Cell phone video shows cop striking woman after Philadelphia parade

Police chiefs are investigating an incident, captured on cell phone video, in which a woman was struck by an officer at the Festival de las Americas after the city's Puerto Rican Day Parade.

The video shows several police officers at Sunday's festival amid a crowd of people. The woman, identified as Aida Guzman of Chester, Pa., is shown being hit by one of the officers and falls to the ground.

"You only see one vantage point, but what you do see is disturbing, I have to be honest about that," said Deputy Police Commissioner Richard Ross.

The incident happened near 5th and Lehigh streets in North Philadelphia, after the parade on the parkway.  Parade organizers say they had nothing to do with the North Philadelphia event. Officials say Guzman was spraying silly string at officers involved in a traffic stop.

"The guy was out there spinning wheels and burning up tires in the middle of the highway, which is not normal. And we're out there to make sure that stopped. As we're doing it, things are being thrown, liquids are being tossed, substances being sprayed from a can," says Fraternal Order of Police President John McNesby.

Guzman was cited for disorderly conduct. Her face was bleeding as officers took her away. She told NBCPhiladelphia.com: "I feel angry, very angry. I go to someplace, got a good time and look this happen, for no reason."

Philadelphia police confirm the officer involved in the incident is Lt. Jonathan Josey. Josey has been with the department for more than 17 years and is a decorated supervisor with the Highway Patrol. He is now on administrative duty.

Internal Affairs is investigating the incident, according to police. The FOP says it will defend Josey "to the end." McNesby said people often throw things such as bleach and urine at officers, and urged people not to judge the incident based on the video alone.

Lt. Josey has made headlines before. He was exonerated in the shooting death of a Philadelphia man shortly after the man robbed a convenience store in Lower Merion in March 2010.

In July 2010, Lt. Josey was stabbed in the back while trying to break up a fight outside a West Philadelphia bar.

The executive director of Concilio, which organizes the parade every year, called on police to fully investigate the incident.

"While we have no knowledge of what led to the incident, it is clear from the video that a police officer unnecessarily and brutally struck a woman in the face," the statement read. "Even as we celebrate the tremendous advancements of Philadelphia’s Hispanic community over the decades, we cannot overlook this episode. We call on the Philadelphia Police Department to fully investigate and take appropriate action."

I like to see these cops smack down some real criminals and not go after someone like her. I don't think the cop would have had the bal.s to that if the other person was as big as he was, they will only go after the ones that they know they can slap around, how sad.

You have to understand what she did to deserve it to have the whole picture. She obviously didn't come up to the officer and offer him a hot cup of coffee and he turn around and sock her. She must have done something. Why else was she trying to run?

And you all are content to condemn the officer before the investigation is complete. What is wrong with waiting to see what the outcome? Who thinks it is OK to throw anything at an officer while he is trying to protect them from some idiot in a car?

Why can't a group of people enjoy a parade and festival without having some gang mentality of violence and stupidity rule the day.

Ms. Guzman had no right to even involve herself with an officer doing his job. Silly string or water or urine or bleech it really makes no difference because attempting to distract the police while they are doing their job could get them killed.

The women did nothing, someone else threw the water at the officer as the women was walking behind them. The officer turned around and thought she did it so he went and hit her. Not sure why this article does not show the whole video. Search online for the rest of the video and you'll see what happened before he went after her.

In the Video you can see some one throwing water from the back left of the woman, onto the cops..

The Super NON Water officer then attacks the closest person , this poor lady.

Pause the video and you see the water flying from behind of the left of the lady.. the rest is LOSER officer at work.

The police were doing their job. The idiot burning his tires in a crowed area could have caused a terrible accident and possibly killed people. She interferred with the police doing their lawful job. Whether she was throwing water or spraying silly string. You act like a @SS (probably a drunk @SS) the police are RIGHTFULLY EXPLAIN IT TO YOU! The problem with today's generation is that they do not respect authority. When this officer is engaged in stopping a situation where someone is spinning their tires he is focused on the task at hand knowing that his training to be prepared for any situtation to become potentially explosive or have others get involved that need to get the hell away from there. Then you have some inbred half-wit that has the audacity to spray silly string at the officer who is already in a High PRF mode with someone spinning the tires. The officer doesn't know what just got sprayed on him and by rights she should have been cited with assault on a police officer. Because she knew she did something wrong she tried to get away. The officer gave her a lawful order to stop and since she was trying to get away and he was within arms length, he arrested her.

Assault on an police officer is a crime.
Failure to obey a lawful order from a police officer is crime.
She is lucky that is all she got.

Did he need to strike her with that level of force? PERHAPS NOT.
Was she acting when she got hit like that? PERHAPS.
Was she an dumbass for spraying @!$%# on a cop? MOST DEFINITELY.
Does she enjoy a good beat down from someone with authority? APPARENTLY SO.

Police need to be taught that in today's society the likelihood of them getting videoed during the course of their duties is all but assured and that the video that captures their actions can and will be used against them.

Having said that, I will give the officer a reprimand with counseling on the above that videos can and will be used against you, but I will continue with citing her with the misdemeanor as well as assaulting the police officer. Had she never sprayed that on him, this video would have never gotten its 15 minutes of fame.

There are other(better) videos online that show clearly that she had nothing to do with throwing anything at the officers and it was someone else. The officer did NOT try to find out who was throwing the stuff and just assumed it was her and than slapped her on the face. The officer should be fired, period.

If you see police officers performing their duties such as stopping someone from causing harm to innocent bystanders by spinning thier tires, you give the police officers a wide berthing to allow them to conduct their operations without causing a distraction. Distracting a police officer can get them killed. Wrong place, wrong time. Stay the @!$%# back and you wouldn't have been within arm's length of that officer. Why did she try to run? I would say that if she didn't run she would not have been guilty. If she stayed put and THEN the officer struck her, that is an open and shut case- Officer is at fault. Because she tried to run when he tried to ascertain what just got sprayed on him-[BUZZER]- she loses.

There will be an investigation. After said investigation will be the determining factor. But even then, when nothing occurs, you will all still be up in arms. BOTTOMLINE: You see a cop and he is performing a stop, STAY THE @!$%# AWAY FROM THEM. Otherwise, you will become part of the challenge problem and be dealt with accordingly.

A cop doesn't know if it is silly string or water; a cop has to assume that it is acid, bleach, ammonia and a cop will defend himself from assault. Whatever hits a cop is assault.

IndyTX: all it takes is a lighter: you have an officer admitted to UPenn with significant deep-tissue burns. Silly string can be considered a weapon: the contents as well as the propellant are highly flammable. Have treated both civilians and safety personnel for napalm in a can injuries.

When you are a cop, you have the support of the community, you have powers that are given to you as a cop, e.g. people can get into trouble for disobeying you.

With this power comes responsibility, and that responsibility is to ENFORCE THE LAW, and not be there for your own personal, petty reasons. This also means that when someone insults you or tries to hit you, you don't take it personally. You can arrest them - not because they hit you - but because they hit someone. And most especially, YOU ARE NOT ALLOWED TO TAKE REVENGE.

I realize that these are cutesy politically correct ideas, and many of our Republican friends think that anyone who strikes a police officer needs to be strung up and then shipped back to Mexico, but the simple fact is that we are a nation of laws.

Our system works because everyone obeys the law, and most especially that means police officers. You cannot hit anyone. No matter how mad you are at them. Period. You are a professional.

This cop should go to prison for assault on an innocent woman. Even if she did throw water on this abusive cop he had NO right to physically assault her. He should be in prison, it's an easy call.

    watching the footage, you can see her attempting to antagonise the officers (she comes in from the left and by appearance of her movements clearly doing so) then sprays the officer, and immediatly walks away like "it wasnt me" in her walk, knowing she had done something that would have gotten her arrested.

    had this drunk crack head (who wouldnt have a shot in hell being a wife to me) been doing just as she was, she got her deserve by messing with the wrong people trying to maintain saftey, and order. the person with theis footage, just so happen to have just this part on their fone, or was their more? if this was the full segment for most part, it clearly is nothing more than a troll looking for a payout... even so, a troll looking for a payout. this woman needs to lay off the crack and booze, and spend more money on food, and would have to guess looking for a job other than harassing law enforcement.

      No fricken way was that ok to do he needs to be removed from the force. If that was my wife, daughter it would not have ended so pretty for him. If she did something wrong she needed to be arrested but his arrogant actions to smack her down he needs to be smacked down see how he likes it.       Hey If my wife daughter had this happen to them sure I would I would have placed myself between her and the cop . I would try to find out what happened but your damm right I am not just going to stand there with my thumb up my ARSS. Hey I would have gotten my butt kicked but they would be kicking mine not her's. Their is no way you can justify what that guy did to that lady.

      If you noticed in the Video the other cops did not I repeat did not just start smacking this lady around. The other police acted correctly and responded with control and professionalism.

      Quite honestly, if this was a video of a woman spraying police with silly string, I'd have little problem with this cop slugging her in the face. I'd probably giggle my arse off at her stupidity!

      That said, it's CLEAR from the video that it was the person BEHIND Ms. Guzman who threw the water on the police. This woman didn't do a damn thing to that cop. AND THERE IS NO SILLY STRING!

      When she wins a big cash settlement, I'll giggle my arse off at the Philly Police department's stupidity.

      After looking at the Video on Yahoo I can see at .39 a man wearing a dark coat shorts and shoes on the left hand side of the screen toss something clearly liquid.

      This placed the Lady between the person tossing the liquid and the police. The lady starts moving off after getting hit first then the Police feel it.

      The LT seen her first and moved quickly to her and smacked the wrong person.

      He is still in the wrong first for hitting someone like that then

      second hitting the wrong person.

      There are two discussions going on here.

      First, is whether it's okay for a cop to hit someone who physically provoked him/her, and

      Second is whether it's okay to mistakenly hit an innocent person you wrongfully assumed to be the person who physically provoked you.

      To the first, my answer is yes. To the second, my answer is no.

      In this case I do think this cop should be punished, but ONLY because he hit the wrong person, and most definitely NOT for his instinct to physically retaliate.

                  I watched the video, in it's entirety, on one of the Philadelphia news websites, and it looks like where the silly string, beer, whatever it was, did not come from her. If you watch the full video closely, the object is thrown from behind her from her left side. She has her arms down, which would indicate that she didn't throw or aim anything at a police officer. She was walking across the street when somebody behind her threw the silly string, beer, or whatever it was at the police officer, not her. For the police officer to come up to her, and hit her in the mouth with his fist was also dead wrong too. It's one thing to apprehend someone whom you think did something to you, but for a police officer to actually hit a woman with his fist is wrong as wrong can be.

                        It is not a matter of what she did. The protocol is clear. OFFICERS CANNOT USE EXCESSIVE FORCE. PERIOD. She was trying to back away from him when he struck her. Even if she did assault the officer previously (which is in question) he cannot hit her if she is not advancing on him and is not a clear and immediate threat. He messed up.

                        He gives all good officers a bad name. Bad cop, no doughnut. GO DIRECTLY TO JAIL. Do not pass go, do not collect your wages. Fire him. Since he is a higher ranking officer, find out if he has taught his subordinates "misbehavior" tactics and retrain them. They could be a liability as well.

                        It is time for due diligence and risk management. Stop letting bad cops run wild. Police your own.

                        When someone assaults a cop then they can be subdued "by any force necessary" to protect life and limb. She sprayed something at them, therefore she was subdued. I would agree with you 100% if she had not done something that could be considered assault herself prior to the slap in the face, and she was not backing away either, she was running the other direction trying to get away after doing whatever she did.

                        When cops are in an environment like that they have to act quickly before things get out of hand. If you've ever seen a crowd get out of control you would know why.                         We don't know the whole story, as so often is the case. This officer is working! He is on the job during a public event...an already heightened state. Officers don't know what will happen during such public displays but, they do know that there is NOTHING THAT CANT HAPPEN.

                        I have a very difficult time believing that of the 9 officers I can count in the picture, all of them are just going to stand by and watch this veteran officer unnecessarily beat a woman. However, I can believe that officers are going to stand by and make sure that a fellow officer is not in danger. I can believe that the woman probably was spraying an (at the time) unknown substance on officers and refused to follow directions that were given to her that would protect her and the officers.

                        I will reserve judgement until all the information is available. I thank our LEOs for their dedication to a thankless job where their life is on the line every single moment of every day. A job that even their family can be targeted. A job where they don't make enough money for the incredible type of work they do. God bless them and their families!

                        Why is it that when people are trying to make a case for this abusive cop, they use terms like "sprayed substances" at the officer, or "threw an unknown substance" or some such bull@!$%#?

                        If the officer can not recognize silly string for what it is - a party favor intended for laughs and good times - then that officer should not be in a position of authority over a parade. Most likely the lady was a little tipsy and having a grand old time, spraying everyone around her. I have done much the same at parties all over the world. I sure as hell wouldn't expect to get hit and hauled off to jail for it, no matter the circumstances.

I suspect they have the "rest of the story" recorded and either they or the news services aren't sharing it with the public.

                            Picture a possible scenario (not in any way saying this happened, just something that would change the whole tune of things) - party-goer starts spraying some unknown stuff on a couple of policement executing their duty in dealing with a dangerous traffic situation. Cop tells party-goer to stop. Party-goer thinks it's fun and continues. Cop gets to a point he can arrest the party-goer for interfering with a police officer and possibly even assault ... party-goer tries to leave and gets stopped. I'm not sure even this scenario justifies the punch, but there's so much missing from the video you just cannot know at this point. What I do know, is that what was shown is just enough to incite riots - thanks again to wonderful, complete?? reporting.

                            You are kidding, right? Do you see this woman as a physical threat to the police officers? Do you see a weapon in her hands? Did she kick one of them? The fool throwing water is a man. The cop has his back to this woman, so he cannot possibly see who threw water or sprayed "silly string". (Wow, both of those things are SO dangerous.) Simply because she tried to walk away when the enraged coward turned around does not mean she did anything. His assault on the woman is not justified regardless of what he thought she did. The fake charges will be dropped because there isn't a single shred of evidence against her. The cop didn't see what happened, either. she will collect a large sum of money form the taxpayers because this coward lost his temper and slapped this small woman to the ground while her back was turned...

                            There are additional videos available on the source's website NBC 10. The video is grainy and terribly shot, but it looks like she has something(s) in her hands and she walks up to the group of police officers and appears to do something because she stops suddenly, then turns around and leaves very quickly. The officer yells at her and she turns her head back but doesn't stop. If she actually touched them in any way with anything, that is assault of a police officer and most suspects get decked when they commit assault. That is especially true of cities with high rates of citizens committing police assaults (like Philadelphia). It doesn't matter if it's man or woman or if they have their back turned after they commit the assault.

                            The best thing to do is gather more information before coming to a rash conclusion. The video that appears here is heavily edited and is missing a lot of footage that the other video shows. Even watching the second video, it's just too difficult to come to a conclusion as to what she did to them. The officer does have an excellent record of service on the force and no prior issues with abusive power.

                            Holy sh!t there Doc...silly string and water, that's pretty life threatening. I 'm surprised he didn't use deadly force...then hunt her kids down and do them too.

                            The thing is the cops don't know what it is, liquid acid looks like water, and if you let one person get away with interfering /w an arrest it turns into a mob and before you know it everyone starts throwing bottles and other objects and you end up with a friggin riot. Especially with alcohol being involved, and this guy in the car they are stopping could be carrying a gun or knife, and this cop has to put up with this dumb ass standing behind him spraying stuff on him, should never stand BEHIND an officer anyway when he is trying to detain someone, the guy was already stabbed in the back once. And she said she was there having a good time,. to me assaulting a police officer and basically being an azzhole isn't my version of a good time. Lets say she sprayed that stuff, distracts the cop, then while cop is distracted the guy in the car they pull over gets out with an automatic weapon and starts shooting the crowd first thing ppl would be criticizing is why this officer didn't take a more aggressive stance with this lady Also you could see he was telling her to stop, she starts running, what do you think is gonna happen?? What makes her think she is so special she doesn't have to stop when a cop asks her to?                             Hey Cranky, 20 complaints and 0 so far have been found to be actual abuses. In a city with plenty of scumbag neighborhoods, it isn't uncommon to see this. Anyone looking for a quick payout will always file claims of abuses, then lawyer up and try to strong arm payouts from the districts. There's actually lawyers around here that advertise no upfront costs and their "expertise" in handling police brutality cases. I wonder why there are so many claims against the officers that work in the worst areas of the city?

                            I've lived and worked in some of the worst of the Philly area almost my entire life and see what these officers go through every single day they work. People yelling and screaming about how much they are being abused as the officers struggle to place cuffs on this individual resisting arrest only to see it in the news or news papers two days later this low life career criminal filed an abuse claim against that officer. It goes into the officer's record regardless of whether or not the claim is true and wastes tons of resources to find the answers.

                            I'm a F**k the Police guy as much as many of us here, but these men and women in the city have to deal with a lot of bad stuff and overwhelmingly, they actually do a pretty decent job.

                                Looks like he was trying to grab the can in her left hand, caught her head instead. Perhaps not pressing charges for interfering with them during the stop and not checking her immigration status is enough "compensation".

                                The lesson, DON'T GET IN THE WAY DURING A TRAFFIC STOP, all you're doing it putting yourself and others at risk.

                                If she hadn't acted like a complete dumb-ass, nothing would've happened. She created the chain of events that lead to her having a scraped elbow. Poor baby. Here's a band-aid. You'll get over it.

                                        Silly string is Napalm in a can. I witnessed and susequently treated 2 civilians and a police officer for serious burns during a mardi gras/carnivale event. All it took was a lit cigarette of a nearby reveler to ignite both the liquid and the propellant. Bear to extinguish, even harder to treat. Burned through officer's duty jacket.

                                        Some police jurisdictions consider any aerosol to be a potential weapon. Why do you think every avation security force worldwide treats all aersol as a banned substance?

                                          Police officers put their lives on the line every day. This woman provoked and continued to provoke until she got what she deserved. I guess you think that the officer should just lie down and take it until she pulls out an assault rifle or something. He only subdued her and he was right in doing so. Maybe she will have a little more respect for an officer in the future.

                                          Sheila and Dimples don't think that's a punch..I guess they must be female boxers. Looks to me like a big dude with a long reach catching a much smaller woman in the face with a right hook as she walks away from him, turning her face a bit over her shoulder to look back. She got hit hard enough to make her mouth bleed and make her fall on the ground, which is a pretty firm hit (for those of you who haven't been punched in the face recently). If he was ready to punch her anyway (which looks likely from the speed of his response), she's damn lucky she was turned away and moving. If she had been standing there facing him, that punch would have been a lot more damaging. That's nasty enough to suit me.

                                          Yep, that's Filthadelphia. Hope I don't have to drive through any time soon. If I get pulled over for a traffic stop, I'll be expecting the left hook from the window as I turn to get the insurance card out of the glovebox.

                                            Puerto Ricans are still 100% American Citizens. Except for a few minor exceptions (such as not being able to vote for POTUS) they have the same rights as any other American Citizen. In fact, this November, Puerto Rico is having an election to determine if they will become a state, become independent, or stay an unincorporated US territory

                                            Now with that said, I am still curious about what may have happened just prior to this incident. it's hard to tell if she did or did not throw anything as the video starts at an odd place. There are several others also recording on their phone which would be of curiosity to see.

                                              So let's start with you.

                                              An IQ test, shows only what an individual is capable of, not what they actually do or don't do with their brain. I knew a Korean dishwasher at our local rural Alaskan cafe. This guy was off the charts math genius with an 160 IQ. He was happier living a simple life with a family...he didn't need the other life of intellectual fame like so many. To me, he was kind and funny and very simple. To the locals, he showed his brilliance not by flash, but by goodness and a humble spirit.

                                              So much for the IQ theory....

                                                    No I am not saying that. Imagine you are a cop with a hateful crowd throwing unknown substances at you and you see someone with an spray can, you try to remove it from her hand to stop further assault upon yourself and coworkers. She was trying to doge his grab and moved right into his hand. I remember a time not that long ago when we were all applauding the police and fire fighters, remember that? it was post 9/11, I miss those days when people had respect for those putting their lives on the line for us.

                                                    Cheering a job well done is one thing Joe, but allowing one to punch me in the face for any reason is another. You need to zoom in your broad view a little. This woman was easy to detain without undue violence. He is twice her size, and there were multiple cops there. He had no need to hit her in the face. It was all due to anger on his part, and he needs to be scrutinized.

                                                        I would like to see the video from the beginning. Obviously it was started just after the event that sparked his reaction.

                                                        Was much of a smack....caught her by surprise.

                                                        Cannot wait to see the beginning of the video....I wonder is this is another editing by MSNBC (as usual) to get viewers upset and pretend they are unbiased and on your side.

                                                          you don't need a different video to see what happened. this one shows a guy beside her in all black throw water then the officer responds to the closest person to him which was the woman.

                                                          The woman just happens to shoot silly string at the LT. while the man next to her throws water on him. Do you know what happens to silly string when hit with water? The police should arrest her as a criminal and a little poke should help her gain a little respect for authority!

                                                            The woman had no weapon on her and I honestly didn't see anything that looked like she was a threat at all. Smacking her in the face was uncalled for and the officer needs to be fired. Not even sure about the claims that she threw water at them or whatever but I've seen 2 versions of this incident via youtube and I did not see anything in her hand. Shame on the officer for striking and unarmed woman.

                                                            Why is everybody getting so worked up? You know how this will end, He is a Cop, What he did will be justified and he will be cleared. Happens all the time. Move on people nothing to see or be done here.

                                                            With out a rush to judgement it appears that the LT. went over the line in his actions. A thorough investigation is warranted to establish all the facts to determine if the punishment dished out fit the crime. Cops are notorious for using resisting arrest with out violence to make an arrest legal under the law. I say after all the I's have been dotted and T's crossed the officer will be charged with a crime and Ms. Guzman will file a civil suit against the deepest pocket. In this case the city. The police are the oldest gangs in the country. What a scum bag.

                                                            Philly cops are the worst - I know, I live here. Hell, they even said it on an episode of Barney Miller back in the 70's.

                                                            I can only imagine the outrage if the cop had been white & the woman black. The Osamabama would surely be commenting for his campaign.
