Korean-American man sues Queens Hooters over racial slur on receipt

A worker at a Hooters in Queens, N.Y., resigned after identifying a Korean-American man and his girlfriend with a racial slur.

A Korean-American man is suing a Hooters restaurant in Queens after a worker there identified him and his girlfriend on a receipt using a slur referring to Asians, they allege.

Kisuk Cha, 25, and his girlfriend, both Korean immigrants, placed a to-go order at Hooters in Fresh Meadows, Queens on July 10, according to their lawyer Daniel D. Baek.

After placing their order, the couple noticed their hostess and another worker standing at the computer giggling and "gawking at them," according to the lawsuit.


When their hostess handed them their receipt, it had the word "Chinx" printed in the space reserved for the customer's name.

"Here we are in Fresh Meadows, and we have large populations of Asian Americans — Korean Americans, Chinese Americans, Indian Americans, you name it," said Baek. "It's happening right here in Fresh Meadows. I'm shocked."

Cha told the New York Times he was so distraught that he lost his appetite and, when he got home, threw the food away.

The unemployed information technology specialist emigrated from Korea in 2000 and lives in Philadelphia, according to the Times.

Nicole Conboy, director of human resources for the holding company that owns the Fresh Meadows restaurant and three Hooters on Long Island, said the 17-year-old hostess admitted to the act and immediately resigned, the Times reports.

The company's lawyer wrote in a letter to Baek, "It does not reflect the manner in which the restaurant is operated," and said the worker's conduct was "deplorable" and "egregious."

Earlier this year,  the Papa John's company had to apologize after a worker in a Manhattan restaurant printed "lady chinky eyes" on a receipt for an Asian-American customer. The worker was dismissed.

Guys it is flat out ugly. I admit, I laughed when I saw it because it so outragoeus that your eyes sort start out of your head. Frankly it would be funny if people meant these things in a kidding way and were looser about how we all deal with each other. But the fact of the matter is that this was an ugly incident and it was cruel thing to do to a customer whatever race. What if it had be a dorky awkward white guy who exemplifiies a geeky nerd...and the hostess put "Nerd" on the customer line. It would be a cruel and hurtful thing to read that on your ticket and it doubles the indignity when you realize this was a PAYING customer. The employee should have resigned or been fired and Hooters should apologize on behalf of the restaurant for the ugly behavior of the employee and give the guy a $500 or $1000 gift voucher. Suing is over the top but the guy is out of work, angry and this is America. Nasty little incident indeed.

Firing the employee and maybe a free meal seems sufficient to me. I don't see a need for a big gift voucher or a lawsuit.

To me, the lawsuit part makes me think he's just looking to cash-in on the situation.

The lawsuit was a threat most likely. His lawyer files the lawsuit hoping to get them to offer a settlement out of court quickly to make it all go away and doesn't embarrass the company. It's a bluff, really, a legal way to extort the company. A reasonable person can see that the case has no merit.

Many people treat Hooters as just a sports bar the "hooters" are just part of it.

    No company can constantly and completely control what their employees do during the time that they are at work. The issue policy on how their employees are expected to behave and then it is up to those employees to obey or be fired. If it is written in Hooter's policy that employees refer to Asian clients as Chinx, they this man has grounds to sue Hooters, if not, then he can only go after the employee who wrote it.

    Dismissed? What does that word mean? Why isn't the word "FIRED" used? As a half-Japanese/half American-Caucasian (of English descent), I grew up in a town of 98% white people (34,000 population).       I've been to Hooters once, in Atlantic City. The food was lousy. I would never go back. In my view anyone who goes to Hooters just to look at big boobs should save the gasoline and look in the mirror instead.

      The suit is ridiculous. It wasn't the company's fault. It was the individual server. How can any company know how their employees are going to react in certain circumstances. They can't. If the situation wasn't handled properly, that would an another issue entirely.

      The customers should accept a gift certificate and the apologies from the owner. That should be enough.

          Personally, I feel both parties are wrong here. First it doesn't matter who typed in the slur, that person was allowed to resign, meaning she can use the job there on her applications for a new job, and since she wasn't fired, the company that owns this Hooters can't tell a prospective employee anything bad about her, only that they wouldn't hire her back, IF that question is asked of them.

          As to the Korean couple, suing the holding company is a bit extreme since the person who did the act is now gone. If the boyfriend were not unemployed, most likely it wouldn't have gotten to this level.

          Instead, it is just another case to clog up NYC's already over-burdened courts until the company's insurance decides it is better to just settle and save on court fees.

          What's worse is some of the comments here stating that since she has a Black name she must also be a stripper (and worse). I knew racist trolls exist here, as evidenced by posts regarding our President who is half-Black, but most of them at least use code (still 100% racist mind you). Glad to know I live in a country full of people with less sense than a rock. As a fifth generation, WHITE US citizen, I am appalled and ashamed by my fellow citizens' behavior, words and actions.

            If someone printed "a**hole" on my receipt, I'd ask to speak to a manager, point out the offense, and refuse to pay for my meal. The manager most likely would trip overhimself, offer the next meal on the house and assure me that the employee would be dealt with swiftly and harshly. I would have gone home, updated my FB status telling the world about the event and ate my free wings and moved on with my life. I wouldn't sue the corporation or even the chain, because, regardless of how angry it made me in the moment, I would know on a fundemental level that this was not the result of a corporate policy to insult their customers. It would be clear as day that it was the ignarant action of a 17 year old who apparently has no manners. I would feel vindicated that I most likely cost her her job by complaining and hope that it teaches her a life lesson about how one needs to comport themselves in the real world. The fact that this individual feels this slight can only be made right by winning thousands of dollars in a lawsuit is laughable.

            Actually it is the fault of the Employer for not screening their employee's properly and making sure they have a policy educating their employee's in typical business practices, if you just assume an employee has proper customer service experience then when the Sh_t hits the fan like it did you will need to own up to the problem. Today in our society companies only learn when there is money lost or it just goes back to business as usual that is why there is a Suit filed. Companies today want cheap labor and to increase profits cut every corner they can will this is the sort of things that happens.

            Corporations can be held liable for the actions of their employees. It's pure BS that people can't go have a meal in a public place without racial slurs being made to them by the employees and further documented in a customer receipt. Money damages is also to deter future acts by others. A lawsuit has obviously given more attention and bad publicity to the restaurant than some ranting update to your FB account ever would.

              You really shouldn't have to teach an employee to respect a customer, it pretty much goes without saying.

Large lawsuits and damage awards should be reserved for repeated acts in a company culture by management.               Common Sense - It seems that anyone with common sense can see that the response of the injured party here is in this case disproportionate to the offense. What happened amounts to name calling. Yes, it was a poor decision on the part of the hostess. She was disciplines appropriately. One can screen as much as possible, but one cannot control for every variable in their workforce, particularly at the lower end of the employment ladder. It would be one thing to sue the company if it was a midlevel manager who used this language with a customer or even if it was the store manager, I could see maybe suing the individual franchise. But this was a 17 year old hostess who couldn't even wait tables because she's not old enough to serve beer. Hooters isn't exactly haught cuisine either, it's not fine dining where one expects the staff to be highly paid and highly trained. It's a job for young girls to make good tips because men like to ogle their goodies. If the restaurant hadn't responded appropriately to the complaint, by all means sue them as that demonstrates a willful cultivation of a culture in which that behavior is deemded appropriate. In this instance, the restaurant took the complaint seriously, investigated it, and the employee found in violation of their policy was terminated.

              The following is an excerpt from their employee handbook/acknowledgement:

              "I hereby acknowledge and affirm that I have read and understand the company's Non-Harrassment Policy, that Hooter's forbids harrassment of anykind, and that I agree to immediately notify company officials of any harrassment complaints which I might have or of any discrimination or harrassment by any employee that I become aware of."

              I always thought there was a "one bite of the apple" rule, where if an employee does something boneheaded the employer isn't liable if it happened for the first time.

                    1. My experience is that photos can be very deceptive. Some photos can make average look gorgeous. Hot In Miami's photo is clearly touched up.

                        The idea is to be able to identify them on sight. So putting there name in won't help you unless you know who "Bob" is when you bring the order out. Usually it's subtle, like the color of a shirt (red), tall (or short), long (for hair), that sort of thing. She was wrong to use "Chinx" because it's a slur and identifiable as one. Had she put "KOR" or "ASN" or something abbreviated like that so only she knew what it meant looking at it it wouldn't have been a big deal. But she was stupid and got caught being stupid and as a result lost her job. She may have "resigned" but I'm sure she was pressured to leave. Why this guy feels the need to now sue over what amounts to name calling when the employee acted alone, against company policy and was subsequently terminated is beyond me.

                                  Pine Barrens-There was a time in this country when being called a "mick" was absolutely a slur. However, my ancestors got over it and made a good life for themselves and I'm proud of my Irish heritage.

                                    As a Korean-American (who thinks most racial humor is funny), I feel bad for the guy. I would be pretty shocked if something like this happened to me.                                       Happened in Subway, guy came in, said sub gave him gas, his wife wouldn't have relations with him. He wanted his money back and they gave it to him. They said it was easier to refund him then to deal with him.

                                      This behavior was outrageous. Will probly settle out of court.

                                      I wish that in cases like this, the employee would have a judgement entered and listed on credit report.

                                          She wasn`t fired. She was allowed to resign. Big difference when she applies for her next job.

                                          I agree blaming the company for her actions is wrong. But that precedent has been set. Employers are ultimatley responsible for their emploees actions.

                                          Her name on the receipt and her admission are probably enough evidence for a jury. Mr. Chinx will get paid for this. But it will likely be an out of court settlement. Hooters execs. and attorneys would be fools to give the plaintiffs attorneys a chance to select a jury for this. Imagine how many women would love a chance to sit in judgement of Hooters !!

                                          I'm a double amputee and have been called so many names I can't count and it never bothers me, although I'm not some thin skinned whiner looking for free money either, but I guess some people feel guilty because they don't belong here.                                           To Konyak and all others dictating how people should feel when someone racially slurs them: YOU are free to do as you please and simply ignore it just as the Koreans are free to NOT not take your wonderful "thick skinned" advise to ignore it, so they sued. See how that works? At the end of the day, the way to not have to deal with anyone's offense at ethnic slurs is to, I donno, NOT MAKE THE ethnic slur in the first place. And to all the freedom of speech experts, you still have the freedom to make the slur -- but guess what? You don't get to dictate the response and you won't be able to predict the response. After being called a name, the insulted person has the freedom to do any of the following: laugh, walk away, ask for the manager, sue and my favorite, possibly kick the stew out of you.
