for the rest of his life. Seems wrong to me to get worse for killing another inmate than an innocent woman on the outside.

            In no way am I condoning these despicable acts, but I had to ask myself, how can someone get raped repeatedly like that!! I mean, why didn't the girl tell her parents or any other trusted relative, or even the authorities?? Why was she so readily available to him and not run when she is anywhere near him???!!! Even if she was in this country illegally that should not hinder them from protecting their daughter!!

              Out of the 20 males who raped her, 6 were juveniles, and at least oone was a middle schooler. My bet is that that middle schooler went to her school, and it was him showing around the cellphone video he made of McGowan raping her with a beer bottle that finally got the attention of a student who told the teacher.

              As her mother was in the hospital sick an her father was unemployed, she was taking care of herself and her two siblings as best as she knew how.

              I read another person's perspective (voiced in her comment on another article about this topic) based on what she gleaned from the original article. I haven't seen the original article myself, but she said that it was the girl who found the abandoned trailer in the first place and it was her that dressed up and met the men there to have sex. And the only reason it was found out was because one of her friends followed her to the trailer and saw what was happening through a window (the supposed victim wasn't planning on telling her parents she was having sex). Personally, I have no idea if this is true or not, but it does cast some doubt on what the girl actually said happened (kids can be pretty malleable, especially by their parents).

              Of course, the fact that these men were having sex with her is still inexcusable, as statutory rape laws are pretty cut and dry. I also don't understand (on the premise what I stated before is in fact true) why NONE of the men would try to find out the girl's age before having sex with her. For the younger kids (i.e. middle school boy) I can understand not knowing, but for the rest it's inexcusable. I can't really label any of them as sexual predators due to the conflicting information I have heard, but what I do know is that ignorance of the law is not a defense in court.

                What these men did to the little girl was horrible. Yet, since the parents are illegal immigrants, the entire episode may have been avoided if the girl's parents followed the law

                Instead, now taxpayers have to pay for the judge, lawyers, police, years in jail, etc. And of course, the free citizenship for the victim and her parents. We need someone to help stop this garbage already.

                      This is horrific!!! I at first caught myself thinking 99 years???? But what was I thinking...this child should be protected from predators such as this man. To suggest that charges and the sentence do not fit the crime because people "don't know all of the facts" is just a reminder that people are divided by more than race. I don't care if a girl, teen, woman (this applies to men too) with makeup wearing nothing, NOONE has the right to touch them or God forbid rape them. This rolls time back to not so long ago when a woman wearing a skirt and a halter can be sexually assaulted and the cops say... well look at how you're dressed...disgusting.                       Its a shame they cant get the death sentence for this. In my county he would hve only gotten less than 5 years because we have a commonwealth attorney who has no balls and does not believe in the death penalty. He makes a plea on about every case and most of the time they get time serve or no time.
