Soldier allegedly shoots friend while trying to cure victim's hiccups

A 22-year-old Fort Hood, Texas, soldier was shot in the face and died after what prosecutors say was an attempt by a fellow soldier to cure the victim’s hiccups.

Patrick Edward Myers, of Spartansburg, S.C., was charged with manslaughter in the case and remains in the Bell County Jail on $1 million bond, according to a news release from the Killeen, Texas, police.


Police say three men were inside a Killeen residence Sunday night watching  a football game and drinking when one of the men produced a handgun, handled it in an “unsafe manner,” and shot the victim in the face.

An arrest affidavit obtained by the Associated Press said Myers apparently pointed a gun at the victim’s head to scare him and stop the hiccups. Myers allegedly thought the gun had dummy rounds when it discharged.

The victim was being taken by ambulance to an airfield for transport to a hospital when he died.

After a review by the Bell County District Attorney, Myers was charged with manslaughter.

A Fort Hood spokesman on Tuesday declined to release the name of the victim, saying relatives had to be notified.

Another case of a completely stupid person, that doesn't have the slightest idea of gun safety. He thought he had dummy rounds? I guess he hadn't heard of Bruce Lee's son, and how blanks can kill you too.

Careful there. When it's put like that, people start saying 'That couldn't happen to me!' because, naturally, NONE of us are 'completely stupid'. You do not have to actually be stupid in order to do stupid things!

He may very well have had dummy rounds. The problem is, of course, that they were not what was in the magazine and/or in the chamber when he, for whatever the reason, pulled the trigger. He could have had a magazine full of 'snap caps', A-Zoom dummy cartridges, or whatever else he could get his hands on. That magazine full of dummy cartridges could have replaced a magazine loaded with live cartridges...which is really not all that important when there is a live cartridge in the chamber which has not been cleared. Anyone who would go so far as to point a gun at someone in jest and pull the trigger while not even at a place where you'd want to be to fire a gun (most folks really don't want squeeze a round or two off while at home, in their living room!) probably isn't real big on other basics of firearms handling, such as determining the status of the gun as soon as it's picked up.

Blanks are extremely dangerous. They're also much more rare than most people realize, especially for an automatic pistol which is now the prevalent handgun these days. Blanks (usually for revolvers, as they don't cycle a pistol) are smokey and extremely loud, which makes anyone who's ever fired one before think twice about discharging one indoors. They're quite unpleasant for everyone in the room, including the person with the gun! Unfortunately, dummies make no noise, all you get is the 'click' or 'snap' of the firing pin or hammer smacking down on the insert that takes the place of the primer. Their function is to check a repeating firearm for correct feeding and ejection of cartridges without the risks of 'jacking' live rounds through the action as well as to protect the gun during 'dry firing', which can be damaging to some firearms if done while the chamber is empty. If the guy had blanks, he might not have done this.

Not exactly.

Firstly, in any kind of accidental death, an autopsy is extremely likely to follow. The reason for this is to determine the precise cause of death. Sure, a kid may have been recovered from the pool. But did they drown, or were they strangled or beaten and then thrown in the pool to make it look like a drowning? If a crime was committed, the authorities want to know about it and forensic science is how they can sometimes do that.

IF it is determined that a child drowned, for instance, then yes, a lesser crime such as endangerment or neglect of some sort is much more likely to be charged than murder as the intent to kill the child was not there. Doing something that somehow placed or forced the child into the pool could open a person up to a manslaughter charge. Thinking you can teach a child to swim by throwing them in the water and then not reacting fast enough when they sink to the bottom might be such an example.

In this case, unless it can be demonstrated that the soldier with what sounds like a privately owned handgun was trying to and had been planning to kill his friend with that gun, he was just doing something that he definitely knew better than to be doing, sober or not. That kind of gross negligence would be a manslaughter charge or maybe even a second degree murder charge depending on how the local prosecutor feels about it.

Practically all the teenagers and young adults who do really stupid things in automobiles that get themselves and their friends killed at night and on the weekends have taken drivers' ed and then passed an examination to obtain a license to operate a motor vehicle. Having been trained, passing examinations and tests, and even being licensed or certified to do something is no guarantee that a person will actually follow their training...or any of the rules they've demonstrated that they know.

An astonishing number of people have been killed by 'unloaded' firearms through the years!

My arms are bare right now! It was a great day for late September in these parts and it actually started to get uncomfortably warm while I was doing carpentry work outdoors late this afternoon.

But I may be keeping them covered up in a couple more weeks as autumn sets in...

I have a set for each caliber, dummy rounds are normally called snap caps. Used to dry fire your firearm without damage. Big difference between dummy/snap caps and blanks.

Glad I quit drinking in '86. No good comes from alcohol use.

                                Would it be so hard for gun manufacturer's to attach instruction's for the correct way in which to point a gun at friendly people in a correct friendly manner?

                                Step 1: Be sure barrel is free of all foreign objects by visual inspection of barrel with either right or left eye.

                                Step 2: While visually inspecting barrel pull trigger in a slow steady manner until you hear a slight click or nothing at all. If you hear a slight click move on to step 3.

                                Step 3: If after steps 1 and 2 you are reading step 3, yep you are right, gun is empty.

                                NOTE: When testing for dummy round's: Follow step 1 but in step 2 do not pull trigger while visually inspecting barrel. Instead once visual inspection has determined (to the best of knowledge) no foreign object present. Please direct barrel to the center of forehead and proceed with step 2. This will insure you don't put your eye out should a dummy round be ejected from the barrel.

                                            That's his story and he's sticking to it. If you believe that, I have some Kansas beachfront property I can sell you for ONLY $500,000 per 1/4 acre. Yep, let's ban handguns and assault weapons. That way only the criminals will have them. If you think for a moment that criminals will turn in their weapons and all gather around and sing kumbya with the rest of us, you have to either be stupid or a lunatic.

                                              It's apparently 100% effective as a treatment, but it has some pretty bad side effects. This is one case where the cure is worse than the disease.

                                                Just to drop a different sort of note here....There is a very real, tried and true way of curing hiccups. I have been helping people with even severe hiccups for over 20 years with a 98% success rate. For real. It is also true that I never use either firearms (which I believe in our right to own) or alcohol as a part of the cure. I also dont ask anyone with hiccups to eat or drink anything, nor do I frighten them or embarrass them. I have also never ever charged for my help. I do try to teach each person I help how to help others. Anyways, carry on, folks.
