Subscribe to RSSPolice have discovered what they believe to be the remains of Justin Kowalczik, a missing 17-month-old boy in Farmingdale, Long Island.
According to investigators, Kowalczik's remains were found buried in the backyard of the home Justin's mother, Heather Kowalczik, rented with her boyfriend and their two other children.
The search for Justin was ignited Wednesday after police say someone called Child Protective Services out of concern for the health and welfare of Justin's 6-year-old sibling.
Police said when officials inquired into Justin's whereabouts, his mother first said he was with relatives, but then revealed he died in 2010. It was unclear how he died and why he was buried in the family's backyard.
Kowalczik and her boyfriend, Robert Rodriguez, have been questioned by police but have not been charged. An investigation is ongoing.
"It is absolutely a suspicious death and it is being investigated as such," said State Police Maj. Patrick Regan. "We don't have a cause of death, and to our knowledge, there was never a report made of the child being missing."

On Friday, an Amber Alert was issued when Rodriguez abducted his 9-year-old son, after allegedly learning of the investigation.
The Amber Alert was canceled a short while later when the two were found by police.
A medical examiner is performing an autopsy on Justin, who would have been 3 years old.
Police say Kowalczik and Rodriguez are no longer cooperating with authorities. Their two surviving children were in the custody of county child welfare agents, police said.
Neighbor Tekiera McCormack told Newsday that she was stunned.
"I can't see this," she told the newspaper. "This is crazy. She was a good mother. Those kids loved her."

It's time for everyone to become anti-choice. No woman should have the right to choose whether or not to have a child until she can prove that she's got what it takes to have one. The same for men. Children are not major household appliances. Either people rearrange their lives to do all they need to do to care for their children, or else they're not allowed to have them.
Again: no right to choose whether or not to bear a child. Be able to have one, or not be allowed to have one.
Too bad we can't do reversible vasectomies on baby boys as well as circumcisions. Then when they are 'mature' and can prove financial, mental and emotional stability, they can apply to have their fertility restored.

She could have been a good mother. She also could have been a bad mother or maybe he killed the kid and she was scared of him or maybe she is one of those crazy women who no matter how abusive a man is she says "I Love Him" or she was financially dependent on him. Either way a child is dead and I just can't understand it. Didn't this child have any Aunts or Uncles or Grandparents wondering where he was for 2 years?

Ms. Deb I agree with you , all, children love there parents unconditionally its the natural way of things. However, it does not make the women innocent of any crime that may have been committed by her or the boyfriend. . Just wondering like many others as well ,what of other family members? didn't they notice a missing baby? Sad news really sad .
I will never understand why the people who call themselves pro-life do not get upset at this type of thing, It happens all over, neglect abuse, comes in all shapes and sizes. Why not put energy into helping the born? Why force a woman to have a child when we have the technology to stop the process safely three months and under? It is so cruel, to the mom but mostly to the unwanted child. To have a child should be one of the biggest most thought out decisions a woman can make.

The boyfriend was the "natural father" of both the older children--just not the father of the dead toddler. The woman is the mother of all three children, but the boyfriend is only the father of the two alive children--not the dead one. Now what makes you think the man is the innocent one in this situation? A good reason to abduct the nine year old is that he was seven two years ago when his little brother disappeared. Old enough to remember and tell what he knows.

I agree. We should move to the point where no one, woman or man, should be allowed the "right to choose whether or not bear a child" until they can prove they can care for that child. Children don't asked to be born. They're not major household appliances designed to satisfty the need, wants and desires of parents. Men and women should have to fully prove they are willing to love, raise and support a child or else they don't get to conceive one. This pro-choice nonsense has got to end. Either be able to provide a child with everything he/she has the right to have, or else don't create one. If one can't do it, then one can't have one. Too bad if it makes the woman or man feel bad. If one cannot provide all a child needs, then forced contraception is the answer. If a conception results, then forced abortion is the answer (or forced adoption). When one can provide proof of bearing and raising a child, then fertility is allowed. If not, it is disallowed. No choice.

Both parents hold responsibility for this child's death and burial. I am not going to use the word murder yet but if one parent buried the child the other parent knew there was a missing child. They had three years to come clean about the death and if it was a natural death why did they feel the need to secretly bury the child? It is probably due to the fact that the child was sick and neglected or the child was accidentally killed. I cannot see the child being intentionally murdered but there may be some child abuse gone too far. There are endless possibilities in this case I just hope the autopsy gives some conclusive results.

Skipastar - conservative right to life, begins at conception and ends a birth; you must have that baby regardless of the circumstances, but don't ask me for any help once it is born!
Liberal College Girl - people are locked up every day for suspicion of committing a crime and held with or without bail depending on the crime; yes they still get their day in court, but just because a person hasn't been convicted does not necessarily mean they don't get or deserve to be locked up.
Under the circumstance out lined in the story, the death is more than suspect and the mother almost surely knows something about it, but yes the case in not closed.
The facts are irrelevent at this point. There does not need to be an investigation. She buried her toddler in the back yard. Life in prison or death.

6) Are any immediate family currently serving prison time for rape or homicide?

I agree in part. Upto the vasectomies. I agree as long as you can agree with tubes being tied also is another solution. For both men & women; getting knocked up/knocking up a woman "as the case may be" time after time then getting an abortion time after time in the name of "I have a right to have a little fun!" is not only irresponsible, but in my opinion is criminal!!! Take responsibility for your own actions!!! And Grow Up!!!!!!!!
The heck with free tube ties and vasectomies - I'd be more than willing to PAY THEM a few hundred bucks to get "fixed". Talk about a cheap solution to a chronic problem. But some guy, Chicago I think, was offering a few hundred bucks to women to get "fixed", and groups came down on him for a social engineering issue - but the heck with the poor kids that get born into these miserable family situations. Sad.
Jerry, you have a good point. Having children should be a privilege, not a right...just like driving a car. But for this to be enforced, contraception would have to be provided without cost. [no on pays to NOT have the privilege to drive] However, your harping against "Pro-choice" is misdirected. Pro-choice allows for abortions. Pro-Life forces the "privilege" of having a child on everyone regardless of circumstance. [maturity, finances etc.]

A little confusing. Article begins with "a home she rents with her boyfriend and their other two children", child services called about 6 year old? Boyfriend ID'd as Rodriquez he abducts his 9 year old??? How do you do that when he lives with you. What happened tot he 6 year old isn't Rodriquez father of that one too? It just doesn't make sense.
I bet that boyfriend is responsible for killing that child and I bet he told her if she ever tell anybody he kills her and the other kids too. No mother would kill her baby unless she is a monster!!!
Of course they love their mother--they don't know any different. They think this is how every kid is treated. They think it is normal.
The saddest thing I ever saw was a show near Christmas, about small children that had been beaten and tortured by their mothers. They showed pictures of a little boy who had been beaten, cut and burned until you had to look hard to be able to tell it was a human being. His ears were nearly burned off and his whole body one big bruise. I forget how many bones were broken, but most of them. He had many poorly healed broken bones from past abuse.
They showed him after months of hospitilization and he was horribly disfigured. They talked to him on camera and asked if he could have anything he wanted for Christmas, what would it be? His answer? "My mommy." He was still crying for the woman who inflicted all that torture on him for his whole life.
This was many years ago, but I remember it every time I read about a "parent" abusing or killing their child. I cry my eyes out at the memory of how that poor little boy looked when he was brought to the hospital and even after months of hospitalization.

I can relate to that big time. I was working nights and filling in the ER for a shift, they were short. I usually worked ICU. Had a heroin addict come in with her kid. She had a Massive case of cellulits and the kid was dirty, hungry, diaper hadn't been changed in so long, it was hanging off of him. He had to been about 18-24 months. We fed him gave him a bath and what not. There was massive brusing all over his body. The kid was put in Child protected services. They sent an officer to pick up the kid. And the last thing I remember is this baby as he is being carried off crying for his mother. That was so heart wrenching you would not believe. It is so fresh in my mind and it happened about 20 yrs ago. I will never forget that for as long as I live.

What in the hell is wrong with people these days? Why do we as a society put up with adults who do this to children? If an adult is cold blooded enough to harm a child, we should dispatch them, so they can't do harm to another child. Why do the authorities fail to find answers to a childs plight? I am so sorry for you little baby. At least you won't suffer from the treatment these creatures would have surely given you had you lived.
Barb, I agree! An innocent, helpless little tot completely dependent on their parent for everything and the parent does something like this? I hope they come out with updates on this story; especially after the autopsy report is completed. My heart aches for the little one, the two adults should get their trial by their peers, yes, but they should also get whatever the toughest sentencing is that NY has to offer for murder.

There is only one valid reason to bury a child like that. If they took it anywhere for care it would be discovered that one of them killed the child.
Given the story I would bet she was drawing state money for the children's care which is why they weren't married. He bolted with his son because either he is guilty or he's illegal or both. I'll leave out the "other cultures" narative.

Wow. To think he gave up brain surgery for police work is astounding.
He was likely asked "is this considered a suspicious death" or some other stupid question by a reporter. Making a dig at a cop investigating a child's death is kind of low.
Well, it is a reasonable statement on one level. If a child dies and the parents are afraid to say he did for various reasons it is possible that it was an accident and they buried him. That could mean that no one killed him, but burying him that way wasn't okay.
17 months is not too old for crib death (SIDS). I suppose it's possible for the baby to have died of SIDS, and they may have a questionable life style, possible police history, etc., that would make it very easy for the police to suspect the parents. Parents get scared, thinking they'll be accused of murder, and bury the baby themselves.
As far as no family missing the baby, if the aforementioned life style really is so, it wouldn't be a far stretch for the family to be estranged.

17 months is too old for SIDS. The highest chance of SIDS is between 0 and 4 months. It sounds to me like a very suspicious death, an accidental murder at the hands of one of the adults in the house. A loving parent reports their child missing, injured, or not alive. This woman and Casey Anthony are cut from the same cloth.
I think we need iron clad laws for abuse and murder of children and adults. YOU will be punished and it will be long and not in a facility with computers, exercise rooms, tvs, or any luxuries. The food will be very basic and you will work while there. The cell will be bare. You will NOT smoke. Reading material will be basic and approved. NO phone calls. The coddling of criminals has not worked. Blaming the victims has not worked. Let's go back to the basics and make it federal law so it does not matter what state you commit the crime in the law reads the same.
Let us make our lawmakers work instead of campaign their whole career. Set some work standards for politicians or vote them out. We need to clean us the USA starting with child molesters and murderers.
How's the law work these days, you kill a child bury it until it's so decomposed authorities are unable to conclude how the child died so there are no charges brought against the parents? Autopsy. Confused, autopsies can bring to light many facts. Though it was just a fictional citcom, the show Quincey, was a prime example. The forensic science works wonders to nail criminals, or exonerate an innocent person.

Police work investigating this childs death and secret burial is not a Pathologist pin point cause of death. There are many stages in the law channels their investigation have to crawl through before arresting, then the trial is the main events, to prove if a crime was committed...
The the question then would be ask if they will let them walk? If they move the two eldest children the investigation are in full swing, and these may or may not know something that happen so long ago especially whil'st they were asleep at night. It will be a miracle.
This is really sad, how can a mother bury her child and just move on with life like nothing was wrong, and where were the grandparents and Aunts and Uncles, if this child's should have been 3 yrs old and the body was of a 17 month old then there was at least a yr and a half that this little boys was missing that someone should have reported. Unless there is some kind of explanation about why the mother never reported the child's death that might sound plausible (which I doubt) I think that these people both need to just be shown the same death as that little boy did. This is getting to be enough. Mothers and Fathers should not be killing their children, I don't care what excuse they come up with. If they can take the time to lay down to get pregnant then they need to deal with the after math of their actions. We really need to stop the violence that we are doing to our children, and by this showing them how they can inflect violence on others.

You can still get useful information from an autopsy after this long, though obviously not as much as if they could have done it right away.
There might not be enough to prove foul play, however. I'm sure the parents will claim an accidental death, panicking that the police might get the wrong idea, etc. You know the story.
I think it's a crime to not report a death. And to dispose of a body incorrectly. If they can't get witnesses or a confession of anything else, that might be it.
My thoughts exactly- NO ONE noticed this child missing? Do they not have neighbors, relatives, friends? Or did they have a web of lies concocted about the child moving to someone else's or something? SOMEONE had to miss this baby.
That is a real short time period especially since the child was only 17 months old NOW. So he apparently died when he was just a small baby MONTHS old. Yes real suspicious. Why did no one ever report this child missing? They should ask the children. They'll know what happened to the youngest member of the family.
This is the reason the father abducted the nine year old boy when he found out there was an investigation. A seven year old has a really good memory, especially when his baby brother disappears. He is a witness and the father needed to get him away and scare him from telling what he knows.

A lot of people, probably most, won't agree w/me, but I believe the law should use any means to get to the truth of a crime, short of torture, to include polygraph, hynosis, and various truth serums. Too many criminals walk free while the victim is screwed over!!! Just saying is all!
olsoldier, polygraphs do not work. That is why they are not admissible. Guilty people have bee know to pass them. That is why I would never take one.
It is amazing how a "good mother" can change when they get hooked up with a new boyfriend. You question why the boyfriend would kidnap his child when the investigation started. I have seen so many problems occur when the boyfriend does not like the child or has problems dealing with a crying toddler. Seems like so may single mothers think that the boyfriend is more important than her children.
As a man, I can assure you we degrade equally when hooking up with the opposite sex. Obviously this man had been pushed to the point of kidnapping his own child.

The 2 older children were his "natural" children, meaning she had to have been sleeping with another man to get pregnant with the youngest that was found buried in the yard.
Besides, the boyfriend's children are the two older ones. The youngest was not his. He was together with the mother, then they were apart and she had a baby by another man, now the original boyfriend is back in the picture and suddenly the other man's baby dies. For this child to die under mysterious circumstances and not be reported certainly makes one look more suspiciously at the boyfriend. However, if he did do it, the mother would have been involved in that she didn't report the death and cooperated in covering it up and burying him in the back yard.
john B-463946. The guts finger is pointing either way in this puzzle. There's no "SID" here if an accident here these two adults knows the missing answer. The burial in the back yard proved a hush up in a homecide crime which could happen in the wee hours of the night avoiding witnesses.
These parents should be held accountable, another turn in this scene why was the father dissappear with the eldest child for secret reason? the law have all right to remove the remaining children and arrest the parents as bates for uncovering this zigzag puzzle of a suspected hush up crime.

On the surface, it could be anything from an accidental death and the mother freaked out to cold-blooded murder and trying to hide it. More investigation needs to be done before charging or jailing anyone.

Yeah she's a great mother except the part of having her child buried in the back yard after the boyfriend no doubt killed him. Jerks. The step father most likely killed the kid. It's almost always a step parent that does not like the kids and wants them gone. If the the step parent doesn't like the kids then the mother should protect them and get the step father out of the house. This happens way too often.

What are the odds that this poor child was killed by one of the parents? Probably about 95%. HOWEVER, thus far all they have is a body buried in the yard... if the baby died naturally and these folks CHOSE to bury him in the yard, I believe they are legally permitted to do it.

dbth - so why didn't they just tell a doctor? Surely a doctor would be able to say - yes he died of natural causes. (Oh yeah - from this little froggy: this poor child had to be MONTHS old when he disappeared (read: killed). He could not have even been walking that is if he REALLY died in 2010.
DB is right that so far there is a body and they are investigating. Illegally burying someone you didn't kill isn't the same as killing someone, so how about we let them do their job and see what apparently happened before we assume things.
Texas, it said in the article that he was 17 months old when he went missing and would be three years old now. What are you talking about? I would think he was most likely walking since it's not the norm for toddlers that age not to be able to walk.
It is illegal to dispose of human remains on your own. Each state might vary a little, but you can't do it. I think its even illegal to bury your pets in most places.
