Student from prominent SMU family accused of campus sex assault

John David Mahaffey, 19, was arrested on charges he sexually assaulted another male student on the campus of Southern Methodist University.

A fourth-generation Southern Methodist University student accused of sexually assaulting another male student told the victim “you better not tell a soul” and later admitted the crime in a phone call recorded by police, according to a court document released Friday.

John David Mahaffey, 19, a sophomore finance major, has been suspended from the Sigma Phi Epsilon fraternity and banned from the University Park, Texas, campus while the investigation into the alleged assault continues.

The incident happened late Saturday night.

An affidavit of probable cause filed by an SMU police investigator provides graphic details.

Mahaffey forced the other student to perform a sexual act on him, the officer said.

“Victim stated ‘NO’ and ‘STOP’ several times but felt intimidated and physically forced into compliance,” the affidavit said.

The following day, the student went to police and agreed to make a recorded phone call to Mahaffey, police said.

“During the phone call, the victim told the defendant, ‘You know I didn’t want to do that?’ The defendant replied, ‘I know you didn’t, but we have to say it was consensual or lawyers, parents, and the school will be involved.’”

According to police, the alleged victim was attacked twice – once in a campus parking garage and again near the fraternity.
 
Mahaffey, of Springfield, Mo., is a Hunt scholar, a student senator, a scholarship committee chairman, and an officer on SMU's Inter-fraternity council, according to the university website.

According to an article last year in SMU's student newspaper, the Daily Campus, his great-great grandfather was a member of SMU's founding committee and one of its first professors and his grandmother, father and two aunts also were students.
 
SMU released a short statement, confirming the arrest, and saying Mahaffey is “temporarily banned from campus pending further investigation."
 
Debbie Denmon, a spokeswoman for the Dallas County District Attorney’s office, said Friday that the case probably will be referred to a grand jury in the next few weeks.
 
Mahaffey was released from the Dallas County jail on $25,000 bond. He did not return a phone call seeking comment.

          An young arrogant, rich bully with a highly inflated sense of entitlement. Sounds like he just killed his excellent chance to work at Bain Capital after graduation. In prison he just be learning a lot more about sex assault - as a bottom.

            Actually they like ambitious people there. There are people that simply wait, and there are "go-getters". Obviously this guy doesn't let opportunity go by. He tracks opportunity and stalks it like a lion stalking its prey.

                      Guilty until proven Innocent? My kids went to school with J D Mahaffey since elementary school. In our experience, he has always been a well-mannered, hard working, respectful young man from a caring family. The comments in this blog have been very hateful from people that don't know him. The judicial system should decide if he is guilty or innocent, not the press & general public. In America, it used to be "innocent until proven guilty." Not any more.

                      These acusations sound fishy. What man would unwillingly perform oral sex on another without some type of fight? J D is not a big, strong bully type person. What person would call their attacker the next day and say "you know, I really didn't want to do that"? And why the attacks against his "prominent family"? They are hard working people that go to work every day just like many of the rest of us.

                      The press should not be allowed to smear someone's image just based on allegations. It should only be on the outcome of the courts.

                          Knowing JD for 5 years, and seeing how this is completely uncharacteristic, I think the best thing to do here is just wait, there is definitely WAY more to this story. And just to clear up the mystery, Mr. Mahaffey is by no means homosexual.

                            I wondered if the accused is a good Republican god-fearing Christian soul who goes to church every Sunday and hates homosexuals. But it seems there is more to this story. Wonder if he and the victim were closet gays and had a lover's quarrel that got the victim to file a complaint to fix the lover boy. There is no way a rich boy like this can admit he is a homosexual to his Republican parents.

                                    Mahaffey singled out that particular young guy and became preoccupied with putting his penis into the guy's mouth. what was the intention? homosexual pleasure, social structuring, some indirect hidden message, or just an uncontrollable urge to blow a load of semen into any warm wet hole available? *** but then again we are not assured that it was an oral sexual act, the writer says only "...to perform a sexual act on him" which could be many things. Mahaffey may have forced the student to masturbate into mahaffey's ear, which could be defined as a sexual act. we just do not know. it sucks.
