Convicted Ohio killer: I'm too obese to be executed

A condemned Ohio inmate who weighs 480 pounds and has a history of difficulty losing weight argues he would face a "torturous and lingering death" if executed in January.

Ronald Post, who shot and killed a hotel clerk in northern Ohio almost 30 years ago, said his weight, vein access, scar tissue, depression and other medical problems raise the likelihood his executioners would encounter severe problems. He's also so big that the execution gurney might not hold him, lawyers for Post said in federal court papers filed Friday.

"Indeed, given his unique physical and medical condition there is a substantial risk that any attempt to execute him will result in serious physical and psychological pain to him, as well as an execution involving a torturous and lingering death," the filing said.

Post, 53, is scheduled to die Jan. 16 for the 1983 shooting death of Helen Vantz in Elyria. The woman worked in a motel Post was robbing, and died after the man shot her twice in the back of the head.

According to The Cleveland Plain Dealer, Vantz's son, William, laughed when he first heard about the request, but immediately turned serious.

"I don't care if they have to wheel him in on a tractor-trailer; 30 years is too long," he said, according to The Plain Dealer. "Enough is enough. This is just an excuse to get out of the execution."

A spokeswoman for the prisons department had no comment on the pending litigation.

Post's attorneys also want more time to pursue arguments that claims of a full confession by the inmate to several people have been falsely exaggerated.

"Post's case is about more than his weight, and his life should be spared for reasons wholly unrelated to his obesity," his federal public defender, Joseph Wilhelm, said in a statement.

Inmates' weight has come up previously in death penalty cases in Ohio and elsewhere.

In 2008, federal courts rejected arguments by condemned double-killer Richard Cooey that he was too obese to die by injection. Cooey's attorneys had argued that prison food and limited opportunities to exercise contributed to a weight problem that would make it difficult for the execution team to find a viable vein for lethal injection.

Cooey, who was 5-foot-7 and weighed 267 pounds, was executed Oct. 14, 2008.


In 2007, it took Ohio executioners about two hours to insert IVs into the veins of condemned inmate Christopher Newton, who weighed about 265 pounds. A prison spokeswoman at the time said his size was an issue.

 

 

In 1994 in Washington state, a federal judge upheld the conviction of Mitchell Rupe, but agreed with Rupe's contention that at more than 400 pounds, he was too heavy to hang because of the risk of decapitation. Rupe argued that hanging would constitute cruel and unusual punishment.

After numerous court rulings and a third trial, Rupe was eventually sentenced to life in prison, where he died in 2006.

Ohio executes inmates with a single dose of pentobarbital, usually injected through the arms.

Medical personnel have had a hard time inserting IVs into Post's arms, according to the court filing. Four years ago, an Ohio State University medical center nurse needed three attempts to insert an IV into Post's left arm, the lawyers wrote.

Post has tried losing weight, but knee and back problems have made it difficult to exercise, according to his court filing.

Post's request for gastric bypass surgery has been denied, he's been encouraged not to walk because he's at risk for falling, and severe depression has contributed to his inability to limit how much he eats, his filing said.

According to The Plain Dealer, Post's attorneys said his weight has yo-yoed for years. At one point, the paper reported, the 6-foot-3 convict lost 150 pounds. While at the Mansfield Correctional Institution, Post "used that prison's exercise bike until it broke under his weight," according to the filing.

Post currently uses a wheelchair at the Franklin Medical Center in Columbus, The Plain Dealer reported.

In an open letter last year, William Vantz said that he’s still waiting for justice to be served for his mother.

“Some have said that since it’s been so long just let [Post] stay in prison for the remainder of his natural life. No!” William Vantz wrote for  the Morning Journal.

"I am as committed to this as the day he took her life. I will never forgive or forget what he took from us. We all have recourse to the law and it’s time he paid his debt to society. It’s way overdue!"

Post's case is unusual, as the man pleaded no contest to the murder charges, The Plain Dealer reported. That means he did not admit to having committed the crime, but chose instead not to challenge the facts presented by the prosecution.

Why is it the heartless bustards who kill,are always the most cowardly when it is time for them to pay the price of their crime? He had no problems 30 years ago putting 2 bullets in the back of the lady's head. However, the fatal injection does not have to go in his arm veins, they can either use his carotid artery or a massive injection straight into his heart - if the heartless SOB has one.

Agreeing with the comments above.....too fat to give lethal injection, fine, use the gas chamber, bullet(s) to the head, can't hang the SOB because there is a chance of decapitation (so what!!).

Here's where I have a problem with the court system. I'm not saying this man doesn't deserve to be executed for his crime but there are many that have committed worse offenses than killing a hotel clerk that have served their time and since been released. The courts and police have a higher priority of crimes against a business than crimes against individuals. A man can rob a person of $2000 and it's treated with kids gloves but rob a 7-Eleven of a hundred dollars and you're in deep trouble. Is it any wonder home invasions are on the rise?

Or he could eat a lethal dose, like they do in assisted suicides? You can even get it in liquid form, I know because I have done hospice work in a state with assisted suicide.

Why limit it, find a way and get 'er done.

He does not deserve special rights, He gave that up when he took someone else's away.

We can control what he eats, and caloric intake ... maybe for him that is punishment on the way ... ?

Serisously, there are so many ways to get the job done and we are letting one method of execution rule the day.

Hang him, with all that weight, his neck is sure to snap ... shoot him, that works on everyone or figure it out. He has been condemned, he has no rights in a sense ...

    Bruce, I couldn't agree more. The prison system has to answer for his weight problem. This guy didn't get to be 480 lbs. on his own. Someone had to supply him with a hell of a lot of food in order for him to weigh that much. Just to maintain that amount of weight one has to eat a ton. Nice way for them to spend our tax dollars, folks. This is absolutely ludicrous.

    Yeah, what's wrong with a good old fashioned firing squad. It's relatively quick and painless (having a dozen or so sharpshooters aiming at your heart), that's more humane than what he did to that poor woman. I always thought executions were TOO quick and painless. I mean you use executions as a deterrent against crime. Nobody wants to die, and certainly nobody wants to die a slow painful death, what could be a better deterrent than that?

    I can not believe how blood thirsty you all are. Yes, this is an evil man and he deserves no rights or privileges, but don't you understand that by killing him or anyone we reduce ourselves to being murderers? That makes us no better than the one you are trying to kill. Perhaps he deserves to die, but that is not a deterrent or a punishment, it is just revenge.     He says he is too depressed to control his eating on his own. He is inside his cell, so why are they bringing him so much food that he can weigh almost 500 pounds? If they only bring him even 2,500 calories worth of food a day he couldn't possibly maintain that much fat, no matter if he doesn't exercise at all. He can't eat what they don't bring him. It's not like he can call and get pizza or chinese delivered to his cell.

    I believe you're missing my point or are you saying a hotel clerk is more valuable than my wife and I. The court puts a high value on crime against a business as opposed to a person. They will give a man 25 years or less in prison for killing a bank teller at home but execute a man for killing the same bank teller on the job yet a murder is a murder.

    I fail to see the problem here other than it should never have taken 30yrs to end this POS. A bullet will do just fine and there will be no lingering suffering or anything. Yup we have ones that will go thru concrete walls so there will be no issue whatsoever about it going thru this fat turd. It is time we stop babying these killers. If there is 100% certainty then punishment should be handed out the day after the trial and does not need to involve any special equipment. Lead shot, one and done. Then we all try to move on and victims loved ones can try to start the healing process.

    I have a lot of trouble getting needles into my veins as well. Make sure this creeper has been very well hydrated before execution day, it'll help alot. Make sure they have a real good phlebotomist with lot's of experience in hitting the difficult veins. They are out there thank-god!!!! Worked woth folks with disabilites for 24 years and had to take folks for blood draws frequently. THe more experienced and patient they are the easier it is to get the needle in. Was in the hospital once. The first nurse attacked my arm over a 45 min period and couldn't get the IV in. FInally.....some one with experience came along and hit the vein on the 1st try!!!!

    This is NO excuse TO keep this guy alive. Build a special gurney to take his weight, make sure you get good medical personnell, get him on a damn diet, make sure he is hydrated before execution day. I'm sure the doctors can look at other cases and figure out the best dose to inject this sob with. IF they mess it up and it takes too long, it hurts etc.. I have absolutely NO sympathy!!!!!! He had no sympathy, no compassion.. forthe woman he murdered or her family and friends!!!! He doesn't deserve any in return. The taxpayers have supported his life for 30 years now. ENOUGH IS EHOUGH. tHERE IS NO DOUBT HE DID THIS CRIME!!!!

    For those of you wondering how he got so fat off prison food, I can sort of offer an answer. I worked in a prison here in Missouri and if Ohio is anything like Missouri, then I can see how he got that fat. When I worked there, we had a Canteen that the inmates could purchase food from. Everything from Ramen noodles, candy bars, chips, cheese sauce, little sausages, and loads of jerky products. They were allowed to spend $200 per canteen trip which was usually once a week. If they were confined to their cell, staff went and got whatever food they ordered. You may wonder "where did they get the money from?" You would be surprised on how many women and family members of these men send them every penny they have. I knew one inmate in my housing unit who had 3 different women sending him money every month. Then his family would also send money. It's really a joke!

    As far as the story, they should have killed his A$$ 30 years ago. And I really don't care how they do it, just get it done.

    I believe that anyone sentenced to death needs to be dead with in 1 year of the day he was sentenced. They can appeal during this time, but not longer than that year. It's a joke that they sit on death row for years and we have to pay for them.

    I really hope the family of this woman who he killed can find peace. It may sound weird, but I pray for his family also because it can't be easy knowing your brother/son/nephew is a heartless killer.

                    Hey...They give all inmates the same amount of food. It is his commisary privileges that need to be taken away. They can't prevent him from buying more food if he has the funds in his account unless there is a solid reason....I think that his health issues are a good enough reason to limit his food consumption. If he gets so depressed that he kills himself....well...seems like the very definition of win-win to me.

When I was in labor with my son, I was 5'3" and 140 pounds fully pregnant and it took the nurse at least three times to find my veins. The condemned are guaranteed a speedy trial and execution. It's a bout 29 years, 364 days past due. Bring in the firing squad. A 30-06 will kill far heavier things than this useless lump, 6 bullets will take him out just as efficiently.

                                Hey Nico!! Why would you need six bullets?? One good shot should do it. Don't waste ammo like that. It is getting expensive. They don't use the phase "execution style" for nothing. The mobsters had their poop in a group when it came to killing--unless it got personal, then it got messy. One shot. One kill. Back of the head just at the base of the neck....That is where all involuntary body functions are fueled--like breathing and heartbeat. Painless, as the spinal cord is imediately severed from the brain....with a 30 06 or better. His 30 years on death row is ridiculous and actually more cruel and unusual than getting er done. He has a date set for January. Make him keep it.....finally....and give this family some justice.

                                  What is far more concerning than Post's obesity is some 30 years passes before the execution date finally rolls around. And this is acceptable? Capital punishment must be implemented such that it serves as a deterrent, or it is ineffective. This 30-year fiasco accomplishes nothing aside from making a mess, decades too late.

                                  Ted, Thank you for putting my sentiment so well. 30years of incarcerationand now he scheduled to for execution? Something that should have happened at least 25 years ago?

                                  In order for any punishment to be a deterrent it must be swift.

                                  As usual. This execution is about 29 years, 364 days late. It should be conviction, three appeals in no more than a year., execution. In the case of DNA proof that indicates a certainty of exclusion greater than the population of the planet, appeals are deemed pointless, than move directly to conviction, execution. Use the money not spent feeding and housing these Neanderthals to feed the poor and on education.

                                  And with this swift execution, how do we correct a mistake. Oh new evidence came about 6 months after the execution. Sorry your dead, but at least your are innocent. Killing people is never a good answer.

                                  Gum Drop, killing predators is always the best answer. Ever wonder why the murder rate per capita had increased over the decades? Lack of swift, sure and severe punishment! If you are worried about innocents convicted then use it only where ther is no doubt of guilt. There are a lot of those. BTW, just because someone's case gets thrown out on appeal, doesn't mean they are innocent. They wait until witnesses are gone or memories dim or evidence is gone and get cases thrown out on a technicality. With noo way to retry them, they are let go. Supporting this animal and providing him medical care and legal defense for 30 years is outrageous! Convict them and if there is no doubt, take them to the freshly dug grave and put a bullet in the back of their head so the fall into the hole. Do this the next day. The victim would have loved to put off her execution date for 30 years!

                                    Study after study has shown that capital punishment is not an indirect deterrent to crime...You folks are just going to have to accept that, because it is true. It is also much more expensive because of the appeals processes. It IS however a DIRECT deterrent. One is certain that this person (the condemned) will never harm another human being. After the Huntsville Seven escaped from death row, it shows that there is always a possibility that these people will do more harm if they are allowed to live...and they do. They need to abbreviate the appeals process and put it on fast forward and get this done in timely manner. For the victims to wait for 30 years for justice to (maybe) be done is cruel and unusual punishment for the survivors....Take the direct deterrent argument....It has some teeth. Most criminals don't think that far ahead and, if they do, they don't think they will get caught, and if they do, they know that they will probably die before we kill them...of natural causes. This is an embarassment for our justice system. I believe in appeals, just get them done and move one with the punishment in a timely manner.

                                    I'll bet the dbag would have no problem insisting that someone stick an IV in his arm if it were part of some life saving surgery. This argumnet is so transparent and flimsy. If it takes a few hours to find a vein, then it takes a few hours. Keep tying rubber cords around his arm and get him to squeeze a rubber ball, until a vein appears.

                                    Why were they feeding this guy that much food to begin with? As far as his claims, they can mix the amount of drugs to what someone weights and even if it takes a minute or two longer to go through his fat viens, so much the better.

                                    IF any court and any judge is that stupid to buy this then every person on death row can just start eating because they then can not be executed.

                                    This bullsh*t of cruel punishment should NEVER have extended to death row.

                                    They are on death row because they are cruel and in human people who did very bad things to other humans.

                                    Steven...They feed all inmates the same amount of food unless there are religious differences or some serious health situation--like diabetes, for example. Still, in most cases, they require the inmate to order a veggie plate. They have commissary privileges and must have money in their account in order to get extra food. For health reasons, I don't see why the prison isn't taking care of his health better. His depression can be medicated with something other than food and it would be considered situationally induced and normal to most therapists. The family of the victim has waited far too long to be told that he has gorged himself for thirty years out of his death sentence. Would you want to deliver that news to the son who lost his mother to this jerk? I wouldn't.

                                      He is a perfect case for having a prisoner exchange system with another country of a more, let's say, dubious nature. We take 100 of our death row or "lifer" prisoners and send them to, hmm.., Thailand, Saudi Arabia or Equador. We take in exchange 100 of their hardened criminals. During a year of exchange incarceration, keep a tally of the live ones and post it on the wall in all American penitentiaries. After 1 year, if any are left, we send/ get them back and allow the prison populations an understanding, by example and compare/ contrast, how easy they have it in the US. In fact, send the exchange prisioners on prison tour and let them share the story.
