Subscribe to RSSDays after California’s governor vetoed a bill that would have let local authorities ignore federal requests to hold undocumented immigrants for possible deportation, the Los Angeles police chief has decided he won’t comply with the requests in low-level cases.
Police Chief Charlie Beck said Thursday that he had to craft a program that would serve his community.
"It strikes me as somebody who runs a police department that is 45 percent Hispanic and polices a city that is at least that, that we need to build trust in these communities and we need to build cooperation or we won't be prepared," the Los Angeles Times quoted Beck as saying.
Out of 105,000 annual arrests, the Los Angeles police get about 3,400 requests, known as detainers or holds, from Immigration and Customs Enforcement, The Los Angeles Daily News reported. The holds are part of the Secure Communities program, in which the FBI shares fingerprints of those arrested with federal immigration authorities, who determine if the persons are legally in the U.S. or if they can be deported due to a criminal conviction.

Immigration advocates say the holds cast a wide dragnet that has ensnared even those who had committed minor crimes or no offenses at all. But ICE has said the program was instrumental in helping enforce immigration laws and in getting violent offenders off the streets.

“The LAPD is proposing to no longer grant an ICE detainer request without first reviewing the seriousness of the offense for which the person is being held as well as their prior arrest history and gang involvement,” according to an LAPD statement.
The department was developing a list of criminal offenses, such as public nuisance and low-grade misdemeanors, that in its view don’t meet the program's intended purpose.
Under the LAPD’s new proposal, those arrested for low-grade misdemeanors won’t be held for ICE unless the person had a prior felony arrest or was a documented gang member. The person also won't be held without additional information from ICE. The police will still honor detention requests on felony and high-grade misdemeanor arrests.
About 400 ICE requests annually could be ignored under the new policy, Beck said, adding that City Attorney Carmen Trutanich had informed him that police could legally refuse to honor ICE detainer requests, according to local media reports.

Beck said he believes in some cases, the detentions have unnecessarily split up families, Reuters reported.
"Community trust is extremely important," he said. "It's my intent that we gain that trust back."

Late Sunday, Gov. Jerry Brown vetoed the Trust Act, controversial legislation similar to what Beck has opted to do. Beck said his new rules, which he hopes to implement by Jan. 1, were in the works before the governor’s veto, the Daily News reported.
In his veto message, Brown said he could not sign the bill because under it, “local officers would be prohibited from complying with an immigration detainer unless the person arrested was charged with, or has been previously convicted of, a serious or violent felony.
“Unfortunately, the list of offenses codified in the bill is fatally flawed because it omits many serious crimes,” he said, adding that he would work with lawmakers to improve the legislation.
Several counties and cities have enacted ordinances that limit police cooperation with federal immigration authorities, The New York Times has reported.

ICE says it prioritizes the deportation of those who present the most significant threats to public safety, and that it has deported more than 147,400 convicted criminal undocumented immigrants, including more than 54,200 individuals convicted of violent offenses such as murder, rape and the sexual abuse of children, under the program.
“Over the past three and half years, ICE has been dedicated to implementing smart, effective reforms to the immigration system that allow it to focus its resources on criminals, recent border crossers and repeat immigration law violators,” ICE Deputy Press Secretary Gillian Christensen said Friday in a statement to NBC News. “The federal government alone sets these priorities and places detainers on individuals arrested on criminal charges to ensure that dangerous criminal aliens and other priority individuals are not released from prisons and jails into our communities.”

Shame on you, Beck! You've betrayed your country. This is the job of ICE to decided who will be deported, not your LAPD.
I am appalled to hear that our own law enforcement will not "enforce" the laws of these United States. I agree that the LAPD Chief should be fired and tried for treason. Reporters, please stop referring to illegal aliens as undocumented immigrants. If you review the legal terms you will find that illegal alien is the proper nomenclature. Using the word "immigrant" when referring to illegal aliens is a slap in the face to all of those folks who came to this country legally and can rightfully be called an immigrant.
Great! I hope if I ever get arrested for a crime that I will have a sympathetic police dept. who will just give me a pass and turn me loose. Stop Federal Funds to L.A. and all cities who ignore the law.

Why doesn't this jerk just do what he is paid to do.Arrest and jail all people who his officers see breaking the law or who has been determined from facts to have broken the law.There should be no arbitrary enforcement of laws based on personal preferencec.I think I should never get another ticket and if I do and refuse to pay the fine,if caught,I should be allowed to go free.Try that exception first,at least,,it will effect someone living here legally and how pay taxes that pay your bloated salary!

How would they know if the person arrested wasn't a murderer running wild amoung the populace! Hell recind all the gun control laws and let everyone own a gun.Then fire about half the police and require the remaining officers to never write another ticket or stop a car driving irratically.Next,cut loose all criminals and every man for himself.The remaining police can be used to clean up the dead bodies.

Police Chief Beck, if he embarks on this policy, is himself breaking federal law and is liable for prosecution. If he doesn't obey the law, the next time that I'm in Los Angeles I will personally put you under citizen's arrest and turn you over to the federal authorities.

Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):
A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:
* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
* knowingly assists illegal aliens due to personal convictions.
Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime. Anyone employing or contracting with an illegal alien without verifying his or her work authorization status is guilty of a misdemeanor. Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

Charlie needs to be relieved of duty. Charlie Beck is the senior law enforcement, lets repeat that LAW ENFORCEMENT, officer in Los Angeles. If he refuses to the job for which he was hired it is time to get rid of him. I swear this Country has gone insane. Since when do you allow people that have broken our laws and crossed our borders to be granted more power than the citizens??? There is not another Country in the world that would allow this. Why do these officials even bother to take an oath to uphold our Constitution and it's laws? Not a one of them honors their oath! But I also have to wonder when the citizens of this Country are going to say ENOUGH and put a stop to this madness.

Being here illegally, having no job, unable to house, unable to feed and sick isn't good enough to get you deported! Stealing won't get you deported! Assault won't get you deported! Drugs won't get you deported! How much money does California have? Is it really able to take care of millions of illegals without costing Californians a dime?
Not enough money and it isn't cheap. You might ask why the State is in such deep financial straits. This type of nonsense is part of the answer.
I'm pretty sure Beck would be breaking Federal law if he actually did what he's grandstanding about, and, since the governor vetoed the bill in question, he won't even have the protection of the state, for what it's worth, if he's does so. Refusing to hand over a fugitive illegal alien in his custody for deportation could be construed as aiding or abetting an illegal, which is a felony (INA 274A(a)(1)(A)), that could net him 5 years in prison.
Either Chief Beck is just grandstanding for the press or he's an idiot. Another reason to avoid LA, in any event...
Simple. Fire him. A police chief who won't enforce the law is worthless.
Police Chief Charlie Beck should be fired for failure to uphold the laws of the country. Is the very thing you are hired to do. You are not hired to pick and choose which laws you are going to uphold or to be an accountant for the city.
What he's doing may be a Federal felony - aiding and abetting an illegal alien. He could and should go to jail.
